Contactor has to obtain attendance certificate from the various above listed office
and to put it with the monthly bill of agency. UGVCL will count attendance by exception
of weekly off and remuneration will not be given for weekly off, remuneration will be given on the
basis of present day of the manpower and if not present except the days of weekly off than

Employer must has to implement the above salary structure and contractor is only
liable to take payment of service charge on the basis of above payments service
charge will be calculate on the basis of payments done to employee and statutory
payments as per the above .and contractor should strictly follow the above salary
structure without it bill will not be processed for payments, further, if any govt
resolution will be issued during the tenure of work order than it will be implemented
in minimum wages, and no any changes will be given in extra allowance.
❖ Working hours: Contractor has to deploy Manpower for 9 hours including
Break time at mentioned location and shift time will be decided by concern
❖ Travelling Expense: If there is a requirement of travelling from the allocated
location than UGVCL Will be responsible to pay Per KM Rs2.5/-as Travelling
expense and it must be credited to Employee by Contractor and no service
charge will be paid on travelling expense.
❖ Manpower Gender = Contractor has to Deploy 8 Male Sweeper and
Female Sweeper.
CRITERIA FOR THE AWARD OF CONTRACT
1. The tenders/bids from those tenderers who are unable to unconditionally
accept UGVCL’s tender conditions or who fail to deposit the required EMD &
Tender Fee shall be rejected as non-responsive, and Technical bid will not
be open for those bidders who have not paid tender fee and emd.
2. Price bid shall have to be filled online as per the website and format of
https://tender.nprocure.com/ within the time and date stipulated in this
Tender Document. And it will be open only of technically qualified bidders.
3. The bidder should quote a firm and fixed price for the performance of their
services and it should not be a percentage of the overall project cost. The
work/contract will be awarded to the bidder with lowest financial bid (Service

• Phase II (Financial Evaluation): This phase will involve the
assessment of the financial consideration. The Financial Bid of only
technically qualified tenderers shall be opened (online). All the
technically qualified tenderers shall be placed on the equal footing.
The Tenderer who has quoted the lowest tender price (L1) shall be
selected as the successful bidder/tenderer. In case, the lowest bidder
(L1) does not accept the award of contract or found to be involved in
corrupt and/or fraudulent practices, the next lowest bidder (L2) will be
awarded the contract, provided that it is willing to match the lowest

7. Notification of Award/Order
The acceptance of a tender, subject to signing of the Contract, shall be
communicated in writing at address mentioned by the Bidder in the Bid.
Any change of address of the Bidder should, therefore, be promptly
notified to the UGVCL.
The successful bidder shall be engaged by the UGVCL to execute the
work and provide services as per the scope of this Tender Document.
8. Signing of the Service Contract (Execution of Agreement)
Prior to expiration of the period of bid validity, UGVCL will notify the selected
bidder/tenderer and issue loa (letter of award) to the selected bidder and the
selected bidder shall be required to enter in to the services contract,including
any agreement(s) reached during the negotiation process, within fifteen days
of the award of the contract or within such extended period, as may be
specified by UGVCL.
(a) UGVCL reserves the right to accept or reject any Bid, and to annul the
bidding process and reject all Bids at any time prior to the award of
Contract, without thereby incurring any liability to the affected Bidder
or Bidders or any obligation to inform the affected Bidder or Bidders of
the grounds for UGVCL’s action.
(b) Failure to agree with the Terms & Conditions of this Tender Document:
Failure of the successful Bidder to agree with the Terms & Conditions
of the Tender Document shall constitute sufficient grounds for the
annulment of the award, in which event UGVCL may make the award
to the second ranked Bidder (L2) or call for new Bids.
(c) Subletting is not allowed either in full or part of the assignment/work.

