SUBMISSION OF TENDER

The completed Tender document shall be submitted through e tendering only.

Supporting Tender copy shall be accompanied by EMD in the submitted in the form of

D.D./P.O. in favour of Municipal Commissioner, Amdavad of any Banks mentioned in

AMC circular and payable at Amdavad; The tenders not submitted in line with the

tender clauses and without Tender fee and EMD in the form specified, will be out

rightly rejected. The Technical bid of only those bidders will be evaluated who have

remitted tender fees and submitted EMD.

OPENING OF TENDER

The bid will be opened as mentioned in ‘General Detail of Work’ Section above, if there

is any change, same will be conveyed to tenderers. Intending bidders or their

authorized representative who wish to participate in tender opening can remain present

on the due date and time. Price Bids / Financial bids of only those bidders will be

opened, who are successful in the qualification Criteria and the Technical Evaluation.

GENERAL INSTRUCTIONS

11. As per the Bombay Stamp Rules Act 1958, Appendix 1, Article 5, the successful bidder

shall enter in to an Agreement with the Corporation on Rs. 300 Stamp Paper.

12. Bidders shall submit necessary registration certificate like GST number registration

copy & any other if required for execution of such work as per government rules along

with tender document.

13. If required tenderer may visit and at our Municipal Central Workshop for general idea

of working and requirements of Drivers with prior appointment.

Municipal Commissioner, Amdavad reserves the right to accept or reject any or all

tenders without assigning any reason thereof. This Tender notice shall form a part of

contract document. The tenderers are advised to read carefully the “Instructions to

INSTRUCTIONS TO TENDERERS

1.0 Amdavad Municipal Corporation invites tender for Selection of agency to Provide

Driver manpower on yearly rate contract basis for two years as per tender scope of work

terms‐ conditions and requirements of AMC.

2.0 The requirement of Selection of agency to Provide Driver manpower on yearly rate

contract basis for two years as per tender scope of work terms‐ conditions and

requirements of AMC and their detailed technical specifications, scope of work etc. are

set out in Appendix 1. Interested and qualified parties, based on qualification criteria

set out in Appendix 2, (Online)are requested to submit information about bidder and

a financial Quotation / price bid in a manner prescribed in Appendix 3 & 4 (Online).

Tenderer has to submit various other details as per format / details asked for in the

3.0 Each Tenderer shall submit only one (1) Bid in response to this Tender Document (TD).

Any Tenderer who submits more than one Bid will be disqualified.

4.0 Not More than one tender shall be submitted by a contractor or by a firm of contractors.

No two or more concerns in which an individual is interested as a proprietor and / or a

partner & / or director shall submit tender for the execution of the same work / tender.

If they do so all such tender shall be liable to be rejected.

5.0 At any time prior 72 hours to the last date and time of submission of Bids AMC may,

for any reason, whether at its own initiative or in response to clarifications requested

by any Tenderer, modify the TD by the issuance of Addenda. All interested tenderer

shall have to check the AMC website. The Bidder shall not transfer the TD to another

interested party. Any reply/changes (if required) , will also be declared on above

6.0 Perpetrations of tender document: Tenderer shall carefully examine the tender

documents and fully inform themselves as to all the conditions and matters, which may

in any way effect the work or the cost Should a Tenderer find discrepancies, error or

omission from the specifications or other documents or should he be in doubt as to their

meaning, he should address query to the concerned authority. Any resulting

interpretation of the tender documents will be issued to all Tenderers as an addenda

corrigendum. Verbal clarification and/or information given by the Tenderer shall not

be binding on the Corporation.

6.1 Earnest Money Deposit (EMD)

Each Bid shall be accompanied by EMD of Rs. 36,90,000/‐ (Rupees Thirty Six Lakh

Ninety Thousand only).

6.2 Each Bid shall be accompanied by EMD as mentioned in tender documents.

6.3 The EMD shall be in the form of a crossed demand draft / Pay Order / Bank Guarantee

in favour of Municipal Commissioner, Amdavad of any Bank mentioned in AMC

circular and payable at Amdavad

6.4 The EMD shall be forfeited in the following cases:

(a) If the Tenderer withdraws itʹs Bid during the interval between the Bid Due Date and

expiration of the Bid Validity Period.

(b) If the successful Tenderer fails to provide the Performance Security within the

stipulated time or any extension thereof provided by AMC;

7.0 Performance Security

7.1 The successful Tenderer would be required to submit Performance Security amounting

5% of the 1 year order amount in the form of crossed demand draft/ Pay Order in favour

of The Municipal Commissioner, Amdavad on any Bank mentioned in AMC circular

and payable at Amdavad (As per AMC rules). This shall be renewed timely and till the

contract continue. This will be returned only after successful completion of contract

7.2 Irrevocable Bank Guarantee issued by a Bank mentioned in AMC circular and payable

at Amdavad (As per AMC rules) shall also be acceptable.

7.3 Modification of Documents : Modification of specifications and extension of the closing

date of the tender. If required will be made by an addendum. Notification of addendum

will be published on website only. These shall be signed and shall form a part of tender.

The Tenderer shall not add to or amend the text of any of the documents except in so

far as may be necessary.

8.0 Addenda: Addenda form part of the contract documents and full consideration shall be

given to all addenda in the preparation of tenders. Tenders shall verify the number of

addenda issued, if, any and acknowledge the receipt of all Addenda in the Tender.

Failure to do so may cause the Tender to be rejected.

9.0 The Bid shall remain valid for a period not less than 120 days from the date of opening

of tender i.e. technical bid (bid validity period). AMC reserves the right to reject any

Bid, which does not meet this requirement. In exceptional circumstances, prior to expiry

of the original Application Validity Period, AMC may request Applicants to extend the

Application Validity Period for a specified additional period. Applicants not extending

the Application Validity Period when so requested would automatically be

14.0 Performance Security

15.0 The successful Tenderer would be required to submit contract Performance Security

amounting to 5% of the 1 year contract service Order value for which they are awarded

work in the form a crossed demand draft/ Pay Order in favour of The Municipal

Commissioner, Amdavad on any Bank mentioned in AMC circular payable at

Amdavad which will be returned back on successful completion of one year article /

structure warranty period.

16.0 Irrevocable Bank Guarantee issued by a Bank mentioned in AMC circular located in

Amdavad, India (as per AMC rules) shall also be acceptable.

17.0 Formats and Signing of Bid

17.1 The Tenderer would provide all the information as per this TD. AMC would evaluate

only those Bids that are received in the required format and are complete in all respects.

Each Bid shall comprise the following:

(a) Details of the Tenderer in the format set out in Appendix 3‐ Online

(b) Qualification Criteria / Technical bid in the format set out in Appendix 2‐ Online

(c) Financial Quotation/ price bid for Selection of agency to Provide Driver manpower on

yearly rate contract basis as per tender scope of work terms‐ conditions and

requirements of AMC in the format set out in Appendix 4 in online formats only.

(d) Tenderer has to submit various other details and formats duly self attested and signed

as per Annexure 1 to

(f) The Bidder shall duly sign all the sheets of the Tender Document submitted in support

of their online tender.

(h) All bidders are requested to upload technical bid documents, however if they found

any difficulty in uploading, they can submit the same in physical with tender technical

bid (EMD, Tender fee etc) supporting documents. However mandatory services /

documents must be uploaded in e tender.

18.0 The bidder shall seal the Tender fee, EMD and relevant Tender Document submitted in

support of their online tender in envelopes, which shall be clearly marked as Providing

Drivers on yearly rate contract basis as per tender scope of work terms‐ conditions and

requirements of AMC.

