1. The information contained in this Request for Proposal document (the “RFP”) or subsequently
provided to Bidder(s), whether verbally or in documentary or any other form by or on behalf of the
Tourism Corporation of Gujarat Limited (the “Authority") or any of its employees or advisors, is
provided to Bidder(s) on the terms and conditions set out in this RFP and such other terms and
conditions subject to which such information is provided.
2. This RFP is neither an agreement nor an offer by the Authority to the prospective Bidders or any
other person. The purpose of this RFP is to provide interested parties with information that may be
useful to them in making their financial offers (Bids) pursuant to this RFP. This RFP includes
statements, which reflect various assumptions and assessments arrived at by the Authority in relation
to the Project. Such assumptions, assessments and statements do not purport to contain all the
information that each Bidder may require. This RFP may not be appropriate for all persons, and it is
not possible for the Authority, its employees or advisors to consider the investment objectives,
financial situation and particular needs of each Bidder who reads or uses this RFP. The assumptions,
assessments, statements and information contained in the Bidding Documents, especially details
regarding the project sites, may not be complete, accurate, adequate or correct. Each Bidder should,
therefore, conduct its own investigations and analysis and should check the accuracy, adequacy,
correctness, reliability and completeness of the assumptions, assessments, statements and
information contained in this RFP and obtain independent advice from appropriate sources.
3. Information provided in this RFP to the Bidder(s) is on a wide range of matters, some of which may
depend upon interpretation of law. The information given is not intended to be an exhaustive account
of statutory requirements and should not be regarded as a complete or authoritative statement of law.
Authority accepts no responsibility for the accuracy or otherwise for any interpretation or opinion on
law expressed herein.
4. Authority, its employees and advisors make no representation or warranty and shall have no liability
to any person, including any applicant or Bidder under any law, statute, rules or regulations or tort,
principles of restitution or unjust enrichment or otherwise for any loss, damages, cost or expense
which may arise from or be incurred or suffered on account of anything contained in this RFP or
otherwise, including the accuracy, adequacy, correctness, completeness or reliability of the RFP and
any assessment, assumption, statement or information contained therein or deemed to form part of
this RFP or arising in any way for participation in this bid stage.
5. Authority also accepts no liability of any nature whether resulting from negligence or otherwise
howsoever caused arising from reliance of any Bidder upon the statements contained in this RFP.
6. Authority may in its absolute discretion prior to the Bid Due Date, but without being under any
obligation to do so, update, amend or supplement the information, assessment or assumptions
contained in this RFP at anytime during the Bidding Process.
7. The issuance of this RFP does not imply that the Authority is bound to select a Bidder or to appoint
the Preferred Bidder or Agency, as the case may be, for the Project and Authority reserves the right

to reject all or any of the Bidders or Bids without assigning any reason whatsoever. Mere submission
of a responsive Bid does not ensure selection of the bidder as Agency.
8. The Bidder shall bear all its costs associated with or relating to the preparation and submission of its
Bid including but not limited to preparation, copying, postage, delivery fees, expenses associated
with any demonstrations or presentations which may be required by Authority, or any other costs
incurred in connection with or relating to its Bid. All such costs and expenses will remain with the
Bidder and Authority shall not be liable in any manner whatsoever for the same or for any other costs
or other expenses incurred by a Bidder in preparation or submission of the Bid, regardless of the
conduct or outcome of the Bidding Process.

In the interpretation of this RFP, unless the context otherwise requires:
1. The singular of any defined term includes the plural and vice versa, and any word or expression
defined in the singular has the corresponding meaning used in the plural and vice versa;
2. Reference to any gender includes the other genders;
3. Unless otherwise stated, a reference to a Clause, Sub-Clause, Paragraph, Subparagraph, Annex,
Exhibit, Attachment, Schedule or Recital is a reference to a Clause, Sub-Clause, Paragraph,
Subparagraph, Annex, Exhibit, Attachment, Schedule or Recital of this RFP;
4. A reference to any agreement is a reference to that agreement and all annexes, attachments,
exhibits, schedules, appendices and the like incorporated therein, as the same may be amended,
modified, supplemented, waived, varied, added to, substituted, replaced, renewed or extended,
from time to time, in accordance with the terms thereof;
5. The terms “include” and “including” shall be deemed to be followed by the words “without limitation”,
whether or not so followed;
6. Any reference to a person shall include such person’s successors and permitted assigns;
7. A reference to a “writing” or “written” includes printing, typing, lithography and other means of
reproducing words in a visible form;
8. Any date or period set forth in this RFP shall be such date or period as may be extended pursuant
to the terms of this RFP;
9. A reference to “month” shall mean a calendar month, a reference to “week” shall mean a calendar
week and a reference to “day” shall mean a calendar day, unless otherwise specified.
10. The terms “hereof”, “herein”, “hereto”, “hereunder” or similar expressions used in this RFP mean
and refer to this RFP and not to any particular Article, Clause or Section of this RFP. The terms
“Article”, “Clause”, “Paragraph” and “Schedule” mean and refer to the Article, Clause, Paragraph
and Schedule of this RFP so specified;
11. The descriptive headings of Articles and Sections are inserted solely for convenience of reference
and are not intended as complete or accurate descriptions of content thereof and shall not be used
to interpret the provisions of the Agreement; and
12. All capitalized words and expressions used in the RFP but not defined therein shall have the same
meaning as ascribed to them in the License Agreement.

In this RFP Document, unless the context otherwise requires or provides for, the following words and
expressions shall have the meanings as are hereinafter respectively assigned to them:
a. “Authority” or “Licensor” or “TCGL” shall mean Tourism Corporation of Gujarat Limited;
b. “Agreement” or “License Agreement” shall mean the legal document, including recitals,
schedules and attachments which may be amended, supplemented or modified in accordance with
the provisions, as executed between TCGL and the Selected Agency;
c. “Bid” means the documents in their entire form submitted by the Bidder in response to the Tender
issued by the Licensor in accordance with the provisions thereof;
d. “Bidding Process” shall mean the entire process commencing from the uploading of the tender
documents, pre-bid meeting, technical and financial bid submission, evaluation and the award of
the work (unless the authority decides to terminate the bidding process at any point of time before
its successful completion)
e. “Bidder” shall mean such Person {a legal entity in the form of proprietorship / partnership firm
(including LLP) or a company incorporated in India} who / which (as the case may be) has
submitted a bid pursuant to the Tender;
f. “Bid Due Date” shall mean the last date for submission of Bids,
g. “Business Day” shall mean such day on which the offices of the Gujarat Government are open for
h. “Conflict of Interest” shall have the meaning set out at Clause 1.2.3;
i. “Earnest Money Deposit” or “EMD” shall mean an amount of Rs. 5,00,000 to be submitted by the
Bidder along with its Bid;
j. “Letter of Award” or “LOA” shall mean the letter issued to the Preferred Bidder by TCGL.
k. “Operation & Maintenance Period” is the period commencing from the signing of Agreement and
shall extend for a period of 5 (five) years. The said period is inclusive of a maximum period of
30 days for initiation of services following the execution of the License Agreement.
l. “Person” shall mean to include a legal entity in the form of proprietorship / partnership firm
(including LLP) or a company incorporated in India;
m. “Preferred Bidder” or “Agency” or “Operator” shall mean the “Technically Eligible Bidder” who
has sought the lowest grant and whose bid has been accepted by the Authority and has been
issued a Letter of Award;
n. “Project Facilities” means collectively the facilities created / constructed at National Salt
Satyagrah Memorial (NSSM), Saifee Villa and Tourist Facilitation Centre including associated
installations, equipment, furniture and fixtures and other assets (if any) created / upgraded by the
o. “Restrictive Practice” means forming a cartel or arriving at any understanding or arrangement
among Bidders with the objective of restricting or manipulating a full and fair competition in the
bidding process;

p. “Technical Requirements” shall mean the technical conditions, as set out in Section 2.2, that are
to be satisfied by a Bidder;
q. “Tender” shall mean this document and the corrigenda (if applicable) issued.
r. “Tender Fee” shall mean an amount of Rs. 5,000 to be paid by the Bidder along with its Bid;
s. “Undesirable Practice” means (i) establishing contact with any person connected with or
employed or engaged by the Authority with the objective of canvassing, lobbying or in any manner
influencing or attempting to influence the bidding process; or (ii) having a Conflict of Interest;

