with airbag for the person occupying the front seat, other than the driver and the

requirement for such airbag shall be as per AIS 145, as amended from time to

time, till the corresponding Bureau of India standards (BIS) specification are notified

under the Bureau of India Standards Act,

1) The Vehicle is to be hired for a maximum 3000 Km/Month.

2) Rates for excess Km travelled by hired vehicle beyond 3000Km’s per month is

admissible occasionally, with written permission of circle head.

3) Any excess travel of vehicle beyond 3000Km’s by the office in-charge of the vehicle shall

be under the written/verbal approval of circle head and the same shall be regularized by

an office note giving clear reasons for travelling beyond stipulated Km’s.

4) All road tolls/bridge tolls shall be reimbursed on production of proof of payment along

with monthly bills.

5) The vehicle to be offered for hiring shall be in up-to-date condition including the tubes,

tyres, engine as well as condition of outside body. The passenger vehicle (Sedan and

SUV/MUV/Nine seater) to be offered shall not have been registered before 3 years and

loading vehicle (Truck, pick up and utility) shall not have been registered before 5 years

on the date of tender opening. However, in case of a very poor response or to break off

the likely cartel, a relaxation can be granted for One year with the permission of circle

head. However, the officer placing the order will decide the condition of vehicle is tiptop.

6) The period of the contract shall be for Two years. The period further One year can be

extended for mutual agreed terms as per same rates, terms & conditions for maximum

two times. i.e. total Extension can be given of two years in two segments of one each

year, if required. However, in case of poor service provided by the contractor, circle head

shall be empowered to terminate the contract after one year.

7) The undersigned reserves right for extending contract by three months without obtaining

any confirmation and for a period of 12 months by obtaining confirmation / mutual

8) The contractor shall immunize company’s personal against any claim arising out of

accidents or misbehavior of the drivers. The vehicle shall be kept properly insured all the

time to cover the 3rd party risk and simultaneously immunized company on account of

likely claims from public, police dept. Etc.

9) The vehicle shall be utilized for survey of transmission lines, sub-stations etc. of GETCO

or other office work under GETCO Navsari or anywhere in GETCO in Gujarat. The

general use of vehicle is for monitoring, supervision, testing etc. work to transport man &

material, used on Kaccha/Pakka road/Cart track where vehicle approach is possible.

10) The bills for travelling of the vehicle shall be paid on monthly basis.

11) Driver shall be preferably below the age of 40 yrs and never above 55 yrs. The lodging

and boarding of driver shall be borne by owner.

12) If the contractor fails to provide a vehicle, the deduction from his RA bill should be made

on prorate considering the monthly rate payable within 26 days per month.

13) If the contractor fails to provide a vehicle on any day, as per contract, penalty of

Rs.2000/- per day per vehicle will be recovered from current RA bill and also vehicle will

be hired from other agency, and if required by paying higher rate, in that case, difference

of rates will be recovered from contractor.

14) The driver should provide with enough money to cover the cost of Diesel/Patrol, repairs

and incidental expenditure while in journey. Driver should provide mobile phone facility

for communication. Driver should always keep all documents relating to vehicle such as

R.C.books, insurance, valid license and PUC certificate or any other important

documents in original copy with vehicle

15) Contractor should appoint a driver with valid license according to vehicle. Driver must not

be addicted of any habits. Changing of driver shall be intimated by contractor to concern

user of vehicle in prior.

16) If the contractor fails to execute the order successfully, the order will be got completed

through agency and if required to pay higher rates, in that case, difference will be

recovered from the contractor.

17) No price variation will be payable on cost of oil, tyres, tube etc. Only changes in price of

will be adjustable. Contractor must quote prices on the basis of prevailing 15 days before

the due date of tender. This basic rate shall be indicated in the offer.

18) For every ten paise increase in price of fuel, price of one paise per Km shall be payable

and for every ten paise decrease in prices of fuel, price of one paise per Km shall be

deductible. This will be applicable to the actual Km travelled during the month.

19) The Bidder shall complete all the schedules & annexure in the Bid Proposal Sheets,

technical Data Sheets and specified elsewhere.

20) The vehicle shall be utilized for any other official purpose of GETCO as per EIC.

21) If vehicle is released or used at or after 01.00 AM ie in mid night, it will be considered as

night halt and paid accordingly. And overtime charges will not be payable.

