Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.
Contractor shall be solely responsible for safe running of the plant. Railway will not be responsible for any loss, damage or accident or any compensation thereafter arising out of it and claimed by anyone
In case of any accident, total responsibility lies with contractor and his staff/representative. Railway will not bear any responsibility.
The entire cost of Railway materials lost by the contractor or damages sustained to the Railway Property, while in the contractor's custody or any amount otherwise will be liable to be recovered from the contractor's bill/security deposit. For this purpose, amount as assessed by the Sr.DME/DSL/DDU on behalf of Railway Administration shall be final and binding on the contractor.
The existing rule of employment of his staff/workers by the contractor either State or Central Government will have to be followed.
The contractor may inspect the site of work and acquaint himself/herself with the site conditions, working hours, lay out details, existing hindrance, if any, in executing the work.
All permissible taxes and surcharges as per existing rule will be deducted from the running bill of the contractor. Railway reserves right to make any other deduction as per statutory.
In the event of any dispute or difference of opinion between the Railway administration and the contractor arising out of this agreement, the Railway should reserve unconditional and absolute right to terminate the contract during its currency without assigning any reason what so ever and the contractor shall not be entitled to any sort of damage on account of any alleged loss of for such premature termination.
The contractor should quote their rate inclusive of all taxes
The contractor will adhere to the existing Labour rules, Workmen compensation Act and payment of minimum wages Act and other labour legislation's.
No passes or concession facilities either for the travel of the Contractor or his employees shall be issued by the Railway.
All notice shall be given by the Railway on behalf of the President of India. All action shall also be taken by the Railway on his behalf.
In the event of termination of the contract, the contractor will have to remove all his materials lying at the site of the work
The Railway reserves the right to make any change in the quantity of the work as and when required or delete any item from the purview of the Agreement as per its requirements. No claim, what so ever, shall be entertained on this account.
The acceptance of the tender will not entitle the contractor for any compensation for the work, which has not been done.
The contractor shall supply identity cards (work permission card) with photographs pasted and attested by the contractor and duly approved/signed by the authorized representative of Sr. DME/DSL/DDU to all labours engaged for the above job. No labour will be allowed in shed premises without possessing valid Identity card. Performa of I-card as per Annexure-E of the tender document.
Police Verification of Labour employed by Contractor. The contractor is required to submit Police Verification certificate for all contractual staff that she/he will be hiring for the instant work. The format for the same is provided with the tender document in the Annexure-F.
Condition on Labour: - Contractors are instructed to adhere to following Law/Conditions. (a)Contract Labour (Regulation and Abolition) Act (CLRA), 1970. Contract Labour (R&A) Rules 1971. (b)Minimum Wages Act (MWA) 1948 & Minimum Wages Rules (MWR), 1950. (c)Employees' Provident Fund and Miscellaneous Provisions Act (EPF and MPA) 1952 and Employees Provident Fund Scheme (EPFS) 1952. (d)Employees' State Insurance Act (ESIA) 1948. (e)Employees' Compensation Act (ECA), 1923. Contractors are also advised to visit https://trial.ireps.gov.in/CLIP/clip.jsp labour payment portalfor payment of their labour.
Mandatory updation to contractor/firm to ensure that the man update/upload labour date in Railway's Shramkalyan portal after receiving of LOA/work order.
Safety Measure: The contractor shall take all precautionary measures in order to ensure the protection of his own personnel moving or working on the railways premises, but shall then confirm to the rules and regulations of the railway. The contractor shall be responsible for safe custody of all equipments till provisional acceptance .Moreover, if any time the works to be carried out directly concern the safety of the trains, the contractor's staff must comply fully with railway's regulations given to him by authorized railway staff. The contractor's employees and workers may for no reason operate an installation concerning train safety or train movement. They shall notify the authorized representative of the purchaser/ consignee who will take all necessary steps in this regard.
Apart from above, these Special conditions of Contract (SCC) shall be read together with the terms and conditions incorporated in this uploaded Tender document no. DLS-MnP- Plg-AMC-ETP-M-26 and the General Conditions of Contract 2022 (GCC April 2022) with all its correction slip issued after GCC 2022 of the Railway. If there should be any conflict between the provisions of the SCC and GCC 2022, the condition of GCC-2022 will prevail upon SCC.
