Special Eligibility Criteria

   (i) Bidder must be OEM or its authorized dealer having tender specific authorization. Authorized dealers with valid authorization from OEM can also quote on behalf of OEM provided the OEM takes full responsibility for the quality of the material including warranty obligations and the inspection against Railways orders. ii. OEM means the firm that has its own manufacturing facility from start to finish (i.e. spinning, weaving & processing) of the tendered product under same PAN Card. In this regard, a certificate of capacity cum capability to be furnished by manufacturer issued by RITES along with the offer. iii. Financial Capability: OEMs Total Gross Revenue from Operations/Gross Sales Value, within the period of current financial year & previous three financial years (period to be reckoned as on the date of tender opening) must be minimum 150% of the estimated tender value. Bidder must submit a summary of financial year wise Gross Revenue from Operations/Gross Sales Value of OEM to show the compliance of this condition, duly supported by the copies of Income & Expenditure Statement or Profit & Loss account pertaining to the above period. These financial statements must be certified by a Chartered Accountant or any Statutory Auditor. iv. OEM must have in-house lab in their premises along with all testing procedures in their in-house lab required for ensuring quality of all parameters for the ease of doing stage inspections and also to make sure that supplier is able to provide linen of required quality to Railways. v. OEMs Test Report issued by NITRA/BTRA/SITRA/ATIRA/WRA lab for proving conformity to tendered specification to be submitted along with the offer. vi. OEM should be ISO-9001, ISO-14001 & ISO-45001 and certificate to be furnished along with the offer. vii. OEM premises must be certified under Pollution Control Board for all stages of manufacturing for Pollution control norms. Certificate to be furnished along with the offer. viii. OEM should be Oeko-Tex (Standard 100 Product Class-II) certified and valid certificate to be furnished along with the offer.

Commercial-Compliance

   Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

   All the bidders/tenders should ensure that they are GST compliant and their quoted tax structure/rates are as per GST Law. In case the successful tenderer is not liable to be registered under CGST/IGST/UTGST/SGSTAct, The railway shall deduct the applicable GST from his/their bills under reverse charge mechanism (RCM) and deposit the same to the concerned tax authority.

   Tenderer should mention in their offer: - 1. Name of manufacture with complete address. 2. Place of inspection be indicated with complete address, option for inspections at godowns/ outstation/ multiple places be strictly avoided, and preferably be permitted only at manufacturers place.

Other Conditions

   (i) There will be 3 times Inspection by TPI. 2 Stage inspection at OEM's in-house Lab and final Inspection at OEM's premises by TPI through NITRA/BTRA/SITRA/ATIRA/WRA lab. Railways may however also get the stage inspection done from NITRA/BTRA/SITRA/ATIRA/WRA lab through TPI. (ii) Stage-1 Inspection -Yarn Manufacturing (Spinning stage for yarn quality control). TPI to verify that firm has manufacturing facility from start to finish (i.e. spinning, weaving & processing). (iii). Stage-2 Inspection - Weaving stage (For construction quality control). (iv). Final inspection- To be done after the product is ready by TPI through NITRA/BTRA/SITRA/ ATIRA/WRA lab.

   The para 5.3 of NWR Tender conditions document(SBD) Section-I of make in India policy is applicable . Other conditions shall be as per detailed Make in India policy mentioned in NWR tender conditions document (SBD).

   Pre-decided quantity splitting clause shall be applicable. Splitting clause as per para-10 of section-II of NWR SBD attached with the tender.

   Sample Clause :- (i) After award of contract for feel, finish, shade/color, appearance and comfort, Successful Bidder shall get advance sample (free of any cost and any expenses whatsoever) approved from buyer before bulk manufacturing/starting bulk supplies. However, final material shall be inspected by inspecting authority as per tender specifications. Successful Bidder shall submit 5 samples for Buyers approval, within 07 days of award of contract. ( i i ) Buyer shall, as per contract specifications framework, either approve the advance sample or will provide complete list of modification required in the sample within 07 days of receipt of advance sample. (iii) In case, the sample is found to have major deviations/not conforming to the Contract specifications, the buyer at its discretion may call for fresh samples for approval before allowing bulk supplies or may terminate the contract after notifying the deviations to the seller. (iv) Unless otherwise provided in the contract, all samples required for test shall be supplied by the contractor free of cost. Where under the contract, the contractor is required to submit advance samples, any expensed incurred by the contractor on or in connection with the production of stores in bulk, before the samples have been approved unconditionally shall be borne by the Seller and he shall not claim any compensation in the event of such samples being found unacceptable by the Buyer/Consignee. ( v ) Seller shall be required to ensure supply as per approved sample with modifications as communicated by Buyer. If there is delay from buyer side in approval of advance samples - the delivery period shall be re-fixed without LD for the period of delay in samples approval.

   Warranty / Guarantee:- The Warranty/Guarantee shall be applicable as per latest IRS conditions of contract as per Para-10 & Para-11 of the IRS Conditions of Contract (Attached with the Tender).

   Micro and Small Enterprises firms In order to avail themselves of benefits and preferential treatments, the MSEs must be registered with any of the following: - (a) UDYAM (UDYAM Registration Certificate). (b) Udyog Aadhar Memorandum (Note :- Terminal date for consideration of this certificate was till 30.06.2022 or as extended by Ministry of Micro, Small & Medium Enterprises from time to time. Thus this certificate (Udyog Aadhar Memorandum) can only be considered if the above terminal date is further extended beyond 30.06.2022). MSEs registered with above agency/agencies must attach (in the template - "Attach Documents" on "Techno-Commercial Bid Details form", as scanned copy in PDF format) their current & valid registration certificate along with their offer. Other Conditions shall be as per Para 4 of Section-I of NWR tender condition document.

   "Class-I local supplier"/ "Class II local supplier" shall be required to provide a certificate from the statutory auditor or cost auditor of the company (in the case of companies) or from a practicing Cost accountant or practicing chartered accountant (in respect of suppliers other than companies) giving the percentage of local content. The certificate should have valid UDIN mentioned in the certificate.

    Purchaser reserves the right to verify at any time, the details submitted by the Bidder by actual site visit. If the information furnished in the bid is found to be incorrect during verification, the bid shall be considered invalid and their EMD shall be forfeited, and necessary action will be initiated including suspending business with North Western Railway. It is the bidder's responsibility to ensure that the information in the offer remains unchanged for the validity of the offer and must be verifiable during this period.