19.0 The Tender Document submitted in support of their online tender shall be initialled by

an authorized signatory of the Bidder or an Individual, as applicable.

20.0 Sealing and Marking of Bid for submission of Physical Tender supporting

if, in their opinion and at their sole discretion, they consider that it would be

24.0 Bid Due Date

25.0 Bids should be submitted online before 18.00 hours IST on 25th August 2026 in the

manner and form as detailed in this TD. Bid submitted by either Hard copy (not as per

format in TD), facsimile transmission or telex or email or in person will not be accepted

and such tender/s will be rejected.

26.0 AMC may, in exceptional circumstances, and at its sole discretion, extend the above Bid

Due Date by issuing an Addendum. It will be published on website only.

27.0 Opening of Bids and Clarifications

All information must be typed or hand written legibly in English language. All pages

of the pre‐qualification document must be initialled by the applicant. All corrections,

erasures or overwriting, therein, must be initialled by Applicant.

28.0 Technical bid will be opened on 29th August 2026 ‐ 11.00 hrs onwards AMC would

open the Bids possibly on Bid Opening Date as mentioned above in the ‘General

Description of Work’ for the purpose of evaluation, if there is any change, same will be

intimated to tenderer.

29.0 AMC reserves the right to reject any or all Bids not submitted on time and which does

not contain the information/documents as set out in tender .

30.0 To facilitate evaluation of Bids, AMC may, at its sole discretion, seek clarifications in

writing from any Tenderer regarding its Bid.

31.0 Evaluation

The details given by the applicants in the pre qualification documents will be evaluated

as per qualifying criteria, Amdavad Municipal Corporation reserves the right to restrict

the list of pre‐qualified applicant to any number deemed suitable by it. Amdavad

Municipal Corporation’s decision for pre‐ qualifying the applicants shall be final and

binding to all.

32.0 As part of the evaluation, the Bids shall be checked for responsiveness with the

requirements of the TD and only those Bids, which are found to be responsive, would

be further evaluated in accordance with the criteria, set out in this TD.

33.0 The Bid would be considered to be responsive if it meets the following conditions:

(a) It is received /deemed to be received by the Bid Due Date including any extension

(b) It is signed, sealed and marked as stipulated in tender.

(c) It contains all the information and documents as requested in the TD.

(d) It contains information in formats specified in this TD.

(e) It mentions the validity period as set out in tender.

(f) It provides information in reasonable detail. (“Reasonable Detail” means that, but for

minor deviations, the information can be reviewed and evaluated by AMC without

communication with the Tenderer). AMC reserves the right to determine whether the

information has been provided in reasonable detail.

(g) There are no inconsistencies between the Bid and the supporting documents. A Bid that

is substantially responsive is one that conforms to the preceding requirements without

material deviation or reservation. A material deviation or reservation is one (i.) which

affects in any substantial way, the scope, quality, or performance of the project, or (ii.)

which would affect unfairly the competitive position of other Tenderers presenting

substantially responsive Bids.

34.0 AMC reserves the right to reject any Bid, if:

(a) If the tender is incomplete; or

(b) At any time, a material misrepresentation is made or discovered; or

(c) The Tenderer does not respond promptly and diligently to requests for supplemental

information required for the evaluation of the Bid.

35.0 In case the Bid is found to be responsive, the Bid would be evaluated in accordance with

the Qualification Criteria as set out in Appendix

36.0 In case the Bid is found to be inadequate, AMC may request the Tenderer for

modifications to the Bid submitted. As part of the evaluation of the Bid, AMC may also

request the Tenderer to submit clarifications.

37.0 The Financial Quotations/ Bid of only those Tenderers, who meet the Qualification

Criteria, would be opened.

38.0 The Tenderer offering the lowest quotation for the Selection of agency to Provide Driver

manpower on yearly rate contract basis for two years as per tender scope of work terms‐

conditions and requirements of AMC would be declared as the Preferred Tenderer for

39.0 Tenderer has to submit the technical presentation in support of their technical bid with

all the credentials & proposal to enable the more technical evaluation of the available

proposal, if required AMC can ask the tenderer to show the presentation so that based

on available information AMC can take the decision for technical evaluation. This will

be binding to all the bidder.

40.0 Even though agency is qualifying all the above criteria but found to be poor in

performance, in the opinion of AMC his price bid will not be opened. It is the discretion

of Municipal Commissioner or the Tender Scrutiny Committee to qualify / disqualify

the agency or to open / not to open the price bid of agency.

41.0 AMC may either choose to accept the Quotation of the Preferred Tenderer or invite him

for negotiations.

42.0 In case there are two or more Tenderers quoting the same price, AMC may in such case

call all such Tenderers for negotiations and select the Preferred Tenderer on the

outcome of the negotiations. The selection in such cases shall be at the sole discretion of

43.0 In the event of acceptance of the Preferred Tenderer with or without negotiations, AMC

shall declare the Preferred Tenderer as the Successful Tenderer. AMC will notify the

Successful Tenderer through a Letter of Award (LoA) that its Bid has been accepted.

44.0 This work will be considered as rate contract for Two Year for Selection of agency to

Provide Driver manpower on yearly rate contract basis for two years as per tender

scope of work terms‐ conditions and requirements of AMC as per TD. Rate sanctioned

will be fixed for entire two year RC (Rate Contract) period. During this RC period if

AMC needs more Providing Drivers successful bidder has to provide drivers at the

same approved rates & terms, if AMC ask to do so. No price escalation will be given

during RC period. Only change in GST, duties, govt. levies, Govt. rate will be accepted

by AMC & consider for payment. RC period may be extended for further period of One

year by mutual confirmation. Decision of The Municipal Commissioner Shri, AMC will

be final & binding to all. AMC can order for further / extra Numbers, if required during

entire RC period.

45.0 Notwithstanding anything contained in this TD, Municipal Commissioner, AMC

reserves the right to accept or reject any quotation, or to annul the bidding process or

reject all quotations, at any time without any liability or any obligation for such rejection

or annulment, without assigning any reasons thereof.

46.0 Notwithstanding above, the MC‐ AMC., at his discretion, may also split the contract, if

require for timely execution of the work among two of more qualified bidders. MC‐

AMCʹs decision in this regard shall be final. MC‐ AMC also reserves right to award the

Contract to any of the eligible and qualified suitable Bidder. Splitting of work will be

carried out based on bid capacity, manufacturing capacity, past work experience of the

bidder, time frame for execution of work etc and this shall be binding to all bidders.

Parallel Rate contract, if required, can also be awarded on above basis and will be

binding to all.

47.0 However, if the AMC decided to put an end to the business relations on breach of any

conditions of the contract no such notice shall be necessary and on event of AMC

decided to put an end to the business relations on breach of any conditions of the

the business, and the R.C. shall stand terminated with immediate effect.

The R.C. can also be terminated by the MC ‐ AMC in the following circumstances:

1) If the firm is debarred or disqualified or ceases to exist or convicted of any offence.

2) If the quality of the service to be provided is found not up to the AMC requirements

(as applicable) and multiple times faults are found for poor service.

3) If contract position of the firm is not satisfactory.

48.0 Whenever under this contract any sum of money is recoverable from the RC Holder

and payable to the MC ‐ AMC, Amdavad, or an officer empowered by him shall be

entitled to recover such sum by appropriating in part of whole the Security Deposit paid

by the Contractor, if a security being insufficient or if no security has been taken from

contractor, then the balance of the total sum recoverable as the case may be deducted

from the sum due to the contractor under this or any other contract.

