Fabrication of LHB Bogie Frames through Outsourcing at Bogie Manufacturing Factory, Eastern Railway, Budge Budge

The tenderer must have minimum average annual contractual turnover of V/N OR 'V' whichever is less; where V= Advertised value of the tender in crores of Rupees N= Number of years prescribed for completion of work for which bids have been invited. The average annual contractual turnover shall be calculated as an average of "total contractual payments" in the previous three financial years, as per the audited balance sheet. However, in case balance sheet of the previous year is yet to be prepared/ audited, the audited balance sheet of the fourth previous year shall be considered for calculating average annual contractual turnover. The tenderers shall submit requisite information as per Annexure-VIB, along with copies of Audited Balance Sheets duly certified by the Chartered Accountant/ Certificate from Chartered Accountant duly supported by Audited Balance Sheet.

The tenderer must have successfully completed or substantially completed any one of the following categories of work(s) during last 07 (seven) years, ending last day of month previous to the one in which tender is invited: (i) Three similar works each costing not less than the amount equal to 30% of advertised value of the tender, or (ii) Two similar works each costing not less than the amount equal to 40% of advertised value of the tender, or (iii) One similar work costing not less than the amount equal to 60% of advertised value of the tender.

Defination of Similar Work :- Firm should experience on Fabrication of any of the following for Indian Railways/ PSUs/ Metro Railways/ Government organizations; i.Coach Body Shell/ Underframe of Railway coaches. ii.Underframe of Locomotives. iii.Bogie frame of Railway coaches. iv.Bogie frame of Locomotives

PROVISION OF PAYMENT OF WAGES ACT & CONTRACT LABOUR (REGULATION & ABOLITION ACT): Vide Railway Board's letter No. 2018/E(LL)/AT/CNR/3 dated 24.01.2018, every contractor must abide by and ensure compliance to statutory provisions of applicable Labour Laws and various Labour Legislations, as applicable, when they are engaging workmen for execution of Works Contracts awarded by Railways. Details of the above are clearly mentioned in the said letter of Railway Board. 'Successful Bidder/tenderer' or 'Contractor' shall have to submit an Undertaking stating that they shall abide by the above instructions meticulously, to pay the Minimum Wages and others facilities as per provisions of the above Labour Legislations/Laws; and in case of any deviation/non-compliance in respect of above laws/legislations; or any complaint is received to that effect, the Contractor will be solely responsible and Railway will take up necessary punitive/penal proceedings under relevant laws against the default/accused Contractor in consultation with Labour Authorities and black list them nationally. The Successful Bidder, who is the recipient of this letter, is advised to take a serious note of these issues and follow the instruction laid in the said letter of Railway Board thoroughly, both in letter and spirit. VARIATION IN QUANTITY: The quantities may vary to the extent of 50% on higher side or to any extent on lower side during the execution of work according to the actual need of the Railways. All other terms and conditions will be as per guidelines mentioned in GCC-2022 of works matter

STORAGE OF INFLAMMABLE ARTICLES: No inflammable materials, such as petroleum oil etc. within the meaning of the Indian Petroleum Act and Indian Explosives Act shall be stored at site or adjacent land until the approval of the Railway and necessary license under the Act has been obtained by the Contractor. All due precautions as required under the Act shall be taken by the contractor.

SAFE WORK METHODS: The Contractor shall at all times, adopt such safe methods of working as will ensure safety of structures, equipment and labour, safety rules that should be adhered to are given as guidelines in safety procedure orders of C & W Workshop/ER/LLH and also as mentioned under safety rules in documents attached with tender. If at any time, the Railway finds the safety arrangements inadequate or unsafe, the Contractor shall take immediate corrective action as directed by the Railway representative at site. Any directions in the matter shall in no way absolve the Contractor of his sole responsibility to adopt safe working methods. The contractor is responsible for providing skilled personnel and adequate expert supervision so as to ensure complete safety.

FIRST-AID: The contractor shall maintain in a readily accessible place first-aid appliance including adequate supply of sterilized dressing and sterilized cotton wool. The appliances shall be placed under the charge of responsible person who shall be readily available during working hours.

DAMAGE, ACCIDENTS OR FLOODS OR TIDES: The contractor shall take all precautions against damages from accidents, floods or tide. No compensation will be allowed to the contractor for his tools, plants, materials, machines and other equipment lost or damaged by any cause whatsoever. The contractor shall be liable to make good the damages to any structure or part of a structure, plant or material of every description belonging to the Railway Administration, lost or damaged by any cause during the course of contractor's work. The Railway Administration will not be liable to pay to the contractor any charges for rectification or repairs to any damage which may have occurred from any cause whatsoever, to any part of the new structures during construction. No claims in this regard will be arbitrable.

EMERGENCY WORK: In the event of any accident or failure occurring in, on or about the work or arising out of on in connection with the construction, completion or maintenance of the work, which in the opinion of the Engineer requires immediate attention, the Railway may bring its own workmen or a n y other agency to execute or partly execute the necessary work or carry out repairs if the Engineer considers that the Contractor is not in a position to do so in time, and charge the cost thereon, as to be determined by the Chief Workshop Manager, C & W Workshop/E.Railway, LLH to the Contractor.
