INSTRUCTIONS TO BIDDERS
The Bidder should study all the tender documents carefully and understand the conditions,
drawings, and specifications etc. before quoting. If there are any doubts, he should obtain
clarifications but this shall not be justification for late submission or extension of opening
date/time of the tenders.
The Bidder should visit the site to understand the Scope of work and to acquaint himself with site
conditions, availability of water, electricity, approach roads, construction materials as per
specifications, shelter for his staff etc. since these are to be provided/arranged by the Bidder
(unless otherwise specified) at his cost.
The rates should be quoted in the same units as mentioned in the tender schedule.
Every page of the tender documents shall be signed by the Bidder or his authorized
representatives.
The Bidder must read carefully all the General Terms and Conditions of Contract as mentioned in
Annexure-II before filling up the tender schedule and his financial bid. The bidders who are
confident of executing the contract in time by employing the required resources, manpower and
materials need only participate in this tender.
In respect of the matters pertaining to this contract, bidder shall not directly or indirectly bring or
attempt to bring any political or outside influences or intervention through any association, union
or organization. All disputes, differences, clarifications etc. arising out of this contract will be
represented by bidder himself or by his legal representative.
The Bidder shall be bound by all General Terms and Conditions of Contract, as uploaded in with
this e-tender document.
Conditional bid shall not be considered and will be rejected outright.
If any firm quotes “Nil” charges / consideration, the bid shall be treated as unresponsive and will
not be considered. Amount should be adequate to meet statutory deductions towards TDS and
such other levies laid by Government. In case of the quoted service charge is less than such
statutory deductions, then the bid will be summarily rejected.
It may be noted that the tender notice is only for fixing a contract and shall not be construed as
invitation to bid for providing the job i.e. there is no guarantee for award of work without
assigning any reason whatsoever may be.
Any bidder participating in this tender should make sure that he/she will be able to carry out the
work in the contract.
It is implied that the bidder has obtained all necessary information directly or indirectly affecting
the contract such as legal stipulation, possible delays and hindrance or interference in executing
the contract and has satisfied him/her before making the offer. Unexpected difficulties or
expenses shall NOT be considered excuses for difficulties in performing the contract. The rate
quoted should take all factors into consideration.
The bidder acknowledges that he/she assumes all risks contingent upon the nature of the
contract to be actually encountered by him in executing the contract, even though such actual
conditions may result in the bidder performing more or less work than that originally anticipated.
The bidders who are confident of executing the contract in time by employing the required
resources, manpower and materials should only participate in this tender offer.
The tender schedule shall be read in conjunction with General Terms and Conditions of Contract
and any other additional conditions. The bidder shall be deemed to have carefully examined all

these documents. It is further understood and agreed that the bidder by careful examination
satisfied him with the terms and conditions of the tender document.
The quantities indicated in tender may increase or decrease in each category depending on the
future office requirement.
The tender shall contain the name, address of residence and place of business of bidder and shall
be signed by the bidder with his usual signature. Partnership firms shall furnish full names and
addresses. In case of the partnership firm, Self-Attested true copy of the partnership deed must
be submitted along with the tender. Similarly in case of company the Self Attested copy of
Memorandum of Article & Association.
Corrections, if any, in the technical bid of application must be counter signed by the person
authorized to sign the tender bids.
GOVERNING LAWS: The laws of Union of India shall govern all matters concerning the tender. Any
issue arising related to the tender or the selection process shall be adjudged by the courts in
The bidder shall bear all costs associated with the preparation and submission of the bid and
BPCL will in no case be responsible or liable for these costs, regardless of the conduct or outcome
of the bidding process.
BPCL is not responsible for any delays from bidder end.
BPCL reserves the right to make any changes in terms and conditions of tender before due date
of bid submission and to reject any or all bids received incomplete. BPCL reserves the right to
change the quantity tendered.
BPCL reserves their right to negotiate the quoted prices with lowest bidder.
Online submission of the tender shall be considered as token of having read, understood and
totally accepted all the terms and conditions.
