•The pre-qualification requirement is as under:
1. Financial Criteria:
Bidder must have achieved a minimum annual Contractual turnover
(contractual income fromsimilar work as mentioned in qualification) from work
in progress and completed in any one year over the last seven financial years
(ending 31.03.2026)of the annual value Rs. 51,54,87,500/-. However, If any
tenderer has books of account with provisionally for year financial year 2025-
26, in such case they can submit the CA certified provisional turnover, Profit &
Loss Statement, Balance sheet and it will be considered in last 7 FY data
2. Working Capital:
The applicant should give undertaking (on CA Certificate) that he has access to
or has available liquid assets (aggregate of working capital, cash in hand &
uncommitted bank guarantees) and/or credit facilities equal to 25% of the

of *similar nature of work at least 40 percent of the processing fresh/legacy municipal
solid waste of 9,37,250 MT within the last seven years ending on 31/08/2026. (i.e. 40%
iii. Experience in successfull Disposal of RDF (Refused Derived Fuel) 2,01,685 MT (i.e.
Fresh Waste 26 % of 237250 MT = 61685 MT and Legacy waste 20 % of 7,00,000 MT =
1,40,000 ) through vendor’s registered with GPCB/CPCB for Plastic waste recycler,
Processor/Waste to energy plant/ Cement Plant within the last seven years ending on
Similar Nature of work:
a. Having Experience of Operations and Maintenance of Trommel system
for work of MSW Segregation
b. Having Experience of Bio mining / Bio remediation of Legacy/Fresh
Waste/Bio mining, Bio Remediation related work.
c. Having Experience of Processing of MSW/Bio Mass/Bio-methanation
/Compost/Waste to Energy
d. Having Experience of Segregation/Processing of Dry waste/Wet Waste.
1) The bidder who is ful-filling the above experience criteria 2.Must have work
experience as describe in below in any one year during the last 7 years.
The bidder shall produce the work completion certificate / 3A Progress Certificate or
performance certificate from Central govt. organization/ State govt. organization /RMC
/MunicipalCorporations / Institute or any other Agency of Government of India or any of the
State Governments /ULBs/Govt/Municipal Authority. The same shall mention clear amount
and Work Done Quantity of work related to this tender.
2) Minimum Scope of work :
1 Bidder shall Process the Legacy Waste/Fresh Waste by using Power Supply through
Diesel Generator Set (DG Set). Bidder shall establish, erect, install and run / operate DG
Set at his own cost. RMC will allow to use electricity on site for this work if coonection is
available at site.
2 Bidder shall have enough Vehicles, Machineries like (Trommel with conveyor Belt
System) and Manpower to move and transport waste to process legacy on daily basis as
per the given time limit 12 months). Work will be extended upto new agency of same
work will be finalized.
3) Other Scope :
1 Disposal of RDF and Compost as per MSW Rules-2026 is under Agency’s
Responsibility and must be disposed daily basis.
2 If RDF and Compost shall not be stored more than 15 days after processing.(Total
estimated qty. of stored RDF, compost shall not exceed as per theoretical qty.
calculated from processed qty. of last 15 days) if more qty, exceeds above limit than
35% of corresponding RA bill amount will be withheld from RA Bill as Deposit. If
this will continue for 2 months than amount shall be retained as penalty or security
deposit will be forfeited.
3 Inert Disposal at Landfill cell is under Agency’s Responsibility.
VI) The following list includes Vehicles and machinery owned by contractors with machines and
Vehicles suppliers along with copy of R.C. book, Insurance, Purchase Bill shall be submitted at the
time of Tender Document Submission. Bidder should deploy minimum Vehicles and machinery
mentioned below either owned or rented/leased by bidder. In case vehicles equipment are
leased/rented by bidder, then the bidder must submit notorised rent/lease agreement with the owner
along with copy of RC book, latest insurance copy, fitness certificate etc. of all rented/leased
equipment and machineries.

