2. INSTRUCTIONS TO TENDERER / BIDDER

1. Name of work: Supply of PoC Radio sets

(a) PoC Radio sets – 500 Nos.

(b) Subscription and Dispatch console charges (Consolidate).

2 EXAMINATION BY TENDERERS

a At his own expenses and prior submitting his tender, each tenderer shall

3 Tender Document Fee

a Each Tender must be accompanied by tender document fee of Rs. 4,248/- including GST

on the name MUNICIPAL COMMISSIONER, SURAT MUNICIPAL CORPORATION payable at Surat

only. Tender fee in form of cash, cheque, Bank guarantee shall not be accepted. Tender without

4 EARNEST MONEY DEPOSIT

a Each Tender must be accompanied by an Earnest Money Deposit of Rs. 2,49,080/-

b Earnest Money Deposit fee shall be submitted along with Hard copy submission in form of Demand

Draft on the name MUNICIPAL COMMISSIONER, SURAT MUNICIPAL CORPORATION payable at

Surat only. EMD in any other form cash, cheque, and Bank guarantee shall not be accepted. Tender

without EMD shall be out rightly rejected.

b The Earnest Money Deposit will be refunded to the unsuccessful tenderer after the award of the

5 SUBMISSION OF TENDER DOCUMENT

a Tenderer / Bidder shall submit their tender document on n-procure web portal

f Sealed tender duly super scribed with tender notice number, name of work and due date must reach

to the office of the Chief Accountant, Surat Municipal Corporation, Muglisara, Surat - 395003 on or

before the date and time mentioned in tender documents through RPAD / Speed post through postal

authority only. The Corporation shall not be responsible for any postal delay. Tender sent through

Angadia / Courier / Hand Delivery shall not be accepted.

g No delay on account of any case for receipt of tender shall be entertained. Tenders received or due

to be received after the time limit is over will not be accepted and if inadvertently accepted, will not

be opened and will be returned unopened. The tenders who may get opened before the due date

with no indication having been given on the outside of the envelope are liable to be rejected

h Mailed tenders must be sent in a covering envelope by Registered Post Acknowledgement due. The

return receipt will be endorsed to show the date and time of receipt. Mailed tender not received at the

required place before the date and time set for the receipt of tenders will be rejected.

The tender must contain the name, address and residence and place of business of the persons

submitting the tender and must be signed and sealed by the tenderers with his usual signature.

Tenders by partnership firm must be signed by all partners. The full name and addresses of all the

partners shall be furnished. The tenders by Corporation / Companies must be signed with the legal

name of the Corporation/Company by the president/or by the secretary or other person or persons

legally authorized to bid the Corporation/ Company in the matter.

6 TENDER VALIDITY PERIOD

The validity period of the tender submitted for this work shall be 200 Calendar days from the date of

opening of the technical bid and that the tenderer shall not be allowed to withdraw or modify the

tender offer on his own during the validity period. The tenderer will not be allowed to correct the

tender or make any modifications or additions in the terms and conditions of his tender. If this is done

then the Corporation shall, without prejudice to any right or remedy, be at liberty to reject the tender

and forfeit the Earnest Money Deposit in full.

7 WITHDRAWAL OF TENDERS

If, during the tender validity period, the tenderer withdraws his Tender, the Tender Security (Earnest

Money) shall be forfeited and the Tenderer may be disqualified from tendering for further works under

the jurisdiction of the Surat Municipal Corporation

8 ERRORS AND DISCREPANCIES IN TENDERS

In case of conflict between the rate mentioned in figures and words, the rates expressed in words

shall prevail and apply in such cases.

9 SIGNING OF TENDER DOCUMENT

If the tender is submitted by an individual, it shall be signed with his full name above his current

address. If the tender is made by a proprietary firm it shall be signed by the proprietor above his

name and the name of his firm with his current address. If the tender is made by a partnership firm it

shall be signed by all the partners of the firm above their full names and current address, or by a

partner holding the power of attorney for the signing the tender in which case a certificate copy of the

power of attorney shall accompany to the tender. A certificate copy of the partnership deed, current

addresses of all the partners of the firm shall also accompany the tender. If the tender is made by a

limited company or a limited Corporation, it shall be signed by duly authorised persons holding the

power of attorney for signing the tender in which case a certified copy of the power of attorney shall

accompany to the tender. Such limited company or Corporation may be required to furnish

satisfactory evidence of its existence before the contract is awarded.

