TENDER TERMS AND CONDITIONS
[A] Online Preliminary stage (This is mandatory): -

2. If during the tender validity period, i.e. 180 days (from the date of opening of technical bid), the tenderer withdraws his
tender, the EMD shall be forfeited and the tenderer may be disqualified from tendering for further works

Bid Submission:
Bidder has to upload scanned copies of Original (Notarized/Self attested copies of Original-as specified in tender
document) document with bid in online only. Tender documents submitted in physical form will not be accepted and
Bidder has to upload scanned copies of Original documents (in PDF form) remain legible and should not be password
Any deviation found in Data / Details / Documents between online offers (e-tendering).
Further bidders are requested to submit price – bid online only and not to submit the price bid in physical form. This is
mandatory. If price bid is submitted in physical form, same will not be opened and only on-line submitted price will be
considered for evaluation. Further, if the quantity quoted differs in any of the technical bid forms and in price bid forms, it
is discretion of Evaluation Committee – DGVCL to consider the quoted quantity.
It is mandatory for all the bidders to submit their tender documents by both forms wise on-line (e-tendering) in schedule
time. Tender documents submitted in physical form will not be accepted and considered.
The price bid must be submitted strictly as per Schedule-B. The Price bid may be opened as per the specified time and
date of opening of the price bid.

Tender without EMD and tender fee shall be rejected.
DGVCL reserves the rights to reject any OR all tenders without assigning any reasons thereof.
The right to reject/accept and or split up of tender is reserved by the undersigned without giving any reason thereof.
No tender should be accepted/opened in any case after due date of time and receipt of tender.

8 The average annual turnover during last 3 years, ending 31st March of the previous
financial year of the applicant should be at least 30% of the estimated cost ( i.e 2024-
25,2023-24,2022-23,). Contractor should produce the Audited Balance sheet with profit
and loss account of last 3 Years ( i.e 2024-25,2023-22,2022-23).
9 Contractor should produce evidence of experience of having successfully completed
similar works(i.e. similar works means waterproofing) during the last Seven years
ending last day of month previous to the one in which applications are invited should be
either of the following in Govt., /Semi Govt., along with certified copies of documentary
evidence, preferably photo copy of orders secured from
DGVCL/MGVCL/UGVCL/PGVCL/GSECL/GETCO/DISCOMs/GEB/Central/State
Government/Semi-Government and satisfactory completion certificate from respective
department thereof:-
a) Three similar completed works costing not less than the amount equal to 40% of the
estimated cost.
b) Two similar completed works costing not less than the amount equal to 50% of the
estimated cost.
c) One similar completed works costing not less than the amount equal to 80% of the
estimated cost.
The DGVCL may verify the above certificates / documents from respective department,

10 Contractor should submit evidence as a registered contractor in appropriate class With
Govt./ Semi. Govt. i. e. Class “E2” or any such registration allowed to work for amount
Up to Rs.50 lacs or enlisted with DGVCL/MGVCL/UGVCL/PGVCL /GEB / GSECL/
GETCO / DISCOM / Central / State Government / Semi Government in similar category
TENDER SPECIFICATIONS:
Bids are invited under a Single Stage – Two bid procedure. This will also include the process of post-qualification of the
bidders. Bidders are to submit simultaneously, technical bid & Price Bid online only as per the given schedule.Proposal
including bidder’s data on his technical and financial strengths along with experience profile to meet with post qualification
criteria and Bidder’s Technical proposals containing work methods, approach, construction program etc will be submitted by
the bidder both online. The Technical Proposal along with the data and information for qualification will be opened first. The
technical proposal along with qualification information will be subjected to an evaluation process contained as a part of the
tender document and bidders those who found fit to qualify will be invited for opening of the price bid. DGVCL as an employer
reserves its absolute and unchallengeable right to qualify or disqualify one or all bidders by following an objective and
transparent system. The envelope containing the post qualification data and the technical bid will be opened first for post
qualification of the bidders and evaluation of their technical proposals and to determine the responsiveness of the bids.
Price bids of only those contractors who are declared as substantial responsive to the requirements of the bid documents will
be opened only online for further evaluation.
Qualification requirement specifying financial capacity, technical, minimum acceptable levels with regards to bidders
experience in relevant projects and other relevant factors, such as work in hand, future commitments and litigation history etc.
will be evaluated first, and those qualifying the criteria will be considered for further price evaluation. Technical proposal,
which are not substantially responsive will be rejected.
PRICE EVALUATION:
No price preference shall be given on any account. All tenders will be evaluated on firm price end cost basis, but without
loading GST, unless otherwise mentioned in the tender documents. The parties however will have to give end cost for all

SECURITY DEPOSIT :
The contractor shall pay total 5% of contract value as Security Deposit within 10 days of the issue of Letter of Intent / Letter of
Acceptance. The work order will be issued only after payment of full SD amount at 5% of contract value as above. The
Security Deposit shall be paid in the form of Bank Guarantee / D.D.
No exemption in payment of Security deposit shall be given to NSIC certificate holder.
Security Deposit if paid will be returned on successful completion of the Order and only after the Performance Guarantee
Condition of One Year is fulfilled.
You will have to execute a stamped agreement and indemnity bond on stamp paper of Rs.300-00 with Company if your offer
is accepted by the Company and cost of the same shall be borne by the party.
VALIDITY OF THE OFFERS:
The offers will have to be kept valid for a period of 180 days from the date of opening of technical bids. In case of finalization
of the tender is likely to be delayed, the tenderer will be asked to extend the same without change in the prices or any terms
and conditions of the offer. If any change is made, original or during the extended validity period, the offers will be liable for
outright rejection without entering into further correspondence in this regard and no reference will also be made.

