Only electronic submission of offer in this website will be valid. The copies of the Documents including EMD sought shall be attached as scanned copies in e-procurement system. All corrigendums will be available in this web site only. New vendors are requested to obtain class III Digital Signature Certificate (DSC) with the company name from any certifying authority licensed by controller of certifying authority. The vendors are also required to get themselves enrolled on CPP Portal e-procurement website by using the DSC, as per instruction available on the website. Vendors should also have valid email address on this website. The DSC for both component (Signing and Encryption) is required to access the CPP Portal e-procurement website.) SELECT YES

2 Modification and Withdrawal of Bids No bid shall be modified after the deadline for submission of bids. No bid shall be withdrawn in the interval between the deadline for submission of bids and within the period of bid validity specified. Withdrawal or modification of bid during this period will result in forfeiture of Earnest Money Deposit and necessary action as deemed fit may be initiated. SELECT NO

4 Validity of Tender The period of validity of tender shall be minimum 90 days from the date of Technical Bid opening and the prices quoted shall be deemed to remain valid for this period. Tender documents are strictly non-transferable i.e. offer can be submitted only by the tenderers to whom tender documents have been issued. Offers submitted by others will be ignored. SELECT

5 Submission of EMD EMD to be submitted in the form of TDR/ Fixed Deposit Receipt, in the name of MUNITIONS INDIA LIMITED_ORDNANCE FACTORY BADMAL payable at SBI Badmal, Branch Code SBIN0008703 with minimum validity of three Months. EMD amount payable is mentioned in NIT. The vendors must write the tender No. on the reverse of DD/STDR/TDR/FDR for EMD. SELECT

6 EMD hard copy submission of The SEALED envelope containing EMD in Original in the form of Fixed Deposit Receipt/TDR, from any Nationalised Bank or ICICI/HDFC/AXIS Bank should be reached physically at OFBL either by post or by hand and should be deposited/dropped at EO tender box kept at Admin Gate of O.F. BADMAL. The envelope clearly super scripting the Name of Work, TE No and Name of the Contractor should be dropped on or before bid opening date & time failing which bid will be summarily rejected. N.B.:The size of sealed envelope containing EMD and documents related to EMD should be such that it can be dropped/inserted in the slot of the Tender Box. 10 Site Inspection The tenderer shall inspect the site if considered necessary and shall satisfy him-self of site conditions and shall collect himself any other information which he may require before submitting the tender. Claims and objections due to ignorance of site conditions will not be considered after submission of the tender. SELECT

11 Checking of specification & Drawing The tenderer shall carefully check the specifications and drawings and shall satisfy himself of the suitability of the work being offered before quoting and shall take full responsibility for the successful completion of the work within PDC. SELECT

12 Technical Specification The offer should conform to technical specification and general conditions of contract. SELECT

13 PDC Time is the essence of this contract. Hence contractor quoting will have to strictly adhere to the date of completion. The work is to be completed (as per time mentioned in NIT) (in accordance with the phasing, if any, indicated in the tender) from the date of placement/issue of Work Order. SELECT

14 Security Deposit The contractor shall have to pay/lodge Security Deposit as prescribed depending upon the Value of Contract Sum (3% on of the value of the contract) for the period of One (01) year in the form of Bank Guarantee or FDR and the same will be retained with Factory authorities against SD from the date of completion of the said work. Firm has to submit Security Deposit as mentioned in the contract within 30 days from the date of placement of order. The security deposit shall be pledged in name of Munitions India Limited_Ordnance Factory Badmal. The Security Deposit will be forfeited in the event of breach of contract by the contractor. SELECT

2 Effective Date of the Contract after Site Handover The contract shall come into effect on the date of signatures of both the parties on the contract after the site handover (Effective Date) and shall remain valid until the completion of the obligations of the parties under the contract. 3 RAR Bill RAR Bill payment will be made in stages as per the progress/value of work done based on the certificate/report rendered by the SIC, EIC & TE. The RAR bill shall be claimed by the contractor stating the progress of different activities. SELECT