10 GENERAL PERFORMANCE DATA

Tenderer shall present all the information which is sought for in the tender documents in the form of

various schedules. Tenders may not be considered if left blank or the schedules are not properly

filled in before submission of the tender.

11 OPENING OF TENDER DOCUMENTS

Technical bid of the tender will be opened on any next working day after last date of submission of

the tender to ensure data of the Tender Document Fee and EMD and other relevant documents If

any. All original tender documents shall be notarised and copy of any documents shall be attested

12 EVALUATION OF TENDER

After opening of the tender, SMC will examine the tender document thoroughly. The tenderer fails in

fulfilling the requirement, regulation and specification of the tender documents will be rejected out

rightly and select the bids qualified for opening the price bid. Price bid submitted online will be

opened by SMC on suitable date.

13 BID EVALUATION CRITERIA

a Bidders should have local valid DPL / authorised operating license, ETA Certificate holder as per

DoT guidelines. Bidder should have 05 years experience of manufacturing / supply of Analogue /

Digital Radio Wireless sets / Communication equipments. Manufacturer can also bid directly or

through its Authorised agent / distributor.

14 TAXES AND DUTIES ON MATERIAL

All charges on account of excise, Goods and Service Tax (GST), Labour Welfare Cess (Construction

cess) and other duties on parts obtained for the works from any sources shall be borne by the

New statutory taxes/duties or changes in rate of tax structures by State / Central Government / local

authority after submission of tender which have financial effect shall be borne by SMC and shall be

reimbursed on production of receipt of payment

total works and include all costs due to parts, labours, supervisions, other services royalties and

octroi, all taxes and duties, works contract tax etc. and to include all extras to cover the cost.

b No erasures will be permitted, mistakes may be crossed out and correction typed or written in ink

adjacent thereto, and must be authorized in ink by the persons signing the tender. All extensions of

prices and arithmetic shall be checked before submission of the tenders.

Rates must be quoted in figures as well as in words. If there is discrepancy between the rates quoted

in figures and in words, the rates expressed in words shall be considered as binding.

c The exact percentage of taxes, duties included must be stated.

d Price Variation Clause of any form shall not be accepted. Price shall remain firm till execution of

16 PAYMENT TERMS

a Payment will be made after successful completion of Supply and monthly payment made for

subscription work, subject to fulfilment of entire document related criteria required by the Account/

Audit department of SMC.

b Payment terms other than mentioned here in above shall not be considered or acceptable.

Advance payment term shall not be accepted by the Corporation. All payments are subject to income

tax and sales tax, GST deduction at source as per rule.

All payments shall be made by A/C payee Cheque of any Nationalised / Schedule Bank, Surat

Branch only. Bank Commission charges for payment through bank or Demand Draft will be born by

the supplier, except otherwise mentioned. Contractor may choose the option for ECS payment facility

by submitting necessary documents in Account Department, SMC, Surat

During the transit up to SMC office, Bidders shall take necessary insurance policy from date and time

of the dispatch to successful delivery of the products, against possible loss damage during transit

period. No extra payment shall be done on this account. Cost of insurance shall be covered under

18 DELIVERY TERMS / PERIOD / TIME LIMIT

Delivery period shall be 120 days from the date of the work order and overall subscription period will

be mentioned in work order. Contractor can also offer standby units / materials in case of any import /

Government hassles.

SMC may buy full/partial quantity from one/more bidder(s) and may split/ defer/ stagger the order(s)/

deliveries. The quantities shown in the tender are approximate and no claim shall be entertained for

variation of quantities being less or more than those mentioned in the bid. The variations in the

quantities shall not vitiate the contract. The selected bidder shall be bound to supply additional

quantity up to 30% (thirty percent) of tender amount/quantity, in accordance to any instruction, which

may be given to him in writing by SMC. The rates quoted by the bidder will be applicable on full /

partial /additional quantity also.

a The successful tenderer has to fulfil the supply order within prescribed time-limit failing which penalty

at a rate of 0.2% of the total order value per day subject to maximum of 10% of the total supply order

value shall be charged. The Corporation also reserves right to cancel the order in such case.

