1. Separation into Supply and Erection is only for convenience and better economic management and for
the ease of Accountancy but the entire Contract, is to be assessed under GST Law, as the Works Contract
Service, which is as per the provisions of Section 2(30), read with, section 2(119), further read with,
Paragraph 6(a) of the Schedule II to the CGST Act 2017 or SGST Act 2017 and similar provisions,
applicable under the UTGST Act 2017 and the IGST Act 2017 and the entire activity, would be subjected
to levy of Tax at the rate of 9% CGST + 9% SGST or 18% IGST, under the GST Law.

SECTION 1: INSTRUCTIONS TO BIDDERS
This part, Instruction to Bidders (ITB), Section-1 of the Bidding Documents provides the information
necessary for bidders to prepare responsive bids for laying of underground HT cable network with
terminations under UGVCL area. The UGVCL hereinafter called 'Owner' will receive bids in respect of
laying of underground HT cable network with terminations to be furnished in the accompanying
specifications. All bids shall be prepared and submitted by bidders in accordance with instructions.
2 GENERAL INSTRUCTION
2.1 The Executive Engineer, UGVCL having its Office at, Vijapur Division, hereafter called the " UGVCL
" intends to invite tender for laying of underground HT cable network with terminations under

from - -2023. The complete Bidding Documents shall be available at Government e-procurement
portal https://nprocure.com.
2.3 Bids submitted after the time and date fixed for receipt of bids as set out in the INVITATION to
Bid shall be rejected.
2.4 The works referred herein shall cover the entire scope of the Bid which include as per describe in
scope of work, laying of cable testing and commissioning under selected UGVCL area, including the
successful completion of performance and tests which the UGVCL desires to get executed.
2.5 The issuance of bid document would not mean that the bidder has qualified for the bidding.
Hence bidders should ensure themselves of their credentials before submitting their offer.
2.6 Documents towards payment of Tender fee and earnest money deposit (EMD) should be kept in
the Tender Fee and EMD cover only. First the Tender Fee & EMD cover will be opened and if the
documents towards payment of Tender fee and EMD are found in order then only online techno-
commercial bid shall be opened first. All those who are found technically and commercially
competent to carry out the job will be considered as qualified bidders and only their price bid will be
2.7 At any time prior to the deadline for submission of bids, UGVCL may, for any reason, whether at
its own initiative or in response to a clarification requested by the Bidders, may modify the terms and
conditions by issuing amendment in the UGVCL website, bidder must be vigil as this addenda`s will
be uploaded only.
2.8 UGVCL reserves the right to spread / split the order, if required.

2.9 Bidder does not anticipate change in the ownership during the proposed period of work. (If such
a change is anticipated, the scope and effect thereof shall be defined.
2.10 UGVCL reserves the rights to instruct the contractor for carry out the works anywhere in the
jurisdiction of UGVCL and accordingly contractor shall carry out the work as per the same rate and
terms and condition of contract.
2.11 If at any stage it is found that bidder had hidden material information or had submitted
information which is false and fraudulent shall be debarred from bidding in UGVCL, tender for three
years and EMD shall be forfeited. The matter shall also be brought to notice to the registration
authority of the contractor
2.12 The bidder shall be disqualified if;
a. The bidder had made misleading or false representation in the forms, statements and
attachment submitted in proof of qualification requirements and/or
b. A record of poor performance such as abandoning the work, not properly completing the
contract, inordinate delays in completion, litigation history or financial failures etc.
c. Every bidder should at the time of submission of bid, give a declaration that bidder and / or
proprietor / partner / director of the firm has not been placed on stop dealing / banned for
business dealing / blacklisting by GUVNL and its subsidiary companies.
The bidder should provide accurate information on litigation and/ or arbitration resulting from
contract completed or under execution by him over the last five years. A consistent history of
arbitration awards/ judgments against the applicant or any partner of a joint venture may result in
disqualification for proposed work. If the details of litigation history are hidden by the applicant and
later on it comes to knowledge of the employer the bidder shall be disqualified for the proposed
work and other appropriate actions shall be taken against the bidder.
UGVCL would have the right to forfeit the EMD and black list to the bidder if any of the information
given by the bidder is found false / wrong or incorrect or misleading.
3 Bid Submission and Contents of Standard E-Bidding Document
3.1 The Bidders must ensure that all the schedules are completely filled in their Bids and the
information called for is given in totality. A set of complete Bid documents is required to be
submitted duly signed and stamped by authority competent to sign on behalf of bidder on each page
of bid as well as amendment thereof as a token of unconditional acceptance to the conditions of
various clauses of Bid documents through online mode on e-procurement module. The bidder's bid
and the documents attached there to shall be considered for forming part of the contract
3.2 The outside of the envelope for Tender Fee and EMD Submission in case of paid through DD /
Bank Guarantee should also indicate clearly the name of the Bidder and his address. In addition, the
left-hand corner of the envelope or container should indicate the Bid number and the bid opening

