Hiring of Diesel Driven, Air-Conditioned, Minimum 9 Seater close body SUV Vehicle along with Driver for 12 Hrs./Day and 3000 KM/Month for period of two years for Telecom Unit under Mehsana Circle.

9. The arrangement of expenditure for night halt of driver at any where in Gujarat shall have

to be done by the contractor.

10. The vehicle should have good upholstery covered with clean covers, comfortable seating

arrangement and shall be washed/service at regular intervals of a week. Vehicle shall

always be kept neat and clean.

11. If the contractor fails to provide a vehicle, the deduction from his RA bill should be made

on prorate considering the monthly rate payable within 26 days per Month.

12. Penalty: If the contractor fails to provide a vehicle on any day as per contract, penalty of

Rs. 2000/- per day will be recovered from his current RA bill with applying Taxes in part of

Contractor. Also, if vehicle will be hired from other agency by paying higher rate, in that

case difference of rates will be recovered from the contractor.

13. The bills for traveling of the vehicle shall be paid on monthly basis. No advance for hiring of

vehicle shall be paid. The bill in triplicate should be forwarded with bank account detail

with cancelled Cheque to concerned engineer/In-charge of mentioned location.

The payment of the above work will be processed through VMS portal of GUVNL, hence

you are required to get yourself registered on https://vms.guvnl.com and submit the

digitally signed Invoices, GST CA Certificates, Log-book, Toll payment receipt, Attendance of

Driver/Vehicle, Driver’s PF related compliances and other supporting documents to

Consignee/ Location/ Division offices wise using your login ID and Password on the VMS

portal of GUVNL. No Physical submission of invoice required.

Payment will be made within 30 Days of invoice received by RTGS only. No any claim

accepted in case of delayed payment from GETCO end. Income tax will be deducted at

source from monthly bill.

Supplier/Contractor should charge GST in Invoice at the rate as agreed to / mentioned in

acceptance of tender only and any deviation in the same shall not be accepted. Further,

any additional liability of GST (later on due to wrong mentioning of GST rate, mis-

interpretation of HSN/SAC Code, etc.) over and above as charged in the invoice shall be

borne by the Supplier/Contractor. However, any refund received by the supplier /

contractor on account of GST charged from the company; such refund shall have to be

passed on to the company, along with interest if any. Such refund along with interest needs

to be passed on suo-moto by the supplier / contractor.

Further, the Company has a right to recover the amount of GST along with penal interest at

the rate of 15% per annum if GST charged is not paid / short paid to the government or fail

to upload the details or uploads inaccurate particulars on GSTIN portal by the Supplier /

Contractor within the stipulated time limit.

In case, Govt. revises the rate of GST rate / Code during the tenure of the contract, the

provision of GUVNL’s statutory variation clause shall apply.

(i) Contractor has to submit the GST Registration certificate.

(ii) Contractor should be registered under GST laws which they shall pay the GST for this

(iii) Contractor has to submit invoice/Challan as documentary proof with each RA bill &

Final Bill and in which it shall be specifically mention the nature of service SAC code

under which the amount of GST payable.

(iv) GST shall be paid along with RA Bills and contractor shall provide the GST CA

Certificate with Final Bill and GST undertaking signed by authorized signatory of the

contractor along with the first RA Bill to ensure that GST charged and collected from

GETCO is paid to Government treasury and the accurate and correct details of

invoices are also uploaded on the GST portal within stipulated time.

However, final bill shall be paid and SD/BG/FDR shall be released only if contractor

has duly discharged its GST liability related to the said contract and submit necessary

documentary evidences as mentioned above.

The Contractor has to submit invoice to GETCO indicating following.

o Name, address and GST registration no. of the service provider

o Name and address of person receiving the service i.e. GETCO

o Description and value of taxable service provided

The total GST payable thereon with bifurcation of GST payable by service provider and

service receiver. Contractor has to submit tax invoice as described under GST rules and

Regulation indicating GSTIN No.

Tax deduction at source(TDS) under GST at the prevailing rate will be deducted from bills in

accordance with the provision of section 51 of the CGST Act, 2017, and to that effect a

certificate will be issued to the contractor.

Statutory Variations:

Any statutory increase or decrease in the taxes subsequent to offer if it takes place within

the original contractual period will be to the GETCO’s account subject to the claim being

supported by documentary evidence. However, if any decrease takes place after the

contractual period, the advantage will have to be passed on to the GETCO.

