[a] The tenderer with past performance of satisfactory execution of contracts to SC Railway, or Other Zonal Railways/Pus for supply of the same / similar items for a quantity of 20 percent or more of tendered quantity against a single contract during last three years prior to, and excluding tender opening date may be considered as responsive to SC Railways requirements for placement of bulk and regular order. Tenderers are requested to submit the past performance report such as Copies of R Notes/CRAC/Proof of acceptance of material by consignee etc. along with their offer; failing which offer will be summarily rejected without making any back reference. However, in cases where the tenderers are having satisfactory past supply performances of tendered items for stock items with SCR, the supply performance data available in iMMIS with SCR shall be taken into consideration while evaluating the offers of the tenderers. [b] If such past performance level is lower, then the offer may be considered as responsive to SC Railways requirements for placement of developmental order not exceeding 20 percent of the net procurable quantity. The tenderers, who have no past performance as above, may also be considered for such developmental orders, but for consideration of such developmental orders, they shall submit details of M & P, testing facilities, STR & QAP, technical manpower available, UDYAM Registration Certificate for same/similar items etc., along with their offer. [c] In case, the tenderer participates as an authorized dealer, then the performance as required above shall be that of Principal (OEM) authorizing the agent or bidder for the same OEM. It may so happen that the agent/dealer has credentials of past supply for a different Principal/OEM, then it will not be considered as performance. For Authorised dealer, tender specific authorization from OEM has to be uploaded with bid.

Have you gone through the Instruction to tenderers and General Tender Conditions, etc., uploaded in IREPS by this Railway? Having participated in the tender it will be considered that you have gone through all the conditions and the same are accepted by you.

Have you agreed to supply the tendered stores at the rates quoted by you in accordance with the IRS conditions of contract and in accordance with special and other conditions specified / attached with the tender.

Have you ensured that while quoting the rates, you have clearly indicated the rate of applicable duties and taxes included in the prices quoted by you. Any variation in tax structure/rate due to introduction of GST, shall be dealt with under Statutory Variation Clause.

Have you ensured that you are GST compliant and your quoted tax structure / rates are as per GST Law.

Have you ensured that you have not quoted/uploaded any commercial/technical deviations/financial term in place other than specified in the tender enquiry as the same will not be considered and will be ignored. Any contract placed after ignoring such financial / commercial terms at the place other than the specified in tender enquiry will be binding on you.

Firms claiming benefit/preference under public procurement policy for MSEs must submit relevant documents along with their offer. Failing which such benefit will not be extended to them.

1. EMD IS COMPULSARY AGAINST BID VALUE. 2. ALL THE FIRMS EXEMPTED FROM EMD a. Micro and small Enterprises (MSEs) registered for the tendered item. b. Other Railways and Government. c. Indian ordinance factories. d. PSUs owned by Ministry of Railways and PSCs for the group of items that are manufactured by them. e. Vendors registered with Railways for the trade group of the item tendered upto their monetary limit of registration status being valid on the date of tender closing. f. Vendors appearing on the approved vendor lists of RDSO/Pus/CORE, subject to approval status being valid on the date of tender closing. g. Vendors registered with Railways for supply of Medicine, medical equipments and consumables shall be exempted from submission of EMD for these items, subject to valid registration on the date of tender opening. h. In tenders issued against PAC, OEM in whose favour PAC has been issued shall be exempted from submitting EMD. KVIC and ACASH shall be exempted from EMD for items supplied by them.

THE FIRMS CLAIMING EXEMPTION MUST SUBMIT THE FOLLOWING DECLARATION:- 1) BID SECURING DECLARATION TO BE SIGNED BY BIDDERS AVAILING EXEMPTION FROM SUBMISSION OF EMD. 2)I/We certify that my/our offer is eligible for exemption from submission of bid security/Earnest Money Deposit, in terms of the tenner conditions:- 3)In case my/our claim to exemption from submission of bid Security/Earnest Money Deposit is not found valid as per terms of the tender. I/We understand and accept that Railways has unquestionable right to summarily reject my bid and my offer shall not be considered for ordering. Further, I/We hereby understand and accept that if I/We withdraw or modify my/our bids during period of validity, or if I/We are awarded the contract and being called upon to submit the performance Security/Security Deposit, fail to submit the performance security/Security Deposit before the deadline defined in the request for bid document/Notice inviting Tender, I/We shall be debarred from exemption of submitting Bid Security/Earnest Money Deposit and performance Security/Security Deposit for a period of 6 (six) months, from the date I/We are declared disqualified from exemption from submission of EMD/SD, for all tenders for procurement of goods issued by any unit of Indian Railways published during this period.

1)The Public Procurement Policy envisages extending certain benefits / preferential treatment to MSEs and making efforts for development of appropriate vendors and enhancement of their participation in government procurements. In order to avail themselves of such benefits and preferential treatment, the MSEs must be registered with any of the following:- (i) Udyam Registration. (ii) Udyog Aadhar Memorandum (valid upto 31.03.2022 or as extended by Ministry of Ministry of Micro, Small & Medium Enterprises) 2) MSEs who are interested in availing themselves of these benefits have to enclose with their offer the proof of their being MSE registered with any of the agencies mentioned in the notification of Ministry of MSME as indicated below. (i) Udyam Registration. (ii) Udyog Aadhar Memorandum (valid upto 31.03.2022 or as extended by Ministry of Ministry of Micro, Small & Medium Enterprises)