49.0 If any dispute arises about the contract or any terms of contract, Municipal

Commissioner, AMC shall be the sole arbitration and his decision would be final and

binding to all the parties.

50.0 Services shall be inspected / verified by authorized representative/s of AMC with the

scope of work of AMC (if required) & during the entire contract period same quality

services shall be provided.

51.0 The price escalation or variation clause will not be accepted. Tenderer has to quote the

total price, net including of all taxes & duties etc. and for evaluation and finalization

purpose, the total price will be taken in to consideration. However any change in the

GST, Govt. statutory levies and taxes , Govt. Rate etc. will be considered for payment at

actual (for service providing work) for which contractor will have to submit necessary

documentary proofs as required by department. No other change will be accepted.

52.0 TAXES AND DUTIES: ‐

Prices quoted must be inclusive of all & all taxes.

GST (Goods & Service Tax) has come in existence from 1st July, 2017. Contractor/

successful bidder is bound to pay any amount of GST prescribed by the Govt. Of India

as per the terms of contract agreed upon during the course of execution of this contract.

During the course of execution of contract, if there is any change in rate of GST (Goods

and Service tax) by the government, the same shall be reimbursed/recovered separately

by AMC, subject to the submission of original receipt /proof for the amount actually

remitted by the successful Tenderer/ Contractor to the competent authority along with

the certificate from Chartered Accountant of contractor/successful bidder certifying that

the amount of GST paid to the government and the same shall be intimated/ submitted/

claimed within 30 (thirty) days from the date of payment.

Remittance of GST within stipulated period shall be the sole responsibility of the

successful bidder/contractor, failing which, AMC may recover the amount due, from

any payable dues with AMC and decision of Municipal Commissioner shall be final

and binding on the contractor/successful bidder in this regards.

Further, the non‐payment of GST to the government may lead to the termination of

contract and forfeiture of Security deposit/performance guarantee amount.

2% TDS will be also be deducted as GST TDS. (If Applicable)

If imposition of any new taxes/ duties/levies/cess or any other incidentals etc or any

change in the existing taxes/ duties/levies/cess or any other incidentals etc (Including

GST) and imposed during the course of the contract, the same shall be considered at

actual for payment purpose. Necessary documents shall be submitted by tenderer as

required by AMC.

53.0 The requirement & scope of work for Providing Drivers on yearly rate contract basis is

given in Appendix 1, however bidder are advice to personally visit the AMC, Central

Workshop for better understanding of requirement of service.

54.0 EXTENSION FOR DELAY.

If the supply is delayed by:

a) Force Majeure.

b) Abnormally bad weather, or

c) Serious loss or damage by fire

d) Civil commotion or strike or lock out of their principal workshop.

Any other cause which is beyond the contractorʹs control then upon the happening of

any such event causing delay, the contractor shall immediately inform in writing to the

Dy. M.C. (Central Workshop) but at the same time his best endeavours to make good

the delay. The Dy. M.C. (Central Workshop) in such event can take the final decision

regarding the late delivery penalty for such cause.

55.0 The contractor must follow all the rules and regulations pertaining to the work, labour

56.0 PAYMENTS DUE FROM CONTRACTOR.

The Municipal Commissioner shall be entitled to recover costs, damages, or expenses

for which under the contract, the contractor is liable to the Amdavad Municipal

Corporation from any money due or becoming due to the contractor under the contract

or Municipal Commissioner will have the liberty to recover the amount from the

57.0 Payment Terms: ‐

As mentioned in Appendix‐1

58.0 PQ criteria are mentioned in Appendix‐2.

59.0 The MC ‐ AMC shall, in addition to his powers under other clauses to terminate the

contract, have powers to terminate his liability there under of the time by giving one

month’s (or such shorter period as may be mutually agreed) notice in writing to R.C.

holder of his desire to do so and upon expiry of the notice, the contract shall be

terminated without prejudice to the right accrued to the date of the termination.

60.0 This tender is for finalising rate contract for selection of agency to Provide Drivers. If

AMC wish to place order to technically qualified L2 or other agency at same rate &

terms based on L1 tenderer, same will be binding to all tenderer. Decision of Nos. (for

various category drivers i.e. HMV / LMV / Tractor /Rickshaw / E Vehicle) etc. shall be

at sole discretion of AMC. It shall be binding to all bidders.

61.0 If any tenderer does not have Labour Licence at the time of tender submission then they

have to get it before actual start of work, if work is awarded to them.

62.0 The Municipal Commissioner, Amdavad Municipal Corporation reserves the right to

reject all or any of the tender including the lowest tender or part of the tender which in

the judgment of the Municipal Commissioner, Amdavad Municipal Corporation does

not appear to be in the best interest of Amdavad Municipal Corporation and the

contractor shall have no cause of action or claim against the Amdavad Municipal

Corporation, its officers, employees, successors, or assignees for rejection of his tender

63.0 Tenderer has to submit all the relevant information likes;

 Availability of local office point.

 Detailed client list to which such type of services are provided (manpower

 Details of Technical experience of tenderer (Manpower providing work)

 Performance certificates as per tender requirements.

64.0 Special Conditions

a) The bidder has to make the invoices in the name as suggested by purchaser.

b) On failure of L1 to show the presentation for technical approval of bid his

tender will be rejected. AMC can ask the Lowest &/or other qualified bidder/s

to submit the presentation for under standing the work execution method &

checking / verifying the same with tender scope of work and actual

requirement‐ working, before finalizing the bid. On failure of L1 for execution

of tender the L2 shall be invited for negotiation and further formalities (as

above) if required.

c) The tenderer must quote for complete job. The tenderer that does not include

the complete job as specified in schedule of tender (specification, etc.) will be

rejected. The successful bidder shall be responsible for any fault, shortfall in the

services proposed in the tender etc or any other requirement which is

mandatory for the completion of successful equipment manufacturing.

d) The successful tenderer will be fully responsible for the safety and security of

the vehicle when in their possession during the usages.

e) This is subject to the jurisdiction of the competent court of Amdavad only. In

case of any claim, dispute of difference arising in respect of a contract, the cause

action thereof shall be deemed to have arisen in Amdavad and all legal

proceedings in respect or any such claim, dispute or difference shall be

instituted in a competent court in jurisdiction of Amdavad city only.

for two years as per tender scope of work terms‐ conditions and requirements

1. The Successful Bidder is required to make payment to Different category Driver Staff

personnel deployed by him within the 5th day of every month. These payments to the

deployed‐personnel by the Successful Bidder shall be remitted into the Bank Accounts of the

concerned personnel. The Successful Bidder shall furnish latest by 18th of each calendar

month the documentary proof of having disbursed the payments into the bank accounts of

the deployed personnel by way of a copy of the “Bank Statement”. Non‐submission of such

a Bank Statement proving disbursal of payments into the bank accounts of the deployed

personnel shall lead to disallowing of further payments to the Bidder from AMC side until

such a Bank Statement is actually submitted. In case of persistent default in timely

submission of such a Bank Statement for each month, the contract to the Successful Bidder

shall be cancelled treating persistent delayed submission of such a Bank Statement as violation

of “Scope of Work” and, thus, a “Breach of Contract”. In this “persistent default” means non‐

submission of such a Bank Statement until 25th of the month in which it is due, and, such

default occurs for more than 2 months in any continuous period of 12 months. In other

words, in a continuous period of 12 calendar months the persistent default is said to have

occurred the moment it occurs for the 3rd time during such a 12‐month period.