1. Information to Bidders
1.1.1 The Tourism Corporation of Gujarat Ltd. (the “Authority” or “TCGL”) incorporated under
Companies Act, 1956, is a 100 (one hundred) percent subsidiary of Government of Gujarat.
TCGL is engaged in focused development of tourism and related infrastructure across the state
1.1.2 As a part of its initiatives towards upkeep and maintenance of tourist infrastructure, Authority
intends to select an Agency which can offer services, as per terms of this RFP, at National Salt
Satyagrah Memorial (NSSM), Saifee Villa and Tourist Facilitation Centre in Dandi.
1.1.3 The NSSM is conceived as an experiential journey recreating the spirit and the energy of the
1930 Dandi March led by Mahatma Gandhi and taking the visitors to the Monument step-by-step
in order to visualize and understand the history of the iconic Dandi March and the methodology
of Satyagraha, which contributed to India’s Independence from the British colonial rule.
1.1.4 The Saifee Villa is a bungalow located adjacent to the NSSM, where Mahatma Gandhi spent the
night on April 5th, 1930, prior to the momentous Salt Satyagraha event against the Salt Law
enforced by the British colonial government.
1.1.5 The Tourist Facilitation Centre (TFC) has been developed by the Authority and provides
support infrastructure to the tourists visiting NSSM and Saifee villa. The NSSM has space for
entry ticket counter, space for ATM, parking, Handicraft stalls, Prarthna Hall, Display Gallery,
Garden, Children play area, Restaurant, Rest rooms etc
1.1.6 The Authority now intends to select an Agency which can offer services towards a) Overall visitor
facilitation, b) overall operation, maintenance and management of the sites, c) housekeeping,
sanitation, landscaping and security services, and d) conceptualization and periodically
organizing of various events at the sites of National Salt Satyagrah Memorial (NSSM), Saifee
Villa and Tourist Facilitation Centre in Dandi. The detailed scope of work is placed in Section
1.1.7 Bidders are advised to take note that the Project Facilities shall be handed over on an “as
is where is basis”. Bidders are advised to undertake site visit, prior to filling the bid, to
ascertain the condition of the Project Facilities vis a vis the anticipated scope and level of
services as mentioned in the RFP Document and apply for the tender accordingly. Neither
any complaints regarding the Project Facilities or sub-standard services shall be accepted
nor any additional payments beyond the accepted financial bid shall be made by the
General Conditions
1.2.1 Bidders who wish to participate in online tender will have to procure / should have legally valid
Digital Certificate as per Information Technology Act - 2000 using which they can sign their
electronic bids. Bidders can procure the same from any of the license certifying Authority of India
or can contact (n)code solution-a division of GNFC Ltd., who are licensed Certifying Authority by
Government of India.

Bidders shall furnish all relevant information, as per the formats provided in the Request for
Proposal (the “RFP”).
1.2.2 Bids, as submitted by the Bidders, shall have a Bid Validity of 180 Days this from the Bid Due
Date. The Authority will make its best effort to complete negotiations within this period. Should
the need arise, however, the Authority may request Bidders to extend the validity period of their
Bids. Bidders who do not agree have the right to refuse to extend the validity of their Bids.
1.2.3 A Bidder shall be considered to be in conflict of interest with one or more Bidder in the same
bidding process if they have relation with each other, directly or indirectly or through any other
Person that puts them in a position to have access to information about or influence the bid of
another Bidder (“Conflict of Interest”). Any Bidder found to have a Conflict of Interest shall be
disqualified. In the event of disqualification, the Authority shall be entitled to forfeit and
appropriate the EMD or Performance Security, as the case may be, as mutually agreed genuine
pre-estimated loss and damage likely to be suffered and incurred by the Authority and not by way
of penalty for, inter alia, the time, cost and effort of the Authority, including consideration of such
Bidder’s proposal (the “Damages”), without prejudice to any other right or remedy that may be
available to the Authority under the tender documents and/ or the Agreement or otherwise.
Clarifications and Amendment of RFP Documents
1.3.1 Bidders may request clarification on any of the points contained in RFP documents up to the
number of days as indicated below. Any request for clarification must be sent in writing by paper,
mail, facsimile, or electronic mail to the Authority's address as indicated. The Authority will upload
response to all such requests received by it on the website https://tender.nprocure.com/. The
Authority may also upload response to all such requests received by it on the website
https://www.gujarattourism.com.
1.3.2 Queries, if any, proposed to be raised at the pre-bid conference by the Bidder/s should be
submitted in writing (over email or a letter) least two (2) working days before the date of the Pre-
Bid Conference to the Official as below:

A maximum of two representatives of each Bidder shall be allowed to participate in the
Pre-Bid Meeting.
1.3.3 At any time before the submission of Bids, the Authority may for any reason, whether at its own
initiative or in response to a clarification requested by a Bidder, modify the RFP documents by

amendment. Any such amendment shall be issued in writing through Corrigenda. Corrigenda

Preparation of Bids
1.5.1 The Bidders are required to submit the Bid in two parts in two separate envelopes / parts and put
together in one single outer envelope. The two parts shall be captioned as follows on the
respective envelopes:
(a) Part 1: Bid Processing Fee & EMD and
(b) Part 2: Technical Bid (Original)
Part 1: Bid Processing Fee and EMD (as per details provided in RFP)
1.5.2 Bids should be accompanied with Bid Processing Fee and EMD as per the terms of this RFP.
Bid submitted without Bid Processing Fee and / or EMD shall be summarily rejected and will not
1.5.3 The EMDs of all unsuccessful Bidders, except the Bidder (L2) next to the Preferred Bidder (L1),
will be returned without any interest, promptly, but not later than one month after the expiration
of the Bid validity period or within 15 days of issue of Letter of Award (LoA) to the Preferred
Bidder, whichever is earlier. The EMD of L2 will be returned within 15 days of signing of License
Agreement with the Preferred Bidder.
1.5.4 The EMD of L1 & L2 shall be extended beyond the original validity period in case the signing of
License Agreement is delayed due to any reason. Such extension shall however be as mutually

(i) If they withdraw their Bid after their Technical Bid has been accepted, or
(ii) In case Preferred Bidder fail to execute the License Agreement within 30 days from the
date of receipt of the Letter of Award, or
(iii) If they conceal any material information or make incorrect and misleading statements or
misrepresent facts in their Bid, or
(iv) Try to influence TCGL or any of its officials in relation to the evaluation of Bids;
TCGL shall have the right to forfeit their EMD and blacklist them from participating in any future
tenders issued by TCGL.
Part 2: Technical Bid
1.5.6 In preparing the Technical Bid, Bidders are expected to examine the submission documents /
format / enclosures etc., comprising this RFP in detail. Material deficiencies in providing the
information requested may result in rejection of the Bid.
1.5.7 The Technical Bid must provide the following information, using but not limited to the formats as
indicated below:
- Form 1: Technical Bid Submission Form
- Form 2: Format for Power of Attorney for Authorized Representative
- Form 3: Financial Summary of the Bidder
- Form 4: Format for Letter of Undertaking
- Form 5: Format for Showcasing Experience
- Form 6: Format for Team Profile
- Form 7: Format for Bank Guarantee
1.5.8 A soft copy of Technical Bid, in PDF format on pen drive, should also be placed in the cover
containing the Technical Bid
1.5.9 The Technical Bid must not include any financial information.
1.5.10 During evaluation of Bids, TCGL may, at its discretion, ask a Bidder for further clarifications and
/ or information. The request for clarification and the response thereto shall only be in writing.
The Bidder shall have to reply to the clarification within the period as specified from the date of
receipt of the request failing which the Authority shall evaluate the bid as it deems fit.
Part 3: Financial Bid – to be strictly submitted online only
1.5.11 In preparing the Financial Bid, Bidders are expected to take into account the requirements and
conditions of the RFP documents. Bidder should also include all costs associated with the
Project, including remuneration to the staff, consumables, rentals / fixed rates, transportation (for
mobilization and demobilization), services and equipment, provision of tourist infrastructure prior
to filling up of the Financial Bid.
1.5.12 The Financial Bid should clearly identify and include all the taxes, duties, fee, levies and other
charges imposed under the applicable law, on the Bidders, and their personnel, and include as
part of their offer, and show only GST separately.
1.5.13 Bidders have to express the price of their services in the format as indicated in the sample format

placed at Annexure 1: Financial Bid Submission Form (to be submitted online only on
https://tender.nprocure.com/).
1.5.14 Conditional Tenders / bids shall not be accepted.
Submission, Receipt and Opening of Bids
1.6.1 Bids should be submitted in an outer envelope clearly mentioning “RFP for Selection of an
Agency for Operation & Maintenance of National Salt Satyagrah Memorial (NSSM), Saifee
Villa and Tourist Facilitation Centre at Dandi, Gujarat”.
1.6.2 The Bid Processing Fee and the EMD must be in one Envelope (Cover-1) and Technical Bid
must be in another Envelope (Cover-2). The envelope must be clearly marked on top as
"Technical Bid”. The Financial Bid shall not be submitted along with the hardcopy
submission of Technical Bid, in printed form or pen drive.
1.6.3 The Bid shall be written in English only.
1.6.4 The Bid shall be prepared in indelible ink. It shall contain no inter-lineation or overwriting, except
as necessary to correct errors made by the Bidder. Any such corrections must be initialled by the
person who signs the Bids.
1.6.5 The bids, along with their relevant enclosures should be bound, paginated, with an index of
submission on the first page.
1.6.6 An authorized representative of the Bidder shall initial all pages of Technical Bid. The
representative's authorization shall be in the form of a written power of attorney accompanying
the Bid, or in any other form demonstrating that the representative has been duly authorized to

1.6.8 The completed Bids must be delivered / submitted on or before the submission time and date as
stated in Bidding Schedule. The Authority shall not be responsible for misplacement, losing or
pre-mature opening, if the outer envelope is not sealed and / or not marked as stipulated.
1.6.9 After the deadline for submission of Bids, the Technical Bid envelope shall be opened in the
presence of the Bidders / their Authorized Representatives who choose to attend on the date and
time indicated in the Bidding Schedule.
Important Note:
a. Bidders are required to be upload Technical as well as Financial bid on n-procure website,
https://tender.nprocure.com/, as per terms of this RFP.
b. The complete set of the Technical Bid only (including Forms, Letters, various
documentary proofs etc.), as being uploaded by the Bidder shall also be submitted in the
Hard copy, along with a copy of the same in a pen drive along with the Bid Submission.
c. Financial Bids are to be uploaded on the website only as mentioned in the RFP.