4 Retention of Money Reserve money will be retained from the work done value as per IAFW 2249 and the same will be released at the time of final bill. SELECT

5 Final Payment Final payment will be made only after satisfactory completion of the work as per Contract Conditions & Specification and based on the certificate rendered by the SIC, EIC and TE. SELECT

6 Income Tax Income Tax shall be borne by the contractor. The contractor will be responsible to furnish Income Tax declaration and file returns with respective Income Tax Authorities as required under Indian Income Tax Act. SELECT

7 GST Goods & Service Tax (GST) and other Government taxes as applicable from time to time and which are all in force shall also be borne by the contractor and the quotation/offer shall be inclusive of all. It will be the duty of contractor to completely update him-self about prevailing taxes and rates and this office will not issue any certificate regarding taxes etc. The contractor should have valid Goods & Service Tax Identification No. (GSTIN) or Any other valid statutory registration as required by law. 8 Welfare Cess Welfare cess will be deducted from contractor's bill at the rate of 1% as per provision of B.O.C.W (Building & other Construction Workers) Act-1996 SELECT

9 Payment of Royalty Firm has to submit Royalty for minor minerals in the office of Tahasildar, Saintala at the prevailing norms and produce clearance certificate before claiming payment. SELECT

10 Workmen’s Compensation Act The contractor himself will be responsible against all claims for death or injury caused to any person, whether workman or not while engaged in any process connected with the contractor’s work or for dues of any kind whatsoever, and the OFBL shall not be bound to defend any claim brought under Workmen’s Compensation Act, 1923 or payment of Wages Act 1936, or any other statutory Act or Law or revisions in force from time to time and applicable against said work. 11 Notices on behalf of the Department Notices and certificates on behalf of the department in connection with the contract may be given by duly authorized officer of the department whose name shall be previously communicated in writing to the contractor. SELECT

12 Other Conditions The contractor will have to take extra precaution that the production activities are not affected/hampered at any way. The contractor is required to work in close co-operation with departmental Staff & Officers engaged to supervise the work. That the contractor should not make damage to any of the factory property and if so done, the factory authorities will initiate for suitable deduction from bills due to him. SELECT

13 Minimum Wages Act and Bonus Act (a) The workers shall be paid as per the Minimum Wages Act 1948 and to be followed as per the notification issued from Ministry of Labour from time to time. (b) The contractor has to follow all the provision of payment of Bonus Act 1965. SELECT

14 Rectification of Defect Work The firm shall undertake to rectify any defect including replacement of defective parts resulting from faulty design, poor workmanship, bad materials etc. during the erection as well as within guarantee period on free of charge. The contractor shall give guarantee for satisfactory performance of the work for a period of at least 10 years for roof treatment. If any leakage/seepage found in the roof or any other defects then contractor has to rectify it at his own expenses within the guarantee period specified. SELECT

15 Water & Electricity charges Water & electricity will be supplied by O.F.Badmal at the prescribed / prevailing charges and the same will be deducted from the contractor's Bill. Water will be charged @ 5.00 per Rs. 1000/- worth of value of work done of the contract. Electricity charges given by PS Section may be deposited in the account: Munitions India Limited_Ordnance Factory Badmal and submit the acknowledgement. SELECT

16 Compensation for delay Compensation for delay in completion of the work / Liquidated damage clause is accepted. Compensation for delay if the contractor fails to complete the work in all respect on or before the date fixed for completion, he shall without prejudice to any other right or remedy of Govt. on account of such breach be liable to pay compensation as per Condition No.50 of IAFW 2249. SELECT

