INSTRUCTIONS TO BIDDERS

1. The tenderer is subject to be disqualified, if he is found to have misled

or furnished false information in the forms/statements/ certificates

submitted in proof of qualification requirements or record of performance

such as abandoning execution of the works, litigation history and or

financial failures and or suppression of material facts and information.

2. The Corporation shall not hold any risk on account of postal delay.

GENERAL CONDITIONS FOR TENDER

Incomplete tenders of the tenderers which are not full filling any

SPECIAL CONDITIONS OF CONTRACT

1. The work to be carried out the contract shall except as otherwise

provided in these conditions include all labour, materials, tools,

plants, equipments and transport which may be required in

preparation of and for and in the full and entire execution and

completion of the works. The descriptions given in the schedule of

quantities shall unless otherwise stated be held to included waste

on materials, carriage and cartage, carrying in, return of empties,

hoisting, setting, fitting and fixing in position and all other labours

necessary in and for the full and entire execution and completion

and all applicable taxes as aforesaid in accordance with good

practice and recognized principles.

2. The rates quoted by Contractor should also include for providing

all scaffolding, hoists, tackle and other plant, shuttering profile and

apparatus generally required for the proper execution of the work.

The contractors shall provide without extra charges all labour and

apparatus required by GSPHCL for testing and measuring the

works and for weighting measuring, providing or testing the

efficiency of any portion of the works and shall also at his own cost

provide all planking gang ways, etc. necessary for affording access

to every part of the works.

3. The Contractor is expected to quote rate for each item after careful

analysis of cost involved for the performance of the completed

item considering all specifications and conditions of contract. This

will avoid loss of profit or gain in case of curtailment or change of

specification for any item. In case it is noticed that the rates quoted

by the tenderer for any item are unusually low, analysis for such

rates will have to be furnished by the tenderer on demand, to

satisfy GSPHCL about the reasonableness of the rates.

4. The Contractor shall provide at his cost all temporary lighting

arrangement required for the works and to enable to contractors

and sub-contractors to complete the works in the specified time

including that for the workmen of any sub-contractors or special

lights, guards, fencing and watching when and wherever necessary

or required by the Engineer in-charge / Project Architect /

Engineer for the protection of the works or for the safety and

measuring instruments found necessary on the works shall be

provided by the Contractor for the due performance of their

contract as instructed by GSPHCL. The Engineer in-charge will use

any or all measurement instruments or tools belonging to the

Contractor as and when he chooses for checking the complete

works as well as the work in progress. Any other apparatus

deemed necessary by GSPHCL or its consultants for proper control

shall be provided by the contractor at his own cost.

7. All scaffolding and ladders that may be necessary for taking

measurement at site will be provided by the Contractor.

8. The whole of the works included in any contract shall be executed

by the Contractor whom the work entrusted and the Contractor

shall not directly or indirectly transfer assign or under let the

contract or any part share thereof of any interest therein without

the prior written consent of GSPHCL and no undertakings shall

relieve the contractor from the full and entire responsibilities of

the contractor or from active superitendence of the works during

works included in this contract and the contractor shall not be

responsible for any damage or delay which may happen or be

12. The successful tenderer is bound to carry out any item of work up

to any deviation in quantities for the completion of the job /work.

13. The rate quoted shall include the cost of supplying colour

photographs of 8” x 10” size with negative / soft copy to employer

after completion of work from various angle one set each to

employer and the architect separately in respect of each stage of

work as directed.

14. Contractor should submit three sets of as built drawings after

completion of work.

planning, supervision and co-ordination of this project work.

consultant Engineer / Architect / Engineer in-charge of

corporation or their authorized representative in co-ordination to

all other contracting agency engaged in this project work.

16. Before tendering the tenderer shall visit the site on his own and

also carefully examine all aspects in relation to work and tender. If

any ambiguity or discrepancy is found, he shall refer to the

engineer in-charge. The submission of the tender shall be regarded

as signifying acceptance by the tenderer this instruction

specifications and conditions.

17. The tenderer shall make all the necessary arrangements for

unloading the furniture and fixing the same at the suitable place on

site. The contractor shall remain solely responsible for making the

protection of the said furniture at his cost.

18. The tenderer, if required by the corporation shall have to submit

detailed computations and break ups of cost showing the figures

on which the overall rates are based.

19. The date of completion of job is essence to this contract. The

contractor is therefore requested to complete the job in the

stipulated time. Any deviation with respect to time or specification,

the actions will be taken as per agreement booklet.

20. Drawings are intended to give the tenderer an idea of work

involved. These drawings are only indicative and for use prior to

tendering only. Work shall proceed at the tenderer’s at site only on

the basis of drawings marked “Final for Execution” which shall be

issued to the successful tender. No claim shall be entertained from

the tenderer if the “Final for Execution” drawings are with the

26. The contractor shall be deemed to have carefully examined the

specification general conditions and drawings and to have fully

informed and satisfied himself as to the nature and character of the

work to be executed, site conditions and other relevant matters

work. This shall include all charges required for labour, materials

storage of materials, transportation of materials and equipment.

periods as stated in the relevant specifications and to do all things

28. The contractor shall make his own arrangements for the water

required for the job. He shall also make arrangements for

chlorinated drinking water for the workers during the execution of

the work. The contractor shall also make arrangement for the

security of materials, machineries, plants and all the items which

are to be used during the work. Security shall not be the

responsibility of the corporation.