Joint Venture is allowed between maximum 02 Agencies / Members / firm.
The Joint Venture must fulfil the following condition.
The lead partner/ Prime member shall meet not less 50 percent of all criteria given in
para of general experience and working capital. The joint venture must collectively satisfy
the criteria of para of general experience and working capital. The experience of the joint
venture partners shall be considered if it is not less than 30 percent of the qualifying criteria
in para of general experience and working capital.
Individually each partner must satisfy the requirements of (1) The audited balance
sheet for the last seven year should be submitted which must demonstrate the soundness
of the applicants finical projection for the next two years if necessary, the employer will
make inquires with the applicants bankers. (2) The applicant should provide accurate
information on any litigation or arbitration resulting from contracts completed or under
execution by him over the last seven years, the consistent history of awards against the
applicant or any partner of a Joint Venture may result in failure of the applicant.
Bid shall be signed so as to legally bind all partners, jointly & severally and shall be
submitted with a copy of the joint venture agreement providing the joint & several liabilities
with respect to the contract.
1. Rajkot Municipal Corporation has right to depute Qualified Bidder as per below.
(a) If L-1 agency disagree to do the work or fails to complete the allotted work,
the remaining quantity will be reassigned to L-2, L-3, L-4 respectively
whichever agency is ready to execute works at L-1 agency’s bid price.
(b) RMC shall provide a as per available Fresh/ legacy waste at the site.
(c) Agency shall give RDF disposal planning before the agreement as per MSW-
• While furnishing Experience Data & Bank Documents, the agency submitting the tender
shall have to provide the Contact Address, Phone No., Fax No, e-mail address of the
authorities issuing the Experience Certificate for confirmation by this office. In case of
failure of confirmation, the tender will be liable to be rejected out rightly.
• EMD in form of D.D. or NEFT/RTGS or Online Transfer or Bank guarantee, Cost of
tender Document (Tender fee) in form of D.D.– Cover – 1 Bid document/ Tender fee (2)

• Technical Proposal Signed Documents shall be submitted in electronic format only
through online by scanning.The E-tender with signed and stamp, Pre-proposal Minutes of
the Meeting, Addendums issued, Work Experience Certificate,Financial documents (turn
over, working capital, company profile, pancard, GST certificate, and all necessary
documents etc., shall be submitted online as well as Hardcopy but without financial bid
related information.
• After opening of online Technical Bid, the procedure for the pre-qualification shall be
adopted and the e-Price Bid of only successful qualified bidder shall be opened for final
evaluation of the contract. The decision of Municipal Commissioner regarding the pre-
qualification shall be final and binding to all the bidders.
• The Tender of those bidder(s) those who fail to submit the required documents online
within the stipulated date and time will be treated as none responsive and their Price Bid
will not be opened and RMC will not be liable for the same.
• The bidder should not have been Black Listed or debarred by Government of India /
Government of Gujarat or any State Board / Corporations, since inception of the firm /
Company. A Declaration in this regard on Rs.300/- Stamp Paper duly Notarized,
shall have to be submitted as per format Annexure, along with the tender fee and EMD
fee physically submitted RMC office through Regd. AD / Speed post failing in which will
be automatically rejected and disqualified.
• The bidder should provide accurate information on any litigation history or arbitration
resulting from contracts completed or under execution by him over the last ten years.
This should also include such cases, which are in process / progress. The bidder must
provide such informationto the authority.
• Conditional Tenders will be out rightly rejected.

Rajkot Municipal Corporation Collects the Municipal Solid Waste through Mini
Tipper vanes and dumpes at Nakrawadi Site of RMC. This site is located around 22 Km
away from Rajkot City. RMC has acquired 200 Acres Land for processing of various
category Municipal Waste. The processing of Legacy Waste is to be conducted in New
Allotted Land as per sketch below. At this site RMC has sufficient space for setup of
Machineries required for Bio-Mining process of Legacy Waste and to dump RDF and
Compost for temporary storage till disposal. RMC has Landfill sitetodisposeInert Material
generated from processing. This site contains no regular Electricity Power Supply. Whole
process shall be run on Power supply through Diesel Generated Power Supply Set(DG Set).