9. Commencement of Assignment
The Selected Bidders Shall Commence The Services Within 7(Seven) Days Of
The Date Of The Contracts (Agreement) Or Such Other Date As May Be Mutually
Agreed. If The Selected Bidder Fails To Either Sign The agreement as specified
above or commence the assignment as specified herein, the UGVCL may invite
the second ranked bidder (l2). In such an event, the emd of the first ranked bidder
(l1) shall be forfeited.
TERMS & CONDITIONS
Tendering shall be carried out only for the valid bidders for Hiring man power
services work, who have paid (furnished) the EMD and tender fees along with
the supporting documents.
If any damage occurs to the UGVCL’s properties during delivery/handling of
materials, the agency/Contractor has to put it into the original condition to
the satisfaction of the officer in charge of UGVCL, at its own cost. If the
agency/Contractor fails to do so, the same expenditure shall be recovered
from the earnest money deposit amount or monthly bill of the
agency/Contractor.
The contract resulting from this tendering process shall be subject to the
jurisdiction of the competent courts at Ahmadabad, Gujarat only.
Tender shall be kept valid, without any change in prices and rates, for
acceptance by UGVCL for a period of 90 days after the financial bid opening

The rate offered in the (Price Bid) provided by the bidder shall only be

Order may not be placed for all items, Order for the part quantity as may be
required by the UGVCL has to be acceptable by the Contractor.
Tendered rates shall be for completed work covering all material, labour,
carriage, machinery and equipment, royalties, fees, rent, excise duty,
custom duty etc., GST, sales tax of works contract tax (if any) octroi, entry
tax, wages, tools and plants, transportation, risks, overhead general and
special liabilities/obligations as mentioned. The Contractor shall pay
necessary taxes, such as GST and any other applicable taxes, central
excise duty, customs duty, etc. as above to the relevant authorities.
Gst will be paid as per rate quoted by bidder in financial bid.
The Contractor has to procure and place the Manpower within 30 days from
the issue of work order, failing which the Contractor will be subjected to a
penalty of Rs. 250/- per day plus Taxes per manpower will be charged.
Complete work shall be on the basis of rate contract valid for 12 months.
The Contractor which gets the contract has to enter in to the formal
contract/agreement with UGVCL and shall prepare the document on
appropriate value of non-judicial stamp paper (agreement in UGVCL’s
format on Rs. 300/- stamp paper) for accepting the Contract.
The Contractor shall not sub-assign the Contract. He shall not sublet any
portion of the Contract except with the written consent of UGVCL. In case of
breach of these conditions, UGVCL may serve a notice in writing on the
Contractor rescind/terminate the contract where upon the Performance Bank
Guarantee & Security Deposit shall stand forfeited to UGVCL, without
prejudice to his other remedies against the Contractor.
The rates shall be firm and shall not be subject to exchange variations,
labour conditions, fluctuations in freights or any conditions whatsoever.
Tenderers must include in their rates GST, Excise Duty, and any other tax
and duty, cess or other levy levied by the Central Government or State
Government or Local Authority, if applicable.
The Contractor shall strictly comply with the provisions of safety code
annexed herewith, and it is the responsibility of the agency that all
manpower should follow all safety related norms and for that if any
requirement than agency should fulfill it.
The Performance Guarantee & Security Deposit of the successful Tenderer
will be forfeited if he fails to comply with any of the conditions of the contract.

information for submitting this Tender including his visits to the site or efforts
in compiling the Tender shall be borne by the Tenderer and no claim for
reimbursement thereof shall be entertained.
The Contractor is requested to note that no extra items or deviated item of
work to be executed without taking prior permission from UGVCL If the extra
items or deviated items of work is executed without taking prior permission,
UGVCL shall not be responsible for the payment of such works executed.
If Contractor fails to pay the taxes to the authorities concerned, UGVCL
reserves the rights to recover the said amount from the amount payable to
the Contractor and pay the same to the authorities concerned.
The Contractor shall cover all the workers under a Block Insurance Policy,
comprehensive all Risk Policy/CAR and Fire Insurance equivalent to the cost
of Project or executed cost of the project, which ever is higher, within seven
days from the date of letter of award / work order. The certified copies of the
same must be submitted within one month from the date of issue of the work
The Contractor shall submit daily report, comprising labour deployment,
important activities planned for the day and materials received the previous
day, materials approval request form or other format approved by UGVCL.
Monthly attendance report must be submitted with bill. Attendance report
procedure stipulated by UGVCL is to be followed by the Contractor.
Contract Period: The Contract will be for a period of one year from the date of
signing the Contract. However, the same can be extended up to one year by
mutual agreement of UGVCL and Agency.
Contract Price
The contract price shall be inclusive of the cost of workforce, cleaning
agents, insurances, all taxes and duties, any statutory charges payable by
the contractor, and other charges like pf/insurance of work force and
maintenance of machinery and equipment. The contractor shall bid for the
contract price as per financial bid(online only).
UGVCL reserves the right to increase or decrease the scope of work as
mentioned in the annexure and accordingly the contract rate may be altered
during the course of the contract period. However, the rates for the
increased or decreased scope of work shall have to be mutually agreed
upon by UGVCL and the contractor, in writing.

