2. INSTRUCTIONS TO TENDERER / BIDDER

1. Name of work: Airtime Charges of Ultra High Frequency (UHF) Radio Truncking Wireless Sets.

2 EXAMINATION BY TENDERERS

a At his own expenses and prior submitting his tender, each tenderer shall

(b) Familiarise himself with all Central, State and local laws, ordinance, rules, regulations and codes

affecting the service/parts supply including the cost of permits and licenses required for the work and

(c) co-relate his observations, investigations, and determinations with requirements of the tender

3 Tender Document Fee

4 EARNEST MONEY DEPOSIT

5 SUBMISSION OF TENDER DOCUMENT

f Sealed tender duly super scribed with tender notice number, name of work and due date must reach

to the office of the Chief Accountant, Surat Municipal Corporation, Tapipura, Surat - 395003 on or

before the date and time mentioned in tender documents through RPAD / Speed post through postal

authority only. The Corporation shall not be responsible for any postal delay. Tender sent through

Angadia / Courier / Hand Delivery shall not be accepted.

g No delay on account of any case for receipt of tender shall be entertained. Tenders received or due

to be received after the time limit is over will not be accepted and if inadvertently accepted, will not

be opened and will be returned unopened. The tenders who may get opened before the due date

with no indication having been given on the outside of the envelope are liable to be rejected

h Mailed tenders must be sent in a covering envelope by Registered Post Acknowledgement due. The

return receipt will be endorsed to show the date and time of receipt. Mailed tender not received at the

required place before the date and time set for the receipt of tenders will be rejected.

The tender must contain the name, address and residence and place of business of the persons

submitting the tender and must be signed and sealed by the tenderers with his usual signature.

Tenders by partnership firm must be signed by all partners. The full name and addresses of all the

partners shall be furnished. The tenders by Corporation / Companies must be signed with the legal

name of the Corporation/Company by the president/or by the secretary or other person or persons

legally authorized to bid the Corporation/ Company in the matter.

6 TENDER VALIDITY PERIOD

The validity period of the tender submitted for these works shall be 180 Calendar days from the date

of opening of the technical bid and that the tenderer shall not be allowed to withdraw or modify the

tender offer on his own during the validity period. The tenderer will not be allowed to correct the

tender or make any modifications or additions in the terms and conditions of his tender. If this is done

then the Corporation shall, without prejudice to any right or remedy, be at liberty to reject the tender

and forfeit the Earnest Money Deposit in full.

7 WITHDRAWAL OF TENDERS

If, during the tender validity period, the tenderer withdraws his Tender, the Tender Security (Earnest

Money) shall be forfeited and the Tenderer may be disqualified from tendering for further works under

the jurisdiction of the Surat Municipal Corporation

8 ERRORS AND DISCREPANCIES IN TENDERS

In case of conflict between the rate mentioned in figures and words, the rates expressed in words

shall prevail and apply in such cases.

9 SIGNING OF TENDER DOCUMENT

If the tender is submitted by an individual, it shall be signed with his full name above his current

address. If the tender is made by a proprietary firm it shall be signed by the proprietor above his

name and the name of his firm with his current address. If the tender is made by a partnership firm it

shall be signed by all the partners of the firm above their full names and current address, or by a

partner holding the power of attorney for the signing the tender in which case a certificate copy of the

power of attorney shall accompany to the tender. A certificate copy of the partnership deed, current

addresses of all the partners of the firm shall also accompany the tender. If the tender is made by a

limited company or a limited Corporation, it shall be signed by duly authorised persons holding the

power of attorney for signing the tender in which case a certified copy of the power of attorney shall

accompany to the tender. Such limited company or Corporation may be required to furnish

satisfactory evidence of its existence before the contract is awarded.

10 GENERAL PERFORMANCE DATA

Tenderer shall present all the information which is sought for in the tender documents in the form of

various schedules. Tenders may not be considered if left blank or the schedules are not properly

filled in before submission of the tender.

11 OPENING OF TENDER DOCUMENTS

Technical bid of the tender will be opened on any next working day after last date of submission of

the tender to ensure data of the Tender Document Fee and EMD and other relevant documents If

12 EVALUATION OF TENDER

After opening of the tender, SMC will examine the tender document thoroughly. The tenderer fails in

fulfilling the requirement, regulation and specification of the tender documents will be rejected out

rightly and select the bids qualified for opening the price bid. Price bid submitted on line will be

opened by SMC on suitable date.

13 BID EVALUATION CRITERIA

a Bidders should have valid authorised operating license for operating Airtime services for

Ultra high frequency (UHF) trunking wireless sets in surat circle Gujarat area as per DoT

guidelines. Bidder should have minimum 07 years experience of operating Airtime services of

UHF radio trunking systems (i.e.LTR,NEXTEDGE,MOTOTURBO).