• The Financial Bid shall not be submitted with the Technical Bid. Submission of
Financial Bid along with Technical Bid (in hard copy or pen drive) will lead to the
disqualification of the Bidder.
Right of Rejection
1.7.1 Authority reserves the right to reject any or all Bids, to waive any informality in such Bids, to
request new Bids, to revise the RFP prior to, and including, the pre-bid meeting date, to proceed
to do the work otherwise, withdraw this RFP, not award the work, or not award a portion of work
1.7.2 The receipt of bids shall not in any way, obligate the Authority to enter into a License Agreement,
or any other agreement of any kind with the Bidder. All submitted copies of the bids shall become
the property of Authority.
1.7.3 The bid will be rejected for award if it is determined that the Bidder recommended for award has,
directly or through an agent, engaged in corrupt, fraudulent, collusive or coercive practices in
competing for the project in question.
1.7.4 A Bidder will be declared ineligible, either indefinitely or for a stated period of time, to be awarded
a project if Authority at any time determines that the Bidder has engaged in corrupt or fraudulent
practices in competing for or in executing, a project; and
1.7.5 A Bidder may be declared ineligible and /or blacklisted from further bidding with Authority for a
period as deemed fit by Authority, in case any misrepresentation of facts / details is found in the
bid as submitted by them at any point of time.

2. Evaluation of Bids
The following procedure shall be adopted in evaluating the bids:
Stage 1: Test of Responsiveness
2.1.1 Prior to evaluation of the documents contained in the Technical Bid envelope, the Authority shall
determine whether each Bid is responsive to the requirements set out in this Tender. A Bid shall
be considered responsive only if:
▪ It is received by the Bid due date including any extensions thereof.
▪ The Part-1 submission (Cover-1) shall contain the Bid Processing Fee and EMD as defined
o Bid Processing Fee: Bidder has to furnish, as part of its submission, non-refundable
Bid Processing Fee amounting to Rs. 5,000/- (i.e. Rupees Five Thousand only). The
Bid Processing Fee shall be submitted in the form of a Demand Draft (DD) drawn in
favour of Tourism Corporation of Gujarat Limited, payable at Gandhinagar.
o Earnest Money Deposit: Bidder has to furnish, as part of its submission, Bid Security /
Earnest Money Deposit amounting to Rs. 5,00,000 (Rupees Five lakhs only) in the
form of a Demand Draft / Bank Guarantee (Refer to Annexure 2 for List of Banks in
case Bid Security is being submitted in the form of Bank Guarantee. The format of
BG is placed in Form 7).
Note: Bidders must ensure that the purchaser of the DD towards Bid Processing
Fee and Earnest Money Deposit should be the Bidder only. DDs purchased under
the hand/in the name of any purchaser other than the bidder may render the bid
non-responsive.
o It does not contain any condition or qualifications, and it is not non-responsive in terms
Responsive Bids, fulfilling the criteria as given above, shall be evaluated as per Stage 2 given
Note: Bidders must take utmost care that the submission made by them shall also adhere
to the following:
▪ It is signed, sealed, bound together and marked as stipulated in this Request for Proposal
▪ It is received as per the formats prescribed in the Section 5 – Technical Bid Forms of the
Request for Proposal document.
▪ It contains information in formats same as those specified in this Request for Proposal
▪ It contains the necessary documentary proof as specified in the checklist mentioned in
Request for Proposal document.
▪ The validity period of the Demand Draft submitted towards the Bid Processing Fee shall
not be less than 60 (Sixty) days from the Bid Due Date.

▪ The validity period of the EMD, in case of DD, shall not be less than 60 (Sixty) days from
the Bid Due Date and in case of an BG, shall not be less than 180 (one hundred and
eighty) days from the Bid Due Date. The validity period of the DD (towards bid processing
fee and EMD) should be extended by as per the Bid Validity Period, if so desired by the
Authority. In both cases, the validity may be extended (beyond 180 days) by mutual
agreement between the Authority and the Bidder.
Stage 2: PQ Evaluation of Pre-qualification Criteria
Bidders who comply with the following basic criteria are eligible for participation in this tender:
2.2.1 Bidder should be a Company registered under the Companies Act of India, 1956 (or later) OR a
Partnership Firm (including LLP) OR Proprietorship Firm and should be in existence for at
least five years, in India as on the Bid issue date.
2.2.2 The Bidder must have recorded a Minimum Average Annual Turnover of Rs. 10.00 Cr.
(Rupees Ten crores only) in any three consecutive financial years in the last four financial
years (FY 2022-23 to 2025-26).
2.2.3 The Bidder must have provided services (completed or ongoing with a minimum continuous
period of 12 months), related to operation & maintenance and / or housekeeping and / or
security and / or facilities management and / or visitor facilitation and / or landscaping, during
the last 7 years, in India as on the bid issue date as below, for Government Clients:
▪ One similar work with a total fee not less than Rs. 4.00 crores (exclusive of taxes)
▪ Two similar works with a total fee not less than Rs. 2.50 crores (exclusive of taxes) each
▪ Three similar works with a total fee not less than Rs. 2.00 crores (exclusive of taxes)
a. At least one eligible project should be in a Tourist Site / Memorials / Monument / Spiritual
Complex / Heritage site / Exhibition Halls / Convention Centres / Museums /
Interpretation Centre or similar.
b. Bidder must have provided a minimum of 2 services out of the services as given below for
the projects to be considered eligible:
▪ Operation & Maintenance
▪ Facilities Management
▪ Visitor Facilitation
c. For projects that:
▪ Include scope elements beyond those explicitly listed above,
▪ Operate on a financial model where the net payable amount to or by the bidder is
calculated as revenue minus fee, or

▪ Are structured as Public-Private Partnership (PPP) projects wherein overall
Operations & Maintenance (O&M)—including any of the aforementioned activities—
is part of the scope,
the bidder must furnish documentary evidence from the client’s clearly substantiating the fee
component attributable solely to eligible services. Only upon such substantiation shall the
project be considered eligible for evaluation.
d. Standalone Manpower mandate, albeit towards providing resources on an outsourcing
basis, operation & maintenance and / or housekeeping and / or security and / or facilities
management and / or visitor facilitation and / or Landscaping shall not be considered
e. Decision of TCGL towards consideration of eligible projects shall be final and binding.
2.2.4 Bids qualifying as per the PQ Criteria, given above, will be eligible for the next stage of evaluation,
that is Stage 3: Technical Bid Evaluation.
Stage 3: Technical Bid Evaluation
2.2.5 The Authority will carry out evaluation of Technical Bids, based on the point / marks system as
specified in the Table below. Each pre-qualified bid shall be attributed a Technical Score. The
Bidders will also be required to give a presentation detailing various aspects as per the details
included in the Table below. Marks out of 100 shall be awarded as per the Technical Bid
Evaluation and the presentation before the Evaluation Committee.
2.2.6 The combined Technical Qualification and presentation would carry marks as below:

TOTAL MARKS 100 marks
1. For all the submitted projects, documentary evidence to substantiate the scope of work,
duration of engagement, completion / ongoing for at least 12 months, fee, location and any
other aspect for which marks are being sought shall be submitted in the form of Work Order,
Agreement, Completion Certificate from the Client is mandatory.

