1. The TENDER is issued by the Statue of Unity Area Development and Tourism
Governance Authority (SoUADTGA) or the “Authority.”
2. The information contained in this TENDER is selective and is subject to updating,
expansion, revision, and amendment. It does not and does not purport to contain all the
information that a Bidder may require. Neither Authority nor any of its officers; employees
nor any of its advisors/consultants undertakes to provide any prospective bidder with
access to any additional information or to update the information in this TENDER or to
correct any inaccuracies therein which may become apparent. Each prospective bidder
must conduct its analysis of the information contained in this TENDER or correct any
inaccuracies therein that may this TENDER and is advised to carry out its own
investigation into the proposed Project, the legislative and regulatory regime which
applies thereto and by and all matters pertinent to the proposed Project and to seek its
own professional advice on the legal, financial, regulatory and taxation consequences of
entering into any agreement or arrangement relating to the proposed Project.
3. This TENDER is neither an agreement nor an offer by the Authority to the prospective
Bidders or any other person. The purpose of this TENDER is to provide interested parties
with information that may be useful to them in making/submitting their Bids (technical and
financial bids) pursuant to this TENDER. This TENDER includes statements, which reflect
various assumptions and assessments arrived at by the Authority in relation to the Project.
Such assumptions, assessments and statements do not purport to contain all the
information that each Bidder may require. This TENDER may not be appropriate for all
persons, and it is not possible for the Authority, its employees, or advisors to consider the
investment objectives, financial situation and particular needs of each Bidder who reads
or uses this TENDER. The assumptions, assessments, statements, and information
contained in the Bidding Documents may not be complete, accurate, adequate, or correct.
Each Bidder should, therefore, conduct its own investigations and analysis and should
check the accuracy, adequacy, correctness, reliability and completeness of the
assumptions, assessments, statements, and information contained in this TENDER and
obtain independent advice from appropriate sources.
4. Information provided in this TENDER to the Bidder(s) is on a wide range of matters, some
of which may depend upon the interpretation of the law. The information givenis not
intended to be an exhaustive account of statutory requirements and should not be
regarded as a complete or authoritative statement of law. The Authority acceptsno
responsibility for the accuracy or otherwise for any interpretation or opinion on law
expressed herein.
5. The Authority, its employees and advisors make no representation or warranty and shall
have no liability to any person, including any applicant or Bidder under any law, statute,
rules or regulations or tort, principles of restitution or unjust enrichment or otherwise for
any loss, damages, cost, or expense which may arise from or be incurred or suffered on
account of anything contained in this TENDER or otherwise, including the accuracy,

adequacy, correctness, completeness or reliability of the TENDER and any assessment,

6. The Authority also accepts no liability of any nature whether resulting from negligenceor
otherwise howsoever caused arising from reliance of any Bidder upon the statements
contained in this TENDER.
7. The Authority may in its absolute discretion prior to the Bid Due Date, but without being
under any obligation to do so, update, amend or supplement the information, assessment
or assumptions contained in this TENDER at any time during the Bidding Process.
8. The issue of this TENDER does not imply that the Authority is bound to select a Bidder or
to appoint the Selected Bidder for the Project and the Authority reserves the right to reject
all or any of the Bidders or Bids without assigning any reason whatsoever. Mere
submission of a responsive Bid does not ensure the appointment of the bidder as
Preferred / Selected Bidder.
9. The Bidder shall bear all its costs associated with or relating to the preparation and
submission of its Bid including but not limited to preparation, copying, postage,delivery
fees, expenses associated with any demonstrations or presentations which may be
required by the Authority, or any other costs incurred in connection with or relating to its
Bid. All such costs and expenses will remain with the Bidder and the Authority shall not
be liable in any manner whatsoever for the same or for any other costs or other expenses
incurred by a Bidder in preparation or submission of the Bid, regardless of the conduct or
outcome of the Bidding Process.

Interpretation:
In the interpretation of this TENDER, unless the context otherwise requires:
1. The singular of any defined term includes the plural and vice versa, and any wordor
expression defined in the singular has the corresponding meaning used in the plural
and vice versa.
2. Reference to any gender includes the other genders.
3. Unless otherwise stated, a reference to a Clause, Sub-Clause, Paragraph, Sub-
paragraph, Annex, Exhibit, Attachment, Schedule, or Recital is a reference to a Clause,
Sub-Clause, Paragraph, Subparagraph, Annex, Exhibit, Attachment, Schedule, or
Recital of this TENDER.
4. A reference to any agreement is a reference to that agreement and all annexes,
attachments, exhibits, schedules, appendices, and the like incorporated therein, as the
same may be amended, modified, supplemented, waived, varied, added to,substituted,
replaced, renewed, or extended, from time to time, in accordance with the terms thereof.
5. The terms “include” and “including” shall be deemed to be followed by the words
“without limitation”, whether or not so followed.
6. Any reference to a person shall include such person’s successors and permitted

