Rockfall protection, slope stabilization and Debris Flow Protection alongwith other associated miscellaneous works for vulnerable locations from Kheraund (Excluding) to Major Bridge 108 (Excluding ) and Km. 41.500 to 42.220 (on Left Side in increasing chainage direction) & Km. 41.710 to 41.900 (on Right Side in increasing chainage direction) in connection with new BG Line between Tilaiya to Koderma under the jurisdiction of Dy.CE/Construction/ Dhanbad

The tenderer must have minimum average annual contractual turnover of V/N or 'V' whichever is less; where V= Advertised value of the tender in crores of Rupees N= Number of years prescribed for completion of work for which bids have been invited. The average annual contractual turnover shall be calculated as an average of "total contractual payments" in the previous three financial years, as per the audited balance sheet. However, in case balance sheet of the previous year is yet to be prepared/ audited, the audited balance sheet of the fourth previous year shall be considered for calculating average annual contractual turnover. The tenderers shall submit requisite information as per Annexure-C, along with copies of Audited Balance Sheets duly certified by the Chartered Accountant/ Certificate from Chartered Accountant duly supported by Audited Balance Sheet.

Technical Eligibility Criteria (Clause 10.1 of GCC-2022) (a) The tenderermust have successfully completed orsubstantially completed any one ofthe following categories of work(s) during last 07 (seven) years, endinglast day of month previous to the one in which tender is invited: (i) Threesimilar works each costing not less than the amount equal to 30% ofadvertised value of the tender, or (ii) Two similar works each costing notless than the amount equal to 40% of advertised value of the tender, or(iii) One similar work costing not less than the amount equal to 60% ofadvertised value of the tender. (b) (1) In case of tenders for compositeworks (e.g., works involving more than one distinct component, such asCivil Engineering works, S&T works, Electrical works, OHE works etc. andin the case of major bridges - substructure, superstructure etc.),tenderer must have successfully completed or substantially completedany one of the following categories of work(s) during last 07 (seven)years, ending last day of month previous to the one in which tender isinvited: (i) Three similar works each costing not less than the amountequal to 30% of advertised value of each component of tender, or (ii)Two similar works each costing not less than the amount equal to 40% ofadvertised value of each component of tender, or (iii) One similar workeach costing not less than the amount equal to 60% of advertised valueof each component of tender. Note for b (1): Separate completed worksof minimum required values shall also be considered for fulfillment oftechnical eligibility criteria for different components. (b) (2) In suchcases, what constitutes acomponent in a composite work shall be clearlypredefinedwith estimated tender cost of it, as part of thetenderdocuments without any ambiguity. (b) (3) To evaluatethetechnical eligibility of tenderer, only components of work asstipulatedin tender documents for evaluation of technicaleligibility, shall beconsidered. The scope of work covered inother remaining componentsshall be either executed bytenderer himself if he has work experience asmentioned inclause 7 of the Standard General Conditions ofContractorthrough subcontractor fulfilling the requirements as perclause7 of the Standard General Conditions of Contract orjointly i.e., partlyhimself and remaining throughsubcontractor, with prior approval of ChiefEngineer inwriting. However, if required in tender documents by wayofSpecial Conditions, a formal agreement duly notarized,legallyenforceable in the court of law, shall be executed bythe main contractorwith the subcontractor for thecomponent(s) of work proposed to beexecuted by thesubcontractor(s), and shall be submitted along withtheoffer for considering subletting of that scope of worktowardsfulfilment of technical eligibility. Such subcontractormust fulfill technicaleligibility criteria as follows

The subcontractor shall have successfully completed atleast one worksimilar to work proposed for subcontract,costing not less than 35% valueof work to be subletted, inlast 5 years, ending last day of month previousto the one inwhich tender is invited through a works contract. Note:forsubletting of work costing up to Rs.50 lakh, no previousworkexperience of subcontractor shall be asked for by theRailway. Incaseafter award of contract or during executionof work it becomesnecessary for contractor to changesubcontractor, the same shall be donewith subcontractor(s)fulfilling the requirements as per clause 7 of theStandardGeneral Conditions of Contract, with prior approval ofChiefEngineer in writing. Note for Item 10.1: (Clause 10.1 of partIGCC2022) Work experience certificate from privateindividual shall not beconsidered. However, in addition towork experience certificates issuedby any Govt.Organization, work experience certificate issued byPubliclisted company having average annual turnover of Rs 500crore andabove in last 3 financial years excluding thecurrent financial year, listedon National Stock Exchange orBombay Stock Exchange,incorporated/registered at least 5years prior to the date of closing oftender, shall also beconsidered provided the work experience certificatehasbeen issued by a person authorized by the Public listedcompany toissue such certificates. In case tenderer submitswork experience,certificate issued by public listedcompany, the tenderer shall also submitalong with workexperience certificate, the relevant copy of work order,billof quantities, bill wise details of payment received dulycertified byChartered Accountant, TDS certificates for allpayments received andcopy of final/last bill paid bycompany in support of above workexperience certificate.

