TENDER SPECIFICATIONS

1) Bidders have to submit their offer online only

2) The technical scrutiny committee of PGVCL shall evaluate the technical view of the tender.

PGVCL reserves the right to open or not to open the price bid of the bidders on the basis of their

past performance of their services.

Incomplete bids, amendments and additions to bids after opening of the bids will be ignored

The price bid of those who are technically qualified shall be opened. After technical bid is

opened, for modification, if any, all shall be given equal chance.

3) TENDER FEES & E.M.D.:

Tender fees & EMD fees to be paid online only.

4) Bidders have to submit Technical bid documents and price – bid (Schedule – A) on-line only and

not to submit in physical form (Except tender fees & EMD proof in case of payment made through

cash receipt/DD/Banker‟s cheque). This is mandatory. If it is submitted in physical form, same will

not be opened and only on –line submitted bids will be considered for evaluation.

5) POST TENDER CORRESPONDENCE / ENQUIRIES:-

Any correspondence or enquiry subsequent to opening of Technical and Commercial bids are not

9) All prevailing rules of PGVCL regarding works are applicable to vendor which are not mentioned

in this tender copy.

10) If any matter, public dispute arise between PGVCL and Contractor, Contractor is permitted to

represent the matter up to tender issuing authority only and decision of the tender issuing authority

will be final and binding to Contractor.

11) OBJECTIVES :

It is proposed to start stated work with your man power & tools & tackles in RSO,Rajkot under Rajkot

City Circle. The contractor has to engage required strength of skilled persons for execution of work

and proper supervisor to avoid complication and unnecessary delay to complete work timely. The

contractor will be solely responsible for labor claims arising out of the labor employed for this job. The

contractor has to co-ordinate and co-operate fully with Engineer In Charge and for execution of the

12) SCOPE OF WORK

The scope of work will include following:

I. Materials are readily available and arrangement made to procure the rest. However, the contractor

should be prepared to carry out the work as and when the materials are received. No idle labor

charges will be paid by the PGVCL in case such occasion of idle labor arises, due to want of any

II. The contractor will be fully answerable and responsible any theft and loss of pilferage shall have to

be borne by the contractor.

III. You will have to submit fortnightly progress report regularly in duplicate to Engineer In Charge .If

found that the work is unsatisfactory or not progressing as per schedule then any action would be

taken by the PGVCL as may deemed fit to see that work is completed at the risk and cost of

contractor. The completion time allowed shall be strictly observed. If the work is not completed

within the scheduled period, penalty at the rate of 1/2% of the contract value (of delayed work) per

month or part thereof the contract value subject to the maximum of 10% of the total contract value

will be levied. This will be deducted from the bills payable either against this contract or any bank

guarantee or any other amount payable under any other contract with the PGVCL .

IV. No higher rate or revised rate will be application for the work, if work is held-up/ closed due to

whatever so reasons.

V. R.A. Bill shall be paid by the PGVCL, if it satisfy with the output of works otherwise only final bill

VI. The time limit for the work may be reduced and contractor should make all his efforts to complete

the work within stipulated time limit as may be given by the Engineer In Charge depending upon

emergency of work.

VII. The contractor has to remain in closed contact with Engineer In Charge of work who in turn shall

issue detailed instruction for the commencement of the work.

VIII. The contractor has to maintain site register covering all aspects of material Received / utilized for

day to day work and has to obtain signature of Engineer In Charge.

IX. The contractor will be solely responsible for any accident/damage either to equipments or any human

being during the time of execution of work.

X. Contractor will have to make his own arrangement for required all kinds of tools, tackles, required

for the execution of work.

XI. The cost of damages, if any will be recovered from the Contractor‟s bill. The assessment of which

will be done by Engineer In Charge in consultation with division office, and his sole discretion and

his decision shall be binding to the contractor and shall be considered as final and unchallengeable..

