Eligibility Criteria

Bidders shall not be under a declaration of ineligibility for corrupt and fraudulent practices issued by Government of Karnataka

It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of e-Procurement on or before the last date and time of bid submission.

EMD Payments through e-Payment mode shall be made as one single transaction and payments made in part are liable for rejection.

a)The Agency should have minimum Five years of experience in providing Manpower Services to Government of Karnataka /Government of India/Government Undertakings/Government Institutions like universities etc

b)The Agency should have experience in providing Manpower Services of Computer Operator and Gropu-D

c)The Agency should not have been declared as ineligible under corruption and fraudulent practices issued by Government of Karnataka /Government of India/Government Undertakings/Government Institutions like universities etc.

d)Annual turnover certificate for last five financial years i.e., 2020-21 to 2024-25 to be obtained from the Chartered Accountant and uploaded. The tenderer must have achieved in at least two financial years a financial turnover not less than Rs. 8.79 Lakhs. (The Agencies should upload proof of Audited Balance sheet, Profit and Loss Accounts, Income and Expenditure Accounts documents issued by C.A.)

The Agency should have the following Registration and other certificates & shall upload copies of certification along with the technical bid. i) Employees Provident Fund Registration Certificate issued by the Regional Provident Fund Commissioner. (Upload last 5 years, year wise statement of yearly returns submitted to EPF authorities.) ii)Any other registrations required as per the existing laws relating to Man Power Services. (Scanned Copies of the same should be uploaded). iii)IT returns for last five years i.e., 2020-21, 2021-22, 2022-23, 2023-24, 2024-25 (upload returns acknowledgement copies of each year filing). iv) Mandating satisfactory completion as a prime successful bidder for at least one similar work in last five years to an extent of 50% of the cost of the work or estimated cost i.e. Rs. 4.40 lakhs. v) Registration certificate for having registered under pertinent Act and competent Government authority (Scanned copies of the same should be uploaded). vi) PAN and TAN of Income tax department (Scanned copies of the same should be uploaded). vii) GST registration certificate (Scanned copies of the same should be uploaded). viii) Certificate of Registration under Professional Tax issued by Commercial Tax Department, Government of Karnataka. (Scanned copies of the same should be uploaded). ix) Registration Certificate under Employees State Insurance Act (ESI ACT). Previous years statements of half yearly & yearly returns submitted to Employee State Insurance (ESI) authorities (upload last 5 years statement including year wise statement of yearly returns submitted, year wise ESI returns details).

The Agency should have administrative staff with required skills, qualifications, good service record and should be free from litigations.

g)The Agency should have paid all statutory taxes like service tax, professional tax, timely payment of TDS deducted to IT department etc. (upload the related documents as specified in Para - 11 of this document)

The Agency shall abide by the provisions of Employees Provident Fund & Miscellaneous Provisions Act & Rules there under ESI Act the Contract Labour (R & A) Act and Workmens Compensation Act. Should have enrolled the eligible employees working with the Manpower Agency and remitted the required contributions at applicable rates to the concerned authorities regularly.

Agencies black listed by Government of Karnataka /Government of India/Semi Government Undertakings/Government Institutions like universities etc in the last five years are liable for rejection. Command Area Development Authority holds the right to terminate the agreement if any of the agencies are found black listed subsequently or later.

The required EMD should be paid through E-procurement only.

The bidder has to produce all the relevant Documents as indicated in the Bid Document in originals during the Evaluation of the Bid Mandatorily. This is in addition to Uploading all the relevant Documents in the e-procurement portal. If the Originals are not submitted, the Tender will be rejected.

CADA authority reserves the right to stop, cancel, postponement of this tender and other necessary actions in the interest of CADA at any stage of this tender without assigning any reason.

The successful Lowest (L1) Man Power Agency has to deposit 10 percent of contract value as performance security deposit in the form of DD/FDR/NSC to that extent in favor of Executive Engineer, M&G CADA Divn.No.2 Jamakhandi at the time of signing of Agreement.

The Agency shall issue ID cards to all the employees with Agencies logo. (ID card should have Name, Designation and Photo of the employee).

The Agency shall furnish wages slips to all the employees indicating Gross wages and Net wages showing all the statutory deductions.

The agency shall make the payment of wages to the outsourced employees within the 5th of following month and submit the bills for reimbursement within 10th of the following month along with statutory deductions with all details.

The Agency shall make the payment of wages to outsourced staff deployed through individual Bank Account and shall arrange to remit all statutory deductions like ESI/PF to the designated authorities along with the Agencies contribution as per law.

The Agency shall make timely payment of wages to its employees effecting authorized deductions and shall also be responsible to fulfill all statutory obligations such as remittance of PF, ESI remittance etc., in respect of its outsourced staff posted under this contract. If it fails to do so, it will be the breach of contract and Command Area Development Authority has its discretion to cancel the contract. The Agency shall also be liable for any pecuniary liability arising on account of any violation of the provisions of the relevant laws.

The Agency shall submit the ESI remittance challans of the staff deployed under this contract separately with all employee wise details along with the monthly bills. The Agency shall also submit the copy of the remittance of service tax to the appropriate authorities along with the Bills.

Remuneration for the outsourced Personnel shall be determined on the basis of time actually spent by such Personnel in the performance of the services as consolidated remuneration, including PF, ESI etc. And also it includes management contribution and employee contribution to PF and ESI etc, as applicable (Cost to Company).

The Agency shall maintain proper records pertaining to outsourced staff deployed including the wages slips, disbursement of wages, and remittance of payments, to the various statutory authorities and present the same to the Command Area Development Authority / concerned authorities whenever called for verification

The Agency shall maintain the muster roll/ pay roll and other wages relevant particulars pertaining to the outsourced staff deployed and shall make available for inspection by the officials of Command Area Development Authority, Labour Department and any other department as required by them, as and when arises.

The Agency should not sublet the contract. If the Agency is found to have sublet the contract, the contract will be terminated at the risk and cost of the Agency concerned

The scopes of services in respect of number of employees are liable for addition, deletion and modification and are at the discretion of Command Area Development Authority.

The bidder should quote services charges in rupees Only. Zero and Negative bid is liable for rejection.

If many bidders quoted lowest same price to the work and the award of work will be done by toss/ lottery system or by obtaining no objection certificate in this regard by other contractors who have quoted the same price.

Agency shall provide employees within 7 days soon after the Agreement, if fails to do so agreement will be cancelled by CADA.

Payment will be made to the actual quantity, not as per Agreement quantity. Agency shall note of this part while quoting the rates in the tender.

Payment will be made after completion of work satisfactorily and as per availability of grant.

As per the 14thVidhana Sabha Application Committee (2015-16) and as per recommendations in 21st Report, Outsourcing employees payment shall be made through individual account every month report has to be submitted.

If the Agency violates or unsatisfactorily manages the work, the tender will have to be cancelled with risk & cost by CADA.

Labour Risk Insurance : If any incidental losses occurs due to strikes, accident to the employees employed as peon and driver, the CADA Authority is not responsible, the agency has to bear the losses and it is the responsiblity of the agency (Labor Risk Insurance).

While on duty if the employees render any damage to vehicles, materials or any property of the authority, the agency has to bear the losses.

Authority reserves the right to fix/to be fixed by the Govt. as per Labor Act during service period, since from Agreement and after the end of service period.
