Regular order : Regular order shall be placed on firms having following credentials : The OEM or its authorized agency shall have experience of design, development, manufacturing & installation of any two or more systems out of PAPIS / ETBU / CCTV/ IOT based Water level indicator in Integrated form and should have supplied the integrated system for at least 15 Railway passenger coaches for Indian Railways / Indian PSU. Developmental order : The OEM or its authorized agency shall have experience of design, development, manufacturing & installation of PAPIS / ETBU / CCTV/ IOT based Water level indicator and should have supplied at least 05 Railway passenger coaches (individual or combined system) for Indian Railways / Indian PSU. Note: 1. Credential of only OEM shall be considered for Eligibility Criteria. 2. The OEM or its authorized agency should submit records of previous supplies and credentials. The contact details (Names, Phone number, and email-ids) with complete address of the customer with list of key personnel should be submitted along with offer for verification purpose. 3. The Firm should also submit certificate of satisfactory installation from user railways/PSU. 4. Firm or their principal should have well- established manufacturing and testing facilities. 5. Firm or their principal should have established quality control system and Organization to ensure quality of the product and should be an ISO 9001 certified company or should have an internationally certified quality control system. 6. The firm should also submit an affidavit indemnifying genuinity of all the certificates submitted with the offer. 7. ln case the credentials of the associate/subsidy/group company of the OEM is used for the requirement of the eligibility criteria, a tender specific authorization by the associate/subsidy/group company for using their credential and also proof of their relationship with the OEM is to be submitted. 8. Firm has to submit clause wise compliance of tender specifications.

For all items — Commencement : Within 1 Days of issue of Contract, Completion 50% quantity to be : Within 150 Days thereafter start supply immediately and completed within 90 days and balance 50% quantity to be completed in next 60 days.

Payment Terms

80% payment will be allowed after receipt of the material in good and acceptable condition at Consignee's end against Inspection certificate and the supplier's challan certified by the consignee's Gazetted Officer. Balance 20% payment will be made on successful Installation & Commissioning. During CAMC period, after completion of warranty period, the successful bidder shall be paid for its CAMC obligations as per purchase order/contract agreement. CAMC payment shall be made by Sr. Divisional Finance Manager of user workshop/shed/division of concerned Zonal Railways as per their requirement.

Statutory Variation Clause

Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/ contractor.

Option Clause

The purchaser shall be entitled to vary the order quantity upto +30% anytime within the delivery period (including extended delivery period) on the same terms and conditions. The increase in quantity with respect to the tender quantity can be done even at the time of ordering and the tenderer shall be bound to accept the quantity so ordered on the basis of his original offer. The purchaser shall be entitled to exercise + 30% option clause in one or more than one installment as long as the total variation in quantity does not exceed the limit of 30% of ordered quantity.

Standard Governing Conditions

IRS Conditions of Contract: The contract shall be governed by latest version (along with all correction slips) of IRS conditions of contract, and all other terms and conditions incorporated in the tender documents.
