ELIGIBILITY CRITERIA : 1.Works Experience; The contractor should have satisfactorily completed "one similar single service contract for a minimum of 35% of advertised value of the bid to Zonal Railways/PUs of Indian Railways/Government Organisation /PSUs/ Large Scale Private Organisation" in the last three previous financial years and the current financial year up to the date of opening of the tender. A copy of Original Completion Certificate as a proof of Documentary evidence for Work Experience duly signed and stamped by Gazetted Officers in case of Railways/Government Organisation and Management Official in case of PSU/Large Scale Private Organisation should be attached along with offer. failing which the offer will be considered as non- compliance with respect to Work Experience. Similar work definition: "Any kind of Logistics/Transportation by using material handling equipment with or without Involving labor". 2. Financial Standing: The contractor will be qualified only if they have minimum financial capabilities as below;- The contractor should have an annual financial turnover not less than 1.5 times the advertised bid value during the last three previous financial years and in the current financial year up to the date of opening of the tender. The audited balance sheet reflecting financial turnover certified by chartered accountant with her stamp, signature and membership number shall be considered for opening their financial bids. PERFORMANCE GUARANTEE : a)The successful bidder shall submit the Performance Guarantee (PG) amounting to 5% of the original contract value The successful bidder shall have to submit a Performance Guarantee (PG) within 21 (Twenty one) days from the date of issue of Letter of Acceptance (LOA). Extension of time for submission of PG beyond 21 (Twenty one) days and upto 60 days from the date of issue of LOA may be given by the Authority who is competent to sign the contract agreement. However, a penal interest of 12% per annum shall be charged for the delay beyond 21(Twenty one) days, i.e. from 22ndday after the date of issue of LOA. Further, if the 60thday happens to be a declared holiday in the concerned office of the Railway, submission of PG can be accepted on the next working day. In all other cases, if the Contractor fails to submit the requisite PG even after 60 days from the date of issue of LOA, the contract is liable to be terminated. In case contract is terminated railway shall be entitled to forfeit Bid Security and other dues payable to the contractor against that particular contract, subject to maximum of PG amount. In case a tenderer has not submitted Bid Security on the strength of their registration as a Startup recognized by Department of Industrial Policy and Promotion (DIPP) under Ministry of Commerce and Industry, DIPP shall be informed to this effect. The failed Contractor shall be debarred from participating in re-tender for that work. b)The successful bidder shall submit the Performance Guarantee (PG) in any of the following forms, amounting to 5% of the original contract value:- (i)A deposit of Cash; (ii)Irrevocable Bank Guarantee; (iii)Government Securities including State Loan Bonds at 5% below the market value; (iv) Pay Orders and Demand Drafts tendered by any Scheduled Commercial Bank of India; (v) Guarantee Bonds executed or Deposits Receipts tendered by any Scheduled Commercial Bank of India; ( v i ) Deposit in the Post Office Saving Bank; (vii)Deposit in the National Savings Certificates; (viii)Twelve years National Defence Certificates; (ix) Ten years Defence Deposits; (x) National Defence Bonds (xi) Unit Trust Certificates at 5% below market value or at the face value whichever is less. Also, FDR in favour of FA&CAO (free from any encumbrance) may be accepted. c)All other conditions related to PG as per para 16.4 of GCC for services are applicable.

