Core Labour Standards in our business practice in accordance with ITB Sub-Clause
and Form COC-5.6;

1. We recognise and accept that KfW only finances projects of the Project Executing Agency
(“PEA”)2 subject to its own conditions which are set out in the Funding Agreement it has
entered into with the PEA. As a matter of consequence, no legal relationship exists between

2. We hereby certify that neither we nor any of our board members or legal representatives add

Subcontractors under the Contract are in any of the following situations:
2.1) being bankrupt, wound up or ceasing our activities, having our activities administered
by courts, having entered into receivership, reorganisation or being in any analogous

sanctions by the United Nations, the European Union or Germany for involvement in a
criminal organisation, money laundering, terrorist-related offences, child labour or
trafficking in human beings; this criterion of exclusion is also applicable to legal Persons,
whose majority of shares are held or factually controlled by natural or legal Persons
which themselves are subject to such convictions or sanctions;
2.3) having been convicted by a final court decision or a final administrative decision by a
court, the European Union, national authorities in the Partner Country or in Germany for
Sanctionable Practice in connection with a Tender Process or the performance of a
Contract or for an irregularity affecting the EU’s and/or Germany’s and/or the Partner
Country’s financial interests;
2.4) having been subject, within the past five years, to a contract termination fully settled
against us for significant or persistent failure to comply with our contractual obligations
during such Contract performance, unless this termination was challenged and dispute
resolution is still pending or has not confirmed a full settlement against us;
Capitalised terms used, but not otherwise defined in this Declaration of Undertaking have the meaning
given to such term in KfW ’s “Guidelines for the Procurement of Consulting Services, Works, Goods,
Plant and Non-Consulting Services in Financial Cooperation with Partner Countries”.
The PEA means the purchaser, the employer, the client, as the case may be, for the procurement of
Consulting Services, Works, Plant, Goods or Non-Consulting Services.

2.5) not having fulfilled applicable fiscal obligations regarding payments of taxes either in
the country where we are constituted or the Partner country;
2.6) being subject to an exclusion decision of the World Bank or any other multilateral
development bank and being listed on the website http: //www.worldbank.org/debarr
or on the relevant list of any other multilateral development bank, respectively; or
2.7) being guilty of misrepresentation in supplying the information required as condition to
participation in this Tender Procedure.
3. We hereby certify that neither we: nor any of the members of our Joint Venture nor any of our
Subcontractors under the Contract are in any of the following situations of conflict of interest:
3.1) being an affiliate controlled by the PEA or a shareholder controlling the PEA, unless the
stemming conflict of interest has been brought to the attention of KfW and resolved to
its satisfaction;
3.2) having a business or family relationship with a PEA's staff involved in the Tender Process
or the supervision of the resulting Contract, unless the stemming conflict of interest has
been brought to the attention of KfW and resolved to its satisfaction;
3.3) being controlled by or controlling another Applicant or Bidder, or being under common
control with another Applicant or Bidder, or receiving from or granting subsidies directly
or indirectly to another Applicant or Bidder, having the same legal representative as
another Applicant or Bidder, maintaining direct or indirect contacts with another
Applicant or Bidder which allows us to have or give access to information contained in
the respective Applications or Offers, influencing them or influencing decisions of the
3.4) being engaged in a Consulting Services activity, which, by its nature, may be in conflict
with the assignments that we would carry out for the PEA;
3.5) in the case of procurement of Works, Plant or Goods:
(i) having prepared or having been associated with a Person who prepared
specifications, drawings, calculations and other documentation to be used in the
Tender Process of this Contract;
(ii) having been recruited (or being proposed to be recruited) ourselves or any of our
affiliates, to carry out works supervision or inspection for this Contract;
4. As a state-owned entity competing in a Tender Process, we certify that we have legal and
financial autonomy and that we operate under commercial laws and regulations.
5. We undertake to bring to the attention of the PEA, which will inform KfW, any change in
situation with regard to points 2 to 4 here above.
6. In the context of the Tender Process and performance of the corresponding Contract:
6.1) neither we: nor any of the members of our Joint Venture nor any of our Subcontractors
under the Contract have engaged or will engage in any Sanctionable Practice during the
Tender Process and in the case of being awarded a Contract will engage in any
Sanctionable Practice during the performance of the Contract;