The bidder is expected to examine all instructions, forms, attachments, terms and specifications in
the tender document. The entire tender document together with all its attachments thereto, shall
be considered to be read, understood and accepted by the bidder, unless deviations are
specifically stated seriatim by the bidder. Failure to furnish all information required in the tender
document or submission of a bid not substantially responsive to the tender documents in every
respect will be at bidder's risk and may result in the rejection of his bid.
Bidders in their own interest shall ensure that they submit their e-bid, complete in all respects,
well within the specified bid due date and time. No relaxation shall be given for delay due to any
unforeseen event in submission of bid.
The bid prepared by the Bidder and all correspondence/ drawings and documents relating to the
bid exchanged by Bidder and the Owner shall be written in ENGLISH language, provide that any
printed literature furnished by the Bidder may be written in another language so long as
accompanied by an ENGLISH translation, in which case, for the purpose of interpretation of the
bid, the ENGLISH translation shall govern.
Declaration with the bid qualification criteria that bidder has not been banned or delisted by any
Government or quasi Government agencies or Public Sector Undertaking (PSU) as per declaration
format (provided as attachment under declaration format) of the tender document should be
downloaded & then suitably filled, signed, stamped & uploaded against relevant heading.
Bidders are advised to submit bids based strictly on the terms & conditions and specifications
contained in the tender document and not to stipulate any deviations. Each Bidder shall submit
only one bid. A Bidder who submits more than one bid will be rejected.
BPCL may, at its discretion, extend the bid due date, in which case all rights and obligations of the
BPCL and the Bidders, previously subject to the bid due date, shall thereafter be subject to the
new bid due date as extended.

Telex/Telefax/ E-mail/postal offers will not be considered and shall be rejected.
No bid shall be modified subsequent to the due date & time or extension, if any, for submission
of bids. Bidder(s) to note that Price changes after submission of bid shall not be allowed. In case
any bidder gives revised prices/price implication, his bid shall be rejected. No bid shall be allowed
to be withdrawn in the interval between the deadline for submission of bids and the expiration of
the period of bid validity specified by the Bidder. Withdrawal of a bid during this interval shall
result in the forfeiture of Bidder's EMD. No reduction in prices quoted by bidder shall be
permitted after opening of the bid. If any bidder unilaterally reduces the prices quoted by him in
his bid after opening of bids, the bid (s) of such bidder(s) will be liable to be rejected. Such
reduction shall not be considered for evaluation of prices but shall be binding on the bidder in
case he/she happens to be a successful bidder for award of work.
Bids that do not meet the Bid qualification criteria as specified in the bid document shall be
rejected. A bid with incomplete scope of work and/or which does not meet the technical
requirements as specified in the bid document, shall be considered as non-responsive and
rejected. Conditional bids will be liable for rejection.
The Owner will examine the bids to determine whether they are complete, whether any
computational errors have been made, whether the documents have been properly signed and
whether the bids are generally in order.
The experience details and financial & technical capabilities of the Bidder(s) shall be examined to
determine whether the Bidder(s) offer meets the Bid Qualification criteria mentioned. To assist in
the examination, evaluation and comparison of Un-priced bids, the Owner may, at its discretion,
ask the Bidder clarifications on the bid. The request for such clarifications and the response
thereto shall be in writing. Prior to the evaluation and comparison of the bid, the Owner will
determine the substantial responsiveness of each bid to the bidding documents.
Prior to the expiration of period of bid validity, the Owner will notify the successful Bidder in
writing or by email, that his bid has been accepted. The Notification of Award will constitute the
formation of the Contract. Delivery Period shall be counted from the date of notification of award
(Letter/Fax/e-mail of Intent).
Any efforts by a Bidder to influence the Owner/ in the Owner bid evaluation, bid comparison or
contract award decisions may result in the rejection of their bid.
VERIFICATION BY OWNER: All statements submitted by Bidder regarding experience, manpower
availability, equipment and machinery availability etc., are subject to verification by the Owner
either before placement of order or after placement of order. If any data submitted by the Bidder
at the bid stage is found to be incorrect, the offer is liable to be rejected or the Contract/order is
liable to be terminated.
