   "Purchase will be made from the OEMs [i.e., M/s ESAB, M/s OTC Daihen, M/s Kemppi, M/s Abicor Binzel, M/s Keean and M/s Ador only] or their authorized dealers, supported by either a tender-specific authorization from the OEM or a valid dealer/distributor certificate issued by the OEM" otherwise their offer will be summarily rejected.

   Offers received without make/brands or with vague mentions like "0", NIL, "as per tender" etc will be rejected. Participating firms should mention their offered Make/Brand against tendered item in the corresponding Make/Brand column without fail.    Failure consequences: In case the firm fails to execute the contract within the original delivery period, the purchaser will be entitled to impose liquidated damages for extension of delivery period. For any reason, if the supplier fails to supply goods as per the conditions of contract, as amended from time to time, Purchaser shall have the right to levy damages from the supplier for failing to comply with the contractual conditions, not by the way of penalty, an amount equal to 5% of the defaulted order amount. These damages shall be treated as recoveries outstanding against the vendor and dealt with accordingly.
