GENERAL CONDITION TO BE NOTED IN TENDER

1) If due to any reason, payment is delayed then tenderer is not eligible to claim/demand any

compensation for loss of interest thereof.

2) AMC reserve the right (i) to change, alter or to waive any technical or commercial terms,

condition and qualification (ii) to reject all the bids or any bid in part or full without assigning

any reason whatsoever (iii) for making changes / relaxation ineligibility criteria at any time (iv)

to split the order work and award the work to more than one tendered with lowest rate

quoted in the tender in the interest of the public. The bidder shall have no cause of action or

claim against the Ahmedabad Municipal Corporation or its Officers / Employee’s successor or

assignee for rejection of his tender/bid,

technical or commercial documents or any discount, and at the same time tender will be

instruction of E-I-C without any extra cost.

6) The contractor shall complete the Preventive maintenance work latest by every 15th May and shall submit the

report along with site photographs of carried out works showing dates to the E-I-C of AMC.

In case of failure to do so AMC shall carry out proper routine & preventive repairs required through other

agency and the cost of the same shall be recovered from Contractor’s due payments.

In case of any fault / breakdown, during comprehensive repairing & maintenance period / defect liability period

and routine, preventive or break down repairing required the contractor shall have to attend the same within an

hour (1 hour) and shall have to complete the repairing work in max. One ( 1 ) day.

7) Contractor shall make all arrangements for obtaining power connection, the installation, operation, maintenance

and subsequent removal of temporary supply of electricity. AMC shall issue only authorization letter to

Contractor for obtaining power connection, and yet if power is not available in time, the work shall not be

postponed and the Contractor shall have to arrange for diesel generating set (s) at his own cost.

8) Contractor must present regularly and timely whenever work progress review meeting regularly

arranged by department during period of starting of tender work at site to the end of project.

A.1.1 Here by a Percentage rate tenders (Two-Bid System) tenders are invited on behalf of

Municipal Commissioner , AMC by E-Tender system from the Contractor/ Agency

who qualify the Eligibility Criteria, as mentioned in Section–A.5 of the tender

A.1.2 Tender along with Conditions of contract shall be available from the website

www.tender.nprocure.com. Tenderer shall have to submit demand draft of banks

mentioned in Annexure-I only in favour of “Municipal Commissioner, AMC” Payable

at Ahmedabad of Rs. 1500/- as tender fee along with the tender.

Tender received without tender fee shall be considered as Non-Responsive

and shall stand rejected outright.

A.1.3 Earnest Money Deposit (E.M.D.) shall be in the form of demand draft in favour of

“Municipal Commissioner, AMC” payable at Ahmedabad or bank guarantee from

banks mentioned in Annexure-I only of Rs. 30,000/- with their tender documents.

Validity of Bank guarantee shall be of minimum Six months from

date of Technical Bid Opening. Tender received without Earnest Money shall be

considered as Non-Responsive and shall stand rejected outright.

A.1.4 SUBMISSION OF TENDER

A.1.4.1 Tenders shall be submitted together with the other documents that form the

tender. In the event of a Contract, the tender and the documents attached there to

shall be considered as forming part of the Contract Documents.

A.1.4.2 Two set (One Original + One Xerox) of tender documents consisting of following

A.1.4.3 Two sets (One Original + One Xerox copy) of tender documents- Vol-I only

(Including technical specifications, drawings and addendum (if any) duly completed

in all respects, tender fee, EMD and other documents required (hard copy of

original certificate, data sheets, company details, forwarding letters etc.) shall be

A.1.4.4 All Envelops and sub envelops must be sealed by tenderer & each sealed envelope

Tenders which are opened before the due date for tender opening with

no indication having been given on the outside of the envelope or container to

indicate that; is a tender liable to be disqualified.

A.1.4.5 The tender shall be considered non-responsive if tender documents are not

sealed. Tenderer shall not be allowed to fill in or seal their tenders at AMC Office.

