TENDER FOR: Carting of 10 Mtr. /270Kg. PSC poles from Kondh pole
factory to various Destinations of Divisions under Bharuch Circle.

5) The consultant shall have to submit C.A. certified financial turnover of
the last three years in which average annual financial turnover should
be at least 30 % of the estimated cost.

GENERAL TERMS & CONDITION:
They shall have to pay E.M.D. amounting to Rs. 39,800.00/-. This amount will
be payable in Demand Draft/NEFT/RTGS of any Nationalized Bank in favour of
DGVCL circle office situated at Bharuch.
SECURITY DEPOSIT:-
The successful tenders shall be required for further remit amount equivalent to
5 % of the order value towards Security Deposit. This amount will be payable in
Demand Draft/Bank Guarantee at related Circle Office. It will be refunded after
completion of the contact and on production of non-objection certificates of all
the concerned as well as the pole factory.
The successful tenders shall also have to enter in-to agreement with the
DGVCL towards execution of the contract on non-judicial stamp paper of
appropriate value (Cost of stamp shall be borne by the contactor). This
agreement will be executed as per standard format of the DGVCL at related
Circle Office before commencement of the contract.
INDEMNITY BOND:-
The successful contractor shall have to submit notarized indemnity to the
DGVCL for the entire liability of the employee engaged in the work by
contractor. The indemnity should also cover liability towards road accident
done by vehicles of the contractor during the execution of the work. For this
purpose a notarized indemnity bond shall have to be given in standard format
on non-judicial stamp paper of appropriate value as per rules (cost of stamp
shall be borne by the contractor).
TERMINATION OF CONTRACT:-
If the contractor is found to be lacking in execution of the work in any manner
the company reserves the right. To get work done through any other agency at
the risk and cost of the contractor.

days’ notice to remedy the default by Superintending Engineer (O&M) of
the concern Circle Office. For non-execution of contract, contract shall
be rescind and carry out the work as per condition of booklet of "Tender
and contract for works" and S.D. paid shall be forfeited and the
contractor shall be blacklisted.

SPECIAL TERMS AND CONDITION
SCOPE OF WORK:-
Basically, PSC poles of 10 Meter / 270Kg. type manufactured in Kondh pole
factory is required to transport to various works sites under the jurisdiction of
DGVCL. The work will include,
a. Loading of poles at pole factory in to the trucks. Loading should be done
with two point lifting. One point lifting shall not be allowed.
b. Transportation from the pole factory in to the trucks.
c. Unloading of the poles at work site. Unloading should be done with two
point lifting only. Single point lifting shall not be allowed.
Moreover, the DGVCL, if required shall also call-upon the successful contractor
to, cart the poles manufactured at factories other than mentioned above,
carted at any place within the state of Gujarat. Similarly destination, the poles
will be anywhere outside the Bharuch Circle Territory within the state of
The arrangement of necessary manpower as well as conveyance duly occupied
with loading, unloading facility will have to be made by the contractor at his
own cost. The working timing of issue of the poles from pole factory will be

The locations to which the poles are to be transported from the pole factories
shall be decided by Superintending Engineer or Executive Engineer of the
concern Division of Circle for the location under their jurisdiction at every
month as per allotment of poles from concern pole factory. Contractor will be
responsible to compensate the company for any damage to the pole carted
either during loading of pole at the pole factory or during transit or unloading
the pole at the destination. The cost of such damage will be fixed by concerned
field office under whose jurisdiction where damage might have been taken
place and such decision shall be final. Such cost of damage will be recovered
from contractor‘s bills/ dues.

Normally allotment of PSC poles from the Kondh Pole Factory of DGVCL will as
per the requirement received from Sub Division Offices. The company will like
to engage more than one agency for each of the pole factory mentioned above
in order to meet with the requirement of carting of poles.
Poles are to be delivered maximum at 3 locations in same route of each 48/50
poles Truck Trip.
The quantity of the pole to be carted to outside Circle shall be the part of
ordered quantity finalized in the contract.
Based on aggregate quantity to be carted in twenty four months will be
approximate nos. of poles as per Schedule-B. The DGVCL will likes to engage
more than one agency for the pole factory during emergency mentioned in
order to meet with the requirement of carting of poles.
It is proposed that the work shall be executed within the period of contract.
It may be noted that quantities shown in Schedule-B are approximate and
payment will be made for actual quantities carted as per item rate quantity of
It may be clearly under stood that the estimated quantities of the poles
indicated above are approximate and that they are likely to be more or less or
to be nil during any month at any time of the contractual period. The quantity
varies as per actual production / requirements of poles from time to time. If for
any reason the pole factory is unable to manufacture estimated quantity of
poles shown above in any month or at any time of the contractual period the
contractor will be entitle to transport the quantities manufactured in any
particular month. The company’s officers reserve the right to increase or
decrease the quantities of poles to be transported or delete any time either
partly or wholly during the contractual period .Payment of such work will be
based on the offered rates and measurement for the work actually done. No
increase in rates will be allowed for such increase in rates will be allowed for