29. Drawings & Shop Drawings :

The drgs. enclosed in the tender are scope drgs. They indicate

general layouts only. However, the actual location, distances shall

be governed by field conditions. The contractor shall check at his

own and all the drawings of connected utilities, so as to avoid

possible conflict. Any discrepancies found in the drawg. And the

field conditions shall be immediately brought to the notice of the

consultants for decision.

30. The contractor shall carry out the work strictly in accordance with

drgs. work which shall be approved by the consultants.

32. The rates quoted by the contractor shall be inclusive of Govt.

Duties & Taxes, Octroies, Excise and Other levis also inclusive of

charges like handling and transportation up to site.

33. The contractor shall employ a full time qualified engineer at site

during the execution period of work. He shall be assisted by

adequate number of skilled and experienced persons / staff.

places where the work or part there of being fabricated or

38. The quantity of the material supplied for any purpose shall be

approved by the consultant / engineer in-charge. Prior to the use

in the works whenever practicable samples are to be supplied &

govt. approved by consultant / engineer in-charge before delivered

to the site of works. Any material rejected will be removed from

the site at contractor’s expense.

39. The main registered contractor is fully responsible for the whole

work upto defect liabilities period. The payment shall be made to

main registered principle contractor.

40. If any minor or major changes/alteration/modifications at

Special Condition of Contract

1) In case of discrepancy between these "Special Conditions of Contract" and

conditions mentioned elsewhere in the tender paper, these special

conditions of contract will prevail.

2) On demand of contractor working/structural design drawings will be

supplied by GSPHCL/GSPHCL's Design consultant/GSPHCL's proof

consultant. The contractor shall pursue the delivery of working/structural

design drawings before one month from starting of succeeding

construction activity.

3) Read GSPHCL instead of Government of Gujarat in whole document.

4) Work will be supervised by GSPHCL and by Private consultant. (TPI.)

5) Contractor shall establish fully furnished site office (including AC, toilet

and drinking water facility) of 300 sq.ft for client without any extra cost.

6) The various materials to be used in the works shall follow the specification

as per relevant IS provision and records shall be maintained as per

Government and all other taxes.

8) The equipment shall be capable of determining accurately by direct

weighing, prescribed amount of the various ingredients viz. Cement, sand,

aggregates plasticizer and the combination of material in the mixer shall

give a uniform mix within the prescribed time and discharging the mix

without segregation. Equipment and its operations shall be all times to

subject to approval of the Engineer.

9) The contractor shall provide all the equipments and any other ancillary

equipments, required for checking the performance of measuring and

mixing device and shall make tests as and when ordered by the Engineer

incharge to his satisfaction. The contractor shall make such adjustment,

replace or replacement as may be necessary to meet the requirement of

accuracy satisfaction of Engineer.

10) All the services and any utility lines (overhead, underground, surface

utilities and any other) interfering in the work and those which require

shifting shall have to be shifted by the contractor at expense of GSPHCL.

The payment will be made as extra item, if not in tender. The services

shall be shifted as per the guideline given by the concerned authority.

11) Only unconditional tender will be accepted.

12) In case of change of grade of concrete than specified in tender to be same

shall not be treated as a new item. Only the difference in the cost of

cement will be paid.

13) Empty cement bags and wastage of steel are remain with the agency.

14) No fly ash will be allowed in concrete mix.

15) Testing of material expenses / charges shall be born by contractor. Testing

are carried out at Govt. (R&B) approved laboratory or G.E.R.I. Testing at

such laboratory can be done, if asked by GSPHCL, maximum up to 50%

of frequency, mentioned in tender.

16) If Agency desires Fully automatic RMC plant confirming to IS 4926 of

required capacity shall be established within site for which no extra

payment will be done by GSPHCL.

17) All the building works shall start simultaneously at the time.

18) The rate quoted is inclusive of all local State Government, Central

Government and all other taxes. But in case change in law, after

submitting the tender leading to resultant increase or decrease in cost of

work exceeding 5% (Five percent) of the final amount payable for work

done shall be considered for payment or recovery as the case may be.

26.2 Defect Liability Period

(i) The Defects Liability Period for original building works

shall be earlier of (a) & (b) stated below:

(a) Three years from the date of possession of building

taken over by user agency or elapse of three full monsoon

periods following date of possession of building taken over

by user agency, whichever is later

(b) Four years from the certified date of completion or

elapse of four full monsoon periods following the certified

date of completion, whichever is later.

(ii) The Defects Liability Period shall be as under for repairing

/ renovation works:

 For repairing / renovation work costing Rs. 50,000 or less,

three months following the certified date of completion.

 For repairing / renovation work costing more than Rs.

50,000 and upto Rs.100 lacs, one year OR elapse of one full

monsoon period following the certified date of completion,

whichever is later.