22) The contractor shall make his own arrangement of boarding and lodging of his drivers,

Agents and servents.

23) Vehicle hired should be displayed board in paint with words “ON DUTY GETCO”. After

contract over than destroy/discard/re paint of white colour this displayed in short it,

display board is remove from your vehicle.

24) If the vehicle sent by the contractor is not as per the specification, charges will not be

paid though the vehicle is used because of emergency.

25) RTO rules, insurance rules & safety rules are to be complied by contractor and Driver.

Also labour and P.F. laws are to be strictly compiled.

26) Before starting journey, vehicle driver must be in the position to have the log book of

journey of the registered vehicle and it must be filled up the vehicle user officers by

mentioning opening and closing km of the journey

27) The starting and closing kilometres will be admissible from the point of starting and

closing of journey. This will be considered from Head quarter & back. No additional

Kilometres will be allowed for to and for journey from the head quarter i.e. mentioned in

tender notice Log book of the vehicle is also to be filled up day to by the user/officers

mentioning the place visited by him along with the duration of journey, travelled and duly

28) The contractor shall employ qualified and well behaving drivers having valid permanent

for driving vehicle as per RTO and insurance rules. This shall be subjected to scrutiny

and checks by the officer in charge handling the execution of the contract from time to

time. If any legal liability occurs on account of any lapse in this regards, the same will be

at contractor’s account. The driver should behave courteously and respectfully with

travelling officers. He should be free from habits of smoking/drinking intoxicant liquors.

The driver sent with the vehicle shall have valid license for driving and Taxi badge. No

any allowance shall be paid by GETCO to the driver. Any misbehaviour of the driver will

be reported to vehicle owner and if vehicle owner fails to provide new driver within

hrs. GETCO reserves the right to terminate the contract or hire vehicle from open market

at risk and cost of the contractor. Driver should wear a uniform supplied by contractor,

well-dressed driver having good manners with necessary tools and tackles and Contact

facility (Mobile-Phone) to meet the normal breakdown while on road. The lodging and

boarding of driver shall born by contractor.

29) The contractor shall provide standby vehicle to ensure prompt substitute arrangements

should any hired vehicle go off road.

30) The vehicle once inspected and approved by the Engineer for hire shall not be changed

or substituted by the contractor except on orders from the Engineer or on becoming

defective/off road due to accident, breakdown, etc. In such an event, the contractor shall

give immediate intimation to the Engineer. Where a change of vehicle is likely to last for

more than one-week prior approval of this Engineer shall have to be taken.

31) The vehicle to be deployed shall be inspected by authorized representative of GETCO at

any time During period of contract & if any defect is noticed, it should be rectified by the

contractor. GETCO shall have right to reject vehicle if condition of vehicle is not

32) In case of breakdown of vehicle or in case of a vehicle not acceptable to GETCO the

contractor will immediately replace the same by good one within shortest time (say within

1 hour only). Failure to replace the vehicle will entitle GETCO to impose penalty

equivalent to the average daily hiring charges for that period or actual expenditure done

whichever is higher for the period, for which vehicle is under breakdown and not been

accepted by GETCO.

33) The speedometers recording the kilometres by the vehicle should always be maintained

in working conditions. If at any time, the speedometer goes out of order, the kilometre

travelled will be admissible according to route kilometres till the speedometer is brought

back in to working condition. No average shall be admissible based on the earlier

journeys to the same places.

34) Any change in driver and Vehicle due to unavoidable circumstances shall be

immediately intimated to in charge i.e. JE/DE/EE with reasons for the change.

35) The S.D. shall be refunded to successful contractor only after satisfactory completion of

the contract or on its termination by the GETCO due to its own reasons. The GETCO

reserves the rights to recover any dues, outstanding against the contractor from the S.D.

or towards any loss caused to the GETCO owing to negligence or default of the

contractor, his servants or agents. The refund shall be done only on production of No

Objection Certificate of all concerned officers.

36) The vehicle driver shall report to in charge officer of vehicle on daily basis. Non-reporting

of the Drivers shall be treated as absent and shall be liable for penalty.

37) The Vehicle must be on the name of the contractor.