The contractor shall have to transport the poles every month as per allotment
of poles from the concerned quantities. The nos. of poles and the destination
to which the poles are to be transported shall be fixed by the Company’s
officer from time to time.
Validity of the Tender shall be six months after opening of tender and
conditional tenders to be out right rejected.
Company may have huge quantity of poles in very short period in special
circumstances then DGVCL reserve the right to cart through other carting
contractor without informing the contractor to whom order is placed for
particular pole factory.
As made out clause for carting, the contractor has to arrange for the
conveyance facilities, for this purpose tenderer must furnished following
particulars along with the offer.
(1) Nos. of trucks owned along with the R.T.O. registration no., loading
capacity (16/32 poles or higher).
(2) Year of make of each vehicle.
(3) Certified photo state copies of registration book of each vehicle.
(4) Certified photo state copies of documents relating to payments of RTO
dues up to date viz, the registration tax as well as goods tax. The tender
will be liable to be rejected without further communication in absence of
basic information.
(5) Photo state copy of permit for carting of long articles.
The tenderer must simultaneously list out his commitments other than the
proposed contract of carting of PSC poles. If necessary certificate of the agency
with whom the vehicle might have been engage for specific contract/ works be
produced to the effect that the vehicle will be available for the proposed

TRUCKS OF CARTING:-
The necessary trucks for carting of PSC poles of the standard size and weight
shall be arranged by the contractor. The owner should have legitimate
permission for carting such goods. The trucks shall also be equipped with
necessary arrangement for lifting of poles. The truck driver shall always be in
possession of necessary RTO documents to avoid any traffic problem. However
in any extent the owner /contractor/ driver of the truck shall be responsible for
any liability arising out of violation of RTO rules.
Accident Liability:-
The contractor shall be fully responsible for any mishap occurring while the
vehicle is on the road. This will include liability of outsider as well as the truck
driver/ lineman/ cleaner/ employees of the contractor. The insurance liability
will be fully to contractor’s count.
DAMAGE LIABILITY:-
The contractor shall be responsible to make good of the damages which may
be occur either at the pole factory or at the site or during transportation of
poles. You will also be responsible to make good the loss due to breaking of
pole while loading or unloading or during transit. The indenter upon notice of
such breakages will withheld amount equivalent to the cost of the damaged
poles from the bills of the contractor.
ISSUE OF M.R’S. AND POLES:-
The transportation of poles shall be against issue of M.R’s. in quadruplicate by
the indenter. Necessary manpower as well as conveyance dully equipped with
loading unloading facility will have to be made by the contractor at his own
cost. This will issued by RPAD/Mail/Hand to hand or special messenger as may
The price escalation due to increase or decrease in the price of diesel (HSD)
will be admissible at one paisa (1 paisa) per pole in the rate per increase/
decrease of fifty paisa (50 paisa only) in the price of diesel per litre for third
slab of above 75 km. on submission of evidence and will be effective from the
time of its announcement by Government. For 1st slab of 00 to 30 km,
paisa per pole will be increased or decreased on quoted rate for every

paisa rise/fall of price of diesel. For 2nd slab of 30.1 to 75 km, 80 paisa per
pole will be increased or decreased on quoted rate for every 50 paisa rise/fall
of price of diesel. The price variation clause is admissible for all respective
slabs. Basic diesel rate to be considered as per basic diesel rate of Rs. 92.65/-
The rates are inclusive of loading, carting, unloading and stacking the poles at
the destination for period of 24 months or order amount completed from date
of LOI/ work order whichever is completed later. DGVCL will reserve right to
get the poles carted up to 30 % of the specified quantity through its own
departmental vehicles. No compensation for such carting will be admissible to
the successful contractor.
The contract shall be operative for a period of 24 months or order amount
completed from date of LOI/ work order whichever is completed later.
The carting contractor will be required to cart the poles to the desired
destination within the specified period of allotment of the poles from our pole
factory. In no case our allotment should lapse on account of none carting of
the poles. If for this purpose the company is required to order some other
agency, the same will be done without demand of any compensation by the