14. Challan’s for opening and closing Kilometers reading and kilometers traveled should be got

certified any duly signed by the officers traveling the vehicle. In absence of these

requirements the bill will not be paid.

15. The toll taxes to be paid during official travelling of vehicle shall be reimbursed to the

contractor on production of receipt duly signed by GETCO authority who have traveled or

directed a travel. All road tolls / bridge tolls shall be reimbursed on production of proof of

payment along with monthly RA bills for payment through FASTAG only as per RTO latest

guideline. No penalty / double toll shall be paid by GETCO.

16. In case of accident to the vehicle, the driver or occupants of the vehicle at the time of the

accident, the whole and sole responsibility of vehicle owner/ the contractor during accident

to pay compensation or damages to the persons, involved as per law or Act and the GETCO

will not be responsible for any claim on this account.

17. In case of any dispute or any discrepancy, the decision of Superitending Engineer,

Transmission Circle, Mehsana will be final and binding to the contractor.

18. If contractor fails to execute the order successfully, the order will be got completed through

other agency and if required to pay higher rate in that case difference of rate will be

recovered from the contractor.

19. The contractor shall follow all rules and regulations pertaining to the vehicle and its

running/working such as RTO, traffic, etc. scrupulously. Any consequences arising due to

non-observance of any such rules shall be borne by the contractor.

20. Head Quarter of vehicle will be as per mentioned in Vehicle Specification on Page-4 and

journey kilometers will be considered from Head Quarters to Head Quarters.

21. Agreement: As per GETCO’s rules, contractor will have to enter into an agreement on

Stamp paper of Rs. 300/- with the GETCO in prescribed format before execution of work.

The cost of stamp fees shall be borne by the contractor.

22. The contractor will have to execute an indemnity bond on stamp paper of Rs. 300/- at his

cost before commencement of order stating that for any accidents or damages to the

contractor’s staff/equipments or any other persons/vehicle due to non-observance of

safety measures, GETCO shall not be responsible.

23. Contractor will start hiring services from the date of commencement letter/order issued

from concern Division office after submission of self attested documents of Vehicle

Registration, Insurance copy of Vehicle & Driver, Driver’s Driving license and Medical fitness

certificate of Driver.

24. Driver should always keep all documents relating to vehicle such as R. C. Book, Insurance,

Valid license and PUC Certificate or any other in original copy with vehicle.

25. Formula for considering price variation: No price variation will be payable on cost of

oil/tyres, tubes etc. Only changes in price of diesel will be adjustable.

For Every Ten Paisa rise/fall in the price of Diesel per liter, price of one paisa (increase /

decrease) per Kilometer shall be payable/deductible for Kilometers traveled by the

vehicle in comparison with rate quoted in tender. Increase / decrease in Diesel price will

be paid/recovered for the actual Kilometers Traveled during the month.

26. Bidder must quote prices on the basis of rates of Diesel prevailing on the date of opening of

tender. Please submit the prevailing (15 Days before Tender Due Date) Govt. approved

diesel price list with tender copy. Same rate of Diesel applicable as base rate though out

contract period. While submission of bill bidder has to give daily rate for whole month from

I.O.C. or any other Govt. diesel distributor.

27. EMD: It is required to pay Earnest Money Deposit along with tender in form Demand draft/

Banker’s Cheque only in favor of Gujarat Energy Transmission Corporation Limited or

RTGS/online as per detail mentioned in Tender Notice.

28. The ‘Earnest Money Deposit’ paid herewith should be forfeited by the GETCO if the full

amount of specified security deposit is not paid in specified time by the successful bidder.

29. SECURITY DEPOSIT: The 5% of tender value will be required to be paid either in form of

Demand Draft in favor of “Gujarat Energy Transmission Corporation Limited” payable at

Mehsana or in form of “Bank Guarantee” with acceptance of tender. The Security Deposit

will be paid within 10 days of receipt of LOI. No FDR accepted as security Deposit. Bank

Guarantee Format also attached in annexure for reference. On failure of submission of full

Security Deposit amount within prescribed periods as mentioned above, GETCO rights to

forfeit EMD and tenderer may be disqualifying for future work of GETCO.

30. The Superintending Engineer, Mehsana reserves the right to reject any or all the tenders

without assigning any reasons thereof.

