2. The Bidder shall quote his firm and fixed lump sum price for the entire work under this Contract,
defined in more details in various sections of this bid document.

6. The wording in the item description is for subject matter guidance only; clause references are
indicative only and all other relevant clauses shall also be referred to. The prices shall allow for all the
works covered under the bid and all liabilities and contractual obligations whether separately
specified or not. Items against which no prices are quoted shall not be separately paid for and the
Bidder shall be deemed to have covered the cost of execution of such items (according to the
requirements of the bid document) in the prices quoted for other items if any.

12. A) Bidder shall quote the price exclusive of GST, but inclusive of all other taxes and cess or levies or
duties which shall not be paid extra. While GST will be paid for admissible part of actual work done

at the approved tender rates and tender conditions. GST shall be paid as per prevailing rates at the
time of payment. The TDS shall be deducted at source as per provision of IT rules and GWSSB

of all temporary works of whatsoever nature required for SITC of pumping machinery & accessories
including temporary approach, diverting water, pumping, de watering etc. for the proper execution of
works. The rates shall also be deemed to include any works and setting out that may be required to be
carried out for smooth & uninterrupted execution all the works involved.
14. Payment Terms: Schedule of payment for various stages of works and release of retention money on
account of defect liability is tabulated below.
All Mechanical – Electrical – Instrumentation Equipment shall have following three
stages of payment viz. On completion of Supply, on completion of Erection/Installation
& on completion of Testing & Commissioning as per weightage specified above
1 On Supply of Equipment at Site 75 % of Weightage (Amount)
2 After Installation/Erection of Equipment 15 % of Weightage (Amount)
3 After Successful Testing & Commissioning of 10 % of Weightage (Amount)

Note: 5 % Amount towards defect liability of all above equipment (at every stage
of payment) shall be withheld as defect liability which shall be released after a
period of one year from the date of testing & commissioning (inclusive of
completion of stipulated trial period)
15. Payment shall be made as & when funds are made available by Head Office after adherence to
department’s fund requirement & procedure thereof. The GWSSB shall not under any circumstances
relax these of terms of payment and will not consider any alternative payments terms. Bidders should
therefore in their own interest note this provision.
16. 1% of the contract value of work will be deducted from the Running bill(s) on account of
labour cess which is non-refundable.

17. Third Party Inspection and Factory Testing of the major mechanical, electrical equipment &
Instrumentation system such as HSCF Pumps, Induction Motors, Electromagnetic Flow Meters,
Butterfly Valve, DPCV, Expansion Bellows, MCC Panel shall be carried out by the designated
third party inspection agency in the presence of GWSSB's representative (i.e. jointly) at
manufacturers’ works. Inspection charges shall be initially paid to the designated TPI as per accepted
rates by GWSSB. Prior approval of rates shall be obtained by the Contractor from Executive
Engineer, P. H. Mechanical Division, Ahmedabad. Subsequently the amount so paid shall be
reimbursed to the contractor after providing relevant documents viz. receipt of amount(s) paid along
with inspection release note etc. as required by the Engineer-in-charge. Any expenditure incurred by
inspection agency for the work misinformed by the Contractor and charges of inspection agency
without any work due to misinformation shall not be reimbursed to the Contractor.
18. Department shall reimburse the payment made towards insurance of machinery/equipment and for
operating crew/man power engaged as narrated in clauses at serial no. 3, 4 & 5 in this section.
19. The Bidder should acquaint him with the pumping station site conditions including the access to
concerned work site.
20. Contractor has to take over all the plants & machinery of pumping station in writing from concerned
Engineer-in-charge after successful completion of trial run of pumping machinery with accessories.
Detailed handed over/taken over notes shall be duly signed by the concerned Deputy Executive
Engineer and the Contractor.
21. On completion of trial run period of 01 month, the Contractor shall hand over all the equipment and
machinery in proper & satisfactory working condition either directly to the Department and/or any
other Contractor authorized by the Department and as advised. In case of any malfunctioning, the
outgoing Contractor shall be intimated in writing and required repairing and/or replacement shall
have to be made by the outgoing Contractor within a period of maximum 5 days. Only after
completion of required repairs carried out to the satisfaction of the Engineer-in–charge the separate
certificate shall be issued for satisfactory handing & taking over. Only after issue of this certificate
from the Engineer–In–charge the amount of security deposit shall be released.
22. During the process of handing over, if the Contractor fails to repair/replace the malfunctioning
equipment as intimated within 5 days or any reasonable time as decided by Engineer–in-charge, than
the repairs/replacement shall be carried out at the “Risk and Cost” of the Contractor and the
expenditure incurred for carrying out such repairs/replacements shall be deducted from the dues to the
Contractor and/or recovered from the security deposit.
23. Contractor shall pay special attention towards improving the power factor as per design of fixed
power factor improvement panel. The panels provided at pumping station within the scope are
designed & constructed to improve power factor to minimum 0.99 in case of HV & 0.95 in case of
LV power connections. Care must be taken by the contractor to get maximum incentives provided by
the power utility viz. UGVCL on maintaining of power factor (exceeding 0.95) in the monthly