Any poles carted to the place/location other than the destination specified in
the M.R. such poles shall be re-carted by the contractor to the

location/destination specified in the M.R. In the event of failure of the
contractor to do so, they will be carted either by the DGVCL or through other
agency on account and at the risk of the contractor.
Also DGVCL reserves the right at the desecration of competent authority of the
DGVCL to impose penalty at ½ % per week for delay subject to a maximum of
10 % of contract value reckoned on the amount that would have been paid to
the contractor had the poles been carted in the stipulated time. Part of week
will be considered as one week. For working out the penalty, the material
requisition remained uncarted will be considered. If there is a backlog the
same also will be counted provided always that the delay in carting by the
contractor will be condoned on account of non-availability of PSC Poles or due
to unforeseen circumstances on his furnishing satisfactory reason and
production of documentary proof thereof.
PAYMENT OF CARTING BILLS:-
The payment shall be made by the concerned Executive Engineer who received
the poles from pole factory on the basis of poles received by them. One
duplicate copy of bill should be given to Circle office, Bharuch for information

All terms and condition of booklet for “Tender and contract for works” is made

DELAYED AND LATE TENDERS:-
1. No tender shall be accepted/opened in any case after due date and time
of receipt of tender irrespective of delay due to postal, services or any
other reasons and that the company shall not assume any responsibility
for late receipt of tender.

TERMS & CONDITIONS REGARDING INDUSTRIAL LAWS & OTHER RELATED
1. Wages to be paid & time of payment etc. by the contractor:-
The contractor shall pay minimum of as per latest minimum wages act or as
may be specified hereafter or rates fixed under the minimum wages act
whichever is higher. The wages of every contract labour employed by him
under this contract shall be paid by him before the expiry of 7th day of the
last of the month in respect of which the wages are payable (i.e wages of
month have to be paid him in the first week of the next month.) The
payment shall be discharge in the presence of Management representative
during the working hours in factory premises & the contractor shall get
entries certificated in the register of wages by the representative of the
Board. Any default will result in cancellation of contract forthwith or else the
contractor shall be punishable to the extent of Rs. 100.00/- fine per each

Person below age of 18 years shall not be employed for the work.
No female worker shall be employed in the night shift between 7 p.m. to

Government norms from time to time with the office of frame there under
of labour as per The Control Labour (Regulation & Abolition) Act.

3. License fee as prescribed under The Control Labour (Regulation &
Abolition) Act. & rules frame there under depend upon the number of
workmen employed by the contractor.
4. Paid leave facility & wages as per the provision of the factories act at the
rate of one day for every 20 days of working.
5. Identity cards as prescribed under the facilities act with photo affixed
there to the same for identification.
6. Payment of retrenchment compensation notice pay & other liabilities as
per Industrial Disputes Act. Any payment to the contractor’s employees
arising out of any claim or disputes under The Industrial Dispute Act, 1947 or
any other labour laws.
7. Payment of compensation in case of accident injury.
8. Provision of ereche if the female labour employed are more than

The above are some of the major liabilities of the contractor in addition to
other liabilities prescribed under the various labour laws in force from
statutory authorities like State Government / Government of India which the
contractor shall have to comply with.
3. Provident fund & Family pension scheme:-
The contractor shall submit along with his bill (month wise) a statement
regarding deductions against employees provident fund & family pension
scheme in respect of each concerned against employee. Provident fund &
family pension scheme at the rate of 8.33 % (or at the rate made applicable
by the Government from time to time) of the wages. The contractor’s
contribution & his workers contribution towards provident fund, family
pension scheme shall be deposited by the contractor with Regional
Provident Fund Commissioner.

4. Deposit Link Insurance:-
The contractor shall have to deposit 0.5 % of the wages in respect of
employees who is a member of the provident fund as the contribution to the
Deposit link insurance scheme with Regional Provident Fund Commissioner.
5. Administrative charges:-
Administrative charges for monitoring provident fund A/C shall be deposited
by the contractor with Regional Provident Fund Commissioner at the rates
6. Workmen’s compensation fund & employer’s liability Insurance:-
The contractor shall cover all his employees under workmen’s compensation
fund & under the liability insurance. The contractor shall employ adequate
number of experience staff at site for daily supervision & for maintenance of
various register & records required under the law & contract. No payment
for supervision shall be admissible.
7. Contractor to Indemnity the DGVCL:-
The contractor shall indemnity the DGVCL & every member officer &
employees of the DGVCL also. Engineer in charge his staff against proceedings
claims, demands, costs & expenses what so ever arising out of or in
connection with the matters referred herein above elsewhere & against all
actions. Proceedings claims, demand costs & expenses which may be made
against the DGVCL or Government for or in respect of or formance of his
obligation under the contract documents.
The DGVCL shall not be liable for in respect of or in consequences of any
accident or injury to any workmen or other person in the employment of
contractor or his sub-contractor & the contractor shall indemnity & keep
indemnified The Board against all each damage & compensation & against all
claims, demands, proceedings costs, charges & expenses what so ever in
respect thereof in relation there to.
8. Work compensation & employer’s liability insurance:-
Insurance shall be affected for all the contractor’s employees engaged in the
performance of his contract if any of the work is subject the contractor shall
require the sub-contractor to provide workmen’s employees unless such
employees are covered under the contractor’s insurance.
