SUBJECT: Approval For floating limited tender for AMC of Fire Extinguishers and SCABA set
refilling at BPCL Kota TOP and pipeline division.
Note: Bidders must read these conditions carefully and comply strictly while submitting their bids.
Rates once quoted shall be firm and final, no revision of rates shall be permitted.
A. SCOPE OF WORK:
1. Inspection and preventive maintenance need to carry out as per OISD STD 142 for all types of fire
extinguishers present at BPCL Kota TOP (including QA lab) and pipeline division on monthly basis,
details of which are present.

2. There can be increase in number of fire extinguishers during the contract period hence rate as per
10% increase shall be filled by bidder.
3. Since this is non-comprehensive AMC, hence cost and supply of spares required is not in the scope
of this tender.
4. The job also includes refilling as per following details and numbers for the complete year.
5. After each refilling hydro test certificate at required pressure as per OISD 142 and confirmed by
HSSE officer shall be mandatorily required.
6. After refilling of SCABA set with compressed air, quality of air certificate shall also be submitted
along with hydro test certificate.
7. Any leakage observed on inspection by concerned officer just after receiving CO2/SCABA cylinders
shall be accountable on the part of vendor. He/she shall refill once again these cylinders without and
further cost to BPCL.
8. Preventive Maintenance: The AMC visit shall be carried out on monthly basis and shall include
functional checking, necessary adjustments, on monthly basis. Monthly inspection of all the fire
extinguishers (DCP Type and CO2 Type and clean agent), would be carried out as per OISD-142.
9. Breakdown Maintenance: This is to be carried out after any problem with the operation of fire
extinguishers. Any fault related to any part of the facility would be attended on immediate basis.

10. The vendor shall provide necessary tools and instruments to their persons for the purpose of
servicing of fire extinguishers and non-sparking tools shall be used if maintenance is carried out in the
11. Documentation: Inspection/Maintenance for fire extinguishers would be documented as per
standards by the vendor on monthly basis. These records shall be made available for verification and
signature by concerned officer, only then can vendor raise AMC bill of that month. In case on
emergency/visit of external parties vendor should be present at the location.
12. Penalty: During drill/training/emergency/trial run etc. if at any time any fire extinguisher fail to
operate or does not operate effectively then Rs. 500 per extinguisher shall be penalized from that
month AMC bill of vendor.
13. Tender shall be valid for a period of one year from the date of issue of LOI/PO and can further be
extended by one year depending on the services provided by vendor. Both the parties shall be ready
to extend then only same can be extended.
B. Tender terms and condition:
1. After the award of tender to the eligible party, BPCL reserves the right to reduce/modify the order
at any point in case of exigency.
2. BPCL may cancel the tender partly or fully at their own discretion.
3. Unless otherwise specified, the inspection shall be carried out as per the relevant standards /scope
of inspection provided along with the Tender Enquiry/Purchase Order.
4. BPCL may, at its own expense, have its representative(s) witness any test or inspection. In order to
enable BPCL’s representative(s) to witness the tests/inspections. BPCL will advise the Vendor in
advance whether it intends to have its representative(s) be present at any of the inspections.

7. Vendor must keep in mind that no extra price (such as loading, unloading charges etc.) other than
the quoted price will be paid by BPCL.
3 Indemnity Clause:
3.1 The Contractor shall indemnify and keep indemnified the Company, and its every member, Officer
and staff against all actions, proceedings, claims, costs and expenses whatsoever in respect of or
arising out of any failure or default by the Contractor in due performance of his obligations under this
contract and undertake to see that BPCL are absolved of any liabilities whatsoever to any third party
on account of this contract.
4 Penalty Clauses:
In case of non-fulfilment of defined conditions BPCL can impose the following penalty clauses:
4.1 Time is the essence of contract. In case of delayed delivery of the services at any point of contract,
the prices paid to the contractor gets reduced by a sum equivalent to 0.5% of the basic value of
services(as mentioned in contract) not delivered for every week of delay or part thereof, limited to a
maximum of 5% of the basic value of contract.
4.2 If during the contact period, the services are is found unsatisfactory the contract will be terminated
with prior notice.
4.3 In case the contractor fails to cope up with the work or does not render effective services, the
contract awarded to him shall be terminated by giving a 15 days prior notice, without assigning any
reason thereof and his security deposit and payment due to him, if any, shall be forfeited.
4.4 In case any worker reports to work eating any form of tobacco like cigarette, gutka, bidi, supari,
zarda etc or taking any kind intoxicated product, that worker will be immediately dismissed from his
service and will not be allowed to continue any further duty.
5 Payments Terms:
5.1 Payment shall be made against bills, duly certified by BPCL.
5.2 Necessary government levy / taxes would be deducted from the bill on net amount payable as per
the prevailing rate as applicable while passing the bill.
5.3 BPCL will endeavour to make the payment within 30 days of receipt of bills along with supporting
log sheets, duly certified for payment. It has to be strictly taken into consideration that contractor
need not to follow-up for the payment within 30 days from the date of submission of bill.
5.4 Payment would be released only by NEFT mode directly to the account number provided to BPCL.
Successful Tenderer shall be required to furnish NEFT mandate form.