Tenderer are requested to submit the tenders well in time before stipulated date and

time of receipt; so as to avoid rush at the closing hours.

A.1.5 Security Deposit

 The Contractor shall have to pay Security Deposit worth 5% amount of the

total ordered Value in Indian Rupees in approved Form “A” enclosed or other

format acceptable to AMC within 15 days from receiving date of L.O.I./Work Order

in form of Demand Draft or Bank Guarantee from banks mentioned in Annexure-I

only with requisite amount of contract paper.

 Failure of submitting security deposit within 15 days may lead to cancellation of

work order and in those case Municipal Commissioner has all right to forfeit EMD

amount deposit along with tender and have right for all strict actions against

A.1.6 The Earnest Money Deposit of all the Tenderer except 1st, 2nd and 3rd lowest shall be

returned as early as possible.

A.1.8 All details and schedules required for pre-qualification and technical evaluation shall

be submitted in hard copy in prescribed format.

A.1.9 Financial bid shall be submitted only on online on tender.nprocure.com

A.1.10 The technical bid containing Vol-I (technical bids only) from the tenderer received,

shall be opened Online/Physical in the presence of the tenderer’s representatives

who may remain present at sharp time of the day fixed for tender opening and the

technical tenders shall be scrutinized by AMC or his authorized representatives for

satisfying various eligibility criteria prescribed for the tenderer for this work.

After this, the Financial Bids of only technically qualified tenderer will

be opened online. The actual date and Place of opening of Vol-II-Financial Bid of

tenderers shall be communicated to technically qualifying tenderer only later

after scrutiny of tender documents.

A.1.11 The Conditional Tender will not be accepted and shall be rejected outright, unless,

the nature of condition(s) put up by the tenderer is acceptable to AMC. Any

suggestions/alteration from the tender must be mentioned in the main

forwarding letter. Bidder is advised to visit the particular site for said work under

this tender to study the local site condition prior to tendering. Request for any

kind of change (including prices) shall not be entertained under any

A.1.14 Incomplete tender which does not fulfill any of the above conditions shall be liable

for rejection. Tender shall also be liable to be rejected if –

i) The Tenderer proposes any alteration in the work specified or in the time allowed

for carrying out the work or any condition in the covering letter which is not

acceptable to AMC.

ii) The bidder or the person authorized to sign on behalf of the bidder does not sign

the all pages of the tender and amendments if any (digitally online).

iii) All corrections, additions or pasted slips are not initialed by the authority person

having power of attorney

iv) Any Changes/ Modification in any text, documents in original tender documents

published in N-procure web site.

v) Any erasure/modification in original tender documents published in N-procure site.

vi) The tenderer or in the case of a firm the bidder or the person authorized to sign on

behalf of the bidder shall sign the bid document. The Copy of legal status of bidder

(Partnership Deed or Articles of Association of the Company) along with power of

Attorney to sign on behalf of the bidder will be furnished along with other

documents to be dispatched physically.

A.1.15 Acceptance of the tenders shall rest with the competent authority of AMC, who

does not bind himself to accept the lowest tender.

A.1.16 Municipal Commissioner, AMC reserves the right

(i) To change, alter or to waive any technical or commercial terms, conditions and

(ii) To reject all the tenders or the lowest or any other tender in part or full without

assigning any reason whatsoever

(iii) For making changes / relaxation in eligibility criteria at any time

(iv) To split the tender in to two or more agencies

The Tenderer shall have no cause of action or claim against the corporation

or -its officers, employees, successors or assignee for rejection or split of tender.

A.1.17 It must be clearly and distinctly understood that the conditions of contract and

specifications shall be rigidly enforced and no relaxation on the grounds of customs

prevailing shall be allowed.

A.1.19 The Price quoted for work must be of Site / Store delivery of Corporation without

prevailing applicable GST. GST will be paid Extra as actual. Current GST rate for

works contract is 18%.

After awarding Contract and during contract implementation if Government taxes

increases or any type of Govt taxes added then the same rise /addition will given to

Contractor upon submission of necessary documents as mentioned below.