however, they must take note that the Authority may invite the bidders for technical
presentation at a short notice and they should be prepared with the same. No
extension in this regard shall be given at a later stage. The presentation should be
concise, not exceeding ~30 slides and covering all aspects as mentioned above in
table under section 2.2.6.
4. The Bidders must ensure that they submit Form 5 diligently as per the following

i. Bidder must note that eligible projects as per the criteria mentioned in this RFP (type,
fee, duration etc) shall only be listed under Form
ii. All projects as listed under Form 5 must be duly backed by the documentary evidence.
iii. Projects listed in the Form 5 only will be considered for evaluation. Authority shall
not be liable for not evaluating any project related documents which is included in the
bid, but the corresponding project is not reflected in Form
Stage 4: Financial Bid Evaluation:
2.2.7 After completion of the evaluation of Technical Bids, TCGL shall notify those Bidders whose bids
are found responsive and who have qualified in the Technical Evaluation for opening of the
Financial Bids. Bidders scoring at least 70 marks out of 100 marks in the technical evaluation
and at least 15 marks out of 30 marks in the Technical Presentation (the “Technically
Qualified Bidders”) shall be eligible for opening of their Financial Bids,
2.2.8 The Financial Bids shall be opened through the n-Procure portal in the presence of the Bidders
/ authorized representatives who choose to attend the process. The name of the Bidders and the
quoted Financial Bid shall be announced and recorded at the time of opening of the Financial
2.2.9 The Bidders shall carefully assess the scope of work, site conditions, deployment requirements,
machinery requirements, statutory compliances, and all other obligations under the RFP before
submitting their Financial Bid.
2.2.10 Technically Qualified Bidder quoting the lowest financial bid shall be the Preferred Bidder. The
Selected Agency shall be paid on a monthly basis, upon raising of invoices as below:
• Year 1: 0.8 X A

where “A” is the “Average Monthly Charges”, worked out based on the total O&M fee sought
by the Bidder, for a period of 5 years and as accepted by the Authority.
2.3.1 Prior to the expiration of period of validity of Bid, Authority shall notify the Preferred Bidder who
has emerged the L1 bidder and invite them to negotiate.
2.3.2 The Authority at its discretion may seek a further breakup of the financial bid from the Preferred
2.3.3 If negotiations fail, Authority will invite the second ranked bidder (L2), to negotiate.

2.4.1 After completion of negotiations with the Preferred Bidder, the Authority shall award the work to
the Preferred Bidder by issuing a Letter of Award.
2.4.2 The Preferred Bidder with whom the License Agreement (the “Agreement”) is signed is
expected to commence the Project on the date as indicated by the Authority during the
negotiation meeting.
2.4.3 The Preferred Bidder shall be required to submit a Performance Guarantee which shall be equal
to 5% of Annual O&M Fee (for that particular year) in the form of a Bank Guarantee to Tourism
Corporation of Gujarat Limited with a validity of 18 months. The same shall be renewed,
every year with the revised amount. The Performance Guarantee shall be submitted within
days of the issue of the Letter of Award (the “LoA”). Failing to adhere to the said conditions
might lead to the withdrawal of the Letter of Award. Additionally, 5% retention money from each
bill shall be deducted and released back, without any interest, on an annual basis, provided there
are no pending dues.

3. Other Conditions
3.1.1 Information relating to evaluation of Bids and recommendations concerning awards shall not be
disclosed to the Bidders who submitted the Bids or to other persons not officially concerned with
the process without the consent of the appropriate Authority.
3.1.2 The Agency, its Sub-Agencies and the Personnel of either of them shall not, either during the
term or within two years after the expiration or termination of this Agreement disclose any
proprietary information, including information relating to reports, footfalls, content of shows and
brochures, hardware and software design etc, whether written or oral, in electronic or magnetic
format, and the contents thereof; and any reports, digests or summaries created or derived from
any of the foregoing that is provided by the Authority to the Agency, its Sub-Agencies and the
Personnel; any information provided by or relating to the Authority, its technology, technical
processes, business affairs or finances or any information relating to the Authority’s employees,
officers or other professionals or suppliers customers, or contractors of the Authority; and any
other information which the Agency is under an obligation to keep confidential in relation to the
Project, the Services or this Agreement ("Confidential Information"), without the prior written
consent of the Authority.
3.1.3 Notwithstanding the aforesaid, the Agency, its Sub-Agencies and the Personnel of either of them
may disclose Confidential Information to the extent that such Confidential Information:
i. was in the public domain prior to its delivery to the Agency, its Sub- Agencies and the
Personnel of either of them or becomes a part of the public knowledge from a source
other than the Agency, its Subagencies and the Personnel of either of them;
ii. was obtained from a third party with no known duty to maintain its confidentiality;
iii. is required to be disclosed by Applicable Laws or judicial or administrative or arbitral
process or by any governmental instrumentalities, provided that for any such disclosure,
the Agency, its Sub- Agencies and the Personnel of either of them shall give the Authority,
prompt written notice, and use reasonable efforts to ensure that such disclosure is
iv. is provided to the professional advisers, agents, auditors or representatives of the Agency
or its Sub- Agencies or Personnel of either of them, as is reasonable under the
circumstances; provided, however, that the Agency or its Sub- Agencies or Personnel of
either of them, as the case may be, shall require their professional advisers, agents,
auditors or its representatives, to undertake in writing to keep such Confidential
Information, confidential and shall use its best efforts to ensure compliance with such
Penalty Provisions
3.2.1 Liquidated Damages for delay: In case of delay in initiation of services (part or whole) liquidated
damages not exceeding an amount equal to 0.1% (zero-point one percent) of the Average Annual
Fee, per day, subject to a maximum of 2.5% (two-point five percent) of the Average Annual Fee

will be imposed and shall be recovered by appropriation from the Performance Security or
otherwise. However, in case of delay due to reasons beyond the control of the Agency, suitable
extension of time shall be granted, without any penalty, provided prior written approval of the
same has been taken from the Authority.
3.2.2 Encashment and appropriation of Performance Security: The Authority shall have the right
to invoke and appropriate the proceeds of the Performance Security, in whole or in part, without
notice to the Agency in the event of breach of this Agreement or for recovery of liquidated
damages specified in this Clause.
3.2.3 Penalty for deficiency in Services: The Authority shall regularly monitor the services being
provided though feedback, visits or through a Monitoring Agency nominated by them. Non-
performance of the services as per the conditions of the RFP and as per the Performance
Standards shall invite penal provisions. The performance shall be monitored as per the standards
included in Annexure 4. In an event the Authority engages a Monitoring Agency the evaluation
and monitoring parameters and the penalty provisions, shall be finalized in consultation between
the Authority, Monitoring Agency and the O&M Agency. Once the same has been finalized, the
penalties shall be actuated accordingly. Sub-optimal performance / non-compliance in any aspect
as per the scope of work shall invite a penalty of 0.05% per incident, per site (NSSM, Saifee Villa
and TFC), per day. If major deficiency of significant nature in the services is observed, an
additional levy of compensation up to a maximum of 5% of the Average Annual Fee shall be
made on the Agency. The decision of Authority will be final binding in this regard. The amount of
penalties annually shall be capped at 10% of the Average Annual Fee. In case the same is
breached, the contract shall be terminated, and the Authority may forfeit the Performance Service
and the Retention Money and blacklist the Agency for further tenders.
Documents prepared by the Agency to be the property of the Authority
3.3.1 All drawings, maps, designs, content, records of footfalls, documents and other materials (the
“documents and materials”) prepared / generated by the Agency, its employees,
subcontractors and agents, in the performance of this Agreement, shall be the property of
Authority and shall be delivered to Authority upon request of the Competent Officer or upon the
termination of the Agreement, and Agency shall have no claim for further employment or
additional compensation as a result of the exercise by Authority of its full rights of ownership use,
reuse, or assignment of the documents and materials hereunder.
3.3.2 In the event of termination, all finished or unfinished documents and other materials, if any, at
the option of Authority, and to the extent permitted by law, shall become the property of the
Authority. Agency may retain copies thereof for its files and internal use. Any publication of
information directly derived from work performed or data obtained in connection with services
rendered under this Agreement must be first got approved by Authority.
Fraudulent and Corrupt Practices
3.4.1 The Bidders and their respective officers, employees, agents and advisers shall observe the
highest standard of ethics during the Bidding Process and subsequent to the issue of the LOA
and during the subsistence of the Agreement. Notwithstanding anything to the contrary contained