 For repairing / renovation work costing more than Rs.

lacs or more, three years OR elapse of three full monsoon

periods following the certified date of completion,

whichever is later.

For the purpose of this clause, full monsoon period shall be

from 1st June to 30th September.

Clause 46.0 Secured Advance to Contractor.

(1) Before any secured advance for materials is paid the

contractor, the materials shall have to be tested for its

quality in the laboratory, contractor’s request for such

secured advance will be considered only after last results

of materials are received and results are satisfactory. (As

per Government circular No. SSR 1070-1B-191-22-5 of 5-3-

(2) Advance on security of materials brought to site will not

exceed 75% of the value (as assessed by the Executive

Engineer) of such material provided that they are of

imperishable nature.

(3) Recovery of advance will not be postponed until the whole

of the work entrusted is completed. Secured advance will

be recovered within 3 months from the month in which

secured advance is given if material is not utilized in work.

(4) Secured advance is permissible on materials which are all

actually brought on site and are required by the contractor

for use on items of works for which rates for finished work

have been agreed upon.

(5) Secured advance will be given only on materials for which

the full value is paid by the contractor to the seller.

For Preliminary stage – Mandatory documents to be submitted in

electronic form i.e. by scanning along with submission of tender

IV : A Solvency certificate of an amount equal to 25 Percent of the

amount of work put to tender (having minimum validity on the

date of online submission of tender) will have to be produced.

Such solvency certificate should be issued by the banks as per

finance department of Govt. of Gujarat Circular.

TENDER CLAUSE NO. 21: AGREEMENT ON STAMP

Successful tenderer i.e. in case of a proprietorship firm,

(d) (3) Security Deposit : In case of tenders for Annual Rate

Contract (A.R.C.), total 10% security deposit of the contract value

Out of which, first 5% of the contract value will be payable in the form

of FDR/Bank Guarantee, as per prescribed bank details.

Balance 5% deposit of the contract price will be deducted @ 20% from

each of the first 5 bills.

(B) REFUND OF SECURITY DEPOSIT

From total 10% of Security Deposit, first 50% of security deposit

(deposited in the form of FDR / Bank Guarantee received at the time of

contract), will be released after one month of final bill payment :-

 On submission of satisfactory completion report and

recommendation for release of security deposit from Executive

 compliance of all statutory provisions including Clause No. 44.3 by

the contracting agency with regard to GST provisions.

Balance 50% of Security Deposit (deducted from RA bill payments)

will be released after completion of defect liability period as per Clause

No. 26.2 on recommendation and submission of satisfactory

completion certificate obtained from the beneficiary by the Executive

Engineer in the prescribed Form No.

In case of Annual Rate Contract, security deposit of 5% will be

released after one month from the payment of final bill payment of the

last work under Annual Rate Contract on submission of satisfactory

completion report and recommendation of the release of security

deposit from the concerned Executive Engineer AND satisfactory

compliance of provisions of all statutory provisions including of GST as

per Clause No. 44.3.

Remaining 5% security deposit will be released after completion of

defect liability period (as per Clause No. 26.2) on submission of

satisfactory completion report by Executive Engineer obtained from

beneficiary and satisfactory maintenance in the prescribed form.

IT MAY BE CLARIFIED HERE THAT BEFORE RELEASE OF FINAL AND BALANCE

SECURITY DEPOSIT, AFTER EXPIRY OF DEFECT LIABILITY PERIOD AND

MAINTENANCE PERIOD IN CASE OF ANNUAL RATE CONTRACT WORKS, THE

AMOUNT OF EXPENSES, IF ANY, INCURRED BY THE CORPORATION FOR THE

CONCERNED PROJECT WILL BE DEDUCTED FROM THE AFORESAID SECURITY

DEPOSIT AVAILABLE WITH THE CORPORATION UNDER THIS CONTRACT OR

OTHER CONTRACTS.

CLAUSE NO.47 : CERTIFICATE FOR COMPLETION OF

WORK & FINAL BILL PAYMENT

VI. At the time of payment of final bill, in case of handing over memo of

the project, duly signed by the competent authority, is not submitted,

the Corporation will withheld Rs. 50,000/- or 0.5% of the cost of work,

whichever is more and this amount will be released only after

submission of handing over memo.

Following Clause are amended in existing tender clause

Section- 3 Clause – 26.5 Penalty For leakage.

“Lump sum amount of Rs.15,000/- (Rupees Fifteen Thousand only) shall be

recoverd / deducted for every leakage occurred in the buildings as penalty.

Where as for leakage in the terrace, the amount of penalty shall be worked

out at Rs.175/- (Rupees one hundred seventy five only) per sq. meter for the

terrace area of that building shall be recovered from the remaining final

security deposit available with the corporation. Such penalty /recovery will

be over and above the rectification / compliance of such leakage by the

agency towards partial damage to the building affecting its life and

inconvenience caused to the beneficiary for such leakage”

“ The contracting agency will be required to submit a copy of invoice as per

GST Act at the time of delivery of materials at project site towards proof the

materials purchased as per the specification / brand as mentioned in the

tender document of the Corporation”
