15 Safety  Failure to erect safety signage or trying to carry out

he works without proper precautions/safety measures as

equired will attract a fine of Rs. 5,000/- for each incident.

16 Defect &Liability Period The contractor shall be responsible to make good and remedy at

his own expense any defect which may develop or may be noticed

before the period mentioned hereunder from the certified date of

completion, The within 15 days of receipt of the notice. In the case

of failure on the part of the contractor, the Engineer-in-charge may

rectify or remove or re-execute the work at the risk & cost of the

contractor. The Engineer-in-charge shall be entitled to appropriate

the whole or any part of the amount of security deposit towards

the expenses, if any, Incurred by him in rectification, removal or re-

execution. The Defects Liability period shall be as under(a) for all

works costing upto Rs. 50,000 ( amount put to tender), the period

shall be 3 months from the certified date of completion.

(b) for all works costing more than Rs. 50,000 and upto Rs. 1 crore

(amount put tender), the period shall be 6 months from the

certified date of completion or one monsoon, whichever is later.

(c) for major projects costing more than Rs. 1 crore, the period

shall be 12 months from the certified date of completion which

should include one monsoon.

(d) For building works, the period specified in (a), (b) or (c) above

OR elapse of monsoon period following the certified date of

completion, whichever is later. For the purpose of deciding the

monsoon period, the 30th September may be treated as the last

2. AssessmentofSubmission

The Employer will open the technical bid of physically submitted document of all the

bidsreceived for the package (except those received late) containing the sealed Tender

ofbiddersinthepresenceofbiddersortheirrepresentativeswhochoosetoattendonthedateandtime

mentionedintheNITIntheeventofspecified dateofbidopening being declared as aholiday for the

In Physical submission, Bidders detailed and tender fee, E.M.D. shall be opened first.

3. EvaluationandComparisonofTendervolume

TheEmployerwillevaluateandcompareonlythoseTendervolumeswhicharedetermined to be

substantially responsivein accordance with Clause 2 and qualified

forawardofContractinaccordancewithClause5(GeneralTermsandCondition).

4. ProcedureforTenderOpening

Received copies of tender in physical form with in schedule time, will be open on scheduledate and

time. In the event of specified date of bid opening being declared bidders

whoqualifythecriteriathenbidderbidwillbeconsideredforopeningofpricebid.

The Employer will award the Contract to the bidder whose bid has been determined to

besubstantiallyresponsivetothebiddingdocumentsandwhohasofferedthelowestEvaluated Bid

Price, provided that such bidder has been determined to be (i) eligible

inaccordancewiththeprovisionsofClause3(GeneralTermsandCondition);and(ii)qualifiedinaccorda

ncewiththeprovisionsofClause5(GeneralTermsandCondition).

6. NotificationofAward

Prior to expiration of the period of bid validity prescribed by the Employer, the

Employerwillnotifythesuccessfulbidderbycable/faxandconfirmedbyregisteredletterthathisbid

has been accepted. This letter shall name the sum which the Employer will pay theContractor in

consideration of the execution, completion and maintenance of the Works bytheContractor

asprescribedbytheContract.

7. A successful Bidder has to deposit security deposit / Bank Guarantee as per Circular

afterreceiving letterofIndent.Timelimitofworkwill commencefromthedateof

8. ClarificationofBids

To assist in the examination, evaluation and comparison of bids, the Employer may, at

hisdiscretion,askanybidderforauthenticationthecorrectnessoftheinformation/detailsfurnishedb

yhiminhisbid.SuchrequestbytheEmployerandtheresponsebybiddershallbeinwritingorbycable/fa

6. OneBidperBidder

Each bidder shall submitonly onebidpercontractpackage either by himselfor as apartner in

7. BiddingDocuments

Thebidder isexpectedtoexaminecarefully thecontentsofalltheabovebiddocuments.Failures to comply with

8. LanguageofBid

accurate translation ofthe relevant passages in the English

19. AdministrativeConditions:-

 SafetyandSignage

Contractor has toarrange for the completesafety ofthepersons working for project, usersof the

road i.e. public and vehicles also. All the arrangements of traffic drums, metal / fibercones,

traffic blinkers, traffic signs as per design, safety tapes etc. to be arranged at site.Necessary

florescent marking on traffic signs to be provided so that it should be visible

atnight.Duringnightworkinghourssafetyinchargepersonnelshallbeprovidedwithflorescent

jackets. This shall be Provided at no extra cost by the bidder under

attachéwithspecifiedinthetenderdocumentsunderpayableiteme.