SectionVI-GeneralConditionsofContract (GCC)
INSTRUCTIONSTOTHETENDERER
The contract documents may be secured in accordance with the Notice Invitinge-
TENDERfor the work called. The work shall include supply of materials necessary for
construction of the work.
IT2. INVITATION TO e-TENDER
The Rajkot Municipal Corporation here in after referred as the Corporation will receive e-
Tenders for the work of as per the specifications and schedule of prices in the e-Tender
document. The e-Tenders shall be opened online as specified in the e-Tender notice in the
presence of interested Tenderers or their representatives. The Corporation reserv es the right
to reject the lowest or any other or all e-Tenders or part of it which in the opinion of the
Corporation does not appear tobein its best interest, and the Tenderer shall have no cause of
action or claim a gainst the Corporation or its officers, employees, successors or assignees
for rejection of hise-Tender.

evidence ofitsexistence before the contractisawarded.
If the e-Tender is made by a group of firms, the sponsoring firm shall submit complete

the contract documents and furnish evidence admissible in law in respect of the
authority to such firms on behalf of the group of firms for e-Tendering and for

expressedinwordsshallprevailandapplyinsuchcases.
IT09MODIFICATIONOFDOCUMENTS
Modification of specifications and extension of the closing date of the e-
Tender,ifrequiredwillbemadebyanaddendum.Eachaddendumwill bemade available
online toallTenderers. Theseshallform apartof e-Tender.TheTenderershallnotaddtoor
amendthetextofanyofthe documents except insofarasmay benecessary tocomply with
AddendaformpartoftheContractDocuments,andfullconsiderationshall

General Conditions
GC-01 DEFINITIONSANDINTERPRETATIONS:
1.0 In the contract(as hereinafter defined) the following words and
expressionsshall,unlessrepugnanttothesubjectorcontextthereof,have
thefollowingmeansassignedtothem.
1.1 The"Owner/Corporation"shallmeanRajkotMunicipalCorporation
andshallincludeitsMunicipalCommissioner orotherOfficersauthorized
bytheCorporationandalsoincludeowner'ssuccessorsandassignees.
1.2 The"Contractor"shall meanthe personorthe persons,firmorCompany whosee-