3). Work experience certificate in GUVNL/GETCO or any other similar type of fabrication
work executed by fabricator like welding,drilling,cutting,threading,bending etc
presenting bills copy for fresh contractor with minimum 3 years of various fabrication
work experience or UGVCL line material fabrication work experience required by
participating firm.
4).Group Insurance-copy of the insurance policy of the insured labour’s under W.C. Act.
5).Attested Copy of power of attorney, if any, for signing the bid documents, if partnership
firm/company if applicable.
6). GST Registration no and Registration certificate.
7). PAN Card and Latest income tax return.

The prices are excluding GST and Service Tax as applicable, which will be paid extra on a
given taxable goods and/or services within the original contractual delivery period. The
amount and % of GST as applicable should clearly be indicated separately. (GST means all

State for Loss of Revenue) Act, CGST Act, UGST Act and SGST Act, 2017and all related
ancillary legislations).
Supplier/Contractor should charge GST in Invoice at the rate as agreed to / mentioned in
acceptance of tender only and any deviation in the same shall not be accepted. Further,
any additional liability of GST (later on due to wrong mentioning of GST rate mis-
interpretation of HSN/SAC Code, etc.) over and above as charged in the invoice shall be
borne by the Supplier/Contractor. However, any refund received by the supplier /
contractor on account of GST charged from the company; such refund shall have to be
passed on to the company, along with interest if any. Such refund along with interest
needs to be passed on suo-motu by the supplier / contractor.
Further, the Company has a right to recover the amount of GST along with penal interest at
the rate of 15% per annum or interest/fees & penalty charged under GST Law, whichever is
higher if GST charged is not paid / short paid to the government or failed to upload the
details or uploads inaccurate particulars on GSTIN portal by the Supplier / Contractor
within the stipulated time limit. In case, Govt. revises the rate of GST rate / Code during
the tenure of the contract, the provision of UGVCL’s statutory variation clause shall apply.
STATUTORY VARIATION:
Any statutory increase or decrease in the taxes and duties including GST and Cess as
applicable or in the event of introduction of new tax/cess or cessation of existing tax/cess
subsequent to contractors offer if it takes place within the original contractual delivery
date will be to COMPANY’s account subject to the claim being supported by documentary
evidence. However, if any decrease takes place after the contractual delivery date, the
advantage will have to be passed on to COMPANY.
Important instructions for submitting the Tender.
1.0 EARNEST MONEY DEPOSIT: (E.M.D.)
(i) E.M.D. at the rate of 1% of the Total value of the Parts quoted as per schedule B is payable. The
EMD is payable either in Cash or by Demand Draft in favor of the Uttar Gujarat Vij Company Ltd. on
any Scheduled / Nationalized Banks payable at Vijapur EMD COVER: The EMD Cover should contain
the following documents: [i.e. a), b) as under]
[a] Documents towards payment of Earnest Money Deposit (EMD) & Tender Fee may please be kept
in the EMD cover only. First the EMD cover will be opened & if the documents towards payment of
Tender Fee & EMD are found OK then only Technical Bid will be opened which may please be noted.
Tenders submitted without Earnest Money Deposit by the firms, will be rejected without entering in
to further correspondence in this regard and no reference will also be made.
[b] List of Orders executed including electrical work carried out in any DISCOM Viz
UGVCL/PGVCL/MGVCL/DGVCL. EMD will be forfeited (i) if the tender, which it covers, is withdrawn
during the validity of the offer and