17 Arbitration All disputes and difference arising out of or in any way touching or concerning the contract shall be referred to the Sole Arbitrator appointed by CMD, Munitions India Limited (MIL) and there should not be any objection to any such appointment that the Arbitrator so appointed is a Govt. Servant. The Sole Arbitrator may from time to time with the consent of the parties enlarge the time for making and publishing the award save as aforesaid as per rule. The award of the Sole Arbitrator so appointed by The CMD, Munitions India Limited (MIL) shall be final and binding on the parties to this agreement, subject as aforesaid, the Arbitration Act, 1940 and the rules thereunder and any statutory modifications thereof for the time being in force shall be deemed to apply to the arbitration proceedings. The venue of the arbitration shall be at O.F.Badmal, Dist: Balangir. SELECT

18 Dispute All disputes are subjected to Titilagarh Jurisdiction. SELECT

19.1 Cancellation of Contract in part or in full for contractor’s default .......Continued to Clause No.19.2...... If the Contractor: Makes default in commencing the Works within a reasonable time from the date of the handing over the site, and continues in that state after a reasonable notice from factory Or In the opinion of the CFA at any time, whether before or after the date or extended date for completion, makes default in proceeding with the Works, with due diligence and continues in that state after a reasonable notice from factory. Or Fails to comply with any of the terms and conditions of the Contract, or after reasonable notice in writing with orders properly issued thereunder, Or Fails to complete the Works, Work order and items of Works, with individual dates for completion and clear the Site on or before the date of completion. The CFA may, without prejudice to any other right or remedy which shall have accrued or shall accrue thereafter to Ordnance Factories/ units, cancel the Contract as a whole or only such Work Order(s) or items of Work in default from the Contract. Whenever the CFA exercises his authority to cancel the Contract as a whole or in part under this Condition he may complete the Work by any means at Contractors risk and cost, provided always that in the event of cost of completion or after alternative arrangements have been finalized by the Ordnance Factories/ units to get the Works completed, estimated cost of completion (as certified by SIC and EIC) being less than the Contract cost, the advantage shall accrue to the Ordnance Factories/ units. .......Continued to Clause No.19.2...... 19.2 .......Continued from Clause No. 19.1....... Cancellation of Contract in part or in full for contractor’s default .......Continued from Clause No.19.1....... If the cost of completion or after alternative arrangements have been finalized by the Ordnance Factories/ units to get the Works, completed, estimated cost of completion (as certified by SIC and EIC) exceeds the moneys due to Contractor under this Contract, the Contractor shall either pay the excess amount ordered by CFA or the same shall be recovered from the Contractor by other means. The Ordnance Factories/ units shall also be at liberty to hold and retain in their hands materials, tackle, machinery and stores of all kinds on Site, as they may think proper and may at any time sell any of the said materials, tackle, machinery and stores and apply the proceeds of sale in or towards the satisfaction of any loss which may arise from the cancellation of the Contract as aforesaid. The Ordnance Factories/ units shall also be at liberty to use the materials, tackle, machinery and other stores on Site of the Contractor as they think proper in completing the work and the Contractor will be allowed the necessary credit. The value of the materials and stores and the amount of credit to be allowed for tackle and machinery belonging to the Contractor and used by the Ordnance Factories/ units in completing the work shall be assessed by the SIC and EIC and the amount so assessed shall be final and binding. In case the Ordnance Factories/ units completes or decides to complete the Works or any part thereof under the provision of this Condition, the cost of such completion to be taken into account in determining the excess cost to be charged to the Contractor under this Condition shall consist of the cost or estimated cost (as certified by SIC and EIC) of materials purchased or required to be purchased and/or the labour provided or required to be provided by the Ordnance Factories/ units as also the cost of the Contractors materials used with an addition of such percentage to cover superintendence and establishment charges as may be decided by the CFA, whose decision shall be final and binding. 20 Submission of Bar Chart/PERT Chart The contractor shall submit a Bar chart / PERT chart showing the completion of the work vis-a-vis the simultaneous progress of independent works/different activities at the same time so as to complete the work within the stipulated time. The chart shall indicate the planning of the work with progress and completion in time. SELECT

