TheContractorshallberesponsibleformaintenanceandwatchandwardofthecompleteinstallationandsh

allalsoberesponsibleforanypilferage,theft,damage,penaltyetc.inthisregard.TheContractorsha

llindemnifytheOwneragainstanyclaimarisingoutofpilferage/theft,damage,penaltyetc.whatso

everonthisaccount.

TheContractorshalldeputeSiteEngineer&skilledworkersasrequiredforthework.Necessaryprotectivean

dsafetyequipmentsshallbeprovidedtothembytheContractorathisowncostandusedatsite.

6.0 Contractortokeepsiteclean:

Duringtheexecutionofthework,theContractorshallkeepthesiteclean.Allwreckagerubbish,exce

ssmaterials,temporaryworksnolongerrequiredwillberemovedfromsiteimmediately.

7.0 Clearanceofsiteoncompletion:

8.0BillofQuantities

a. Theschedule-

BshallcontainMemorandumshowingitemsfortheconstruction,installation,testing,andcom

missioningworktobedonebytheContractor.

b. ThequantitiesstatedinthescheduleBareestimatedquantities.TheContractorshallbepaidonl

yquantitiescalculatedaftertakingmeasurementsofexecutedwork.Theratestatedinthesche

duleBforeachitemofworkshallapply.TheworksshallbemeasuredbytheContractorjointlywit

htheauthorizedrepresentativeoftheEngineerandallparticularsrequiredbytherepresentativ

eoftheEngineershallbesuppliedbythecontractor.

c. Theworkshallbemeasurednet.Noallowanceforgeneralorlocalcustom,workingspaceetc.ist

TheEngineerinChargeshallhavepowertomakeanyvariationofform,qualityorquantityoftheworksorany

partthereofthatmay,inhisopinion,benecessaryandforthatpurpose,orifforanyotherreasonitsha

ll,inhisopinion,beappropriate,heshallhavetheauthoritytoinstructtheContractortodoandtheCo

ntractorshalldoanyofthefollowing:

 Increaseordecreasethequantityofanyworkuptoanyextentincludedinthecontract,

 Omitanysuchwork,

 Changethecharacterorqualityorkindofanysuchwork,

 ExecuteadditionalworkofanykindnecessaryforthecompletionoftheWorksor

 Changeanyspecifiedsequenceortimingofconstructionofanypartofwork.

Nosuchvariationshallinanywayvitiateorinvalidatethecontract,buttheeffects,ifany,ofallsuchvariationss

hallbevaluedinaccordancewiththefollowingsubclauses.Providedthatwheretheissueofaninstru

ctiontovarytheWorksisnecessitatedbysomedefaultorbreachofcontractbycontractororforwhic

hheisresponsible,anyadditionalcostattributabletosuchdefaultshallbebornebytheContractor.

TheContractorshallnotmakeanysuchvariationwithoutaninstructionoftheEngineer.Noinstructionisreq

uiredforquantitiesvaryingfromthoseprovidedfortheitemsinthecontractscheduleB.

ThebasisforthevaluationofvariationsforadditiontotheContractPriceshallbeasfollowsinthesameordero

a) Variationsinthequantitiesofworkinscheduleofquantitiesshallnotvitiatethecontract.

b) ThecontractorshallbeboundtoexecuteextraitemsofworkasdirectedbytheEngineer-in-

ecostofalltemporaryandincidentalworks,theoverheadsandtheContractorsprofit.

 Theoverheadsshallbetakenat5%ofthesumofmaterialcosts,thelabourcosts,thecostofus

eofallplant,machinery,andequipment,thecostofalltemporaryandincidentalworks.

Incaseoftherateistobederivedfromprevailingmarketrate,theContractorsprofitshallbetakenat10%ofth

efinalratederived.

Intheeventofdisagreement,theEngineerinChargeshallfixsuchratesandpricesasare,inhisopinionapprop

riateandshallnotifytheContractoraccordinglywithacopytotheEmployer.

TheEngineershalldetermineprovisionalratesandpricestoenableonaccountpaymentstobeincludedinth

eInterimPaymentCertificates,untilratesandpricesareagreedasfinalbytheEmployer,theContrac

tor,andtheEngineer.

TheContractorshallnotbeentitledtoadditionalpaymentforcosts,whichcouldhavebeenavoidedbygiving

Paymentsshallbeadjustedfordeductionsforadvancepayments,retention,otherrecoveriesintermsofthe

contractandtaxesatsource,asapplicableunderthelaw.TheEmployershallpaytheContractorthea

mountscertifiedbytheEngineer.

Ifanamountcertifiedisincreasedinalaterdatecertificateduetocorrectionsinpreviouscertificatesorasare

sultofanawardfromdisputesreviewexperts,Contractorshallbepaidsuchamountonly.TheContra

ctorshallnotbepaidanyinterestuponsuchdelayedpayment.

ItemsoftheworkforwhichnorateorpricehasbeenenteredinwillnotbepaidforbytheEmployerandshallbe

deemedcoveredbyotherratesandpricesintheContract.