XII. The contractor shall not refuse to execute the work order at any time and it will be his sole

responsibility to execute and complete this work as per the instruction of Engineer In Charge.

XIII. The period of the contract will be of one year & PGVCL has right to extend the period of contract for

further one year with same terms and condition in concurrence with Bidder. As well as, also PGVCL

have also right to extend the period of contract for further three months with same terms and

condition without concurrence with bidder, in company interest work. Similarly PGVCL has right to

terminate the contract without showing any reason with one month notice.

XIV. All the materials issued by PGVCL shall be transported to the work site in same day and to be

preserved in safe custody failing to which PGVCL shall initiate Police action. Similarly as per

instruction of Engineer In Charge, you have to credit the material at PGVCL store without any loss

of time failing to which PGVCL shall initiate Police action.

XV. The contractor has to follow all labour laws, safety rules and regulations. The PGVCL does not take

any responsibility in case of accident or injury to the workers. The safety, security of men, materials

and equipments shall be sole responsibility of the contractor.

XVI. The bidder shall specifically note that PGVCL will not pay any extra amount towards any type of

claim except for the description indicated in Schedule –D. The party has to carry out all other

additional required activities / work as directed by Engineer In Charge which is not mentioned in

Schedule but required to be completed as per the site condition and for this work no extra payment

shall be made by PGVCL.

XVII. The quantity mentioned in scheduled – D is approximate. The payment will be made as per

actual work carried out.

14) PAYNMENT OF SECURITY DEPOSIT ::

Security Deposit will have to be paid by successful bidder 5% (Five percent) of the total contract price

within 7 days after receipt of LOA at City Circle , PGVCL, Rajkot. The amount will be paid in DD or

bank guarantee. The bank guarantee of nationalized bank shall be valid up to 120 days after the

completion of the entire contract work period.

15) AGREEMENT & BOND ::

As per company‟s rule an agreement on stamp paper of appropriate value is to be done in the prescribed

form after the receipt of LOA within 07 days. The conditions, specifications, price-schedule and

contract work booklet are to be signed by the bidder. The agreement will be done by Superintending

Engineer, City Circle, Rajkot behalf of PGVCL. You have to execute bond of value as per norms. The

cost Rs.300.00 of the Stamp Paper will have to be borne by the contractor.

16) P.F CODE ::

The contractor shall have a separate provident fund code of RPFC and the Contractor who do not

possess separate P.F.Code shall not be considered for acceptance of tender. Contractor has to upload

such certificate showing separate P.F.Code along with tender.

17) SUBMISSION OF BILLS ::

You should have to submit the bills regularly in triplicate along with relevant documents wherever

applicable, to the Deputy Engineer, PGVCL RSO, Rajkot. If you are late or not submitting the bills

within time limit, PGVCL is not responsible for late OR non payment of the bills.

18) PAYMENT TERMS ::

Payment will be done on monthly basis. You will have to submit bill at the end of a month for work

carried out during the month. Bill will be checked by Dy. Engineer of RSO,Rajkot processed for

payment as per procedure of P.G.V.C. Ltd. Payment will be made within thirty days of receipt of the

bill duly certified by Dy. Engineer, RSO, Rajkot, after payment made by City Circle,Rajkot.

19).Stop deal / Black listed contractor / supplier in GUVNL or its any subsidiary company should not be

participated in tender competition, if found the offer of the contractor / supplier should be out rightly

TERMS & CONDITIONS REGARDING INDUSTRIAL LAWS AND OTHER RELATED MATTERS:

1.Wages to be paid at the time of payment etc. by the contractor

(a) The contractor shall pay minimum prevailing rates per day or as may be specified here after or rates

fixed under the Minimum Wages Act, whichever is higher. The wages of every contract labour employed

by him under this contract shall be paid by him before the expiry of 7th day of the month irrespective of

which the wages are payable i.e. wages of the last month have to be paid by him in the first week of the

next month). The payment shall be distributed in the presence of management representative during the

working hours in factory premises and the contractor shall get the entries certified in the register of

wages by the representative of the Company. Any default will result in cancellation of contract forthwith

or also the contract shall be paid punishable to the extent of Rs.100/- fine per each day.