1. INFORMATION TO BIDDERS
1.1. General Conditions
1.1.1 Bidders who wish to participate in the online tender will have to procure / should have
a legally valid Digital Certificate as per Information Technology Act - 2000 using which
they can sign their electronic bids. Bidders can procure the same from any of the
license certifying Authority of India or can contact (n) code solution-a division of GNFC

The Bidder should be a Single Entity. Bidders shall furnish all relevant information,
as per the formats provided in the “TENDER”.
1.1.3 The Bidder shall have to submit a Technical Bid, Financial Bid, Qualifying documents,
Demand Drafts of EMD and Bid Processing fees in electronic format on
www.nprocure.com web site, on or before the specified last date and time for
submission. SoUADTGA shall not be responsible for the slow or non-workingof the

Government Postal Authority or Courier. The tenderer shall have to mention the name
and address of the tenderer, Tender Notice Number and Name of the Work on the
main cover. SoUADTGA shall not be responsible for any postal delay.
1.1.6 The Bid Processing fee is not refundable. The amount of the E.M.D. shall be forfeited
incase the bidder withdraws his competency from the work before or after his tender
is accepted & the tenderer does not complete the Contract documents and pay the
amount of Security Deposit mentioned elsewhere ofthe tendered value, within the
specified time. Otherwise, the E.M.D. shall be refunded.

Bid Processing fee and Earnest Money Deposit and other technical documents in a
physical form specifically listed in this bid document shall be submitted to The Office
of Executive Engineer, Mechanical & Electrical Division, Statue of Unity Area
Development and Tourism Governance Authority, New Administrative Building,
Room No. 322, Ekta Nagar, Ta. Garudeshwar, Dist. Narmada - 393 151, Gujarat,
1.1.7 Bids, as submitted by the Bidders, shall have a Bid Validity of 180 Days (or “Calendar
Days”) from the last date of Bid Submission. During this period, Bidders shall maintain
the availability of Professional staff nominated in the Bid.The Authority will make its
best effort to complete negotiations within this period. Should the need arise,
however, the Authority may request Bidders to extend the validity period of their Bids.
1.1.8 SoUADTGA reserves the right to accept or reject any or all the received tender/s
without assigning any reasons thereof. SoUADTGA also reserves every right to
decrease the quantity and scope of work or to assign the work to more than one

1.1.10 Bidders are advised to submit their bids on time. SoUADTGA shall not be responsible
for slow working/non-working of site/non-submission of tender.
1.1.11 Bidders who agree to such extension shall confirm that they maintain the availability
of the Professional staff nominated in the Bid, or in their confirmationof the extension
of validity of the Bid, Bidders could submit a CV of new staff, being proposed in
replacement, who would be considered in the final Consultancy Agreement, after the
evaluation of the Curriculum Vitae (CV).Bidders who do not agree have the right to
refuse to extend the validity of their Bids.
1.1.12 No alteration in the Technical/Price Bid shall be allowed.
1.1.13 If the bidder finds any deviation or anomaly, he shall intimate the same to the invitee in
writing or e-mail.
1.1.14 The Bidder shall submit Bid Processing fees, EMD and Affidavit in a sealed cover with the Name
of the Work, Tender ID written on the outside of all the envelope.
1.2 Clarifications and Amendment of TENDER Documents.
1.2.1 Bidders may request clarification on any of the points contained in TENDER documents
up to the number of days indicated below. Any request for clarification must be sent in
writing by paper, mail, or electronic mail to the Authority's address as indicated. The
Authority will upload a response to all such requests received by it on the websites of
https://tender.nprocure.com
1.2.2 Queries, if any, proposed to be raised at the pre-bid conference by the Bidder/s should be
submitted in writing as per the attached format in Annexure-5 (over email or a letter) at

1.2.4 A maximum of two representatives of each Bidder shall be allowed to participatein the
production of an Authorization letter from the Bidder.
1.2.5 At any time before the submission of Bids, the Authority may for any reason, whether at
its own initiative or in response to a clarification requested by a Bidder,modify the TENDER
documents by amendment. Any such amendment shall be issued in writing through
Corrigenda. Corrigenda shall be uploaded in N-procureand shall be binding on all Bidders.
The Authority may at its discretion extend the deadline for the submission of Bids.