Radios being used by critical emergency services/health services down time/not attending complaint

call of service is strictly not acceptable. As radios may get malfunctioning in that scenario if any issue

arise at Server side or dispatch console shall get penalty of 5% of the monthly bill amount will be

deducted per hour subject to maximum of monthly bill amount from subscription and dispatch

console charges. If Surat Municipal Corporation avails subscription service with simcards same

clause applicable in case of connectivity issue.

b Necessary parts shall be supplied on as and when requirement basic within the specified period

c At the end of subscription service period or in case of termination, Bidders shall hand over all the

account credentials / login IDs/Passwords related to the Radio service to Surat municipal corporation

and all radios shall be able to reprogramming over the air. Failure to this will tend to punitive action

decided by competent authority of Surat Municipal Corporation.

20 PLACE of DELIVERY

The instruments shall be delivered at 6th Floor, New Annexy Building, Surat Municipal Corporation,

Gordhandas Chokhawala Marg, Mugalisara Surat-395003, Gujarat.

21 GUARANTEE / WARRANTY

The equipments / materials are to be guaranteed against manufacturing defect and piece to piece

replacement shall be done for a period of One year from the date of delivery. Joint inspection/testing

will be carry out for supplied equipments before accepting Delivery. Standard warranty shall be for

years for supplied equipments and 01 year for accessories.

3. DOCUMENTS TO BE SUBMITTED

1 PREPARATION OF TENDER DOCUMENTS

2 Tenderers are requested to note the following while preparing and submitting the tender documents

and submit the necessary documents mentioned under each section of the tender. Tenderer shall

submit all documents mentioned under “data base of tenderer” section

3 The tenderer shall submit Tender Form in bound volume here in English. All tender parts and

statements shall be properly filled. Numbers shall be stated both in words and in figures were so

indicated and signatures of all persons signing shall be in long hand.

4 The Bidder should have registration with any Government Organization such as NSIC/DGS&D/SSI

etc & have to submit the valid copy for the same.

5 Attested copy of attended dealership / distributors or repairer of company for tender items duly

signed by tenderer must be furnished with the tender.

6 A satisfactory performance certificate from clients / users for supply of such types of equipments

during last 08 years should be enclosed along with technical bid.

7 Bidders should mention make & model of the instruments quoted & enclose detailed technical

specifications and OEM's technical literature / leaflets along with the bids. Submitted without such

supporting documents will not be considered. Bidders shall not allow supplying alternate model which

was not quoted in technical BID.

8 In case the Bidders are not providing their own products, they will provide the valid authorization

certificate of the instrument manufacturer for sales & after sales service of the instruments.

9 Bidders to submit a full specification, model no., drawings charts, its specification, and other drawings

relevant to the offer. Offer of bidder who fails to submit specification & technical data shall be

1 Offer should be exactly as per the terms / conditions and scope of tender and no chance will be given

for any sort of clarifications after opening of tender. Offers not in the line of above will be liable for

outright rejection

2 SECURITY DEPOSIT

The successful tenderer shall require entering into contract agreement within 15 days after receipt of

WORK ORDER. The contract agreement shall be executed on Non Judicial stamp paper (Gujarat

State) to be purchased by the tenderer. Contractor shall also execute surety bond on Non Judicial

stamp paper (Gujarat State) for successful completion of the work.

Successful tenderer shall require execute contract agreement and surety bond. Contractor shall

required to deposit an amount 5% of for supply work and 2% for subscription / service work as a

Security Deposit either by Cash / Demand Draft on the name of “Municipal Commissioner, Surat

Municipal Corporation”, payable at Surat.

3 Conditional tenders shall not be accepted in any case.

4 No correction, overwriting erasures in filling tender papers shall be considered unless countersigned.

5 In case of any mis-understanding due to interpretation of any terms, conditions or specifications the

decision of Municipal Commissioner, Surat Municipal Corporation, Surat shall be final and binding to

under the Jurisdiction of Courts of Surat only.

7 Any dispute arising out of the contract shall be subjected to "SURAT JURISDICTION" only.

8 No officer, Employee of Municipal Corporation is directly or indirectly admitted to any share or parts

of this contract to any benefit that may rise there from.

9 Tender documents are non transferable.

10 Municipal Commissioner reserves the right to reduce the scope of work and split the tender in two

parts or more without assigning any reason even after award of contract.

11 Corporation will not defray expenses incurred by tenderer in tendering.

12 The rates shall have to be offered in the price- schedule-B online only and all the tender documents

duly filled in wherever necessary and each paper duly signed must be returned. If any page is taken

out or tender papers are not returned or any change is made in tender papers, the EMD shall be

forfeited and the offer shall be rejected out rightly. Tenderer may attach separate sheet for any

remarks or specifications of the items intend to specify along with the tender only.