On specific occasions, UGVCL reserves the right to ask the contractor to
provide additional cleaning services and other manpower services. The
contractor is bound to provide the same at a short notice of few hours.
The work force provided by the contractor shall have to be properly dressed
(for specific tasks) all the time. Each person provided by the contractor shall
have to display the identity card with photo. Each person provided by the
contractor shall have to obtain a police verification certificate on specific
requirement, before the identity card is issued by the contractor.
The contractor is responsible to have strict control over its work force.
UGVCL has full power to expel any member of the contractor found
misbehaving with any visitor of UGVCL and staff. The contractor shall be
responsible for any damage caused to UGVCL property by their staff.
The contractor shall ensure that the all man powers are mentally stable,
youthful an dare able to communicate properly. They should possess good
etiquettes and shall not pose any hazard to the general public.
The supervisor shall have to be experienced, competent and authorized by
the contractor to take decisions, which are mutually agreeable at site. Such
supervisor shall be deemed to have full authority of the contractor and any
instructions given to him by UGVCL shall be deemed to have been given to
the contractor. The supervisor should be easily accessible at all times at site
and should have a mobile phone in person at all times.
The contractor shall be solely responsible for the behavior and honesty of its
workforce, since the public shall, in no way, be affected because of the
UGVCL reserves the right to ask for the replacement of the personnel not
found fit enough for the want of discipline, honesty, sincerity or quality. The
same shall have to be replaced by the contract or without any extra cost to

Necessary amount, as per the provision of the applicable law, shall be
deposited in pf/esic with government offices concerned. It will be the
responsibility of the contractor to submit certificate of e-payment and
deposition of amount in the pf/esic account made by him for the previous
month at the time of submission of the monthly bill for payment. Delay in
payment for want of such details shall not be attributed to UGVCL.

UGVCL Entitled to Recover Compensation Paid to Workmen
(i) If, for any reason, UGVCL is obliged, by the virtue of the provision of the
Workmen’s Compensation Act, 1923, or any statutory modification or re-
enactment thereof to pay compensation to a workman employed by the
Contractor in execution of the works//services, UGVCL shall be entitled to
recover from the Contractor the amount of compensation so paid, and
without prejudice to the rights of UGVCL, under the said Act.
(ii) UGVCL shall be at liberty to receive such amount or any part thereof by
deducting or from the Performance Guarantee & Security Deposit or from
any sum due to the Contractor under this Contract or otherwise.
Payment of Monthly Bills
Payment of bills for work is being paid as per the agreed rates shall be made on
monthly basis. The approval of competent authority and slips of work force
supplied duly signed by the deputy engineer. Shall have to be attached with
material bills for release of payment. Monthly bills are to be submitted on 1st of
every month for payment and bill will be paid within 30 days of receipt invoice of
the agency without any query and if there is a query in invoice or in related
documents than 30 days will count after last compliance related to it.
The monthly bills submitted by the contractor will be certified and passed for
payment only after the contractor produces the documents regarding payment of
p.f. contributions of workers/workmen duly /receipt for previous month/period
separately for the staff working.

As already stated the contractor will submit p.f. contribution challan with ecr
statement every month in respect of their workmen engaged at UGVCL. Site along
with their monthly bills. Any delay in payment of pf contributions will lead to levy of
due penalty by the concerned authorities for the delayed remittance of contribution
in addition to delay in settlement of bills at UGVCL in case of failure in discharging
the statutory obligations leading to situation wherein UGVCL. Is made to incur any
payment/loss in the capacity as a principal employer, such payment/loss and the
extra expenditure with penalty will be recovered from the monthly bill/ sd/ any other
payment due to the contractor.

