Criteria for Tender Fee and Earnest Money Deposit (E.M.D)
Eligibility for Exemption:
A. Micro & small-scale enterprises which participate directly in tendering process
for the product which they are manufacturing / service which they are
providing and have Udyam registration for items / service under procurement
B. Startups which participate directly in tendering process for the product which
they are manufacturing / service which they are providing and recognized by
DPIIT under the Start-up India Program and has obtained Udyam registration
C. Organization which has registration certificate for the manufacturing product
of the tender, from Gujarat Khadi Gramodyog Board or Khadi and Village
Industries Commission (K.V.I.C) or Commissioner of Cottage Industries.
D. Board/Corporations/PSUs of the Central/State Government for their own
manufactured items.
E. State Government recognized organizations like (i) organizations for blinds,
dumb and deaf, disabled, mentally disabled persons; (ii) women's self-help
group recognized by Gujarat Livelihood Promotion Company; which
participate directly in tendering process for the product which they are
manufacturing / service which /they are providing.
F. Sellers who have got their credentials verified through the process of Vendor
Assessment by Vendor Assessment Agencies through GeM for the Primary
Product/Primary Service for which Bid/RA floated on GeM.
G. In keeping with GeM guidelines, OEM and service providers rendering
services directly or by its own and having annual turnover of INR 500 Crore or
H. In keeping with GeM guidelines, Sellers/Service Providers holding BIS license
for the Primary Product Category whose credentials are validated through BIS
Micro & Small Enterprises (MSEs) who participates directly in the tendering
process as Manufacturers or Service Providers, and holds a valid Udyam
Registration, are eligible for exemption from payment of Earnest Money
Deposit (EMD). Agencies registered under Udyam in the capacity of Traders,
Re-sellers, or similar categories (i.e. other than Manufacturers/Service
Providers) are not eligible for EMD exemption.
Tender fee/EMD shall be accepted through NEFT/RTGS also. In case, payment for
Tender Fee and EMD is done through NEFT / RTGS; the payment details/Receipt
must be submitted/ attached in n-procure (online) in PDF format. In this case no
physical documents are required to be submit. For NEFT/RTGS payment the bank

Note to Bidder:
1 Contract means the documents forming tender and the subsequent agreement that may

3 Contractor means a firm or an individual undertaking these works or offers the rates
4 The general rules and regulations of the GSECL for tender and contract for works will
apply to the extent of the same and not modified herein. The contractor is deemed to
have gone through and considered to be fully aware of the conditions mentioned
therein. Any other rules and regulations, conditions etc. that are in force in present and
that may be framed by the Corporation from time to time in condition with contracts
will be binding and acceptable to the contractor.
5 SUBMISSION OF TENDER
Tender to be submitted through ONLINE process only on (n)Procure. No documents
(except Demand Draft/ Bank Guarantee for Tender Fee and EMD) will be accepted in
offline mode or hard copy. Bidder has to submit Tender fee and EMD in physical
form in case paid through Demand Draft/ Bank Guarantee in sealed cover superscripted
with the “Name of Work” on OR before due date and time. All such documents
should be strictly submitted by RPAD/ speed post only to The office of Addl. Chief
Engineer(Gen.) KHEP, ADM Building, Diwada Colony, Ta:Kadana. Dist. Mahisagar.
Pin Code No. 389250 up to due date and time as mentioned in tender notice.
Otherwise the offer will not be considered and no any further communication in the
matter will be entertained. GSECL does not take any responsibility for postal delay for
cover received after due date and time will not be accepted by this office.
Tenderer should also certify as “unconditional tender” on cover itself. Conditional
tenders are liable for rejection.
“Please note that the Notarized / self-attested copies of original required
documents should be invariably uploaded in n-procure portal on or before due
date and time in pdf form (Scanned copy). This is mandatory. No physical
documents are required to be submitted except tender fee and EMD.”
The Technical Bid shall be opened on the due date as mentioned in the tender notice
(if possible), in the presence of those tenderers who wish to be present. If the
authorized representative is likely to be present, then authorized representative must
submit the authorization letter of the representing company at the time of the opening
of bids compulsorily.

6 Price Bid: Bidders are requested to submit Price Bid (Schedule-B) online (N-procure
portal) only. Scanned copy of Price Bid is not required to be uploaded and if uploaded
with documents, it will not be considered, and only the online submitted Price Bid
(filled on N-procure portal) will be considered for evaluation.
The time and date for the opening of the Price Bid shall be decided by GSECL and
shall be communicated to the tendering firms after technical bids are analysed. The
intimation will be sent only to the technically qualified tenderers.
Any technical questions, information, and clarifications that may be required
pertaining to this Tender should be referred to Addl. Chief Engineer(Gen.) KHEP,

a) Tender fee (Non- refundable) should invariably be paid through Demand Draft
or through online transfer by RTGS/NEFT in GSECL- KHEP TPS account;
otherwise offer shall be ignored out rightly. Demand Draft should be in the

8 Earnest Money Deposit:
(a) EMD should invariably be paid by Demand Draft/ /by RTGS/NEFT/Online
transfer in favor of the “Gujarat State Electricity Corporation Limited payable at
Bank of Baroda (Branch code: BARB0DIWADA (Fifth digit is zero)), Diwda
Colony branch only”. It can also be furnished by way of an irrecoverable Bank
Guarantee from any Banks as per GOG circular, dated 31.03.2026 in a standard
format prescribed by GSECL (Format given in this tender document). The validity
of the Bank Guarantee for EMD should be for a period of at least Six Months from
the date of submission of the Bid of the Tender. Tenders without EMD are liable

(d) No Interest shall be payable against payment of E.M.D.
(e) Tenders submitted without Earnest Money Deposit is liable for rejection without
entering in to further correspondence.
(f) EMD will be forfeited
(i) if the tender is withdrawn during the validity of the offer.
(ii) If the successful bidder fails to furnish the security deposit in time.
(g) EMD of the unsuccessful Tenderers will be returned within 15 days from the date
of placing of the order to the successful Tenderer through RTGS/NEFT for credit
to his Bank Account. However, the EMD Amount of technically disqualified
bidder will be returned within 15 days from opening of price bids.
9 Security Deposit:
a) The successful bidder (lowest-1 bidder) shall have to submit Security Deposit
with acceptance of Letter of Intent (LOI) before placement of order. The
successful bidder will be required to pay an amount as per NIT (excluding
GST) as a guarantee [Security deposit] for satisfactory execution of the
contract. Such guarantee[Security deposit] for satisfactory/successful execution
will be payable either in D.D./ Bank Guarantee/NEFT/RTGS only.
b) For submission of SD, GSECL will accept the bank guarantees, if the
guarantees are issued by bank as mentioned in Sr. No. 8 above.
c) If the full Security Deposit amount is not paid within 15 days after the receipt
of the Letter of Intent, then Gujarat State Electricity Corporation Limited shall
exercise its discretionary powers to cancel the order without entering into any
correspondences and this will be binding on the bidder.
d) If the bidder fails to pay the Security Deposit or defaults in execution of the
orders placed or if GSECL suffers any financial loss due to this, then GSECL
will be at liberty to adjust the amount from other orders of the same firm or by
encashing the Bank Guarantee. Failure to deposit the SD will entail for forfeit
of EMD and the contract shall be treated as terminated.
e) The GSECL reserves the right to forfeit the SD in case of any breach of
contract and in case of disputes. The decision of Addl. Chief Engineer, KHEP
shall be final, binding and acceptable to the contractor.
f) The Security Deposit/ Bank guarantee covering execution of the contract will
be released only on successful execution of contract and on receipt of the bank
guarantee towards warrantee/guarantee wherever applicable and on receipt of
the “NO Objection Certificate” from the Engineer In charge/Officer In
Charge of the work.
10 The bidder shall quote their item wise rates for all the items as per schedule-B
compulsorily otherwise offer will be ignored. The rate quoted should be exclusive of

12 Tender Evaluation: Vehicle wise Successful Bidder (Lowest-1 bidder) will be decided on
overall end cost including GST. As evaluation is based on end cost including GST, hence all
bidders have to quote GST% / amount on n-procure site (online mode) while quoting. In case
different bidder/agency are found lowest-1 for different vehicles then GSECL reserve right
for splitting of order and separate PO will be issued accordingly. (This is applicable to
car/Jeep tender only).
Revision of prices:
13 Revision of prices or any commercial terms affecting the price after opening of
technical bids shall not be considered and will be ignored.
14 Price Escalation:
The bidders must quote firm price only.The contract price remain same throughout the
contractual period including extension (except Fuel cost & Labour escalation). The
Fuel cost & Labour escalation shall be reimbursed as per tender terms & conditions
mentioned in scope of work . In case, if the bidder does not offer firm prices, his offer
shall be rejected.
15 The rates quoted by BIDDER shall be based on his own knowledge, judgment of the
conditions & hazards involved and shall not be based on any representations. No
claim on this account shall be admitted by the GSECL.
16 The tender documents shall be legible and free from addition/alteration, over writings
or conversions of figures. Corrections unavoidable shall be made by crossing out,
initialling, dating and rewriting.
17 The rates quoted shall be firm and valid as per NIT or extension thereof for
acceptance from the date of opening of technical bid. During this period no bidder
shall be allowed to withdraw their tender. Any such withdrawal during the said period
will entail forfeiture of the Earnest Money Deposit submitted along with the tender
and the GSECL may take further action such as stop dealing with such bidder for
future tenders of GSECL as per GSECL policy.
18 Authentication of Documents :
“All bidders shall submit the details/documents in support of Technical Qualification
Requirements duly certified and verified for authenticity from Specified Third-Party
Inspection Agency (TPIA) or Statutory Auditor of their Company or Practicing
CA/CA Firm along with a certificate regarding verification of authenticity of
documents as per the format placed at Annexure XI. All the documents submitted by
the bidder in support of meeting Technical QR shall be digitally signed by the
Specified Third-Party Inspection Agency (TPIA) or Statutory Auditor of their
Company or Practicing CA/CA Firm. In case documents are certified & verified for
authenticity through TPIA, the verification and certification of authenticity of
documents is acceptable from any of the following TPIAs:
1. M/s Competent Inspectorate and Consultants Pvt. Ltd, Hyderabad, India.
2. M/s Gulf Lloyds Industrial Service India Pvt. Ltd.-Ahmedabad.
3. M/s International Certifications Services.
4. M/s Intertek India Pvt. Ltd.