 Copy of Chillan of tax that has been submitted to income tax department

 Other documents as demanded by client

However during Implementation of work if any types of taxes reduces or any type

of Govt taxes is removed then the same shall be recovered from Contractor.

However it is Contractor’s responsibility to inform the same to Client with

supporting documents.

A.1.20 The tender for the work shall remain open for a period of 120 days from date of

opening of Price Bid and the tenderer shall not be allowed to withdraw or modify

the offer on his own during this period.

A.1.21 Tender documents are not transferable.

A.1.22 Any False information given in the tender will invite invalidation of any Contract

awarded on the basis of such false information at the discretion of the

only a part or the whole or up to any excess / lesser thereof

execute it without any objection.

A-3: SCOPE OF WORK AND SPECIAL INSTRUCTIONS TO CONTRACTOR

The scope of work under this contract comprises Rate Contract for Testing work of Existing

C.N.G/P.N.G gas pipe line at various Crematorium of A.M.C. The work shall be carried out and

completed under this contract in every respect in conformity with the current rules and

regulations of the local authority, the Indian Standard Institution or other relevant codes,

and with the directions of and to the satisfaction of the Client.

GENERAL INSTRUCTIONS

A.3.1 The details for Rate Contract for Testing work of Existing C.N.G/P.N.G gas pipe line at various

Crematorium of A.M.C. shall be as per instructions of Engineer-in-Charge and his order shall

be considered final.

A.3.2 The Contractor shall have to properly store the material brought by him on site. This shall be

kept open for inspection by Client and authorized representatives.

A.3.3 The Contractor shall remain responsible for workmen’s compensation, if any, when such

case occurs. The contractor shall arrange for red lamps at night and fencing and shall be

responsible for any damage of life and limb or property, if any happens, during the

execution of work. In case of dispute for unseen or overlooked items, the decision of

Municipal Commissioner, AMC shall be final. The Contractor shall have to give site clean of

all rubbish on completion of work and hand over the site with final finishing of the work as

directed. All the rejected materials shall be removed from site within 24 hours by

Contractor at his risk and cost.

A.3.4 All the materials required for the execution of works shall have to be brought by the

contractor from open market.

A.3.5 Contractor shall be fully responsible for compliance of the various provisions under Contract

Labor Act, 1970 and latest addendum and the Rules frames there under. The Contractor

should obtain necessary permissions, license & registrations from labour commissioner, as

per labour law if required.

A.3.6 All the precautionary measures for safety are to be taken by the contractor during execution

of work at site.

A 3.7 No Contractor shall employ any child heaving age 5 years to 14 years, as it is prohibited by

the Child Labour Prohibition and Regulation Act, 1986.The Hon. Supreme Court has

given certain guidelines and as per the guidelines, if employment of child labour is

detected on the site work, the employer i.e. the Contractor shall have to deposit

Rs.20,000/- (Rupees Twenty Thousand only) in the Child Labour welfare Fund. If the

employer refuses to deposit, then action will be taken for contempt of Court of the

Supreme Court Judgement and also will be prosecuted by the concerned authority.

A 3.8 AMC will not be responsible for any accidents (In case of the death of a person or an injury)

occurred in the any premises of AMC Area due to the above reason and the compensation

for the family of the person affected. It will be in the scope and responsibility of the

contractor to deal with the legal proceeding such as court matter, police case

compensation etc which arises due to the above reason.

A3.9 AMC reserves the right to inspect any Equipment / Material to be supplied by the contractor

as part of his /her scope of work.

TECHNICAL INSTRUCTIONS

The Brief description of the work to be carried out is as follows:-

A.3.10Contractor will have to possess all necessary equipments/machineries for doing

required installation/fitting/repairing work.

A.3.11 Contractor will have to have skilled manpower for doing work related to Testing

work of Existing C.N.G/P.N.G gas pipe line at various Crematorium of A.M.C.