6.2) neither we nor any of the members of our Joint Venture nor any of our Subcontractors
under the Contract shall acquire or supply any equipment nor operate in any sectors
under an embargo of the United Nations, the European Union or Germany; and
6.3) we commit ourselves to complying with and ensuring that our Subcontractors and major
suppliers under the Contract comply with international environmental and labour
standards, consistent with laws and regulations applicable in the country of
implementation of the Contract and the fundamental conventions of the International
Labour Organisation1 (ILO) and international environmental treaties. Moreover, we shall
implement environmental and social risks mitigation measures when specified in the
relevant environmental and social management plans or other similar documents
provided by the PEA and, in any case, implement measures to prevent sexual
exploitation and abuse and gender-based violence.
7. In the case of being awarded a Contract, we, as well as all members of our Joint Venture
partners add if applicable: and Subcontractors under the Contract will, (i) upon request, provide
information relating to the Tender Process and the performance of the Contract and (ii) permit
the PEA and KfW or an auditor appointed by either of them, and in the case of financing by
the European Union also to European institutions having competence under European Union
law, to inspect the respective accounts, records and documents, to permit on the spot checks
and to ensure access to sites and the respective project.
8. In the case of being awarded a Contract, we, as well as all members of our Joint Venture
partners add if applicable: and Subcontractors under the Contract undertake to preserve above
mentioned records and documents in accordance with applicable law, but, in any case for at
least six years from the date of fulfilment or termination of the Contract. Our financial
transactions and financial statements shall be subject to auditing procedures in accordance
with applicable law. Furthermore, we accept that our data (including personal data) generated
in connection with the preparation and implementation of the Tender Process and the
performance of the Contract are stored and processed according to the applicable law by the

The technical proposal is expected in particular to include as a minimum, though not being limited
to, the following contractual warranties, representations and statements of information:
• The details of the Contractor’s proposed design engineering solution for the Works;
• The Contractor's method statements;
• The Contractor's proposed Site organization;
• The list of proposed Subcontractors and suppliers of Works under the Contract, in
furtherance to the Conditions of Contract and which have their origin in the Eligibility Criteria
as defined under Section V of this Bidding Document. The Bidder shall use the specific form
for that purpose which is included in the following pages;
• The programme the Contractor intends to observe when executing its obligations under the
Contract, complying with the level of details described in the Employer’s Requirements, and
demonstrating the Contractor’s ability to meet the Time for Completion and his other time-
related obligations;
• The proposed Contractor’s Equipment and Personnel to deliver the Contractor’s obligations
under the Contract, and meeting the Employer’s Requirements – specific forms shall be used

Annexure – 1: Requirements for proposed Works
1 The Tenderer's attention is drawn to Part - 2 of the Works Requirement and to
General Conditions / Particular Conditions of Contract in which terms are defined.

development, be capable of complying with the Employer's Requirements in all
respects. The Tenderer's Technical Proposals shall demonstrate such compliance.

4. The Contractor's Technical Proposals shall include the following documents:
Drawings shall illustrate, where appropriate, aspects of the Works identified in paragraph 3 above,
including layouts, appearance, main structural features, general arrangements, plans, elevations,
principal sections and typical details of critical areas. In particular, the drawings shall indicate the
proposed arrangements at the interface with adjacent Contractors. Name of Contract may be
read as in Clause 1.1.1 of NIT in all Tender Drawings.
4.2 Specifications
The Specification shall comprise the Construction Specifications, which shall consist of an Outline
Specification identical to that contained in the Tender Documents and a Particular Specification.
The Particular Specification shall draw attention to any part or parts of the Outline Specification

