The tenderer must have minimum average annual contractual turnoverof V/N or 'V' whichever is less; where V= Advertised value of the tenderin crores of Rupees N= Number of years prescribed for completion ofwork for which bids have been invited. The average annual contractualturnover shall be calculated as an average of "total contractualpayments" in the previous three financial years, as per the auditedbalance sheet. However, in case balance sheet of the previous year isyet to be prepared/audited, the audited balance sheet of the fourthprevious year shall be considered for calculating average annualcontractual turnover. The tenderer must have successfully completed or substantiallycompleted any one of the following categories of work(s) during last 07(seven) years, ending last day of month previous to the one in whichtender is invited: (i) Three similar works each costing not less than theamount equal to 30% of advertised value of the tender, or (ii) Two similarworks each costing not less than the amount equal to 40% of advertisedvalue of the tender, or (iii) One similar work costing not less than theamount equal to 60% of advertised value of the tender. Work experiencecertificate from private individual shall not be considered. However, inaddition to work experience certificates issued by any Govt.Organization, work experience certificate issued by Public listedcompany having average annual turnover of Rs 500 crore and above inlast 3 financial years excluding the current financial year, listed onNational Stock Exchange or Bombay Stock Exchange,incorporated/registered at least 5 years prior to the date of closing oftender, shall also be considered provided the work experience certificatehas been issued by a person authorized by the Public listed company toissue such certificates. In case tenderer submits work experiencecertificate issued by public listed company, the tenderer shall also submitalong with work experience certificate, the relevant copy of work order,bill of quantities, bill wise details of payment received duly certified byChartered Accountant, TDS certificates for all payments received andcopy of final/last bill paid by company in support of above workexperience certificate.

•Contractor is to abide by the provisions of various labour lawsin terms of clause54, 55, 55-A and 55-B of the Standard GeneralConditions of Contract. In order to ensure the same, anapplication has been developed and hosted on website'www.shramikkalyan. indianrailways.gov.in'. Contractor shallregister his firm/company etc. and upload requisite details oflabour and their payment in this portal. These details shall beavailable in public domain. The registration/updation in Portalshall be done as under:(a) Contractor shall apply for onetimeregistration of his company/firm etc. in the Shramikkalyan portalwither qui site details subsequent to issue of Letter ofAcceptance. Engineer shall approve the contractor's registrationin the portal within 7 days of receipt of such request. (b)Contractor once approved by any Engineer, can createpassword with login ID(PAN No.) for subsequent use of portal forall Letter of Acceptances (LoAs) issued in his favour. (c)Thecontractor once registered on the portal, shall provide details ofhis Letter of Acceptances (LoAs)/ Contract Agreements onshramikkalyan portal within 15 days of issue of any LoA forapproval of concerned Engineer. Engineer shall update (ifrequired) and approve the details of LoA filled by contractorwithin 7 days of receipt of such request. (d)After approval of LoAby Engineer, contractor shall fill the salient details of contractlabours engaged in the contract and ensure updating of eachwage payment to them on shramikkalyan portal on monthlybasis. (e)It shall be mandatory upon the contractor to ensurecorrect and prompt uploading of all salient details of engagedcontractual labour & payments made thereof after each wageperiod. (ii) While processing payment of any 'On Account Bill' or'Final Bill' or release of 'Advances' or 'Performance Guarantee /Security Deposit', contractor shall submit a certificate to theEngineer or Engineer's representatives that "I have uploaded thecorrect details of contract labours engaged in connection withthis contract and payments made to them during the wageperiod in Railway's Shramik kalyan portal at'www.shramikkalyan.indianrailways.gov.in' till Month, Year. Fordetails, Please refer Indian Railways Standard GeneralConditions of Contract GCC April 2022 with latest correctionslips/amendments if any.

The contractor shall submit a Performance Guarantee (PG)amounting to 5% of the original contract value along withadditional Performance Guarantee, if applicable, in accordancewith Clause 16(4)(h) of Indian Railways Standard GCC April 2022with latest correction slips (as amended from time to time)within 21 days from the date of issue of Letter of Acceptance,valid up to stipulated date of completion plus 60 days so thatcontract agreement can be executed.

The Contractor shall be responsible for deposition of applicableGST to the concerned authority.

Rate quoted by Tenderer shall be inclusive of all taxes andcharges levied by Central Government, State Government,Municipal Corporations, Local or any other bodies including GSTand Transportation Charges.

For all the tenders having advertised cost of Rs 10 lakh orabove, the contractors hall have the option to take paymentfrom Railways through a letter of credit (LC)arrangement asperRB'sletterNo.2018/CEI/CT/9, dated:04.06.2018copy of whichis enclosed in Document Section.

Rights Of The Railway To Deal With Tender: The authority for theacceptance of the tender will rest with the Railway. It shall notbe obligatory on the said authority to accept the lowest tenderor any other tender and no tenderer(s) shall demand anyexplanation for the cause of rejection of his/their tender nor theRailway to assign reasons for declining to consider or reject anyparticular tender or tenders

Tenderer shall not be entitled to withdraw or modify the offer. Ifany Tenderer shows resilience or modifies his/her/their tenderwithin the validity period of offer, the entire earnest moneydeposited by him/them will be forfeited by the Rly. Cancelinghis/her/their tender.

