2.DESCRIPTION OF WORK: Kota - Transportation of Railway Bogie/Trolley /wheel sets between IOH Depot/Kota to CRWS/Bhopal and to any depot/ workshop over Indian Railways for 3 years. 3.SCOPE OF WORK AND SCHEDULE OF TECHNICAL REQUIREMENT: 3.1SCOPE OF WORK: The contractor shall carry out the work of Transportation of minimum 2 Nos. of Railway coach trolleys or 12 Nos. of wheel sets in each trip between IOH Depot/Kota to CRWS/Bhopal and to any depot/ workshop over Indian Railways. 3.2Contractor shall provide the vehicle with minimum capacity of 2 Nos of Railway coach trolleys or 12 Nos of wheel sets to perform the scope of work as mentioned in Para 3.1 above. 3.3Whenever required by SSE/C&W/In-charge or the authorized representative of Sr.DME/Co/Kota, the Contractor shall arrange and provide suitable vehicle having adequate capacity and configuration to safely transport 04 Nos of bogies of LHB type or 04 Nos of ICF type or combination of LHB and ICF Type of bogie in a single trip. 4. The contractor shall carry out the work including civil, electrical, mechanical engineering besides specialized material/ equipment if required for the Transportation of Railway trolleys /wheel sets between IOH Depot/Kota to CRWS/Bhopal and to any depot/ workshop over Indian Railways. However, the tenderer is advised to survey the depot and understand the detailed requirements for deciding the system for carrying out the work. 5.After completion of work, the site is to be cleared of all material, excavated material and any other un-wanted things and dispose the same outside railway premises or at a nominated place within railway premises as decided by the coordinating official of railways. 6.For carrying out the work, Railways will not provide concomitant accessories if required for the Transportation of Railway trolleys /wheel sets between IOH Depot/Kota to CRWS/Bhopal and to any depot/ workshop over Indian Railways. However, Loading and Unloading of wheel sets of coaches at IOH Depot/Kota, CRWS/Bhopal and at any depot/ workshop over Indian Railways will be done by the Railways 7.The work shall include all activities related to Transportation of Railway trolleys /wheel sets between IOH Depot/Kota to CRWS/Bhopal and to any depot/ workshop over Indian Railways. 8.Transportation of Railway trolleys /wheel sets between IOH Depot/Kota to CRWS/Bhopal and to any depot/ workshop over Indian Railways work shall be deemed to be completed only when a work done report is issued by the Sr. Divn. Mech. Engineer(Co) or his authorized representative. 9.The contractor has to make his own arrangements for the drinking water/water requirements for the work whenever required.
10.The contractor will have to make his own arrangements for electricity power supply for the work if required i.e. DG set or temporary connection from RSEB. Alternatively, the electricity can be provided by railways on payment, in terms of Para 31 of Part-II of GCC for works. For this, the contractor shall have to submit his load requirement, based upon which railways shall work out an estimate for all the cabling and equipment required for providing a power source at the desired location. In this case the contractor shall have to submit in advance, a separate security deposit of equivalent amount plus estimated energy consumption for three months. This deposit shall be refunded at the time of completion of work after deducting the actual energy cost and 15% of the equipment and cabling, specially provided for this work. 11.Contractor shall deploy a supervisor (Graduate or equivalent) for supervision of work and liaisoning with railway officials. 12.CONTRACT COMPLETION PERIOD: The contract completion period for the work shall be 3 calendar years from the date of commencement of work. Completion of work shall be certified when the work of Kota - Transportation of Railway trolleys /wheel sets between IOH Depot/Kota to CRWS/Bhopal and to any depot/ workshop over Indian Railways for three years is successfully done. 13.PAYMENT TERMS: The payment terms will be as follows: 13.1 Payment for the work of Kota - Transportation of Railway trolleys /wheel sets between IOH Depot/Kota to CRWS/Bhopal and to any depot/ workshop over Indian Railways for 3 years on monthly basis. The unit of the payment is per km per Trolley/6 Wheel set basis. Payment shall be made on monthly basis for the quantum of the work carried out during that month subject to deduction of security deposit, conservancy cess or any other statutory deductions. 13.2Security deposit shall be released only after successful completion of the contract. 13.3No interest shall be payable on any amount which is payable to contractor for delayed payment or any other cause. 