1) It is certified that the above item is required for use in rail coaches. 2) A string ICF should be prefixed to the invoices uploaded by the suppliers of ICF in to the GSTIN. 3) The Purchaser shall not be responsible for any misclassification of HSN number or incorrect GST rate, if quoted by the bidder. Wherever the successful bidder invoices the goods at GST rate or HSN Number which is different from that incorporated in the purchase order payment shall be made as per GST rate which is lower of the GST rate incorporated in the purchase order or billed. Whenever necessary, vendors will be required to adjust the basic price to the extent required by higher tax billed as per invoice to match the allinclusive price as mentioned in the purchase order. 4) GST is Payable against documentary proof of firm's offer/MA. 5) If any condition / clause in this document is not as per firm's offer the same should be represented within 7 working days failing which it will be deemed unconditional acceptance of the supplier and no representation thereafter will be entertained by the purchaser on this account. 6. Traceability details such as manufacturers name, month & year of supply shall be necessarily provided on the components as specified in the relevant drawings, failing which item shall be rejected by the inspecting authority. 7. Stage inspection, if any shall be carried out as per the requirements given in the specification.
PAYMENT TO LABORERS : All labour engaged should be paid salary not less than the rates specified by the Chief Labour Commissioner for Industrial Workers published for the period starting from first April and first October of the year concerned.
OTHER IMPORTANT CONDITIONS : 1. The contractor should strictly shall abide to Factories Act, Labour Rules, Safety regulations, TNPCB regulations etc., which are in force. 2. The vehicles used inside the factory by the contractor must have valid Fitness certification issued by the Regional Transport Office and Pollution test certificate as prescribed by TNPCB. 3. The contractor shall be responsible to take necessary precautionary measures in order ensure the safety against injury, etc., for his personnel when working at the Railway premises and should follow the safety procedures, rules and regulations of Railway. 4. The contractor shall obtain valid Labour License, Gate Entry Permit cards for all employees deployed for the work from the Principle Chief Security Commissioner / ICF through Chief Safety Officer /Fur duly submitting the necessary documents, proof of identity, proof of address, Police verification Certificate, ESI/WCA etc. In case of extension of contract, the permits should be obtained well in advance by submitting requisite documents. 5. All the workmen and Supervisor engaged by the contractor shall wear uniforms while they are inside the ICF premises for easy identification. 6. Drivers employed for operating Fork Lifts shall have valid and appropriate Licences/Medical certificates and relevant field experience. 7. Fork Lifts deployed for the work shall have unique identification number and shall be that certified by competent person approved by Inspector of Factories. FLTs deployed shall be in good working condition with automatic reverse horn facility. 8. The contractor shall ensure that the persons employed by him/her inside the factory should wear Personal protective equipments viz. Safety Shoes, Helmets, Hand gloves, Goggles and Uniform etc. during execution of the work. 9. The contractors Employees who are employed for the subject work shall be insured under Employees compensation insurance duly indicating Furnishing Division, ICF as work place. 10. All the requisite documents for proof of payment to the labourers and payment of PF, ESI/WCA to the authorities concerned to be submitted along with bill for claiming payment. Bills without these documents will not be processed for payment and may also attract penalty as per rules in force.
COMMON CONDITIONS : 1.The contractor shall maintain a register for the daily attendance of the Fork Lifts, JCB, Crane, Reach Truck drivers and Material Handling Assistants. The daily attendance register shall be put up to CDMS concerned for verification on daily basis and it shall be ensured that both the contractor and the CDMS concerned have signed on each day in the register. 2.The FLT's/JCB/Mobile Cranebrought for the work to be in good working condition and shall not be more than five years old and to be with valid documents wherever applicable. FLTs shall have name of the contractor, identification numbers prominently displayed. 3.Necessary Fuel for Forklifts, JCB and Crane shall be in the scope of the contractor. Electricity will be given free of cost by ICF for charging of Reach Truck . 4.The fuel levels of the Forklifts, Crane and JCB have to be checked daily and the fuel to be topped up to the optimum level everyday for trouble free operation. In case of any break down, the contractor shall make good the material handling equipment or arrange for alternate FLTs/JCB/CRANE at the earliest. The contractor shall make necessary arrangements to ensure that depot functioning is not affected due to break down of the machinery. 5.Storing facility of Fuel/Fuel containers will not be provided inside the ICF premises. 6.One supervisor to be deputed by the contractor for coordinating with this office. Maximum Four Supervisors are allowed for this contract and this aspect will not be considered for Payment. This is only for issue of gate entry permit. 7.As the work involves loading, unloading and stacking of items which are heavy and bulky in nature, the contractor shall employ only staff capable of doing such works. All staff employed by the contractor shall be not more than 55 years of age, physically fit to execute the work and shall have appropriate medical fitness. 8.The items shall be unloaded and neatly stacked at the identified location as shown by the ward/Receipt Branch in-charge. 9.Since the work involves moving equipment and heavy loads, safety of workmen and other personnel is to be strictly observed. 10.FLT's and other material handling equipments should not be driven other than the drivers nominated by the contractor.
ARBITRATION : All disputes and differences of any kind whatsoever arising out of or in connection with the contract, shall be referred to the General Manager as per provisions of Clause 64 of GCC amended from time to time and provision of Arbitration and Conciliation (Amendment) act 2015. The arbitrator however will not be one of those who had an opportunity to deal with the matters to which this contract relates. The award of the arbitrator shall be final and binding on both the parties to this contract.
INSURANCE : The Tenderer shall take out and keep in force a policy or policies of insurance against all liabilities of the Contractor as the Railways at common law or under any statute in respect of accident to persons / vehicle whom shall be employed / engaged by the contractor or about, the site of the Contractor office for the purpose of carrying out the Contract work on the site. The Contractor shall also take out and keep in force a policy or policies of insurance against all recognized risks and losses due to theft, fire or natural calamities. Only Indian insurance shall be employed. Such insurance shall in all respects be subject to the approval of the Railways.
SHRAMIKKALYAN PORTAL : Contractor is to abide by the provisions of various labour laws in terms of above clause 54, 55, 55-A and 55-B of the Standard General Conditions of Contract. In order to ensure the same, an application has been developed and hosted on website 'www.shramikkalyan.indianrailways.gov.in'. Contractor shall register his firm/company etc. and upload requisite details of labour and their payment in this portal. These details shall be available in public domain. The registration/ updation in Portal shall be done as under: (a) Contractor shall apply for onetime registration of his company/firm etc. in the Shramikkalyan portal with requisite details subsequent to issue of Letter of Acceptance. Engineer shall approve the contractor's registration in the portal within 7 days of receipt of such request. (b) Contractor once approved by any Engineer, can create password with login ID (PAN No.) for subsequent use of portal for all Letter of Acceptances (LoAs) issued in his favour. (c) The contractor once registered on the portal, shall provide details of his Letter of Acceptances (LoAs) / Contract Agreements on shramikkalyan portal within 15 days of issue.

Bidder must submit a certificate as per Annexure-XII of instructions to Tenderer Rev.16.0 along with bid for compliance of OM of MoE dated 23.07.2020.If such certificate given by a bidder whose bid is accepted is found to be false, this would be a ground for immediate termination and further legal action in accordance with law. Non-submission of certificate may lead to summarily rejection of offer.
Validity of Offer: No deviation from the offer validity period stipulated in the tender is permitted.
Payment Terms: No deviation from the Payment Terms stipulated in the tender is permitted.
Delivery Period: No deviation from the Delivery Period stipulated in the tender is permitted.
Price Variation Clause: No deviation from the Price Variation Clause stipulated in the tender is permitted.

(i.e. Rs.1083/- for Skilled labour as per minimum wage notice of Chief Labour Commissioner for Industr ial Workers duly considering the average increase during the contract period plus PF, EPF, EDLI, etc.) - 01 Nos for 312 Days.