1.4 Preparation of Bids.
1.4.1 The Bidders are required to submit the Bid in two parts in two separate envelopes/parts
and put them together in one single outer envelope. The two parts shall be captioned as
follows on the respective envelopes:

1.4.4 In preparing the Technical Bid, Bidders are expected to examine the submission
documents/format/enclosures etc., comprising this TENDER in detail. Material
deficiencies in providing the information requested may result in the rejection of the Bid.
1.4.5 During the preparation of the Technical Bid, Bidders must give particular attentionto the
a) It is desirable that most of the key professional staff (as proposed by the bidder) should
preferably be permanent staff. The permanent staff would be considered those employed
with the Bidder for at least one year. More weightages will be given to the personnel,
based on the duration of their employment with the Bidding Party. For the avoidance of
doubt, personnel would mean professionals and support staff provided by the Contractor
and their associates and assigned to perform the Services or any part thereof.
b) Alternative professional staff shall not be proposed and only one Curriculum Vitae (CV)
must be submitted for each proposed professional.

mandatory for key professional staff on this Project. Reports must be in the English

1.4.7 The Technical Bid must not include any financial information.
PART 3: FINANCIAL BID – to be strictly submitted online only.
1.4.8 In preparing the Financial Bid, Bidders are expected to consider the requirements and
conditions of the TENDER documents. It should include all costs associated with the
Project, including but not limited to;
Supply, installation, Testing and Commissioning, Maintenance during DLP, remuneration
to the staff and (b) rentals / fixed rates / reimbursable such as subsistence (per diem,
housing), transportation (for mobilization and demobilization), services and equipment
(vehicles, office equipment, furniture, andsupplies), office rent, insurance, the printing of
documents, and surveys, training, software license, etc. as components of this Project.
1.4.9 The Financial Bid should clearly identify and include all the taxes, duties, fees, levies, and
other charges imposed under the applicable law, on the Bidders, and their personnel, and
include as part of their offer including GST.
1.4.10 Bidders must express the price of their services in the format as indicated in the sample
format placed in Annexure 1: Financial Bid Submission Form (to be submitted online
only on n-procure website).
1.4.11 Conditional Bids shall not be accepted.

1.5 Submission, Receipt and Opening of Bids
The Bid shall be prepared in indelible ink. It shall contain no inter-lineation or overwriting,
except as necessary to correct errors made by the Bidder. Any such corrections must be
initialed by theperson who signs the Bids.
1.5.1 Each of the bids, along with their relevant enclosures should be bound, paginated,with an
index of submission on the first page.
1.5.2 An authorized representative of the Bidder shall initial all the forms of the TechnicalBid in
original. For the supporting documents, a scanned signature shall suffice. The
representative's authorization shall be in the form of a written power of attorney
accompanying the Bid, or in any other form demonstrating that the representative has
been duly authorized to sign.
1.5.3 The Bid Processing Fee and the EMD must be in one Envelope (Cover-1) and Technical
Bid must be in another Envelope (Cover-2). The envelope must be clearly marked on top
as "Technical Bid.” A soft copy of the Technical Bid, in PDFformat on a pen drive, should
also be placed on the cover containing the TechnicalBid.
1.5.4 The two separate envelopes containing the Bid Processing Fee & EMD and Technical
Bid, should be placed on one cover and addressed to the Authority (as per the given
detailed address) and labelled with the Project name clearly. The Bid shall be sent to the

1.5.5 The completed Bids must be delivered/submitted on or before the submission timeand date
as stated in Bidding Schedule. The Authority shall not be responsible formisplacement,
losing or pre-matured opening, if the outer envelope is not sealed and/or not marked as
1.5.6 All Documents must be colored scanned to be seen as original. Scanning in Black and
White or grey shall not be acceptable.
1.5.7 If the original copy is not scanned, the documents to be uploaded must be notarized with
clearly display the stamp, number, and name of the notary. No photocopy of notarized
documents shall be acceptable.

1.5.8 After the deadline for submission of Bids, the Technical Bid envelope shall be opened in
the presence of the Bidders / their Authorized Representatives who choose to attend on
the date and time indicated in the Bidding Schedule.
Important Note:
a. Bidders are required to upload Technical as well as financial bid on the N-Procure
website as per the terms of this TENDER.
b. Site visit is Compulsory & Agency must submit site visit certificate issued by
SoUADTGA on both online & offline. The bidder must visit the site to observe the
conditions of the place where project need to be executed. No extra claim on
consequences of ignorance on ground of insufficient descriptions will not be allowed
at the later date. Bidder should inform Authority about the site visit at least one day in

Earnest Money Deposit as mentioned in the TENDER document (i.e., DD / FDR)
Bid Processing Fees as mentioned in the tender.
Affidavit on Non-Judicial Stamp Paper of Rs. 300/-.