13.4 Railway shall not pay any additional expenses except the contracted price. Any expenses in the form of statutory levies, toll tax, road tax, state-entry tax for safe transit of railway material or any other incidental expenditure shall have to borne by the contractor except GST as per Para 13.6 below. 13.5No Octroi charges shall be payable as the material for transportation belongs to Railways (Government of India) and is exempted from local levies. A certificate to this effect shall be issued by Railway authorities if so required, so as to claim exemption during transit. 13.6GST as applicable and accepted as per agreement will be reimbursed to the bidder on prevailing rate during the currency of contract subject to production of authentic documentary evidence of this tax actually paid to the Government of India by the contractor. 14.The quantities for the above items are approximate and are variable. The contractor will have no claim due to variation / deletion of items. 15.Contractor has to deploy sufficient manpower to carry out the work as directed by the site in charge. 16.Work will be carried out as per Railway's & IS specification and as per relevant RDSO drawing/ CME drawing or drawing supplied by Railway if required. 17.Any wastage of labours and materials due to the site conditions will be on contractor's account and nothing extra will be paid on this account.
18.Work should be carried in such a manner by the contractor that no inconvenience is caused to the other persons. 19.The destination for transportation of Railway trolleys /wheel sets of Railway coach/wagons shall be from IOH/Sick line depot/ Kota to CRWS/Bhopal and to any depot/ workshop over Indian Railways. The contractor shall provide adequate number of trailers at Kota and/ CRWS/Bhopal and to any depot/ workshop over Indian Railways for loading of Railway trolleys /wheel sets of Railway coach/wagons, as and when a demand is placed by an authorized representative nominated by Rly. Administration. In one trip, minimum capacity of trailer shall be to carry either 2 Railway coach bogies with wheels and fittings or 12 Wheel sets of Railway coach/wagons. Details of consignment are as under: 1.Railway coach bogies with wheels and fittings Size 4380 mm L x 2770 mm W x 1000 mm H - Weight - 4.6 tons each or latest as per Railway drawing. 2.Wheel sets of Railway coach/wagons Size 2400 mm L x 1100 mm W x 1100 mm H - Weight - 1.4 tons each or latest as per Railway drawing. 20.The contractor has to provide trailers within 3 working days (excluding the day on which such demand was placed and acknowledged), failing which liquidated damages shall be deducted @ 1/2% of the full contract value per week or part thereof. 21.The contractor has to provide trailer for loading in the forenoon during working hours. In case of late placement, the loading may not be permitted on the same working day. 22.The Contractor shall provide the trailers in good working condition. Railway shall have the right to reject the Vehicle if found unsuitable for loading of Railway Material. 23.The contract shall remain valid for a period of three calendar year from the date of commencement of work, which can be extended in case of unforeseen circumstances with mutual consent. 24.Railway administration reserves the right to Reduce/cancel the quantity without assigning any reason on short time notice. In such a case Contractor shall not be entitled for any compensation. At the same time Rly. Administration shall also reserve the right to increase the quantity by 25% of the originally contracted quantity at same terms and conditions. 25.No detention charges shall be payable to the transporter on any account; however Railway Administration will take necessary steps to load and unload the Railway material in minimum possible time. 26.Contractor will collect the Railway coach bogies with wheels and fittings or Wheel sets as the case may be from coaching/ wagon depots or a place as decided by the Railway and transport the same to the destination. 27.The contractor will transport minimum two Railway coach bogies with wheels and fittings or 12 wheels sets in a trailer. The contractor has to provide trailers in sufficient numbers to transport with capacity of minimum 2 Railway coach bogies with wheels and fittings or 12 Wheel sets of Railway coach/wagons in each trailer as per demand of Railways. 28.Contractor shall make special arrangement if required in the trailer for transportation of Railway coach bogies with wheels and fittings or wheel sets. The necessary security/safety arrangement for the transportation of Railway coach bogies with wheels and fittings or wheel sets will be done by the contractor. All the arrangements shall be done by the contractor to protect the Railway coach bogies with wheels and fittings or wheel sets from bad weather/Rain water and safe transportation.
