Special Eligibility Criteria

   (1) I/We engage to supply the Western Railway with the articles specified above upon the terms of the Indian Railway Standard Conditions of Contract (latest revision) and upon the terms of the Revised Special Conditions and Instructions for the Guidance of the Contractors issued by the Western Railway (Instructions to tenderers & General Condition of Contract revised on September 2021 version 2021/1) available at IREPS portal at link www.ireps.gov.in/ireps/upload/repository/railway/483/148/public/TenderConditionsVersion2021- 1.pdf. (2)The bidders should submit details of structural calculations along with thickness of plate/sheet for girders, end carriage, crab and other load bearing structural members along with offer and got it duly approved by reputed organizations such as NPL, IIT, NIT or govt. approved engineering colleges or a Chartered Engineer along with breakup of weights of major assemblies/components. If not approved by reputed organizations, bid shall be considered to be rejected. (3) Tenderer who are OEM, shall undertake to supply spare parts for a period of expected life of machine. Other tenderers shall submit undertaking from OEM for supply of spare parts for a period of expected life of the machine, if undertaking is not submitted, the offer will be considered to be rejected. (4) Bidders should furnish information on Schedule-II & Schedule-III of attached specification . In case of any discrepancy in the information submitted against Schedule-II and III and that furnished in clause wise comments, the information submitted against schedule-II & III shall over-ride that against the clauses. In case of not furnishing of said information, offer will considered to be rejected. (5) Bidder shall photocopy the specification (annexure-B & C) and furnish comments/ details against each clause or link to deviation statement. Any fraudulent change(s) made in COMFOW specifications (while making photocopy) will lead to summarily rejection of offer. (6) The warranty period in the offer shall survive for a period of 24 months from the date of commissioning of machine. If the offer is found with less than 24 months or ambiguous/uncertain on warranty conditions, the tender is liable to be rejected. (7) Tenderer have to submit parawise compliance of specifications attached, otherwise offer may be consider to be rejected.

   Traders are not exempted from submission of EMD. So bidders to carefully examine regarding their status for claiming exemption from submission of EMD.

   (1) Risk Purchase clauses shall not be applicable.(2) VALIDITY : Tenderers to quote minimum 90 days validity of offers.(3) LD for late supply : Recoveries of liquidated damages shall be levied @ 1/2 % (Half percent) of the price of the store per week or part of week during which delivery is accepted. The upper limit for recovery of LD in supply contract shall be 10 % of the value of contract irrespective of delays, unless otherwise specifically provided in the contract.