The relevant WCT/TDS if & as applicable will be deducted from the charges quoted by the
successful bidder.
It is for the Bidder to assess and ascertain the Tax rate applicable on quoted items. It is clearly
understood that Owner will not have any additional liability towards payment of tax/duty/cess
which is based on Bidder's wrong assessment/interpretation of applicability of such tax/duty/cess.
For Services such as installation, commissioning activities, bidder’s quoted prices shall be inclusive
of taxes applicable till complete execution of the order/contract and Owner shall not have any
liabilities, whatsoever on this account. Variation, for any reason including, Statutory levies will be
vendor’s account. Bidder shall quote rate of Tax on the quoted charges. Bidder shall ensure that
invoice(s) shows the tax component separately and is issued in accordance with the applicable Tax
Rules. Octroi /Entry tax, if applicable in India shall be directly paid by the vendor, which shall be
reimbursed by Owner at actuals on submission of documentary proof. BPCL shall not be liable, in
case the tax authorities assess the tax elements in a different way on account of any reason,

whatsoever. Taxes and duties other than those specified in this document, if any, shall be included
in the quoted prices and no reimbursement shall be made by BPCL. Owner’s liability with respect
to taxes and duties will be restricted to the Tax as quoted by the bidder. Any new or additional
taxes or duties levied by statutory authorities during contract shall be borne by the bidder.
ISSUE OF CONTRACT/ PURCHASE ORDER: After the successful Bidder has been notified that his
bid has been accepted, the Owner will send to such Bidder a detailed contract/Purchase Order/s
incorporating all the terms and conditions agreed between the parties. Within 7 days of receipt of
the detailed contract/ Purchase Order, the Bidder shall sign and return to the Owner the duplicate
copy of the contract/order as a token of their Acknowledgement. The purchase orders will be
issued by respective locations BPCL as mentioned in clause
The value contract will be placed to the L1 bidder as per tender. In case of multiple L1 bidder,
BPCL reserves the right to reallocate the tender value amongst the L1 bidders as per site
Grievance Redressal Mechanism: Bharat Petroleum Corporation Limited (BPCL) has developed the
Grievance Redressal Mechanism to deal with references/ grievances, if any, that is received from
bidders who participated / intends to participate in the Corporation tender. The details of the
same are available on our website www.bharatpetroleum.in.
It shall be understood that every endeavor has been made to avoid errors which can materially
affect the basis of the tender and the successful vendor shall take upon himself and provide for
risk of any error which may subsequently be discovered and shall make no subsequent claim on
account thereof.
In case a Start-up is interested in supplying a tendered item but does not meet the Bid-
Qualification Criteria(BQC)/Proven Track Record (PTR) of prior Turnover norm as indicated in the
tender document, the Start-up may be requested to write a detailed proposal separately and not
against the present tender requirement, to the tender issuing authority about its product. Such
proposal should be accompanied by relevant documents in support of Start-ups as under:
a. Certificate of Recognition issued by Department of Industrial Policy and Promotion
(DIPP), Ministry of Commerce and Industry, GOI.
b. Certificate of Incorporation/ Registration.
c. Audited P&L Statement of all the financial years since incorporation.
d. In case where balance sheet has not been prepared, bidder shall submit a certificate in
Original from its CEO/CFO stating the turnover of the bidding entity separately for each
Financial Year Since incorporation along with declaration stating the reason for not
furnishing the audited P&L statement. The Certificate shall be endorsed by Chartered
Accountant/ Statutory Auditor.
By submitting the bid, the bidder undertakes as under:
I/we hereby undertake that the statements made herein/information given in the bids through e-
tendering system/annexures/forms/uploaded documents referred are true in all respects and that
in the event of any such statement or information being found to be incorrect in any particular,
the same may be construed to be a misrepresentation entitling BPCL to avoid any resultant
I/we further undertake as and when called upon by BPCL to produce, for its inspection, original(s)
of the document(s) of which copies have been annexed hereto.