(b) The contractor shall give his telephone number and address to the Company so that in case of labour

troubles etc. the contractor can be contacted. The contractor shall arrange to have his office outside the

factory premises and the contractor shall keep himself present through out the working hours.

2. LABOUR LAWS.

(a) Person below the age of 18 years shall not be employed of the work.

(b) No female worker shall be employed in the shift between 7 P.M. to 6 A.M.

(c) Contractor shall maintain a valid labour license under the contract labour (Regulation and

abolition) Act for employing necessary manpower to be required by him. It is liable to be terminated

without assigning any reason,

(d) The contractor shall at his own expenses comply with labour laws and keep the Company

Indemnified in respective thereof. Some of the major liabilities under various labour and industrial

laws which the contractor shall comply with are as under.

(i) Payment of contribution by way of employer‟s contribution towards provident fund. Family Pension

Scheme, Deposit Inked Insurance Scheme, Administrative Charge etc. at the rates made applicable

from time to time by Government of Gujarat/Govt. of India or other statutory authority.

(ii) Payment of deposit in respect of contract labour at the rate as per admissible with the office of

Commissioner of labour as per the Contract Labour (Regulation and Abolition Act).

(iii) License fee as prescribed under the Contract labour (Registration and abolition Act) and rules

framed there under depending upon the number of workmen employed by the contractor.

(iv) Paid leave facility and wages as per the provision of the Factories Act at the rate of one day for

every 20 days of working.

(v) Identity Cards prescribed under the Factories Act with Photo affixed thereto the same identification.

(vi) Payment of retrenchment compensation notice pay and other liabilities as per industrial deposit act

any payment to the contractor‟s employees arising out of any claim or disputes under the Industrial

Disputes Act 1947 or any other labour law.

(vii) Payment of compensation in case accidental injury.

(viii) Maternity leave as per the provisions of the Maternity Benefit Act. The above are some of the

major liabilities of the contractor in addition to other liabilities. Prescribed under the various labour

laws in force from time to time from statutory authorities like State Government/Government of

India which the contractor shall have to comply with.

(ix) Provision of crèche if the female labours employed are more than 30 nos.

3. PROVIDENT FUND & FAMILY PENSION SCHEME

The contractor shall submit along with his bill (month wise) a statement regarding deduction against

employees provident fund and family pension scheme in respective of each concerned employee

provident fund and family pension scheme at the rate at admissible (or at rate made applicable by

the Government from time to time) of the wage. The contractor shall deposit the contractor‟s

contribution and his workers contribution towards provident fund and family pension scheme with

Regional Provident Fund Commissioner, Ahmedabad.

4. DEPOSIT LINKED INSURANCE SCHEME

The contractor shall have to deposit ½% of the wages in respect of employees who is a member of the

Provident Fund as the contribution to the deposit. Linked Insurance Scheme with Regional Provident

Fund Commissioner, Ahmedabad.

5. ADMINISTRATIVE CHARGES

The contract shall deposit administrative charges maintaining provident fund A/c with Regional

Provident Fund Commissioner, Ahmedabad.

6. PAID LEAVE FACILITY

The contract shall provide paid leave facility at the rate of one day for every twenty days worked by

the contract labour to his workers. He shall maintain leave reports/leave card for individual laborer

which shall be duly verified and approved/certified by the authorized officer of the Company.

7. WORKMEN’S COMPENDATION FUND & EMPLOYERS LIABILITY INSURANCE

The contractor shall cover all his employees under workmen‟s compensation fund and under the

liability insurance.

8. The contractor shall employ adequate number of an experienced staff at site for daily supervision and

for maintenance of various register and records required under the law and contract. No payment for

supervision shall b admissible.

