Design, Supply, foundation ,installation, testing, commissioning and proving of Coil Scragging and Load Deflection Testing Machine for LHB & IRY coaches as per attached Specifications.

1. Bulk of full order will be placed on manufacturers or its authorized agents who are either registered with Railway for tendered item or who has successfully supplied (supply here interprets to supply, installation & commissioning being M&P item) tendered or similar item to Zonal Railway /PU/CORE/PSU/Other Govt. Department/Public listed Company (with any revision of Specification/drawing or with different size) in last five financial year and current financial year up to date of tender opening. *Definition of Similarity: Coil Spring Scragging & Load deflection Testing Machine Hydraulic type with Ram Force 25 T and above and capability to measure lateral shift of (+/-) 50mm or more.

The tenderer shall, in their offer, submit satisfactory performance certificate of at least 01 no. of such machine (which are counted for the purpose of supply above). The machine covered by these certificates must have worked satisfactorily for at least one year from the date of commissioning as on the original date of closing of tender. The certificate shall not be older than one year from the original date of closing of tender. The performance certificate issued after original date of closing of tender (in cases where tender closing date has been extended) are also acceptable however the machine must have completed one year of satisfactory working after date of commissioning as on original date of closing of tender. To this effect, the performance certificate submitted by the tenderer shall have been issued by the actual end user organization of the machine (Officer level in case of Railway), with their clear signature and address therein, in whose premises the machine is installed and commissioned

In case the tenderer is an agent of the manufacturer, they should clearly indicate the same and also enclose tender specific current authorization certificate from the manufacturer to this effect on the letter head of manufacturer and also mention the place where the equipment will be offered for pre inspection before dispatch.

SD Condition: Security deposit will be 5% of the contract value . Other conditions of SD will be as per Clause 12 of Section-II of NWR tender conditions

EMD condition: As per Clause 3 of Section-I of NWR tender conditions

All the bidders/tenders should ensure that they are GST compliant and their quoted tax structure/rates are as per GST Law. In case the successful tenderer is not liable to be registered under CGST/IGST/UTGST/SGSTAct, The railway shall deduct the applicable GST from his/their bills under reverse charge mechanism (RCM) and deposit the same to the concerned tax authority.

Tenderer should mention in their offer: - 1. Name of manufacture with complete address. 2. Place of inspection be indicated with complete address, option for inspections at godowns/outstation/multiple places be strictly avoided, and preferably be permitted only at manufacturers place.

Warranty obligations: 1. The warranty obligations shall stand for 2 years from Installation, commissioning and proving out of machine by supplier (Details shall be referred at Clause 7 of Section IV and Clause 16 of Section V of Specification appended with the tender.

CA certificate: In cases of procurement for a value in excess of Rs. 10 crores, the Class-I local supplier/ Class II Local supplier shall be required to provide certificate from the statutory auditor or cost auditor of the company (in the case of companies) or from a practicing Cost accountant or practicing chartered accountant (in respect of suppliers other than companies) giving the percentage of Local content. The certificate should have valid UDIN mentioned in certificate.

Prove out and Penalties regarding Productivity drop: As per clause 2.5 & 2.6 of Section IV of Specification appended with this tender.

For firms not seeking/eligible for earnest money exemption, earnest money as stipulated in the Notice for Invitation of Tenders (NIT) will have to be paid only online through Payment Gateway link. No other mode of payment for EMD is acceptable.

1. For Railway specific items tender specific authorization of OEM is required and for other than Railway specific items general dealership/authorization of OEM is also acceptable.The tendered item is non- Railway specific item 2. For traders, Non submission/uploading of valid OEM authorization letter will make their offer invalid and offer will be summarily rejected.

1.Bidders have to quote rates of each of the mentioned items individually in PDF file with price break up such as concomitant accessories, any other concomitant accessories, concomitant works etc (Whichever applicable ) and the quoted cost will be included for the purpose of inter-se ranking and commercial evaluation except for optional services/spares/consumable/accessories. 2. The price break up quoted by firm will be binding for the purpose of post contract management/ entering into separate contract based on this contract.