29.If Railways so decides on trip-to-trip basis, Railway representative shall travel along with trailer crew while transporting the Railway coach bogies with wheels and fittings/ wheel sets under this contract. 30.The contractor shall bear and pay the entire operation cost of the trailer which will deemed to be included the following: a) Provision for the driver, cleaner and also necessary relief's, including their salary and other emoluments b) Cost of fuel and lubricating oil etc. c) Maintenance and repair cost of trailer d) Road Tax/Road permit fee and other taxes in relation to said trailer. 31.Tenderer shall furnish copy of the permit issued by concerned RTO for transportation of the Railway coach bogies with wheels and fittings/ wheel sets to the destination if required. 32.No other material shall be carried in trailer during the transportation of Railway coach bogies with wheels and fittings/ wheel set. 33.Transportation of Railway trolleys /wheel sets of Railway coach/wagons shall be from IOH/Sick line depot/ Kota to CRWS/Bhopal and to any depot/ workshop over Indian Railways by road transport. 34.The likely destinations are given in Annexure 'DEST', along with their distance in Kms & Period of journey in days in one direction. 35.Trip means transportation of material to destination in one direction e.g. Either Kota to CRWS/Bhopal or CRWS/Bhopal to Kota. 36.The payment for the trip to destination, mentioned in Annexure 'DEST', will be made as per the kilometer given therein. For destination not covered in Annexure 'DEST', distance given in Road Distance Guide published by Indian Map Service/Google Map will be considered for the purpose of payment and not distance traveled as per Odometer of trailer. In case, any destination not covered in Road Distance Guide published by Indian Map Service /Google map, an authorized representative of Sr.DME (Co)/WCR/Kota will travel in trailer and distance certified by authorized representative of Sr.DME (Co)/WCR/Kota and Driver of the trailer will be taken for the purpose of payment. 37.The route kilometer will be counted for the shortest route from starting point to destination as per the Road Distance Guide published by Indian Map Service/Google Map.38LOADING/ UN-LOADING OF MATERIAL: 38.1Loading & unloading of consignment on trailer shall be done by Railways. However the fastening and securing of material on the trailer shall be the responsibility of the transporter. Necessary securing arrangements may be made in advance so that during transit no damage is caused to the Railway coach bogies with wheels and fittings/ Wheel sets. Contractor shall be fully responsible for ensuring the delivery of material at destination in sound condition. 38.2 The contractors shall fulfill and carry out all instructions issued by Railways or its authorized representative relating to loading/unloading transporting, operating & delivery of the Railway coach bogies with wheels and fittings/ wheel set in trailer. Any violation/breach or default thereof will be treated as breach or default of the contract entitling the Railways to terminate the same.
39.SAFETY AND SECURITY OF MATERIAL: 39.1 While discharging this contract the contractor shall own full responsibility for the acts of omission/commission/ misconduct/ attempt to pilfer/contaminate the Railway material under transport by crew/operator/contractors. 39.2If a trailer operator/crew provided by contractor is involved in any malpractices Railways will be entitled to suspend operation at it sole discretion forthwith and to conduct investigation into the malpractices. If upon such investigation the Railway concludes that the crew is involved in any malpractice it will blacklist such trailer operator/crewman and take legal action. If however, the investigation reveals the role of the contractor in the malpractices, contract shall stand terminated forthwith and all the trailers provided by the contractor in territory of this agreement will be blacklisted. The contractor shall submit an indemnity bond on Rs. 500/- stamp paper for amount of Rs 60 Lakhs as per prescribed performa /draft for safety and security of Railway materials before commencement of said work. 39.3 In case of any loss/theft/damage suffered by Railways for Railway material, legal action against firm/contractor/transport contractor may be taken in consultation with civil police/GRP/RPF as deemed appropriate by Railway administration. 40.HANDING OVER/TAKING OVER MATERIALS: 40.1While taking over the material from consignee contractor shall acknowledge receipt of material. The cost of material as mentioned by Railways shall be invariably mentioned in the trailer receipt. 40.2Contractors will lift, transport and deliver the stores, during the working hours/working day of individual shed/depots concerned. 40.3On delivery of material to consignee the contractor will have to obtain clear acknowledgement of the consignee under his office stamp duly affixed in support of the consignment having been delivered in safe & sound conditions.
