   (1) I/We engage to supply the Western Railway with the articles specified above upon the terms of the Indian Railway Standard Conditions of Contract (latest revision) and upon the terms of the Revised Special Conditions and Instructions for the Guidance of the Contractors issued by the Western Railway (Instructions to tenderers & General Condition of Contract revised on September 2021 version 2021/1) available at IREPS portal at link www.ireps.gov.in/ireps/upload/repository/railway/483/148/public/TenderConditionsVersion2021- 1.pdf. (2) Offer for make mentioned in tender description will only be considered for ordering. Offer for make not mentioned in the tender description will be summarily rejected. (3) Authorized dealer of OEM of the make mentioned in the tender description to participate with tender specific authorization. (4)Offer of Authorized dealer without Tender specific authorization from OEM will be summarily rejected. 5)Firm must submit performance certificate for item to be supplied

   Railway reserves the right to place order on sources having proven & successful performance for tendered item/similar item in Indian Railway. Firm to submit performance statement/copy of PO,RO, Inspection/invoice along with the offer failing which offer will not be considered.

Commercial-Compliance

   Tenderers are required to mention HSN Code of the offered goods and to quote correct applicable rate of GST. Tenderer will be solely responsible for correctness of the HSN code and the rate of GST for the offered goods.

   Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

   1) All the bidders / tenderers should ensure that they are GST compliant and their quoted tax structure / rates are as per GST Law. (2) Tenderer should furnish his GSTIN with copy of registration with his offer. (3) The successful tenderer is not liable to be registered under CGST/IGST /UTGST/SGST Act, The railway shall deduct the applicable GST from his/their bills under reverse case charge mechanism (RCM) and deposit the same to the concerned tax authority. (4) In case of dispatch by road date of actual receipt of material by consignee will be considered as date of supply.

   Offers for less than 50% of the tendered quantity shall be treated as unresponsive and shall be liable to be ignored.