1.1 The Successful Bidder shall offer and actually make available the manpower of requisite

qualifications adequate in numbers for various requirements of AMC as per the table below.

of one year at the time of expiry of two year contract period at the mutual consent.

2 Service Requirement

- The Bidder shall deploy 250 Driver Staff (As per categories list) personnel on regular

full time basis to discharge the specified activities. The personnel so deployed shall be

under the direct control and supervision of the Bidder. All responsibility, safety,

security of deployed staff shall be rest on successful bidder. He will be solely

responsible all act of his deployed personnel. All financial & / or other misconduct etc.

shall be recovered from successful bidders bill / security deposit if any violation found

during the contract period. C.W. AMC will not have anything to do with the personnel

deployed by the Bidder.

- The Bidder shall not engage any person who is below 21 years of age or above 45 years.

- The personnel deployed by the successful bidder shall maintain high standards of

discipline & personal character.

- The bidder should provide manpower with regional language Gujarat Proficiency and

should experience in automobile workshop, motor vehicle / Heavy motor / tractor /

rickshaw / e vehicle repair maintenance experience etc.

- The agency shall be liable for any kind of violations of applicable laws, rules and

regulations by the deployed manpower.

- The Agency should provide skilled, sincere and dedicated experienced Driver Staff for

each cadre / stream with clear antecedents and ensure that the personnel possess

prescribed qualification and experience.

- It is the sole responsibility of the agency to provide adequately experienced drivers for

repairing of AMC vehicles.

‐ The age of drivers should not be more than 45 Years.

- The agency shall ensure the personnel have passed a medical certifications by registered

medical practitioner for engaging them for vehicle repairing work.

- The agency shall submit to the AMC the personal details such as name, address

(temporary & permanent) telephone number, Aadhar number, e‐mail, police

verification of the deployed candidate along with Xerox copies of Educational

qualifications.

- Notwithstanding anything contained in this tender, the agency shall be liable for any

negligence or willful default of the driver manpower provided by the agency in

connection with the contract.

- If any Driver is involved in accident or incident, the agency shall be solely responsible

to produce the Driver and relevant documents to the Court/Police Station/any

authorities. In accident cases agency is solely responsible for legal procedures.

- The agency shall ensure that the Driver shall not consume alcohol or any prohibited,

drugs / items etc. He shall not smoke while on duty. In the event Driver deployed are

found working by consuming alcohol or indulging in undesirable activities or smoking

while on duty they will be liable to be disengagement and in their places new

manpower shall be deployed. In such case action will also be taken against agency.

- The agency shall replace any Driver falling sick, injured, proceeding on leave or

removal at no additional cost.

- The successful Bidder/Agency shall be responsible for assigning duties to personnel

deployed, and it shall comply with all the statutory requirements such as payment of

wages, ESI, Provident Fund, Bonus, Gratuity, Group Link Insurance scheme etc., as per

relevant laws of the land and other compensation payable under the Workmen’s

Compensation Act Labour law or any other benefits to the personnel deployed by the

Bidder. AMC shall not be responsible for non payment of any of the amounts to the

sand Driver personnel on account of Statutory Acts applicable. However, any liability

that the AMC bears on account of failure to comply with any of these provisions by the

successful Bidder, the same will be recovered from the successful Bidder. The successful

Bidder shall disburse the monthly wages to its personnel deployed in the presence of

the officer designated by the AMC.

- The successful Bidder shall comply with all the statutory requirements as may be

applicable now and as amended from time to time which includes compliance with the

Employees State Insurance Act 1948, employees Provident Fund Act. 1952 payment of

Bonus Act, Payment of Gratuity Act, Payment of Minimum Wage Act and any other

statutes/enactments as may applicable from time to time. Any variation in the minimum

wages including any revision in the Variable Dearness Allowance payable from time to

time as announced by the Government of Gujarat shall be absorbed in the quoted rates

by the Bidder. The Bidder shall maintain necessary Register/Records as required under

the aforesaid statutes and produce the same as and when required to do so by

AMC/Statutory Authorities.

- The successful Bidder/Agency shall comply with all applicable laws, ordinances, rules

and regulations in respect of this contract and the employment of the workers by the

Bidder and the Bidder shall pay at its own cost all the charges in connection therewith.

- The successful Bidder/Agency shall take necessary Insurance cover at his own cost for

any accidents and towards any other amount that would become payable by the Bidder

under the workmen’s Compensation Act or any other statute that would be applicable.

- The successful Bidder/Agency shall ensure that its personnel are in uniform with

badges while on work. The Bidder/Agency shall issue photo ID cards to all its personnel

with relevant details within 15 days from the date of deployment. Attendance register

of Driver personnel deployed for the works shall be maintained by the Bidder/Agency

separately. If any person engaged by the Bidder/Agency is found unsuitable or

undesirable by AMC, he/she should be replaced immediately.

- The Successful Bidder shall issue Photo ID cards to all its personnel with the Bidder’s

Logo & Name and Designation of the employee deployed within a period of one month.

- The staff of Driver Staff Bidder shall be liable for security search during the course of

work and at the time of leaving the premises.

- The Bidder shall indemnify AMC against any losses, damages or claims to the property

of the AMC or third party arising out of negligence, carelessness, misconduct of any of

the personnel of the Bidder deployed in the premises of AMC.

- In the event of any money becoming due to AMC from the Bidder during the currency

of this contract either due to shortfall of services or due to loss or damages caused or

for any other reason AMC shall be entitled to recover such amounts from the Security

deposit lodged with the AMC and/or from payments due to the Bidder/Agency.

- The driver personnel shall normally carry out the work during the time specified by

AMC. On the working days of the AMC. When need arises the Bidder should work on

holidays/after office hours.

- The present working hours of the AMC are in shift duty.

- The AMC shall not be responsible for providing food and / or transport to the staff of

- AMC will not be responsible for any loss to the property or to persons of the Bidder in

normal course as well as in the event of fire, catastrophe or civil commotion etc., if so

- The Bidder/Agency under no circumstances, whatsoever, shall slow down/stop the

designated operations as mentioned in the conditions aforesaid.

- AMC shall have a right to vary the number of Driver personnel given in tender.

- AMC may ask for additional personnel to be provided by a Man Power supplier

- The successful Bidder/Agency has to pay to the employed personnel, the minimum

wages as prescribed by the Government of Gujarat vide published in Gazette of the

Schedule or in accordance with any subsequent amendments issued by Government

from time to time during the period of contract.

- The Successful Bidder/Agency is required to make payment to all Driver personnel

deployed by him within the 5th day of every month. These payments to the deployed‐

personnel by the Successful Bidder shall be into the Bank Accounts of the concerned

personnel. The Successful Bidder shall furnish latest by 18th of each calendar month the

documentary proof of having disbursed the payments into the bank accounts of the

- In case “Breach of Contract” or violation of terms & conditions or non‐fulfilment of

“Scope of Work” by a Successful Bidder subsequent to award of contract leads to

cancellation of the contact as per prescribed terms & conditions of this Bid and/or

agreement there under.

- Official record must not be handed over to any unauthorized person / institute without

permission from higher authority of AMC.

3 COST OF BIDDING

AMC will in no case, be responsible or liable for all the costs and expenses incidental to

preparation and submission of the proposals, discussion and conferences, if any, including

pre‐award discussions with the successful bidder and other presentations including any

demonstrations etc. The bidders shall bear all costs associated with the preparation and

submission of the bid.

4 Amenities to the Personnel:‐

The successful Bidder/Agency should provide all amenities to his personnel such as Dress

/ Identity card / badges,(as / if required) etc., at his cost. The successful Bidder/Agency

should also take care of all safety and risk management of the personnel deployed during

the period of contract including their insurance coverage keeping in mind the service

requirement of this tender.