38) The Gujarat Energy Transmission Corporation Ltd. shall have right to hire the vehicle

from other Agency at the risk and cost of the contractor, in case of default to provide

vehicle in time and as specified. in that case, difference of rates will be recovered from

the contractor’s current R.A. Bill over and above of penalty.

39) You have to comply with all the legal formalities of RTO Office pertaining to vehicle. You

have to submit copies of R.C. book, Comprehensive Insurance Policy for contract period,

Pollution Control Certificate, Taxi Passing Permit etc on acceptance of the order. PF

code number, Pan No. and Service Tax registration have to be submitted separately

40) In case of any dispute or any discrepancy as regard to the tender and the terms of

conditions of the contract, The Superintending Engineer, Navsari will be the final

authority and binding to the Tenderer.

41) Before the execution of the contact, the contractor shall be required to give the vehicle’s

Numbers, RC book copy, Taxi passing certificate, all RTO documents and the name of

Driver with copies of comprehensive Insurance of the Vehicle, photo copy of the License

of the driver, Insurance copy for the driver, contact number and address of the driver to

the officer of GETCO.

42) For participation in tender, the ownership of vehicle is not necessary. Contractor can

provide third party's vehicle. In such case, bidder shall have to execute the agreement

binding that the whole responsibility about any risks shall pertain to him & not to third

party. The format of same is attached herewith. The provided third party vehicle shall be

same throughout the contract period. In special case, only one time change of vehicle

shall be allowed, meeting all the terms of contract & on taking prior approval of

competent authority.

GENERAL INSTRUCTIONS TO THE BIDDERS

a) PART-I Technical and commercial bid. b) PART-II Price bid.

The Documents (Self attested as mention above in Qualification Requirement for

Bidders and price bid shall be submitted through n-Procure (ncode) only and price bid

will be opened of those tenderers who are considered technically acceptable.

The Tender will be downloaded from the site and can be submitted on or before due date

along with tender fee by Demand Draft payable at NAVSARI on any nationalized Bank and

same shall be kept in cover for EMD. The tender shall be ignore / rejected in case of

tender fee & EMD is not submitted.

The Tenders must be sent by Registered Post only so as to reach the office of Suptd.

submission specified in tender notice. Due care should be taken to see that the tenders sent

are posted early enough to ensure their delivery by the prescribed date or even earlier.

tender irrespective of delay due to postal service or any other reasons and GETCO

shall not assume any responsibility for late receipt of tender.

are found OK, then only Technical Bid Cover will be opened which may be noted. The

exemption in payment of EMD shall be considered in case of NSIC / SSI Unit has provided

valid certificate as documentary evidence regarding it. Tenders submitted without payment of

Earnest Money Deposit by the firm will be rejected without entering in to further

correspondence in this regard and no reference will also be made.

The Tenderers are forbidden from furnishing their own printed / typed commercial and other

TERMS & CONDITION FOR VEHICLE HIRING

1) Type of vehicle:

Mentioned in Tender Notice

2) Area of Traveling:

Anywhere in Gujarat. (for 3000KM/Month).

3) ACCIDENT LIABILITY:

The contractor shall at all-time indemnifies GETCO and its officers, servants and

agent against all third party claims, what so ever (Including but not limited to)

property losses/ damages, personal accident, injury or death of persons of any sub-

contractor, and/or agents of the contractor and/or of GETCO, damage to the property of

GETCO, arising out by the Hired vehicle, the contractor shall bare at his own cost and

initiative at all times till the successful completion of the contract period. Contractor shall

have to maintain comprehensive insurance policy in respect of all insurable liabilities,

under Motor Vehicle Act, workman’s compensation act, Personal injuries act, Emergency

risk insurance act, Approved by Secretary/GETCO.

If due to any reason what so ever, the GETCO has to make any payment, for vehicle or

driver etc. the amount so paid by GETCO payable by the contractor to GETCO and all

such payment shall be recovered by GETCO from the dues payable to the contractor

and/or from the security deposit of the contractor. Balance amount if any is still payable by

contractor; it has to be paid immediately to GETCO.

It is the whole and sole responsibility of the Vehicle Owner during accident to pay

compensation or damages to the persons involved as per law or Govt. Act.

4) Parking charges/Toll tax:

The parking charges at the railway station, Airport or any public/private places for the

vehicle when utilized by GETCO would be admissible subject to the production of such

parking slips. These slips may be submitted along with the monthly bills for reimbursement

of these parking charges & same way, Toll taxes will be paid on production of documents

along with monthly bill.