13 Right to accept any or to reject any all tenders without assigning any reason thereof is reserved by

the Competent authority of the Corporation.

14 Any other details if required can be had from the office of the Chief Fire Officer, Fire Brigade H.Q.

Municipal Corporation, Muglisara, Surat-395 003, Gujarat, India on request and prior to submitting

the tender. No-dispute at a later date shall be entertained.

15 Receipts for payment made on account of any work, when executed by a firm, should also be signed

by all the partners, except where the tenderers are described in their as a firm, in which case the

receipts shall be signed in the name of firm by one of the partners, or by some other person having

authority to give effectual receipts for the firm.

16 The Tender will be liable to be rejected out rightly, if while submitting it :-

a The Tender proposes any alteration in the work specified in the tender or in the time limit allowed for

carrying out the work or any other condition.

b Any of the pages of the tender are removed or replaced. Any errors are made by him in the tender.

c All corrections and additions or pasted slips are not initialled by tenderers.

d The tenderer or in the case of a form each partner thereof does not sign or the Signature / Signatures

1. I, the undersigned, do hereby certify that all the statements made in the required attachments are

true and correct. I also understand that in case of wrongful / false information, corporation is entitled

to take any civil & criminal punitive action against me / us.

2. The undersigned also hereby certifies that neither our firm M/s. ___________________ nor any of

its constituent partners have abandoned any work in India nor any contract awarded to us has been

rescinded, during last five years prior to the date of this bid.

3. The undersigned hereby authorize(s) and request(s) any bank, person, authorities, government or

public limited institutions, firm or corporation to furnish pertinent information deemed necessary and

requested by the SMC to verify this statements or our competence and general reputation etc.

investigations to verify the statements, documents, and information submitted in connection with this

bid and to seek clarification from our bankers and clients regarding any financial and technical

11. ANNEXURE – B

 Demand Draft for E.M.D. & Tender fee shall be submitted in electronic format only through online

(by scanning) while uploading the bid. This submission shall mean that E.M.D. & Tender fee are

received for purpose of opening the bid. Accordingly, offer / tenders of those tenderers, whose

E.M.D. & tender fee is received electronically, shall be opened. However, for the purpose of

realization of E.M.D. and tender fee, bidder shall send the EMD as well as Tender fee in required

format in original through RPAD / Speed Post so as to reach to Account Department (Main Office)

by the last date of submission of hardcopy bid.

 Bidder will have to submit penalty amount of Rs. 10,000/- for not submitting original Demand Draft in

the account department of Surat Municipal Corporation within 07 days from the last date of online

submission of the bid for the first time. If bidder will not submit the penalty amount within 10 days to

Surat Municipal Corporation and /or bidder will not submit the demand draft in original for the second

time and after, Penaltative action shall be taken for abeyance of registration and cancellation of E-

tendering code for 06 (six) months. Any documents in supporting of bid shall be in electronic format

only through online (by scanning) & hard copy will not be accepted separately.

 All documents must be coloured scanned to be seen as original. Scanning in black and white or gray

shall not be acceptable.

 All the documents must be notarised with clearly displaying stamp, number and name of the notary.

12. Technical Specifications for Equipments and Subscription service with Dispatch Console

1 Bidders shall mention make & model of the equipment quoted & enclose detailed technical

specifications, technical literature / leaflets along with the bids. Submitted without such supporting

documents will not be considered. Bidders cannot change the offered make and model throughout

the final processing of tender.

2 Bidders shall submit the copy of valid DPL certificate / ETA Certificates as per DoT and Wireless

Communication related certificates from all govt. Departments along with Technical bid

3 Bidders shall provide service and repair facilities with warranty periods and service duration. For

this purpose local (From Surat City limit area) service engineer provided on call basis. As this sets

are going to use in public services complaint call shall be attend immediately failure to this penalty

clause may awake. Any transportation expenses will be borne by supplier/service provider for

service and repair for whole contract period.

4 Bidders / Supplier shall bear the activation / deactivation charges and installation charges

whenever activation/installation done. Cost shall be inclusive of this cost. Extra payment shall not

be entertained any case, failure to this deducted from SD.