5 Period of contract:‐

The period of contract will be 24 months (2‐year) from the date of commencement of work.

If required, the contract is extendable for a further period one year at the time of expiry of

two‐year contract period at the discretion of AMC.

6 INFORMATION REQUIRED WITH THE PROPOSAL:

a. The bids must clearly indicate the name of the Bidder who is participating in the bid

for providing the services of the required personnel.

b. The bidder in order to provide additional information and data in the Bid as deemed

necessary by the bidder may use standard Catalogue pages and other documents.

c. As regards the provision of the bidding documents other than those listed in the Bid

document, in case the “Proposed information contradicts the Specification

requirements”, specifications requirements shall govern, unless otherwise brought

clearly in the technical/commercial deviation schedule in the bid.

7 Oral statements made by the bidder at any time or any other matter shall not be considered.

8 No Deviation what so ever, in the following conditions of the bidding documents is

i. Validity of offer.

iii. Performance Guarantee.

iv. Payment terms

v. Liquidated damages, Penalty for delay

Bidders are advised that while making bid proposals and quoting Financials these

conditions may appropriately be taken into consideration. Bids with deviations on the

above are liable to be disqualified.

The payment shall be made by the AMC to the Bidder against monthly service bill, provided

the same is correct in all respect preferably within 30 days from the date of submission of

bill by the successful Bidder. The bill of claim shall be accompanied by;

i) List of personnel to whom the wages are disbursed to their respective accounts along

with the Bank Statement.

ii) PF remittance details along with the successful Electronic Challan cum Returns

(ECRs) and Confirmation Slips from the respective organization in respect of the

personnel worked during the month.

iii) ESI remittance details along with the successful ECR and confirmation slip from the

respective organization in respect of the personnel worked during the month

iv) Proof for remittance of Professional Tax recovered from the wages of the employees

v) All payments to the Manpower Bidder shall be through RTGS or electronic money

transfer system through Commercial Banks.

10 Statutory Deduction from the bills:‐

The statutory deduction such as Income Tax, TDS GST etc., will be deducted from the

monthly bill of agency as per Rules for which relevant documents will be issued.

11 Deduction of payment for absentees:‐

In case the successful bidder while performing the contract failed to provide substitute for

an absentee, the wage sat 1/25th of the monthly wages per person per day will be deducted

12 Maintenance of payment records:‐

i. The successful bidder/Agency should maintain proper records for having disbursed

the monthly payment to the persons deployed for AMC and the Bidder should also

maintain records of P.F., ESI payments remitted to concerned departments on

account of DEO service provided to AMC which shall be furnished as documentary

evidence to AMC in every month, without which the payment will not be released.

AMC reserves right to deduct any such taxes, duties, cess at source before release of

payments to the Manpower Agencies.

ii. TheSuccessfulBiddershallissueaformalappointmentlettertoallthepersonneldeploye

d under this contract indicating the name, designation, age, wage rate, amount of PF

both employer &employee, the amount of ESI both employer & employee as

required under Contract Labour (R&A) Act,1970 within 15 days of deployment and

submit copy of the same duly receipted by the appointee to the concerned depot

managers for reference and records of AMC.

iii. Successful Bidder should furnish half yearly/yearly returns, employee wise (All

category Personnel), showing details of amount of statutory payments such as ESI

& PF remitted to the concerned authorities. Bidder in order to confirm to this, to

furnish EPF ledger of the personnel employed by them and deployed for AMC

iv. The Successful Bidder shall maintain proper record pertaining to the personnel

deployed including the wage slip, disbursement of wages, remittances of statutory

payments to the various statutory authorities and present the same to the AMC /

Officers of the concerned authorities whenever called for.

v. The Bidder shall maintain the acquaintance / pay roll and other relevant particulars

pertaining to deployed personnel and shall be made available for inspection by the

officer of the AMC, officials of labour department as and when so required.

vi. Whenever the Bidder/Agency fails to provide personnel as requisitioned by the

AMC, it shall be lawful for the AMC to have the service departmentally or otherwise

and the cost incurred shall be deducted from the amounts due to the Bidder.

13 Bidder will have to pay salary to his concerned staff through ECS (RTGS/NEFT) only.

Bidder will have to submit declaration along with necessary proof for the previous month

along with each bill. Bidder will have to submit proof of ESIC & EPF paid.

14 Performance Guarantee & Execution of contract agreement:‐

a. The Successful Bidder shall deposit an amount equivalent to 5% of 1 year Contract

Value as security deposit / performance security in the form of Bank Guarantee at

the time of entering into Agreement and the Bank Guarantee shall be valid for

months from the date of commencement of Service. This shall be renewed timely &

till contract continue. The Successful Bidder is required to extend the period of Bank

Guarantee for a further extended period of the contract. The Bank Guarantee shall

be refunded to the Successful Bidder after successful completion of contract

b. The actual award of contract and signing of agreement shall occur only after the

Performance Guarantee is furnished as prescribed in the bid. In case of failure to

furnish the prescribed Performance Guarantee within 15 (Fifteen) days of issue of

Letter of Acceptance (LoA) by AMC, the bid is liable to be cancelled for the said

default treating it as breach of Bid terms & conditions. The defaulting Bid Winner

shall be blacklisted for two years from any Bids of AMC.

c. The Successful Bidder should also execute a contract agreement as per the prescribed

format on Rs. 300 /‐ stamp paper as provided in the tender documents within 15 days

from the date of issue of Letter of Acceptance and submission of Performance Bank

a. The successful Bidder shall provide the Driver Staff personnel as and when

requisitioned by the authorized officer of the AMC. The request will normally be in

writing Failure to comply with the request will entail recovery of the cost of

providing such service as worked out by the AMC. The successful bidder shall

deploy requisite Driver Staff as and when ordered and within such time as may be

decided by the AMC /Authorized Officer, failing which penalty at double the agreed

rate per day will be levied per person not deployed during the first 02 days,

thereafter, the penalty at 04 times of the rate agreed per day per person for actual

number of days of default.

16 Bidder has to replace or remove concerned manpower for any misbehaviour or misconduct

activities observed by AMC official.

17 Termination of the contract:‐

A. The contract could be terminated for the following reasons;

i) The performance of the Successful Bidder / Agency is poor and not satisfactory.

ii) Indulging in activities detrimental to the AMC services.

iii) The Successful Bidder is found to have submitted fake or fraudulent or false

documents furnished by the Bidder at a later date or if the Bidder is proved to have

suppressed material information disclosure of which would have rendered the

Bidder ineligible as per Bid terms & conditions.

iv) Non‐adhering/violation of the terms and conditions of the contract.

B. The AMC shall have the following powers:

i) To recover from the successful Bidder/Agency as liquidated damages or by way of

penalty clause above and,

ii) To engage someone‐else after giving due notice to the Bidder, on to the account and

at the risk & cost of the bidder at such places where personnel are not so provided.

iii) To cancel the contract

iv) Forfeiture/ encash the Performance Guarantee

v) To blacklist or not to consider the tenderer’s future offers for a specified period.