31. Vehicle supplied should be comprehensively insured meets approved Seating capacity.

Attested copy of insurance policy should be submitted to this office before placement of

order. Insurance for driver should also be arranged by the contractor and attested copy of

the same should be submitted to this office. Moreover, compliances & follow all contact &

fulfilling this requirement will be out right rejected.

33. Vehicle will have to be sent along with well-experienced, well-dressed driver having good

manners with necessary tools and tackles and Contact facility (Mobile-Phone) to meet the

normal breakdown while on road. The driver with the vehicle shall have valid license for

driving and must be well versed with R.T.O. rules. The driver shall be preferably below the

age of 40 years and never above 55 years. The lodging and boarding of driver shall born

35. The driver should be provided with enough money to cover the cost of diesel, repairs and

incidental expenditure while in journey.

36. The driver should be fully instructed for the good behavior and to drive the vehicle only in

accordance to the clear directives of officer in charge & as per RTO rules. In case, if driving

is found rough, contractor shall have to change the genuine driver.

37. Driver must not be addicted of any habits. Changing of driver shall be intimated by

contractor to concern user of vehicle in prior.

38. The contractor shall be immunizing company’s personal against any claim arising out of

accident or misbehavior of the drivers. The vehicle shall be kept properly insured all the

time to cover the 3rd party risk and simultaneously immunize company on account of likely

claims from public, police dept. etc.

39. The prices quoted by the Contractor should be exclusive of Goods & Service tax. Contractor

should have to take registration of GST & agency has to pay the taxes as applicable under

GST regime. The same amount of GST will be reimbursed provided documentary proof to

GETCO and also bidder has to give certificate from Chartered Accountant mentioning that

whatever benefit of input credit of GST is there is passed on to GETCO.

40. The general use of vehicle is for Office use as well as maintenance monitoring work to use

on Kaccha/ Pakka road/Bullock cart way where vehicle approach is possible.

41. During the period of maintenance, breakdown of the vehicle, when the vehicle may not be

sent, the contractor will have to send another vehicle of same class and model year. In

case of failure to meet this condition, another vehicle shall be hired by the GETCO from

other agency and if required by paying higher rate, in that case, difference of amount will

be recovered from the contractor’s bill.

42. The validity of the tender shall be 180 days from the date of opening of tender.

43. Conditional tender will not be accepted and straight away be rejected.

44. The contractor is bound to furnish his analysis & justification of rate, if asked.

45. For participation in tender, the ownership of vehicle is not necessary. Contractor can

provide third party’s vehicle. In such case, bidder shall have to execute the agreement

binding that the whole responsibility about any risks shall pertain to him & not to third

party. The format of same is attached herewith. (Annexure- Undertaking cum indemnity

Bond) The provided third party vehicle shall be same throughout the contract period. In

case, only one time change of vehicle shall be allowed, meeting all the terms of contract

& on taking prior approval of competent authority.

46. Full size carrier should be provided on vehicle. In case of open body vehicle, proper

shielding (roof) to be provided as per Engineer In-charge requirement. For Hotline

maintenance team Vehicle, Carrier should be provided as per in-charge opinion for

accommodate their tools/tackles.

47. Rates for excess Kms traveled above specified in Schedule-B for per Month is admissible

occasionally, with written permission of Circle head.

48. Rate for overtime (for only vehicle hired for 12 Hrs./Day) specified in Schedule-B. If the

vehicle is released/used at or after 01.00 AM (Midnight), it will be considered as night

halt and paid accordingly and overtime charges will not be payable.

49. It is advised to all tender participants to submit application for EMD refund with advance

stamp receipt & Bank account detail along with copy of DD of EMD. So except Lowest

bidder EMD can be released promptly.

50. Vehicle provided by agency should be regularly serviced at company showroom as per OEM

recommendation. Also, agency has to submit proof of regular maintenance as mentioned

interval by OEM/ Authorized service station with invoice.

51. The Bidder should have to take registration under the “GOODS AND SERVICE TAX(GST)”.

Bidder has to register online in given link before bidding. Link for the same is

www.getcogujarat.com/gst. The certified Xerox copy of such registration shall have to be

submitted along with the bid by the bidder.

52. On forfeiture of EMD, SD or guarantee under the terms and conditions of this tender,

applicable GST will also be recovered from the bidder / contractor and GETCO reserves all

rights of such recovery of such forfeited amount along with GST.

