5. Supplier is required to submit Item-wise rate as per the attached list of Items in Annexure-III.
6. The bidder offering the lowest rate on the largest (Maximum) number of products will be selected as
the preferred supplier. This selected bidder will have the first right of refusal to match the lowest (L1)
rate offered by other L1 bidders for products where he is not the L1. If the selected bidder chooses
not to match the L1 rate for any such product, the original L1 bidder will be bound to supply that
product at the rate they initially offered.
7. Once quoted, the bidder shall not make any subsequent price changes, whether resulting or arising
out of any technical/commercial clarifications sought regarding the bid, even if any deviation may be
specifically stated in the bid. Such price changes shall render the bid liable for rejection.
8. Bidder shall quote the rates of items as mentioned with validity for 2 years.
9. The Bidder must have a registered office in the State of Gujarat. Relevant proof of documents should
be submitted along with Bid.
10. The organization should have an average turnover of Rs. 2,00,000 in the last three years (2022-
2023-24 & 2024-25). CA Certificate in the attached format to be submitted.

11. The University will enter into the contract initially for 2 years, extendable to a further period
depending on the mutual consent with such modifications if required.
12. The Supplier shall supply all the items free of postage, packing and forwarding charges.
13. The University shall not make any advance payment to the supplier for the orders placed.
The payments shall be released by the University against the bill (s) received from the supplier after
having received the Goods in good state and to the satisfaction of the University.
14. Supplies are subject to inspection and approval by the Authority.
15. Random testing may be done to verify purity and performance, charges for the same shall be borne by
16. The batch number, expiry date, and manufacturing details must be clearly printed on packaging
wherever applicable.
17. All items must comply with relevant ISI / ISO / BIS standards where applicable.
1. BMTU may ask the bidder to submit any document subsequently if required.
2. The Bidder can quote the rates separately for all the Items, and the bidders have to supply a minimum
of 90% of Items, from orders received from BMTU. For 10% or less supply, the bidder needs to
inform BMTU within 5 working days. The above non-availability of such Items by clearly mentioned
with reason. Once an order is accepted finally the bidder must supply all Items.
3. In case of any dispute(s) arise, the decision of the Vice Chancellor of BMTU shall be final.
4. The BID will be rejected if the required documents are not submitted in the BID within the time
5. In case of partial supply, the payment of the bill will not be made.
6. The bidder is required to provide all the Items in the ready condition and it should not be damaged
while supplying the same at the specified location. If the Products are found damaged, they should be
replaced within a week by the bidder. The Payment for the same will be made thereafter.
7. The prices quoted will include all types of taxes, transportation charges, Labor charges, etc.
8. The selected bidder should submit an affidavit duly notarized that they will accept all the terms and
conditions within 1 month of getting the work order.
9. All supporting documents such as annual Financial Audit reports etc. must be duly stamped and
signed by the competent authority of the firm and the same must be attached to the application form.
10. The firm should submit a Fresh affidavit duly notarized on stamp paper of Rs.300 that they have not
abandoned any work of Union Government / State Government / PSU’s/Universities/Gov.
Organizations etc. during the last 3 years. They should also submit an affidavit that they have not
been blacklisted, debarred, declared non-performer or expelled by Union Government / State
Government / PSU’s /Universities/Gov. Organizations etc. during the last 3 years.
11. The decision of the Management regarding the technical qualification is final and binding to the
bidder and no correspondence will be entertained in this regard thereafter.
12. It is mandatory to quote for all items.
13. The awarded party have to complete the order within the time limit as per specified by the BMTU
14. If the selected bidder fails to provide items within the prescribed time limit, the work order for the
same items may be given to L2 bidder.
15. BMTU may ask the bidders to provide samples of Items and the bidder has to submit the same within
in prescribed time limit. If the bidder fails to do so, the work order will not be issued.

16. In case of any litigation(s) that may arise in this matter, it shall be subject to the exclusive jurisdiction
17. All successful Bidders have to submit a security deposit of Rs.
18. The delivery Items will not be accepted if:
o It has been Re-Furbished
o If the Companies, Manufacturer / Brand etc. are misrepresented by any means,
o If the products are out of date
19. If the bidder fails to perform all and/or any of the terms and conditions laid down by BMTU from
time to time, BMTU will reserve the right to take actions of forfeiting the Security Deposit as well as
cancellation of the contract.
20. The Security Deposit will be refunded after the successful completion of a contract.
21. The Bidder shall bear all costs associated with the preparation and submission of the Bid and BMTU
will in no case be responsible for those costs, regardless of the conduct or outcome of the bidding
22. Bidder has to complete the work of supply Items within 30 days from the work order. The duration
may be extended up to 60 days as per the requirement and if BMTU thinks fit. The decision of
BMTU authority will be final and binding to the bidder.
23. Bids shall remain valid for 2 years after the date of Bid opening prescribed by Registrar, BMTU and
they have to provide Items at the same rate and condition to the office/any college of Gujarat State.
24. Late submission, bid modification and withdrawal of bid will not be accepted.
25. The bid evaluation committee will do the technical and financial evaluation of the bidders.
26. A 10% penalty will be levied on the total bill in case of failure to meet quality standards.
27. The contract can be terminated by BMTU after giving one month's notice to the supplier of Items.
Penalty details mentioned in the following table.
If Items, materials, or parts of an order are delayed, A penalty of 0.5% of the delayed item's value
the delay will be measured per week or any part will be applied per week of delay, up to a
thereof. maximum of 10%.
If Items, materials, or parts of an order are delayed An additional 10% penalty will be applied to
for more than 03 months beyond the actual delivery delayed items.
A replacement period of one week is allowed,
If Items or materials are damaged, misrepresented, after which a penalty of 0.5% of the purchase
missing, or not in acceptable condition. order value will be applied per week of delay, up
to a maximum of 10%.
