in appropriate class with GETCO and who has executed similar nature of work successfully as

mentioned in Qualification requirement criteria given in the tender document. Bidders should

QULIFYING REQUIREMENTS

The bidders must be submitted all documents scanned copy on n-procure and

certified/self-verified copy of all documents

Following credentials shall be submitted with the technical bid for qualification.

1. Bidder quoting for the bid shall be strictly of OEM /manufacturer or authorized dealer / distributor

and has to submit authorized dealership certificate with valid time period of Bird Guard-

manufacturing company other than will not be considered.

2. Contractor should produce evidence of having experience in executing similar equipments i.e Bird

Guard, Mud guard, Bird Spike etc of minimum amounting to Rs. 03.00 Lakh in Last Five(5) calendar

year and they should submit Attested photo copy of orders secured from GETCO / Central / State

Government / Railway / Semi- Government or any Reputed Firm and satisfactory completion certificate

from respective department

3. Bidder shall have to submit manufacturer’s catalogue/literature showing technical

specification of materials as per mentioned in annexure-B with seal & signature of Bidder on

catalogue with technical Bid.

4. Bidder shall have to submit sample of Bird Guard with Accessories which showing relevant

Standers and name of manufacturer with technical bid

6. Technical bid will not be considered without submission of sample as per Specifications.

7. Submit latest authorization certificate from OEM with technical bid if any.

8. Bidder shall have to submit GUARANTEED TECHNICAL PARTICULARS (GTP) of with Bird Guard in

Annexure-B with technical Bid.

Catalogue mentioning all Technical Specifications & Dimensions should be submitted with

tender. Failure in which agency will be disqualified & price bid will not be opened.

1. Contractor should produce copy of the IT Return with Profit and Loss and balance sheet of last

three financial Years.

2. Attested copy of Power of Attorney, if any, for signing the bid documents.

3. The bidder shall be registered under the “GOODS & SERVICE TAX – ACT”.

The certified Xerox copy of such registration under GST indicating “GSTIN” shall have to be

submitted along with bid by the bidder.

4. The Bidder should submit copy of PAN Card.

5. Bank Solvency Certificate of 20% of Total Estimated Cost i.e : minimum ₹ 3.00 lakh

EMD: Read this clause as under in place of commercial terms and condition clause:

1. All the Bidders shall be required to pay EMD, except those who are exempted as per Industries &

Mines Department, GoG New Purchase Policy Resolution No. SPO/1095/2636(97)/CH dated

23.09.1997 for Small and Micro Scale Industries.

2. In cases, where EMD need not to be paid, valid exemption Certificates duly Notarized has to be

produced / attached in place of EMD documents as per the Tender Terms and Conditions.

3. The Micro and Small Scale Industrial (manufacturing) Units registered under Small Scale

Industries of Gujarat State and holding subsequent registration with CSPO / NSIC / DGS&D,

Registration Certificates for the item under Tender will be eligible for exemption from payment of

EMD on submission of attested copies of their SSI (SSI/ MSME Part-II) & CSPO / NSIC / DGS&D

Registration Certificates in EMD Cover. This benefit of exemption will not be admissible if they

take part in the tender indirectly either through their dealers, agents, distributors or other

5. Government or Semi-Government Organizations, which are being run departmentally & are not

Limited Companies, will be eligible for exemption from payment of EMD.

6. Participants not covered under these categories mentioned at Clause No. 3 will have to pay EMD

compulsory, failing which the “Bid” will be treated as “Disqualified Bid” and automatically stand as

“Rejected Bid” at the time of opening of Preliminary / Technical Bid.

7. Any basic document with regard to EMD will not be acceptable after closing time of Online bid.

8. The EMD amount is should be paid vide online mode NEFT/RTGS.

9. The validity of the Bank Guarantee for EMD should be for a period of at least Six Months from

the date of submission of the Bid of the Tender.

EMD detail must contain the following documents:

(a) Details & Documents as per clause No. 08 (Commercial terms and conditions) of this

tender for EMD requirement. (This is must.)

