This item to be procured from RDSO approved/Developmental sources registered under RDSO Item ID: 3100423 with Sub Item ID: 3100423008 is available on IREPS vendor directory. The status of firm will be reckoned as on date of tender closing and not thereafter. However, in case of removal /suspension/banning/delisting/downgrading etc after closing of tender, such changes shall be taken into account while considering the offers. BULK ORDER:-Railway reserves the right to order entire or bulk quantity on RDSO approved sources. DEVELOPMENTAL ORDER: - Development Vendors shall be eligible for development order of up to 20% of NPQ in regular tenders. Total quantity to be ordered on developmental sources shall be limited up to 20% of NPQ in regular tenders. Note: - It is clarified that the Developmental Vendors are only such vendors which are listed as developmental vendors on UVAM without any condition. DEVELOPMENTAL ORDER: -The development orders may be placed on firms which are unconditionally approved by RDSO as developmental vendor as per Para 1.3.1 of Annexure-B of WCRs e TENDER DOCUMENT FOR SUPPLY CONTRACTS. Note :- (i) In case there are not more than three Indian Suppliers categorized as Approved Vendor for a particular item, unconditionally approved developmental vendors ( without any condition of prototype / field trials etc) can be considered for placement of bulk order without any quantity restrictions as per Para 1.3.1 of Annexure-B of WCRs eTENDER DOCUMENT FOR SUPPLY CONTRACTS

1.The bidder agrees to supply the tendered stores at the rates quoted by him in accordance with the IRS Conditions of contract and (or) special conditions and (or) other Conditions specified/attached with the tender. 2.The bidder confirms that Rates and other financial terms quoted in relevant columns of financial bid will only be ruling terms for acceptance, and such terms quoted anywhere else should be ignored. Code of Integrity, Misdemeanor and Penalties :- I/We have carefully gone through the IRS conditions of contract (included and uploaded along with the bid document) particularly Para 2500 pertaining to "Code of Integrity, Misdemeanor and Penalties". I/We hereby certify that none of our sister concern or affiliates (such as having common partner/director/promoter/owner/holding company decision control etc.) have participated in this tender which can give rise to a conflict of interest or fall under anti-competitive practices. We understand that the offers of all such sister concern or affiliates including ours are liable to be rejected as per relevant provisions of IRS terms and conditions. I/We, affirm that we shall abide by the Code of Integrity in general, with specific reference to conflict of interest [Para 2502 (e)], anti competitive practices [Para 2502(c)] and obligation to proactive disclosures [Para 2503]. I/We understand that we are fully responsible for the above declaration and it shall not be the Railway's responsibility to verify the same. Code of Integrity, Misdemeanor and Penalties :-In case your confirmation in commercial compliance regarding Code of Integrity, Misdemeanor and Penalties is 'No', then provide/upload the names and addresses of your sister concerns or affiliates .
Jurisdiction of Court :- As per Para 2703 of IRS Condition of Contract the Courts of the place from where the acceptance of tender has been issued shall alone have jurisdiction to decide any dispute arising out of or in respect of the contract.
Tenderer must indicate delivery schedule. Offers with longer delivery period with respect to the delivery period/schedule in the tender conditions may be ignored in the interest of the Railways.
PLASTIC WASTE MANAGEMENT RULE 2016:- It is certified that for execution of this contract, the plastic packing material or commodities which are made out of Compostable Plastic or Biodegradable Plastic shall be purchased from firms having certification by CPCB for manufacture or sale of plastic packing or commodities made from Compostable Plastic or Biodegradable Plastic as per rule 4 (4) of Plastic Waste Management rule 2016. It is also certified that we shall also not use any other category of plastic, such as Bio compostable or Oxo-degradable or Oxo-bio-degradable or the like, which are not recognized under Plastic Waste Management Rule 2016 with all amendments. ( Note:- May confirm as Yes, to certify all the above certification.)
LOCAL CONTENT AS PER MAKE IN INDIA POLICY:- Order shall be restricted to Class-I Local Suppliers only (with minimum local content of 50%) as per Make in India Policy for the tendered item and as such, the vendors who do not qualify to be Class-I Local Suppliers for the tendered item, should not quote in this tender as their offer shall not be considered for any ordering. In case, any vendor who does not qualify to be a Class- I Local Supplier for the tendered item participates in the tender, it does so at its own risk and cost and Railways shall not be liable for any loss or damage caused to the vendor.
LOCAL CONTENT CERTIFICATE: Procurement value of this tender is more than Rs. 10 Crores. [i] Irrespective of the value of the tender case, the Class-I local supplier/Class-II local supplier at the time of bidding shall be required to indicate percentage of local content and provide self certification that the item offered meets the local content requirement for Class-I local supplier/Class-II local supplier, as the case may be. They shall also give details of the location(s) at which the local value addition is made. Purchaser reserves the right to call for fresh self certification for Local Content from technically suitable offer where either self certification for local content has not been uploaded or for any other reason deemed fit by the purchaser. Tenderer who are not able to provide above mentioned document, the tenderer will be treated as non-local supplier and the offer will not be considered for any order. The decision of the purchaser in this regard will be final. [ii] In cases of procurement for a value in excess of Rs. 10 Crores, the Class-I local supplier/Class- II local supplier shall be required to provide, at the time of execution of the contract, a certificate from the statutory auditor or cost auditor of the company (in the case of companies) or from a practicing cost accountant or practicing chartered accountant (in respect of suppliers other than companies) giving the percentage of local content. The same shall also be provided by the contractor along with the bill submitted by the contractor for payment. For cases where it is not possible to provide the requisite certificate at the time of execution of the contract, the supplier is permitted to provide the requisite certificate for local content at the time of submission of bill. Submission of the requisite certificate by the contractor is mandatory for claiming any payment from the Railway. In case the contractor/supplier does not meet the stipulated local content requirement and the category of the supplier changes from Class-I to Class-II/Nonlocal or from Class-II to Non-local, a penalty of 10% of the value of the portion of contract for which the stipulated local content requirement is not met, will be imposed. However, contract once awarded shall not be terminated on this account. Note: The requisite certificate of local content must be signed with UDIN or relevant similar numbers for statutory auditor or cost accountant whichever is applicable, and should be verifiable online using such UDIN (or other relevant number as the case may be)
I/We, the tenderer hereby certify that we are aware that in cases of procurement for a value in excess of Rs. 10 crores, the Class-l local supplier shall be required to provide a certificate from the statutory auditor or cost auditor of the company (in the case of companies) or from a practicing cost accountant or practicing chartered accountant (in respect of suppliers other than companies) giving the percentage of local content. We are also aware that false declarations will be in breach of the Code of Integrity under Rule 175(1) (i) (h) of the General Financial Rules for which a bidder or its successors can be debarred for up to two years as per Rule 151 (iii) of the General Financial Rules along with such other actions as may be permissible under law. We, the tenderer, hereby certify that the local content certificate provided by me/us shall be issued by the authority as required by the Make in India Policy.