14 TAXES AND DUTIES ON SERVICES/MATERIAL

All charges on account of excise, Goods and Service Tax (GST), Labour Welfare Cess (Construction

cess) and other duties on parts obtained for the works from any sources shall be borne by the

New statutory taxes/duties or changes in rate of tax structures by State / Central Government / local

authority after submission of tender which have financial effect shall be borne by SMC and shall be

reimbursed on production of receipt of payment

total works and include all costs due to parts, labours, supervisions, other services royalties and

octroi, all taxes and duties, works contract tax etc. and to include all extras to cover the cost.

b No erasures will be permitted, mistakes may be crossed out and correction typed or written in ink

adjacent thereto, and must be authorized in ink by the persons signing the tender. All extensions of

prices and arithmetic shall be checked before submission of the tenders.

Rates must be quoted in figures as well as in words. If there is discrepancy between the rates quoted

in figures and in words, the rates expressed in words shall be considered as binding.

c The exact percentage of taxes, duties included must be stated.

d Price Variation Clause of any form shall not be accepted. Price shall remain firm till execution of

16 PAYMENT TERMS

a Payment shall be done on monthly basis after submission of monthly Airtime service bill.

b Payment terms other than mentioned here in above shall not be considered or acceptable.

Advance payment term shall not be accepted by the Corporation. All payments are subject to income

tax and sales tax, GST deduction at source as per rule.

All payments shall be made by A/C payee Cheque of any Nationalised / Schedule Bank, Surat

Branch only. Bank Commission charges for payment through bank or Demand Draft will be born by

the supplier, except otherwise mentioned. Contractor may choose the option for ECS payment facility

by submitting necessary documents in Account Department, SMC, Surat

17 DELIVERY PERIOD / TIME LIMIT

Service period of above works will be implemented with immediate effect from date mentioned in

work order. No extra time shall be given for setup or granting any other related permissions. Bidder

shall have preparedness for ready to give service.

a The successful tenderer has to fulfil the order within prescribed time-limit failing which penalty at a

rate of 0.2% of the total order value per day subject to maximum of 10% of the total order value shall

be charged. The Corporation also reserves right to cancel the order in such case. As the wireless

services is being used by critical emergency services/health services down time of network is strictly

not acceptable. However due to technical limitation at the time of only routine repairs and service not

more than 15 mins down time allowed. As well as prior intimation must be given to SMC for same.

Failing to this 1% of the monthly bill amount will be deducted per hour subject to maximum of monthly

Airtime services of UHF radio trunking wireless sets should minimum to area of Surat Municipal

Corporation boundaries, extended service area is desirable. Bidder should provide extended area

service without rise in rates if boundaries of Surat Municipal Corporation extends

1 PREPARATION OF TENDER DOCUMENTS

2 Tenderers are requested to note the following while preparing and submitting the tender documents

for each work and submit the necessary documents mentioned under each section of the tender.

Tenderer shall submit all documents mentioned under “data base of tenderer” section

3 The tenderer shall submit Tender Form in bound volume here in English. All tender parts and

statements shall be properly filled. Numbers shall be stated both in words and in figures were so

indicated and signatures of all persons signing shall be in long hand.

4 The Bidder should have registration with any Government Organization such as NSIC/DGS&D/SSI

etc & have to submit the valid copy for the same.

5 Attested copy of valid operating licence for Surat Circle, Gujarat state for tender items duly signed by

tenderer must be furnished with the tender.

6 A satisfactory performance certificate/work order/PO from clients / users for operating uhf trunking

airtime services should be enclosed along with technical bid.

7 SOLVENCY CERTIFICATE

Latest valid Solvency Certificate as per tender Terms / Condition (minimum 20% amount of the total

Tender value) must be attached.

8 The tenderer shall have to attach GST No/Certificate, sales tax, VAT, Service tax, PAN No.

certificates with residential address evidences for each work.

9 Tender as a partnership firm, attested copy of partnership deed, delegation of power given to partner

for submission & signing the tender document and agreement if any must be enclosed along with

4. OTHER TERMS AND CONDITIONS

1 Offer should be exactly as per the terms / conditions and scope of tender and no chance will be given

for any sort of clarifications after opening of tender. Offers not in the line of above will be liable for

outright rejection.

2 SECURITY DEPOSIT

The successful tenderer shall require entering into contract agreement within 15 days after receipt of

WORK ORDER. The contract agreement for each work shall be executed on Non Judicial stamp

paper (Gujarat State) to be purchased by the tenderer. Contractor shall also execute surety bond on

Non Judicial stamp paper (Gujarat State) for successful completion of the work.

Successful tenderer shall require execute contract agreement and surety bond. Contractor shall

required to deposit an amount 2% of total order value amount as a Security Deposit either by

Demand Draft / Pay order on the name of “Municipal Commissioner, Surat Municipal Corporation”,

payable at Surat.

3 Conditional tenders shall not be accepted in any case.

4 No correction, overwriting erasures in filling tender papers shall be considered unless countersigned.

5 In case of any mis-understanding due to interpretation of any terms, conditions or specifications the

decision of Municipal Commissioner, Surat Municipal Corporation, Surat shall be final and binding to

6 The contract shall be constituted according to and subject to laws in India and State of Gujarat and

under the Jurisdiction of Courts of Surat only.

7 Any dispute arising out of the contract shall be subjected to "SURAT JURISDICTION" only.

8 No officer, Employee of Municipal Corporation is directly or indirectly admitted to any share or parts

of this contract to any benefit that may rise there from.