9. CONTRACTOR TO INDEMNIFY THE COMPANY

The contractor shall indemnify the Company and every member officer and employees of the

Company, also engineer in charge and his staff against all actions, proceedings, claims of demands,

coasts and expenses, which may be made against the Company or Government for or in respective of

or performance of his obligation under the contract documents the Company shall not liable for or in

respective of or in consequence of any accident or inquiry to any workman or other person in the

employment of the contractor or his sub-contractor and the contractor shall Indemnify and keep

indemnified the Company against all such damage and compensation and against all claims, demands,

proceedings costs, charges and expenses whatsoever in respective thereof in relation thereto.

10. WORKER’S COMPENSATION AND EMPLOYER’S LIABILITY INSURANCE

Insurance shall be effected for all the contractor‟s employee engaged in the performance of this

contract if any of the work is subject the contractor shall require the sub-contractor to provide

workmen‟s compensation and employers liability insurance for the letter‟s employees unless such

employees are covered under the contractor‟s insurance.

11. The Company reserve the right to terminate this rate contract at any time during its tender

without giving notice of termination or any reasons thereof.

12. The Company will be entitled to deduct directly from the bills to be paid to the contractor any sum or

payable by you and which sum/sums the company is required to pay as principal employer on account

of your default in respect of all liabilities referred to in above clauses.

13. Only after production of personal P.F. code tender will be issued.

14. Also all contractors should ensure that all Labour Laws and Provisions of E.P.F. and M.P.Act-1952

should be fulfilled in all respect strictly.

15. The PGVCL shall not be responsible for any accident/loss/damage to PGVCL‟s property or

contactor‟s labours/ technician arising out of any accident (Electrical or Mechanical) during execution

16. No deviation in terms & condition in Schedule-C and Technical Specification will be entertained. All

the documents related to this Tender shall be final and binding to all the bidders. Any ignorance for this

shall not relieve the contractor from their contractual liability arising as per Tender documents.

17. The bids should be valid for a minimum period of 90 days from the date of opening, during this period

no tenderer shall be allowed to withdraw his tender. Any such withdrawal during the said period will

entail for forfeiture of Earnest Money Deposit submitted with the tender.

18. The contractor shall have a separate provident fund code of RPFC and the Contractor who do not

possess separate P.F.Code shall not be considered for acceptance of tender. Contractor has to upload

scan copy of such certificate showing separate P.F.Code along with tender bid.

19. AVAILABILITY OF MATERIALS AND IDLE LABOUR CHARGE :

Materials are readily available and arrangement made to procure the rest. However, the contractor

should be prepared to carry out the work as and when the materials are received. No idle labour

charges will be paid by the PGVCL in case such occasion of idle labour arises, due to want of any

Compensation Act, Insurance Rules etc. or any other act, rules or regulations that have to be observed

by the contractor for carrying out the work.

21. The contract will be governed by the company as per works terms & conditions of the company.

22. ACCOUNTING OF PGVCL MATERIALS ::

The contractor will be faulty answerable and responsible for all the material issued to him for the work

by the PGVCL, any theft and loss of pilferage shall have to be borne by the contractor.

23. PROGRESS OF WORK AND PENALTY ::

You will have to submit fortnightly progress report regularly in duplicate to Engineer In Charge and

Deputy Engineer,PGVCL,RSO , Rajkot. If found that the work is unsatisfactory or not progressing as

per schedule then any action would be taken by the PGVCL as may deemed fit to see that work is

completed at the risk and cost of contractor. The completion time allowed shall be strictly observed. If

the work is not completed within the scheduled period, penalty at the rate of 1/2% of the contract value

(of delayed work) per month or part thereof the contract value subject to the maximum of 10% of the

total contract value will be levied. This will be deducted from the bills payable either against this

contract or any bank guarantee or any other amount payable under any other contract with the PGVCL.