The rates quoted should be inclusive of all materials, labour, water, electricity, power equipment,
tools/tackles, catering, shoring, lifts, leads, scaffolding, excise/customs/octroi duties, sales tax etc.
All materials are to be supplied by the bidder unless otherwise stated.
The rates quoted shall be valid for a period of four months. Once the quotation is accepted, the
rates quoted shall be firm till the entire work is completed in all respects.
3. ACCEPTANCE OF TENDER
Incomplete/conditional tender quotations or those received late and/or not conforming to the
Terms and conditions in the tender documents, will be rejected.
The Company reserves the right to reject any or every tender without assigning any reasons
whatsoever and/or to negotiate with the bidder’s in the manner the Company considers suitable.
The manpower engaged by the successful bidder for providing the services as per the scope of
work will remain under the ultimate superintendence and control of the successful bidder. The
quality of service being provided by the successful bidder will be reviewed by the authorized
representative of the corporation, but this will not detract successful bidder’s full responsibility for
quality/period of execution of work.
The successful bidder shall not undertake on his own any change in specifications mentioned in
the tender documents. In case of doubt he will refer the matter in writing to the Corporation and
act as per clarifications given by the Corporation. Any changes in the work involving changes in
original specification quantities/additional items of work should be covered by obtaining suitable
variation order(s) from the Corporation immediately.
If the performance of the successful bidder is found to be unsatisfactory, the corporation reserves
the right to cancel / terminate in part or the whole of the contract and get the work executed
through alternative means at the entire risk and cost of the successful bidder.
The work in the Corporation’s premises should be carried out during the Corporation’s normal
working hours and without obstructing day-to-day work of the corporation.
It will be the liability of the agency to pay all the necessary taxes, salaries, wages, or other
statutory requirements for which corporation will not make any additional payments. On demand,
the successful bidder should be able to show all such records to the authorized representative of
the corporation.
The successful bidder shall be fully responsible to ensure proper behavior by staff engaged and
deployed by him in the corporation’s premises.
4. EXECUTION OF WORKS
The entire work will be carried out under the supervision of the authorized representative of the
company, but this will not detract successful bidders full responsibility for quality/period of
execution of work.
The successful bidder shall not undertake on his own any change in specifications mentioned in
the tender documents. In case of doubt he will refer the matter in writing to the Company and act
as per clarifications given by the Company. Any changes in the work involving changes in original
specification quantities/additional items of work should be covered by obtaining suitable
variation order(s) from the Company immediately.

If the performance of the successful bidder is found to be unsatisfactory, the company reserves
the right to cancel in part or the whole of the contract and gets the work executed through
alternative means at the entire risk and cost of the successful bidder.
The successful bidder should ensure the safety of adjoining property and shall make good any
loss to product/property resulting from his negligence.
The work in the Company’s premises should be carried out during the Company’s normal working
hours and without obstructing day-to-day work in the establishment. If any work is required to be
carried out beyond normal working hours, prior permission should be obtained before
undertaking such work.
In the event of the successful bidder failing to complete the work within the stipulated time, the
Company shall have the right to employ any other agency to complete the remaining work at the
risk and cost of the successful bidder.
If the work is required to be carried out in a working Installation. The progress of work is likely to
be interrupted on account of operations in such units. Stoppage of work under such
circumstances shall not entitle the successful bidder to claim any compensation for idling of
labour, machinery etc. during such interruptions.
The successful bidder and his men shall abide by all security/safety rules/regulations in force at a
location and the laws, bylaws and statutes of Govt. Semi-govt. and other local authorities such as
requirement/liabilities under enactments like the Workmen’s Compensation Act, Contract Labour
(R&A) Act, Provident Fund and Miscellaneous Benefits Act, 1972, etc and the Company shall stand
indemnified against any claims on these scores. The successful bidder and his men shall strictly
abide by “no smoking” and other petroleum regulations on the premises.