electric bills. However in case of imposition of any power factor adjustment charges i. e. penalty in
the monthly bills, the same amount along with 5 % of administrative cost shall be recovered from the
bills of the contractor. No representation from the contractor in this aspect shall be entertained by the
24. Contractor shall to have to make payment to the man power/operating crew engaged by him
regularly on monthly basis preferably by NEFT/RTGS transfer directly into the bank accounts
of the concerned employees. Above payment must not be less than prevailing minimum wages fixed
by the Labour Commissioner, Government of Gujarat. The contractor has to submit Notarized
Affidavit to the Engineer-in-charge mentioning that all the employees engaged by him shall be paid
minimum wages as per labour laws & entire responsibility rests on him & him only in this regard.
Failure to adhere to this condition may result into termination of the Contract by the Department. The
Contractor has to submit certified monthly attendance sheet (muster) of employees with clear
declaration of receipt of monthly wages by the concerned employees duly signed by individual
25. The Contractor shall have to pay the labour registration fee of required applicable amount Rs
per labour as per prevailing laws and also pay annual contribution of required applicable amount Rs.
75.00 to the Labour department of the Government of Gujarat.
26. Income Tax, Labour cess and any other tax/cess as per prevailing rules of the Government resolutions
shall be deducted from bills payable to agency.
27. The rates to be quoted by the Bidder must include all kinds of taxes/levies/cess applicable to the work
contained in price bid. No extra amount shall be paid to the agency on account of any such tax/cess/
levy by the Department.
28. The Contractor has to maintain cleanliness at all times during the currency of the contract. The
Contractor must keep pumping station & the surrounding open areas clean at all times. Pumping
station must be swept regularly by the helper engaged by the Contractor without any additional cost
to the department. No amount of dirt, dust, refuge, leaves, garbage etc. shall be allowed either in the
pump house or premises & adjoining surrounding areas. The Contractor has to ensure only minimum
allowable leakages from pumps & valves. Under no circumstances leakages from expansion bellows
or delivery pipe lines within the pump house shall be allowed.
29. Record of quantity of water received to the pumping station & water pumped from the pumping
station on hourly basis along with consumption of electric power shall be maintained without fail by
the Contractor. Data of number of pumping hours and quantity of water pumped on daily basis must
be intimated provided to the Engineer–in–charge as well as control room of GWSSB as instructed &
in the required format & mode of communication viz. cellular mobile hand set and/or tab.
30. Shutdown: Shutdown of maximum continuous 01 day will be given for dismantling of

equipment/machinery at pump house at Valli GWSSB pumping station. As existing
pumping machinery provides water to several villages in Khambhat/tarapur Talukas, it will
be imprudent to take shut down for longer periods at a stretch so as to avoid disruption of
water supply. However Contractor shall be allowed to dismantle existing pumping machinery
& install the same pumping machinery etc. & allied mechanical – civil works in maximum
03 slots (batches) to be decided in consultation with Engineer-in-charge. Similarly for
installation of electrical equipment shutdown of maximum continuous 01 day will be
given for dismantling of panels etc. & install new electrical equipment etc. & allied electrical
– civil works in maximum 02 slots (batches) to be decided in consultation with Engineer-in-
charge. However timings & schedules of shut down shall be decided in advance by the
Engineer-in-charge & Contractor has to strictly follow & adhere to the pre-decided schedule.
Failing which liquidated damages of Rs. 5,000.00 per day of delay shall be recovered from
the running bill (s) of the contractor.
31. During execution of the entire work, minimum 50 % system (i. e. 1 pump set) shall be in
running condition and functional to maintain the supply of water (except scheduled
shut down as per above Sr. No. 30).
32. Existing Two no. of 45 KW HSCF pumpsets, valves, pipes, expansion bellows, MCC
panel, flow meter etc & all other items as per instruction of EIC shall be dismantled from
Valli pumping station & same have to be Transfer to Deva(T) Store.

– commercial terms conditions & post qualification criteria, technical specifications & data sheets, conditions
Addenda/Corrigenda/Amendments to the above, for the execution of the above contract, we the undersigned
offer to carry out SITC of HSCF pumping machinery with associated mechanical and electrical equipment &
accessories of pumping station/plant in conformity with the Conditions of Contract, Specifications, Preamble

(a) If we fail to provide required facilities to the GWSSB's representative or any other
person/agency by the GWSSB to perform on his behalf for carrying out the
inspection and testing of materials and workmanship
(b) If we incorporate into the works, materials before they are tested and approved by the
Engineer’s representative
(c) If we fail to deliver raw/clear water of required quantity according to the
conditions/stipulations of the contract, the Engineer-in-charge will be at liberty to
take any action including termination of contract and impose at his absolute
discretion any liquidated damages penalties and/or reject the complete and part
portion(s) of the work (s).
3. We undertake, if our bid is accepted, to complete and deliver the works in accordance with the contract
within stipulated time limit as prescribed in notice inviting the tenders inclusive of monsoon, from the
date of issue of Letter of Acceptance issued to us by you.
4. We agree to abide by this bid for a period of 180 days from the last date of submission of bid and it
shall remain binding upon us and may be accepted at any time before the expiry of that period.

5. In the event of our bid being accepted, we agree to enter into a formal contract agreement with you
incorporating the conditions of contract thereto annexed but until such agreement is prepared this bid
together with your written acceptance thereof shall constitute a binding contract between us.

specified in the conditions of contract of a sum equivalent to 10 % of the contract price or estimated
amount put to tender (whichever is higher) for due performance of the contract.
7. We have independently considered the amounts of liquidated damages shown in various sections of the
bid documents and agree that they represent a fair estimate of the damages likely to be suffered by you
in the event of the work not being completed by us in time.