herein, or in the LOA or the Agreement, the Authority may reject a Bid, withdraw the LOA, or
terminate the Agreement, as the case may be, without being liable in any manner whatsoever to
the Bidder or Agency, as the case may be, if it determines that the Bidder or Authority, as the
case may be, has, directly or indirectly or through an agent, engaged in corrupt practice,
fraudulent practice, coercive practice, undesirable practice or restrictive practice in the Bidding
Process. In such an event, the Authority shall be entitled to forfeit and appropriate the Bid Security
or Performance Security, as the case may be, as Damages, without prejudice to any other right
or remedy that may be available to the Authority under the Bidding Documents and/or the
Agreement, or otherwise.
3.4.2 Without prejudice to the rights of the Authority under Clause above hereinabove and the rights
and remedies which the Authority may have under the LOA or the Agreement, or otherwise if a
Bidder, is found by the Authority to have directly or indirectly or through an agent, engaged or
indulged in any corrupt practice, fraudulent practice, coercive practice, undesirable practice or
restrictive practice during the Bidding Process, or after the issue of the LOA or the execution of
the Agreement, such Bidder shall not be eligible to participate in any tender or RFP issued by
the Authority during a period of 2 (two) years from the date such Bidder or Agency, as the case
may be, is found by the Authority to have directly or indirectly or through an agent, engaged or
indulged in any corrupt practice, fraudulent practice, coercive practice, undesirable practice or
restrictive practices, as the case may be. For the purposes of this Clause, the following terms
shall have the meaning hereinafter respectively assigned to them:
a. corrupt practice means (i) the offering, giving, receiving, or soliciting, directly or indirectly,
of anything of value to influence the actions of any person connected with the Bidding
Process (for avoidance of doubt, offering of employment to or employing or engaging in any
manner whatsoever, directly or indirectly, any official of the Authority who is or has been
associated in any manner, directly or indirectly, with the Bidding Process or the LOA or has
dealt with matters concerning the Agreement or arising therefrom, before or after the
execution thereof, at any time prior to the expiry of 1 (one) year from the date such official
resigns or retires from or otherwise ceases to be in the service of the Authority, shall be
deemed to constitute influencing the actions of a person connected with the Bidding
Process); or (ii) save and except as permitted in this RFP, engaging in any manner
whatsoever, whether during the Bidding Process or after the issue of the LOA or after the
execution of the Agreement, as the case may be, any person in respect of any matter
relating to the Project or the LOA or the Agreement, who at any time has been or is a legal,
financial or technical adviser of the Authority in relation to any matter concerning the Project;
b. fraudulent practice means a misrepresentation or omission of facts or suppression of facts
or disclosure of incomplete facts, in order to influence the Bidding Process;
c. coercive practice means impairing or harming, or threatening to impair or harm, directly or
indirectly, any person or property to influence any persons participation or action in the
Bidding Process;
d. undesirable practice means (i) establishing contact with any person connected with or
employed or engaged by the Authority with the objective of canvassing, lobbying or in any

manner influencing or attempting to influence the Bidding Process; or (ii) having a Conflict
of Interest; and
e. restrictive practice means forming a cartel or arriving at any understanding or arrangement
among Bidders with the objective of restricting or manipulating a full and fair competition in
the Bidding Process.
3.5.1 Force Majeure shall mean any event beyond the control of Authority or of the Agency, as the
case may be, and which is unavoidable notwithstanding the reasonable care of the party affected,
and which could not have been prevented by exercise of reasonable skill and care and good
industry practices and shall include, without limitation, the following:
a. War, hostilities, invasion, act of foreign enemy and civil war;
b. Rebellion, revolution, insurrection, mutiny, conspiracy, riot, civil commotion, and terrorist
c. Strike, sabotage, unlawful lockout, epidemics, quarantine, and plague;
d. Earthquake, fire, flood or cyclone, or other natural disaster
3.5.2 As soon as reasonably practicable but not more than 48 (forty-eight) hours following the date of
commencement of any event of Force Majeure, an Affected Party shall notify the other Party of
the event of Force Majeure setting out, inter alia, the following in reasonable detail:
a. The date of commencement of the event of Force Majeure;
b. The nature and extent of the event of Force Majeure;
c. The estimated Force Majeure Period,
d. Reasonable proof of the nature of such delay or failure and its anticipated effect upon the
time for performance and the nature of and the extent to which, performance of any of its
obligations under the Agreement is affected by the Force Majeure.
e. The measures which the Affected Party has taken or proposes to take to alleviate/mitigate
the impact of the Force Majeure and to resume performance of such of its obligations
affected thereby.
f. Any other relevant information concerning the Force Majeure and / or the rights and
obligations of the Parties under the Agreement.
3.6.1 The Agreement may be terminated forthwith by either party by giving written notice to the other
a. The other party is in material breach of its obligations under this Agreement and / or, in the
case of such breaches capable of being remedied, fails to remedy that breach within thirty
days of receiving notice of such breach; or
b. The Agreement may be terminated forthwith by the Authority by giving written notice to the

i. In case of breach of any of terms and conditions of the Agreement by the Agency,
the Authority shall have the right to terminate the Agreement without assigning any
reason thereof, and nothing will be payable by the Authority and in that event the
security deposit in the form of Performance Security shall be forfeited and encashed.
ii. The Agency does not provide services as per the Scope of Work / Requirements
iii. The Agency goes bankrupt and becomes insolvent.

4. Terms of Reference
The National Salt Satyagraha Memorial (NSSM), Dandi, Gujarat, India is conceived as an
experiential journey recreating the spirit and the energy of the 1930 Dandi March led by Mahatma
Gandhi and taking the visitors to the Monument step-by-step in order to visualize and understand
the history of the iconic Dandi March and the methodology of Satyagraha, which contributed to
India’s Independence from the British colonial rule.
The Saifee Villa is a bungalow located adjacent to the NSSM, where Mahatma Gandhi spent the
night on April 5th, 1930, prior to the momentous Salt Satyagraha event against the Salt Law
enforced by the British colonial government.
The Tourist Facilitation Centre (TFC), developed by the Authority, provides support
infrastructure to the tourists visiting NSSM and Saifee villa. The NSSM has space for entry ticket
counter, space for ATM, parking, Handicraft stalls, Prarthna Hall, Display Gallery, Garden,
Children play area, Restaurant, Rest rooms etc.
The Preferred Bidder will be required to broadly undertake the following:
• Provide services towards overall operation and management (including housekeeping &
security services) of NSSM, Saifee Villa and Tourist Facilitation Centre, by deployment of
adequate and trained human resources, machinery and consumables.

• Curate the overall destination in a holistic manner and plan, organise and manage
activities so as to promote the destination, engage tourist during their visit to the destination
• Undertaking Events on special occasions like birthday of Gandhiji, start date of Dandi
March, End date of Dandi March, Independence Day, Republic Day and so on, in
consultation with the Authority.
• Provide support for implementation, logistic, branding, citizen connect campaigns, visitor /
tourist facilitation and management, documentation of these in a holistic manner
• The Agency shall be free to charge market driven rates for components like – rental for
ATM, parking, handicraft stalls, restaurant, resting areas etc, in the Tourist Facilitation
• The Agency shall install QR code for registering the feedback prominently on the entry
as well as other locations as desired by the Authority, of all the three sites (NSSM,
Saifee Villa and TFC). The visitors should be able to register their feedback and

the QR code is prominently displayed at a conspicuous location and maintained in proper
working condition at all times

1. Solar Trees: There are 41 No Solar trees in Galvanized Mild Steel and SS pipe branches
each tree having 12 leaves in Alumina Magnesia tray with PV modules for solar power
generation. Cleaning of dust and salt deposition on the PV module would be required to
maintain efficiency besides other normal maintenance work. The peak power generation of
the system is 144 KW. Out of this 90KW is online system with net metering and other
infrastructure such as inverter etc. 54KW offline system in two parts of 26KW & 28KW with
battery backup. Therefore, proper maintenance of battery and replacement of batteries is
required. Civil structure also needs periodical maintenance. Proposed sanctioned load of the
Memorial is 62KW.
2. Salt-Making Pots: There are 14 salt-making pots which are installed at the space for the
salt-making activity. The quantity of salt-water required for making a pinch of salt (assuming
an average footfall of 500 visitors a day) is 100 litres per day (3000 litres per month). Storage
tank for salt-water have been created near the Salt-Making Activity. Since the salinity of sea-
water at Dandi is not sufficient to yield a pinch of salt in about 10 minutes (expected time for
boiling 200 ml of salt-water), salt-water of sufficient salinity should be brought by a tanker
from a salt-pan near Dandi. Staff would be required to assist visitors in this activity and ensure
smooth operation and also protection of pots and equipment from any damage. Salt-water
to be filled in 100 bottles of 200 ml capacity each and kept in the shelf from which visitors
may take a bottle and pour into the pan. Visitors shall be provided with packaging material
to carry the salt they make.
3. The NSSM has an “A frame” in Duplex Steel which is approximately 40m height with satin
matt finish. The monument area is 2,442 Sqm. There is a crystal structure on the top of the
A frame. Glass crystal requires cleaning and also maintenance at that height.
4. Murals and Statues: There are 81 life size statues of the 80 marchers and Mahatma Gandhi
in silicone bronze and another large monument statue of 15 feet height of Mahatma Gandhi
which needs periodic maintenance. Further, there are 24 Murals, made in silicon bronze, of
size 3.0m x 2.1m and 600mm thick. These murals are fixed in a massive granite stone
monolith with provision for electrical fittings etc.
5. Artificial Lake: The plan area of lake is about 13,000 Sqm and with 1mtr depth of water,
volume of total quantity of water is about 130 lakh litres. In the absence of water, lake would
be filled up with subsoil water from the bore wells within the Memorial Complex containing
high level of salinity. The broad important element involved in operational maintenance would

would vary depending on the atmosphere viz., temperature, humidity level in air,
wind etc. Assessed average loss due to evaporation could be considered as 3 to
5% of the total quantity per month