2. Bid Evaluation
The responsive bids shall be evaluated on an L1 (Lowest) basis as detailed inTENDER.
The following procedure shall be adopted in evaluating the bids:
2.1 Test of Responsiveness
2.1.1 Prior to the evaluation of the documents contained in the Technical Bid envelope, the
Authority shall determine whether each Bid is responsive to the requirements set out in
this Tender. A Bid shall be considered responsive only if:
2.1.1.1 It is received by the Bid Due Date including any extensions thereof.
2.1.1.2 The Part-1 submission (Cover-1) shall contain the Bid Processing Fee and EMD as
2.1.1.2.1 Bid Processing Fee: Bidder must furnish, as part of its submission, a non-refundable Bid
Processing Fee amounting to Rs. 2500 + GST = Rs. 2950/-. The Bid Processing Fee shall
be submitted in the form of a Demand Draft (DD) drawn in favor of the STATUE OF UNITY
AREA DEVELOPMENT AUTHORITY, payable at Ekta Nagar / Rajpipla.
2.1.1.2.2 Earnest Money Deposit: Bidder must furnish, as part of its submission, Bid Security /
Earnest Money Deposit amounting to Rs.83,000 /- (Rupees Eighty Three Thousand Only)
in the form of either Fixed Deposit Receipt or a DD (The validity period of the Bid Security,
in case of Demand Draft, shall not be less than 180 (One Eighty) days from the Bid Due
Date (which shall be extended on mutual agreement) and in case of a FDR shall not be
less than 180 (one hundred and eighty) days from the Bid Due Date, and may be
extended as may be mutually agreed between the Authority and the Bidder from time to
time or BG. The EMD of the unsuccessful bidders shall be returned by the Authority
preferably within 15 days from the date of signing of the contract agreement with the
Successful Bidder. The EMD of the successful bidder shall be returned upon submission
of the Performance Guarantee.
2.1.1.2.3 The bidders are also required to bring forth all the required documents mentioned
in Annexure 2 of the TENDER document, to be considered for the technical evaluation

Responsive Bids, fulfilling the criteria given above, shall be evaluated as per the pre-
qualification criteria given below:

2.1.1.5 It is received as per the formats prescribed in the Technical Bid Forms of the Tender

2.1.1.7 It contains the necessary documentary proof as specified in the checklist mentioned in
the Tender document.
2.1.1.8 The documents, especially the scanned copies, should be clearly readable.
Submission of non-legible documents might lead to the bid beingrejected.
2.2 Pre-Qualification Evaluation Criteria
Bidders who comply with the following basic criteria are eligible for participation in
2.2.1 Bidder should be an established IT/Security Surveillance Solutions System Integrator
and should have been engaged in setting-up and Operations & Maintenance for Out
Door Type CCTV surveillance, in last 7 years as on bid submission date.
2.2.2 The CCTV Camera’s OEM should have supplied same or Similes product 2.5 times than
the bid quantity during the last 3 years before the bid opening date.
2.2.3 OEM Authorization: Bidder should attach Authorization certificate from the OEM of the
equipment specified in Form, for the authenticity, authorized representation and after
sales support. (Camera, VMS, NVR).
2.2.4 “Bidder is required to submit the undertaking as per the Department of Expenditure,
Government of India guidelines on procurement dated 23.07.2020 to confirm that, all the
quoted product Make under this bid are not from a country which shares a land border
with India or, of if from such a country, quoted product/OEM have been registered with
competent authority. Bidder and OEM is required to submit the undertaking on bidder’s
& OEM letter head with authorized stamp and sign for all quoted product.
2.2.5 All the proposed equipment should not be declared End-of-Support by the OEMs for
next 7 years and should not be end of production for next one year from the date of bid
2.2.6 CCTV OEM should have direct Manufacturing in India from last 05 years. (Not as joint
Venture, partnership firms or through any association) and R&D unit registered with

2.2.7 Bidder will have to submit OEM Authorization on OEM letter head with bid number for
Quoted Product.
2.2.8 OEM should not be blacklisted or barred by any Ministry of Government of India or any
of the Government / PSUs or any other government department at the time of bidding.
The OEM should not have any common directors who are also on the board of
blacklisted companies.
2.2.9 CCTV OEM should have ISO 9001, 14001, 20000, 27001, 45001 Certificate.
2.2.10 CCTV OEM Offer camera must have IoT SCS {IoT System certification scheme}
certification (ER) Essential Requirement from 'standardization Testing & Quality
certification (STQC).
2.2.11 All Camera, NVR have to be a same make.
2.2.12 The bidder should have a minimum average annual financial turnover of INR
lakh/- in the last “Three Financial Years” ended by 31 March
2.2.13 Experience of having successfully completed similar works during the last 5 (five)years
ending the last day of the previous month to the one in which applications are invited
should be either to be following:
2.2.13.1 Three Similar completed works costing not less than the amount equal to 40 (Thirty)