Any document/documents in support of Technical QR, which is not certified by the
Specified Third-Party Inspection Agency (TPIA) or Statutory Auditor of their
Company or Practicing CA/CA Firm, as per the format enclosed with the bidding
documents, shall not be considered verified/ certified for the purpose of evaluation,
and the bid shall be liable for rejection. The Bidder shall be responsible to get their
documents/ credentials verified & certified by the Specified Third Party Inspection
Agency (TPIA) or Statutory Auditor of their Company or Practicing CA/CA Firm in
support of Technical QR. All the costs pertaining to third party verification and
certification (including those by statutory auditors) shall be borne by the Bidder.
GSECL shall have no liability (financial or otherwise) towards the same and shall not
be liable for any claim/ dispute between the bidder and the Specified Third-Party
Inspection Agency (TPIA) or Statutory Auditor of their Company or Practicing
19 Conditional tender is liable to be rejected. Withdrawal or insertion of conditions
unilaterally after opening of tenders will not be permitted unless it is so desired by
20 Addl. Chief Engineer, KHEP reserves the right to reject any or all tenders without
assigning any reasons thereof.
21 Technical Bids received will be opened if possible on the day and time indicated in the
tender notice by representing Officer nominated by GSECL as in presence of such
of the bidders who wish to be present. Time and date for opening of price bids will be
determined by GSECL and intimated to qualified bidders only.
22 The bidders shall submit their offer without any deviations to the technical
specifications, Commercial conditions and General Terms and Conditions of the
23 Tenders received after the time and date specified in the tender notice will not be
accepted. Once the offer is submitted by the bidder before the due date of submission,
the bidder shall not be allowed to submit revised / additional / modified offer after due
date and time of submission of tender. However, if the date of submission of tender is
extended by GSECL, the bidder may submit revised / additional / modified offer
before extended due date and time of submission. Bidders shall clearly mention
“Revised Offer” on envelope and revised offer shall only be considered.
24 The bidder may visit the site before submitting the tender. The bidder shall be
presumed to have carefully examined the conditions & specifications of work and to
have fully acquainted themselves with all details of the site conditions, locations,
materials, geological and weather characteristics, labour conditions and in general all
the necessary information and data etc. pertaining to and need for the work.
25 The bid submitted by bidders who are listed under declaration of ineligibility for
corrupt or fraudulent practices issued by the GOI/GOG as well as the list of
Blacklisted contractors announced by GSECL/GUVNL subsidiaries, shall be rejected.
26 Any tender not bearing signature of the bidder & with seal of company on all the
documents accompanying the tender is liable to be rejected.
27 The Notice inviting tender/clarification/amendments/corrigendum, general instruction
to bidders and all other documents of this tender shall be the part of the contract.
28 The information given in this specification is in good faith and meant to serve as a
guide to the BIDDER. It is, therefore, imperative that BIDDER shall obtain and
examine for himself all the data, information and particulars required for the
satisfactory execution of the work under this enquiry/tender. The submission of a bid
by Bidder implies that he has fully read the specifications, bid drawing, Contractor
Document and General Conditions of Contract and has made himself aware of the
scope and the specifications for the work to be performed and local conditions and
other features which have a bearing on the cost and execution of the work. GSECL
shall not, therefore, after acceptance of the bid, pay any extra charges for any reason
29 Every page of the bid document/amendments/corrigendum, shall be signed and dated
in ink by the BIDDER as a token of having examined the same.
30 ACCEPTANCE / REJECTION OF BID
A. GSECL reserves the right to accept or reject any bid in whole or part and/or accept
other than the lowest bid without assigning any reasons.
B. The bid is liable for rejection prima facie, if it is:
a. Not in the prescribed form.
b. Not properly signed by the BIDDER.
c. Not conforming to TENDER specification.
d. Tender fee & EMD cover Received after expiry of the due date and time.
e. Bid submitted without payment of Tender fee & EMD (in case of paid through
Demand Draft / Bank Guarantee),
g. Online tender not filled and Hard copy of Tender fee & EMD cover Sent.
31 Any clarification/queries asked by GSECL / GSECL's representative about
tender/offer shall have to be furnished by the contractor within stipulated time;
otherwise the offer of the firm will be liable to be rejected.
32 Tenders which do not fulfil all or any of the above conditions or incomplete in any
respect, are liable to rejection.
33 a) GSECL. reserves the right to accept/reject/Cancel any or all the offers/tenders,
extend dates and / or re-advertise tender, and /or modify the process at any
stage of the process without assigning any reason thereof.
b) GSECL reserves the right to accept any tender irrespective of whether it is
lowest or not or to reject all the tenders without assigning any reasons thereof.
c) Tenders departing from the stipulated technical specifications, commercial
conditions or the method of bidding in a radical manner are liable to be
34 Relationship with employee
Every bidder should, at the time of submission of bid, give a declaration as under.
“If in any Bidder Company/ firm, the interest (i.e. Shareholding in company and share
in partnership firm) of any employee of the tendering Company or his/ her relative as
defined in Section 2(77) of the Company’s Act. 2013 is 10% or more, the tendering
Company will not deal with such Company/ Firm at all.
Tenderer, therefore, must specifically disclose this fact in his technical Bid. Non-
disclosure of such facts would immediately disqualify the tenderer for further dealing
with the tendering Company.”
35 If participating bidder/agency have stake in one or more other agencies/ bidders who
are participating in same tender and on account of submission of wrong information /
declaration in the tender / enquiry, than the bidder will be declared as disqualified
automatically and EMD & SD will be forfeited. Further, GSECL shall take stern
action including Stop dealing with their firms.
36 If the bidder has opted for the composition scheme of GST, the same must be clearly
specified with valid declaration and certificate from department. In the event of
withdrawal / cessation of the bidder from composition scheme during the tenure of the
contract, the rate (i.e. Price) mentioned in the prices bid shall be final and any
additional GST will have to be borne by the bidder. In no case additional amount
toward GST or otherwise will be paid /reimbursed to bidder.
37 Every bidder should mention separate HSN/SAC Code and rate of GST and cess as
applicable, if not specifically mentioned then company will have the option to take the
prices as exclusive of taxes and duties at maximum higher slab rates for the evaluation
38 Every bidder shall have to inform their GSTIN NO of the registered place from where
the bidder intends to supply the goods/services, meaning thereby the bidder has supply
the goods/services from the relevant declared / registered place(s) of supply Only.
39 It should be clearly understood that the GSECL will not reimburse any cost incurred
by bidder for the Preparation of offer, site visit, collection of information, or, if bidder
is selected, for contract or negotiation.
40 Bidders are requested to remain in touch with the web-site for any amendment /
corrigendum or extension of due date etc. At any time prior to the deadline for
submission of bids, the GSECL may, for any reason, whether at its own initiative, or
in response to a clarification requested by a prospective Bidder, amend the bidding
documents. The amendments will be posted at e-Tender Portal for viewing by the
Bidder. The amendments will be binding on Bidders and it will be assumed that the
information contained therein will have been taken into account by the Bidder in its
bid. Bidders are also advised to regularly check e-Tender Portal regarding posting of
Amendment, if any.
41 If party has two registrations, out of which one is cancelled than party has to provide