5. FINAL BILLS/RETENTION MONEY
The successful bidder shall not sublet or assign any part of the work to another party without the
prior written consent of the company. In any event the successful bidder will be solely responsible
for the work so sublet or assigned.
“The contractor undertakes to ensure due and complete compliance with all laws, regulations,
rules etc. whether of the Central Govt. or the State govt. or of any other competent authority
applicable to the workmen employed or whose services are otherwise availed of by the
Contractor whether in connection with the construction work at the site or otherwise.
The employer shall have the right to inspect the records maintained by the Contractor concerning
such workmen from time to time and the Contractor shall whenever required by the Employer
produce such records as the Employer may call upon the Contractor to produce for the
employer’s inspection in order to ascertain whether or not the requirements of all such laws,
regulations, rules etc. have been complied with by the Contractor. In the event of any
contravention of such laws, regulations, rules, etc coming to light whether as a result of such
inspection or otherwise the Employer shall have the right to require the Contractor to effect such
compliance within such time as the Employer may prescribe in that behalf and in the event of the
Contractor failing to effect such compliance within the time prescribed by the Employer then the
Employer shall without prejudice to his rights be entitled to withhold from the amount payable
to the Contractor any amount pay able to the workmen under any such laws, regulations or rules
and to make payment thereof to the workmen. The employer shall also have in that event the
right to terminate the contract with immediate effect and to exercise powers reserved to the
Employer under the contract as a result of termination.”

6. CANCELLATION / TERMINATION OF CONTRACT
If at any time during the period of the contract, it is observed by the Corporation or by an
authorized representative(s) that the services rendered by the agency / its contract labour(s) are
not to the satisfaction of the Corporation or any terms of the contract are violated, the
Corporation reserves the right to summarily terminate the contract without any notice or
compensation thereof. No running bill shall be accepted.
The Corporation reserves right to terminate the contract by giving one month’s notice in writing
without assigning any reason whatsoever. For all disputes relating to this contract, Arbitration
clause as enclosed will be applicable.
7. OTHER PROVISIONS
The agency shall co-operate and produce all required records, documents, formats and register
during any inspection / audit by any internal or external agency as and when advised by the
Periodic review will be done by location in charge/ engineering officer of the corporation. If any
lapses are found with respect to the quality of work, deviation from work processes, any offences,
safety deviations, and statutory deviations etc., the corporation reserves its rights to levy penalty
at appropriate rate. Any losses or pending payments required to be made by the agency shall be
recovered from payments due to the agency or adjusted against the bank guarantee.
The agency and his labour shall abide by all security/safety rules/regulations in force at the
premises of the corporation.
The agency should follow the safety rules as directed by engineering officer/location in/charge. In
case any lapse is observed in adhering to safety regulations while carrying out the work, penalty
will be levied per lapse observed at any time on discretion of location in/charge.
The corporation will have no liability whatsoever concerning the contract labour deployed by the
Agency for the purpose of this Contract. The Agency shall keep the corporation indemnified
against all losses or damages or liabilities arising out of or imposed in the course of contract or
afterwards for the labour deployed by him.
The Agency shall be entirely responsible to ensure that no unlawful act is done by its contract
labour(s) while on duty. In case of loss of the Corporation’s property due to negligence or
carelessness of the contract labour(s) deployed by the agency, the Agency will be responsible and
shall make good the same. In case the Agency defaults in making good the losses, the
Corporation shall have right to deduct the said amounts from payables to the agency or make
any adjustments from the bank guarantee.
The Agency shall keep the corporation indemnified against all losses or damages or penalties,
claims and liabilities of every kind for any violation of such Acts, Laws, Rules or Regulations by
him/her, his/her agent or his/her staff. Any change by the Govt. or any such appropriate authority
in any applicable Act, Laws, Rules, and Regulations shall become immediately applicable to the
The Agency shall be responsible for payment of any compensation / settlement of any liability
arising out of any death or injury caused to the persons employed by him for rendering the jobs
on contract under the agreement, either under the Employee Compensation Act, 1923 or any
other act in force at that time.