which the Contractor intends to amend or omit and shall contain further material such that the
design of the Permanent Works is fully specified and the construction of the Permanent Works is
specified at least in outline at this stage.
4.2.1 In producing the Particular Specifications, the Tenderer shall ensure that
clauses, paragraphs and any appendices therein are identified by their
numbering as uniquely belonging to the Particular Specifications, and shall
not in any event amend or change the numbering in the Outline
Specifications.
4.2.2 The Tenderer should note that the Specifications submitted with the
Tender as part of the Contractor's Technical Proposals will, prior to
acceptance of tender, be merged and consolidated into a single document
for incorporation into the Contract.
4.2.3 The Tenderer should note that the Particular Specifications form a crucial
part of the Contractor’s Technical Proposals, and shall be prepared in
sufficient detail to demonstrate full compliance with the Employer’s
Requirements. The quality of the Particular Specifications will be
paramount in evaluating technical compliance of Tenders.
4.2.4 The Tenderer should note that the Particular Specifications form a crucial
part of the Contractor’s Technical Proposals, and shall be prepared in

4.3 Statement of Compliance
A statement from the Tenderer is required to be furnished to the effect that
the Contractor's Technical Proposals comply with the Technical
Specifications and can be developed to become the Definitive Design of
the Permanent Works without significant change other than amplification.
4.4 Statement of Maintainability
The Tenderer shall state the maintenance objectives and the anticipated
operational life associated with the principal elements and components of
the Permanent Works, and in particular, how these apply in the selection
and use of proposed materials. The Tenderer shall demonstrate a
reasonable balance between construction costs and maintenance costs and
the effect of its proposals on the lifetime costs of the Permanent Works. The
Tenderer shall include in this statement a schedule of the main maintenance
operations, including the intervals between such operations, for all aspects
of the required construction, as well as the main spares and stores required
and their rates of use.

(ESHS) Methodology

explanations to Section VII, 1 b) - Specifications for Environmental, Social, Health and

The Bidder shall provide an ESHS Methodology providing information on how the Bidder
shall meet those requirements and objectives, which are specified in Section VII, Works

The ESHS Methodology submitted shall be in the form of a preliminary draft of the Project
Area Environmental and Social Management Plan (PA-ESMP), the content of which is

PREAMBLE AND GENERAL REQUIREMENTS
BILL OF QUANTITIES (BOQ)
This Bill of Quantities (BoQ) forms an integral part of the Tender Documents and shall be read in
conjunction with the Conditions of Contract, Technical Specifications, Drawings, and other relevant
documents of the Multi-Modal Integration (MMI) works under the Surat Metro Rail Project – Phase I.
This document shall be read in conjunction with technical specifications, Employer’s requirements,
BOQ for the work, and other provisions of the tender documents, Schematic tender drawings, etc.,
including Annexure, Appendix, Addendum/corrigendum and any other document forming part of the
Tender Document.
1 Scope of Work
The work under this contract comprises detailed design and preparation of Good for
Construction (GFC) drawings based on the GAD drawing supplied; planning, site support services,
execution and completion of Multi-Modal Integration works at designated metro stations as per
the designs, including but not limited to:
• Site surveys, investigations and verification of station surroundings
• Civil, architectural, drainage, and utility relocation works
• Footpath development, pedestrian crossings, cycle tracks
• Foot overbridges/ skywalks at selected locations.
• Provision of bus bays, para-transit bays, parking, street furniture, and signage
• Installation of CCTV Cameras and monitoring terminals
• Traffic management during execution
• Coordination with local authorities and stakeholders
• Defect liability and maintenance obligations as specified
2 The Bill of Quantities shall be read in conjunction with the Instructions to the Tenderer, General
Conditions of Contract, Special Conditions of Contract, Employer’s Requirement, Scope of work,
the technical specifications and drawings, etc. If the specifications in the scope of work,
Employer’s Requirements, and the technical specification are inferior with respect to relevant
codes and standards, then provision of the Codes and Standards shall prevail and vice versa. The
decision of the Engineer-in-charge regarding this issue shall be binding on the contractor.
3 The quantities specified in the Bill of Quantities are estimated and provisional, and are provided
to establish a common basis for bidding. The basis of payment will be the actual quantities of
work carried out, as measured by the Contractor and verified by the Engineer and valued at the
rates and prices tendered and accepted in the priced Bill of Quantities, where applicable, and
otherwise at such rates and prices as the Engineer may fix within the terms of the Contract. The
quantities may vary with reference to tender BOQ.
4 The rates for each item and Section of the Schedule of Items shall be written in indelible ink or
typed in the summary sheet in words and figures. The rates for LS items governed as mentioned
in Point No. 4, GWSSB and similar local schedule of rates pertaining to the services encountered
shall be only as a percentage at par or above or below the Par Value mentioned in the BOQ in
words and figures. Thereby, the quoted price for each section shall be calculated and written
against each Section of the work. The total price, as the sum of the quoted prices for all the
Sections of the work, shall be shown at the bottom of the summary sheet. The total price shall
also be written in words and figures. In case of any discrepancy, the amount written in words will
be taken. The percentage/item rates shall be quoted and the amount evaluated in Indian Rupees
only, as applicable against sections/items in BOQ, both in figures and in words. The person
authorised to sign on behalf of the tenderer shall sign in full at the bottom of all pages and at
the end of the schedule.