2.3 Financial Bid Evaluation
2.3.1 It is expected that Bidders shall determine all the costs appropriately and shall take
necessary care in allocating budgets adequately to major components of the study.
2.3.2 The Evaluation Committee shall consider the price quote and the Eligible Bidder based
on Lowest (L1) Based Selection.
2.4 Award of Work/ Work Order
2.4.1 After completion of the evaluation process, the Authority shall award the work to
Lowest (L1) bidder by issuing a Letter of Award.
2.4.2 The Successful Bidder {(L1) Bidder} with whom the Contract Agreement (the
“Agreement”) is signed and is expected to commence the work on the date and at the
location specified as indicated by the Authority.
2.4.3 The successful bidder shall be required to submit a Performance Guarantee as
mentioned in clause 3.5 in the form of a Bank Guarantee OR Fixed Deposit Receipt as
a pre-requisite to signing of the Contract Agreement.
2.4.4 The Performance Guarantee, as submitted, shall have to be renewed by the contractor
before 90 days of its expiry (if required by the authority).
Information relating to the examination, clarification, evaluation, and recommendation for
the selection of Bidder(s) shall not be disclosed to any person who is not officially
concerned with the process or is not a retained professional adviser advising the
SoUADTGA in relation to matters arising out of or concerning the Public Procurement
Process. The SoUADTGA shall treat all information submitted as part of the Proposal, in
confidence and shall require all those who have access to such material to treat the same
in confidence. The SoUADTGA may not divulge any such information unless it is directed
to do so by any statutoryentity that has the power under law to require its disclosure or to
enforce or assertany right or privilege of the statutory entity and/or the SoUADTGA or as
may be required by law or in connection with any legal process.

2.6 Right to Rejection
2.6.1 Authority reserves the right to reject any or all Bids, to waive any informality in such Bids,
to request new Bids, to revise the TENDER prior to, and including, the pre- bid meeting
date, to proceed to do the work otherwise, withdraw this TENDER, not award the work,
or not award a portion of work at any time.
2.6.2 The receipt of bids shall not in any way, obligate the Authority to enter into a Contract
Agreement or any other agreement of any kind with the Bidder. All submitted copies of
the bids shall become the property of the Authority.
2.6.3 The bid will be rejected for the award if it is determined that the Bidder recommended for
the award has, directly or through an agent, engaged in corrupt,fraudulent, collusive, or
coercive practices in competing for the project in question.
2.6.4 A Bidder will be declared ineligible, either indefinitely or for a stated period,to be awarded
a project if Authority at any time determines that the Bidder has engaged in corrupt or
fraudulent practices in competing for or in executing a project; and
2.6.5 A Bidder may be declared ineligible and/or blacklisted from further bidding with Authority
for a period as deemed fit by Authority in case any misrepresentation of facts/ details is
found in the bid as submitted by them at any point in time.
2.7 Liquidated Damages and Penalties
2.7.1 Liquidated Damages for delay: In case of delay in completion of contract, liquidated
damages (for repair works) not exceeding an amount equal to 0.2% (zero-point two
percent) of the contract value per day, subject to a maximum of 10% (ten percent) of the
Contract value will be imposed and shall be recovered by an appropriation from the
Performance Security or otherwise. However, in caseof delay due to reasons beyond the
control of the Contractor, a suitable extensionof time shall be granted on written request
justifying the cause of such act.
2.7.2 Encashment and appropriation of Performance Security: The Authority shall have the
right to invoke and appropriate the proceeds of the Performance Security, in whole or in
part, without notice to the Contractor in the event of a breach of this Agreement or for
recovery of liquidated damages specified in this Clause.
2.7.3 Penalty for deficiency in Services: In addition to the liquidated damages not amounting
to penalty, as specified in this Clause, a warning may be issued to theContractor for
minor deficiencies on its part. In the case of significant deficiencies in services causing
adverse effects on the Project or on the reputation of the Authority, other penal action
including debarring for a specified period may also be initiated as per policy of the
Authority. If a major deficiency of significant nature in the services is observed, an
additional levy of compensation up to a maximum of 5% of the contract value shall be
made on the Contractor. In this regard, the decision of the Authority will be final and
binding. In case the penalty exceeds to its maximum value, Authority (SoUADTGA) shall
have the right to carry out / complete the work by another agency at the risk & cost of

Original Contractor/Selected bidder, and the original Contractor’s SD/Performance
Security shall be forfeited.
2.8 Documents prepared by the Contactor.
All drawings, specifications, maps, photographs, studies, surveys, data, notes, computer
files, reports, records, documents and other materials (the “documents and materials”)
prepared by the Contractor, its employees, sub-contractors and agents in the performance
of this Agreement shall be the property of Authority andshall be delivered to Authority upon
request of the Competent Officer or upon the termination of the Agreement, and
Contractor shall have no claim for further employment or additional compensation as a
result of the exercise by Authority ofits full rights of ownership use, reuse, or assignment
of the documents and materials hereunder. In the event of termination, all finished or
unfinished documents and other materials, if any, at the option of the Authority, and to the
extent permitted by law, shall become the property of the Authority. Contractor may retain
copies thereof for its files and internal use. Any publication of information directly derived
from work performed or data obtained in connection with services rendered under this
Agreement must be first got approved byAuthority.