24. Contractor will not be allowed to work after working hours except in special case, if any.

25. The contractor has to engage required strength of skilled persons for execution of work and proper

supervisor to avoid complication and unnecessary delay to complete work timely. The contractor will

be solely responsible for labour claims arising out of the labour employed for this job.

26. The tenderer should furnish details of past experience of such job of similar nature completed by him

satisfactorily within the time limit in PGVCL will be preferable.

27. The tenderer will be abide by and fulfil at the terms and provisions of the “Tender and contract” for

works as applicable and in case of any default there to the PGVCL Company shall forfeit the S.D. or

any other action as may be decided by Superintending Engineer PGVCL, City Circle, Rajkot.

28 The contractor has to co-ordinate and co-operate fully with Engineer In Charge and for execution of

29. In case of any dispute doubt, the decision of Superintending Engineer PGVCL, City Circle,

Rajkot.shall be unchallengeable and final, which will be binding to the contractor.

30. The quantum of work as mentioned in Estimate Schedule-“D” is tentative and it can differ as per site

condition. The payment shall be made only on actual work executed or order quantity whichever is

31. Security Deposit will be refunded after completion of guaranteed period if any.

32. All legal complication of disputes is subject to RAJKOT jurisdiction only.

33. No higher rate or revised rate will be application for the work, if work is held-up/ closed due to

whatever so reasons.

34. R.A.Bill shall be paid by the PGVCL, if it satisfy with the output of works otherwise only final bill

35. The time limit for the work may be reduced and contractor should make all his efforts to complete the

work within stipulated time limit as may be given by the Engineer In Charge depending upon

emergency of work.

36. The contractor has to remain in closed contact with Engineer In Charge of work who in turn shall issue

detailed instruction for the commencement of the work.

37. The contractor has to maintain site register covering all aspects of material received/utilized for day to

day work and has to obtain signature of Engineer In Charge.

38. Contractor will abide by and fulfill all the terms and conditions and general terms and condition of the

contract for works as per company‟s rules.

39. The contractor will be solely responsible for any accident/damage either to equipments or any human

being during the time of execution of work.

40 All other general terms and conditions as prevailing in the PGVCL shall be applicable to this work

41. Either you or your authorized person should contact our Engineer In Charge as well as RSO, PGVCL,

Rajkot daily for the availability of materials required for this work, failing to which this work order

shall be terminated without giving any notice.

42 Prior institution in writing for starting the job will be given by PGVCL for the work.

44. Contractor will have to make his own arrangement for required all kinds of tools, tackles, required for

the execution of work.

45 The cost of damages, if any will be recovered from the Contractor‟s bill. The assessment of which will

be done by Engineer In Charge in consultation with division office, and his sole discretion and his

decision shall be binding to the contractor and shall be considered as final and unchallengeable.

46. The contractor will have to give indemnity bond to PGVCL against any possible claim of

compensation for damage ton contractor‟s equipment or any of third parties during the execution of

47. The contractor will have to complete entire job as per directive and instruction of engineer in charge. If

he fails to do so entire work will be carried out at the risk and cost of contactor.

48. The contactor must engage sufficient knowledgeable person round the clock, exclusively for execution

49. The tender shall be issued to only experienced contactor who has complied such job of similar nature

and magnitude satisfactorily in time. However, issuance of blank tender, will does not qualifies the

tenderer to officer the bid.

50. The Contractor will governed by the PGVCL general conditions of works contract. The Booklet will be

available in the concerned office in any working days. In the event of placing order, the Contractor will

be bound to the terms & conditions of the booklet. All the usual terms and conditions of the Company

though the same might have not been mentioned in this specification or contractor booklet will

applicable to this contract, and the decision of the Superintending Engineer PGVCL, City Circle,

Rajkot.shall be binding on the Contractor.

51. After completion of the work, all the surplus materials issued by the PGVCL shall be returned by you

to the respective Subdivision of the PGVCL as per instruction of Engineer In Charge at your cost.