42 Conflict of Interest among Bidders/ Agents: -
A bidder shall not have conflict of interest with other bidders for particular quoted
item. Such conflict of interest can lead to anti-competitive practices to the detriment of
Procuring Entity’s interests. The bidder found to have a conflict of interest shall be
disqualified. A bidder may be considered to have a conflict of interest with one or
more parties in this bidding process for quoted item, if:
(a) They have proprietor/ partner(s)/ Director(s) in common; or
(b) They receive or have received any direct or indirect subsidy/ financial stake from
any of them; or
(c) They have the same legal representative/agent for purposes of this bid; or
(d) They have relationship with each other, directly or through common third parties,
that puts them in a position to have access to information about or influence on the bid
of another bidder; or
(e) Bidder participates in more than one bid in this bidding process. Participation by a
bidder in more than one Bid will result in the disqualification of all bids in which the
parties are involved. However, this does not limit the inclusion of the components/
sub-assembly/assemblies from one bidding manufacturer in more than one bid.
(f) In cases of agents quoting in offshore procurements, on behalf of their principal
manufacturers, one agent cannot represent two manufacturers or quote on their behalf
in a particular tender enquiry. One manufacturer can also authorize only one agent/
dealer. There can be only one bid from the following:
1. The principal manufacturer directly or through one Indian agent on his behalf; and
2. Indian/ foreign agent on behalf of only one principal.
(g) A Bidder or any of its affiliates participated as a consultant in the preparation of
the design or technical specifications of the contract that is the subject of the Bid;
(h) In case of a holding company having more than one independently manufacturing
units or more than one unit having common business ownership/ management, only
one unit should quote. Similar restrictions would apply to closely related sister
companies. Bidders must proactively declare such sister/ common business/
management units in same/ similar line of business.
(i) Bidder shall not act in contravention/ violation to the provisions of competition act,
as amended from time to time.
Every bidder should, at the time of submission of bid, give a declaration as per
ANNEXURE, that bidder shall not have conflict of interest/related with other bidders
for particular quoted item, as above.
43 Stop Dealing/Blacklisting/Banning for business Dealing
As per GSECL policy, A Firm/bidder will be placed in a Stop deal/ banned for
business dealing / blacklist, if the Firm/bidder has carried out any of the following
mischief/mal practices with GSECL.
(a) Has submitted fake, false or forged documents / certificates.
(b) Has revised / withdrawn price bid after opening of Techno-commercial bid, until
and unless it is sought for.
(c) Has tampered with the stipulated tendering procedure.
(d) Has refused to accept Letter of Acceptance / Purchase Order / Work Order after
the same is issued by the Company within the validity period and as per agreed terms
and conditions.
(e) Has committed breach of contract or has failed to perform a contract or has
abandoned the contract.
(f) Has failed to provide suitable expertise for the work as per pre-scheduled program.
(g) Has failed to submit all the necessary tests reports / documents within time
schedule / as per Company’s time limit, as mentioned in the LOA, if the Letter of
Acceptance (LOA) is placed subject to submission of type reports / documents to the
(h) Has indulged in construction and erection of defective works.
(i) Has supplied inferior quality / defective materials and refused to replace with
stipulated time frame, as specified by the Company.
(j) Has substituted materials in lieu of materials supplied by the Company or has not
returned or has short returned or has unauthorisedly disposed of materials / documents
/ drawings / tools or plants or equipment supplied by the Company.
(k) Has involved in malpractices such as bribery, corruption, fraud, canvassing and
(l) Has unauthorisedly obtained official company information or copies of documents,
in relation to the Tender / Contract.
(m) Has failed to follow the stipulated mode of communication, if specified by the
tendering authority / purchaser.
(n) Has parted with, leaked or provided confidential / proprietary information of the
Company given to the firm only for its use (in discharge of its obligations against an
order) to any third party without prior consent of the Company.
(o) Any other ground for which in the opinion of the Company makes, it undesirable
to deal with the Firm, and.
(p) In case the State Government directs the Company to place a firm in stop dealing /
banned for business dealing / blacklisting.
Section-3: (Tender Pre-Qualification Criteria) No:GSECL/Works Tender/
Name of Work: Hiring of 01(One) No. of AC Bolero Camper (Model BS6) 05 (04 +
01) Seated Capacity on hire with fuel, driver all type maintenance & liabilities for
three years (36 Months) 12 hrs at KHEP.
The bidders who wish to participate in the bidding shall satisfactorily establish that
they fulfil the following Qualifying Requirements in addition to the satisfactory
fulfilment of the requirements stipulated under tender condition:
1. Driving License: Bidder have to submit their Valid Driving License must be
Older than three years from the date of invitation of tender.
2. P.F.Code: Copy of P.F. code from the appropriate provident fund authorities.
3. Labour License for Labour Contract: The contractor on getting the work
order but before starting the work shall have to furnish the copy of Labour
License under the Contract Labour (Regulation & Abolition) from the
appropriate authorities. Also required workman group insurance policy
covering labour engaged.
4. Self Declaration: In case bidder wishes to take exemption from PF code &
other Labour related compliances (Point no.2 &3 as above) then Bidder has to
submit self-declaration stating that the vehicle will be driven by
himself/herself or their family members only. In that case no PF document
and labour laws shall be applicable. Further bidders have to prove his/her
family relation for deploying driver/labour by submitting copy of certificate
of talati (family tree) or certificate from competent government official.
5. Proprietorship/partnership/Memorandum of Article/Declaration of
individual bidder: Bidder has to submit copy of Proprietorship
/partnership/Memorandum of Article if participate as an agency or submit
copy of declaration of individual bidder if participate as an individual bidder.
6. Bidder as well as their driver/labour shall not have any criminal record and
same should be duly certified by Police station.
7. Bidder should have a separate valid GST registration number (If applicable)
and PAN Number along with last 03 years income tax return documents.
8. Bidder has to submit copy of vehicle documents for the offered vehicles
against subject tender such as RC book, insurance and other vehicle related
documents or bidder has to provide self-declaration stating that they shall
provide newly purchase vehicles as per tender terms & condition and submit
the documents accordingly if they found successful (lowest-1) bidder.
9. Tender fee & EMD will be application as per NIT.
Section-4: General Conditions of Contract No:GSECL/Works
Name of Work: Hiring of 01(One) No. of AC Bolero Camper (Model BS6) 05 (04 + 01)
Seated Capacity on hire with fuel, driver all type maintenance &
liabilities for three years (36 Months) 12 hrs at KHEP.
1 The General rules and regulations of the Corporation for tender and contract for
works will apply to the extent the same are not modified herein. Any other rules
and regulations, conditions etc. that are in force in present and that may be framed
by the Corporation from time to time in condition with contracts will be binding
and acceptable to the contractor.
To sublet or to transfer the contract without prior approval of the GSECL
shall be treated, as breach of contract and it shall be punishable by forfeiting
the S.D. as well as termination of contract.
The contractor shall not engage any sub-contractor without written prior
permission of the Chief Engineer or the authorized officer of the GSECL. In
no case the GSECL will be liable in any manner regarding any liability in
respect of any contract laboure engaged by the sub-contractor and the
liability of such contract laboure will solely rest with the principal
3 Execution of Agreement:
The successful bidder (contractor) will have to enter into an agreement (notarized
stamp paper of Rs.300/-) with the GSECL before starting the work and the cost of
the stamp paper will be borne by the contractor. The contractor will also have to
execute indemnity bond on required value of stamp paper as per GSECL‟s rules.
The cost of stamp paper for indemnity bond will be borne by the contractor.
The GSECL will be entitled to deduct directly from the bills to be paid to the
contractor any sum or sums payable by the contractor and which sum/sums the
GSECL is required to recover as its own dues/recoveries as well as to pay as a
principal employer on account of contractor’s default in respect of all liabilities
referred to in above clauses.
In case of default, the work will be got done through other agency/agencies
at the risk and cost of the original contractor, and the GSECL shall be
entitled to recover such expenses from defaulting contractor by such
methods as deemed fit. The contractor shall not, however, be entitled to
terminate the contract or stop works undertaken by him before expiry of the
contract period/extended period due to any reason whatsoever.
The contractor is bound to execute the work for any item as per the
instruction of the Engineer-in-Charge. On refusal to do so, the work will be
carried out at the risk and cost of contractor by using the contractors tools
and tackles, for which no compensation whatsoever shall be payable to the
6 Limitation of Liability : Except in cases of criminal negligence or wilful
(a) Neither Party shall be liable to the other Party, whether in contract, tort, or
otherwise, for any indirect or consequential loss or damage, loss of use, loss of
production, or loss of profits or interest costs, which may be suffered by the
other Party in connection with the Contract, provided that this exclusion shall
not apply to any obligation of the Contractor to pay liquidated damages to the
(b) The aggregate liability of the either party to the other party, whether under the
Contract, in tort or otherwise, shall not exceed the total Contract Price, provided
that this limitation shall not apply to any obligation of the Contractor to
indemnify the Employer with respect to patent infringement.
Notwithstanding anything contained hereinabove, the aggregate liability of the
Employer to the Contractor shall not exceed the Total Contract Price, less payments
already released to the Contractor, if any.
a) The GSECL shall not pay any advance(s) against this work including
mobilization advance if not otherwise included hereunder.
b) The Payment shall be made within 30 days from recording of bill. Any delay in
payment of bill shall not entail the contractor for any extra claim. All required
documents are required to be submitted with bill.
d) Amount of GST and applicable cess will be kept under retention till submission
of documentary proof of payment of GST or till reflection of payment of GST
pertain to respective bill amount in GST return for concern order after due
8 Taxes and Duties:
All royalties, sales tax, local tax, development charges, welfare cess and any other
taxes including works contract tax etc., except GST in respect of this contract and
also any statutory variation in future towards above mentioned taxes & any other
taxes if levied in future by statutory authority which are applicable to the this
contract shall be payable by the contractor and GSECL will not entertain any claim
whatsoever in this respect.
GST is applicable as per government rules. The Bidder shall have to furnish
attested copy of Registration Certificate issued by government authority
mentioning GST Registration Number and the same is to be shown in each invoice.
Amount of GST and applicable cess will be kept under retention till submission of
documentary proof of payment of GST or till reflection of payment of GST pertain
to respective bill amount in GST return for concern order after due verification.
10 Statutory variation :
Statutory variation on applicable taxes mentioned in order shall be admitted
provided they take place during the contractual completion period subject to claim
being supported by documentary evidence.
Any statutory increase or decrease on the taxes and duties subsequent to your offer
if it takes place within the original contractual delivery date will be to the
company’s account subject to the claim being supported by documentary evidence.
However if any decrease takes place after the contractual delivery date the
advantage will have to be passed on the company.
Income tax & other taxes at the applicable rate will be deducted at source from
your bill as per rules. Contractor has to submit all the invoices clearly mentioning
The contractor being exempted for Income tax shall submit the valid exemption
certificate with bill.
12 Arbitration:
All matters, questions, disputes, differences and / or claims arising out of and / or
concerning, and /or in connection with, and /or in consequence of, and /or relating
to this contract which may arise between the parties in connection with the Contract
or any matter arising out of or in relation thereto shall be reported to Gujarat Public
Work Contract Dispute Arbitration Tribunal and provision of Gujarat Public Work
Contract Disputes Arbitration and Tribunal Act 1992 shall be applied as updates
Recoveries due from the contractor, up to the end of the month previous to the one
in which the bill is prepared shall be made from bills approved by payment every
month or at other periods when the bills are prepared, for the various items in the
following order of priorities and extents.
a) Deduction on account of security deposit in full together with shortage, if
any, to be made good.
b) Penalty/Liquidated Damages in full, if levied.
c) Expenditure, if any, incurred by the GSECL on behalf of Contractor for
labour or materials in full.
d) Other recoveries. (If any).
14 Labour wages:
The contractor shall pay minimum wages to his labourers as per the Minimum
Wages Act, 1948 and rules therein, as applicable from time to time, in pursuance to
the state government notification. The concerned contractor, after making such
payment to his labourers, shall submit the details of the payment with the
certification of Labour Welfare Officer/Industrial Relations Officer. The
contractor/Agency shall strictly observe all the labour laws, Factory Acts and other
applicable statutory Rules in existence and amendments made from time to time.
15 Commencement of Work:
The contractor shall not enter upon or commence any portion of the work without
clear commencement letter issued by the GSECL (except with the written authority
of GSECL), failing which the contractor shall have no claim to ask for
measurement or payment for work and shall be responsible for any claims or
damages that may arise due to such unauthorized commencement or entry. The
contractor shall make all necessary arrangements at site to mobilize labour,
supervisor as per schedule.
Before starting the work, the contractor should contact Industrial Relation Officer/
Labour Welfare Officer to complete all formalities and obtaining the gate passes of
The contractor shall have to submit required documents for obtaining of GATE
PASS i.e labour licence, workman compensation policy, police verification
certificate, photo ID etc as per applicability for gate entry of his workers, materials
, tools and parts etc.
16 Liability for accidents to persons
a) The contractor or sub-contractor shall indemnify the GSECL against any claims
which may be made under the workman's compensation Act, 1923, or any
statutory modification or otherwise in respect of any damages or compensation
payable in consequence of any accident or injury caused, by fault of contractor or
sub-contractor and sustained by any workman or other person in the employment
of the contractor or sub-contractor. In every case in which by virtue of the
provisions of sub-section (1) of section 12 of the workman's Compensation Act,
1923, the GSECL is obliged to pay compensation to a workman employed by the
contractor or sub-contractor in execution of the work, the GSECL will recover
from the contractor the amount of compensation so paid, and without prejudice
to the rights if the GSECL under sub-section (2) of section 12 of the said Act any
such amount shall be paid by contractor within 30 days, failing which the
GSECL shall be at liberty to recover such amount or any part thereof by
deducting it from any due by the GSECL to the contractor under this contract or
otherwise. The GSECL shall not be bound to pay any claim made against either
of them under section 12, sub-section (1) of its said Act, except on written
request from the contractor and upon his giving to the GSECL full security for
all costs for which the GSECL might become liable in consequence for
entertaining such claim.
b) The contractor and/or sub-contractor named in the contract shall indemnify the
GSECL against all claims based upon injury or death to any person in the
employee of the contractor or sub-contractor, or to third parties to the extent of
any sums recovered under the insurance policy.
c) On the occurrence of an accident which results in the death of workman
employed by the contractor or sub-contractor, which is so serious as to be likely
to result in the death of any such workman, the contractor shall within 24 hours
of happening of such accidents intimate in writing to the Engineer the fact or
such accidents. The contractor or sub-contractor shall indemnify GSECL against
all loss or damage sustained, by the GSECL resulting directly or indirectly from
his failure to give intimation in the manner aforesaid including penalties or fine if
any, payable by GSECL as a consequence of GSECL's failures, to give notice
under workman's compensation Act or otherwise to confirm to the provisions of
the said Act in regard to such accident.
d) The contractor will be responsible for complying with all rules and regulations
and labour land applicable to him and the GSECL will not be responsible for any
lapses committed by them. If there is any claim from any Govt. Authority
pertaining to the contractor the same amount will be deducted from the
contractor's bill.
e) The contractor shall hold the Corporation indemnified against and in respect of
any claim arising out of injury to any persons, loss of life, workman’s
compensation or any other claims whatsoever. The contractor shall be
responsible for any damages to any property of the Corporation due to
negligence of the contractor or his employees. The Corporation will be entitled to
recover the damages from the contractor and it shall be final and binding to the

them when required in connection with the execution of the said works.
An authorized and technically qualified representative of the contractor must be
available at site while the work is going on. The address of the representative
should be submitted to this office so that EIC can be contacted whenever required
in connection with execution of the work.
20 Any clarification/queries asked by GSECL / GSECL's representative shall have to
be furnished by the contractor.
21 All safety measures as required to be adopted as per the Statutory Regulations and
the Safety Rules of the Plant shall be strictly followed by the Contractor during the
execution of the Contract. The Contractor shall set up a suitable safety organization
of his own in this regard. The contractor shall ensure the safety of workers, material
and structure including existing structures during execution of the contract. Safety
measures shall be followed during operations of equipments/machinery being used.
No separate payment shall be made for the safety measures and the quoted rates
shall include the cost for all safety measures.
22 The GSECL will not pay any extra charges or rate for any reasons in case the
contractor claims, after acceptance of contract to have misjudged the site condition.
23 In case of conflict/discrepancies among clauses of different specifications given in
this document, the stringent specification shall be followed and under such
circumstances, the decision of the EIC shall be final and binding to the contractor.
24 The contract or any part thereof shall not be subject to change without the written
permission of the Addl. Chief Engineer (KHEP) or his authorized representatives
from issuing authority of certificates / details.
25 For any conflict and ambiguity, the decision of the Addl. Chief Engineer (KHEP)
shall be final and binding on the contractor.
26 The GSECL reserves the right to terminate this contract at any time during its
currency without giving notice of termination or any reason thereof and no any
compensation shall be given.
27 Measurements to be provisional and subject to correction
Every measurement for running payment on account of work done shall be subject
to adjustment or final measurements. In case of disagreement between such
intermediate and final measurements, the latter shall prevail.
28 Performa returns
The contractor shall maintain Performa, charts and details regarding machinery
equipments materials, labour personnel and other matters as may be specified by
the Engineer. He shall further, submit returns of Performa and details as may be
specified by the Engineer in charge from time to time.
29 Jurisdiction and Governing laws:
The Contract shall be governed by laws of GOI/GOG and the Courts of Lunawada
shall have exclusive jurisdiction in all matters under the contract.
Section-5: Detail Scope of work & Special No:GSECL/Works Tender/
conditions of contract (SCC)