The agency or any contract labour deployed by the agency shall not claim any employment for
self or other in the corporation under any circumstances on any later date whatsoever.
The Agency shall be solely responsible for settling/resolving any dispute/claim of his/her labour
during the pendency of the Contract. No liability shall accrue to the corporation under any

circumstances even after expiry of the contract. The agency shall indemnify the corporation
against all actions, suits, claims & demands brought or made against it in respect of anything
done or committed to be done by the agency in execution of or in connection with the work of
this contract and against any loss or damage to the corporation in consequence of any action or
suit being brought against the agency for anything done or committed to be done by the agency
in execution of or in connection with the work of this contract.
In case the agency fails to perform the job mentioned in the scope of work, the Corporation
reserves the right to make alternate arrangements to perform the same and the loss/damage
incurred, if any, by the Corporation on account of the same shall be deducted from the amount
payable to Agency by the Corporation.
The agency shall understand and implement any technological up-gradation and process change
implemented by the corporation within its premises. The agency shall ensure that the contract
labour (s) deployed by the agency are capable of working / are upgraded for working on any such
new technology introduced by the corporation.
Contract labor provided by the agency whose work or conduct is found unsatisfactory by the
Corporation, shall be replaced by the agency immediately.
The contractor shall supervise the jobs and visit the work area in person at frequent intervals and
ensure it is always up to the mark.
There will not exist any employer-employee relationship with Bharat Petroleum Corporation
In case of any additional financial burden on the contractor arising out of revisions in minimum
wages or due to any other labor enactment during the pendency of the contractor, the same will
be borne by the contractor.
Arbitration: The jurisdiction of arbitration will be Mumbai and the Arbitrator shall be
Director Marketing of the Corporation or some other officer of the Corporation who may
be nominated by the Director (Marketing).
Statutory Deductions: All statutory deductions like Income Tax, ESIC, Works Contract Tax,
Service tax (CE) etc. as applicable or any other deductions as per the State / Central Government
rules will be deducted at source from each bill of the contractor.
Failure by the contractor to comply with the Co’s instructions: If the contractor after receipt of
written notice from the Co. requiring compliance within ten days fails to comply with such
instructions / specifications, the Corporation reserves the right to employ and pay other persons
to execute any such work whatsoever may be necessary to give effect thereto. All costs incurred in
connection therewith shall be recoverable from the contractor by the Corporation on the
certificate of Depot In charge and may be deducted from the money due or to become due to the
contractor or recover the money if any in excess from the contractor.
The successful bidder is required to submit an Indemnity bond on Rs.300/- non judicial
stamp paper before execution of the job. The format of Indemnity bond is enclosed here
In case of any dispute, the decision of Ops I/c, Bakania Depot shall be final & binding.
8. CLARIFICATION OF BID DOCUMENTS
Bidders requiring any clarification on the Bid Documents shall notify office of Ch. Mgr. ops. I/c,
Bakania Depot by email to Officers mailing address indicated in the invitation of Bid. The office
shall respond by email /in writing to any request for the clarification of the Bid Documents which
he receives not later than 7 days prior to the date of opening the Tenders. Copies of the

clarification sought for by the bidders and Clarifications by BPCL shall be sent to all the
prospective bidders who have received the bid documents.

The clarifications made as above shall form part of the Bid document and will be treated as
amendment to the Bid document. These clarifications will also be made available in the website
and bidders who have down loaded Bid document from internet are to submit the bid document
accordingly after taking into account all the clarifications Issued.
10. AMENDMENT OF BID DOCUMENTS
At any time prior to the date of opening of bids, BPCL may, for any reason, whether on its own
initiative or in response to any clarification received from a bidder, shall modify bid documents by
amendments and the same will be uploaded on the portal and these amendments will be binding
In order to afford prospective bidders a reasonable time to take the amendment into account in
preparing their bids, the BPCL may, at its discretion, shall extend the deadline for the submission
of bids suitably. Any amendment to the Bid document shall also be uploaded in the web site as
and when it is made.