52. Specification in any items mentioned in tender are subject to change without any prior notice and

binding to the contractor.

53. The PGVCL shall deduct the Income-Tax and other taxes GST TDS @2 % on contract value as per

prevailing rules of all relevant Govt. Authorities from the bill.

54 If the work is required to be carried out during fix outage then the contractor has to deploy adequate

man power, material, tools etc. well in advance and has to complete the entire work during this specific

outage period only, failing to which Company shall be at liable to deduct the amount of revenue loss

due to prolong outage.

55. The tender include all minor accessories and items of work which may not have been specifically

mentioned in the specification / Schedule etc. but are essential for completion of work. The contractor

will not be eligible for any extra payment in respect of such minor accessories and item of work.

56. The contractor shall not refuse to execute the work order at any time and it will be his sole

responsibility to execute and complete this work as per the instruction of Engineer In Charge..

57. For shortage of any materials issued by the PGVCL for the work, recovery shall be made from you, on

the basis of prices of the materials (prevailing on the date of settlement of materials

account) plus 15% supervision charges.

58. The contractor has to carry out all the works in accordance with revised and latest provision under I.T.

Rule Act made there under and as per instruction of Engineer In Charge.

59. The S.S.I. industries will be exempted from the payment of Security Deposit provided a competency

certificate is issued by the Regional Division Officer of the National Small Scale Industries

Corporation to the effect that the firm is capable of executing the order.

60. All the materials issued by PGVCL shall be transported to the work site in same day and to be

preserved in safe custody failing to which PGVCL shall initiate Police action. Similarly as per

instruction of Engineer In Charge, you have to credit the material at PGVCL store without any loss of

time failing to which PGVCL shall initiate Police action.

61. Any delay causing extension of outages shall be contractor‟s responsibility and appropriate amount (in

term of Rupees) as decided by Superintending Engineer PGVCL, City Circle, Rajkot.shall be

recovered from contractor‟s bill as a penalty.

62. The Superintending Engineer PGVCL, City Circle, Rajkot., reserve rights to reject any or all the

tenders without assigning any reasons thereof. Issuance of blank tender does not automatically

qualifies the tenderers for award.

63. No tools, tackles, manpower, crane facilities etc. will be provided by the PGVCL.

64. The contractor has to follow all labour laws, safety rules and regulations. The PGVCL does not take

any responsibility in case of accident or injury to the workers. The safety, security of men, materials

and equipments shall be sole responsibility of the contractor.

65. The bidder shall specifically note that PGVCL will not pay any extra amount towards any type of

claim except for the description indicated in Schedule –D. The party has to carry out all other

additional required activities / work as directed by Engineer In Charge which is not mentioned in

Schedule but required to be completed as per the site condition and for this work no extra payment

shall be made by PGVCL.

(a) Electricity Rules:-All the works shall be carried out in accordance with latest rules under Electricity

In case of any doubts about what is mentioned in specification or schedule of elsewhere, the tenderer

should get all doubts cleared from the Department in writing and in advance before filling in the tender.

In case of difference of opinion about interpretation of specification etc. the

decision of the Superintending Engineer PGVCL, City Circle, Rajkot. will be final and shall be binding

to the contractor.

(d) Account of material issued :-

The contractor shall have to maintain accurate day to day item wise account of use of issued

materials which shall be got checked from time to time by the Engineer In Charge of the

Company. The contractor will be responsible for custody and preserving the issued materials till

the work is hand over by the contractor after completion.

(e) The contractor has to maintain site register, covering all the daily details of material receipt and

utilization, progress of work etc. This register shall be checked and signed by Engineer In Charge during

the site visit as per requirement and exigency of work if deem fit.

The erection work should be carried out according to the specification and as per instruction and

programme laid out by the Engineer In Charge of the work.