21 Execution/Supervision of Work Execution of the subject work shall be carried out strictly as per the specifications mentioned in MES SSR-2009 Part-I and the materials shall be used as per IS specifications. The work shall be executed as instructed / directed by Site In-charge / Engg. In-charge of the work from time to time. The contractor shall follow and execute all works as per the instructions of SIC/EIC with the approval at every stage and then progress the work. The progress of the work shall be recorded day to-day basis in the prescribed work-diary for checking. Agreed for inspection of work at every stage of work . SELECT

22 Approval of Material All good quality of Materials shall be brought by the contractor for incorporation in the work and shall be got checked & approved by the EIC / SIC before incorporating in the work. All ISI marked / EIC approved materials for Building materials and approved branded Electrical materials as directed by EIC shall be supplied by the contractor for incorporation in the work. Agreed for bringing material for incorporation in the work as specified/as directed/as per IS specified and approved. SELECT

23 Plant & Machinery The Plant & Machineries like Concrete Mixer, Vibrator & other machineries like Tools, Tackles, Welding arrangement, Gas cutting equipments etc; has to be arranged by the contractor of his own and shall be in good condition. SELECT

24 Security Instruction Agreed for execution of work inside the factory (Restricted Area) by adhering all Factories and Security Rules & regulations which are in force. Contractor shall engage Indian Nationals after verifying their antecedent and Liability. Contractor should furnish the detail particulars of labourers / workman while engaging inside Factory and Estate area. The contractor should bring the material inside the factory after obtaining due permission and following the procedure laid down by factory authorities strictly, the surplus material after the work is over, shall be allowed to take out after due verification as per the security standing instruction of this factory. SELECT

25.1 PVR Only the PVR cleared persons will be allowed to go inside the factory and contractor immediately after getting the S.O./Work Order should contact the Security Section and fill up the PVR form of its employees and submit to Security Section. It is the responsibility of contractor to ensure that the PVR of its employees is cleared. Agreed for deploying only Police Verified (PVR) workers. SELECT

25.2 Character/Antecedents The Contractor would, at his own responsibility expenses get the character/antecedents of his Employees verified through the local policy authority and would employ only such persons in the work. SELECT

25.3 PVR Clearance The contractor or his representative or every workman so engaged by the contractor for any civil/electrical work should possess PVR clearance. Alternative temporary arrangement like temporary character certificate and Notary affidavit for maximum period of 3 (three) months only pending PVR is allowed. No extension beyond 3 (three) months relaxation shall be allowed. SELECT

25.4 .......Continued from Clause No. 25.3...... The contractor’s labourers having PVR clearance should have invariably in their possession, the identity by wearing distinguished jackets or red ribbon on their right bicep showing their names and the name of the contractor under whom they are engaged all the time during the working hours or during their stay period inside factory or Estate area for easy identification. SELECT

25.5 Violation of Security Instruction Punitive action will be taken as deemed fit by the Factory authority, if a contractor is found to be violating the security instructions. It will be at the discretion of the Fy. Authority that a contractor may be banned for further works, in the event of violation of security instructions. SELECT

25.6 Wearing of Identification Jackets by Contractor’s Labourers The contractor’s labourers & their supervisors entering the Factory shall be required to wear the “MAROON COLOURED JACKET” and the cost of the jacket shall be borne by the contractor only. If the required condition is not followed, the Security officer will have the right to stop the entry of contractor’s labour / Supervisor inside the factory for working. SELECT

25.7 Identity Card passes The contractor, his agent and representative are required individually to be in possession of identity cards of pass duly verified by the Police Department, the identify card of pass will be examined by the security staff at the time of entry into or exit from the restricted area (s) and also at any time or any number of times inside the restricted area (s). SELECT

25.8 .......Continued from Clause No. 25.7...... Every workman shall be in possession of an identity card each and every time. The identity cards shall be issued after the search, investigation of the Coincident of workmen by the contractor and attested by the Security In Charge of the area in accordance with the standing rules and regulation of the factory authorities. Contractor should follow all the contract labour/workmen act in the interest of contract labourers. Contractor shall be responsible for the conduct and action of his work agency or representative’s passes will be issued by factory authorities for the entry and exit of contractor labour through Gate-1 only. SELECT