GENERAL CONDITIONS OF CONTRACT

1. The contractor shall be required to supply diesel driven vehicle having Taxi / Maxi passing

from RTO and strictly in accordance with the specification laid down in the tender

specification. Any vehicle not confirming to the said specifications shall not be accepted.

1.1 It is strictly instruction to provide same vehicle mentioned during tender. No alteration of

vehicle will be allowed after confirming in Tender documents during tender process.

1.2 For Provide new vehicle, agency has to mention document of Model provided with

estimate/quotation of Dealer with payment of required Security deposit of Rs. 10000/-

mentioned in Annexure. Also, it is compulsory to provide new vehicle after confirming in

Tender documents. On fail in the same Deposit mentioned for provide new vehicle will be

3. The contractor shall make his own arrangements for the Boarding and lodging of his

drivers, agents and servants.

4. The vehicles when in service shall have to be parked at the GETCO’s premises or as near as

the work site is possible.

5. The contractor shall ensure that representative on his behalf is deputed by him to keep in

touch with the Engineer with regard to detailing of vehicles, providing arrangements for

substitutes in case of any vehicles going off road looking after to general need of vehicle.

6. The contractor shall also make his own arrangements for refueling, repairs and

maintenance of his vehicle and provide other vehicle during maintenance or repair period

with all above-mentioned conditions.

7. The contractor must follow all the rules, regulations and enactments of the labour laws

relating to engagements of persons by him with PF registration.

8. Contractor has to fulfill the requirement of PF Registration as per Govt. Rules. Final decision

of tender authority in respect of said regarding requirement/Self-driving consideration will

bind for all bidders.

9. The vehicle once inspected and approved by the Engineer for hire shall not be changed or

substituted by the contractor except on orders from the Engineer or on becoming

defective/off road due to accident, breakdown, etc. In such an event, the contractor shall

have given immediate intimation to the Engineer. Where a change of vehicle is likely to last

for more than one-week prior approval of this Engineer shall have to be taken.

10. The speedometers of the vehicles must be maintained with full accuracy and in working

condition/order at all times. Any defect noticed therein must be rectified at the earliest in

a period not exceeding two days. Till such time, the Kms. of journeys for various places

shall be decided by the users/Engineers.

11. No interest shall be paid by the GETCO on Security deposit. Earnest Money Deposit (EMD)

received along with the tender shall also be converted into security deposit in the event of

awarding the contract to a successful party.

12. Tender fee paid for purpose of tender papers is non-refundable.

13. The security deposit shall be refunded to successful bidder only after satisfactory

completion of the contract or on its termination by the GETCO due to its own reasons. The

GETCO reserves the right to recover any dues, outstanding against the contractors, from

the Security Deposit or towards any loss caused to the GETCO owing to negligence or

default of the contractor, his servants or agents. The refund shall be done only on

production of No Objection Certificates of all concerned Officers.

14. The rates quoted by the bidder in the schedule of rates must include all charges of every

type such as fuel and levies maintenance / repairs, driver or contractor’s servant/agent

wages, service taxes etc.

15. The contractor shall provide standby vehicle(s) to ensure prompt substitute arrangements

should any hired vehicle go off road.

16. GETCO shall have right to hire vehicle from other agency at the risk and cost of contractor

in case of default.

17. Contractor has to fulfill statutory requirement if it will rise in future during execution of

contract. If same will not be satisfied by contractor whole contract will be cancelled.

18. To be insure, mentioned vehicle in the tender should not under service in any contract at

any other organization on Dt. of mentioned tentative service commencement. If same is

observed/found, GETCO rights to forfeit SD/EMD and tenderer may be disqualifying for

future work of GETCO.

Race course, Vadodara.( hereinafter called as GETCO, which expression shall mean and include

its legal representative, administrators assigns) has agreed under the terms and conditions of

Indemnity Bond.

We do hereby undertake and agree to Indemnify and keep Indemnified GETCO from time to

time to the extent of Rs.______ Rupees________only against any losses or damages, costs,

charges and expenses caused to or suffered by reason of the CONTRACTOR while Project,

R&M, O&M work including work carried out by outsourcing agency, failing to take proper care

or not complying the guidelines given hereunder as per Annexure-A and instructions which

may be given from time to time during the continuance of the contract and we further

undertake to unconditionally pay the amount claimed by the GETCO on demand and without

demur to the extent aforesaid.