5) MAINTAINING OF LOG BOOK:

The contractor will be required to Maintain Log Book as per the standard format which will

record the journeys performed by the GETCO officer. The Log book when closed or at the

end of the contract, should be handed over to the GETCO for its record.

If the contractor fails to provide a vehicle; the deduction from his RA bill should be made

on prorate + applicable GST considering the monthly rate payable within 26 days per

month. And if successful bidder provides another vehicle and the vehicle is not on road

worthy straight away, the vehicle will be sent back even though temporary arrangement is

done and penalty as mentioned here in above will be levied.

In case of failure on part of the contractor to provide vehicle, the GETCO will hire another

vehicle at contractor’s risk and cost. Amount spent will be adjusted at against a penalty to

be divided as brought out here in above and also vehicle will be hired from other agency

and if required by paying higher rate, in that case, difference of rates will be recovered

from the contractor’s current R.A. Bill.

In case the party provides the vehicle which is not worthy and in good conditions. GETCO

reserves the right to use or not to use the vehicles depending upon circumstances.

7) TERMINATION OF THE CONTRACT:

i. In case of breach of any of the terms or the conditions of satisfactory service, the

GETCO without prejudice to other clauses of the contract may cancel the work order and

terminate the contract by giving a notice less than 15 days. In the event of termination of

the contract for any condition, or for any other reason the GETCO shall forfeit security

deposit and reserves the right for recovery of liquidated damages. The contractor shall

have not to claim of compensation for any loss whatsoever sustained by him.

ii. In the event of any dispute in the contract, the decision of the GETCO shall be final and

binding to the contractor.

8) VALIDITY OF TENDER:

i. The validity of tender shall be up to 180 days from the date of opening of

tender by the GETCO and they shall be legally bound to honour and commitment

relating to tenders during this period including accepting of work order and providing

vehicles on hire if so ordered by the GETCO.

ii. After the tender is accepted a work order will be placed to the party / contractor

who fulfills the terms and conditions mentioned in the tender.

iii. The parties submitting tenders must ensure that in the event of their tenders being

accepted, they will have to meet the requirement of vehicle for the category for which

tenders are submitted. In case they fail to provide vehicle as agreed will be considered

a breach of any of the terms or the conditions of satisfactory service or defaulter on the

part of the party. Their EMD will be forfeited.

iv. The vehicles ones inspected and approved by the Engineer in charge for hire,

shall not be changed or substitute by the contractor on becoming defective / off the road

due to accidental break down, etc. In such an event the contractor will give immediate

information to the Engineer in Charge of vehicle if it likely to take more than one-week

prior approval of the Engineer shall have to be taken.

9) CONTRACTOR’S UNDERTAKING:

The bidder shall give the undertaking under: “I/We have carefully read all the terms and

conditions contained in these specifications and agreeable to the same in token

therefore. I / We have laid our signature & seal hereunder of this tender copy.”

10) SAFETY REGULATION ACCIDENT AND DAMAGE:

i. The contractor shall be responsible at his own cost in and relative to performance of the

work and contract to observed and to ensure observance of the provisions of the safety

code as herein after appearing safety and security regulations as may be prescribed by

the GETCO from time to time and such other precautions measure as shall be

necessary during working time of which, minimize the disturbance and inconvenience to

the GETCO other contractors the public and the adjoining land and property owner and

occupies and shall indemnify and keep indemnified the GETCO from all against all

losses and damage and cost, charges and expenses and penalties actions claims,

demands and proceedings whatsoever suffered or incurred by or against the owner as

the case may be virtue of any loss, alteration or accidents to any works contractor shall

be exclusively responsible for any accident, loss, damages, alteration displacement

disturbance or destruction as afore said result directly or indirectly from any break by the

contractor or his obligations afore said or upon any operation act of commission act of

the contractor.

ii. The contractor’s liabilities under the contract shall remain unarmoured notwithstanding

the existence of any insurance covering any risk damage, loss or liabilities for which the

contractor is liable to the GETCO in terms of the foregoing clauses or otherwise and or in

respect of which the contractor as indemnify the GETCO with the intent that

notwithstanding the existence of such instance the contractor shall be and remained fully

liable for all liabilities and obligations under the contractor and indemnities to the GETCO

and the GETCO shall not be oblige to seek recourse under such police in performance

to recourse against the contractor on otherwise to exhaust any other remedy in

performance to the remedies available to it under contract.