18 DELAYS IN THE BIDDERʹS PERFORMANCE:

a. Delay by the Successful Bidder in the performance of the obligations under the

contract shall render the Bidder liable for any or all the following sanctions:

forfeiture of its performance security, imposition of liquidated damages and/or

termination of contract for default as detailed hereunder.

b. If, at any time during performance of the contract the Bidder should encounter

conditions impeding timely delivery of the services and for performance of services,

the Bidder shall promptly notify to AMC in writing of the fact of the delay, it’s likely

duration and its cause(s). Upon receipt of the Bidder’s request the AMC shall

evaluate the situation and may, at its discretion extend the time for the performance

in which case the extension shall be ratified by an amendment.

c. If, at any time during performance of the contract the Bidder should encounter

conditions impeding timely delivery of the services and for performance of services,

19 It is primary responsibility of the bidder for any fault on the part of his deployed staff.

Bidder/s will be responsible for payment to his staff as well as any dispute arising among

their counterpart. They have to follow all Laws and Rules and Regulations of AMC as well

as Laws of Government Applicable (i.e., payment of wages act, contract act, GST act,

industries dispute act and any other law or rule applicable).

20 Resolving of disputes:‐

a. All disputes shall be first attempted to be resolved amicably with mutual

b. In case of non‐resolution of any issue or dispute arising out of or in connection with

any thing in this Bid or the contract, the same shall be referred to resolution to MC,

AMC who shall hear the parties and give his findings on the issue/dispute, and, the

same shall be final and binding on both the parties to the contract.

21 Bidder will be responsible to follow Procedures, Rules, Circulars, Amendments etc. of

AMC; and also any amendment in Govt. Laws, Notifications, Resolutions etc. and all other

criteria of General Administration Department and Labour and Employment Department

22 Breach of Contract

 Failure to deploy the required number of personnel within the prescribed time limit

 Failure to submit PF, ESI, Salary & other statutory remittances in respect of any of

the personnel deployed by the Bidder at the prescribed rate within the prescribed

 Failure to make payment to his deployed manpower on timely & regular basis.

 Failure to submit the relevant documents/registers pertaining to the personnel

deployed under the contract for inspection either to the statutory authorities or to

AMC when such request is made

 Deficiency in service, like not replacing the persons in place of absentees,

underperformers, persons suspected of carrying out fraudulent transactions,

misbehaviour of provided personnel etc.,

It is open to the AMC to initiate the following penal actions against the Bidder on breach of any

of the above terms

a) At first instance to issue warning notice clearly narrating the incident of breach

asking the Bidder to submit its explanation and the action the Bidder is proposing to

avoid repetition of such incident.

b) On the second instance to impose a penalty

c) On the third instance to impose penalty & to terminate the contract and blacklist the

Bidder, based on approval of competent authority.

d) This does not preclude the AMC from necessary directly attributable losses on

account of the actions of the personnel of a Bidder from any available legal options

including forfeiture of security deposit.

e) The Performance Guarantee can be en‐cashed for any “Breach of Contract” as cited

above to the extent to make good any financial loss to AMC. This encashment of PG

is without prejudice to any other legal action that is necessary and required in a

given situation.

23 Staff provided by bidder will be solely on Payroll of Bidder. The staffs have nothing to

do with AMC pay structure and payroll. Staff, in no case, will be able to claim themselves

to be a staff of AMC.

24 The AMC may at any time during the execution of the contract make changes within the

general scope by written instructions, in any one or more of the following.

a) The place of work

b) The services to be provided by the Manpower Bidder

c) The number personnel required may increased or decreased

25 In case of absence, attrition of employees; bidder will have to manage with replacement

manpower immediately.

26 EFFECT AND JURISDICTION OR CONTRACT:

a. The contract shall be considered as having come into force from the date of

“Notification of Award” unless otherwise provided in the “Notification of Award”.

b. The laws applicable to the contract shall be the law in force in India. The Courts of

Ahmedabad, Gujarat shall have exclusive jurisdiction in all matters arising under

the contract, including execution of arbitration awards.

27 AMC reserves right to increase/decrease number of manpower to be deployed at the time

of assigning order or at any point of time at later stage based upon necessity of work,

infrastructure, demand etc. same shall be provided by successful bidder.

28 ADDITIONAL INSTRUCTIONS FOR THE ATTENTION OF BIDERS:

a. Techno‐commercial shall contain technical bid with commercial conditions with

Schedule indicating ONLY THE QUANTITIES AND NOT FINANCIAL BID. Incase

Financials are indicated in the Technical Bid, the offer will be summarily rejected.

b. The Bidders shall submit their offer in(Electronic form) online only before the

notified date and time of Bid.

c. The date and time of opening of financial bids will be notified to all the technically

eligible Bidders after technical evaluation of the Bid is completed.

29 Bidder has to provide the list of the employees who will work as driver personnel at AMC.

Along with the same, Bidder has to maintain following documents for each staff in a

separate file and a copy of the same has to be submitted to AMC:

a. Curriculum Vitae

b. Passport size Photograph

c. Photocopies of Address proof, photo identification proof

d. Education/ Qualification Certificates

e. Experience certificates, if any

30 The Bidder shall obey all relevant Central, State and Local Regulations and enactments

pertaining to contract workmen and labour and the Ass. Manager (Transport) shall have

the right to inquire into and decide all complaints on such matters.

31 The successful Bidder is liable to comply with all laws applicable, including labour laws,

more particularly it shall pay compensation to its workmen for any injury caused during

the course of employment as per the “Workmen’s Compensation Act” in force, failing

which, the AMC may deduct the compensation amount at its discretion from bills and paid

to the injured person.

32 All compensations or other sums of moneys payable by the Successful bidder to the AMC

under the terms of this contract may be deducted from its security deposit or from any sums

that may be due or may become due to the Successful bidder by the AMC on any account

whatsoever and in the event of security deposit being reduced by reasons of any such

deduction, the Bidder shall, within 10 days thereafter make good the shortfall in the security

deposit referred to above.

33 If the Successful bidder fails to provide the Driver Staff personnel services satisfactorily

during the currency of the contract, the AMC shall have the power to enter upon and take

possession of the works and engage any other person, firm or Bidder to complete the work.

Any extra cost incurred by the AMC due to such failure on the part of the Bidder shall be

recovered from the Successful bidder.

34 Driver Staff engaged by the Successful bidder for deployment should be verified through

local police and shall be responsible for the good conduct of its staff while on duty as well

as off duty in AMC premises and the staff shall behave like responsible persons at all times.

The staff should not be found developing familiarity with the officials of the AMC.

35 The agency will be held responsible for all the acts of the deployed Personnel with all risks

arising from carelessness, negligence or damage or loss by theft, pilferage, fraud, misdeed

etc. and the agency shall undertake to compensate the losses arising from such acts of the

personnel to all the concerned including AMC and the Agency shall with draw services of

such personnel and should provide alternate staff.

36 The AMC reserves the right to extend or foreclose the contract depending upon the exigency

and the Successful bidder shall continue to provide Driver Staff personnel on the same

terms and conditions of the contract during the extended period in the event of any

extension given.

37 In the event of acceptance of the Preferred Tenderer with or without negotiations, AMC

shall declare the Preferred Tenderer as the Successful Tenderer. AMC will notify the

Successful Tenderer through a Letter of Award (LoA) / order that its Bid has been accepted.

38 This tender / order will be considered as rate contract for Two Year for Providing Driver

Staff Manpower as per tender terms from the date of work order as per tender requirements

and technical specifications of AMC as per tender conditions; as per TD. Rate sanctioned

will be fixed for entire two year RC (Rate Contract) period from the date of work order.

However if any change in minimum labour wages published by Govt. same will be

applicable. During this RC period if AMC needs more Driver Staff successful bidder has to

provide at the same approved rates & terms. No price escalation will be given during RC

period. Only change in taxes, duties, govt. levies, Govt. rate will be accepted by AMC &

consider for payment. RC period may be extended for further period of One year by mutual

confirmation. Decision of The Municipal Commissioner Shri, AMC will be final & binding

to all. AMC can order for further / extra quantity, if required during entire RC period.