The quantities mentioned in the accompanying schedule are only approximate. Actual quantities will be

decided after detailed survey and the same may decrease or increase according to the site conditions, the

department reserves the right for revising or omitting any of the quantities. The quantities actually executed

by the contractor will be calculated at the rate given in the contract schedule of the rates binding to the

This agreement is made at Rajkot _____ (hereinafter

referred to as “The Contractor”) which expression shall unless excluded by or repugnant to the

context included its successors or permit assigns of the one part and the PGVCL having this Head

Office, At Nana Mava main road, Laxminagar, Rajkot (hereinafter called “The PGVCL” which

expression shall unless excluded by or repugnant of the context include its successors of assigns)

of the other part.

Whereas the aforesaid PGVCL has accepted the tender of the aforesaid contractor

for __________________________. as per PGVCL’s LOA Order No_____________________

hereinafter called “The works” and more p articularly desorbed enumerated or referred to in

specifications, terms and other letters and schedule or price which for the purpose of identification

have been signed by_________ on behalf of the Contractor and The Superintending Engineer PGVCL,

City Circle,Rajkot on behalf of the PGVCL,a list where of is made out in the schedule here under written

and all of which said documents are deemed to form part of this contract and include in

the expression “The Works” wherever herein used, upon the terms and subject to the

conditions hereinafter mentioned. And whereas the PGVCL has accepted the tender of the contract

for _______________________. up on the terms and subject to the conditions herein mentioned.

1.The contractors shall do and perform all works and things in this contract mentioned and described

or which are implied therein of there form respectively or are reasonable necessary for the completion

of the work as mentioned and at the time in the manner and subject to the terms and conditions

and stipulation contained in this contract and in consideration on the due provision, executions,

contusion and completion of the work agreed to by the contractor as aforesaid the PGVCL both

hereby convenient with the contractor to pay all the claim of money as and then they become due

and payable to the contractor under provision of the contract such payment to be made at such times

in such manner as is provided by the contract.

The conditions and convenient stipulation herein before in this contract are subject to and without

prejudice to the right of the PGVCL to enforce for delay and or any other right to reject and cancel

on defaulter breach by the contract of the conditions and the convenient as stipulated in the

general conditions specifications form or tender schedule drawing etc. attached with the PGVCL Order

The contract value extent of supply delivery dates, specifications as other relevant matters may

be altered by mutual agreement and if so altered shall to be deemed of constructed to mean and

to effect or alter other terms and conditions of the contract and the contract so altered or revised

be and shall always be deemed to have been subject.

In consideration of the Paschim Gujarat Vij Company Limited hereinafter

known as the Vij Company having given contract for the work of

___________________ as per Work Order ________________aAnd all future

contract that may be awarded to me in the next one year and in terms of the

condition in Clause 33 of the Vij Company tender and contract for work.

I, ____________ residing at Rajkot City by this Bond bind myself responsible for

and shall pay compensation to my workmen payable under the workmen’s

compensation Act-1923 (viii of 1923) hereinafter called the said Act for death or

injuries caused to the workmen engaged by this presents, if such compensation is

paid by the Vij Company as principal under such Sub-Section )1) of Section 12 of

the said Act on behalf of me, to pay such amount of compensation on demand

within 48 hours to the Vij Company that it might have to send as legal and other

incidental charges in defending any suit or action arising out of the death of injuries

in regard to compensation paid to the workmen or heir of the deceased workmen.

For the condition of the said written bond is such as a suit or action arising out of

the death on injuries to the workmen engaged by me. During the execution of the

work of said contract and all future contracts that may be awarded to me in the next

one year is filed by the worker against PGVCL.

I, _____________ shall reimburse to PGVCL such sum that PGVCL is required

to the spend as legal and other incidental charges in defending such suit or action

and also the amount that may be ordered to be paid to the worker/or his heir as

compensation and that the above written bind shall remain in full force and virtue till

PGVCL is required to defend such suit or action filed by the workers and or heirs