5 Bidders shall offer Two year warrantee against manufacturing defects. Accessories likes,

Batteries, PSU, Display, Antenna, charger and adapter shall be warranted for one year.

6 For security and Quality Bidder shall provide minimum AES256, ISO 27001 & SOC 2 LEVEL

Certificates from manufacturer as well as device level encryption. For better security and scalability

bidder shall provide all subscription related or Dispatch console or Any other software related

service based on Global and reputed user friendly cloud based server facility like Amazon /

Microsoft Azure proof for the same shall be attached with the BID.

 PART – B - SUBSCRIPTION AND DISPATCH CONSOLE SERVICE FOR OF POC RADIO SETS

1. Bidder shall provide subscription service in support with the product quoted in Part-A

 Which include group call and private calls, location reporting, remote device

management, software service/update support.

3. Bidder shall provide centralised Dispatch console with full access rights exclusive for

radio quoted in above part A.

4. Subscription services for radios includes all charges of Centralise Dispatch console,

software updates (any radio or dispatch software), Gateway charges, or any other

connectivity or Registration charges.

5. Bidder shall provide such a subscription service and Dispatch console software which

are not restricted to the number of users. Number of radios quoted in this tender as well

as future expansion shall accommodate in the single dispatch console. However limited

user talk groups shall be design as per requirements of Surat Municipal Corporation.

6. Bidder shall provide training / installation - operational guidance/assistance for Dispatch

console or for any software which are being used in service throughout the contract

7. It is stated that all the features shall be provided to Surat Municipal Corporation for the

Dispatch Console including optional features mentioned in Data sheet, no extra

payment will be given.

8. The design rights (create/modified/deletion/rename) of user talk groups in Dispatch

console as well as in PoC radios shall be as per requirements of Surat municipal

corporation as well as Bidder shall provide service for (create/modified/deletion/rename)

of user talk group as per instruction given by competent person from Surat Municipal

Corporation. Subscription service and Dispatch Console shall meet minimum criteria as

9. Bidder shall provide rates with SIM card service and without SIM card service

(mentioned in price bid) for the subscription of PoC radio. According to the general use

of PoC radios, bidder shall ensure the proper network coverage of carrier and provide

SIM card services in case Surat Municipal Corporation accept offer with simcards.

However bidder shall comply testing of SIM cards services.

10. Bidder shall provide unlimited voice services for the PoC radios and provide data / voice

plan accordingly in case Surat Municipal Corporation avail offer with simcards.

11. Surat Municipal Corporation will not responsible for any network coverage related issue

for sim card service. Bidder shall provide alternate arrangements or change in carrier

service provider as per requirement in case Surat Municipal Corporation avail offer with

12. Bidder shall provide all certificates associated with the Quality of product and service

and necessary testing.

13. Before price bid evaluation Bidder has to provide 04 radio sets for demonstrations/

testing with subscription services and Dispatch console.

14. Price bid will be opened up for those bidders who set satisfactory performance in

demonstration. If quality of product and service does not found satisfactory Bidder shall

disqualified immediately.

15. As the subscription rates are for 02 years. In case Surat municipal corporation increase/

decrease the quantity of PoC radio sets then same subscription rates will be applicable

with the same terms and conditions for any increase/ decrease number of radio sets

16. At the end of service period or in case of termination bidder shall handover all the

accounts credentials/login ids/passwords to Surat Municipal Corporation and all radios

shall be able to reprogram over the air or like factory default. Failure to this will tend to

punitive action decided by competent authority of Surat Municipal Corporation.

 General Scope of Service Work

1. The system should operate for 24x7 hours, continuously without any disruption.

2. If there is any break down during emergency, prompt services to be provided to rectify

should be done against request without any extra charges. Extra payment shall not be

4. Bidder should have all the permissions of Govt. Regulatory Authority for wireless

services/ PoC Radio sets supply and its services, during whole contract period, if

bidder fails to get permission and due to this any loss occur at SMC side SD shall be

subjected to forfeit.

5. Rates quoted by bidder shall be remaining same for in case Surat Municipal

Corporation puts more PoC Radio sets in service. Extra payment shall not be

entertained any case.

6. Surat Municipal Corporation has rights to increase/decrease the number of PoC

Radio sets in service.

7. Rates quoted for Subscription / Dispatch console software/ Registration service of

PoC Radio sets should be for 02 years as mentioned in price bid schedule. However

Surat Municipal Corporation has rights to lower down validity period according to