 LiaisonwithlocalauthorityforelectricalconnectionsfortheAMC

Thecontractorisresponsibleforliaisonwithlocalauthorityforchangeinsupplyconnectionornewco

nnectiononbehalfofAMC.ItincludesfillingthenecessaryapplicationtopowerSupplyCompany,fo

llowupandgettingthesupply,fillingthenecessary test reports to the power supply company. All

official fees including

securitydepositsandotherexpensesshallbeofinitiallypaidbythecontractor.AMCmaysupportto

get the temporary connection and may at its diseretien get the same converted

20:-CONTINGENTFEE:

 The Contractor warrants that he has not employed any person to solicit or secure

thecontractuponanyagreementfora commission,percentage,brokerage orcontingentfee.

Breach of this warranty shall give the Municipal Commissioner the right to cancelthe

contract or to take any other measure as the Municipal Commissioner may deem

fit.Thewarranty doesnotapply tocommissionspayableby

thecontractortoestablishcommercialorselling agentforthepurposeofsecuringbusiness.

 No officer, employer of theMunicipal Corporation beadmitted to any share or part

ofthiscontractortoanybenefitthatmayrisetherefrom.

21:-OVERPAYMENTANDUNDERPAYMENT:

Whenever any claim fourths payment of a sum to the Municipal Corporation arises

outoforunderthisContractagainstthecontractorthesamemaybedeductedbytheMunicipalCorporation

fromanysumthendueorwhichatanytimethereaftermaybecome due to the contractor under this

contract and failing that under anyother contractwith the Municipal Corporation or from any sum

due to the contractor with the MunicipalCorporation (which may be available with

MunicipalCorporation), or from his

theowner againstsuchlien or claimor if suchlienor claimbevalid theowner may be orbecomedueand

14. SpecialmodesoftheconstructionnotadoptedingeneralEngineeringpractice,ifproposed to

be adopted by the contractor shall be considered only if the contractor providedsatisfactory

evidence that such special mode of construction and completion of work to therequired

strength and quality. Acceptance of the same by the Engineer in charge shall

nothowever,absolve the contractor from theresponsibility of any adverseeffect and

concordanceofadoptingthesameinthecourseofexactionorcompletionofthework.

15. The contractor shall be responsible for observing the rules and regulation imposed under

the"MinorMineralAct",andsuchotherlawsandrulesprescribedbytheGovernmentfromtimetotime.

16. All necessary safety measures and precautions (incl. those laid down in the

variousrelevant Indian Standard) shall be taken to engrave the safety ofmen, materials and

machineryontheworkandalso oftheworkitself.

17. Quantity measured in the tender is approximate. It may increase or decrease looking

tothequantumofactualworkforwhichnoanyclaimshallbeentertainedbyA.M.C.

18. ContractorshallhavetoexecuteextraitemifrequiredorasperneedofAMC.

19. The work in general shall be carried out as per standard specifications of the

relevantitems to be executed & as per the instruction of Engineer in charge & as per the

guidance ofAMC'sConsultantforthisproject.

20. Thegeneralterms&conditionsofthecontractshallbeapplicable&shallbebindingonthe

contractor.The contract agreement shall have to be executed betweenAMC &

21. ForTenderamountingbelow10lakhLOIshallbeissueswithin3daysafterreceivedofsanctione

dtenderandresolution.Within10dayscontractorhastosubmitSDandafterreciveing SD Work order

shall be issue to contractor and the time limit shall be start from

orspecification and the Engineer -in-charge shall make such corrections and interpretations

asnecessarytofulfilltheintentoftheplantsandspecifications.

24. ThequantitiesofitemsinBOQ(BillofQuantities)mayvaryincaseofnecessityarises.

29. Electricity: Electric supply will be made available at the site by the Contractor and

thecontractormustmakehisownarrangementswiththeCorporationandElectricitySupplyAuthoritie

The Contractor shall be entitled to use supply Electricity as may be available on the site

forpurposeoftheworkandshallpaysuchchargesasisfixedbytheappropriatesupplyAuthorities.

The colour and workmanship shall be in accordance with the Code of Practice for painting, and as specified in the drawings or as

directed by the Engineer

Materials: Synthetic enamel paint shall conform to IS.

The materials required for work of painting work shall be obtained directly from approved manufacturers or approved dealer and

brought to the site in maker's drums, kegs etc. with seal unbroken.