A.3.12 If any sub work order is issued for Testing work of Existing C.N.G/P.N.G gas pipe line

at various Crematorium of A.M.C. at any site then it is the responsibility of Contractor

to check existing site condition and feasibility to do Testing work of Existing

C.N.G/P.N.G gas pipe line Work by its own.

A.3.13 Contractor has to testing work in Existing Gas pipe line 3 time in one year for every

crematorium as per schedule given.

A.3.14 Contractor will have to prepare sheet for all the executed items on any site for a

given sub work order and submit the same with the running bills for payment.

A.3.15 Written order will have to be procured from the concerned AMC Engineer and Gas

pipe line testing work in the presence of third party Inspector

A.3.16 Contractor has to attend immediately all leakage in Existing Gas pipe line when

complaint given.

A.3.17 The Contractor has to submit the bill of testing work in Existing Gas pipe line along

with testing certificate as per attached proforma certificate with AGL authority sign,

isomatric Drawing of IP and calibration certificates of pressure gauge. The payment of

bill will be done only after submitting the above documents. Contractor will have to

ensure safety of its working personnel during execution of said work by providing them

necessary protective gears/equipments. If any dispute or accident happen with the

contractor’s working personnel then the whole responsibility will be solely of the

contractor only and AMC will not be responsible.

A.3.18 The tenderer should have round the clock service facility for contacting and attending

the gas pipe line leakage including after office hours (24 hours x 7 days).

Special Note: All items/Equipments/sub-items/process mentioned in B.O.Q. must be as per

relevant Latest Indian Standard and must follow latest rules and regulations

prescribed by relevant authorities of state government/central government.

A – 4:- INSTRUCTIONS TO TENDERER

A.4.1.1 These instructions are provided to assist tenderer while preparing their tenders.

A.4.2 INVITATION TO TENDER

A.4.2.1 The Municipal Commissioner, AMC shall receive tenders for Rate Contract for Testing

work of Existing C.N.G/P.N.G gas pipe line at various Crematorium of A.M.C. according

to the specifications and Schedule of Quantities and in the tender documents herewith

A.4.2.2 Tenders shall not be accepted after the hour and date fixed for receiving of tenders.

Telegraphic tenders shall not be accepted under any circumstance. Tenders received

after the hour and date so fixed shall not be considered. Tenders shall be received only

by Regd Post A D / Speed Post / Hand delivery on or before due date and time as

mentioned in Tender notice. Tenderer’s authorized representatives may attend the

tender opening. The tenders shall be opened at the date and time as mentioned in

A.4.3 TENDER VALIDITY PERIOD

A.4.3.1 The tender shall be kept valid for acceptance for a period of 120 Days (One Hundred

twenty days) from date of opening of Price Bid.

A.4.4 LANGUAGE OF TENDER

A.4.4.1 Tenders shall be submitted in English, and all information in the tender shall be in

English. Information in any other language shall be accompanied by its translation in

English. Failure to comply with this may disqualify a tender. Only English text shall be

The tender must be accompanied by an Income-Tax return copy of last three financial

A.4.6 Joint Venture: Not Applicable

A.4.7 MODIFICATION OF DOCUMENTS

A.4.7.1 Modifications of specifications and extension of the closing date of the tender, if

required, shall be made by an Addendum. Copies of each Addendum shall be put up on

website tender.nprocure.com. These shall be signed and submitted along with tender

documents by the tenderer and shall form a part of the tender document.

A.4.8 Evaluation of Tenders / Documents -Information to be submitted along with Volume

– I (Technical Bid)

The Contract will be awarded on the basis of overall lowest prices as per N-procure Vol-II.

A.4.9 SIGNING OF CONTRACT

A.4.9.1 The successful tenderer shall be required to execute the Contract within 15 days of

receipt date of Work Order/ L.O.I. If the contractor shall not pay security deposit and

shall not sign agreement within 15 days after issuing the first letter from the authority

of AMC, EMD shall be forfeited and such tenderer shall be disqualified for getting

further any work in AMC.