39 Notwithstanding anything contained in this TD, Municipal Commissioner, AMC reserves

the right to accept or reject any quotation, or to annul the bidding process or reject all

quotations, at any time without any liability or any obligation for such rejection or

annulment, without assigning any reasons thereof.

40 Notwithstanding above, the MC‐ AMC, at his discretion, may also split the contract, if

require for timely execution of the work among two of more qualified bidders. MC‐ AMC

ʹs decision in this regard shall be final. MC‐ AMC also reserves right to award the Contract

to any of the eligible and qualified suitable Bidder. Splitting of work will be carried out

based manufacturing capacity, past work experience of the bidder, time frame for execution

of work etc and this shall be binding to all bidders. Parallel contract, if required, can also be

awarded on above basis and will be binding to all.

41 However, if the AMC decide to put an end to the business relations on breach of any

conditions of the contract no such notice shall be necessary and on event of AMC decided

to put an end to the business relations on breach of any conditions of the contract no such

notice shall be necessary and on event of AMC deciding to terminate the business, and the

R.C. shall stand terminated with immediate effect.

42 The R.C. can also be terminated by the MC ‐ AMC in the following circumstances:

43 1) If the firm is debarred or disqualified or ceases to exist or convicted of any offence.

2) If the quality of the manpower to be provided is found not up to the AMC requirements

and found to be not of proper skill.

44 3) If supply position of the firm is not satisfactory.

45 Whenever under this contract any sum of money is recoverable from the RC Holder and

payable to the MC ‐ AMC, Ahmedabad, or an officer empowered by him shall be entitled

to recover such sum by appropriating in part of whole the Security Deposit paid by the

Contractor, if a security being insufficient or if no security has been taken from contractor,

then the balance of the total sum recoverable as the case may be deducted from the sum due

to the contractor under this or any other contract.

46 If any dispute arises about the contract or any terms of contract, Municipal Commissioner,

AMC shall be the sole arbitration and his decision would be final and binding to all the

47 If any loss or damage is caused to the AMC by non‐compliance of the obligations under this

agreement by the Bidder, the Bidder is liable to make good such losses and the AMC shall

be entitled to recover the same from the Successful bidder.

48 The arrangement between the Successful bidder and the AMC is on Principal to Principal

basis and neither of them shall be treated as the agent of the other.

49 A high standard of workmanship is expected out of this agreement and therefore, the

Bidders shall adhere to the instructions from the officer in‐charge from time to time and

deploy personnel who are in possession of required skills to carry on the technical work

assigned to Driver Staff. The materials to be used in carrying out the manpower works shall

conform to relevant standards prevailing in the field.

50 The work shall be carried out with due diligence and all the work executed shall be in a

workman like manner. In the event of any dispute arising, the decision of Sr.Trans.

Inspector /Assi. City Engineer shall be final, binding and conclusive.

51 The Bidder shall issue two pairs of uniform per year, per person, including the period of

55 During the manpower deployment operations, the Bidders shall carry out the work in

harmony with the officials of the AMC in the best overall interest of the work.

56 No advance shall be paid for staff deployed from agency.

The Bidder is permitted to allow a day’s paid casual leave per month to the persons

deployed. In case any employee remains absent from work for one or the other reason, it

shall be the responsibility of the Bidder to give a suitable substitute within 48 hours of

receiving information from the AMC.

Driver Providing period

Tenderer has to provide driver immediately within 3 days of issuance of each order (as & when

issued by AMC), Other wise penalty will be charged for delay in execution.

Rate Contract Period: This rate contract will be valid for two year during which if AMC requires

extra numbers of Drivers same shall be supplied by contractor at same approved rate and terms

conditions. However if AMC needs any more drivers & wants to extend RC period for more

One year, same can be done with mutual consent.

Delivery location: Amdavad, Gujarat at site specified by AMC

The payment shall be made by the AMC to the Bidder against monthly service bill, provided

the same is correct in all respect preferably within 30 days from the date of submission of bill &

all supporting documents as required by AMC, by the successful Bidder.

The successful Bidder/Agency shall take necessary Insurance cover at its own cost for any

accidents and towards any other amount that would become payable by the Bidder under the

workmen’s Compensation Act, for his personal or any other statute that would be applicable

for such services.

PERFORMANCE GUARANTEE.

As a contract security, the contractor shall furnish separate performance guarantee in the form

of Bank Guarantee or by Demand draft/ pay order within 15 days from the date of order for the

amount at least 5 % of the 1 year ordered amount from any Bank mentioned in AMC circular

and made payable to the ʺMunicipal Commissioner, Amdavad Municipal Corporationʺ.

Payable at Amdavad. This shall be renewed timely & till contract continue.

The performance guarantee shall be returned to the contractor without any interest on the

successful completion of the contract period. When the contract ceases to be under any

Notwithstanding the provisions of tender, the Tenderer shall not be liable for forfeiture of its

performance security, liquidated damages or termination for default, if and to the extent that,

its delay in performance or other failure to perform its obligations under the Contract is the

result of an event of Force Majeure.

For purposes of this Clause, ʺForce Majeureʺ means an event beyond the control of the Tenderer

and not involving the Tendererʹs fault or negligence and not foreseeable. Such events may

include, but are not limited to, acts of the Purchaser either in its sovereign or contractual

capacity, wars or revolutions, fires, floods, epidemics, quarantine restrictions and freight

If a Force Majeure situation arises, the Tenderer shall promptly notify the Purchaser in writing

of such conditions and the cause thereof. Unless otherwise directed by the Purchaser in writing,

the Tenderer shall continue to perform its obligations under the Contract as far as is reasonably

practical, and shall seek all reasonable alternative means for performance not prevented by the

Force Majeure event.

TAXES AND DUTIES: ‐

Prices quoted must be inclusive of all & all taxes.

GST (Goods & Service Tax) has come in existence from 1st July, 2017. Contractor/ successful

bidder is bound to pay any amount of GST prescribed by the Govt. Of India as per the terms of

contract agreed upon during the course of execution of this contract.

During the course of execution of contract, if there is any change in rate of GST (Goods and

Service tax) by the government, the same shall be reimbursed/recovered separately by AMC,

subject to the submission of original receipt /proof for the amount actually remitted by the

successful Tenderer/ Contractor to the competent authority along with the certificate from

Chartered Accountant of contractor/successful bidder certifying that the amount of GST paid to

the government and the same shall be intimated/ submitted/ claimed within 30 (thirty) days

from the date of payment.

Remittance of GST within stipulated period shall be the sole responsibility of the successful

bidder/contractor, failing which, AMC may recover the amount due, from any payable dues

with AMC and decision of Municipal Commissioner shall be final and binding on the

contractor/successful bidder in this regards.

Further, the non‐payment of GST to the government may lead to the termination of contract and

forfeiture of Security deposit/performance guarantee amount. 2% TDS will be also be deducted

QUALIFICATION/ELIGIBILITY CRITERIA

Following are the minimum requirement for Qualifying in the Technical bid of the tender

A. The tendering Firm/Company should be duly registered. Provide Certificate of

Registration. (GST / IT etc.) Tenderer must be having GST registration. Registration

documents must be submitted with tender.

B. The bidder should be a registered firm with all the statutory agencies/bodies viz. P.F.,

ESI, IT, PAN, GST and Contract License (as applicable) etc., from Labour department.