41.LOSS & DAMAGE OF MATERIAL: 41.1The contractor shall be liable for any loss or damage to the Railway employees/property, contractor's employees or any third party resulting from fire, negligence, explosion, accident or any other cause while discharging this contract and the contractor shall indemnify Railways against any such damage and shall be liable to pay to the Railways any such amount as may be awarded by any court of law or specified by Railways. 41.2The contractor shall remain at all-time liable and responsible to the Railways for any loss or damage caused to Railway material, building, plant, machinery or any property of the Railway by any carelessness negligence, inexperience, natural calamities, civil unrest or willful act of the contractor or his employees/representative. The assessment of damage shall be done by Railways and this assessment shall be final and binding on the contractor. 41.3The Railways will also be authorized to recover/reimburse the amount of loss suffered by the Railways from the contractor under these provisions and the decision and determination by the Railways or its authorized representative as to the reasons for such loss or as to the existence of any acts or events such as riots civil commotion or natural calamities as prescribed above shall be final and binding on the contractor/s & shall not be challenged in any court of law or arbitration or otherwise and the contractor after signing this agreement hereby irrevocably authorizes the Railways to set off and adjust such loss or damage against the amount of security deposit and/or outstanding payment and in the event of short fall, the contractor shall immediately, on issuing a certificate by the Railways, pay the same amount to the Railways without demur or objection. 41.4The contractor is required to safe guard the material given for transportation and carries it safely. Wastage or loss or damages to Railway material in any manner should be totally avoided and in case any shortage or damages is found the recovery will be made from the contractor in accordance with Railway rules. 41.5The contractor shall get the railway material insured for all types of road risk & SRCC during transit from a public sector insurance company before the loaded truck leaves the railway premises from Kota/ Destination. The same shall be verified by a representative of Railway before the release of the trailer from Kota/ Destination. A copy of the original insurance cover note shall have to be deposited along with the invoice, without which a penalty of Rs 1000/- per trip will be imposed and deducted from the first or next running bill. The value of consignment for the purpose of insurance shall be Rs 30 Lakh/- for one trolley/6 wheel sets and shall be multiplied by the number of trolleys transported in each to or from trip. For example, if 2 complete coach bogies/ 12 wheel sets are transported from Kota to Destination, value for the insurance shall be Rs 60 Lakh for one trip. 42.COMPLIANCE OF VARIOUS ACTS/LAWS: 42.1The contract is subjected to compliance of Motor Vehicle Act 1988,the Central Motor Vehicle Rule 1989 and the amendments there off and other relevant State Motor Vehicle Rules and notifications, if any, issued by Railways. The contractor shall ensure compliance of these and indemnify the Railways in this regard.