Tender terms & conditions mentioned herewith.
Bidders shall quote/offer their rates in Schedule-B (price Bid) covering cost of: -
1. Providing vehicle with Drivers including service charge.
2. Tools & Tackles for repair, maintenance/replacement of spares.
3. Salary & wages of drivers as well as other staff essential for above contract
including statutory liability thereof.
4. Full Comprehensive Insurance for vehicle/staff/passengers travelling therein.
5. RTO Tax/permits which are essential for the subject work.
6. Any Legal & Accident liabilities etc.
7. All other related expenses for successful execution of above contract.
Note: GSECL will pay the charges as per quoted/offered rates in Schedule-B only.
However all other charges/fees shall be paid by contractor.

(A) TERMS AND CONDITIONS:
(1) Period of Contract:
The duration of this contract is 36 months [03 years] and agency have to
deployed vehicle (s) for the period of 36 months [03 years].This includes
Sundays, National holidays and GSECL declared holidays. Further GSECL
reserves the right to extend the contract for further period of 36 months or
part thereof with same rates, terms and conditions of original contract on
requirement based on satisfactory performance of the contractor. However, in
case of poor services provided by the contractor, GSECL reserve right to
terminate the contract at any time after given 01 month notice period.
(2) Area of Work:
a) The vehicle (s) hired will be deployed for local as well as outstation
movement as per requirement of GSECL (KHEP).
b) The vehicle will be required to run anywhere within the territory (i.e.
anywhere in India) as and when the GSECL, so desires. If in special case the
same is required to be used outside Gujarat state, the contractor shall obtain
requisite permission of concern RTO authority for the same. All such permit
charges payable for this purpose shall be reimbursed on actual based on
production of receipts.
c) If required the vehicle shall be utilised for other than allotted section as per
instruction of EIC/OIC and contractor/bidder is bound for same.
a) The contractor /bidder should maintain logbook of the vehicle and the
logbook should bear the name contractor / bidder on all pages.
b) A daily record indicating time and mileage of the vehicle, KM travelled,
Cumulative KM travelled and obtaining the signature of user of vehicle
along with driver’s signature shall be maintained in a log book as per
format decided by EIC and shall be submitted to the concerned officer on
regular basis for verification.
(4) Safety Regulations, Accident, Damage & Accident liability:
(a) The Contractor/bidder must have to observe all Labour laws, safety rules and
RTO rules. The Contractor / bidder has to provide 'SAFETY ARTICLES to
all his Workmen as per the nature of work they have to perform in the
contract. The Certificate in this regard should be obtained from safety
(b) GSECL shall not be responsible for any damages whatsoever to public/
private property and/or to any third person due to any accident arising out of
and in the course of deployment of the vehicle. It will be the whole and sole
responsibility of the contractor/bidder for any accident or damage to vehicles
and persons traveling including driver for which comprehensive Insurance
policy must be insured time to time throughout the contractual period. The
loss or damage or legal expenses on this account shall be borne by the
contractor/bidder. If any damages will occur in the GSECL premises by your
vehicle, the contractor will have to pay the amount of damage or the same
will be deducted. The contractor will be responsible to provide another same
type vehicle for GSECL in case of accident or police case.
(c) The GSECL will not be liable in case of any accident or for any other claims
arising out during the transport services rendered to the GSECL. The
contractor shall be fully responsible for all liabilities & actions, which may
be, arise in case of accident / fault or due to any contractor obligations. The
contractor shall indemnify corporation and its personals against any claim
arising out of accident, misbehaviour of driver and violation of RTO, traffic
laws or any other laws.
(a) The Contractor shall take the complete and comprehensive insurance for the
safety of the vehicle and for the necessary compensation of the persons
travelling by the hired vehicle. Certified copies of the insurance policies and
its receipts must be submitted as a proof and responsibility for the renewal of
the required policies will always be part of the Contractors.
(b) The contractor/bidder shall immunize company’s personnel against any
claim arising out of accidents or misbehaviour of the drivers. The vehicle
shall be kept properly insured all the time to cover the 3rd party risk and
simultaneously immunized company on account of likely claims from public,
police dept. etc.
(c) Comprehensive vehicle insurance (covering third party insurance) must have
to be obtained from any national insurance company. The contractor shall
keep GSECL free from all type of encumbrances, arising due to any accident
throughout the contract period through such insurance policy.
(6) Payment Terms:
The payment will be made as per actual work done only after taking joint
measurement and the contractor will be paid 100 % amount of actual work done
on satisfactory completion of job work. Payment will be released within 30 days
from receipt of bill in all aspect. However, amount of GST and applicable cess
will be kept under retention till submission of documentary proof of payment of
GST or till reflection of payment of GST pertain to respective bill amount in GST
return after due verification.
(7) Parking Charge, Toll Tax:
a) As per Guidelines of Central govt. Authority (NHAI), All vehicles
travelling through toll plaza mandatorily pay toll tax using “FASTag” on
vehicle & without fixing of FASTag, vehicle pay up penalty of twice toll
tax at toll plaza. As per above guidelines Contractor / bidder mandatory
has to provide ‘’FASTag’’ on all hired vehicle. In case fastag is not
provided or not in working conditions, GSECL will reimburse only Toll
tax amount without penalty.
b) The toll tax & parking charge will be reimbursed at actual on production
of documentary proof of payment.
(8) Reimbursement of Fuel cost:
Cost of fuel [i.e. Diesel/Petrol] will be Reimbursed as per consumption based on
mileage of vehicle (s) as per prevailing market rates [Monthly average] of fuel for
actual travelled kms only as per below formula on producing documentary
evidence. The fuel rate shall be considered from local area authorised fuel pumps
of IOCL/HPCL/BPCL

The mileage of AC Bolero Camper in diesel shall be considered 12 Kms /Litre.
Bidder has to submit invoice for fixed cost & fuel cost separately on monthly basis
(9) Service (Working) Hours :
a) For 12 Hours Vehicles: The agency shall deploy the vehicles with drivers on
12 hrs basis. The normal working hours will be from 8:00 AM to 8:00 PM for
all days of the year. However as per requirement the vehicle may have to
report earlier or may be relieved after working time.
(10) Extra working hours charge
a) For 12 Hours Vehicles: GSECL (KHEP) will pay extra hours charges
Rs.129 per hour if the vehicle is deployed beyond the normal 12 hours period.
In case the vehicle services required in extra hour more than 30 minutes, it
will considered as 01 hour as an extra hours and accordingly Extra hours
charges will paid, However in case the vehicle services required in extra hour
less than 30 minutes, the same shall be ignored and no extra hour payment
(11) Night halt Charge :
a) For 12 Hours Vehicles: For 12 hours vehicles, in case vehicle (s) stayed out
from head quarter in night hours [between 00:00 hours to 6:00 AM],the
night halt charges Rs.500 per night will be applicable and same will be
paid extra by GSECL (KHEP).
If the vehicle (s) reaches to head quarter in night hours [between 00:00
hours to 6:00 AM] and does not requires to stay outside the headquarter, in
such case, night halt charges will not be applicable, however extra hours
charges shall be payable as per tender terms & conditions.
Contractor will be able to claim Night halt charge in the following circumstances:
i) If driver has driven vehicle with officer & officer has stayed out in night
ii) Contractor cannot overlap & claim combine of Extra hours & Night halt
charges for night hours [between 00:00 hours to 6:00 AM].
iii) For payment of Extra Hours & Night halt charges, proof of record
indicating time with KM travelled and obtaining the signature of officer of
vehicle along with driver’s signature shall be maintained in a log book and
shall be submitted to the concerned officer, regularly for verification &
passing of Monthly R.A. Bill.
iv) During Night halt, the lodging and boarding of driver shall be borne by
Contractor/Bidder only.
(12) Driver Liability:
a) Driver Age: Driver Age shall be preferably between 21 to 40 years & not
above 55 years.
b) Driver Education: Minimum 7th standard pass.
c) Driver Experience: Minimum 3 years of taxi driving & able to attain normal
d) Contractor/Driver shall be followed the Central Motor Vehicle Act 1988 &
rules 1989, The Motor Vehicles (Amendment) Act 2019 & Gujarat motor
Vehicles rules 1989 and amendment thereon during the this contract.
e) The driver must have valid Taxi driving License issued by RTO and it should
be valid up to the validity of the contract.
f) Driver should carry necessary permits/clearance from the Transport Authority
any other concerned authority including pollution certificate.
g) Engaged/deployed Driver should be medically fit in all respect.
h) Driver so engaged will be well disciplined, well behaved and well
experienced of driving. If driver misbehaves with any GSECL Officers / staff
and found in any illegal condition during his duty hours, same will be
dismissed immediately. They must behave in a polite and courteous manner
with the Company’s employees. In case of any complaint against any drivers
etc., the contractor must change him/them and in case contractor fails to do so,
such Driver shall not be accepted on duty and vehicle on which deputed shall
not be accepted on duty and marked absent.
i) The driver should always remain with the vehicle during entire period of duty
hours. In case of any urgency the driver may seek permission of the concerned
officers. The driver cannot be changed /on leave without the permission of the
officer using the vehicle.
j) The Drivers should be provided with enough money to cover the cost of fuel,
repairs and incidental expenditure etc.
k) The lodging and boarding of driver & contractor staff shall be borne by
Contractor/Bidder only. In no case, contractor’s any staff including driver
shall ask money or facility for lodging/boarding/fuel charge/repairing cost or
any other cost from any GSECL officers. Contractor/bidder have to clearly
instructed to their staff accordingly. In case any complaint received from any
GSECL officer regarding this, the paid amount by GSECL officer for
lodging/boarding/fuel charge/repairing cost or any other cost plus 25% as
penalty will be deducted from contractor’s bill.
l) The required speed limits mentioned in the plant, township areas,
Road/Highways etc as notified there are to be strictly followed. In no cases
driver should be engaged in Rash driving or cause any type of men and
material damages in duty hours.
(13) Contractor Liability:
(a) The vehicle shall be deployed within 30 (Thirty) days from the date of issue
of Letter of Intent or as per written instruction of EIC/GSECL.
(b) The Contractor will have to depute responsible supervisor for to obey
instruction & better co- ordination with GSECL (KHEP) throughout the
(c) The vehicle to be deployed for hiring shall be in up-to-date condition
including its battery, Oil, Tyre-tubes, engine as well as conditions of its
outside body & maintain schedule service as per OEM guideline throughout
the contractual period & for that no any extra payment shall be paid by