(b) Exemption in the payment of EMD shall be given to the Small, Cottage & Tiny

Industrial Units registered under Small Scale Industries of Gujarat State and holding

subsequent registration with CSPO/NSIC/DGS&D registration certificates for item

under tender. While no exemption shall be given to outside Gujarat based

(d) Vender Registration-clause No.2 of commercial terms & conditions of this tender may

be read as: “Valid Vendor registration certificate / letter for the tendered item

is not mandatory.”

(e) List of Orders executed during last three (3) years from the date of publication of

tender notice (including supplied made to GETCO/GEB/ GUVNL or their any subsidiary

company) for the tendered items. Please attach order copies. In absence of this

document the performance / status of bidder for the tender item would be evaluated

accordingly. (This document is not mandatory for opening of the technical bid.)

Delivery schedule::

The delivery schedule of the materials to be supplied against this tender shall be within 04 Month

(Four Calendar Months) considering commencement period & approval from the date of

issuance of order.

The above specified delivery Schedule is for the entire quantity of the tender items. If the quantity /

items offered by the bidder is less while placing the order, the delivery period will be reduced on pro-rata

basis based on the quantity allocations done by the Corporation.

Bidders offering partial quantity against the tender items shall be required to specify delivery schedule,

as per the quantity derived on equal quarterly / monthly basis keeping in view the entire tender quantity.

Any deviations in the offered delivery schedule in online Annexure-IV shall lead to outright rejection of

the bid and no further correspondence shall be entertained.

The firm whose supply against the previous order is pending as on the date of opening of the tender

even after completion of their contractual delivery period, such firm will not be eligible for evaluation

purpose unless convincing and sufficient reasons satisfactory to Corporation are furnished by the bidder.

Corporation reserves the right to terminate the contract at any time, without assigning any reason,

whatsoever, by giving a notice period of one month from the date of notice of termination of the

contract. Suppliers will not be entitled for any compensation/ damages / losses, whatsoever, on account

of such termination of the contract. Other text portion of Clause No. 49 – Termination of Contract will

also be applicable.

Security Deposit::

(A) Guarantees issued by following banks will be accepted as SD/EMD on permanent basis:

i. All Nationalized Banks.

(B) Guarantees issued by following Banks will be accepted as SD /EMD for the period up to March,

2027 Or the issuance of new Government Resolution on the same subject whichever is earlier. The validity

cut – off date in GR is with respect to date of issue of Bank Guarantee is irrespective of date of termination

The tender should be submitted in sealed envelope on which it should be definitely indicated the name of

Bidder should quote price for supply items including all taxes as per Schedule – B, Over all

lowest will be considered as L1 party during commercial evaluation. Rates should be quoted

on firm price basis.

Bidder must confirm their full acceptance to various terms & condition of GETCO specification. They

should also confirm that offers are based strictly on the specification date in all respects.

An Earnest Money deposit shall have to be remitted by the bidder by way of NEFT/RTGS Only

The bidder are required to quote only firm prices for all item No variation on price statutory or otherwise

or raw material or finished products on any cause will be accepted.

The bidder should note that the completion of above work in all respect in accordance with the time limit

given below is very important and should be strictly adhered to “Supply in 04 (Four) Months from the

date of issue of letter for commencement of the work”.

The bidders should furnish a list of orders for similar work executed by them and clearly mention the

name of the party for whom the works have completed. The reference of order number and date

performance report of such works be furnished in attached bidding at schedule.

The bids should be valid for a minimum period of 6 months from date of opening.

The prospective bidder shall have executed satisfactory similar worked as large magnitude in time and

have full fledge Engineering organization to handle this highly specialized skilled and intricate work and

The successful contractor shall have to sign an agreement as per GETCO’s rules on a stamp paper and

the specification and any other points which he would like to consider along with the tender. If such

These section are supplementary to each other and the particulars and requirement so contained have in

The contractor shall have to use the best quality of material to supply as per the specification and

relevant I.S. codes. In case GETCO desired to carry out any field test/laboratory test for any material

required for the work, the contactor shall arrange for the same at his own cost. The contractor shall

have to maintain the regular records for such testing & shall submit along with each R.A./FINAL bills.

No collection of material shall be made before it is approved form the Engineer-In-Charge.

