It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of e-Procurement on or before the last date and time of bid submission.

EMD Payments through e-Payment mode shall be made as one single transaction and payments made in part are liable for rejection.

The First Electronic Document (Technical bid) will be opened first and thereafter Second Electronic Document (financial bid) will be opened only of those bidders who qualify in the technical bid. In case the lowest bidder fails to produce the original documents for entering into an agreement or the original documents submitted does not match with the uploaded documents or found false, then his bid is treated as non-responsive bid as per clause -26(4) of the KTPP rules & his name would be recommended for cancellation of registration in Karnataka PWD and barred from participation in any of the tenders invited by the KNNL apart from forfeiting the EMD paid through E-cash.

Second Electronic Document (financial Bid) of the successful bidders who qualify in the technical bid will be opened after approval to the technical bid from the competent authority

The necessary certificates/documents in support of pre-qualification criteria fulfilled as stipulated shall be scanned and attached to e-tender document. The scanned signature of the bidder /authorized representatives of the bidder shall be attached while uploading the bid document

The intending bidder should have in last 5 years i.e. from 2021-22 to 2025-26, satisfactorily completed (not less than 90% of contract value) as a prime contractor, one similar nature of work, such as Construction/Improvement of Nala/ Canal works Consisting of Earthen Embankment, concrete structures like RCC Retaining wall/Bridge/ barrage/aqueduct/weir costing not less than 50% of the amount put to tender i.e,Rs.246.43 Lakhsin last five years. The work done certificate should be obtained duly signed from an officer not below the rank of Executive Engineer of the concerned Division and counter signed by the Superintending Engineer of the same circle or equivalent in case of other Government undertaking within India. The cost will be updated to the present value by giving a weight age of 10% for each year.

The intending bidder in his name should have in the last 5 years i.e., 2021-22 to 2025-26 achieved in at least 2 financial years, a minimum financial turnover of Rs.985.72Lakhs (usually not less than two times the estimated annual payments under this contract). The turnover prior to FY 2025-26 will be updated to the Present Price Level 2026-27 by giving weight age of 10% each year. Audited Profit and Loss account certified by a practicing Chartered Accountant bearing UDIN along with copy of Income Tax returns filed for the years indicated above should be furnished.

The intending bidder should have executed minimum quantity of i.Earthwork in excavation is 7404.80Cum in any one financial year, during the last five financial years (2021-22 to 2025-26). ii.Earthwork in Embankment) is 5951.20Cum in any one financial year, during the last five financial years ((2021-22 to 2025-26). iii. RCC Structure concrete quantity (Grade M-15 and above) is 2118.40Cumin any one financial year, during the last five financial years (2021-22 to 2025-26). iv. Reinforced steel is 116.80 tonne in any one financial year, during the last five financial years (2021-22 to 2025-26). The work done certificate should be obtained duly signed from an officer not below the rank of Executive Engineer of the concerned division and counter signed by the Superintending Engineer of the same Circle or Equivalent in case of other Government undertaking.

Tenderers who meet the above specified minimum qualification criteria, will only be qualified, if their available tender capacity is more than the total tender value (Rs.492.86 Lakhs). The available tender Capacity will be calculated as under: Assessed available tender Capacity Equals to (AxNx1.5 - B), Where, A - Maximum value of civil engineering works Executed in any one year during the last five years (updated to 2026-27 price level) taking into account the completed as well as works in progress. N - Number of years prescribed for completion of the works for which tenders are invited. B - Value, at 2026-27 price level of existing commitments and on going works to be completed during the Period of completion of the works for which tenders are invited.

If the bidder / bidders have participated in more than one work, the available tender capacity will be assessed and number of works will be awarded as per his available bid capacity.

Bidder should furnish liquid assets and/or availability of credit facilities of not less than Rs.148.00 lakhs from any Nationalized / scheduled bank Credit lines/letter of credit/certificates from banks for meeting the fund requirement etc. The format for Bankers Certificate/ Line of Credit (BC/LOC) letter to be issued by the Banks as per circular No: FD- CAM/16/2022 (P-2) dated: 22.08.2022.