5 All items of work which are not covered in the BOQ but are required to be carried out as per the
direction of the Engineer-in-charge, will be based on a list of concerned items as available in the
Schedule of Rates (SOR) of work. the bottom of all pages and at the end of the
i) Schedule of Rates of Road & Building(R&B) Department of the Government of Gujarat for
the year 2023-24 and for the electrical wing
ii) Schedule of Rates of Gujarat Water Supply & Sewerage Board (GWSSB) of the year 2022-
iii) Schedule of Rates of CPWD, Volume 1 and Volume 2,
iv) Schedule of Rates of CPWD Horticulture,
v) Schedule of Rates of MGCM Garden, Traffic, E&M,
The above SORs are given in their order of preference.
6 1. The rates and prices to be tendered in the Bill of Quantities are for completed and finished
items of work and complete in all respects. It will be deemed to have included all constructional
plant, tools, machinery, labour, supervision, materials, fuel, oil, consumables, electric power,
water, transportation, all leads and lifts, dewatering, all temporary works and false works,
construction of temporary stores and buildings, fencing, watering, lighting, erection
maintenance, night working, inspection facilities, safety measures at work sites/casting yard for
workmen and road users, preparation of design and drawings pertaining to the casting yard,
staging, shuttering/ sacrificial steel shuttering, form work, stacking yard etc., establishment and
overhead charges, labour camps, insurance cost labour and works, contractor’s profit, except all
taxes, CGST/SGST/IGST (after factoring all due ITC), royalties duties, cess, octroi, VAT and other
levies and other charges together with all general risks, liabilities and obligations set out or
implied in the contract and including remedy of any defects during the Defect Liability Period,
unless otherwise provided in BOQ. GMRCL will reimburse taxes and other duties on submission,
and of documentary proof and a certificate that “no appeal for refund at a later date from revenue
authorities. Construction of all items and payments shall be for the good of the construction
drawings approved by the Engineer.
2. The rates in BOQ are exclusive of GST and all other Taxes, octroi, etc., as on the date of

curing compound and all labour, tools, plants, machinery required for execution of work
complete in all respects including de-shuttering after completion of work in conjunction with
Technical specification.
8 General directions and descriptions of work and materials are not necessarily repeated or
detailed in the Bill of Quantities. References to the relevant specifications and sections of the
contract documentation should be made before quoting rates in the Bill of Quantities.
9 The unit rates shall also account for compliance with applicable Indian codes,
IRC/MoHUA/UD&HD guidelines, R&B Gujarat, Surat Municipal Corporation regulations, and the
requirements of GMRC.
The rates are deemed to be inclusive of all lead (except as otherwise specifically provided in the
description of the particular item), lifts, ascend, descend, handling, re-handling, crossing of
Nallah/Streams/Tracks any other obstructions.
10 Storage of Material: All the material at site will have to be properly stacked & stored so as to
facilitate inspection. The material should be properly protected from the detrimental effects of
nature and fire, theft etc. The contractor shall be responsible for watch & ward, and any loss or
deterioration on account of the above shall lead to rejection of the material, and the contractor
has to replace the same at his own cost.