Materials, if and when rejected by the Engineer-in-charge shall be immediately removed from site of

Approval to the sample of various materials given by the EIC shall not absolve the contractor from the

responsibility of replacing defective material brought on site or material used in the work found defective

at a later date. The contractor shall have no claim to any payment of compensation whatsoever on

account of any such material being rejected by E.I.C.

FOR PROCUREMENT OF GOODS OR SERVICES AND NON-WORKS CONTRACTS

(1) Amicable S e t t l e m e n t

Any dispute, difference, controversy or claim between the Parties arising out of or relating to this

contract with reference to the construction, interpretation, breach, termination or validity thereof

(hereinafter referred as "the Dispute") shall, upon the written request of either Party be referred to

t h e authorized representatives of the Disputing Parties for resolution. The authorized representatives

shall promptly meet and attempt to negotiate in good faith a resolution of the Dispute within thirty

days of the s ervice of the request.

(2) Arbitration

If the Parties fail to amicably resolve the disputes or differences or contrary claims as indicated

herewith in sub clause (1) of Clause, arising under or in connection with the present agreement, the

same shall be referred to the Arbitration Centre (Domestic and International) High Court of Gujarat at

Ahmedabad ("the Centre" for Short), currently functioning in the High Court Complex, Sola,

Ahmedabad for appointment of arbitrator and thereupon, the Centre shall appoint a sole arbitrator

and conduct the arbitration proceedings in accordance with its r ules. If the parties unanimously

agree to appoint three arbitrators, then in that case, each party shall appoint one arbitrator from the

panel of arbitrators of the Centre, and the Centre shall appoint the third arbitrator, who will act as the

Presiding Arbitrator. Such arbitration shall be the sole and exclusive remedy between the parties for

all disputes arising under or in connection with this agreement. The arbitration shall take place at the

Arbitration centre, Ahmedabad, High Court Complex, Sola, Ahmedabad, Gujarat in a c c o r d a n c e

with the provisions of the Arbitration and Conciliation Act, 1996 as amended from time to time and the

proceedings shall he conducted in English. The arbitration award shall be final and binding on the

7. The cost of damages, shortages, breakages will be recovered from the contractor’s bill. The

assessment of which will be done by field Engineer at his sole discretion and his decision shall be

binding to the contractor and shall be considered as final and unchallengeable.

8. The GETCO will not be responsible for any accident, injury etc. to the Contractor’s labour or any

disability to those persons, while supply or transport the materials. Any shortages / loss / damage to

Contractor`s equipments / tools-tackles during supply will be liability of the contractor.

9. Contractor will have to give indemnity bond to GETCO against any possible claim of compensation for

damage to GETCO equipments or staff or any other third party during the execution of whole job. If

for any reason, GETCO is called up on to pay any such claim or compensation, the same will be

recovered from the contractor`s bill any where pending with GETCO even at any later date.

10. The GETCO will not be in any case responsible for any delay in completing the job. No extra charge

for any matter whatsoever will be paid to the contractor. If contractor fails to execute the job in

reasonable time, the job will be done at contractors risk and cost. Penalty/additional expenditure as

per GETCO rules will be levied and will be recovered from the contractors running bills/deposit etc.

Tr. Circle / Const. Circle under NADIAD Tr. Circle GETCO.

20. In case of any dispute or doubt, the decision of Superintending Engineer (TR), NADIAD shall be final

and binding to the contractor.

21. All the general terms and conditions of the GETCO’S contract booklet shall be applicable in this

22. The GETCO reserves the right to terminate this rate contract at any time during its tendency without

giving notice of termination or any reason thereof. GETCO reserves the right to reject any OR all

tenders without assigning any reasons thereof.

23. If the contractor will fail to arrange to execute the job in time and due to this any revenue loss

occurs, the same will be recovered from the contractor.

24. The GETCO shall deduct the income-tax or any other levy duly as per Government Law/prevailing

rules from each & every bill.