25.9 Returning of passes identity cards after completion of the work All identity cards and passes shall be returned by the contractor, to the factory authority after the completion of work under this contract. In case of issue of identity cards, the contractor will have to pay penalty as per requisite on the subject. SELECT

25.1 Search The contractor/labourers have to undergo search any time at sites in restricted areas. SELECT

25.11 Female Search If the contractor desires to employee female labour on works to be carried out inside the OFBL and female searcher is not borne on the authorized strength of the factory at the time of submission of the tender, he shall be deemed to have allowed on his tender for pay and allowance etc., for female searcher if employed by the contractor inside the area. The General Manager/OFBL decision in regard to the amount recoverable on this account from any contractor shall be final and binding. SELECT

25.12 Entry of manpower & Vehicle Within the restricted areas: - 1) The contractor or his agent (s)/ representatives working/ materials carts, truck etc. will be allowed to enter the restricted area through the Gate No. 1 of this factory. Thorough search will be through conducted by the security staff for as many time on the Gate is used for entry and / or for exit date for security reasons to any time or any number of times to work site. The contractor shall note that certain time may be lost on account of restriction mentioned in this clause, such as searches etc. thus affecting working hours and therefore the contractor should ensure before quoting against tender. 25.13 Condition of Working The work under this contract is in “Restricted/under restricted area” The following are the condition for working with in restricted area. SELECT

25.14 Definition: Restricted area For the purpose of this contract means the area declared as such by factory authorities. Visit to site within restricted area (s). SELECT

25.15 .......Continued from Clause No. 25.14...... Permission to either one restricted area (s) before the submission of tender can be obtained from the General Manager, Ordnance Factory Badmal, Bolangir, tenderer are advised to send Prior initiation to the General Manager about particulars of their agents representative etc, if any the dates and times of their proposed visits, so that necessary arrangements may be made by him for admission. The tenderer should have full knowledge of the restrictions of entering inside the factory area and working within the restricted area (s). SELECT

25.16 Working hours Even though the work is in restricted area for the contractor and his workmen shall be allowed to work from 8.30 AM to 5.00 PM at the work site within the restricted area. SELECT

25.17 Working in Holidays The contractor shall not carry out work on Gazetted Holidays, Weekly holidays and other working day except when especially authorized in writing to do so by the General Manager of the Factory may at also discretion declare any day as holiday of Non-Working day without assigning any reason for such declaration SELECT

25.18 Account of Restricted area after completion of the work After the completion of work, surplus stores etc. are to be removed by the contractor or his agents & make the area clean. Representatives of contractor or workmen etc. will have access allowed having any account to the restricted area (s) except for extending of rectification the defects pointed out to him by the JT.GM/WM or by the Engineer In Charge of the work. 26.19 Firm precaution: - Firm/contractor should take following precautions The contractor, his agent, representatives, workmen etc., shall strictly follow the order pertaining in firm precaution prevailing within the restricted area. Motor transport vehicle if allowed by the authorities to enter into restricted area must be fitted with serviceable fire extinguishers. Gas welding will not be carried inside the factory area. Advance intimation of 3-4 days will have to be given by the contractor to factory authorities before any electric welding is required to be carried out so that necessary permission can be taken. 25.2 Entry/Exit of Material The contractor should bring the material inside the factory after obtaining due permission and following the procedure laid down by factory authorities strictly, the surplus material after the work is over, shall be allowed to take out after due verification as per the security standing instruction of this factory SELECT

26.1 Safety Instruction The contractor should have to adhere to all the Safety Rules / Regulations laid down by Safety Section / O.F.Badmal & also MIL safety instructions from time to time. Before execution of work, WORK PERMIT should be obtained from Safety Section/Ordnance Factory Badmal. SELECT