(ii) the Tenderer fails to furnish / deposit the Performance Guarantee towards Execution Period
( security deposit ) .EMD of the unsuccessful tenderer’s will be returned within 60 days of placing of
the order with the successful Tenderer subject to the Tenderer returning the original receipt of the
EMD together with the advance stamped receipt, to the Account Officer (Expenditure) of UGVCL,
Vijapur. EMD will be returned to the successful bidders, only on their submission of performance
guarantee towards execution period against order released on them. Bidders should complete the
tender documents in all respects and it should be signed by contractor with Company’s seal on all
(iii) Earnest money deposit will be forfeited in case the successful tenderer after his tender has been
accepted shall refuse to pay the prescribed security deposit and execute the contract.
2.0 The bidders shall submit their offer without any deviations in general terms and conditions of the
contract or in Technical specification/items. Tenders of such deviations may also be rejected.
Incomplete and conditional tenders shall not be considered.
3.0 UTTAR GUJARAT VIJ COMPANY LTD reserves the right to split up the work covered in the scope of
this contract amongst more than one contractor.
4.0 Intending bidders should submit their tenders after studying all tenders documents carefully and
visiting the site for satisfying themselves of actual site conditions, location and accessibility of site
and nature, extent of the work involved etc. Submission of tenders implies that bidders have
obtained all necessary information and other data required for executing the work and read all the
terms and conditions. No claim for extra charges on account of any misunderstanding will be
5.0 All approaches to the site shall be in the scope of bidders.
6.0 Bidders will not be allowed to give sub-contract of the works awarded to him for any, reasons
what so ever without written permission of competent authority.
7.0 In the experience certificate, contractor has to furnish the details of similar works executed by
him along with the list of equipment, tools and tackles and manpower available with him.
8.0 Price quoted shall be firm, till overall completion of the work, under contract and there will not
be any price escalation.
9.0 VALIDITY OF THE OFFERS:
The offers will have to be kept valid for a period of 180 days from the date of opening of technical
bids. In case of finalization of the tender is likely to be delayed, the tenderers will be asked to extend
the same without change in the prices or any terms and conditions of the offer. If any change is
made, original or during the extended validity period, the offers will be liable for outright rejection
without entering into further correspondence in this regard and no reference will also be made.
10.0 Tenders, which do not fulfill all or any of the conditions of the tender of incomplete in any
respect, are liable for rejection.
11.0 Uttar Gujarat Vij Company Ltd. reserves the right to reject any or all tenders without assigning
any reason thereof.

12.0 The tenderer’s own conditions of the contract will not be considered as forming the part of the
tender. The tenderers must send in their tenders, only if the Company’s conditions are acceptable to
13.0 The rate quoted should be in percentage higher /lower/rate to rate. The rates shall be quoted
both in words and figures as per unit specified in schedule-‘B’ in case of any discrepancy between the
rates quoted in words & figures, rate quoted in words will prevail. A Cello tape must be adhered on
rates provided by the contractor along with signature and stamp.
14.0 Revision of prices or any commercial terms affecting the price after opening of technical bids
shall not be considered and will be ignored.
15.0 Each part is treated as a separate tender
16.0 Jurisdiction for execution of work under each Part will be decided by UGVCL at the time of issue
17.0 In case of equally quoted rate by two different contractors the rates quoted by contractor
working with Vijapur DIVISION OFFICE right now shall be preferred.
18.0 TERMS OF PAYMENT:
The payment will be made to the contractor by RTGS subject to an advance stamped receipt being
received from payee and details of Accounts for RTGS in prescribed format.
19.0 SUBMISSION OF ACCOUNTS BY CONTRACTOR:-
The contractor shall submit materials account with each R. A. Bill also he shall on completion of the
work have to prepare and render the final detailed materials account of the materials received by
him from the Company’s store within one month from the date of completion of work if however the
contractor does not render the materials accounts a notice shall be issued to be contractor under
Registered A.D. to render the materials account within ten days from the date of issue of the notice
in default, the materials account and procedure which shall have to be accepted by the contractor
and disputes if any raised shall not be entertained the balance materials also will have to returned by
the contractor within one month from the date of completion of work otherwise Company is not
liable to accepted at a of date.
20.0 The contactor will not be allowed to transfer materials from one work to another without
written permission of the field officer justifying the reasons for such transfer.
21.0 Price bid will be opened for those bidders who are technically qualified.
22.0 MS Angle 50 x 50 x 6 mm / MS Angle 65 x 65 x 6 mm / MS round bar 16 mm2 / MS Flat 50 x
mm / MS channel 100 x 50 x 6 mm /GI Wire No.8 will be supplied by UGVCL at your work site &
Fabricated Material will be collect by UGVCL itself, if Work site should be within range of 10 Km from

23.0 If Work site is not within range as per Sr no.22.0 carting of Raw material & Fabricated material
should be arrange by bidder as per instruction of E.I.C as and when require.
24.0 Scrap should not be more than 1.5 %. No any percentage margin will not be allowed (i.e. Raw
material wt. = Ready material wt. + Scrap wt.)
25.0 Tikadi & etc scrap should not credit back to UGVCL. So Bidder should bid accordingly.

26.0 Fabrication should be done as per drawings & specification / Sample & Instruction of E-I-C.
27.0 In all fabrication item of Schedule-B, Quantity may be change as per requirement within total
amount of order
28.0 If the contractor having any work order or supply order under respective Division office &
security deposited not paid till the date of display of this tender, then it is considered such contractor
is negligent to complete work in stipulated time limit and not achieving work progress as per UGVCL
requirement & which may leads probability of accident. Thus such may have not
started/(commenced) work., Then such contactor will technically have disqualified only for this
tender & price bid will not be opened without intimating reason thereof
GENERAL CONDITIONS:
1. Time limit 24 Months from the date of the order issued.