position tracker along with the software to track the same and submit vehicle
wise monthly GPS tracker report with RA bills.
(e) The contractor shall ensure that the vehicle (s) deployed under this contract
shall be strictly utilised for GSECL officer/GSECL site requirement/as
instructed by EIC only and not for the other purpose. If any time it is found
that the contractor or its staff utilising the vehicle (s) deployed under this
contract for any personal use (except GSECL requirement) then penalty will
be imposed as per penalty clause. Further if similar incident found more
than 03 times, the contact is liable for rejection.
(f) The contractor shall ensure that speedometer of vehicle(s) supplied is
properly sealed so that no tampering is done with a view to inflate distance
travelled. LPG Cylinders/Gas Kit should not be used for running the
vehicles in any case.
(g) In case of any breakdown of vehicle on duty, the contractor shall make
arrangement for providing another same type vehicle. In such a case,
mileage from garage to the point of breakdown would not be paid.
(h) In case vehicle does not report within the reasonable time or does not report
at all, the GSECL would have a right to make an alternate arrangement of a
vehicle from the market and the additional cost incurred by the GSECL will
be borne by the Contractor and same will be deducted from contractor’s
(i) In case of outside journey, the vehicle should be provided immediately after
receipt of Telephonic intimation from EIC with sufficient fuel and pocket
money to driver.
(j) The contractor shall also be liable for depositing all taxes, levies, cess etc.
on account of services rendered by it to GSECL to concerned tax collection
authorities from time to time as per extant rules and regulations on the
(k) Contractor shall ensure that the vehicle deployed by them does not damaged
GSECL goods, materials and equipments etc. in the process of carrying out
the services undertaken by it and shall be responsible for acts of commission
and omission on the part of its staff and its employee etc. If the GSECL
suffers any loss or damage on account of negligence, default or theft on the
part of the employees/drivers of the contractor then the contractor shall be
liable to reimburse to the GSECL for the same. The contractor shall keep
this GSECL fully indemnified against any such loss or damage.
(l) The vehicle shall be used for movement of persons of the
department/others and material as per the instructions of EIC. The
contractor/agency/driver can’t have any rights for objection. In case of any
such objections, the deployment of vehicle for the day shall be treated as “not
reported” and no payment for the same shall be paid. In addition additional
50% of charges for the day shall be deducted as penalty for non-
(m) The contractor shall not assign, transfer, pledge or contract the performance
or service without the prior written consent of the GSECL.
(n) Driver or any other staff shall not be entitled for the accommodation in
GSECL colony area. Contractor/bidder have to make arrangement for
accommodation for their staff near to GSECL colony area on his own cost.
(o) Necessary entry and gate pass will be issued to Maximum
persons/vehicle by GSECL authority for which contractors have to submit
and comply all necessary formality for the same.
(p) The contractor shall ensure that one permanent numbered mobile phone with
head phone with the engaged vehicle is in working condition round the
clock and it must with engaged driver & for which no separate payment
shall be made by GSECL. For non-responding recurrence will be viewed
seriously and appropriate penalty may be imposed.
(q) Driver wages: Drivers Salary to be paid by the agency/bidder as semi-
skilled labour wages as per the minimum wage circular of GOG revised time
to time along with applicable liability as per GSECL rules. The present
minimum wages for semiskilled labour wages are Rs. 512.50/- and same is
considered in tender estimated cost. In case labor wages increase by GOG
during the contractual period then the differential amount along with
applicable liability shall be reimbursed to agency/bidder against
documentary evidence for the payment made to driver/Cleaner (s).In case
decrease in wages it will be adjusted in next bill. However in case of
individual bidder who has submitted self-declaration stating that the
vehicle will be driven by him/herself or their family members only are
eligible for reimbursement of labour wages difference as mentioned above
without any documentary evidence and they are not allowed for any labour
liability difference as they are already exempted.
(r) The contractor has to make payment of driver salary through bank account
only.(Not applicable to self-driving individual bidder/his family members)
(s) It will be the responsibility and liability of contractor/bidder for observance
of PF/gratuity/all other statutory rules, for the persons/drivers engaged for
this work if applicable.
(t) Contractor will be wholly and exclusive responsible for payment of wages
to the person engaged by it in compliance of all the statutory obligations
under all related legislations as applicable to it from time to time including
Minimum Wages Act, Employee Provident Fund, etc. and the Department
shall not incur any liability for any expenditure whatsoever on the person
employed by the contractor on account of any obligation.
(u) The contractor shall maintain all statutory registers under the applicable law.
The contractor shall produce the same, on demand, to the concerned
authority of GSECL or any other authority under law if applicable.
(v) In case, the contractor fails to comply with any statutory/taxation liability
under appropriate law, and as a result thereof the GSECL is put to any
loss/obligation, monetary or otherwise, the GSECL will be entitled to get
itself reimbursed out of the outstanding bills or from security deposit of the
contractor, to the extent of the loss or obligation in monetary terms.
(w) It will be the responsibility of contractor to arrange for biometric
punching (i.e. providing biometric specimen of all drivers engaged to LWO)
Engaged driver’s payment will be made by contractors as per biometric
presence and documents & payment to be paid to persons by RTGS in their
bank account, nowhere GSECL will be responsible for the same. Any
banking/transition charges etc. to be borne by contractor.
(x) It is liability of the contractor to maintain regular biometric presence record
and should be paying all acquired, benefits to the drivers which in force.
(y) It is the agency's responsibility to arrange required numbers of drivers to run
without any hindrance and extra payment.
(z) The Contractor shall arrange to pay all taxes and dues to the Government
from time to time and shall abide by statutory requirements for
operating and providing such hire services. The Contractor shall
indemnify GSECL against all claims arising out such demands and
GSECL takes no liability on this accounts.
(aa) During the contract period, if the vehicle is seized or detained or
requisitioned by Police/Motor Vehicle Authority or any other authorities for
whatsoever reasons that will be at the Contractor’s risk. Also alternate
vehicle (s) of similar or higher category will be provided by contractor
without any extra charges.
(14) Penalties: In case contractor or their staff does not adherence the tender terms
& conditions, GSECL shall imposed penalties to contractor/agency as under.

Road Transport rules in force from time to time.
(16) If contractor fail to execute the order successfully, the order will be got
completed through other agency and if required to pay higher rates, in that case,
difference of rates will be recovered from contractor who fails to execute the
(17) Addl. chief engineer, GSECL, (KHEP) reserves right to withdraw/relax any of
the terms and conditions mentioned above so as to overcome the problem
encountered by the contracting parties.
(18) For any dispute in terms & conditions for this work order interpretation,
meaning and decision of Addl. Chief Engineer GSECL, (KHEP)shall be final
and binding upon contract.
(19) The contractor shall have to keep logo "ON DUTY GSECL " in the vehicle.

9. Tender Evaluation: Vehicle wise Successful Bidder (Lowest-1 bidder) will be decided
on overall end cost including GST. As evaluation is based on end cost including GST,

quoting. In case different bidder/agency are found lowest-1 for different vehicles then
GSECL reserve right for splitting of order and separate PO will be issued accordingly.