The tenderer shall clearly specify whether the tenderissubmitted on his own (Proprietary Firm) or onbehalf of aPartnership Firm / Company / JointVenture (JV) / RegisteredSociety / Registered Trust /Hindu Undivided Family (HUF) /Limited LiabilityPartnership (LLP) etc. The tenderer(s) shallenclosethe attested copies of the constitution of theirconcern,and copy of PAN Card along with theirtender. Tender Documentsin such cases are to besigned by such persons as may be legallycompetentto sign them on behalf of the firm,company,association, trust or society, as the case may be.

If it is NOT mentioned in the submitted tender thattender isbeing submitted on behalf of a SoleProprietorship firm /Partnership firm / Joint Venture /Registered Company etc., thenthe tender shall betreated as having been submitted by theindividualwho has signed the tender.

After opening of the tender, any documentpertaining to theconstitution of Sole ProprietorshipFirm / Partnership Firm /Registered Company/Registered Trust / Registered Society /HUF/LLP etc.shall be neither asked nor considered, ifsubmitted.Further, no suo moto cognizance of anydocumentavailable in public domain (i.e., on internet etc.) orinRailway's record/office files etc. will be taken forconsiderationof the tender, if no such mention isavailable in tender offersubmitted.

The tenderer whether sole proprietor / a company orapartnership firm / joint venture (JV) / registeredsociety /registered trust / HUF / LLP etc if they wantto act through agentor individual partner(s), shouldsubmit along with the tender, acopy of power ofattorney duly stamped and authenticated byaNotary Public or by Magistrate in favour of thespecific personwhether he/they be partner(s) of thefirm or any other person,specifically authorizinghim/them to sign the tender, submit thetender andfurther to deal with the Tender/ Contract up tothestage of signing the agreement except in casewhere suchspecific person is authorized for abovepurposes through aprovision made in thepartnership deed / Memorandum ofUnderstanding /Article of Association/Board resolution, failingwhichtender shall be summarily rejected. A separatepower ofattorney duly stamped and authenticatedby a Notary Public orby Magistrate in favour of thespecific person whether he/they bepartner(s) of thefirm or any other person, shall be submittedafteraward of work, specifically authorizing him/them todeal withall other contractual activities subsequentto signing ofagreement, if required. Note: A Powerof Attorney executed andissued overseas, thedocument will also have to be legalized bytheIndian Embassy and notarized in the jurisdictionwhere thePower of Attorney is being issued.However, the Power ofAttorney provided by Biddersfrom countries that have signedthe HagueLegislation Convention 1961 are not required tobelegalized by the Indian Embassy if it carries aconformingAppostille certificate.

(a) The tenderer shall clearly specify whether the tender issubmitted on his own (Proprietary Firm) or on behalf of aPartnership Firm / Company / Joint Venture (JV) / RegisteredSociety / Registered Trust / HUF etc. as the case may be.Following documents shall be submitted by the tenderer: - (b)Following documents shall be submitted by the tenderer in caseof Sole Proprietorship Firm; (i) An undertaking that he is notblacklisted or debarred by Railway or any othr Ministry/Department of Govt. of India from participation in tender on thedate of opening of bids, either in individual capacity or as amember of the partnership firm or JV in which he was /is apartner/member. Concealment /wrong information in regard toabove shall make the contract liable for determination underClause 62 of the General Conditions of Contract. (ii) All otherdocuments in terms of Para 10 of the Tender Form (SecondSheet) of GCC-2022. (c) Following documents shall be submittedby the tenderer in case of HUF; (i) A copy of notarized affidaviton stamp paper declaring that he who is submitting the tenderon behalf of HUF is in the position of Karta of Hindu UndividedFamily (HUF) and he has the authority, power and consent givenby other members to act on behalf of HUF. (ii) An undertakingthat the HUF is not blacklisted or debarred by Railway or anyother Ministry /Department of Govt. of India from participation intender on the date of opening of bids, either in individualcapacity or as a member f the partnership firm or JV in whichHUF was / is a partner/member. Concealment/wrong informationin regard to above shall make the contract liable fordetermination under Clause 62 of the General Conditions ofContract. (iii) All other documents in terms of Para 10 of theTender Form (Second Sheet) of GCC-2022. (d) Followingdocuments shall be submitted by the tenderer in case ofCompany registered under Companies Act 2013; (i) The copiesof MOA(Memorandum of Association) / AOA (Articles ofAssociation) of the company (ii) A copy of Certificate ofIncorporation (iii) A copy of Authorization /power of Attorneyissued by the Company (backed by the resolution of Board ofDirectors) in favour of the individual to sing the tender on behalfof the company and create liability against the company. (iv) Anundertaking that the Company is not blacklisted or debarred byRailways or any other Ministry / Department of Govt. of Indiafrom participation in tender on the date of opening of bids,either in individual capacity or as a member of the partnershipfirm or JV in which the Company was / is a partner/member.Concealment / wrong information in regard to above shall makethe contract liable for determination under Clause 62 of theGeneral Conditions of Contract. (v) All other documents in termsof Para 10 of the Tender Form (Second Sheet) of GCC-2022

Definition of Similar Nature of Work:- "Tenderer must have completed Any work involving slope protection in cutting by using high strength wire netting and rock bolting with minimum quantity of high strength wire netting 70000 sqm in the same single work. They should also have executed the work of debris flow barrier as per typical elevation and technical specification as provided in tender document in the same or another completed work. Apart from above, they should also have an experience of supply and installation of any type of early warning / alert system over high strength wire netting in the same or any other completed work."