To qualify for a package of contracts made up of this and other contracts for which tenders are invited in this IFT, the tenderer must demonstrate having experience and resources to meet the aggregate of the qualifying criteria for the individual contracts.

Thebid shall be technically evaluated based on the specifications indicated in Section-3 titled Qualification information in bid document. The Bidder or any of his partner shall not be under Corporate Debt Restructuring (CDR) / Strategic Debt Restructuring (SDR) or Bureau of Industrial and Financial Reconstruction (BIFR) in the last 5 Years prior to bid submission date. In this regard, the Bidder shall submit along with Bid, a certificate from their Statutory Auditor with a declaration that, the Bidder is not under CDR / SDR or BIFR.

During technical evaluation, if the employer finds that any certificates / information furnished is false, such bidders will be disqualified and barred from participation in the bid

If any bidder fails to satisfy the conditions mentioned above, such bids will be rejected and their financial bids will not be opened.

The bidder should enclose the detailed methodology of execution of the scheme as per the scope of work.

The Bidder shall be responsible for successful performance of the contract.

The Bidder to participate in the tender under single bid basis only. Any violation will attract disqualification of the bid.

The contractor/authorized signatory should attach his/her scanned signature to the Schedule-B before uploading and also submitting their tenders.

Conditional tenders are liable to be rejected. The officer competent to accept the tender shall have the right to reject any or all the tenders without assigning any reason whatsoever.

Corrigendum will be published in the web site/ newspapers/e-portal of all modifications /corrections if any.

Mineral Dispatch Permit (MDP) shall be paid (as per Mines and Geology Circular dated 7/11/2023 )as per the prevailing rates issued by the department of Mines and Geology from time to time together with GST at the applicable rates.

The contractor is to be abide to pay the royalty charges as per the prevailing Government Orders.

The intending bidders should note that, if any of lands either in part/ parts or in whole required for the work is not acquired by the Nigam, it shall be the responsibility of the bidder to take the possession of such land and start the work by obtaining consent of the land owners before commencement of work at no extra cost to the Nigam and no claim / delays whatsoever relating to on account of non-availability of land would be entertained.

If the percentage quoted by the contractor for the work is below ninety percent of the updated recast estimated amount put to tender, then the contractor shall furnish an additional performance security in the form of Bank Guarantee for an amount equivalent to the difference between the cost as per quoted percentage and 90% of the updated cost put to tender. In case of contractor quoting above 125% of updated cost put to tender, then the over and above 125% of the updated cost put to tender will be withheld during the progress of work. The additional performance will be released proportionately to the bill amount till the contractor achieves progress of the entire cost of the work as per agreement. The additional performance security and withheld amount in the later case will be released only after 30 days from the date of entire work contracted is fully completed and so certified by the competent. (If BG submitted while issuing fresh BG or extending any existing BG, claim period of a minimum one year from the date of expiry of validity period of BG is to be specified invariably).

They should abide by the directions of Government towards recovery of 1% (or as modified by the Government from time to time) Cess from the contractors bill under the provisions of building and other constructions worker welfare cess Act 1996.

The intending bidders are advised to visit the site of work, make themselves familiar with local situation about the availability of construction materials, work men, land required for construction activities, etc.

The contractor is responsible for any damages due to natural calamity the government or Nigam will not give any compensation for until the completion of maintenance period.

The intending bidder/firm/company are advised to visit the work site before submission of the tenders.

The contractor should mention their recent correct portal address & mail address in declaration forms.

The tender processing charges paid by the bidder/firm/company are not refundable even if the tender is cancelled.

The bidder/firm/company shall send the authorization letter for their representation duly attesting their signature.

Defect liability period for this work is 12 monthsfrom the date of issue of completion certificate by the competent authority for successful commissioning of the project.