AllpaymentsshallbemadeinAhmedabad.

12 Taxesandduties

TheratesareinclusiveofalltheprevailingtaxesanddutiesoftheCentral,StateandLocalGoverningbodiespr

evailingonthedateofawardofthecontract.TheContractorwillhavetopayallsuchtaxesanddutiesf

ortheperformanceofthisContract.TheEmployerwilldeductfromtheContractor’smonthlyandot

herpaymentsalltaxesandduties,whichheisboundtorecoverinaccordancewiththeapplicablelaw

TheContractorshallkeephimselffullyinformedofallactsandlawsoftheCentral&StateandlocalGoverning

bodies,allorders,decreesofbodies,tribunalshavinganyjurisdictionorauthoritywhichinanymann

eraffectthoseengagedoremployed,andanythingrelatedtocarryingoutthework.Allthebye-

lawslaydownbyAMC/AUDAandanyotherlocalbodieswhileexecutingtheworkshallbeadheredto

.Alltaxesoflocalbodiesshallbebornebythecontractor.TheContractorshallarrangetogiveallnotic

esrequiredbyanyauthorityandtopaytosuchauthorityallthefeesthatmayhavetobepaidforthem

aterial,plants,equipmentsetc.TheContractorshallalsoadheretoalltrafficrestrictionsnotifiedbyt

helocalauthorities.HeshallprotectandindemnifytheOwneranditsofficials&employeesagainsta

nyclaimorliabilityarisingoutofviolationsofanysuchlaws,ordinances,orders,decree,

B. FINISHINGTHECONTRACT

17.0 Completion

TheContractorshallrequesttheEngineertoissueaCertificateofCompletionoftheWorksandtheEn

gineerwilldosoupondecidingthattheWorkiscompleted.

18.0 Termination

TheEmployershallbeentitledtoterminatethecontractifthecontractor:

(a) Failstocarryoutanyobligationunderthecontract.

(b) Withoutreasonableexcusefails–

1. TocommencetheworksonsitewithintheperiodstatedintheAppendixtoBidafterreceiptb

yhimofaNoticetothiseffectfromtheEngineer/Employeraftersigningtheagreementor

2. Toproceedwiththeworks,oranysectionthereof,within28daysafterreceivednotice

3. Hasfailedtocomplywithanoticeissuedoraninstructionissuedwithin28daysafterhavingr

Aftertermination,theEmployermaycompletetheworksand/orarrangeforanyotherentitiestodoso.TheE

mployerandtheseentitiesmaythenuseanygoods,contractor’sdocumentsandotherdesigndocu

mentsmadebyoronbehalfofthecontractor.

TheEmployerortheContractormayterminatetheContractiftheotherpartycausesafundamentalbreacho

FundamentalbreachesofContractinclude,butshallnotbelimitedtothefollowing:

(a) theContractorstopsworkfor14dayswhennostoppageofworkisshownonthecurrentProgra

mandthestoppagehasnotbeenauthorizedbytheEngineer;

(b) theEmployerortheContractorismadebankruptorgoesintoliquidationotherthanforareconst

ructionoramalgamation;

(c) Thecontractorfailstofulfillrequirements;

(d) theEngineergivesNoticethatfailuretocorrectaparticularDefectisafundamentalbreachofCo

ntractandtheContractorfailstocorrectitwithinareasonableperiodoftimedeterminedbythe

(e) theContractordoesnotmaintainasecuritywhichisrequired;

(f) theContractorhasdelayedthecompletionofworksbythenumberofdaysforwhichthemaximu

mamountofliquidateddamagesbecomespayableasdefinedintheContractdata;

(g) iftheContractor,inthejudgmentoftheEmployerhasengagedincorruptorfraudulentpractices

incompetingfororintheexecutingtheContract.

(h) Forthepurposeofthisparagraph:“corruptpractice”meanstheoffering,giving,receivingorsoli

citingofanythingofvaluetoinfluencetheactionofapublicofficialintheprocurementprocessor

incontractexecution.“Fraudulentpractice”meansamisrepresentationoffactsinordertoinflu

enceaprocurementprocessortheexecutionofacontracttothedetrimentoftheBorrower,and

includescollusivepracticeamongBidders(priortoorafterbidsubmission)designedtoestablis

hbidpricesatartificialnon-

competitivelevelsandtodeprivetheBorrowerofthebenefitsoffreeandopencompetition.”

WheneitherpartytotheContractgivesnoticeofabreachofcontracttotheEngineerforacauseotherthanth

oselistedabove,theEngineershalldecidewhetherthebreachisfundamentalornot.

Notwithstandingtheabove,theEmployermayterminatetheContractforconvenience.

IftheContractisterminatedtheContractorshallstopworkimmediately,maketheSitesafeandsecureandle

avetheSiteassoonasreasonablypossibleandhandoverthesitetotheEmployerincludingallmateri

alsandplantandequipmentexistingthereupon.