4.4.2 Operation, Maintenance and Management
1. The Agency should submit SOP of all services such as mechanical / electrical / plumbing /
solar trees / A Frame / Artificial Lake / Salt making pan / multimedia / HVAC / ELV /
housekeeping of entire campus with murals and installations with checklist of daily
maintenance and preventive maintenance considering sustainable parameters and net zero
waste to the department within a period of 15 days after the signing of the Agreement.
This shall form an addendum to the Agreement.
2. The Agency shall be required to get the maintenance and repair through OEM only for
installation and infrastructure like solar trees, AV related infrastructure, filtration unit etc. The

Agency shall ensure that all E&M equipment and services shall be maintained as per the
manufacturer’s specifications, guidelines and directions in the User Manual of the equipment.
3. The Agency shall be responsible for carrying out regular / normal operation & maintenance
of A Frame & Glass Crystal, Solar Trees, Artificial water body, Marchers, Murals, Landscape,
Bore & protection wall, water supply and drainage, civil construction like door & windows,
Flooring etc, light & sound system, Auditorium, Toilet Block, AV room, Library, Salt making
activity, Saifee villa and Tourist Facilitation Centre.
4. The Agency shall ensure that all the installations (indoor as well as outdoor), murals &
statues, salt making pots, equipment, electronic fittings and fixtures, firefighting system,
plumbing fixtures, landscaping elements, solar trees, filtration system, etc. are maintained
and in working condition. It shall be the responsibility of the Agency to ensure that breakdown
of any nature is reported to the Authority immediately through the Manager, and the same is
fixed within 24 hours by the Agency, at its own cost.
5. The Agency shall provide services towards the maintenance & repair of existing
Infrastructure (including Electrical and electronic works / Equipment / Fittings and Fixtures
etc.), being handed over, as under:
▪ Periodic inspection (by technical team) to undertake the maintenance work as per
▪ Maintenance of all existing structures including outdoor installations.
▪ Restore minor cracks, flooring / tiling work, railing, joint sealant, doors, windows,
staircase, furniture, Landscape area, water supply, Sanitary and Plumbing works, U/G
tanks and O/H tanks, toilets etc.
▪ The Agency shall take upmost care that no damage occurs to existing structure as well
as Outdoor Installations during the tenure of the Agreement.
▪ The Agency must ensure that the water quality of the lake is maintained as per good
industry standards. The Agency must ensure that as much as possible, the wastewater
is reused for landscaping purpose and wastage of water is minimized.
▪ The Agency must ensure that all the lights in all the premises are switched on at a
mutually agreed time with the Authority.
▪ The Agency shall undertake regular inspection of foundation bolts and welded joints
specifically in components like A Frame, Solar Trees, SS Perforated sheets.
6. The Agency shall ensure that the salt making area is functional at all times. The Agency shall
maintain a reserve stock of the salt making pots (like the ones installed) and replace them
as required. The ceramic pots shall be cleaned appropriately such that their functionality is

the properties leading to serious threats to property / human being and surrounding.

8. The Agency must ensure that the solar trees are in working condition and ensure periodic
maintenance and cleaning of the same. The Agency shall undertake regular inspection of
foundation bolts, LED lights and metal surface coatings.
9. In case of any replacement of parts, as mentioned above, they should be preferably of the
same brand. In case of change in the brand, an equivalent or better brand must be used and
should be got duly pre-approved by TCGL.
10. The Agency shall submit all the necessary Warranty/Guarantee necessary invoices/delivery
challans etc. of all purchases of assets (to ascertain OEM/Vendors).
11. List of all repair and maintenance activities to be undertaken in the entire year is to be
submitted by the Agency for approval. Further, quarterly plan shall be approved by TCGL
based on site assessment once the Agency has initiated the services.
12. Monthly quantification of all civil, cleaning and MEPF shall be submitted to TCGL for
approval. It shall be submitted monthly with the bills for record and reference.
4.4.3 Visitor Management and Facilitation
1. The Agency shall create a ticketing kiosk and maintain a ticketing system, with the ticket
rates as per the directions of TCGL. A software / mechanism for the same shall be developed
in consultation with TCGL. The Ticketing rates shall be capped as below:
o Below 5 years: free
o 5 to 12 Years: Rs.
o Above 12 Years (Per Person): Rs.
o Foreign Visitor: Rs.
There shall be no revision in the ticketing rates during the License Period
2. The Agency shall appoint trained resources including trained guides / curators, for ensuring
best visitor experience to the guests / visitors / tourists visiting site/s.
3. The Agency shall provide services towards appropriate visitor management including guide
/ curator services. The visiting timing, no. of batches, recess timing, weekly off etc. shall be
decided in consultation with the Authority.
4. The Agency must ensure proper visitor management and provide a satisfying and enriching
experience to the visitors.
4.4.4 General Housekeeping and Facility Management Services
1. The Agency shall provide services towards general housekeeping and facility maintenance
of the entire premises handed over to it, as per the SOP as approved by the Authority,
including but not limited to the following:
▪ Washing, cleaning and maintenance
▪ Sanitation of bathrooms and toilets
▪ Cleaning and maintenance of all the drains within the areas handed over .
▪ Removal of beehives and cobwebs / honey webs from the sites and its premises.
▪ Routine / Emergency plumbing works pertaining to water supply, distribution and
checking of leakages and replacement of leaking taps, etc.

▪ Supply of suitable and adequate number of dustbins, cleaning of dustbins and disposal
(including transportation) of collected garbage at an approved location. The Agency
shall ensure collection, screening and segregation of dry and wet garbage. Appropriate
disposal as approved by applicable authority shall be the responsibility of the Agency.
Agency shall in no way harm the environment of the place.
▪ Periodic pest control, mosquito control including winged pests, termite, larva control
and rodent control of the entire site in all covered and open area as per good industry
▪ Cleaning of all equipment available in the area handed over to it in terms of the RFP
with dusting or wet mopping or vacuum cleaning or any other suitable method.
▪ Cleaning of all lighting and electrical fixtures, indoor as well as outdoor.
▪ Periodic cleaning and upkeep of facades, stonework, metalwork, walls, furniture,
partitions, railings, etc.
▪ Cleaning of drinking water coolers, water filters.
▪ Cleaning of all miscellaneous equipment as available or being provided from time to
▪ The Agency shall ensure that equipment and installations are cleaned such that their
functionality and working is not impaired in the long run. There are multiple fragile
installations and parts like glass, murals, statues etc. They should be maintained very
carefully and suitable cleaning agent and mechanism should be used.
▪ Any other provisions as advised by the Authority, during the Agreement Period shall
also be binding on the Agency.
2. The Agency shall be responsible to carry out all the regular / normal upkeep, cleanliness and
sanitation including but not limited to following.
▪ Attending blockage of drainpipes, gully trap, and manholes.
▪ Water supply, Storm Drainage & Sewage Disposal work.
▪ Plumbing related maintenance work related to attending the leakage from taps and
valves, sanitary fixtures, fixtures for water supply etc.
▪ Cleaning of shafts, if any and keeping the same functional.
▪ Occasional replacement of water supply fittings / sanitary fixtures on need basis
▪ Periodical cleaning of overhead tanks, underground tanks etc. thereby maintaining
record of cleaning.
3. The Agency must ensure that the waterbody is well maintained and is kept free of any algal
growth or floating impurities of any kind at all times. Agency must ensure that the sufficient
water level at the artificial lake is maintained at all times, with the desired water quality.
4. The Agency shall check various components of laser light portal on SS perforated sheets
and polish the sheets with motorized buffering wheel once every month. The Agency shall
ensure that the dust / stains / droppings settled on glass panels is cleaned off regularly. A
Vinegar-water solution (50% distilled vinegar (white) + 50% tap water) or other appropriate

solution can be used to wipe off. For cleaning fingerprints marks, proprietary spray-applied
polishes can be used and options for minimizing the same must be used.
5. The Agency must ensure that the dust / stains / droppings / salt deposition on solar modules
and the outer surface of A Frame is regularly cleaned such that the efficiency is maintained.
The Agency shall use motorised robotic clamp climber cleaner or any appropriate
mechanism for cleaning these components.
6. The Agency shall use water jet with high force water pump or any other appropriate and
effective system for cleaning of outside glass panel of the A crystal structure. The Agency
shall also undertake regular inspection of aviation light, glass panels and pedestal bolts.
7. The sites have substantial stonework and metalwork. The Agency shall ensure periodic
cleaning of the same including removal of any vegetation which can lead to structural
damage. The choice of cleaning agents / chemicals and the equipment for the same should
be such that there is no harm to the stonework and metalwork.
8. The Agency must ensure regular cleaning of dust and salt deposition on the PV module such
that efficiency is maintained. The Agency shall also undertake proper maintenance of battery
and replacement of batteries after their serviceable life would be required. The civil structures
should also be periodically maintained.
9. The Agency shall provide landscaping services in the entire campus. This landscape
contains irrigation system with sprinklers and drip irrigation with pumping system and
hydrants. It also contains about 450 Trees, Shrubs, Hedge plants, Ground cover plants,
grass etc apart from those in Welcome centre that require regular maintenance.
10. The Agency shall provide service towards horticulture development and maintenance in the
site along with planters in the building common areas.
11. The Agency shall provide service towards regular maintenance, including pruning, pest
control and regular maintenance of trees, shrubs, hedge, planters, ground cover plants,

and use of fly catching machine to keep the site/s hygienic.
13. It shall be the responsibility of the Agency to procure, store and use all consumables and
equipment for the purpose of housekeeping and landscaping. Indicative details of the

b) Fresheners: Urinal Cubes, Naphthalene Balls, Auto Janitors etc.