42.2 Contractor will indemnify the Railways against all the liability, where ever in pay and compensation under Workman's Compensation Act 1923 or in respect of any accident of labors employed by him or compensation in respect of any claim received out of or in the course of the works contemplated by this contract and against the cost charges and expenses incurred or sustained by the Railways in the matter. 42.3Contract shall abide by all relevant Labour Laws/Workmen Compensation Act and other statuary provisions of State and Central Government. 42.4 The contractor hereby binds himself to abide by the Motor Vehicle Act, Payment of Wages Act and other Labour regulations in force in the territory of operation of Trailer for the purpose of works contemplated in this contract. 42.5Contractor shall be solely responsible for payment of any compensation to his workmen under the Workmen's Compensation Act 1923,1933 & the amendments thereof for the injuries caused to the his workmen even in the Railway premises. The contractor shall also indemnify the Railways against any such payment toward injuries/loss of life of contractor's workmen, which may be ordered by any court of law. 42.6While transporting dangerous/hazardous products, the transport contractor shall ensure to take all precautionary measures including display of special sign with warning in the language of states of transit and destination, including the nature of product being transported. The transport contractors are to follow instruction issued by transport commissioner office for carrying such dangerous/hazardous products from time to time. 42.7The contractor must ensure that the driver engaged for transportation possess a suitable valid driving license for the trailor with due endorsement if required for carrying hazardous goods as per the prevailing sections in the Motor Vehicle Rules/ Acts. 42.8The contractor must ensure that the compliance of all Government rules and regulations regarding transportation of material and route permit etc. will be responsibility of the contractor and any point of non compliance of any such rules shall be treated as breach of contract. 42.9The trailer shall have the necessary permit clearance, all the paper clearances i.e. insurance, road tax, vehicle fitness certificate, PUC certificate etc. and all other liabilities from State Motor Vehicle authority.
43.Penalty a)Vehicle shall be available whenever required for transporting wheels or bogie as per the SSE/C&W In charge, failure of availability of vehicle is liable to penalty of Rs 1000/- per such incidence. b)Any incidence of delay due to non availability of vehicle driver is liable to penalty of Rs 1000/- per such incidence. c)Any incidence of detention due to failure of vehicle or failure of contractor's staff shall be liable to penalty of Rs 1000/-per such incidence. d)If the work is not started up to the specific date of contract order. A penalty of Rs 1000/- per day shall be imposed. e)The Wheels/Bogie/Trolleys must be transported from one end to other end in maximum days mentioned in Annexure- DEST". In case of delay in reaching the destination (for location specified in Annexure- "Dest" ) of departure from loading point a fine of 1000/-will be imposed per day for every additional day after specified period. However, holidays, Sundays and non-working hours at either end depot/workshop shall not be taken in consideration while calculating journey days. f) If contractor fails to deploy supervisor as per para 11, A penalty of Rs 500/- per day shall be imposed. g)Sr. DME/Co shall have the discretion for waiver of penalty on case to case, depending on merit of each case. 44.Letter of Credit (i)For all the tenders having advertised cost of Rs 10 lakh or above, the contractor shall have the option to take payment from Railways through a letter of credit (Le) arrangement. (ii) This option of taking payment through LC arrangement has to be exercised in IREPS (Indian Railway Electronic Procurement System -the e-application on which tenders are called by Railways) by the tenderer at the time of bidding itself, and the tenderer shall affirm having read over and agreed to the terms and conditions of the LC option. (iii) The option so exercised, shall be an integral part of the bidder's offer. (iv) The above option of taking payment through LC arrangement, once exercised by tenderer at the time of bidding, shall be final and no change shall be permitted, thereafter, during execution of contract. (v) In case tenderer opts for payment through LC, following shall be the procedure to deal release of payment through LC:(a) The Le shall be a sight LC (b) The contractor shall select his Advising/Negotiating bank for LC The incidental cost towards issue of Le and its operation thereof shall be borne by the contractor. (c) SBI, New Delhi, Main Branch will be the nodal branch for issue of LCs based on online requests received from Railway Accounts Units for tenders opened in financial year 2018-19. SBI branches where the respective Railway Accounts Office has its Account (local SBI branch) will be the issuance/reimbursing branch for LC issued under this arrangement. The Bank shall remain same for this tender till completion of contract. The incidental cost @ 0.15% per annum of LC value, towards issue of LC and operation thereof shall be borne by the contractor and shall be recovered from his bills.