All materials not in actual use shall be kept properly protected, lids of containers shall be kept closed and surface of paint in open

or partially open containers covered with a thin layer of turpentine to prevent formation of skin. The materials which have

become stale or flat due to improper and long storage shall not be used. The paint shall be stirred thoroughly in its container

before pouring into small containers. While applying also the paint shall be continuously stirred in smaller container. No left over

paint shall be put back into stock tins. When not in use, the containers shall be kept properly closed.

If for any seasons, thinning is necessary, the brand of thinner recommended by the manufacturer shall be used.

The surface to be painted shall be thoroughly cleaned and dusted. All rust, dirt and grease shall be thoroughly removed before

painting is started. No painting on exterior or other exposed parts of the work shall be carried out in wet, damp of otherwise

unfavorable weather and all the surfaces shall be thoroughly dry before painting work is started.

Brushing operations are to be adjusted to the spreading capacity advised by the manufacture of particular paint. The paint shall

be applied evenly and smoothly by means of crossing and laying off. The crossing and laying off consists of covering the area over

with paint, brushing the surface hard for the first time over and then brushing alternately in opposite directions two or three

times and then finally brushing lightly in direction at right angles to the same.

In this process, no brush marks shall be left after the laying off is finished. The full process of crossing and laying off will

constitute one coat.

Each coat shall be allowed to dry completely and lightly rubbed with very fine grade of sand paper and loose particles brushed off

before next coat is applied. Each coat shall vary slightly in shade and shall be got approved from Engineer-in-charge before next

coat is started.

Each coat except the last cost shall be lightly rubbed down with sand-paper of fine pumice stone and cleaned of dust before the

next coat is applied. No hair marks from the brush or clogging of paint puddles in the corners of panels angles of mouldings etc.

shall be left on the work.

Approved best quality brushes shall be used.

Mode of measurements & payment :

Any type of C.C. Central verges curbs surface shall be measured under this item.

All the work shall be measured not in the decimal system as executed subject to the following limits unless otherwise stated

(a) dimensions shall be measured to the nearest 0.01 metre.

(b) Areas shall be worked out to the nearest 0.01 Sq. metre.

No deductions shall be made for openings not exceeding 0.5 sq. mt. each and no addition shall be made for painting to beadings,

mouldings, edges, jambs, soffits, etc. of such opening.

The different surfaces shall be grouped into one general item, areas of uneven surface being converted into equivalent

plain areas in accordance with the mode of measurement for payment.

The rate shall be for a unit of one SMT.

Clause : 1 Contractor shall not employ any child having age 5 to 15 years as it is prohibited by Child Labour Prohibition and Regulation

Act 1986. Hon'ble Supreme Court has given certain guide lines and as per the guide lines. If child labour is employed on the site work,

the contractor shall have to deposit Rs. 20,000.00 (Rupees Tw enty thousand only) in the child labour welfare fund. If the employer

refuses to deposit then action will be taken for contempt of Supreme Court Judgement and also will be prosecuted by concerned

authority. Because of the breach of any provision of child labour prohibition and regulation Act 1986 by the Contractor & Municipal

Corporation becomes liable to pay any amount then the Municipal Corporation shall recover the said amount from the contractor.

Clause : 2 The Standing Committee has decided to deduct 1/2% amount from each running bill as per its Reso. No. 1783 Date 06--02-

97, but the Municipal Corporation Board has recently decided that the actual testing charge is taken and the remaining amount is

refundable at the time of final bill (As per Muni. Board Reso. No. 123 dated 25-02-97)

Clause : 3 Contractor has to follow prevailing Labour act and has to maintain labour register acordingly,and has to follow other

Modification of specifications and correction/corrigendum in respect of the work if required will be made by A.M.C. The same shall

be placed on A.M.C website which may be downloaded by the tendrers enclosed along with the tender duly signed. These shall form

a part of tender. The tenderer shall not add or amend the text of any of the documents except in so far as may be necessary to

comply with any addendum.

* ADDENDAUM/CORRIGENDUM .

Addendum or corrigendum conveying any change or correction in respect of the work shall form the part of the contract documents.

The full consideration shall be given to such addendum or corrigendum or correction before submission tender duly filled in by the

contractor. Therefore, the contractor shall have to watch such addendum or corrigendum or correction published by A.M.C through

its website www.egovamc.com. Tenderes shall verify the number of addendum issued and enclose the same with the tender

documents,failing which the tender shall be liable for rejection and no any complaint in respect to this shall be entertained under any