3. Terms of Reference
3.1. Background
The Statue of Unity Area Development & Tourism Governance Authority (SoUADTGA)
has deployed CISF at the Statue of Unity.
To enhance the security infrastructure of these vital CISF establishments, SoUADTGA
intends to implement a robust, STQC-compliant, and cyber-secure CCTV
Surveillance System through this tender for Supply, Installation, Testing and
Commissioning (SITC) of CCTV System at the CISF Armory, Office and residential at
Ekta Nagar. The upgraded surveillance system will support CISF in maintaining
stringent safety protocols, monitoring sensitive activities, preventing unauthorized
access, and ensuring adherence to Government of India’s security guidelines.
This tender seeks to engage a contractor who can deliver an advanced, reliable, and
scalable CCTV monitoring solution that meets the operational requirements of the
CISF Unit and strengthens the overall security architecture of the armoury and
command office.
3.2. Scope of Work (SITC 30 Days)
The scope includes Supply, Installation, Testing and Commissioning (SITC) of
complete CCTV Surveillance System including Cameras, NVR, Server/Storage,
Networking Components, UPS/Power System, Software, Licenses, Cables,
Accessories, and all allied works as per specifications provided by the
Employer/Engineer-in-Charge (EIC).
Modification/Alteration of power supply: The permanent power supply required for
the projects shall be arranged by the SoUADTGA. The supply point shall be in nearby
the project/s. However, the Bidder shall arrange the power connection required for
construction/installation purposes at his own cost & risk. In case the successful bidder
needs alternative power supply to cover the power failures it shall be arranged by the
bidder at his own cost.
3.2.1. Terms and Conditions:
1. The rate quoted by the bidder shall be valid for the entire contractual period, i.e. the
bidder will not be liable for any annual increment in any fee/charges during the contract
2. Any additional of item/s which are required to successfully execute the project, will be
paid after approval/satisfaction of the SoUADTGA. Agency shall require intimate
/informing to concern authority.
3. The authority shall have the right to carry out / complete the work by another agency at
the risk & cost of Original Contractor/Selected bidder, and the original Contractor’s
SD/Performance Security shall be forfeited.

4. The Contractor/Agency shall ensure that all the equipment’s and manpower associated
with this project including Maintenance period is fully insured from time to time at its
own cost and expenses against all the risks of fire and extended cover thereof,
earthquake, flood, cyclone, strikes riots, insurgency, civil strife commotion, terrorism,
electrical fire machinery equipment break down.A copy of each renewed policy (ies.)
cover note will be furnished to the Authority on every renewal.
5. However, the Contractor shall immediately take measures to have the insurance claim
processed and re-construction/ renovation of the project shall be commenced within
days of occurrence of the incident and shall be completed in such time as may be
determined by the Authority and any other insurance that may be necessary to protect
the Authority and Contractor and its employees, including all Force Majeure Events.
6. The Contractor/Agency must involve qualified and experienced local engineer (related
field) for supervision of all the work.
7. It is mandatory for the Contractor to prepare detailed Drawings of the Entire Installation
indicating Cabling Work.
8. All the electrical safety standards should be adhered during the execution of thework.
Appropriate ratings of RCCB/ELCB are must on all the circuits.
9. The quantity mentioned in the tender is indicative. There are possibilities for an increase
or decrease in the item quantity, which will be utilized during the execution period of
contract as per the requirements.
10. Transportation of manpower and materials are in the scope of the Contractor/Agency.
11. Bidder may visit and survey the site before participating in bidding process. Thecost
of site visit shall be borne by bidder only.
12. Authority will provide Single Electric supply point near to site locations,
Contractor/Agency must take electricity supply from it with necessary arrangement of
Electric wire/cable, Electric Plug, etc.
13. Contractor shall be bound to follow the safety procedure as per Government norms
and ensure the safety of labor staff working under this work project.
14. Contractor shall be bound to use standard materials and maintain work quality for
execution of work.
15. All cables switchgears, fittings with accessories etc. should be ISI MARKED positively
with their relevant IS standards.
16. The Contractor/Agency must provide the manpower as per instruction from Engineer-
in-Charge (EIC) to meet the requirement.
17. SITC: SITC should be as per the given data sheet submitted by bidders.
18. The prices filled in should be inclusive of all applicable taxes, levies,
transportation & other unforeseen charges including GST.