Copies of the same should be uploaded.

C. The firm should be conversant with all labour rules and Regulations and EPF &MP Act,

ESI Act, Minimum Wages Act, Payment of Wages Act, Contract Labour (R&A) Act etc.

The Bidder should upload copies of payment of GST, Professional Tax and ECR &

Confirmation slips for at least three months out of any previous three financial years,

for having paid the PF & ESI to the concerned departments along with the Bid for three

months out of any Last three financial years.

D. The relevant supporting documents in respect of the eligible criteria for the above

services should be furnished along with the tender documents without which the

tender is liable for rejection.

E. The agency shall submit a checklist with details of documents for all the requirements

in the tender on which reliance has to be laid by the AMC to ensure fulfilment of PQR

conditions prescribed herein.

F. The bidders should be well conversant with the Rules and Regulations, Contract

Labour (R&A)Act, EPF &MP Act, ESI Act, Minimum Wages Act, Payment of Wages

Act, GST and I.T. Act etc. The bidder should take into account all the above facts before

quoting the rates. The bidders should maintain all relevant documents/records for

having registered with the concerned departments and copy of the same shall be

furnished in support of their claim to meet the required qualifications as specified in

the Bid documents.

G. .Certificate from Chartered Accountant about turn over must be attached.

H. Financial Criteria:

The Tenderer should meet the financial criteria as set out below:

a. The Tenderer should submit data for the F.Y. 2022~2023, 2023~2024 and 2024~2025 year.

CA certificate must also be attached with tender. The tenderer should have average

annual turnover of last 3 Financial Year ending 31/03/2025 must be atleast 30% of

Estimated value Rs. 1230 Lakhs (i.e. It shall be min. Rs. 369 Lakhs) (as mentioned in

tender) of tender. If any tenderer has completed his books of account & submitted IT

return for financial year 2025‐26. In such case data of financial year 2025‐26 will be

considered in last 3 financial year data.

b. The bidder shall submit Liquidity certificate from a Nationalized / Schedule

Commercial Bank addressed to AMC, for a value of service for two months for assuring

uninterrupted performance. The Liquidity certificate should be duly signed by the Bank

and should have been obtained. No other document in this regard except the Liquidity

certificate as indicated above will be considered.

I. Work Experience:

i) The bidder should have provided similar service by deploying personnel in any

Government Departments or Central/State Government PSUs, ULBs, Municipal

Corporation or reputed private companies continuously for one year, out of the last

preceding years and should have rendered service satisfactorily. Documentary proof

along with certificate of satisfactory service issued by min. 2 previous employer should

be uploaded. The AMC will verify the documents with the concerned wherever

necessary. However, documents like Service agreements, Work Orders/any other

documents with incomplete details, will not be considered for the purpose. Following

are the minimum work requirements.

a. Three similar work of Providing of manpower should not be less than 40% of

quantum or amount (i.e.100 No. in each order & amount not less than 492 Lakhs) of

b. Two similar work of Providing of manpower should not be less than 50% of

quantum or amount (i.e. 125 No. in each order & amount not less than 615 Lakhs)

c. One similar work of Providing of manpower should not be less than 80% of quantum

or amount (i.e. 200 No. in each order & amount not less than 984 Lakhs) of this

ii) In case of experience to provide personnel as Man Power Agency to Private Companies,

that Private Company must be registered / incorporated under the Indian Companies

i) “Similar Services” means experience in providing personnel, as a Manpower Bidder or

Manpower Tenderer.

ii) Bidders whose contracts have been terminated/foreclosed/penalized by any company/

firm during the last 5 years due to non‐fulfilment of contractual obligations/deficiency

in service, are not eligible to bid. The agency should clearly specify and submit

declaration letter in writing separately stating that they do not fall under this category.

iii) The relevant supporting documents in respect of the eligible criteria for the above

services should be furnished along with the Bid documents without which the Bid is

liable for rejection.

Note: The bidder shall furnish documentary evidence in support of the above qualifying

requirements as stipulated. Bidder not satisfying any of the above qualifying

requirements will be summarily rejected.

J. Disqualification

Disqualification Even though the Applicants meet the above criteria, they are subject to be

disqualified if Applicant or any of its constituent partners have: ‐ Made misleading or false

representation in the forms, statements, and attachments submitted; or ‐ Been debarred or

terminated or blacklisted (and effect is continue on due date of this tender) by Central

Govt. organization / State Govt. organization / AMC / Any Municipal Corporation / ULBs

In case of a proprietary firm, partnership, private ltd, limited firm the following are the

disqualification in case of failure to disclose information by partners or the proprietor:

(i) If, any of the directors, partners or the proprietor is debarred / blacklisted by Central

govt. organization / State Govt. organization / ULB / Any Municipal Corporation / AMC

or any other Agency of Government of India or any of the State Government.

(ii) If, any of the directors, partners or the proprietor has a criminal history or has been

convicted by any court of law for any of the offences under any Indian laws.

(iii) If, any criminal proceeding is pending in any court of law in India against any of the

evaluation. The price quoted includes insurance, all taxes and duties etc. Delivery will be made

at Amdavad, Gujarat at site specified by AMC and will be as per tender terms of Appendix 1 of

 30 Days shall be considered for the Monthly Payment Calculation.

 Value of (A) shall be minimum of 30 days *......... (Equal to Minimum Wages or higher).

 Values of (E) shall be minimum of 5% of the value of Total Monthly Payment i.e. of Column

 Agency quoting service / administration charges less than 5% of Column (A+B+C+D) quoted

by it shall be disqualified.

 If any agency quotes change in percentage than above referred value for respective field,

then they have to submit justification with documentary proof for its validity keeping in

mind the latest govt. rules for the same.

 Values quoted should be round off in rupees and should not contain paisa.

 At the time of change in minimum wages, Payment in components of minimum wages will

be revised and paid as per govt. regulation but service/administration charges quoted will

remain same throughout the tender period. No changes in service/administration charges

will be given to the agency.

 Amount of bonus to be paid every month.

 Agency has to give 2 set of dress to each driver on yearly basis which includes shirt & pent.

 If rate found non workable then MC, AMC will be final authority to accept or reject the

tender, which will be binding to all.

whether the Bidder is in default of due and faithful fulfilment and compliance with the

terms and conditions contained in the Bidding Documents including, inter alia, the

failure of the Bidder to keep its Bid open during the Bid validity period set forth in the

said Bidding Documents, and the decision of the Authority that the Bidder is in default

as aforesaid shall be final and binding on us, notwithstanding any differences between

the Authority and the Bidder or any dispute pending before any Court, Tribunal,

Arbitrator or any other Authority.

6. The Guarantee shall not be affected by any change in the constitution or winding up of

the Bidder or the Bank or any absorption, merger or amalgamation of the Bidder or the

Bank with any other person.

7. In order to give full effect to this Guarantee, the Authority shall be entitled to treat the

Bank as the principal debtor. The Authority shall have the fullest liberty without

affecting in any way the liability of the Bank under this Guarantee from time to time to

vary any of the terms and conditions contained in the said Bidding Documents or to

extend time for submission of the Bids or the Bid validity period or the period for

conveying acceptance of Letter of Award by the Bidder or the period for fulfilment and

compliance with all or any of the terms and conditions contained in the said Bidding

Documents by the said Bidder or to postpone for any time and from time to time any of

the powers exercisable by it against the said Bidder and either to enforce or forbear from

enforcing any of the terms and conditions contained in the said Bidding Documents or

reference to the matters aforesaid or by reason of time being given to the said Bidder or