The contractor will submit wage register, attendance register, pf challan along with
bill to the hr officer for verification every month.
Payment of wages to the workers employed by the contractor in their bank account
will be made by the contractor on or before 7th of following month. The wages
shall not be less than the rates of minimum wages as notified from time to time the
contractor will be required to take out most care of in-custody items, utensils and
equipment which were handed over to him and the party will be required to carry
out physical verification on quarterly basis in presence of hr officer. If any items,
utensils and equipment etc. Are found lost, the cost of the items, utensils and
equipment will be recovered from the contractor’s bills as per records available
The contractor should peacefully vacate the premises after expiry / termination of
contract and remove all his material, equipment, staff etc. From the site. All the
items provided by UGVCL should be handed over to UGVCL’s representative as
issued to the contractor at the time of beginning of the contract in sound and
working condition.
This award of work to the contractor will be a mere license to enter the premises
and does not confirm any tenancy right or ownership. The entire and exclusive
possession of the premises will remain and shall at any time be deemed to have
remained always with UGVCL.
UGVCL shall have right to accept or reject any or all tenders without assigning any
reasons thereof.
The contractor shall comply with all the central, state and municipal laws & rules
and shall be solely responsible for the implementation of the provisions of the
various labour laws and rules there under and other statutory regulations, rules
that are in force and such of the labour enactment that may be made applicable to
him during the tenure of his contract with UGVCL.
He will have to be particular in implementing the provisions of the contract labour
(r&a) act, 1970, the factories act, 1948. The employees provident funds, family
pension fund and deposit linked insurance fund act, 1952, the payment of bonus
act, 1965, the payment of gratuity act, 1972, the payment of wages act, 1936, the
minimum wages act, 1948, the workmen’s compensation act, 1923. He shall be
required to maintain and produce records
Under the various labour laws for the inspection and perusal of the representatives
of the management/ statutory authorities at any time. Any obligations, financial or
otherwise, imposed in future under any statutory enactment, rules and regulations
as revised from time to time, there under shall be sole responsibility of the

All staff employed by the contractor shall be the contractor’s employees for all
intents and purposes. The contractor shall give a declaration to this effect and
engage his staff elsewhere on expiry of the contract.
Engagement of child labour/adolescentis prohibited and violation of this clause will

The contractor shall not issue employment certificate to his employees with
stipulation that they are working for UGVCL. Any breach of this condition will make
the contract liable for termination.
Evaluation of contractor's performance by the ugvc land decisions taken there on
shall be final and binding upon the contractor. UGVCL may terminate the contract
at any time after giving one month’s notice particularly in any of the following
i. Fraud committed by the Contractor
ii. Serious default of the Contract terms committed by the

v. Any violation of general terms and conditions of the Tender.

Any act on part of the contractor or his employees which will be prejudicial to the
interest of the UGVCL shall be considered as grave breach of the condition of the
contract and shall render the contract liable for immediate term in ation.
Loss due to any act on part of the contractor will be entirely his responsibility.
In the event of the failure or delay to fulfill the obligations in the execution of work
to the entire satisfaction of the UGVCL, UGVCL reserves the right to terminate the
contract as above and make alternate arrangements for carrying out the work at
risk and cost and forfeit the security deposit without prejudice to the UGVCL’s
further right to claim compensation from the contractor for loss if any incurred by
the UGVCL as a result of his failure to fulfill the obligations. Without terminating
this contract, the UGVCL will also have the option of engaging some other
contractor(s) to carry out the work, in the event of failure to meet the UGVCL’s
requirements and any additional expenditure incurred by the UGVCL will be
recovered from the security deposit, bills or any amount due or in any other
UGVCL may direct the contractor to replace any of his workers whose services are
not found satisfactory and Agency should accept it without demanding any reason.

Terms and Conditions
1) NAME OF THE CONTRACT
Open tender for hiring of executive and non-executive manpower at
Sabarmati division
2) DURATION OF CONTRACT
(i) The Duration of the contract shall be 1 year from date of commencement of

3) EARNEST MONEY DEPOSIT
The EMD is payable online in favor of the Uttar Gujarat Vij Company Limited
Division Office Sabarmati.
EMD of the successful bidder to whom a contract is awarded will be returned after
the said bidder provides the contract Security Deposit and signs the contract
If the successful bidder fails to submit a Security Deposit within 15 days after the
date of LOA of the contract or fails to sign the contract agreement, then the EMD
amount will be forfeited by UGVCL without any notice or proof of damages etc.