19. Safety Clause: Safety will be checked strictly by the SoUADTGA and there will be no
relaxation for the same. The contractor shall comply with all applicable laws/ rules
including those relating to local building regulations, safety, health, sanitation,
environment, labor, and hazardous/ dangerous materials during the contract period.
20. The Contractor/Agency will be responsible for any kind of fatal/non-fatal incidence that
might occur on the project site during the execution of the SITC & DLP period.
21. The Contractor/Agency shall have to take all necessary steps and precautions to
safeguard the lives of the manpower working on site. If in case any incident happens,
the entire responsibility of the same would be with the contractor to deal with any of the
legal proceedings which may arise, including a police case, court case, compensation,
insurance to settle the matter. The authority will not be held responsible for any such
incidence which arises during the contract period.
22. Law Governing Contract: This Contract, its meaning and interpretation, and the
relation between the Parties and all disputes shall be governed by the applicable Law of
India and the State of Gujarat, Rajpipla court jurisdiction.
23. The Contractor shall have to arrange and deploy necessary manpower & trained
personnel for the execution of the project.
24. Payments shall be made as per actual execution of items and as per payment
schedule finalized by department.
25. The materials specified in tender shall be transported immediately to the site andwithin
the time limit as instructed by Engineer-in-charge. To and for material transportation to
site and its cost is in the scope of bidder only.
26. Contractor has to start the work immediately on as and when required basis as per the
instruction of Engineer-in-charge.
27. During the work/event, if any material is missing or any material is damaged, in such
event, the contractor shall be responsible for it.
28. Government ceremonies are the reflection of state's prestige. Hence, all the material
should be of high quality and should be properly cleaned and as per the instruction and
approval given by Engineer-in-charge. Please note that no exemption shall be allowed
in this matter.
29. The behavior of the staff, workers/labours appointed by the contractor must be polite
and respectful towards SoUADTGA (The Authority) officials or otherofficials/ employees
and other dignitaries.
30. The wires and cables used for the project should be without any joints as far as
possible. In inevitable case, the joints should be waterproof having properly tapped and
insulated with required connectors. The agency shall be fully responsible for any
occurrence of accident due to negligence.
31. The Contractor/Agency will have to work as per provision of Labour (Regulation and
Abolition) Act 1970, under the provision of 1972 of Gujarat Rules and worker’s

compensation rules and regulation including any recent amendments. Agency shall
provide the facilities to workers as per relevant laws and regulations. In case of any
incidence/accident or any Staff/worker gets injured, the agency shall be liable for the

33. The agency shall not deploy any person in connection with any activity under thescope
of this work, who is minor according to the Law.
34. The persons of the agency shall be covered by the Rules and Regulations of the
SoUADTGA to carry out the work, which may change from time to time, and they should
follow the instructions given by the nominated officers of the SOUADTGA from time to
Defects Liability Period (DLP) Coverage (For 01 Year).
The Contractor shall ensure that all relevant policies (where applicable) remain valid or are
renewed to cover any liabilities arising during the Defects Liability Period.
Any damage occurring due to defective workmanship, materials, or negligence during DLP
shall be covered entirely by the Contractor.
3.2.2. Ownership of the proposal
All proposals submitted in response to this tender shall become the property of the
SoUADTGA regardless of the rejection/acceptance of any proposal.
3.2.3. Proprietary information
Any information considered as a legitimate trade secret or non-published financial
information must be clearly marked in the Proposal and will be treated as such in
accordance with the laws of the State of Gujarat and the Government of India. A
proposal that is entirely marked as confidential will be Rejected.
3.2.4. Code of ethics
The Bidder(s) must ascertain that there is no conflict of interest or violation of ethics. if
they are awarded the contract for these works. The Bidder(s) also pledge that all
information included in their proposal are accurate and correct to the best of their
knowledge. Any falsification of facts or deceiving information may be grounds for

3.2.5. Contract award
As per the evaluation process mentioned in this TENDER, selected bidder would be
issued Work Order and invited to sign the Contract Agreement. The selected bidder
shall be required to return a duplicate copy of Work Order/LOA as issued by the
authority, duly signed by authorized signatory within 7 (seven) days from the date of
issue as a token of acceptance of the work. Within 15 days from the date of issue of
work order, the selected bidder shall sign the contract agreementwith authority failing
which the work order shall stand cancelled / withdrawn without any liability on Authority
and the EMD of such bidder shall stand forfeited.
The SoUADTGA reserves the right to award partial list of services/works offered in the
Tender. The tender and the Bidder(s) proposal shall become part of the contract
between the SoUADTGA and the Bidder(s).
If the Bidder(s) fails to execute/sign the contract with the SoUADTGA within 15 business
days, the SoUADTGA may elect to cancel the selection and award to the next L2
ranking applicant.
3.2.6. Terms of Payment:
Payments will be made based on progress percentage of total project cost as per the

