Terms and conditions

1. Purpose of the Tender:

This tender is to invite bids for empanelment of interested agencies willing to carry out forestry activities

in the listed Rajpipla, Dediyapada, Sorapada, Fulsar Sagai, Piplod, Sagbara Range of Narmada Division.

2. Who can Apply: Any citizen of India preferable residing in Naramda or other district

citizen having valid PAN, GST number(if applicable) PF Number with experience in forestry works

experience certificate issued by RFO, Site visit Certificate regarding the forestry related works issued by

Range Forest Officer agreeing to the mentioned terms and conditions can apply. In case of agency i.e. a

body of more than one person the PAN card of the main executive person is needed. For the purpose of

this tender agency could be an individual also. A person/agency can apply for a bid only in Two Range.

3. Method of selection of agency:

a. Minimum 3 agencies are planned to be empaneled in Range but Based on Successful Bidder the

person/Agency may be increased..

b. The agencies will have to specify at what rate / unit for material and transportation agencies have

to specify per unit , they are willing to carry out works.

c. All empaneled agencies shall give certificate on the duly notarized stamp paper that the wages

paying to laborers will be in accordance with existing minimum wage act .

d. The party quoting least rate will be declared as L1 and will be empaneled provided it fulfils all other

e. If L2 party is willing to work at the L1 rates it will also be empaneled. If it is not willing to work at

L1 rates then it will be passed over and chance will be given to the next lowest bidder. The process will

be repeated till three agencies are selected for range.

f. In case a tie like situation arises where there is no way to choose between the competing agencies

then the number of empanelled agencies would be increased to accommodate all of such tied agencies.

i.Example 1: If at L1 there is a tie of 5 agencies, all of them will be empanelled and no offer would

be made to L2 or L3 agencies.

ii.Example 2: If there is no tie at L1 rates but there is a tie of 4 agencies at L2 rates and all of them

are willing to work at L1 rates, then L1 and all 4 agencies at L1 rates would be empaneled and L-3

will not be called

g. It may be noted that though minimum 3 agencies are to be empaneled but the rates will be the same

i.e. the L1 rates.

h. These empanelled agencies will be at par with each other and the respective Range Forest Officer

will be in its full right to get work done by any one of them Normally only one agency would be given

work at one spot at one time but respective Range Forest Officer can give work to more than one

empanelled agencies at the same spot at same time with permission of Deputy Conservator of Forests.

4. Execution of work:

a. This tender is just for empanelment of the agencies and not a work contract hence mere empanelment

does not guarantee any work. The actual quantity, type and place in the concerned ranges will be informed

by the concerned RFO from time to time.

b. The agency will be asked to execute the work directly by the RFO. The agency will have to execute the

work within the specified time and when it is necessary to make a note in Measurement book, it should

be noted in Measurement book and produce the bill within 7 days of completion of work clearly specifying

the items sanctioned SOR, agreed percentage, quantity etc to the concerned RFO.In case of supply of

material through transport, agencies have to obtain receipt from Forester. Approved SOR, Agency's rate,

work volume, goods/material rate, quantity,receipt of supplying materials must be obtained from forester

and have to submit in RFO's office

5. Payment method: The payment will be released as according to fund availability but since it is

dependent on release of grant, no firm commitment can be given for the same.In case of delay in

Payment to the labours by the agency, the department shall not be responsible for the same.

6. Penal clauses and other conditions:

a. If the agency fails to execute the work timely or qualitatively it can be de-empanelled or and can be

blacklisted and any other agency willing to work at that rate can be empanelled. Time and quality in

execution of the works is very important in forestry works and no compromise under any circumstance

will be tolerated. The decision of the concerned Range Forest Officer regarding quality will be final

provided it is confirmed by the concerned Deputy Conservator of Forests.

b. The agency may be asked to maintain the measurement books, line-wari register etc. which must be

maintained properly by the agency and also get the signatures of the concerned officers as per instructions.

c. Even after payment if any deficiency is found in quality or quantity in the works then also the agency

will be penalized on proportion of defect/damage and may even be de-empanelled by the Deputy

Conservator of Forest.

d. Deputy conservators of forests will have full rights to issue any clarification regarding

the interpretation of any of the terms or conditions in the interest of better execution of work and the same

will be binding on the agency.

e. The empanelled agency will be solely responsible legally and financially to ensure

compliance of any act like minimum wages, ID act ,insurance, transportation, medical, workman

compensation, safety etc. The agency will have to provide all the necessary medical and safety devices on

the work spot . Loss of life, or any damage to human life shall be the solely responsibility of the

empanelled agency.

f. The empanelled agencies shall be responsible for damages inside and outside of the work area.

g. Work to be not subleted. Contract may be rescinded and security deposit forfeited for subletting it

without approval

h. The Agencies shall pay the royalty for soil, stone or other geological materials.

i. The agencies shall be responsible to pay workman compensation under the workmen's compensation

j. No agencies shall employ any person who is under the age of 18 years.

k. The agencies shall have to engage local labour and person seeking employment, where available on

l. The successful agencies will be required to furnish an affidavit duly notarized in the format provided

by the Deputy conservator of forests.

m. The Deputy conservator of forests will have full rights to suspend or even terminate this empanelment

process at any stage through a speaking order by the report received from RFO

n. Empanelled Agencies shall be responsible for paying all taxes/cess respect to the

materials/labours

o. Jurisdiction of Court will be Narmada District.

p. Tenderer Agencies have to sign on each page of Tender Documents

q. Empaneled Agency ought have direct blood relationship to Forest officer / employer or ought

be a part of family and agency have to give a self deduction certification of that failing which

agency will not be empaneled will be blacklisted

Note: Agencies shall mention rate for which they willing to works/provide materials
