Special Eligibility Criteria

   IRS Condition of Contract: The contract shall be governed by latest version (along with all correction slips) of IRS conditions of contract, and all other terms and conditions incorporated in the tender documents.

Commercial-Compliance

   The Delivery period shall be reckoned from the date of issue of Formal Purchase Order.

   Earnest Money Deposit (EMD) for stores Tenders: 1.1: EMD shall be submitted by tenderer as specified in tender schedule, along with their online offer. There shall be no exemption from submission of EMD for any tender or by any tenderer except those exempted following: a] EMD shall normally not be called against Limited Tenders with estimated value up to Rs. 25 Lakhs (including Single tenders, Global limited tenders) (b) Micro & small Enterprises (MSEs) having udyam registration certificate in manufacturing category. (c) Other Railways and Government Departments (d) Indian ordinance Factories (e) PSUs owned by Ministry of Railways and PSUs for the group of items that are manufactured by them in terms of Railway (f) Vendors registered with Railways for the trade group of the item tendered (g) Vendors appearing on the approved vendor lists of RDSO/PUs/CORE, subject to approval status being valid on the date of tender closing. (h) Vendors registered with Railways for supply of medicine, medical equipment and Consumables shall be exempted from submission of EMD for these items. (i) In tenders issued against PAC, OEM in whose favour PAC has been issued shall be exempted from submitting EMD. (j) KVIC and ACASH shall be exempted from EMD for items supplied by them. 1.2: Offers submitted without EMD shall be summarily rejected. 1.3 EMD amount will be as (Rounded off to nearest higher Rs 10 (Ten)- (i) For Estimated value of tender above Rs. 25 Lakhs and upto Rs. 50 Cr. EMD will be @2% of the estimated value of the tender subject to Max. Rs 20 Lakhs (ii) For Estimated value of tender above Rs. 50 Cr. EMD will be Rs. 50 Lakhs

   Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

   MSE: Purchase Preference and other benefit as per MSE shall be considered as per Para10.0 Part B of General Conditions of tender revised on Jun 2024, Version 14 available at IREPS portal .www.ireps.gov.in/ireps/upload/repository/railway/483/148/public/Tender Conditions Version 14.pdf and latest amendment available on TOD. MSE exemption not available for traders. Registration of existing enterprises as MSE: As per latest guidelines issued by the Ministry of MSME, Govt Of India, only Udhyam certificate will be considered for all kinds of benefits extended to MSE firms. Please attach Udhyam certificate along with the offer. If the MSE unit is owned by SC/ST or women entrepreneur having more than 50% shareholding in the firm. Please attach documents in support of the same.

   EFT: All Payment will be compulsorily made through Electronic Fund Transfer (EFT) scheme & vendors are requested to register for this scheme.

   The successful tenderer is not liable to be registered under CGST/IGST /UTGST/SGST Act, The railway shall deduct the applicable GST from his/their bills under reverse case charge mechanism (RCM) and deposit the same to the concerned tax authority.

   Tenderer should submit an undertaking that he will pay GST collected from Successful Railway within due date and upload the payment details in GSTIN to enable railway (purchaser) to obtain input tax credit.

   Tenderer should furnish his GSTIN with copy of registration with his offer.

   All the bidders/Tenderes should ensure that they are GST compliance and their quoted Tax structure/Rates are as per GST Law

   MARKING : Manufacturer to mark his name and date of manufacture as per drawing, wherever indicated, or at a location where it may not get obliterated in service on the item being supplied by them against the purchase order. Supplies received without this are liable to be rejected by consignee.

   Collection of non- biodegradable solid waste after successful delivery of the product / material from consignee place will be arranged by the supplier

    Single use plastic shall not be used in packing or any other purpose.

    Compliance of Restrictions under Rule 144 (xi) of GFR 2017: Restrictions on procurement from a bidder of a country which shares a land border with India I. Any bidder from a country which shares a land border with India will be eligible to bid in this tender only if the bidder is registered with the Competent Authority. II. "Bidder" (Seller / Service Provider) means any person or firm or company, including any member of a consortium or joint venture (that is an association of several persons, or firms or companies), every artificial juridical person not falling in any of the descriptions of bidders stated hereinbefore, including any agency branch or office controlled by such person, participating in a procurement process. III. "Bidder from a country which shares a land border with India" for the purpose of this Order means: - A An entity incorporated, established, or registered in such a country; or B. A subsidiary of an entity incorporated, established, or registered in such a country; or C. An entity substantially controlled through entities incorporated, established, or registered in such a country; or D. An entity whose beneficial owner is situated in such a country; or E. An Indian (or other) agent of such an entity; or F. A natural person who is a citizen of such a country; or G. A consortium or joint venture where any member of the consortium or joint venture falls under any of the above IV. The beneficial owner for the purpose of (iii) above will be as under: 1. In case of a company or Limited Liability Partnership, the beneficial owner is the natural person(s), who, whether acting alone or together, or through one or more juridical person, has a controlling ownership interest or who exercises control through other means. Explanation - a. "Controlling ownership interest" means ownership of or entitlement to more than twenty-five per cent. of shares or capital or profits of the company; b. "Control" shall include the right to appoint majority of the directors or to control the management or policy decisions including by virtue of their shareholding or management rights or shareholders agreements or voting agreements; 2. In case of a partnership firm, the beneficial owner is the natural person(s) who, whether acting alone or together, or through one or more juridical person, has ownership of entitlement to more than fifteen percent of capital or profits of the partnership; 3. In case of an unincorporated association or body of individuals, the beneficial owner is the natural person(s), who, whether acting alone or together, or through one or more juridical person, has ownership of or entitlement to more than fifteen percent of the property or capital or profits of such association or body of individuals; 4. Where no natural person is identified under (1) or (2) or (3) above, the beneficial owner is the relevant natural person who holds the position of senior managing official.

    Continuation of Land Border condition: 5. In case of a trust, the identification of beneficial owner(s) shall include identification of the author of the trust, the trustee, the beneficiaries with fifteen percent or more interest in the trust and any other natural person exercising ultimate effective control over the trust through a chain of control or ownership. V. An Agent is a person employed to do any act for another, or to represent another in dealings with third person. VI. The successful bidder shall not be allowed to sub-contract works to any contractor from a country which shares a land border with India unless such contractor is registered with the Competent Authority. Any false declaration and non-compliance of the above would be a ground for immediate termination of the contract and further legal action in accordance with the laws. Following self-declaration shall be given by all bidders along with tender.     LD: Recoveries of liquidated damages shall be levied @ 1/2 % (Half percent) of the price of the store per week or part of week during which delivery is accepted and the upper limit for recovery of LD in supply contract shall be 10 % of the value of contract irrespective of delays, unless otherwise specifically provided in the contract.

    In case of dispatch by road, date of actual receipt of material by consignee will be considered as date of supply.

    The firm must quote Free at destination rates, movement by road only.

    The bidder confirms that rates and other financial terms quoted in relevent columns of financial bid will only be ruling term for acceptance, and each term quoted anywhere else should be ignored. (Denial of this condition not recommended).