above at each stage by the Authority after 60 days from successful acceptance. In case
the payment is delayed for reasons beyond the reasonable control of SoUADTGA, no
interestthereon shall be paid to the Contractor.
Any expenses which may accord during site visits, fieldwork, or meetings at
SoUADTGA at Ekta Nagar or at anywhere shall be borne by the Bidder, and no
residential accommodation shall be provided by the authority, and it shall be made
by/arranged by the Bidder at own cost.
3.3. Commission and Omission of the Project
The Authority reserves the right to make changes to the project includingrevision in
the total value of the project. The Authority shall pay such charges to Bidder for
additional works, if any, at the same rate as specified in this TENDER. In the event of
the discontinuation of the project, the payment would be made to the Contractor
according to the services rendered at the various stages.
3.4. General Terms regarding the scope
a) The SOUADTGA shall communicate all changes, decisions, etc., in writing as
shortest in time as possible.
b) Concept & Approved Drawings, plans and specifications are the property and
ownership of the SOUADTGA, irrespective of whether the work for which they are made
has been executed or not.
c) The assigned project is to be completed within a period specified in the works contract
of TENDER, with effect from the LOA to the contractor.
3.5. Security Deposit & Performance Security Deposit
Security Deposit:
The successful Bidder shall have to furnish the required security deposit @5% of the
contract value indicated in work order / LOI at the time of signing of contract agreement
The Security Deposit must be in form of FDR in favor of “STATE OF UNITY AREA
DEVELOPMENT AND TOURISM GOVERNANCE AUTHORITY “payable at Ekta
Nagar / Rajpipla, Narmada & must be issued by a Bank mentioned in Annexure A-1
having a branch at Ekta Nagar, Narmada.
The security Deposit will be returned after 90 days from issuance of completion
certificate by Competent Authority of SoUADTGA.
Guarantees issued banks as listed in ANNEXURE-4 will be accepted as SD /EMD
on permanent basis.

Additional Performance Security Deposit:
The Bidder(s) shall furnish additional 5 % of contract value as Performance Security if
agency quote 20% below to cost put to tender, to be kept as a surety that the bidder(s)
completes the work satisfactory, the performance guarantee will be valid up to end of
agreement period + 90 days or as prescribed in the contract document (Excluding
Defect Liability Period). In case the time of completion is enlarged the validity of the
guarantee shall be correspondingly extended. It carriesno interest and it returned to the
bidder(s) after expiry of contract period or after the date specified in the contract.
If the Security /Performance Deposit is not paid within 15days from the date of
issue of the “Work Order”, then the penalty @0.05% of the performance security
amount shall be charged. If the Performance security is not paid within one
month from the date of the “Work Order,” necessary action as per the
Conditions of Contract shall be taken.
3.6. Defect Liability Period`
Defect liability period for the work is 12 months (1Year). It shall be counted after the
successful trial run or till prescribed parameters are attained & whichever is later. During
the defect liability period the bidder(s) shall be responsible for repair and replacement
of any defective material used on the entire work & he will carry the full liability to make
good to the complete satisfaction of the engineer.
3.6.1 Making Good
The Bidder(s) shall be responsible for making good any defect in Defects or damage to
any part of the Works which may appear or occur during the Defects Liability Period,
and which arises from, either:
a) Any defective materials, workmanship or design, or
b) Any act or omission of the Bidder(s) during the Defects Liability Period.
The Bidder(s) shall make good the defect or damage as soon as practicable and at his

If any such defect appears or damage occurs, SoUADTGA shall forthwith notify the
Contract thereof.
3.6.3 Failure to Remedy Defects
If the Bidder(s) fails to remedy a defect or damage within a reasonable time, the
Employer may. Carry out the work himself or by others at the Bidder(s)’s risk and cost.

3.6.4 Defects Liability Certificate
When the Defects Liability Period for the Works has expired, and the Bidder(s) has
fulfilled all his obligations under the Certificate Contract for defects in the Works the
Engineer shall issue within 28 days to the Employer and the Bidder(s) a Defects Liability
Certificate to that effect.
3.7. Extension of Project
If the Contractor/Selected bidder(s) shall desire an extension of time for the completion
of the work on the grounds of his having unavoidable hindrance in its execution or on
any other ground, he/she shall apply in writing to Executive Engineer within 07 days of
the date of hindrance on account of which he desires such extension as aforesaid and
department (SoUADTGA) take the final authority for the extension of project.
3.8. Excess & Extra Items
3.8.1 Excess Items
If the quantity for any individual item increases by a quantity limited to 30 % of tender
quantity, such quantity shall be executed only after the approval of competent authority of
The contractor shall not undertake any excess beyond 30% / extra work without written
orders from the Engineer in Charge and any violations to this shall lead to non-payment to
the contractor.
No payment shall be entertained for excess quantity, if any, beyond the 30% of the tendered
quantity (that means total 130% of the tendered quantity) until such executed quantity and
the rates thereof are correctly derived afresh with mutual agreement and approved by the
authority of SoUADTGA.
3.8.2 Extra Items
Extra item of work shall not vitiate the contract. The contractor shall be bound to execute
extra items of work as directed by Engineer-in-Charge. No payment shall be entertained for
extra item until such executed quantity and the rates thereon are correctly derived and
approved by the authority of SoUADTGA.
