RequiredThe bidder should have an annual financial turnover of minimum of amount put to tender for Rs. 92.41 Lakhs in two financial years during the last five years that is 2020-21 to 2024-25. Certificate issued by the Chartered Accountant should be enclosed and mention UDIN Number. Additional weightage at 10 percent for each year shall be given for turn over to bring it to 2025-26.

It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of e-Procurement on or before the last date and time of bid submission.

EMD Payments through e-Payment mode shall be made as one single transaction and payments made in part are liable for rejection.

BID CAPACITY The tenderers who meet the above specified minimum qualifying criteria, will only be qualified, if their available tender capacity is more than the total tender value The available tender Capacity will be calculated as under: Assessed available tender Capacity (A x N x 2.50 - B) Where A is Maximum value of civil engineering works Executed in any one year during the last five years (updated to 2025-26 price level) taking into account the completed as well as works in progress. N is Number of years i.e., (12 months) prescribed for completion of the works for which tenders are invited. B is Value, at 2025-26 price level, of existing commitments and on-going works to be completed during the next (Period of completion of the works for which tenders are invited)

The statements showing the value of existing commitments and on-going works as well as the stipulated period of completion remaining for each of the works listed should be certified by statutory auditors of the company or by the proprietor of the company through an affidavit.

The Contractor should furnish the name of the individual/firm with address & mobile No with Place of registration year of incorporation etc. If it is a Firm, Registration Certificate issued from the Registrar of Firms.

The evaluation of Technical Bid for qualification will only be done based on the information provided/uploaded documents by the contractor as in e-portal duly verified (if necessitates

Govt. of Karnataka Order No: FD/263/Exp-12/2022 Dated: 11.05.2022 and GO No: FD/732/Exp-12/ 2023 Dated: 27.11.2023 is applicable.

Original EPF Clearance certificate and Original ESI clearance certificate issued by the competent authority shall be submitted to division office during the agreement.

The Financial Bid Documents for the above service comprises of financial bid to indicate the amount offered by the bidder for supply of Labour service/Man power mentioned in the tender notification.

Tendering by Joint Venture are not Allowed.

The intending bidders are advised to visit the site of work before submission of the tenders.

The concerned agency should submit the EPF & ESI Details of all the engaged manpower along with Aadhar number during submission of monthly bills compulsorily, otherwise the bill will not be considered.

It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of e- Procurement on or before the last date and time of bid submission.

The additional performance security furnished in the former case/withheld amount in the later case will be released only after the entire work entrusted is fully completed and so certified by the Executive Engineer.

If any of the dates mentioned above happen to be a general holiday, the next working day holds good.

If the percentage quoted by contractor for the work is below Ninety percent (90%) of the amount put to tender (updated cost as per CSR) then the successful contractor shall furnish an additional performance security in the form of bank guarantee for an amount equivalent to the difference between the cost as per quoted percentage and Ninety percent (90%) of the amount put to tender (updated cost as per CSR) before executing the agreement. In case of contractor quoting the percentage above One Hundred and twenty five percent (125%) of the amount put to tender (updated cost as per CSR) then the amount over and above One Hundred and twenty five percent (125%) of the amount put to tender (updated cost as per CSR) will be withheld during the progress of work.

The necessary certificates / documents in support of eligibility criteria fulfilled as stipulated shall be scanned and attached to e-tender document. The Original certificates/documents shall be produced on or before stipulated date and time for verification. Scanned signature of the bidder/authorized representative of the bidder shall be attached while uploading bid document.

The Technical bid will be opened first and there after the financial bids of those qualified in technical bid will be assessed on payment of tender processing fee. The financial bid will be opened subjected to the conditions that Electronic EMD payment is confirmed in the e-Portal.

Conditional tenders are liable to be rejected. The officer competent to accept the tender shall have the right to reject any or all the tenders without assigning any reason whatsoever.

Corrigendum will be published in web site for all modifications/corrections if any.