4) SECURITY DEPOSIT

11) General Terms & Conditions:
1. Pre-Qualifying Criteria :
Minimum 3 years of experience in manpower service. The bidder should
submit the documents pertaining to minimum 3 years of work experience in
manpower service. In supporting of experience the bidder should submit the
copy of work order executed in last 3 years in legal organization like central –
state PSUs, Government organization, Bank, etc. The bidder should also
submit certificate from such organizations regarding satisfactory completion of

The minimum service charge in the procurement of manpower outsourcing
services maybe fixed as 3.85% (3% profit + transaction charges which are
0.85% at present) as proposed by GEM & office memorandum number
F.6/1/2023-PPD, Dated. 23.06.23. issued by Ministry of Finance Government
of India, New Delhi. IF any bidder quote less than 3.85% service than it will be
calculated as 3.85% during the financial bid comparison.
3. Criteria of L-1 Agency:
a) After opening of price bids the agency found with lowest rate.
b) If after opening of price bids 2 or more agencies found L-1, by coating
same service charge, in such case Gujarat based registered agency will
be given priority to be considered as L-1.
c) If 2 or more agencies are found registered in Gujarat State then
experience of the agency in Government Sector and PSUs for last 2(Two)
years in similar business shall be taken in to consideration. (i.e. Agency
having more numbers of work orders) shall be eligible for L-1.
d) If experience of Two or more agencies is found to be same then their
aggregate turnover of last 3(Three) years shall be taken into consideration
and agency having higher turnover shall be considered as L-1 and
contract shall be awarded to that agency. For experience bidder should
also submit certificate from such organization regarding satisfactory
completion of work.
4. Penalty Clause:
a) Manpower found sleeping, misbehaving, being disobedience on duty –Rs.
500/- per day per person + applicable taxes (if any).
b) Not disbursing wages to the hired manpowers on prescribed on due date
in a month i. e (on or before 7th day of the succeeding month) Rs. 250/-
per day + applicable taxes(if any) of delay. For example : if an agency has
made wages payment to a manpower on 11th of the month, then penalty
deduction shall be consider as Rs. 1000/- (for 4 days that i.e. 8th, 9th, 10th and
11th multiply by Rs 250/- per day of delay + applicable taxes(if any)). The

11. Conflict of interest amongst bidders :
If participating bidders are found to have conflict of interest then The
participating agencies shall be disqualified, during the technical scrutiny /
evolution of the tender invited by UGVCL.
A bidder may be considered to have a conflict of interest with one or
more party in this bidding process of tenders as mention below.

b) Effect of putting a firm for Stop dealing / Banned for business dealing /
1. The proprietor / all the partners / directors of the stop deal / banned
for business dealing / blacklisting firm shall also be considered for
stop deal / banned or business dealing / blacklist.
2. Once the name of firm and / or proprietor/partner/director of the firm
appears in the list of stop dealing/ Banned for business dealing /
blacklist in any Offices of UGVCL and Subsidiary Companies.
No enquiry shall be issued to a firm.
No bids / tender shall be considered for evaluation and the bid
submitted by the firm shall be ignored.
c) Action to be taken, when a Firm and / or proprietor/partner/director of the
firm is put on Stop dealing / Banned for business dealing blacklisting by
UGVCL or any its subsidiary Offices, during tender process:-
1. Before opening Technical bids, the bid submitted by the Firm
will be treated as “Disqualified Bid” and automatically stand as
“Rejected Bid” at the time of scrutiny of Preliminary / Technical

allowed to complete such awarded work/supply.
e) The amount of EMD / SD/ any payment against supply withheld at the
instance of UGVCL or any of its subsidiary Offices shall be appropriated
against the dues recoverable from the firm by UGVCL or any of its
subsidiary Offices, EMD / SD / PG in the form of bank Guarantee shall be
encased and appropriated.
f) The Stop dealing banned for business dealing / blacklist shall be Firm-
specific and when a Firm is put on Stop dealing/Banned for business
dealing / blacklist, all the manufacturing works of the Firm shall be on Stop
dealing / banned for business dealing / blacklist for UGVCL and its
subsidiary offices and for all Services of the Firm.

is a Proprietary Concern, then all the Concerns of the same Proprietor
shall also be considered to be on stop Dealing / banned for business

h) The board of Directors of the concerned office may however, if he
considers it to be in the interest of the company remove the ban in respect
of any specific service / supply from any supplier for that office only.