Section-7 Terms and Conditions regarding No:GSECL/Works
Labour Laws Tender/
The following are the major obligations to be fulfilled by the Contractor [Applicable
to Successful bidder only, however all the bidders have to submit duly signed &
sealed on each page of Section-VIII Terms and Conditions regarding Labour Laws as
a token of acceptance]:
1) The Factories Act,
The contractor should not deploy worker below the age of 18 years and above
60 years for the awarded work.
No female worker shall be employed in the night shift between 7.00 P.M. to
As per the provision of the Act, facility of crèches to be fulfilled if the female
laborers employed.
Identity cards as prescribed under the Factories Act shall be issued to each
workman engaged for the nature of work by contractor.
Earn Leave shall be paid at the rate of one day for every 20 days worked by the
contractor to their bonafide contract workers as per the provisions of the
Factories Act, 1948. On competition of calendar year of the awarded contract,
the contractor shall have to pay Earn Leave to its eligible workers within
days; the calculation of payment of Earned Leave to be carried out as per the
provision of the Factory Act. Contractor shall maintain Earn Leave Register in
Form No. 19 as per the provisions of the said Act and submit the same on
Attendance register shall be maintained on daily basis. All the written registers,
Performa etc. shall be filled up and maintained up to date and kept ready for
inspection at any time or submitted on-time to the concerned authorities as per
Contract Labour Act, Factory Act, etc. by contractor.
Contractor shall have to pay Over Time at the double the rate of a wages to
their entitled workers as per the provisions of the Factory Act.
2) The Contract Labour (Regulation and Abolition) Act,
The Contractor / Agency shall have to obtain the Labour License under
Contract Labour (Regulation & Abolition) Act from the appropriate authorities
before commencement of work. The contractor shall maintain a valid labour
license under the Contract Labour (Regulation and Abolition) Act for
employing necessary man power to be required by contractor. In the absence
of such license the contract shall be liable to be terminated without assigning
any reasons thereof.
The contractor should not be allowed to engage fifty (50) or more contract
labourers without initiating to obtain the labour license under the Contract
Labour Act. (the said number i.e., fifty (50) or more includes Supervisor and
If contractor has engaged the female workmen more than 30 numbers then
provision of crèches, shall be complied as per the provisions of the said Act.
3) Minimum Wages Act,
Contractor shall have to make the payment of wages to the Contract Labours
engaged by them, on or before 7th of every month through nearest Nationalized
Bank compulsory, preferably situated in the premises of TPS area in case of All
works Contract. The Contractor shall supply copy of Bank Statement duly
stamped by the Concerned Bank as well as debited entry of amount displayed
in the contractors’ own bank account as token of proof towards payment of
Wages to HR Department. Apart from Payment of wages through Bank,
Contractors shall have to make all other payments like Advances, Bonus,
Leave Encashment etc. to their labours through bank only and cash
payment/entry will not be allowed while issuing HR Clearance Certificate from
Wages rates for contract laborers are applicable as per the terms and conditions
of the license. The contractor shall have to pay wages to workers as notified by
Government of Gujarat., from time to time.
Any default to pay the minimum wages to the engaged workers and
deprived of their right to minimum wages payment on or before 7th of each
month shall result in levy of penalty of Rs. 10,000/- per month by way of
fine and if recurrence of the same may be lead to cancellation of awarded
4) The Provident Fund and Miscellaneous Provisions Act,
The contractor must possess separate P.F. code on the name of the Firm /
Agency / Company itself for the above subject work.
It should be ensured that all the contract labours engaged by contractor are
covered under the provident fund scheme and employee’s pension scheme and
their contribution must be remitted regularly to the concerned RPFC. The
photo copies of challan along with ECR in this regards should be submitted
regularly to the User Department to enable their onward billing clearance.
The contractor shall submit along with his bill (month wise) statement
regarding deductions against employees’ provident fund and family pension
scheme in respect of each concerned employee. Provident fund and family
pension scheme at the rate of 12 % of wages (or at the rates made applicable by
the Government time to time). The contractor’s contribution and his workers
contribution towards provident fund and family pension scheme shall deposited
by the contractor with Regional Provident Fund Commissioner. In case if the
contractor deposits the contribution to the Assistant Provident Fund
Commission, the photo copy of challans and schedule must be submitted in the
5) WORKMEN'S COMPENSATION & EMPLOYER'S LIABILITY
The contractors shall have to obtain Employee Compensation Policy under the
Employees Compensation Act before starting the work. Employee
Compensation Insurance shall be obtained for all the workers engaged for the
execution of awarded contract. If any of the work is sub-letted, the contractor
shall ensure that the sub-contractor take and provide workmen's compensation
and Employer's liability insurance for the labours engaged. Contractor is liable
to pay compensation in case of accidental injury arising out of and in the
course of employment as per the said Act and shall bear medical expenses due
to on duty accident.
6) The Payment of Gratuity Act,
The contractor shall deposit 15 days salary to GSECL, at the rate of last drawn
salary for every completed year of services or in proportionate thereof in case
less than 240 days of services of the worker in the year for each worker for the
liabilities of the gratuity. If contractor pays the same and submit the
documentary proof of payment through bank then in that case no need to
deposit the same to GSECL. (* applicable to ARC / BRC works contract
7) The Payment of Bonus Act,
Every worker shall be entitled to be paid by the contractor in an accounting
year, bonus, in accordance with the provisions of this Act, provided he has
worked in the establishment for not less than thirty working days in that year.
Contractor has to submit the paid bonus details of its worker in Form No. C as
per the provisions of the said Act as and when required by the Govt. Authority
as well as by GSECL.
8) The Maternity Benefit Act,
Contractor shall ensure that entitled female worker should provide Maternity
Leave and other benefits as per the provision of the said Act.
9) The Building and other Construction Workers’ Act,
For any construction work, fall under the definition of Section 2(1)(d),
happening outside / inside the Factory premises the said act will be applicable
and the contractor or its sub-contractor shall be liable to comply the provisions
framed there under.
10) Follow the following procedure at each milestone for the execution of
works contract.
(a) On Commencement of Contractual Work:
(1) Before starting the work, the contractor may contact Labour Welfare Officer
/ Industrial Relations Officer for all formalities related to labour law
compliance before commencement of the contract and onward Labour Law
compliance thereof, so that later no dispute will arise in respect of
compliance of labour laws.
(2) It is the responsibility of the contractor to ensure that contractor’s employees
maintain strict discipline as regards security, methods of safe working etc,
and not to cause any hindrance to smooth running of power station or in
execution of duties by GSECL staff. Any lapse in this regard will be viewed
seriously and if lapse found contract is liable to be terminated. If any of
contractor’s staff is found unsuitable or not behaving properly, the contractor
shall have to remove such worker from the work-site on demand by OIC.
The contractor shall have to strictly observe the rules and conditions
specified in the enclosed works contract booklet of the GSECL, which are
not modified hereunder. To keep harmonious industrial relations amongst
contract labours is solely the responsibility of contractor. Any breach of the
same will be viewed seriously.
(3) The Contractors shall have to obtain Photo-Gate-Pass before the
commencement of contractual work awarded. Photo Gate Pass procedure
(Attached in Annexure & Form section) must initiate by the contractor
before 10 days from actual execution of work in a prescribed application
form which is available at Security Section for the entry of workmen in the
premises at GSECL. Contractor shall obey the digital gate pass
procedure on implementation of Contract Labour Information and
Management System(CLIMS)
(4) Such application shall have to be processed for the approval of Factory
Manager. After obtaining approval of Competent Authority, contractor shall
have to prepare the Gate Passes and obtain the signature of Factory Manager.
(5) If Contract Labours are required to be engaged in Emergency during Public
Holidays / General Holidays, contractor can apply for Temporary Gate-Pass
for the period of only three days with recommendation of respective SE and
the same shall have to be regularized after following the procedure of Gate
Pass applications on the office working day from HR Department. It is to
note that No Temporary Gate-Pass shall be issued for the work other than
acute emergency to carry out the work in power station premises.
(6) The Contractor who intends to engage labours more than the specified limit
under law then necessary - Form No. V under the Contract Labour (R& A)
Act, 1970 or Form No. VI under the Interstate Migrant worker (employment
regulation) Act 1979 as applicable is to be obtained from HR Department for
the purpose of obtaining Labour License from the Licensing Authority.
(7) The attendance of the workers is to be monitored through Bio-Metric
Punching System only. The contractor should submit the details of its
worker in prescribed Performa for Bio-Metric Punching and all formalities
regarding registration thereof shall be completed before commencement of
the work. The concern user section ensures from HR department that
engaged labours have registered themselves for biometric punching and then
only allows to commence the work.

concerned Contractor on its Latter Pad and copy of it be sent to the
concerned User Dept.

(8) It shall be the duty of the Contractor or his Supervisor to ensure Bio-Metric
punching and reporting at the location of work. Non-reporting or non-
punching availability at the location of work shall be construed as absence
and suitable actions can be taken by User department as per terms and
conditions of the contract.
(9) Attendance of contract laborers will be through punching machines for
which punching machines are installed to facilitate the contractors by
GSECL for which monthly charges of Rs. 10/- will be levied on contractor
as administrative charges.
(10) The contractor shall employ adequate number of experienced staff at site for
daily supervision and for maintaining of various registers and records
required under the Labour laws and contracts. No payment for such
supervision shall be admissible.
(11) The gate passes obtained for any specific work order will be valid for that
specific work order only and contractor should not divert the man power for
any other work order. If any work or part thereof is desired/required to
sublet, the contractor shall obtain the necessary permission of the competent
authority in black and white well in advance which is mandatory for
considering the statutory documents of agency other than the agency who
awarded work order.
b) During Contractual Work under the progress:
(1) All Contractors shall have to make the payment of wages to the Contract
Labours engaged by them, on or before 7th of every month through Nearest
Nationalized Bank compulsory, preferably situated in the premises of PS
area. The Contractor shall supply copy of Bank Statement duly stamped by
the Concerned Bank as a token of proof towards payment of Wages to HR
(2) All Contractors has to comply & maintain statutory documents / registers at
GSECL site under the provision of labour laws & EPF Act.
(3) In case the contractor having more than one contract in the same TPS, the
contractor shall have to obtain work order wise separate Gate Passes and
submit the same with the documents of statutory compliance that too work
order wise every month to the User Department to enable their onward billing
12) CONTRACTOR TO INDEMNIFY THE GSECL REGARDING LABOUR
The contractor shall indemnify and keep indemnified the GSECL, and every
member, officer and employees of the GSECL, also Engineer-in-charge and his
staff against all actions, proceedings, claims, demands, costs and expenses
whatsoever arising out of or in connection with the matter referred in above
clauses and elsewhere and against all actions, claims demands, cost and
expenses which may be made against the GSECL by any workman/ employees
of contractor or any sub contractor and or from any liability any wise to any
workman/employees of the contractor or sub-contractor under any laws, rules
or regulation having in force of law including but not limited to claims against
the owner under employee compensation Act, 1923. The Employee’s Provident
Fund Act.1952, and/or the contract labour (Abolition and Regulation) Act,
The GSECL shall not be liable for or in respect of or in consequence of any
accident or injury to any workmen or other person in the employment of the
contractor or his sub-contractor, and the contractor shall indemnify and keep
indemnified the GSECL against all such damage and compensation and against
all claims, demands proceedings costs, charges and expenses whatsoever in
respect of or in relation thereto.
The contractor shall at his own expense / risk and cost to comply with all the
labour laws as above mentioned and keep the G.S.E.C.L. indemnified in
respect thereof.
GSECL : shall be entitled / empowered to deduct directly from the bills, the
amount to be paid to engaged bonafide contract workers or the contract
workers engaged by Sub-contractor; any sum or sums payable by main
contractor / sub-contractor and which sum/sums the Corporation is required to
pay in capacity of Principal Employer on account of the default of contractor in
respect of all liabilities incurred out of non-compliance regarding any
provisions of Labour Laws and same amount shall be recovered from the
pending dues of the contractor with 15% administrative charges.
Any other rules and regulation, conditions, circulars etc., that are in force at
present and that may be framed by the GSECL from time to time in connection
with contracts will be binding and acceptable to contractor.
The above are some of the major liabilities of the contractor in addition to other
liabilities prescribed under the various labour laws in force from time to time
from Statutory Authorities like State Government / Government of India,
which the contractor shall have to comply with.
13) Submission of Statutory documents to ensure the compliances:
The Contractor shall have to submit following statutory documents, work order
wise, under the labour laws and EPF to the recording officer of user
Copy of Attendance register – with name & address of establishment,
Name of work and site (duly signed & stamp by Contractor ) - Form XVI
Copy of Wage Payment Sheet – with signature of workmen, duly signed &
stamped by Contractor - Form XVII
Copy of Bank Statement (Wage Payment statement deposited in respective
bank - duly signed & Stamp by Concern Bank) (along with statement of
labours net payment amount which is reflected in Contractor’s bank account
Copy of PF Challan, ECR Wage Members details along with Copy of
Payment confirmation receipt for the respective month/s
Copy of Gate Pass Permission ( duly signed by Authorities )
Copy of Work Order ( First Time / only once )
Copy of Valid W.C. Policy (to be submitted as and when required and
renew before expiration if required)
Copy of Valid Labour License (Applicable in case of More than
manpower Engaged by Contractor for the said work) (to be submitted as and

Form No. XIII – Register of workers employed by Contractor (to be
maintained at Security Section by every contractor)
Form No. 19 Earn Leave Card issued to the workers engaged for the
calendar year and to pay the same to their eligible workers (* applicable to
ARC / BRC works contract only)