Any statutory increase or decrease in the taxes and duties subsequent to suppliers offer if it takes place within the original
contractual delivery date will be to the DGVCL account subject to the claim being supported by documentary evidence.
However, if any decrease takes place after the contractual delivery date, the advantage will have to be passed on to DGVCL.
No advance Payment shall be made. Bills along with supporting documents showing each item executed with its quantity &
rate shall be submitted by the supplier on completion of each supply /each month on or before the date fixed by the Engineer-
in-charge, for all supplies made in duplicate quoting Vat /Tin No. and other supporting documents. Income-Tax will be
deducted directly from your payment.
The total time limit of order is 3 Months from date of commencement issued by EIC.
Extension of Time Limit:
If the Contractor shall desire an extension of time limit for completion of the work on the ground of his having been avoidably
hindered in it’s execution or on any other ground, he shall apply in writing to the DGVCL and the DGVCL may, if in his opinion
there are reasonable grounds for granting extension, recommend such extension as he may think necessary or proper. The
decision of the competent authority in this regard shall be final and binding to the Contractor. Any delay attributed to DGVCL
shall be compensated only by way of extending the time limit.
PENALTY FOR DELAY WORK:
If, Bidder fails to execute the order successfully in stipulated time limit, or fails to execute the work, penalty shall be levied at
½% per week maximum up to 10% of order value.
Taxes : GST will be paid to the contractor as per Govt., rules & regulations against this particular work.
“D.G.S & D. FORCE MAJEURE CLAUSE”
“If, at any time during the continuance of this contract, the performance in whole or in part by either party of any obligation
under this contract shall be prevented or delayed by reason of any war, hostility, act of the public enemy, civil commotion,
sabotage fires, floods, explosion, epidemics, quarantine restrictions, strikes lockouts or acts of God (hereinafter referred to as
event)”, then provided notice of the happening of any such event is given by either party to the other within twenty one days
from the date of occurrence there of neither party shall by reason of such event be entitled to terminate this contract nor shall
either party shall have any claim for damages against the other in respect of such non-performance of delay in performance,
and deliveries under the contract shall be resumed as soon as practicable after such event has come to end or ceased to
exist, and the decision of the Secretary as to whether the deliveries have been so resumed or not shall be final and
Provided further that if the performance in whole or part of any obligation under this contract is prevented or delayed by
reasons of any such event for a period exceeding 60 days, either party may at its option terminate the contract provided also
that if the contract is terminated under this clause, the Purchaser shall be at liberty to take over from the Supplier at a price to
be fixed by the Secretary, which shall be final, all unused undamaged and acceptable materials brought out components, and
stores in course of manufacture in the possession of the Supplier at the time of such termination or such portion thereof as
the Purchaser may be deem fit excepting such materials, brought out component and stores as the supplier may with
concurrence of the Purchaser elect to retain”.
POST TENDER CORRESPONDENCE / ENQUIRIES:
Any correspondence or enquiry subsequent to opening of Technical and Commercial bids is not desirable, if the same is
indulged into, it will be considered for disqualifying the tender. The Tenderer will be required to abstain from pursuing /
canvassing the matter, directly or indirectly with any Officers of DGVCL, as otherwise the same would also amount to
disqualification of the tender.
Tenderer must submit offers / bids along with requisite descriptive literature etc. in Duplicate (separate sets) clearly indicating
as Original and Duplicate duly signed and stamped by them.
All questions, disputes or differences whatsoever which may at any time arise between the parties to this agreement touching
the agreement or subject matter thereof, arising out of or in relation there to and whether as to construction or otherwise shall
be referred to the decision of the Sole Arbitrator, appointed by the MD of DGVCL, for that purpose, who shall be a retired
High Court Judge or retired District and Sessions Judge, and the decision of the said Arbitrator shall be final and binding upon
the parties. Reference to the arbitration shall be governed by the provisions of Indian Arbitration & Conciliation Act. 1996 as
amended from time to time and the rules made there under.

All questions, disputes or differences arising under out of or in connection with the Tender / Contract if concluded shall be
subject to the exclusive jurisdiction of the court under whose jurisdiction the place from which the tender / Acceptance of
tender is issued, is situated i.e.Surat.
Offers on ex-stock or offers requiring no foreign exchange will be considered. Those offers requiring foreign exchange will not
The Contractor shall take all requisite & necessary care to observe that no damage is caused to the Existing structures,
assets etc. For any damage to the Existing Structures, assets of Dakshin Gujarat Vij Company Limited, the Contractor shall
be held responsible, and he will have to rectify/restore/replace the damage immediately up to the satisfaction of Engineer in
Charge, at his own cost.

2. The Bidder shall ensure that representative on his behalf deputed by him should be in touch with the C.E.O & S.E.

3. The rates quoted by the Bidder shall include all charges such as Fuel, Levies, Transport, Maintenance, Repairs or
Bidder’s servant / agent wages etc.
TERMS & CONDITIONS REGARDING INDUSTRIAL LAWS & OTHER RELATED MATTERS.
The above are some of the major liabilities of the Bidder in addition to other liabilities prescribed under. The various labour