Whereas the CONTRACTOR has/have been awarded to execute the job/works under order

no._____, dated ______ for _________ issued by the GETCO after having observing necessary

formalities, the details of which is described in the order no.______ dated ______ and whereas

the said job/works will be /likely to be done in places covered under Employees’ State

Insurance Act,1948 (ESI) and /or the Workmen Compensation Act,1923 and /or other laws

relating to the Labour Management and Welfare Act. (Respective Amendments)

And whereas according to the condition of the Contract the CONTRACTOR is under obligation

to execute this Safety cum Indemnity Bond before the commencement of actual execution of

Now the indenture witnesses that I/We the CONTRACTOR do hereby undertake to follow the

guidelines as per Annexure-A prepared by the GETCO.

Further we the CONTRACTOR agree that the GETCO shall be sole judge of and as to whether

there has been any breach of the guidelines as per Annexure-A of this bond and as to the

extent of the loss, damages, costs, charges and expenses caused to or suffered by the GETCO.

We the CONTRACTOR further agree that our liability under this bond shall not be discharged

because of the change in the constitution of the GETCO or for the extension of the time limit or

for any other reason.

We the CONTRACTOR further agrees to the given terms and conditions

a. That the CONTRACTOR undertakes /undertake to indemnify and keep harmless the

GETCO from all claims, actions, proceedings and risk, damage danger to any person whether

belonging or not belonging to the. CONTRACTOR.

b. That the CONTRACTOR shall keep harmless the GETCO from all claims, compensation,

damages any proceedings in respect of any of its employee / workmen under the Workmen

Compensation Act or any other laws for the time being in force.

c. That, if during the course of execution of work as stated in the contract order

mentioned hereinabove issued by the OBLIGEE, it is found that the CONTRACTOR has not

complied with guidelines as per Annexure-A or terms and conditions / formalities within the

meaning of Employees’ State Insurance Act,1948 (ESI) or Workmen Compensation Act 1923 or

any other laws relating to the Labour Welfare for the time being in force, and also has not

observed the safety norms in accordance with the law prevailing at the place of work/job to

the satisfaction of the GETCO, the GETCO shall have the right to stop the execution of work/job

and the period of such stoppage shall not be taken into account for the calculation of the total

period of completion of work for which the CONTRACTOR is responsible to complete the

work/job and it will be deemed that discontinuance was due to default of the CONTRACTOR .

d. That, if any time, due to exigency, GETCO as the Principle Employer, becomes liable to

pay any such compensation mentioned hereinabove, whether on failure of the CONTRACTOR

or for any other reason, the GETCO shall have the right to recover the said amount from any

amount receivable by GETCO or any bank guarantee deposited or anything payable whether in

connection with this contract or other contract by the CONTRACTOR to the OBLIGEE.

e. That the CONTRACTOR is/are aware and accept that for the persistent or repeated

violation of any guidelines as per Annexure-A and terms and conditions mentioned in this

Safety cum Indemnity Bond, GETCO shall have right to terminate the contract of work issued to

the CONTRACTOR.

f. In case if any safety related fatal Electrical / Mechanical accident occurred to any

employee of agency or outsider due to negligence or non-compliance of GETCO safety norms

then in addition to the compensation and liability as per statutory requirement, contractor /

agency is hereby agreed to pay the penalty amount as given below:

g. I/We the CONTRACTOR hereby confirm that in case of any dispute/difference for

settlement of claims under this Safety Cum Indemnity bond the courts in Gujarat State

wherever job/work is performed or as per GETCO norms shall have the jurisdiction to decide

the rights & liabilities of the parties while adjudicating the matter of claims under this Safety

Cum Indemnity Bond.

h. This Safety cum Indemnity Bond shall continue and hold good until it is released by the

GETCO in Writing on the Contractor’s application after the Contractor has discharged all his

obligations under the order mentioned hereinabove and submitted a “NO DEMAND

CERTIFICATE” from the GETCO under the said order. The Safety cum Indemnity Bond shall be

valid for a CONTRACT PERIOD and renewable thereof (Claim Period).

i. This Safety cum Indemnity Bond and the guidelines as per Annexure-A herein contained

are in addition to and not by way of limitation or substitution for any other guarantee,

indemnities Hereto before given to the GETCO by the CONTRACTOR and this indemnity does

not Revoke or limit such indemnities or guarantees. IN WITNESS WHEREOF the Parties hereto