Prescribed under the Contract Labour (R&A) Act, 1970 Contractor shall submit
& specify the Name of Work, Place of Work and Work order number in Muster
Roll- Form No. XVI & Wage Register – Form No XVII and self certification
Above documents shall be submitted by the contractor in two copies invariably on or
before the 15th day of each month to respective user department for onward process
and smooth clearance by HR Department.
The contractor shall have to submit “Declaration cum Indemnity Bond” on Rs. 300/-
Non-Judicial stamp paper in prescribed Performa (Attached in annexure &
forms section) with Agreement and Indemnity Bond before the commencement of the
Section-8 : General Safety Rules /Norms to be No:GSECL/Works
observed by The Contractor Tender/
[Applicable to Successful bidder only, however all the bidders have to submit duly
signed & sealed on each page of Section-IX : General Safety Rules /Norms to be
observed by The Contractor as a token of acceptance]:
All the contractors working in Gujarat State Electricity Corporation Limited
Factory like Coal/Lignite/Gas/Hydro/Pumping Station shall have to strictly
observe the following Safety Rules. Concern principle contractors are responsible for
informing & observance of these rules by their supervisors/contract workers as well as
the owner/supervisors/ workers of sub-Contractors engaged, if any, by them for the
work contract awarded to them. Prior to commencement of the work, Contractor shall
have to submit a written assurance on their letterhead to the concerned Sectional Head
/ Engineer-in-charge that they have thoroughly gone through these Rules, have
educated their employees / workers of their sub-contractor and will strictly observe the
said Rules while execution of work under work contract awarded to them. They will
have to indemnify the company for any loss or damage / accident / injury to the
company’s property / employee or employee of their own in default of non - observing
1. Contractor should issue photo gate pass for their workers from GSECL Factory
Manager as per Gujarat Factories rules, 1963 & details shall be filled up in
GSECL gate pass format as per Aadhar card /Election card id proof & to follow
the gate pass issue procedure through concern department EE & SE, Security
Officer, LWO/IRO/DGM, Factory Medical Officer, Safety Officer/Dy. Safety
Officer & Factory Manager.
2. In case of emergency, temporary photo gate pass shall be issued by Security
Officer only for three days with prior permission of Factory Manager only.
More than three days, Permanent photo gate pass procedure shall be completed
by contract agency for their contract workers.
3. Certificate of Fitness of employment in hazardous process & operations in
form no.33 of Gujarat Factories rules, 1963 shall be issued by GSECL Factory
Medical Officer for all contractor workers before commencement of work &
examination responsibility shall be taken by contractor as well as concerned
Head of Department .Pre-employment & Periodical medical examination of
contractor workers shall be carried out in form no.32 from GSECL Factory
Medical Officer after every six (06) months of contractor with their contractor
workers. Contractor shall be fulfilled all health requirements before
commencement of work. After completion of medical examination in form
no.32/33, GSECL Factory Medical Officer shall be signed in contract worker
gate pass procedure format.
4. Contract worker gate pass will issue after completion of safety induction 3D
animation movie & Training record is to be maintained in IMS/OHSAS
training format by TK Office/LWO.
5. As per Gate pass format of GSECL, Safety Officer/Dy. Safety Officer shall be
checked the issue PPE to contract workers as per nature of job, Form no.10 of
lifting tools and tackles, Driving license, Electrical contractor license,
Electrical trade qualifications, Safety induction training, SOP, supervisor
qualifications etc. After fulfillment of all Safety compliances, Safety
Officer/Dy. Safety Officer shall be signed in Contract worker Gate pass
procedure format.
6. Work Contract shall be completed by principle contractor/agency/person who
is awarded the work order. Subletting of contract shall be allowed only if prior
approval of Power station chief before execution of work. Contractor/agency
shall be submitted the entire subletting contract documents with gate pass
application through concern department EE & SE, LWO/DGM, Safety
Officer/Dy.Safety Officer & Factory Manager.
7. Under The Conditions Framed Under Rule-45 Of The Indian Electricity Rules,
1956, Valid Electrical contractor License shall be submitted to concern
electrical department EE/SE/Electrical Safety Officer/ Safety Officer/Factory
Manager at the time of apply gate pass by agency/party with latest renewal
from Chief Electrical Inspector, Gandhinagar- Gujarat. Electrical License
photocopy shall be checked by Concerned HOD of Electrical
Department/Electrical Safety Officer/Dy.Safety Officer/ Safety Officer/Factory
8. As per nature of job/work, Qualified supervisor (Diploma (Electrical/
Mechanical/Civil/C&I) + 3 years experiences or ITI + 10 years) shall be
engaged by contract agency & qualification certificate with experience
certificate shall be submitted to concern EE/SE/LWO/IRO/DGM/ Dy.Safety
Officer /Safety Officer/Factory Manager at the time of apply gate pass.
9. As per rule 3 of CEA regulation ,2010: Designating person(s) to operate and
carry out the work on electrical lines and Apparatus, Contract person/worker
possesses a certificate of competency or electrical work permit, issued by the
Appropriate Government. That means, Electrical trade Qualification of contract
worker/person like ITI-wireman/ Electrician, Diploma (Elect), BE/B. TECH
(Elect), ME/ M. TECH (Elect) shall be submitted to concern
EE/SE/LWO/IRO/DGM, Dy.Safety Officer/ Safety Officer/Factory Manager at
the time of apply for photo gate pass procedure.
10. As per nature of job/work & during capital overhauling work /Annual
overhauling work /24X7 round the clock work/major shut down work,
Qualified Safety Officer/Manager/Supervisor (BE/Diploma (Elect/Mech/Civil)
+ PDIS-Post Diploma in Industrial Safety) shall be engaged by contractor
during dangerous operations/dangerous works as well as day to day dangerous
activities, safety supervision, tool box talk, Safety awareness program, SOP
preparation with hazards & its control measures with each step , checking of
lifting tools & tackles, hydra mobile crane, Safety precautions, coordination
with Safety Department etc.
11. License of driver shall be submitted with gate pass issue application as per
nature of vehicles & to follow the Motor vehicle Act,1988, the Central Motor
Vehicles (Amendment) Rules,2016 as well as Gujarat Motor Vehicles
rules,1989 & driver license shall be checked every day by security shift in
charge before entry in the Factory premises.
12. SOP with JSA (Job Safety Analysis) shall be prepared by contractor through
competent person as per GFR, 1963 or Qualified Safety Officer as per GFR,
1963 with 05 years experiences. SOP will review & approve by concern
JE/DE/EE/SE/Elect. Safety Officer/Dy. Safety Officer /Safety Officer/Factory
Manager before execution of work.
13. It is compulsory to use standard make Personal Protective Equipments
(P.P.Es.) as per the job requirement. Do not work without use of required
P.P.Es. Contractor is responsible to provide standard make
(ISI/DGMS/CE/EN/ANSI approved) & to checked standard/make in PPE issue
format by concern JE/DE/EE/SE/Safety Officer/Factory Manager. Personal
Protective Equipments / Safety Gadgets suitable to give sufficient protection
against hazards involved in their work / job to their staff, as per the job
requirement and insist / enforce their workers to put on the same while at
The ongoing work is liable to be stopped at any time if your contract
workers/staffs found working without P.P.Es.

Respiratory System is a combined face and breathing

15. Shift Security Inspector/Security Officer shall check Safety Shoes & Safety
Helmet of all contractor workers at entry gate of Factory Premises & shall
entered contractor workers with Safety Shoes & Safety Helmet with photo ID
16. Shift Security Inspector/Security Officer shall check validity of Gate pass of all
contractor workers on daily basis.
17. During the work execution, one trained & competent supervisor of agency
should always remain present at work site. Concern JE/DE of GSECL shall
supervise the contract work as per SOP.
18. Approved NABL laboratory calibration certificates of electrical /mechanical/
Civil/C&I /Environment survey/Chemical etc measuring /testing
equipments/instruments which are used during contract work shall be
submitted before starting the work & shall be checked by concern JE/DE/EE
before starting work & it’s record shall be maintained in concerned section.
19. The contractor shall take all the required safety measures prior to
commencement of work on dangerous substances, machineries or area at which
cautionary notice is displayed and obtain “Line Clear” or “Work Permit”
through the concern Department / Section JE/DE and shall be informed to
concern section JE/DE for closed/ returned after completion of work.
20. Safety talk/Safety work instructions shall be given to contractor workers by
concern JE/DE regarding hazards of specific work, risk & it’s control measure
(mentioned in HIRA) before starting the job work and records shall be
maintained for each & every job works.
21. Display Safety instructions shall be strictly followed by all workers who are
working in factory premises.
22. Material Safety Data Sheet (MSDS) of each chemical shall be available with
Chief Chemist/Control room & work related Chemical information shall be
taken by contractor & contractor workers from Concern EE/Chief Chemist
before starting of chemical handling work.
23. The contractor shall be checked & securely covered or securely fenced any
opened fixed vessel, sump, tank, pit or opening in ground or in floor which, by
reason of its depth, situation, construction or contents ,is or may be a source of
danger before starting the work each & every days or after interval/recess.
Contractor supervisor shall be informed to concerned HOD regarding any
unsafe conditions.
24. Prohibition of smoking, fires, lights, spontaneous ignition substance, matches;
fuses, mobile phone etc are to be strictly followed by all workers who are
working in factory premises.
25. Prior to carrying out welding, gas cutting, furnace heating or any other hot
work job, remove all the inflammable material lying at or nearby worksite or
cover it properly by suitable protective covering. Also, special care shall be
taken before carrying out such job & see that all possible contributing factors to
set fire shall be removed / vanished prior to commencement of the work.
Advance intimation shall be given to concerned section / fire section to
commence the work in fire prone areas. They should also keep ready all the
First Aid Fire Extinguishers / equipments & fire extinguishing media / material
like sand / water buckets or other appropriate equipment at such place.
26. While carrying out work in confined space or inside vessel, obtain necessary
“Confined Space / Vessel Entry Permit” from concerned department prior to
commencement of the work. For lighting in such areas, only 24-volt (ISI
certified & with proper guard) hand lamp shall be used. For taking care of the
persons working inside the confined space / vessel, a supervisor / person
capable to keep continuous watch on person(s) working inside, assist them in
case of emergency or arrange to get immediate outside help, shall remain
present at entry point. Use full body safety belt without failed. While working
inside sewage, trench or in-depth, a person to warn outsiders / entrants / passers
etc shall remain available near entry point or the entry point shall be cordoned
by a barricaded tape with a cautionary notice. After completion of the works,
all the lids / covers / grills / grits opened, shall be re-fixed / re-placed in the
original position as it were prior to commencement of the work and leave the
work place in safe condition in all respect, so as to prevent accident to fellow
27. The contractor shall see that he / his persons do not work on or block (by
stacking material, spare parts, tools-tackles, equipments etc), any passages /
walkways / gangways / aisles / staircases / ladders / lifts or any other
approaches / roads leading to plans or its auxiliaries, on which there is traffic
movements or possible traffic movements in case of emergency. Such passages
are meant for safe escape in the event of emergency. If it is utmost necessary to
carry out work in such area with blocking of passage, prior permission of
Competent Authority or the Engineer-In-Charge shall be obtained. To
demarcate / declare the area as “UNSAFE”, cordon it using barricading tape &
display suitable caution notice or keep a person to restrict / divert the traffic on
this route through other safe passage.
28. Prior to use power / electrically operated hand tools / equipments / machines /
gadgets like welding machine, hand grinder, hand drill etc, ensure for its safe
operation & use it only if it is found safe to use. Do not use defective, unsafe or
improperly maintained equipments. The electrical power supply required to run
such equipments shall not be taken directly at their own but shall be obtained
through concerned Electrical Maintenance Departments or their authorized
persons or under their observations / guidance only. The Electrical Section
shall provide temporary electrical connection up to contractor’s Mains Board
on which it is compulsory to install mains switch, ELCB & fuses of adequate
capacity. All such equipments shall invariably be earthed adequately to prevent
electrical shock, sparking, short circuit etc. Power cord to be used shall be of
adequate capacity, without any joint & shall consist of earth wire also. Hence,
it is necessary to use adequate capacity 3-wire power cord for single & 5-wire
power cord for three phase power connections. The plugs, receptacles, pins,
holders etc shall be of adequate capacity & safe to use.
All electrical & mechanical equipments / tools-tackles viz. welding machine,
cutting machine, Grinder, Drill, Chain Pulley Blocks, Hook chooks etc required
to be used during work execution shall be of standard make & bear ISI
certification mark on it.
The consumables like welding electrodes, grinding wheels / discs etc which has
specific prescribed life span shall not be used in any case if its expiry date is
29. Non-Sparking Non-Magnetic electrical hand tools and tool kits shall be used by
Electrical contractor for safe use in areas where hazardous, flammable, or
combustible vapors, liquids, dusts, or residues may be present in Gas Based
power plant and list of tools and tackles shall be submitted with technical bid.
Non-Sparking Non-Magnetic electrical hand tools and tool kits shall be
checked by JE/DE before commencement of Electrical work.
30. Before using lifting machines / tackles (like C.P.Bs., Hook chooks, winch,
forklift, mobile crane, EOT crane etc) & its attachments (like D-shackles,
slings, U-clamps, Eye bolts or any fixtures), it shall be checked and used only
if found safe to use. Also, ensure that these are tested, examined & certified in
form no.10 by Competent Person as per the Factory act-1948 & Gujarat
Factories Rules and its validity do not expire. Further, it shall be fixed properly
and firmly prior to lifting the weight. Valid Test certificate of all Lifting
machines used by Contractor to be submitted to Dy. Safety Officer/ Safety
Officer before commencement of work through concerned EE/SE.
31. Metal Scaffoldings to be used for working at height shall be of adequate size &
capacity. Obtain the work permit when working at height. While climbing on
such scaffolding or working on any structure at height, use of full body safety
belt /full body hardness with double lanyard & Fall arrestor & Helmet is
compulsory. It is also necessary to fasten chinstraps of the helmet.
32. Contractor or their employee shall not interfere in day-to-day routine plant
activities / works except the work assigned to them, shall not loiter in the areas
other than their work jurisdiction, as well as shall not temper / operate / touch
the machineries/equipments/auxiliaries with which they are not concerned.
Also, the contractor shall strictly instruct their staff for not to sit or take rest
at/near/below running plants, auxiliaries, systems or any place which is risky,
hazardous & prone to accident.
33. The cylinders containing poisonous / toxic or inflammable / explosive gas like
Oxygen, Acetylene, LPG, Hydrogen, Ammonia, Chlorine, CO2 etc shall be
handled safely taking due care. To handle / shift such cylinders a special trolley
/cage meant for it must be used but in no case it should be rolled.
34. In Gas Based Power station/Hydrogen storage area /Hydro carbon fumes-
vapour generated area, Spark arrestor (as per approved manufacturer of CCOE,
Nagpur) shall be provided on each vehicle by party/agency and it will check by
shift security in charge before entry of vehicles in the factory premises.
35. No women or young person shall be employed or permitted to work in Lead-
compound area like battery room etc. as per schedule VI of GFR
36. No women or young person shall be allowed to clean, lubricate or adjust any
part of a prime mover or of any transmission machinery while the prime mover
or transmission machinery is in motion. Examination or operation of motion
machinery shall be made or carried out only by a specially trained adult male
worker wearing tight fitting clothing as per section 22 of factories act
37. In all risky job, before start the work, contractor should obtain General Safety
Work Permit through concerned section from Shift –in-charge well in advance.
38. In case of noticing smoke or fire during their work execution, they shall make
immediate efforts to extinguish / control it and simultaneously inform the Fire
Station Mobile No as well as Station Fire Officer or Emergency Control room
no which is displayed at prominent place of factory like Main Security Gate,
All unit control room, Canteen area, Safe Assembly points, Fire Station, All
security gates, Occupational Health Centre.
39. In case of any injury / accident while working, it shall immediately be reported
to Safety Department through concerned Sectional Head / Engineer. The
prescribed Form No. 21 & ANNEXURE may be obtained from concerned
section or Dy. Safety Officer/Safety Officer.
In case of any electrical accident, it shall immediately be reported to Electrical
Safety Officer through concern Sectional Head / Engineer. The prescribed
Electrical accident form no. A as per electricity act-2003 & Form No. 21 &
ANNEXURE as per Gujarat Factories rules shall be filled up by concern
department JE/DE with written consent of contractor. The Form may be
obtained from concerned Electrical section or Electrical Safety Officer.
Electrical accident investigation shall be carried out by Electrical Safety
Officer with Factory Manager.
After any reportable accident, Contract agency shall be submitted the fitness
certificate of injured person with endorsement of GSECL factory Medical
Officer to LWO/Dy.Safety Officer/Safety Officer/Electrical Safety Officer then
after injured person may allow for work.
40. For any incident occurred but have no injury to any persons should also
reported as per GSECL format and informed to Dy.Safety Officer/Safety
Officer as Near Miss Incident.
41. Safety penalty shall be imposed against Offences by contract workers: If
any contract worker worked in a factory contravenes any provision of Factories
act or any rules or orders made there under ,imposing any duty or liability on
workers, contractor/agency shall be punishable with fine which mentioned as