Bidders who download the Bid document through internet are to take care of these amendments
while submitting their bids.
11. DOCUMENTS ESTABLISHING BIDDER’S ELIGIBILITY AND QUALIFICATION
The bidder shall submit following documents along with the tender document. Any bidder
submitting bid without these documents specified below, shall be liable to be summarily rejected.
Bidder’s profile duly filled as per section II.
Bidder must be a firm/ company that should be registered with appropriate authorities and Self
Attested copy of registration may be attached.
Bidder must have GST registration number issued by competent authority. Bidder must have
PAN/TAN/GIR card. (Self-attested copy to be attached)
Bidder should have EPF / ESI registration with competent authority. (Self-attested copy to be
Self-Attested Copy of experience certificate of at least one year (in part or full) Experience.
Bidder should submit last three consecutive year income tax return certificate alongwith audited
Balance sheet and Profit Loss statement.
Declaration of “No near relative” of the bidder firm/company is working/employed in Bharat
Petroleum Corporation Ltd, to be submitted.
Declaration of “BLACKLISTING / DEBARRING “of bidder firm/company to be submitted.
Self Attested copy of Partnership Deed or affidavit in original regarding sole proprietorship
incase of proprietorship firm/ Memorandum of Association / Articles as applicable.
All the tender document pages should be stamped and signed.
Authorization letter from appropriate authority of the firm/company in case person other than the
bidder has signed the tender documents.

The successful bidder has to produce all the relevant original documents as and when directed.
The documents submitted by the successful bidder may be verified from sources.
12. PERIOD OF VALIDITY OF BID
The tender submitted by bidder will remain valid for acceptance for a period of 90 days from the
date of opening of the tender. Bidder shall not be entitled during this period of 90 days, without
the consent in writing of BPCL to revoke or cancel his tender or to vary the tender submitted or in
terms thereof. BPCL shall communicate the acceptance of tender to the successful bidder(s). Due
to administrative reasons, extension of the time period, if requested by BPCL in writing, the bidder
shall accede to such request for extension and communicate his acceptance to BPCL in writing.
13. SUBMISSION OF BIDS
The bid along with the necessary documents should be uploaded in the bpcltenders.eproc.in portal as per
the guidelines mentioned.
14. BID OPENING
Bid opening and finalization will be according to e-procurement procedures.
Bidder’s name, bid price, modifications, withdrawals and such other detail, as deemed fit by the
authorized authority will be notified. The price bid shall be evaluated only for technically qualified
bidders. (Bidder who fulfills all Eligibility Criteria and requirements as per this document.)
15. EARNEST MONEY DEPOSIT
(Applicable only for works costing Rs.500000/- and above in value. However in case of parties
registered within the Corporation, EMD may not be insisted upon).
Bidder shall be required to submit the Earnest Money Deposit (EMD) for a sum equivalent to 5%
of the total tendered value of works, subject to a maximum of Rs. 100000/-, if applicable in
physical form by the way of demand draft or bank guarantee drawn on any Nationalized or
scheduled bank in favor of M/s Bharat Petroleum Corporation Ltd. and payable at Bhopal (M.P.) at
our office in a sealed cover addressed to Ch. Manager Ops I/c, Bakania Depot with following
boldly super-scribed on the outer cover:

II. Name of the bidder
It should be sent by Registered Post/Courier to the following address so as to reach before the
due date & time of the tender. BPCL will not be responsible for non-receipt of instrument(s) due
to postal delay/loss in transit etc. for any reason what-so-ever. Bid received without the EMD if
applicable is liable to be rejected. A photocopy of the instrument of EMD to be duly signed &
stamped and uploaded against relevant heading in tender.
The Bid Security/EMD is required to protect the Owner against the risk of Bidder’s conduct,
which would warrant the security forfeiture.

The bids without requisite EMD will not be considered and bids of such bidder Bidder(s) shall be
rejected. The bidders not submitting EMD by due time & date shall be rejected & their bids shall
not be evaluated further.