4.4.5 Security Services
1. The Agency shall undertake round the clock patrolling various common areas & surroundings
to ensure adequate safety and security of the sites and ensure physical guarding of entry /
2. The Agency shall be responsible for screening / frisking and checking of visitors during and
after operational hours, if so desired. The Agency shall screen items which cannot be carried
inside the premises, in consultation with the Authority.
3. The Agency shall prevent entry of stray animals like cow, dogs, monkeys etc.
4. The Agency shall control the access of persons / vehicles into and out of the complex/es.
5. The Agency shall maintain records of inwards and outwards movement of men, materials
and vehicles, etc. with proper check as per instructions given from time to time by competent
6. The Agency shall ensure the complete safety and security of man and materials.
7. The Agency shall ensure that suitable parking facilitation is provided at both sites. The
parking is currently provided in the TFC located in close proximity of the sites.
8. The Agency must ensure effective involvement during the crisis management like accidents
(fire etc.), any threat and during periodical drills.
9. The Agency shall assist the occupants during the Emergency Evacuation of the buildings.
10. The Agency shall liaison with appropriate agencies in case of emergencies / Disaster & well
equipped with their update contact numbers.
11. The Agency shall, in consultation with the Authority, ensure lodging of complaints / FIRs in
case of emergency / disaster under intimation.
12. The Agency shall maintain a backup (of at least 1 month) of the CCTV installed / to be
installed within the premises.
13. The Agency must ensure that there is no vandalism and shall be specifically watchful towards
any vandalism including but not limited to marchers and mural, which has small and fragile
parts (like spectacles, fingers etc.)
14. The Agency shall be responsible for any loss or damage caused or suffered at Sites on any
account of negligence (by any act or omission) of the personnel / equipment supplied for by
the Agency. This shall include any physical, financial and vicarious losses including thefts.

In the event of such occurrence of loss or damage, the enquiry shall be made by the officers
of the Agency in consultation with the officer of Authority. The decision of the Managing
Director, TCGL shall be treated as final in this regard after the said enquiry.
4.4.6 Organizing Events on a turnkey basis
1. The Agency shall organize events on some special occasions like birthday of Gandhiji, start
and end date of Dandi March, Independence Day, Republic Day and so on, on a turnkey
basis. The events should be of small, medium and large scale and a total of about 7 events,
shall be carried out every year. The list and scale of events through the year shall be pre-
discussed with the Authority and the calendar should be drawn likewise.
2. The Agency shall conceptualize, plan, organise and manage the tours of groups, carry out
various competitive activities like such as cycling race, drawing & painting, essay writing,
drama / mono acting, etc. with the central theme in tune with Gandhiji’s principles / life.
3. The Agency should provide all the necessary facility for conducting the activities like drawing
papers, pencils, colours, other craft materials, bicycle etc. The Agency shall have to arrange
tours from each category of students, researchers, villagers of surrounding region, salt
workers and also covering variety of themes like non-alcoholism, ahimsa, democracy and so
4. The Agency shall conceptualize, plan and manage the pass on bicycle race or cycling starting
from Gandhi Ashram to Dandi.
5. The Agency shall provide all the necessary facilitation to participants like food, snacks, water,
tea, coffee, cold drinks, rest shed, medical help, safety and security, support if required,
cycles, temporary stays etc. as per requirements.
4.4.7 Conditions for Resources to be deputed
1. In addition to the resources for providing services as per the requirements of the tender, the
Agency shall also be required to deploy one Head Facility Manager and one Senior
Engineer throughout the Agreement Period. These Key Personnel’s role shall be to
coordinate and facilitate between the visitors, Agency, Authority, District Collector Office and
other relevant stakeholders.
2. The Agency shall deploy the following resources at the site in the following categories:

Note: This is an indicative and minimum profile of the resources to be deployed. Barring the
position Head Facility Manager and Senior Engineer, wherein the Agency shall be required
to depute them full time on site, for all other positions, the Agency shall be required to
estimate the number of resources to be deployed across shifts.
3. For days with peak flow, holidays, festivals and on discretion of the Authority, the Agency
might be required to deploy additional resources such that the services are maintained as per
good industry practices. The Agency is expected to estimate the same in their financial bid
and no additional payment towards additional resource deployment shall be made.
4. The Agency shall maintain the record of attendance and email the same every day at 10:00
am (or at a time as decided by the Authority) for the previous day.
5. The Agency shall make all efforts to deploy local staff such as to offer better employment
opportunities to locals.
6. The Agency shall not deploy any person below the age of 18 years old. Manpower engaged
for the purpose should be pre-trained in requisite fields.
7. The Agency must issue Photo identity cards to the manpower provided by them. These cards
are to be constantly displayed and their loss reported immediately.
8. The staff deployed within the various sites shall be provided with uniform (minimum of two
sets each of summer and winter uniform with clear logo of TCGL), by the Agency as per their
job assignments and they shall wear it compulsorily while on duty.
9. The colour and style of uniform shall be got approved by the Authority. The staff should wear
clean and properly ironed dress while on duty. The Agency shall employ only adult trained
staff with good health and sound mind.
10. The Agency and his employees shall obtain medical certificate of physical fitness from
Registered Medical Practitioner. If in the opinion, any of the Agency’s employee is identified
on accord of misconduct, the authorised officer shall have the right to ask the Agency to
remove such employee(s) without questioning the decision of the authorised officer.
11. The Agency shall be responsible for all his employees in observing Housekeeping and safety
regulations and instructions as may be issued by the office from time to time.

12. The Agency shall be responsible for providing the staff deployed with personal protective
equipment like gloves, masks, reflective jackets, harness etc. as required.
13. The personnel of the Agency shall not be the employees of the Authority and they shall not
claim any salary or allowances, compensation, damages or anything arising out of their
deployment / duty under this Agreement. The Agency shall make them known about this
position in writing before deployment under this Agreement.
14. Authority shall have the right, within reason, to have any personnel removed who is
considered to be undesirable or otherwise and similarly the Agency reserves the right to
remove any personnel with prior intimation to the Authority, emergencies exempted.
15. During the tenure of this Agreement, the resources deployed by Agency will not engage, either
directly or indirectly, in any other business or professional activities, whether or not they may
conflict with the activities, assigned to the Agency under this appointment without the prior
written consent of the Authority.
16. The Agency shall be liable for meeting all the statutory requirements as provided by the Acts
governing labour laws i.e. Payment of Wages Act 1936, Contract labour (Regulation &
Abolition) Act 1970, Minimum wages Act, Employees Provident funds (EPF) Act
Employee State Insurance Act including EDLI, Payments of Bonus Act 1965, Payment of
Gratuity Act 1972, National, Casual, Annual Festival, Maternity / paternity Leave Acts as
applicable and as amended from time to time or any other rule framed there under from time
to time by the Central or State Government and or any authority constituted by or under any
Law, for the category of persons deployed by Agency.
17. The personnel so employed by the Agency and deputed at sites shall have no right to
employment against any post.
18. In case of any disciplinary inquiry to be conducted against any delinquent personnel provided
by the Agency, the same shall be held by the Officer of the Agency, in consultation with the
Managing Director, TCGL.
General Terms and Conditions
1. Preparation of Detailed Manual including checklist and SOP: The Preferred Bidder within
a period of 15 days from the signing of the Agreement, shall submit a Detailed Manual
including checklist and SOP for providing services as per this Tender. The Manual should
include components like, operations, maintenance, cleaning and housekeeping works
covering use of machineries /equipment’s /consumables, safety precautions, PHE, Electrical
system, Multimedia, firefighting, HVAC, lighting works, water standards in the lake, any such
details. A checklist covering detailed description of all activities with frequency of all
installations including periodic painting, replacement etc. shall also be provided. Upon
acceptance of the same, the Manual shall form an addendum to the Agreement. The Agency
shall be required to submit annual and quarterly reports in this regard, showcasing the
compliance to this manual.
2. The Agency shall install QR code for registering the feedback prominently on the entry
as well as other locations as desired by the Authority, of all the three sites (NSSM,