19.0 Contractor'sownresponsibility

Thecontractoristosetoutandleveltheworksandwillberesponsiblefortheaccuracyofthesame.Hes

hallalsoberesponsibleforthecorrectnessofthepositions,levels,dimensions,andalignmentofallpa

rtsofthestructuresasperinstructionsgiventohim.Ifatanytimeanyerrorshallappearduringtheprog

ressofanypartofthework,thecontractorshallathisownexpenserectifysucherrorifcalledupontoth

esatisfactionoftheEngineerincharge.

20.0 Overpayment&Underpayment

WheneveranyclaimFifthspaymentofasumtotheMunicipalCorporationarisesoutoforunderthisContracta

gainstthecontractorthesamemaybedeductedbytheMunicipalCorporationfromanysumthendue

orwhichatanytimethereaftermaybecomeduetothecontractorunderthiscontractandfailingthat

underanyothercontractwiththeMunicipalCorporationorfromanysumduetothecontractorwitht

heMunicipalCorporation(whichmaybeavailablewithMunicipalCorporation),orfromhisretentio

nmoney,orheshallpaytheclaimondemand.TheMunicipalCorporationreservestherighttocarryo

auditandtechnicalexaminationofthefinalbillincludingallsupportingvouchers,abstracts,etc.

TheMunicipalCorporationfurtherreservestherighttoenforcerecoveryofanyoverpaymentwhendetected

Ifasaresultofsuchauditandtechnicalexaminationanyoverpaymentisdiscoveredinrespectofanyworkdon

ebytheContractororallegedtohavebeendonebyhimunderthecontract,itshallberecoveredbythe

MunicipalCorporationfromthecontractorbywayofallthemeansprescribedaboveorifanyunderp

aymentisdiscoveredbytheMunicipalCorporation,anyamountduetothecontractorunderthiscont

ractorunderpaymentmaybeadjustedagainstanyamountthendueorwhichmayatanytimethereaf

terbecomeduebeforepaymentismadetothecontractorfromhimtotheMunicipalCorporationona

nyothercontractaccountwhatsoever.

21.0 Materialsobtainfromdismantling

Ifthecontractor,inthecourseofexecutionofworkiscalledupontodismantleanypartforreasonsoth

erthanonaccountofbadorimperfectwork,thematerialsobtainedfromdismantlingwillbetheprop

ertyoftheA.M.C.andwillbedisposedofasperinstructionofEngineer-in-

Thedisputesrelatingtothiscontract,sofarastheyrelatetoanyofthefollowingmatters,whethersuc

hdisputesariseduringtheprogressoftheworkorafterthecompletionorabandonmentthereof,sh

allbereferredanindependentArbitratorappointedbyAMCasfarpossibleinconsultationwiththea

gencyifitisnecessaryandsuchdisputesshallbesettledinaccordancewiththearbitrationandconcili

(i) Theratesofpaymentunderclause5foranytools,materialsandstores,inorupontheworks

ofthesitethereoforbelongingtothecontractororprocuredbyhimandintendedtobeused

forexecutionoftheworkoranypartthereofpossessionofwhichmayhavebeentakenbyth

eEngineer-in-chargeunderthesaidclause–5.

(ii) ThereductioninratesmadebytheEngineer-in-

chargeunderclause9fromtheitemsofworksnotacceptedascompletedfullyinaccordanc

ewiththesanctionedspecifications.

(iii) Therateofpartofpaymentforanyclassofworkwhichisincludedintheadditionaloraltered

workcarriedoutbythecontractorinaccordancewiththeinstructionsoftheEngineer-in-

chargeunderclause14andtheratesforwhichistobedeterminedunderthesaidclause14.

(iv) Theratesofpaymentformaterialsalreadypurchasedoragreedtobepurchasedbythecont

ractorbeforereceiptofnoticegivenbytheEngineer-in-

chargeunderclause15and/oramountofcompensationpayabletothecontractorunderth

esaidclauseforlossinrespectofsuchmaterials.

heexecutionoftheworkoranypartthereof.

chargefromutilizingthematerialspurchasedbythecontractorinanyworkorfromremovingsuch

materialstootherplaces,duringtheperiodtheworkisstoppedorsuspendedinpursuance,ofnoti

The work shall consist of furnishing and placing reinforcement to the shape and

dimensions shows as on the drawings or as directed. Steel shall be clean and free from

rust and loose mill scale at the time of fixing in position and subsequent concreting.

Reinforcing steel shall conform accurately to the dimensions given in the bar bending

schedules shown on relevant drawings. Bars shall be bent cold to specified shape and

dimensionsorasdirectedusingaproperbarbender,operatedbyhandorpowertoattain proper

radius of bends. Bars shall not be bent or straightened in a manner that will injure the

material. Bars bent during transport or handling shall be straightened before

reinforcement from corrosion, concrete cover shall be provided as indicated on

coast of neat cement grout. Bars crossing each other where required shall be

As far as possible, bars of full length shall be used. In case this is not possible,

each other, but be kept apart by 25 mm or 1.25 mm times the maximum size of the

coarse aggregate whichever is greater by concrete between them. Where not feasible,