11 The method of measurement of completed work for payment shall be in accordance with
provisions in Contract/Specifications, except as otherwise specifically provided in the description
of the item or particular bill of quantities or explanatory notes to the particular bill of quantities.
12 Obtaining prior permission for felling trees, including payment of royalty and taxes, etc., shall be
the contractor’s responsibility and deemed to be included in the rates. However, it will be
supported by the Engineer.
13 Obtaining approval of GFCs of MMI works from the project stakeholders shall be the contractor’s
responsibility and deemed to be included in the rates. However, it will be supported by Engineer.
14 In all concreting items, all materials, equipment, labour, casting beds, stress frames, form work
staging, scaffolding, steel shuttering, sacrificial shuttering, etc., are to be arranged by the
contractor within the quoted rates.
15 All design-mix concrete shall be machine-batched with an automatic weigh batcher, machine-
mixed, and machine-vibrated, or Ready-Mix Concrete prepared in a batching plant and
transported by transit mixer to the site of work or as directed by the structural designer.
16 Prior to demolishing any structure, measurements will have to be taken. The scheme for
dismantling must be approved by the Engineer-in-Charge.
17 All activities not specifically covered in the BOQ /Schedule of Items, but required to be executed
in order to complete the Scope of work, have to be deemed as covered within these mentioned
items of the Schedule/BOQ.
18 Errors will be corrected by the Employer for any arithmetical errors in computation or summation
as indicated in the Contract Document.
19 Repairs to damage of existing carriage way, canal work, etc., during construction work shall be
carried out by contract at his own cost as per the technical specification. Prior to the start of
repair work, the scheme of repair work shall be approved by the Engineer-in-charge.
20 Charted and uncharted utilities will be shifted by the contractor, if required. Payment for diversion
will be made under the relevant payment Schedule. If work is stopped due to utilities, no claim
shall be entertained on this account.
21 For all types of cement concrete work, the rate shall include
I. The rate shall include the cost of all necessary admixtures required as per the mix design, curing,
casting, including centring, shuttering/ sacrificial steel shuttering, propping, staging, scaffolding,
necessary tools, plants, machinery and all related operations, etc.
II. The rate shall include the cost of carrying out the concrete mix design from the approved
laboratory as described in the specification or as approved by the Engineer-in-charge.
III. The rate is inclusive of all materials, including mixing in a fully automatic batch mix plant,
transportation by transit mixer for any lead from the plant site, pumping, pouring, curing, placing
in position, making good the damages, with all lifts with contractor's labour, tools & plants,
machineries, as required.
IV. The rate is inclusive of providing formwork for exposed form finished concrete surface for
concrete above ground level in the desired pattern, sizes with grooves, using laminated
shuttering plywood/steel shuttering/sacrificial steel shuttering, including neat cleaning &
rendering of exposed concrete surface, as per the sample approved by the Architect and as
directed by the Engineer-in-charge. (Same kind of shuttering material should be used only for
standard and residual sizes)
V. The rate is inclusive of roughening and/or hacking exposed concrete surfaces for key for
plastering, grinding with carborundum stone over concrete spills/level difference in joints of
VI. The rate is inclusive of the cost of providing grooves, chamfers, moulding, cut out, etc. in
formwork & using the required dosage of plasticiser in concrete for obtaining the required
workability as per approval of the Engineer-in-charge. The work will include vibration of concrete,

