Special Eligibility Criteria

   Format for submission of Technical bid is attached in Annexure A of section VI of the enclosed specification. Firm has to submit all the necessary documents which are specified in Annexure - A of section VI of Specification along with their offer, failing which the offer is liable to be rejected.

   Firm should have previous experience in the supply of cranes and documentary evidence in support of the experience in the period last 5 years (for details refer special condition 2. ii of bid document part II) to be submitted as per the format in Annexure A1 of bid document part II.

   Firm should submit the certificate of performance from the users for the cranes supplied and commissioned as per the format in Annexure A1 of Bid document part II..

   The tenderer shall provide satisfactory evidence, acceptable to the purchaser, to show that he is a regular manufacturer and has adequate plant and manufacturing capacity, as per the format in Annexure F (Minimum Mandatory Infrastructure Requirements) of Section VI, and Quality Assurance Program as per Annexure H of Section VI of the enclosed specification.

   The tenderers shall read the details regarding the leading parameters given in Schedule I of Section V of the enclosed specification (Specification for EOT Crane/schedule 1 attached pdf no.12 of tender document) and shall furnish clause wise comments for each parameter, failing which the Railway reserves the right to reject the offer.

   1. EMD shall be 2% of the estimated tender value and shall be taken from all bidders for contract value above Rs.25 lakh subject to the applicable exemptions. For details please refer 2.0 Part A of Southern Railway Tender Conditions available under the mentioned link in the tender. 2. Authorized dealers are advised to remit the EMD amount for consideration of the offer.

   The bidders should furnish offered make/brand of all critical items/ subassemblies mentioned in para 14.3 of section V of the enclosed specification.

Commercial-Compliance

   Bidders are instructed not to indulge in any anti-competitive practices. As per the provisions of Competition Act 2002, Railways can make a reference to the Competition Commission of India for making an enquiry in case of suspected anti-competitive behaviour by the bidders. 2) Collusive bidding, Bid rotation, Bid Suppression, Complementary bidding, Market Allocation and subcontracting arrangements fall under the purview of "Bid rigging" which would cause appreciable adverse effect on competition. 3) Competition Commission of India can impose heavy penalties such as: Penalty upto 10% of the average turnover for the last three preceding financial years upon each of such enterprises which are parties to bid-rigging and can even order the parties to cease and desist. In cases where cartel formation by the approved sources is suspected or the rates available from approved sources are adjudged unreasonably high, the purchaser reserves the right to place orders on deserving firms outside the approved vendor list, without any restrictions.

   Firm should submit the individual rate break-up details of "List of Spares" for crane & "List of Maintenance Tools" mentioned in the Schedule IV & Schedule V of Section V of the enclosed specification in the given format and the same has to be submitted along with their offer.

5. 5

   Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

General Instructions

   The offers shall be evaluated based on the GST rate quoted by each bidder and same will be used for determining the inter se ranking. While submitting offer, it shall be the responsibility of the bidder to ensure that they quote correct GST rate and HSN number. Purchaser shall not be responsible for any misclassification of HSN number or incorrect GST rate if quoted by the bidder.

   All taxes, freight, packing, forwarding & other charges should be quoted in numeric only @ financial tabulation. If any make is available, it should be specified.

   Goods and Service Tax (GST) shall be applicable as per GST act (Please refer Para 14.0 (a to h) Para-A of tender condition. INPUT TAX credit benefit if any accrued should be passed on the purchase as reduction in Basic Price, or else the following certificate should accompany the bill: A) It is certified that no INPUT TAX credit benefit has accrued on materials invoiced/billed for, that can be passed on to Purchaser. B) Firm should submit the Invoice/Bill clearly indicating the appropriate HSN and applicable GST rate thereon duly supported with documentary evidence. C) Firm should also give a declaration that any additional Input Tax Credit benefit, if become available to supplier, the same shall be passed on to purchaser without any undue delay.

   Validity of offers: Offers should be valid for 120 days after closing date of tender. Any offer having lesser validity shall be deemed as commercially unresponsive and will be summarily rejected.