A.4.10 STAMP DUTY AND LEGAL CHARGES It shall be incumbent on the successful tenderer to

pay stamp duty on the contract and legal charges for preparation of the contract

A.4.11 Not More than one tender shall be submitted by a contractor or by a firm of contractor.

No two or more concerns in which an individual is interested as a proprietor and/or a

partner & /or director shall submit tender for the execution of the same work/tender. If

they do so all such tender shall be liable to be rejected.

A.4.12 Any objection/Complaints regarding tender can be done by any applicant/tenderer in

period between technical bid opening and price bid opening. In case any applicant is

complaining after the price –bid is opened then it will be considered as bidder/applicant

is trying to harm the tender process and complainant/Bidder will be Debar for 5 yrs for

tender process in AMC and Earnest Money Deposit will be seized. If the complaint is not

done by applicant then file will get close (case no longer) without checking.

A.4.13 Even though the bidders meet the above criteria, they are subject to be rejected, if

they have record of poor performance such as abandoning the work, not properly

completing the contract, inordinate delays in completion, financial failures etc.

A.14 DECLARATION FORM

A.14.1 I/ We hereby declare that I / We have perused in detail and have examined closely the

specifications/scope of work/general terms and conditions/special terms/important

instructions/note described in the tender document. I / We hereby agree to be bound

by and comply with all such specifications/terms, conditions etc.

A.14.2 I / We also certify that I / We have visited the sites and inspected the locations of the

proposed work before quoting my/our rates and will not claim any extra towards

minor/major item related the job.

A.14.3. I/We also confirm that I/We have understood intent and content of the tender and

I/We assure that I/We shall abide by all intents of the tender besides its wordings.

A.14.4 I/We also confirm that my/our offer is strictly in line with tender

stipulations/terms/conditions and understand that deviation of any kind, if found, my

/ our offer will be summarily rejected.

A.14.5 If due to any reason, payment is delayed then tenderer is not eligible to claim/demand

any compensation for loss of interest thereof.

A.14.6 AMC reserve the right (i) to change, alter or to waive any technical or commercial

terms, condition and qualification (ii) to reject all the bids or any bid in part or full

without assigning any reason whatsoever (iii) for making changes / relaxation

ineligibility criteria at any time (iv) to split the order work and award the work to more

than one tendered with lowest rate quoted in the tender in the interest of the public.

The bidder shall have no cause of action or claim against the Ahmedabad Municipal

Corporation or its Officers / Employee’s successor or assignee for rejection of his

respect removing all raw materials, grass, debris or any kind of waste material from

site as per instruction of E-I-C without any extra cost.

A.14.10 Contractor shall make all arrangements for obtaining power connection, the installation,

operation, maintenance and subsequent removal of temporary supply of electricity.

AMC shall issue only authorization letter to Contractor for obtaining power connection,

and yet if power is not available in time, the work shall not be postponed and the

Contractor shall have to arrange for diesel generating set (s) at his own cost.

Qualification will be based on meeting all the following minimum pass / fail criteria regarding the bidder’s general and

particular experience, personnel and equipment capabilities and financial position. The AMC reserves the right to

waive minor deviations, if they do not materially affect the capability of a bidder to perform the contract.

A.6 Guideline of Existing Gas pipe line Testing.

1. Entire pipe line work should be flushed with nitrogen to remove dust, dirt and welding

spatter etc. meter and regulator should be removed before Flushing should be done from

pressure after removing meter for 24 hrs. Testing should be done with all appliances vales

open and plugged. pressure should not drop during testing. each joint specifically threaded

3. Once testing with 6 bar pressure is found ok, pressure should be vented out. meter and

regulator(if required) to be fixed in place and again entire pipeline along with meter

should be tested at 150 mbar(g) pressure for 2 hours. meter inlet and outlet joints to be

checked with leak detection fluid.

4. Once testing is ok a testing certificate to be produced as per the proforma certificate.

5. After completing testing entire pipeline should be under pressure of 150mbar(g)