26.2 Appoint of Technical Staff The contractor shall give details of Engineers, Technical persons skilled persons with their qualifications & experience along with the details of plant & machineries, Trucks & other machineries owned by him for execution of the work. 26.3 PPEs for Workmen The workmen should be well equipped with protective items like hand gloves, safety goggles, safety shoes, helmet, safety belt etc. SELECT

26.4 Working on Height The workers engaged to work above 3 mtr. height shall be medically checked and necessary medical certificate shall be produced. SELECT

26.5 Use of Scaffolding While doing work at height, Scaffolding must be rigidly tied and adequate. Platform if any used must be spacious, safe for movement of men over it. The opening should be avoided so that there is no chance of man falling through it. SELECT

26.6 Use of Safety Belt Ropes are to be fixed to vertical pillar or cross beams as necessary wherein the end of safety belt can be tied. SELECT

26.7 Use of Ladder Ladder used for painting must be tied by rope at the top of beams where it is leaned for white washing in nearby area. It should be also held by the helper on the platform. SELECT

26.8 Painting Work at Height White washer and helper must have adequate experience of work at such height. SELECT

26.9 Safety Measure Supervisor of contractor must be efficient, technically sound and experienced enough to ensure full safety measures before start of the work. SELECT

26.1 Inspection of Site Contractor himself inspects the site and gives clearance prior to start the work. SELECT

26.11 Clearance of Work Commence Unless EIC/Site-In-Charge gives the clearance about adequate safety measures taken by contractor, no work should be started. SELECT

26.12 Prohibition of drink/drug Workmen should not be under influence of any drinking/drug SELECT

26.13 Workmen Mental & Health Condition Workmen should be in good health and sound mental condition. SELECT

26.14 Restriction of Workmen Movement Workmen movement should be restricted to only in the working area and they should not go to any un-authorised place. SELECT

26.15 Accessibility of road/gantry Workmen should not block the road/gantry/area by dumping the Bldg. materials/boxes. SELECT

26.16 Precaution while working Workmen should observe general safety precautions by applying commonsense to avoid any incident while working. SELECT

26.17 First aid box First aid box for immediate use in case of accident should be made available by contractor. SELECT

26.18 Factory Act & Odisha Factory Rule Workmen should carry the load while working at height in accordance with the Factory Act 1948 & Odisha Factory Rule. SELECT

26.19 PPE while working in Height Workmen should use safety belt, Helmet while working in height. SELECT

26.2 Work Permit Proper work permit system mentioning all necessary safety precautions, while working at height should be taken care of. SELECT

26.21 Area Barricading Barricading the portion on ground beneath working Zone at top. There should not be any movement of the personnel in this area if there is a constant risk of fall of any object from height. SELECT

26.22 Shut-down of electric supply The contractor is required to take the shutdown of electric supply, day-to day basis, before commencement of work for the purpose, he has to obtain a permit from factory (PS Section) every day in prescribed Proforma and discharge the same after the end of the day work (The shut down can be given between 8.30 A.M. to 4.00 P.M. on all working days). All Safety precaution will be taken by the contractor with regard to safety of workmen working at height on the poles to avoid any electric or other accidents. SELECT

26.23 Shut-down of furnace/machine Seeking permission from OFBL for the shutdown of furnace or machines wherever required at site. SELECT

26.24 Display of Work Instruction Further, suitable Safety Precautions/Work instructions may be displayed for all workmen/Supervisor/Fy. Worker/Visitors who are likely to encroach/approach area under construction. SELECT

26.25 PPEs for Safe guard in Important area Further, to make any essential movement in the aforesaid area, the individual (s) must wear Helmet and other PPEs, safe guard themselves fully, due to likely fall of any object from the height. SELECT

26.26 Workmen Compensation Act In case of an accident caused to a contractor’s worker while working, the provision of medical treatment and compensation for the period of his absence shall be ensured by the firm and they should be covered under Employee’s State Insurance Scheme or the Workmen Compensation act. All the medical expenses for treatment or medicine is to be borne by the contractor. SELECT