Useful rubble and Stone chips obtained from excavation shall be issued to the contractor for use on works (including enabling works and aggregate crushing) at the rates specified for those materials in the prevailing Schedule of Rates

The bidder/firm/company shall adhere to accepted execution plan submitted by him under any circumstances without linking to the pending payment of the work & also land acquisition problems if any.

Typographical errors if any will not be the ground for any claims by the bidder/firm/company.

The contractor shall also abide by the other conditions as laid down in Bid document.

As per GO FD 5 EXP -12 / 2023 dated 15.05.2023 the contractor shall be abide to provide Bank Guarantee towards Security Deposits

Within 20 days of the receipt of the letter of acceptance, the successful tenderer shall deliver to the employer security deposit in any of the forms given below for an amount equivalent to 5% of the contract price plus additional security for unbalanced tenders in accordance with clause 25.5 of ITT & Clause 44 of the conditions of contract for all works

The contractor should take still photos / videos of the work before commencement of works, during execution and after completion compulsorily. These photos/ videos should be made available to the implementing officer, for immediate reference during review of works to enclose it with completion certificate.

The bidder at the time of execution of the agreement should give a detailed execution plan and fortnightly program to complete the work in full manner in maintenance period 2026-27 without fail. The program can be modified with mutual consent.

The work will be constantly monitored by the Executive Engineer and if there is any slippage in achieving the program/a penalty / liquidated damages as indicated in the agreement / tender document would be levied. However, these liquidated damages will be refunded if the contractor makes good the shortfall in the subsequent months or completes the whole work before the stipulated date of completion.

All materials like steel, cement etc., required for the above work should be procured by the contractor only at his own cost. And these materials will have to be got tested by the competent authority before put to use.

As per the Karnataka building and other construction workers welfare cess act 1996, 1 percent of the bill amount will be deducted from the bills.

The payment of bills of this work will be made as and when the letter of credit is received under the same head of account from KNNL/Government of Karnataka.

The contractors should adhere to the accepted action plan submitted by him under any circumstances without linking to the pending bill payment of the work.

The tender processing charges paid by the bidders are not refundable even if the tenders are cancelled.

The tenderer has to make his own arrangement for procurement of all materials required for the work. There is no departmental supply of materials.

Contractor should procure only ISI mark materials and submit necessary quality control certificates from the authorized quality control authority, before execution

Sub leasing of work in any form is prohibited.

The validity period of EMD shall be for a minimum period of 225 days from the date of opening of the tenders

The EMD of the unsuccessful bidder will be refunded only after the acceptance of the tender by the competent authority as per tender clause

The tender inviting authority has got right either accepting tender or rejecting the tender without assigning any reasons.

In case of death of contractor after executing the agreement commencement of the work , his legal heir if any eligible registered contractor and willing can execute and complete the work at the accepted tender rates irrespective of the cost of the work

EMD amount and Amount put to tender will be as mentioned in the e-portal of respective work

No quarries are approved by KNNL for materials. The quarries considered are for the estimate purpose only. The intending bidders shall visit the site, identify the quarries, ascertain availability for the quantity and quality of the materials required for the work and shall quote his rates accordingly. No extra claim whatsoever will be entertained in this regard.

Recovery of Excess or Irregular Payments : Any excess, irregular, or inadmissible payment detected at any stage whether during execution or after completion of the contract arising out of audit objections, financial scrutiny, or any form of review, shall be fully recoverable from the Contractor without any limitation of time or amount. Such recoveries may be effected from any pending or future bills, security deposits, performance guarantees, or any other sums due or becoming due to the Contractor under this or any other contract with the Employer. The Contractor shall have no right whatsoever to dispute, withhold, or seek exemption, compensation, or relief in respect of such recoveries, and the decision of the Employer in this regard shall be final and binding

Debarment of tenderers: The procurement entity may debar tenderer for a period not exceeding 3 years from participation in its tenders following such procedures as may be prescribed on the ground that tenderer is engaged in corrupt or fraudulent practices in competing or executing the contract including misleading the procuring entity or any stage of procurement activity with a fraudulent intention. ( KTPP Act 26A).