Firms registered with National Small Scale Industries Corporation (NSIC)/ Ministry of MSME of
India for the item in tender are exempted from submission of Bid Security/EMD.
All bidders quoting as MSE, should submit a CA certificate issued by a CA on his letter head
along with MSE doc. (UAM/EMII/NSIC) to avail the benefits of Public Procurement Policy as per
MSMED Act 2006/Public Procurement Policy Order 2012. In case CA certificate is not submitted,
bid of the vendor shall be rejected at EMD stage.
Please note the below further points with respect to same:
Bidder shall have to upload scanned copy of CA certificate with stamp of TPIA mentioning as
verified from original. Thereupon, L1 bidder/s shall submit the hard copy of CA certificate
certified by TPIA to BPCL within 7 days of opening of price bid.
The CA certificate should be dated after the date of floating of tender and shall be specific to the
tender for which bid is being submitted.
Format of the CA certificate is attached for reference and bidder needs to submit certificate
strictly in this format, else bid shall be rejected.
Bidders are advised to instruct their banks not to post EMD directly to Owner as the same has to
be submitted to us before e-bid submission due time & date.
The Bid Security/EMD may be forfeited:
i. If a Bidder withdraws/alters his bid during the period of bid validity or
ii. In the case of a successful Bidder, if the Bidder fails or refuses to accept the
contract/Purchase Order in accordance with agreed terms and conditions or
iii. If a Bidder changes the proposed manufacturer after submission of Bid.
EMD by way of DD or Bank Guarantee shall be submitted by all bidders (including Bidders
registered with BPCL). Exemption for this would be in line with govt. policy for MSE/NSIC
Interest shall NOT be payable on the Earnest Money deposit.
The Earnest Money of the successful bidder will be adjusted towards security deposit and of the
unsuccessful bidder will be refunded without interest within reasonable time after final decision
of the tender, normally within six months from the date of opening of tenders.
The EMD of the successful bidder will be retained as Security Deposit till the completion of
contract. The Corporation reserves its rights to adjust the security deposit fully or in part in lieu
of unpaid dues payable to the Corporation by the Agency or unpaid dues towards any statutory
compliance or amounts payable by the Agency to any of its contract labour(s) for the period of
their engagement at the premises of the corporation.
Successful bidder (hereinafter referred to as “The Agency”) has to submit Bank guarantee from
Nationalised / Scheduled banks equal to 10% of the total contract value including GST within
days of placement of LOI/PO in the prescribed format.

The bank guarantee should be valid till 1 year + claim period of minimum six months from the
start of contract.
In case of pendency of any dispute related to such non-payment / less payment of wages or
non-compliance of statutory obligations by the Agency which may possibly result into financial
liabilities for the Corporation, the Corporation reserves its right to withhold the amount payable
to the Agency or such security deposit. The said security amount shall be refunded to the
Agency subject to production of proof of compliance of all statutory provisions and a certificate
of No Objection from the concerned Labour Authorities.
16. PURCHASE PREFERENCE CLAUSE
Owner reserves its right to allow Public Sector Enterprises (Central/State), purchase preference
as admissible/applicable from time to time under the existing Govt. policy. Purchase preference
to a PSE shall be decided based on the price quoted by PSE as compared to L1 Vendor at the
time of evaluation of the price bid.
Owner reserves its right to allow Micro and Small Enterprises (MSEs) and MSEs owned by
Scheduled Caste (SC) or the Scheduled tribe (ST) entrepreneurs, purchase preference as
admissible/applicable from time to time under the existing Govt. policy. Purchase preference to
a MSE and a MSE owned by SC/ST entrepreneurs shall be decided based on the price quoted by
the said MSEs as compared to L1 Vendor at the time of evaluation of the price bid.

Any personnel entering the area shall wear all PPE's (provided by the party themselves) and will be
allowed only after clearance from BPCL authorities. Necessary insurance (Group Insurance of
Lakhs to be submitted) has to be provided by the party. No extra costs shall be paid on any other