Saifee Villa and TFC). The visitors should be able to register their feedback and complaints
through the QR code. The feedback should be receivable by the Agency, Authority and / or
any other agency nominated by the Authority. The Agency shall ensure that the QR code is
prominently displayed at a conspicuous location and maintained in proper working condition
3. Agency shall develop a software (on open-source platform) for the ease of monitoring
of the services. The software should include provision of attendance reporting, status and
condition of assets, ticketing and footfalls, inventory management and all other aspects which
are involved in the operation and management of the sites. Further, the software should have
a provision of remote monitoring of the services and Agency shall share login credentials
with the Authority.
4. The Agency shall be responsible to obtain all the necessary licenses for smooth operations
and management of services and activities as per RFP and Agreement.
5. The Agency shall undertake works as per the scope of services and Good Industry Practices
and taking into consideration the Opening / Closing hours.
6. The Agency shall ensure that the sites are maintained in a way that it remains ready for use
for visitors / tourists at all times.
7. The Agency shall ensure that no chaos and untoward incident occurs at the facility, on a best

9. In case of regular & periodic maintenance, the Agency is required to undertake the same
during non-peak hours, preferably before opening hours in morning or after closing hours in

10. The Agency shall exercise adequate supervision to ensure performance of Services in
accordance with Scope of Work / Requirements. TCGL at its discretion may depute a
competent authority within TCGL or a Third-Party agency for monitoring of the works being
undertaken by the Agency.
11. Agency shall make payments relating to Electricity Bills. Authority shall not be responsible
for the same. Agency must ensure that the ACs, lights are switched off after the working
hours, ensuring minimal wastage. The Agency shall maintain the solar panels in working
12. Property tax shall be borne by the Authority. Any other taxes and levies shall be borne
by the Selected Agency.
13. Without limiting the generality of the foregoing, the Agency shall, at its cost and expense,
purchase and maintain or cause to be purchased and maintained during the License Period,
and in case of sub-clause (a) and (b) below during the License Period, such insurances as
are necessary, including but not limited to the following:
a. comprehensive insurance for the Project Assets for their full market value or
replacement cost (including fire, burglary, earthquake, riots, flood, other such
calamities, standard and specific peril);

b. comprehensive third-party liability insurance, including injury or death of Persons
who may enter the Project Sites including its employees, technicians, support staff,
customers, visitors, labour etc. as may be applicable;
c. any other insurance that may be necessary to protect the Agency, the Persons
claiming through or under it, its employees and its assets (against loss, damage or
destruction at replacement value) including all Force Majeure Events that are
insurable and not otherwise covered in items (a) and (b);
d. insurance of the buildings, equipment and other assets owned by the Authority shall
be taken in name of Authority or its nominee.
14. The Agency shall submit a daily report (or any other frequency as required by the Authority)
including complaints to the scope of work, cleaning schedule, staff attendance and any other
head as desired by the Authority, latest by 10:00 am (or at a time as decided by the Authority).
The format of the report shall be pre-approved by the Authority and / or a third party if so
engaged for the same.
15. Authority shall be at liberty to carry out surprise check on the persons so deployed by the
Agency in order to ensure that the persons deployed by him are doing their duties properly.
16. The Agency shall abide by and follow all the applicable Local and Central Laws strictly.
Additionally, the Agency shall abide by all guidance and instructions by CPWD, IIT Mumbai
and Tourism Corporation of Gujarat Limited for providing services as per the requirement of

18. That the courts covering the area of Authority only shall have jurisdiction to entertain, try and
to decide any dispute arising out of this Agreement
19. The Agency must ensure that the sites are accessible (including interpretation material) to
persons with disability and / or limited mobility.
20. The Agency shall be solely liable for the safety, security and protection of the tourists,
customers, bonafide visitors and their property at the sites, against theft, vandalism, loss,
damage, destruction or otherwise and shall indemnify, defend and hold harmless the
Authority, its employees, representatives from and against all liabilities, damages, legal
proceedings, claims and costs etc. in this behalf;
21. The Agency shall take upmost care that no damage occurs to existing structure or any
installations during the tenure of the Agreement, whether by its own staff in performing
services as per the RFP or by the visitors. Any damages to the property shall be recovered
from its performance guarantee and retention money or the payments to the agency, if any.
22. The Agency must take into cognizance the national significance and sanctity of the
sites and shall provide services in a befitting manner.
4.6.1 Payments shall be made to the Selected Agency by the Authority, on a monthly basis as below:

Where “A” is the “Average Monthly Charges”, worked out based on the total O&M fee
sought by the Bidder, for a period of 5 years and as accepted by the Authority.
4.6.2 The Selected Agency shall retain all revenues accruing from components like ticketing,
parking, restaurant, craft / souvenir stall, lockers, guide services, events, similar. Bidders
are requested to take note that barring the rates of entry tickets as mentioned above, they
are free to charge market driven for the other services
Important Note:
1) The Selected Agency shall raise invoices on a monthly basis.
2) Any deductions towards penalty / non-performance of services / damage to structures or
installations etc shall be made from the Performance Security or payments to be made to
the Agency, if any.
3) 5% retention money from each bill shall be deducted and released back, after each year,
without interest, in case there are no pending dues. The Performance Guarantee shall also
be returned without interest, in case there are no pending dues, after each year, upon
submission of the fresh Performance Guarantee.
4) The Authority shall endeavour in releasing the Retention Money and Performance
Guarantee within 30 days following the release of final payment to the Agency, without
interest, in case no pending dues are there.
5) Submission of Monthly Reports: The Agency shall submit reports including the following:
a) Monthly report covering services rendered, problems encountered and all other
relevant details as desired by Authority shall be submitted with the monthly bill.
b) Operation logbook – Reading of different meters, indicators, recorders regarding
consumption of consumable materials and indicators of services shall be attached
with monthly bill.
c) ERP/SAP/similar software related reports produced by monitoring and surveillance
equipment shall be made operational by the bidder within 15 days after signing of
d) Reports of special shall be submitted monthly with bill.
e) Record of measurable measurement items (Inventory) issued in the store shall be
signed and submitted with the bill.
f) Biometric Attendance sheet shall be attached with all Monthly bills attested by the

providing services related to “RFP for Selection of an Agency for Operation & Maintenance of
National Salt Satyagrah Memorial (NSSM), Saifee Villa and Tourist Facilitation Centre at Dandi,
Gujarat” for which purpose TCGL issued a Request for Proposal (“RFP”) inviting Bids from the Bidders
to execute the Scope of Work specified therein (“Project”);

implementation of the Project (hereinafter called “the Bid”).

this Guarantee without any demur, reservation, recourse, contest or protest and without any
reference to the Bidder or any other person and irrespective of whether the claim of TCGL is
disputed by the Bidder or not, merely on the first demand from TCGL stating that the amount
claimed is due to TCGL by reason of failure of the Bidder to fulfil and comply with the terms and
conditions contained in the RFP including failure of the said Bidder to keep its Bid open during
the Bid validity period as set forth in the said RFP for any reason whatsoever. Any such demand
made on the Bank shall be conclusive as regards amount due and payable by the Bank under
this Guarantee. However, our liability under this Guarantee shall be restricted to an amount not

4. We, the Bank, further agree that TCGL shall be the sole judge to decide as to whether the Bidder
is in default of due and faithful fulfilment and compliance with the terms and conditions contained
in the RFP including, inter alia, the failure of the Bidder to keep its Bid open during the Bid validity
period set forth in the said Bidding Documents, and the decision of TCGL that the Bidder is in
default as aforesaid shall be final and binding on us, notwithstanding any differences between

against the said Bidder and either to enforce or forbear from enforcing any of the terms and
conditions contained in the said RFP or the securities available to TCGL, and the Bank shall not
be released from its liability under these presents by any exercise by TCGL of the liberty with
reference to the matters aforesaid or by reason of time being given to the said Bidder or any
other forbearance, act or omission on the part of TCGL or any indulgence by TCGL to the said
Bidder or by any change in the constitution of TCGL or its absorption, merger or amalgamation
with any other person or any other matter or thing whatsoever which under the law relating to
sureties would but for this provision have the effect of releasing the Bank from its such liability.
7. Any notice by way of request, demand or otherwise hereunder shall be sufficiently given or made
if addressed to the Bank and sent by courier or by registered mail to the Bank at the address set

previous express consent of TCGL in writing.
11. The Bank declares that it has power to issue this Guarantee and discharge the obligations
contemplated herein, the undersigned is duly authorised and has full power to execute this
Guarantee for and on behalf of the Bank.
12. For the avoidance of doubt, the Bank’s liability under this Guarantee shall be restricted to Rs.