Micro and Small Enterprises firms In order to avail themselves of benefits and preferential treatments, the MSEs must be registered with any of the following: - (a) UDYAM (UDYAM Registration Certificate). (b) Udyog Aadhar Memorandum (Note :- Terminal date for consideration of this certificate was till 30.06.2022 or as extended by Ministry of Micro, Small & Medium Enterprises from time to time. Thus this certificate (Udyog Aadhar Memorandum) can only be considered if the above terminal date is further extended beyond 30.06.2022). MSEs registered with above agency/agencies must attach (in the template - "Attach Documents" on "Techno-Commercial Bid Details form", as scanned copy in PDF format) their current & valid registration certificate along with their offer. Other Conditions shall be as per Para 4 of Section-I of NWR tender condition document

1. Inspection -Third party Inspection(TPI) for indigenous makes/brands. 2. Third Party Inspection against GC/TC may be considered for foreign make/brands (works address not located in India),Indian vendors supplying foreign goods or Goods having large foreign content. Documentary evidence will be required to be produced at the time of inspection for the part/whole assembly which has been claimed a foreign part/whole assembly. 3. Wherever the inspecting authority is specified in the tender documents, bidders are advised to quote accordingly. Offer with any deviation from inspection clause (as per applicability detailed in inspection clause) mentioned in tender will be summarily rejected. 4. Railway reserves the right to modify the requirement regarding staged inspection at later stage (if required) as per applicable STR/Specification. 5. TPI inspection here interprets to Pre- dispatch inspection for items which are categorized as supply items. 6. The machine shall be inspected and tested during different stages of its manufacture starting from raw material till the completion of machine, by the inspection agency/purchaser or his authorized representative at the supplier's or his sub- supplier's works. The applicable testing/ Quality Assurance Program will be as per Annexure-I (Quality Assurance Plan) contained in the Annexures- Specification (corresponding to each demand/item) uploaded with the NIT. 7. The detailed norms regarding Inspection shall be referred at Clause 9 of Section VI of specification appended with this tender.

In case of tender item cannot be split or divided, etc. the MSE quoting a price within the band L1+15% may be awarded for full/complete supply of total tendered value to MSE, considering the spirit of the Policy for enhancing govt. procurement from MSEs.

F.O.R.:- Destination

Wherever SD has been exempted, for any reason, and the supplier fails to supply goods as per conditions of contract, as amended from time to time, Purchaser shall have right to levy damages from the supplier for failing to comply with the contractual conditions, not by way of penalty, an amount equal to SD amount, as would have been applicable if the contract was with a non-exempted vendor. These damages shall be treated as recoveries outstanding against the vendor and dealt with accordingly. Purchaser should ensure that the contracts are worded so as to conclude severable contracts for each lot. In case of failure by contractor to meet deliveries for any lot. Railways may cancel the contract for defaulted part by forfeiting SD commensurate to that lot. (5% of the contact value subject to Max. Rs 50 lakh).

Tenderer to note that wherever the Indian Standard is specified in the NIT or in the attached specification, the latest revision of the specification shall be upto the date of publishing of the tender.

In case, any item is required in sets, please specify nos./pieces per set. This is essential for proper technical evaluation of the offer. Offers received without this may be considered as incomplete and liable to be rejected.

Service facility in India and techncial support: The tenderer will clearly spell out in the offer the facilities available with him or his agent for providing adequate after- sales service in India during warranty period . The complete details such as organization for after sales service, availability of technically competent engineers and warehousing facilities for spares should be clearly indicated. Bidders not offering complete servicing/repair facilities in India to ensure quick response to maintenance/ servicing calls are not likely to be considered. Detailed condition as para Clause 13 of Section V of Specification appended with the tender

Purchaser reserves the right to verify at any time, the details submitted by the Bidder by actual site visit. If the information furnished in the bid is found to be incorrect during verification, the bid shall be considered invalid and their EMD shall be forfeited, and necessary action will be initiated including suspending business with North Western Railway. It is the bidder's responsibility to ensure that the information in the offer remains unchanged for the validity of the offer and must be verifiable during this period.

This Tender complies with Public Procurement Policy Order,2017(along with revisions/addendums/additions issued from time to time ) with respect to Make In India Policy.

The delivery specified in Tender schedule covers the complete time period required for supply, installation & commisssioning.

Foundation and related drawing, Approvals of GA, Foundation and related drawings: As per Clause 11 of Section V of Specification appended with the tender.

The bidder shall furnish along with the offer a list of all critical items/ sub- assemblies which are bought out by the bidder and proposed to be used, along with the manufacturers name, brand model etc.The Manufacturer shall produce invoices of bought out items/sub-assemblies to ensure genuineness of such products / verification by the Inspecting agency. Test certificates of bought item should be provided by the supplier with proper identification at the time of inspection

Training:- Contractor shall train the Railway staff regarding operation and maintenance of equipment during commissioning of M&P.(Detailed Training norms shall be referred at Clause 10 of Section V of Specification appended with this tender)