The contractor should mention their recent correct postal address and e-mail address in the declaration form.

Incomplete tender documents will be rejected.

The contractor shall send the authorization letter for their representative duly attesting their signature.

Maintenance period or defect liability period for this work is 24 months from the date of completion of work.

As per the Karnataka building and other construction workers welfare cess act 1996, 1% of the bill amount will be deducted from the bills.

Tenders will be opened on due date in presence of the contractor or their Authorized representatives.

The contractor should furnish the name of the individual /firm with address and Telephone numbers with place of registration, year of incorporation etc.

The tender processing charges paid by the bidders are not refundable even if the tenders are cancelled.

The validity period of EMD shall be for a minimum period of 180 days plus 45 days beyond the validity of tender.

EMD of the unsuccessful bidders will be refunded only after the acceptance of tenders by the competent authority (of the Formal Tender Notice).

EMD of successful bidders will be refunded only after the Conclusion of the tenders.EMD amount and Amount put to tender will be as mentioned in the e portal.

Sub leasing of work in any form is prohibited.

EPF Clearance Certificate for having remitted the EPF shall be obtained from not below the rank of Assistant Provident Fund Commissioner for the last financial year 2024-2025 to be uploaded & submit hard copy at the time of Agreement.

ESI Clearance Certificate for having remitted the ESI shall be obtained from the competent authority for the last financial year 2024-2025 to be uploaded & submit hard copy at the time of Agreement.

The agency has to pay the variable DA to the labours as per the prevailing Govt. Orders the same shall be considered in the RA Bills

Typo-graphical errors (if any) will not be the ground for any claims by the Contractor.

The agency has to submit monthly O&M Report.

In case of delay in the payment of employee by the Nigam the payment should be made by the agency on their own Every month.. Reasons for delay in the payment of salary of employees should not be thrust / attributed to the Nigam.

The agency shall regularly remit the EPF, other relevant Taxes and Cess to the government as per Rules.

Agency shall provide proof of having remitted EPF/Taxes/ Cess / ESI to the Government of monthly payment through nationalized bank to the employees in the succeeding months with the bill, failing which this office will withhold further payment to the agency.

Rates tendered are inclusive of EPF, ESI as per prevailing rates. The manpower agency shall quote the service charge in percentage only for basic plus DA as per WRD labour rates.

For any disputes/ problems with the Man Power Services supplied in accordance with Labour Law, the department bears no responsibility what so ever. The agency will solely be responsible for the same.

Considering the availability of funds, the bill of the agency will be paid. But before this, the tenderer should take care to supply adequate water to the notified crops and tanks. With proper water management/O &M and upon ascertaining the same, the bills of the tenderer shall be paid.

The Employer reserves the right to increase or decrease the quantum of Man Power Services within the contract period and agency shall have no claim of any nature what so ever. The agency shall pay the salary and allowances to the Man Power staff category wise not less than the break up provided at the time of agreement, the agency shall agree to indemnify the department to compensate to department in case of any loss or damage occurred involving department equipments/ assets due to negligence of Man Power staff so deployed.

During the period of contract, tendered shall abide at all times, all existing Labour Enactments, rates of wages and Rules made their under, regulations, notifications and Bye Laws of State government, Central Government and Local Authority.

If two or more bidders quoted same lowest price to the work, the award of work will be done by lottery system or by obtaining no objection certificate in this regard, by forthcoming bidders who have quoted the same price.

The Successful tenderer should give the details of name of Engineer, Electricians, Helpers(Semi skilled), Fitters, Valve man (Semi skilled), Light Mazdoor (Unskilled), Heavy Mazdoor (Unskilled), Welder/Gas cutter working persons daily/weekly/monthly duty chart for various sections in which they are employed.

In case of any employee abstaining from the work, either on long leave or under any other circumstances shall be removed from the site by the department for his misconduct, The agency should immediately provide suitable substitute, so that work does not got hampered.