The LC shall be opened initially for duration of 180 to 365 days in consultation with contractor. The LC shall be extended time to time as per the progress of the contract, on the request of the contractor. The value of LC to be opened initially as well as extended thereafter shall be finalised by the engineer in consultation with the contractor on the basis of expected progress of work. (e) The LC terms and conditions shall inter-alia indemnify and save harmless the Railway from and against all losses, claims and demands of every nature and description brought or recovered against the Railways by reason of any act or omission of the contractor, his ,agents or employees, in relation to the Letter of Credit (LC). All sums payable/borne by Railways on this account shall be considered as reasonable compensation and paid by contractor. (f) The LC terms and conditions shall inter-alia provide that Railways will issue a Document of Authorisation (format enclosed as Annexure H after passing the bill for completed work, to enable contractor to claim the authorized amount from their bank. (g) The acceptable, agreed upon document for payments to be released under the LC shall be the Document of Authorisation. (h) The Document of Authorisation shall be issued by Railway Accounts Office against each bill passed by Railways. (i) On issuance of Document of Authorisation, a copy of Document of Authorisation shall be posted on IREPS for download by the contractor. A digitally signed copy of Document of Authorisationshall also be sent by Railway Accounts Office to Railway's bank(Local SBI Branch). (j) The contractor shall take print out of the Document of Authorisation available on IREPS and present his claim to his bank (advising Bank) for necessary payments as per LC terms and conditions. The claim shall comprise of copy of Document of Authorisation, Bill of Exchange and Bill. (k) The payment against LC shall be subject to verification from Railway's Bank (Local SBI Branch). (I) The contractor's bank (advising bank) shall submit the documents to the Railway's Bank (Local SBI Branch). (m) The railway's bank (issuing bank) shall, after verifying the claim so received w.r.t. the digitally signed Document of Authorisation received from Railway Accounts Office, release the payment to contractor's bank (advising bank) for crediting the same to contractor's account. (n) Any number of bills can be dealt within one I.C, provided the sum total of payments to contractor is within the amount for which LC has been opened. (o) The LC shall be closed after the release of final payment including P VC amount, if any, to the contractor. (p) The release of performance guarantee or security deposit shall be dealt directly by railway with the contractor i.e., not through LC. (q) For opening of LC, executive department shall make a request letter to concerned Accounts Department on a format, placed as Annexure - LC.
45.Shramik Kalyan (i) Contractor is to abide by the provisions of Payment of Wages act & Minimum Wages act in terms of clause 54 and 55 of Indian Railways General Condition of Contract for works. In order to ensure the same, an application has been developed and hosted on website 'www.shramikkalyan.indianrailways.gov.in'. Contractor shall register his firm/company etc. and upload requisite details of labour and their payment in this portal. These details shall be available in public domain. The Registration/ updation of Portal shall be done as under: (a)Contractor shall apply for onetime registration of his company/firm etc. in the Shramikkalyan portal with requisite details subsequent to issue of Letter of Acceptance. Engineer shall approve the contractor's registration in the portal within 7 days of receipt of such request. (b)Contractor once approved by any Engineer, can create password with login ID (PAN No.) for subsequent use of portal for all LoAs issued in his favour. (c)The contractor once registered on the portal, shall provide details of his Letter of Acceptances (LoA) / Contract Agreements on shramikkalyan portal within 15 days of issue of any LoA for approval of concerned engineer. Engineer shall update (if required) and approve the details of LoA filled by contractor within 7 days of receipt of such request. (d)After approval of LoA by Engineer, contractor shall fill the salient details of contract labours engaged in the contract and ensure updating of each wage payment to them on shramikkalyan portal on monthly basis. (e)It shall be mandatory upon the contractor to ensure correct and prompt uploading of all salient details of engaged contractual labour & payments made thereof after each wage period. (ii) While processing payment of any 'On Account bill' or 'Final bill' or release of 'Advances' or 'Performance Guarantee / Security deposit', contractor shall submit a certificate to the Engineer or Engineer's representatives that "I have uploaded the correct details of contract labours engaged in connection with this contract and payments made to them during the wage period in Railway's Shramikkalyan portal at 'www.shramikkalyan.indianrailways.gov.in' till ____Month, ____Year."