curing, protecting from damage, bailing/pumping out water if required, levelling of ground,
making the site good, etc.
VII. The rate includes labour for keeping embedment, if any, wherever required while casting.
VIII. The rate shall include form liner finish as per drawing / technical specifications.
22 The tenderer’s offer shall be exclusive of all taxes and duties payable by them. Income tax and
other statutory taxes to be deducted at source, if any, will be deducted by the Employer in
accordance with the Income Tax Act and any other acts in force and in accordance with
instructions issued by the Authorities on this behalf, from time to time.
23 Rate quoted shall be exclusive of taxes both on materials as well as works contract and will be
reimbursed by GMRCL on submission and of documentary proof and a certificate that “no appeal
for refund at a later date from revenue authorities. If Excise duty on precast elements is levied,
GMRCL will reimburse same on submission and of documentary proof and a certificate that “no
appeal for refund at a later date from revenue authorities will be made.
24 The Tenderer is required to furnish the PAN for all members of the Group.
25 The rates and prices tendered in the Bill of Quantities are for completed and finished items of
work, complete in all respects. It will be deemed to have included all constructional plant, tools,
machinery, labour, supervision, materials, fuel, oil, consumables, elect& power, water,
transportation, all leads and lifts, dewatering, all temporary works and false works, construction
of temporary stores and buildings, fencing, watering, lighting, erection maintenance, night
working, inspection facilities, safety measures at work sites casting yard for workmen and road
users, preparation of design and drawings pertaining to the casting yard, staging,
shuttering/sacrificial steel shuttering, form work, stacking yard etc., establishment and overhead

royalties, duties, cess, octroi, VAT and other levies and other charges together with all general
liabilities and obligations set out or implied in the contract and including remedy of any defects
during the Defect Liability Period, unless otherwise provided in BOQ.
26 There is 'NO' waiver/Concession and exemption from the Governments in respect of Customs
duty, Excise Duty, any other taxes, duties, cess, Octroi/entry tax and levies payable to various
authorities. However, the Tenderers are to note that as per Notification No. 25/2012- Service Tax
dated 20.06.2012, issued under section 93(1) of the Finance Act, 1994, services by way of
construction, erection, commissioning or installation of original works pertaining to, inter alia,
railways, including monorail or metro are exempted from whole of the Service Tax leviable
thereon under Section 66B of the said Act. The Tenderer shall examine and make his own
assessment in regard to Service Tax liability under the Contract. GMRCL will neither be liable for
such examination or assessment nor be liable, in any manner whatsoever, for the reason of
bringing to the notice of the Tenderers the aforesaid Notification. No separate Service Tax
reimbursement will be made by GMRCL.
27 Schedule R of the price bid includes the cost of miscellaneous items required for the execution
of work that cannot be estimated at this stage. You need to quote as a percentage above (+) or
below (-) the estimate.
28 Interpretation
a. In case of any discrepancy between the drawings, specifications, and the BoQ items, the
matter shall be referred to the Engineer, whose decision shall be final and binding.
b.The BoQ item descriptions are brief. The scope shall be deemed to include all necessary
materials, labour, equipment, and operations required to complete the item in accordance
with the specifications.
29 Landscape Maintenance works

includes general maintenance, cleaning, watering, weeding, forking, trimming, pruning, checking
for pests/insects/fungal attacks, applying fertilizers, pesticides as per requirement and the
- General maintenance includes keeping the road median clean and removal of weeds, stones
and rubbish. Frequency to be the same as the watering frequency.
Watering to be carried out with care to avoid flooding and spillage over road median. Adequate
watering to be provided to keep ground moist all around and up to depth of plant roots and
minimum of 5 litres per sqm per watering cycle. Watering to also wash plant leaves. The
frequency shall be varied season-wise as below:
Summer (Mar-Jun) @ 15 times / month
Monsoon (Jul-Oct) @ 5 times / month
Winter (Nov-Feb) @ 10 times / month
Plant Maintenance to include:
- Weeding @ 2 times / month
- Forking and loosening soil @ 2 times / month
- Trimming of shrubs @ 2 times / month
- Pruning of Trees @ 2 times / Year
- Checking for Pests/ insects/ Fungal attacks @ once/ month
- Applying Fertilizer NPK 12:32:16 of amounts 50g per square meter for Shrubs and 100g per
Median width will be considered as 2.25m and additional for traffic islands of Depot as required.
Rates inclusive of necessary machinery, materials, transport, fuel, tools, labour and hires.
Rate to include replacement and replenishment of any dead, dying, or ill-health plants / trees.
Payment to be claimed on monthly basis.
Contractor shall maintain record of attendance and activities carried out and submit same on
weekly/monthly basis to DGM/in-charge for record and billing purposes.
In case of reduction in quantity of landscaping area, minimum amount for maintenance shall not