25. Any dispute arising out of these tender documents will be subject to NADIAD jurisdiction.

26. If the work is not completed in time after issue of sub-order, the contractor shall be liable to pay

penalty up to ½% per week of the total amount subject to maximum of 10% recovered on the

➢ PAYMENT OF BILLS :

As per Annexure-A, party has to supply allocated quantity to various division & submit separate bill for

concerned division for timely payment.

Payment shall be made by the Corporation, through RTGS only for the materials supplied as per Corporation's

standard payment terms and conditions. 80% of Ex-Work price including 100% of F&I, Taxes & duties, within

30 (Thirty) days, from the date of receipt of material in good condition OR from the date of TRC whichever is

earlier on verifying required documents as per A/T conditions i.e. after verifying the invoices and other related

documents, approval of test certificates and on your furnishing certificates of proper Dispatch of the goods in

the form attached which would be sent to Executive Engineer (TR) Division Office, Gujarat Energy

Transmission Corporation Ltd, along with the copy of invoice.

You should upload the original Invoice & relevant documents which are digitally signed by Vendors /

Suppliers/Contractors on Vendor Management System (VMS) Portal, www.vms.guvnl.com. The

➢ DEPARTURE FROM SPECIFICATION AND DRAWINGS :

Should be tenderer wish to depart from the specification in any respect, they should draw attention to such

departure giving his reasons thereof and should get approved the case. However, in case of any clarification

the decision of Engineer-in-charge will be final and binding.

➢ PROGRESS OF WORK AND PENALTY :

If party will not be able to supply materials as per time limit, ½% penalty per week for the balance materials

& subject to the maximum of 10% will be levied.

➢ SPECIAL CONDITIONS OF THE CONTRACT :

➢ Quantities mentioned in scheduled are approximate and before ordering any materials prior

permission from the Deputy Engineer in-charge shall be taken and nothing extra will be paid for the

material collected in excess.

➢ The contractors quoting for this tender are deemed to have gone through supply terms &

ADDITIONAL COMMERCIAL TERMS & CONDITIONS:

The contractor shall be responsible for the breakages / losses and theft of materials from site and the

appropriate cost will be recovered from the contractor for any damage / loss to the GETCO’s equipments.

As regards damages to the materials / equipments and worker of the Contractor, the Contractor will only

be responsible and the Contractor is liable to pay compensation as per the “WORKMAN COMPENSATION

(3) In consideration of the due provision, executions, completion of the Supply, as

repeat order, if any as per the terms & conditions of the LOA

(7) Any Notice in connection with the Supply including the Notice for termination may be

given by the Purchaser or any Authorized Officer for the said purpose as per the

(8) If subject to the circumstances beyond control i.e. Force Majeure conditions, the

damages) at the rate of ½% of the contract price / order price per week or part thereof plus GST subject

to a maximum of 10% of the total contract value / order value (i.e. End cost including taxes & duties)

plus GST & not on uncompleted portion.

7. Bidder should keep their commercial terms and conditions similar in both technical Bid as well as in price

Bid. They should not differ in any of the bid. Only prices should be submitted in only Price Bid and

not with the Technical bid. Rate are Quoted in N-code Online Schedule –table

8. The tender received after time and date specified in the tender notice, will not be accepted. Once the offer

submitted by the contractor before due date of submission, the contractor will not be allowed to submit

revised / additional / modified offer after opening of Technical Bid.

9. Supplier shall have to submit –Online self attested attachment in N-code all the necessary

documents like material Test certificate, other required test certificates, guarantee certificate, invoice etc

along with supply as per the order terms. Without relevant required documents, further process of

payment will not be initiated.

12. SE, Nadiad reserves the right to place repeat order // additional orders on the successful tenderer’s up to

50% of the original quantity of the A/T at the same price, terms & conditions stipulated in the original

contract and within 04 months after completion of the delivery period.

13. If require, GETCO engineer will inspect the material before dispatch. Successful bidder will have to supply

material only after inspection or intimation by the under sign.

14. GETCO reserves the right to reject part or full quantity, if supplied quantity will be found undersize or

improper in quality or not as per the specification. Contractor will have to replace the improper material

quantity at their own expense or amount of the same will be deducted from his bill.

15. Sample should be submitted with technical bid otherwise agency will be disqualified & his price bid will not