Factories Rules,1963

Safety Penalty is to be imposed directly by individual Dy. Safety Officer/Safety
Officer/Electrical Safety Officer and Factory Manager/Occupier against
violation of statutory requirements and penalty will be recovered through RA
bill. Photograph/CCTV camera footage is to be put up with penalty note by
imposed individual officer.
42. Party will damage any fire equipments or property or machinery in factory
during execution of work, total damage cost will be recovered from party RA
bill and recovery Office note put up by concern HOD.
43. All the relevant labour and industrial laws shall also be followed compulsorily.
44. After completion of work, cotton waste, grease, oil, unused material, welding
rod pieces, scrap etc. are to be removed by contractor and scrap shall be
deposited to scrap yard of Main Store.
45. For performance evaluation of contractor, safety factors of work accident, fire
incident & near miss accident will be considered. Steps can be taken to review
the job assignment up to cancellation for negligence.
46. Over & above these, contractor shall have to follow all the safety requirements
/rules & regulations / norms and legal provisions laid down in various statutes.
Particularly the provisions of The Factories Act-1948 & the Gujarat State
Factories Rules-1963 (Amended up to date), The Electricity Act-2003 & rules,
BOCW Act/Rules shall be followed strictly. The contractor shall also obey the
rules / regulations / instructions of the local Competent Authority for safety &
health requirements.
47. Contractor has to send his worker/staff when training arranged by GSECL. No
reimbursement paid for same.
48. Contractor has to give PPE as per undertaking given by contractor and PPEs
should be issued before issuing gate pass.
49. Contractor is responsible for any delay in issuing gate pass due to none
complying of safety rules.
50. The above rules shall be scrupulously followed and where required, Contractor
/contractor workers may contact to the Dy.Safety Officer/Safety
Officer/Electrical Safety Officer in case of any ambiguity or needs further
guidance in this regard.
51. Scaffolding should be erected & inspected by competent person. Arrangement
of competent person is in the scope of contractor.
52. Safety checklist to be followed during work execution as per attached list of
safety check list.

DECLARATION CUM INDEMNITY BOND

THIS DECLARATION CUM INDEMNITY BOND made at -------------------------

expression Shall unless it be repugnant to the context or meaning thereof, be
deemed to mean and include their respective assigns, successor, executors,
subcontractors and/or administrators) of the ONE PART in favour of
M/S Gujarat State Electricity Corporation Limited having its power Station at

which expression shall unless it be repugnant to the context or meaning thereof
be deemed to mean and include its assigns, successors) of the OTHER PART.
WHEREAS the COMPANY has entered into a contract with the Contractor for the

AND WHEREAS it is one of the essential conditions of the Contract that the
Contractor shall comply with all the provisions of the Labour& Industrial Laws, as
may be applicable from time to time for the discharge and completion of the works
and completion of the Works and Services covered under said Contract Labour (R &
A) Act 1970,Child Labour (Prohibition and Regulation) Act 1986,The Employees
Provident Funds & Miscellaneous Provisions Act,1952,Employees State Insurance
Act 1948, Minimum Wages Act,1948,Payment of Bonus Act,1965,Payment of Wages
Act,1936, Employees Compensation Act.1923, Factories Act,1948 and other Labour
Laws, Rules, Notifications and Codes which are at present applicable to the contractor
and which may be applicable during the tenure of the contract (hereinafter referred as
AND WHEREAS the Contractor has agreed to execute this Declaration cum
Indemnity Bond to this effect and has agreed to indemnify and Company, it’s
Directors, Officers and employees and representatives indemnified and hold harmless
against all third party claims, charges ,penalties, fines, expenses ,losses, damages
costs, suits or any other levy against the Company and/or the management due to the
failure of the Contractor to observe or follow all applicable laws.
NOW THIS DEED WITNESSETH AS UNDER:
1. The Contractor hereby declares that all acts, deeds, actions, activities, conduct
and lapse, delays, misdeeds, faults, breaches, inactions etc done by his assigns,
successors, executors, subcontractor and/ or administrators shall be
construed to be have been done by the contractor and he alone shall be
liable for such acts, inactions etc.
2. In consideration of the Company awarding the Contract to the Contractor
subject to the condition of execution of this Declaration cum Indemnity
bond, the Contractor declares and represents to the Company that the
Contractor has obtained all Statutory registrations, Certificates, licenses and
approvals required under the Laws enabling the Contractor to execute the
Contract in a legal and lawful manner.
3. That in the event of any liability arising out of failure to observe or
non-compliance of any such ‘Laws’ by the Contractor in connection with
the Performance of the contract, the Contractor shall bear all the resultant
whatsoever liability (ies), if any arising out thereof and that the company , its
Directors, Officers and employees, representatives, shall not be liable for any
such liability(ies). The Contractor agrees to indemnify and keep the Company
and its Directors, Officers and employees, representatives indemnifies, defend
and hold harmless, against all losses, costs, damages, claims, penalties, interest,
expenses, demands, fines, legal liability, causes of action, injury to persons,
suits etc., which may be suffered, incurred, undergone and / sustained by the
Company including the Costs and expenses that may be incurred in
defending any such liability(ies) claim(S), Proceeding (S) etc. that maybe
made or taken or taken or arise on the same by any Person, body,
authority, government, judicial / quasi - judicial authority due to the
failure or non-compliance of any such laws and rules there under
(including any amendments in acts, laws, statutes & rules there under) of
whatsoever kind and nature arising out of or in any way connected with,
whether or not such acts or omissions are actual or alleged, active or
passive with regard to the discharge of the said Contract.
4. The Contractor further declares that in case of
any suit / claim / right / damages / compensation / fine / levy / charges /
expenses / losses / penalties / costs raised by the third party, including
contract labours engaged by the contractor, he shall join such proceedings in
such Suit/Court/Tribunal/Authority and effectively defend the same.
5. The Contractor hereby agree and undertakes to make good any loss,
damage, claims, suits, demands, decrees, expenses that the Company may
suffer to the fullest satisfaction of the Company and if the Contractor
fails to make good the same then the Company shall have the right to
recover the same and or any other loss sustained, without any restriction
or limitation, together with any other incidental expenses, costs, and all
incidental logistic expenses etc that may be suffered by the Company
from the Contractor and the Contractor hereby further confirms and declares
that this Declaration cum Indemnity Bond is irrevocable and shall be
final and binding on it / him heirs, executors, administrators, legal
representatives, successors, subcontractors and assigns, wherever the context
applies. any claims, demands, shall be adjusted against any amount due
and payable to the Contractor and the Company shall have the right to
withhold any amounts due and payable to the Contractor, till the
settlement of such claims, disputes to the Contractor towards discharge of
such claims, obligations etc.
6. This Declaration cum indemnity bond shall be in accordance with the laws of
India and any dispute between the parties with regard to this Declaration cum
Indemnity Bond shall be resolved through the dispute resolution process
mentioned in the General Conditions of the Contract (GCC).
IN WITNESS WHEREOF, the said Contractor has hereunto set their hand the day and
year first hereinabove written.