9 Tender documents are non transferable.

10 Municipal Commissioner reserves the right to reduce the scope of work and split the tender in two

parts or more without assigning any reason even after award of contract.

11 Corporation will not defray expenses incurred by tenderer in tendering.

12 The rates as well as any discount shall have to be offered in the price- schedule-B online only and all

the tender documents duly filled in wherever necessary and each paper duly signed must be

returned. If any page is taken out or tender papers are not returned or any change is made in tender

papers, the EMD shall be forfeited and the offer shall be rejected out rightly. Tenderer may attach

separate sheet for any remarks or specifications of the items intend to specify along with the tender

13 Right to accept any or to reject any all tenders without assigning any reason thereof is reserved by

the Competent authority of the Corporation.

tender. No-dispute at a later date shall be entertained.

15 Receipts for payment made on account of any work, when executed by a firm, should also be signed

by all the partners, except where the tenderers are described in their as a firm, in which case the

receipts shall be signed in the name of firm by one of the partners, or by some other person having

authority to give effectual receipts for the firm.

16 The Tender will be liable to be rejected out rightly, if while submitting it :-

a The Tender proposes any alteration in the work specified in the tender or in the time limit allowed for

carrying out the work or any other condition.

b Any of the pages of the tender are removed or replaced. Any errors are made by him in the tender.

c All corrections and additions or pasted slips are not initialled by tenderers.

11. ANNEXURE – B

 Demand Draft for E.M.D. & Tender fee shall be submitted in electronic format only through online

(by scanning) while uploading the bid. This submission shall mean that E.M.D. & Tender fee are

received for purpose of opening the bid. Accordingly, offer / tenders of those tenderers, whose

E.M.D. & tender fee is received electronically, shall be opened. However, for the purpose of

realization of E.M.D. and tender fee, bidder shall send the EMD as well as Tender fee in required

format in original through RPAD / Speed Post so as to reach to Account Department (Main Office)

by the last date of submission of hardcopy bid.

 Bidder will have to submit penalty amount of Rs. 10,000/- for not submitting original Demand

Draft in the account department of Surat Municipal Corporation within 07 days from the last date

of online submission of the bid for the first time. If bidder will not submit the penalty amount within

10 days to Surat Municipal Corporation and /or bidder will not submit the demand draft in original

for the second time and after, Penaltative action shall be taken for abeyance of registration and

cancellation of E-tendering code for 06 (six) months. Any documents in supporting of bid shall be

in electronic format only through online (by scanning) & hard copy will not be accepted

 All documents must be coloured scanned to be seen as original. Scanning in black and white or

gray shall not be acceptable.

 All the documents must be notarised with clearly displaying stamp, number and name of the

12. SCOPE OF SERVICE WORK

1 Wireless Sets Means- Static wireless Sets, Mobile (vehicle mount) wireless Sets, All Walkie Talkie Sets

supporting analogue or digital technology.

Surat Municipal Corporation runs approx. 600 nos different types of wireless sets from different makes and

models like Motorola GTX/Motorola max ls/Kenwood tk-480/Kenwood-980/Motorola PRO-7350/PRO

(IS)/Kenwood NX-420(digital)/Kenwood NX-3920(digital).all above mentioned sets must be supported by

bidder's wireless radio trunking system.

3 Bidder have to setup own wireless system with control room, Antenna and other adequate equipment in Surat

City. Service provider has to setup secondary supported network where coverage is poor or inadequate.

4 Airtime services of UHF radio trunking wireless sets must be minimum to area of Surat Municipal Corporation

boundaries, extended service area is desirable. Bidder should provide extended area service without rise in

rates if boundaries of Surat Municipal Corporation extends

5 The system should operate for 24 hours, continuously without any disruption.

6 If there is any break down during emergency, prompt services to be provided to rectify the problem.

7 As per the requirement of Surat Municipal Corporation, activation /deactivation /programming / reprogramming

/ frequency tuning/channel separation/channel setup of wireless sets should be done against request without

any extra charges. Extra payment shall not be entertained any case even if number of wireless sets

increase/decrease.

8 Bidder should have all the permissions of Govt. Regulatory Authority for wireless services during whole

contract period, If bidder fails to get permission and due to this any loss occur at SMC side SD shall be

subjected to forfeit.

9 As wireless services is very crucial at the time of natural /manmade disaster/calamities bidder has to provide

all kind of emergency backup for wireless system including electric generator set/battery bank/extra repeater

with antenna and wireless subsystem to run wireless system uninterruptedly in any situation.

10 Wireless service offered by bidder must be compatible to analogue as well as digital technology.

11 Rates quoted by bidder shall be remaining same for digital wireless service in case Surat Municipal

Corporation puts more Digital wireless sets in service. Extra payment shall not be entertained any case.

12 Surat Municipal Corporation has rights to increase/decrease the number of wireless sets in service.

13 Rates quoted for airtime service of wireless sets should be for 02 years as mentioned in price bid schedule.

However Surat Municipal Corporation has rights to lower down validity period according to requirement