All other terms and conditions of this contract not mentioned inscope of work or special conditions applicable as Per GCCApril2022 with corrigendum.

Modified Provision for GCC 2022 regarding EMD/Bid securitymoney-The tenderer shall be required to submit the Bid Securitywith the tender for the due performance with the stipulation tokeep the offer open till such date as specified in the tender,under the conditions of tender . Tenderer(s) shall keep themselves updated about anymodification in the tender notice and tender document, issuedby Railways through newspapers, website or e-mail or any othermeans and shall act accordingly. It is the responsibility of thetenderer(s) to check if any corrections or modifications arepublished subsequently on the Website and the same shall betaken into account while submitting the tender. The offer of thetenderer(s) is liable to be rejected if they do not enclose all thecorrections/ Corrigendum along with the downloaded tenderdocuments.

Tenderer(s) shall maintain the integrity of downloaded tenderdocument and shall not make any change/ addition/ deletion/tampering, whatsoever, in the downloaded documents. Thetenderer(s) offer shall be rejected, and full earnest money shallbe forfeited, in case it is detected after submission of offer, thatthey have made any modification in the downloaded document.In case such modification is noticed even after award ofcontract, Railways is liable to terminate the contract oncontractor's default. In addition, Railways reserves the right totake other action against the contractor as deemed fit, whichmay include banning of business dealings with the firm and thefirm is also liable to be prosecuted as per the Law. After awardof work, agreement will be prepared based on the master copyof tender document available in the Railway's office. In case,any discrepancy is noted in the tender document submitted bythe tenderer(s), the Master document kept with Railways shallprevail and the decision of Railways thereon shall be final andbinding on Tenderer/Contractor

Care in Submission of Tenders

Before submitting a tender, the tenderer will be deemed tohave satisfied himself by actual inspection of the site andlocality of the works, that all conditions liable to be encounteredduring the execution of the works are taken into account andthat the rates he enters in the tender forms are adequate andall-inclusive to accord with the provisions in Clause-37 of theStandard General Conditions of Contract for the completion ofworks to the entire satisfaction

Tenderers will examine the various provisions of The CentralGoods and Services Tax Act, 2017(CGST)/ Integrated Goods andServices Tax Act,2017(IGST)/ Union Territory Goods andServices Tax Act, 2017(UTGST)/respective state's State 10.1.1 Goodsand Services Tax Act (SGST) also, as notified by Central/ StateGovt. & as amended from time to time and applicable taxesbefore bidding. Tenderers will ensure that full benefit of InputTax Credit (ITC) likely to be availed by them is duly consideredwhile quoting rates.

The successful tenderer who is liable to be registered underCGST/IGST/UTGST/SGST Act shall submit GSTIN along with otherdetails required under CGST/IGST/UTGST/SGST Act to 10.1.2 railwayimmediately after the award of contract, without which nopayment shall be released to the Contractor. The Contractorshall be responsible for deposition of applicable GST to theconcerned authority.

When work is tendered for by a firm or company, the 10.1.3 tendershall be signed by the individual legally authorized to enter intocommitments on their behalf.

The Railway will not be bound by any power of attorney grantedby the tenderer or by changes in the composition of the firmmade subsequent to the execution of the contract. It 10.1.4 may,however, recognize such power of attorney and changes afterobtaining proper legal advice, the cost of which will bechargeable to the Contractor.

The Railway reserves the right of not to invite tenders for any ofRailway work or works or to invite open or limited tenders andwhen tenders are called to accept a tender in whole or in part orreject any tender or all tenders without assigning reasons forany such action. In case if tender is accepted in part by Railwayadministration, Letter of Acceptance shall be issued as counteroffer to the Tenderer, which shall be subject to acceptance bythe Tenderer.

The quantities shown in the Schedule are given as a guide andare approximate only and are subject to variation according tothe needs of the Railway. The Railway does not guarantee workunder each item of the Schedule.

If the tenderer(s) deliberately gives / give wrong information inhis / their tender or creates / create circumstances for theacceptance of his / their tender, the Railway reserves the rightto reject such tender at any stage.

Before participating in a tender, the tenderer will be deemed tohave satisfied himself by actual inspection of the site andlocality of the works, that all conditions liable to be encounteredduring the execution of the works are taken into account andthat the rates he quote are adequate and all inclusive to accordwith the provisions in Clause-37 of the General Conditions ofContract for the completion of works to the entire satisfaction ofthe Engineer. The tenderer is advised to visit the site of work toacquaint themselves with the site conditions and expectedquantum of works in their own interest. The RailwayAdministration before the due date of opening day of its own orin response to any clarification requested or suggested by anyperson at any time modify the documents on its sole discretion.The Railway reserves the right either to cancel or reject any orall the Tenders without assigning any reason thereof.