11) IDEMNITY AND INSURANCE:

i. The contractor shall act the times indemnify and keep indemnified the GETCO its officer

servants and agents from all party claims whatsoever (including but not limited to

property and image, personal accident, injury or death of / to property or person of the

contractor and / or the GETCO ) and the contractor shall at his own cost and initiative at

all times up to the successful compliance of the defect or liability for the period specified

in clause here of take out and maintain insurance policies in respect of all insurable

liabilities under this clause, including but not limited to their party insurance and liabilities

under the motor vehicle act.

ii. Workman’s compensation actual accident act, personal injuries, insurance act,

emergency risk insurance act, and / or other industrial legislation from the time to time in

force in India with insurance companies approved by the GETCO and such policy / (i.e.)

shall be of not less limit here under / above specified reference to the mater here under /

above specified.

iii. Workman’s compensation insurance / to the limit to which compensation may be

payable under the laws of the republic.

iv. Third party insurance – body injury and property damage to the limit of not less than Rs.

1,00,000/- (Rs. One Lac only) in each earth accident at each job site and to a limit than

Rs. 5,00,000/- (Rs. Five Lacs) for all accident death at all job site or during trips

movements from one place to another place. Provided that the limits specify above shall

operate only as a specification of minimum limits for insurance purpose, but shall not any

way limit the contractor’s liability in terms of this clause to the limit(s) specified.

v. Should be contractor fail to take out and slash over keep a foot insurance as provided

for in the fore going clause the GETCO shall be entitled (But without obligation to do so)

to take and / or keep a foot such insurance at the cost and expenses of the contractor

and without prejudice to any other rights or remedied of the GETCO this behalf to deduct

COMMERCIAL TERMS & CONDITIONS

1) GENERAL TERMS AND SPECIFICATIONS:

The rates of said work quoted by the contractor will be valid for the period of six months

from the Date of opening of the tenders. (a) Rates quoted in the tender shall be

considered final; thereafter any change of rates quoted shall not be taken in to

consideration. (b) GST will be reimbursed on production of challan for amount paid to

concern department as proof on actual execution of work.

The rates may please be submitted as per Schedule-B. The rates shall be given both in

figures and words. There should not be any over writing and crossing. If any changes are

to be done crossing the original writing the same should be countersigned by the tenderer.

In case of difference between rates in figures and words the rates most favourable to the

GETCO shall be considered which have been quoted.

3) SIGNING OF AGREEMENT:

The contractor will have to sign agreement as per GETCO’s rules in the prescribed

proforma of the GETCO. The cost of the required stamp paper will have to be borne by the

contract basis, whose details are specified in the said A/T.

The Contractor through t h i s Undertaking cum Indemnity Bond indemnifies GETCO

against any responsibility toward loss/accidents, damages, to the contractor's

staff/equipment or any other person/vehicle, due to non-observance of safety measure

or non-compliance of any other statutory or non-statutory liabilities. The contractor

undertakes that in case he/she sub-lets the contract to any third party or provide the

vehicle to GETCO wherein he is not the owner of that vehicle/s, then also, the contractor

shall be responsible to comply all statutory/non-statutory liabilities, safety measures

& other liabilities of such third party owners of vehicle. The contractor o n behalf of

himself and also on behalf of third party ownership of vehicle, indemnifies GETCO that

incase of any financial or non-financial implications onto GETCO, then Contractor shall

make good for it and will bear all the implications, burdens (financial/non-financial

liabilities) to its effect, throughout the contract period.

1.1. Stop deal / banned for business dealing / blacklist means debarment of parties from

participating in the tendering process.

1.1.1. Firm will mean Bidder / Licensor / Tendered / Consultant / Vendor /

1.1.2. Reasons for Putting a Firm on Stop deal / banned for business dealing /

Blacklisting is to protect the GUVNL and its subsidiary Companies from dealing

with an undesirable firm.

1.2. The list of indicative reasons for placing the firm in a Stop deal / banned for business

dealing / Blacklist are as under.

agreed terms and conditions,