The Employer can terminate the contract at any point of time without assigning any reason what so ever without any prior notice.

Muster Roll of its/ his employee shall be maintained by the agency/firm and payment will strictly be made based on the number of personnel who have attended work in any given month as per indent of the Engineer In Charge.

The agencies shall supply the manpower labour/staff, who possess the prior experience of Operation and maintenance of LIS, water management, Watch and ward, Electrical work in major and medium irrigation system of the government as specified in schedule-B.

The rate considered in bill of quantities are inclusive of EPF, ESI, GST will be paid wherever it is applicable.

The Contractor should procure all materials for O&M like Batteries, Shafts, Grease, Oil, Valves & spare parts, Electrical items, etc., as in Scheduled-B and make sure that All Pumps and Motors should be ready before the Watering Period starts.

The agency has to remit the employer part and labour part of ESI and EPF amount by opening account in each individuals name or to the already existing account.

The agency has to provide different type uniform based on their work to all the manpower engaged at his own cost.

Manpower labours/staff supplied by the man power agency are the workers of the manpower agency not workers KNNL/WRD. The services of the manpower are temporary and they are not eligible for the departmental benefits.

Execution of job on all working days, as per the office working hours, or as specified by the Executive Engineer, KNNL. The contractual staff shall be available at all times as per their duty roster and they shall not leave their place of duty without prior permission.

Job will be as per scope of work/assignment of job as per Contract personnel nature by this Office.

The lowest bidder (L-1)will be asked to produce the original document before awarding of the service. In case the lowest bidder fails to produce the original documents for entering in to an agreement or the Original documents submitted does not match with the uploaded documents or found false, then his bid is treated as non-responsive bid as per clause-26(4) of the KTPP rules. The name of lowest bidder who does not produce the original documents would be removed from the select list of KNNL enrolment and KPWD registration and barred from the participation in any of the tenders invited by the KNNL there after apart from forfeiting the EMD paid through e-cash.

The tenderer is requested to ensure browser compatibility of the computer well in advance well before the last date and time for receipt of tenders. The Nigam (KNNL)/department shall not be responsible for non-accessibility of e-procurement portal due to internet connectivity issues and technical glitches.

The necessary certificates/documents in support of eligibility criteria fulfilled as stipulated shall be scanned and attached to their e-tender documents. The Original certificates/documents shall be produced if necessitates.

If any of the dates mentioned above happens to be a general holiday, the next working day is valid.

Conditional tenders shall be rejected and EMD shall be forfeited The Officer competent to accept the tender shall have the right to reject any or all the tenders without assigning any reasons whatsoever.

Department has no binding/obligation for providing quarters or any civic amenities for the accommodation of workers provided by the agency.

The payment of Bills is dependent on the availability of funds in the department/Nigam. However nonpayment of regular/monthly bills should not be a reason for stoppage of rendering man power services and O&M works.

The rates paid to the persons engaged by the Man Power Agency (for various categories of work) should not be less than Minimum Wages as declared from the Labour Department of Government of Karnataka.

Tenders will be opened on the due date in presence of the contractors or their authorized representatives.

The Contractor/Firm shall send the authorization letter of their representatives, duly attested by their signature while participation during opening of bids.

The tender processing charges paid by the bidders are non-refundable, even if the tenders are cancelled.

Incomplete tenders will be summarily rejected.

The evaluation will only be done based on the information provided by the contractor as uploaded in the e-portal.

The Successful tenderer should give the details of name of all outsourcing manpower daily duty chart for various sections in which they are employed and everyday attendance should be taken jointly from the agency & departmental officials / Engineers. If the worker fails to work as assigned, the agency has to take action and replace immediately.

Personnel employed by the Service provider for the performance of contracted duties shall be aged above 18 years & below 60 years and all should be physically able bodies with good eye sight and hearing power.

The rates considered in bill of quantities are inclusive of EPF, ESI and GST will be paid wherever it is applicable.
