This is tender to enter into Running Contract for Manufacture and supply of PSC Sleeper conforming to RDSO Drg. No. T-8746 and IRS Specification no. T-39

Special Eligibility Criteria

1. 1

   The tenderer (Concrete Sleeper Plant i.e CSP) must, fulfill all the following conditions to be eligible for placement of regular/developmental orders against this tender: Concrete Sleeper Plants (CSPs) certified by RDSO on or before the date of tender closing for undertaking production of PSC Main Line sleepers or any other category PSC sleepers for IR will be considered eligible for placement of orders (regular or developmental as per status of RDSO approval/certification) against this tender. Bidder must attach RDSO certificate in this regard.

2. 1.1

   Those plants will be considered "closed", which have not manufactured any type of sleepers (mainline, Turnout, special sleepers) for more than five years reckoning from the date of tender closing. Such plants will not be eligible for tender until and unless fresh RDSO certification/approval is obtained and placed on record. Bidder must attach RDSO certificate in this regard, if applicable.

   The Firm should not be "black listed/suspended/banned" for business by Railway. Firm must enclose a certificate in this regard.

   Minimum Quoted quantity by a tenderer for a plant (Cumulative for all the consignees of this tender) should not be less than 50% of RDSO certified rated production capacity for a period of 2 years under consideration, i.e., minimum quantity (Cumulative for all the consignees of this tender) to be quoted by a tenderer should not be less than 2 x 0.5 x 12 x monthly certified production capacity by RDSO. Offers quoting for less than specified minimum quantity or cumulative tendered quantities for all the consignees (whichever is lower) will be summarily rejected. Bidder must attach valid RDSO document in this regard.

5. 1.4

   Existing manufacturers quoting for supply from a new location after shifting their existing plant should have prior approval for supply from new location as per instructions of Railway Board vide letter No. 2004/Tk-II/22/11/5 dated 22.02.2006. Plants, which have already been permitted for shifting of location but have not shifted/started production from new location, even after lapse of one year or more from date of issue of permission letter, shall not be eligible to quote from old location. They will be eligible to quote from new location only if they have already obtained the RDSO certification of Plant at new location, before the date of tender closing. Bidder must attach RDSO certificate in this regard, if applicable.

Commercial-Compliance

1. 1

   "Firm to quote Single equated Freight Charge separately up to consignee (Anywhere in North Central Railway Division) destination covering for transportation of finished sleepers from their loading point to consignee destination. However, freight reimbursement to firm will be made at actual or as indicated in the contract, whichever is less." F.O.R. Station shall be:- (i) Works Siding/nearest loading BG station of North Central Railway for CSPs under the administrative control of North Central Railway. (ii) Any loading BG station (opened for commercial loading of PSC sleepers) of North Central Railway for all other CSPs which are under control of other Railways.

   FOR destination means that delivery is to be made up to consignee anywhere in North Central Railway division as detailed in "Item Details" column.

   Railway reserve the right to take delivery by own transport ie Rail/Road. In such case, freight charges shall not be paid to the contractor. However Loading will be arranged by the contractor at his own cost, as per special terms and conditions of contract.

   As per RDSO letter No. CT/FD/CI dtd. 15/02/2024, the changes /revision in IRS Specification of SGCI inserts T-46 (3rd Revision, May 2023) is kept in abeyance till finalization of various issues.

   The tenderers in their bids shall indicate the details of their jurisdictional assessing officers (designation, address and email id). In case of a contract award, a copy of the LOA/Purchase Order shall be immediately forwarded by the purchaser to the jurisdictional assessing officer mentioned in the tenderer's bid.

6. 6

   Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.

   EMD : As per Boards letter No..2004/RS(G)/779/11/Pt. dt.23.12.2019 , the Earnest Money is Rs.50,00,000/- (Rupees Fifty lakh only). There shall be no exemption from submission of EMD by any tenderer except exemptions as mentioned in Rly Bd letter dtd 23.12.2019 and any other letters issued time to time thereafter. Tenderers are required to upload scanned copies of necessary documents in support of their claim for EMD exemption.

8. 7.1

   Micro and small Enterprises ( MSEs ) registered for the tendered item and vendors registered with Railways for the trade group of the item tendered, up to their monetary limit of registration status being valid on the date of tender closing shall have to attach scanned copy of requisite documentary evidence in support of their claim along with Offer, failing which the Offer will be considered invalid and will be summarily rejected. The firm claiming exemption from EMD should clearly indicate valid reasons for such claim duly attaching a signed bid securing declaration as per Annexure-III (attached) along with scanned copy of relevant documents with their e-offers.

9. 7.2

   Tenderers intending to supply PSC line sleepers from their existing RDSO certified/approved sleeper plants, can submit their tenders without Earnest Money. Tenderers willing to claim Earnest Money exemption on this account should upload documentary evidence of having valid RDSO certified/approved plant. The Tenderer should upload the latest letter of RDSO indicating approval/ provisional approval of layout plan of CSP as documentary evidence in support of their claim.

10. 7.3

    EMD should remain valid for a period of 45 days beyond the final offer validity period. EMD (without any interest) will be refunded to the successful tenderers on receipt of security money. EMD (without any interest) will also be refunded to unsuccessful tenderers after finalization of tenders. Offers without Earnest Money shall be summarily rejected, if not under valid exemptions.