1). Earnest Money Deposit:- Earnest Money Deposit 10 % of the estimated cost or minimum Rs.
500 or indicated on the Tender copy should be paid by the tendered along with the tender fee in
cash or by Demand Draft on any Schedule bank in favor of UGVCL in which cash receipt shall be
attached with Tender invariably. Tender without EMD will not be considered for acceptance.
Earnest Money deposit will be forfeited in case the successful tender after his tender has been
accepted fails to pay the prescribed Security Deposit.
2). Acceptance of Tender:- The UGVCL does not bind itself to accept the lowest or any tender,
without giving any Reason is assigned for the rejection. It is also not binding on the UGVCL to
disclose any Analysis reports on the tender. Conditionally tender will not be accepted.
3). Security Deposit:- The lowest tender whose tender is accepted shall have to pay 5% Security
deposit of the Order value within 10 days from the receipt of the acceptance order. If you fail to
supply the material within time limit your security deposit will be forfeited.
4). Jurisdiction:- Any dispute of difference arising under this connection with contract shall be
subject to the exclusive jurisdiction of UGVCL VIjapur DIVISION. The work should be carried out
strictly as per specifications and approved designs of the Company which will be supplied by the
Engineer In-charge for reference at the request of the contractor. The inferior and unsatisfactory
work is liable to be rejected.
5). General:- All tender must be submitted in forms provided by this office and must be clearly &
legibly Filled in the tenders should be filled in ink. The tendered are requested to sign wherever
mentioned in tender and schedule or rates and if not signed the tender shall be rejected.
6). Acceptance of Tender:- The Company does not bind to accept the lowest or any tender with any
reason for the rejection. It is also not binding on the company to disclose any analysis reports on the
tender. Accepting authority reserves the right of rejection of any or all tenders without assigning any

reason thereof. Any tender which does not comply the pre-qualification criteria is liable to be
7). Commercial & Technical Specifications of the work stated in subject are as per UGVCL &
Formerly GEB norms and conditions. The successful supplier will have to sign on agreement as
per the UGVCL’s rules on a stamped paper and the necessary stamp duly charges shall be borne
by the supplier.
8) If the work is not completed within the scheduled period as prescribed in Sub Work
Order, penalty shall be @ 0.5% per Week or part thereof plus applicable tax (if any) subject
to ceiling of 10% plus applicable tax (if any) of the Sub Order Value with GST and Cess as
applicable rates. This will be deducted from the bills payable either against this contract or
any bank guarantee or any other amount payable under any contract with the UGVCL.
9) No tools will be supplied by the department. The work if found inferior and not up to standard of
the Company's is liable to be rejected at the risk and cost of the contractor. Any expenditure incurred
for Rectification work carried out departmentally or by employing hangami labour will be recovered
from his R.A bills, if the contractor fails to rectify the inferior work done by him in spite of the
instructions to Rectify the same.
10) Contract Documents:
The lowest tenderer whose tender is accepted will have to execute a stamped agreement in standard
Form with the company and will have to sign the contract booklet viz Tender and contract for works
at his own cost. In case of partnership firms, necessary partnership documents, in original along with
its copy will have to be produced for verification along with authority to sign the bills measurement
and enter in to contract as well as correspondence with the company. Wherever required necessary
power of attorney will have to be produced especially when the partnership deed is silent on the
point of authority to deal with the Company. The contractor will have to execute the documents and
sign the booklet “Tender and contract for work” before starting the work. If a contractor happens to
be a sole trader he will have to produce an affidavit made before Magistrate to that effect.
The company’s general conditions of contract will apply to all the contractors and he is
deemed to be fully aware of the company’s general conditions of contract for the works in respect of
security deposits, penalty for late completion of work etc. and any ignorance of these conditions will
not exempt the contractor from the liability to abide by the same. Submission of a tender by a
tenderer implies that he has read that the instructions and conditions of contract contained in
booklet and has made himself aware of the scope and specification of the work to be done and of
the conditions and rate at which stores etc. will be issued to him and local conditions and other
factors bearing on the execution of work. If the contractor stands lowest for more than one Part it
will be at the discretion of the competent authority whether to award more than one Part of work or
not without assigning any reason thereof.

B. The Company is not liable for any injury on damage to contractor’s workman or his equipment
respectively during execution of this contract and the Company will not pay any compensation for
any reasons whatsoever. The contractor is also responsible for any damage to private property
C. Contractors should observe all the safety rules during execution of work.
D. The contractor will have to see that labours working on the site should be utilize all safety
equipment if any labours found without safety equipment at site during execution of work it is fully
responsibility of contractor for any accident occurred.
12) Price Evaluation: - No Price preference shall be given on any account. All tenders shall be
evaluated on the basis of firm price End cost including GST and cess. If the tender is invited
with Total Owning Cost (TOC) Clause, The Evaluation shall be done accordingly. For the same,
the bidders have to give detailed breakup of the end cost