    Submission of certificate from CA or Statutory Auditor :- This tender is governed by Purchase preference for Make in India policy and paras 14.1, 14.2, 14.3 and 14.4 of Special Conditions of Contract shall be applicable. This tender is governed by Purchase preference for the Make in India policy. As per the Government of India Make in India policy, it is mandatory that the bidder shall give self-certification for local content in the quoted item (goods) at the time of tendering for tenders value more than Rs. 10 crores. However, at the time of supply for all contracts above INR 10 Crore, the contractor/ supplier shall be required to give local content certification duly certified by cost/chartered accountant in practice. For cases where it is not possible to provide certification by Cost/Chartered Accountant at the time of supply, the supplier is permitted to provide the certification for local content from Cost/Chartered Accountant after completion of the contract or at the time of submission of bill. In case the contractor/ supplier does not meet the stipulated local content requirement and the category of the supplier changes from Class-I to Class-II/ Non-local or from Class-II to Non-local, a penalty of 10% of the portion of contract for which the stipulated local content requirement is not met will be imposed. However, contract once awarded shall not be terminated on this account. Please note - The necessary certificate of local content must be signed with UDIN/relevant similar Nos. for statutory auditor or cost accountant, whichever is applicable, documents without UDIN number shall be construed as non- submission of CA certificate and 10% penalty shall be deducted from the bill.

Special Conditions

1. 1

   Inter-se Ranking: As per Para-2.4 of special condition of contract.
2. 2

   A Firm owning more than one plant, is permitted to quote for more than one plant.
3. 3

   Price Variation Clause: As per Para 13 of Special Conditions of Contract attached with this tender. In order to avoid blockage of funds till final escalation is worked out and paid on the basis of indices for the month of production, the accepted price will be updated every six months as per the above formula for escalation. First updating shall be done on the basis of indices for the month of acceptance of tender as soon as confirmed indices for the month of acceptance are available. Payment for the supplies made shall be done at the latest updated price. Offers received without Price Variation Clause (PVC) i.e. offers with FIRM price will be summarily rejected without any back reference. Offers with PVC other than the PVC indicated in this tender will also be summarily rejected without any back reference.
4. 4

   Acceptance of Tender: (1). The purchaser reserves the right to reject any or all of the tenders in part or full at his sole discretion without assigning any reasons. (2). Railways does not pledge itself to accept the lowest or any tender and reserves to itself the right of acceptance of the whole or any part of the quantity offered. The decision of Railways with regard to allotment of quantity so as to ensure uninterrupted supply of sleepers will be final. (3). The acceptance of the tender will be communicated by letter of acceptance direct to the tenderer. In case where a counter offer is issued, the unconditional acceptance of counter offer will result in a validly concluded contract, though formal letter of acceptance may be forwarded to the contractor at a later date.

   Splitting Clause is applicable as per clause 7.0 (Quantity distribution Methodology) of INVITATION AND INSTRUCTIONS TO TENDERERS uploaded in this tender.
6. 6

   The Security Deposit (SD) shall be exempted for this tender for the CSPs (Concrete Sleeper Plant) which are approved by the RDSO for supply to IR. However: (i) Wherever Security Deposit has been exempted, for any reason, and the supplier fails to supply goods as per conditions of contract, as amended from time to time, Purchaser shall have right to levy damages from the supplier for failing to comply with the contractual conditions, not by way of penalty, an amount equal to Security Deposit amount (5% of contract value), as would have been applicable if the contract was with a non-exempted vendor. These damages shall be treated as recoveries outstanding against the vendor and dealt with accordingly. (ii) Apart from claiming damages from vendors, in case of failure to comply with the contractual obligations, Railways shall record poor performance of the vendors for taking suitable penal action.
7. 7

   Dispatch of Material: : Provisions have been kept for dispatch by supplier/collection by Railway both by rail/road. Detail conditions are as per para 9 of the special conditions of contract enclosed.
8. 8

   Preferential treatment to MSE firms: This tender complies with the Public Procurement Policy on MSE. Offers failing to comply para 14.5(a) to 14.5(d) of Special Conditions of Contract will not be eligible for consideration of benefits detailed in MSE notification of Government of India dated 23.03.2012 as amended by the Ministry of MSME from time to time.

   Validity of offers: 180 Days
10. 10

    Inspection : : 1) Inspection by RITES (Non-TPI). 2) Inspection will be as per Para 6 of Special Conditions of Contract attached with this tender. 3) The details of methodology of Process Inspection by RITES (Non TPI) shall be referred at Railway Board letter No.2024/RS(G)/779/12 (E3482675) dtd.03.03.2025 (annexed with the NIT).

    Guarantee as per Para 19 of Special Conditions of Contract attached with this tender.

    Benefits available under PPP for MSME will not be extended to agent/dealer.

    Partial inspection, partial supply and partial payment are allowed.

    Delivery Period: : Supply will be regulated as per Para 10 of Special Conditions of Contract. Material is to be delivered as per the details of Consignee, Quantity and delivery period mentioned in Supply orders issued from time to time against the Running Contract.
15. 15

    In case of any contradiction or conflict, order of precedence (higher to lower) for provisions/ conditions mentioned shall be as under: (1) Conditions mentioned in tender document (NIT) (2) Special conditions of contract (enclosed) (3) IRS conditions of contract (enclosed) (4) Invitation and Instructions to Tenderers (enclosed).