GC-03CONTRACTORTOUNDERSTANDHIMSELFFULLY:
The Contractor by e-Tendering shall be deemed to have satisfied himself, as to all
considerations and circumstances affecting the e-Tender price, as to the possibility ofexecuting
the works as shown and described in the contract and to have fixed hisprices according to his
own view on these matters and to have understood that no additional allowances except as
otherwise expressly provided, will afterwards bemade beyond the contract price. The
Contractor shall be responsible for any misunderstanding or incorrect information, however,
GC-04ERRORSINSUBMISSIONS:
The Contractor shall be responsible for any errors or omissions in the particularssupplied by
him, whether such particulars have been approved by the Engineer-in-chargeor not.
GC-05 INTERPRETATION OF CONTRACT DOCUMENT :
The provision of the General Conditions of Contract and Special Conditions of Contract shall
prevail over those of any other documents of the contract unless specifically
providedotherwise, should have there be any discrepancy, inconsistency, error or comission in
the several documents forming the contract, the matter may be referred to the Engineer-in-
charge for his instructions and decision. The Engineer-in-charge'sdecision in such case shall be
final and bindingtothe Contractor.
GC-06BREACHOFCONTRACTBYCONTRACTOR:
If the Contractor fails to perform the work under the contract with due diligence orshall refuse
orneglect to comply with instructions given tohim in writing by the Engineer-in-charge in
accordance with the contract, or shall contravene the provisions of the contract,theCorporation
may give notice in writing to the Contractor to make good such failure, neglect, or contravention.
If the Contractor fails to comply in connection to written notice within 14 (fourteen) days of
receipt, it shall be lawful for the Corporation, without prejudice to any other rights the
Corporation may have under the contract, to terminate the contract for all or part of the works,
and make any other arrangements it shall deem necessary to complete the work outstanding
under the contract at the time of termination / Black List / Debar the agency for the period of
three years from the works of RMC. In this event, the performance Bond shall immediately
become due and payable to the Corporation. The value of the work done on the date of
termination and not paid for shall be kept as deposit for adjustment of excess expenditure
incurred in getting the remaining work completed and the Corporation shall have free use of any
works which the Contractor may have atthe site atthe time of termination of the contract.
GC-06LAWS GOVERNING THE CONTRACT :
"The Service Provider shall, in addition to complying with applicable laws, rules, and regulations,
strictly adhere to all guidelines, directives, and written instructions issued by RMC.
GC-07OVER PAYMENT AND UNDER PAYMENT :
Whenever any claim for the payment of a sum to the Corporation arises out of or under this
contract against the Contractor, the same may be deducted by theCorporation from any sum
then due or which at any time thereafter may become due to the Contractor under this contract
and failing that under any other contract with the Corporation (which may be available with the
Corporation), or from his retention money or he shall pay the claim on demand. The
Corporation reserves the right to carry out post payment audit and technical examinations of the
final bill including all supporting vouchers, abstracts etc. The Corporation further reserves the
right to enforce recovery of any payment when detected, notwithstanding the fact that the
amount of the final bill may be included by one of the parties as an item of dispute shall be
resolved as per GC-49 (Interpretation Related To Tender Conditions or Contract Agreement) of
this contract and notwithstanding the fact that the amount of the final bill figures as resolved
through GC-49. If as a result of such audit and technical examinations any over payment is
discovered in respect of any work done by the Contractor or alleged to have been done by him
under the contract, it shall be recovered by the Corporation from the Contractor as prescribed
above. If any under payment is discovered by the Corporation, the amount due to the Contractor
under this contract, may be adjusted against any amount then due or which may at any time
thereafter become due before payment is made to the Contractor.
GC-08SETTLEMENT OF DISPUTES :
Except as otherwise specifically provided in the contract, all disputes concerning questions of
fact arising under the contract shall be decided by the Engineer-In-Charge subject to a written
appeal by the Contractor to the Engineer-In-Charge and those decisions shall be final and
binding on the parties hereto. Any disputes or differences including those considered as such by
only one of the parties arising out of or in connection with this contract shall be to the extent
possible settled amicably between the parties.
GC-09DISPUTES OF DIFFERENCES TO BE REFERRED TO :
If at any time, any question, disputes or differences of any kind whatsoever shall arise between
the Engineer-In-Charge and the contractor upon or in relation to or in connection with this
contract either party may forthwith give to the other, notice in writing of the existence of such
question, dispute or difference as to any decision, opinion, instruction, direction, certificate or
evaluation of the Engineer-In-Charge. The question, dispute or differences shall be settled by the
Municipal Commissioner, Rajkot Municipal Corporation, who shall state his decision in writing
and give notice of same to the Engineer-In-Charge and to the Contractor. Such decision shall be
final and binding upon both parties.
GC-10 INTERPRETATION RELATED TO TENDER CONDITIONS OR CONTRACT AGREEMENT:
For any interpretation related to tender conditions or contract agreement conditions, the
decision of Municipal Commissioner, Rajkot Municipal Corporation shall be considered as final
and binding and in the event of any dispute arising pertaining to tender conditions or contract
agreement conditions the jurisdiction shall be Rajkot Civil Court/Commercial Court of Rajkot
GC-11TERMINATIONOFTHECONTRACT:
i) IftheContractorfindsitimpracticabletocontinueoperationowingto forcemajeure reasons
orforanyreasons beyond hiscontroland/orthe Corporationfinditimpossible
tocontinueoperation,thenprompt
notificationinwritingshallbegivenbythepartyaffectedtotheother.
ii) If the delay or difficulties so caused cannot be expected to cease or become unavoidable or if
operations cannot be resumed within two (2) months then either party shall have the right to
terminate the contract upon 10 (ten) days written notice to the other. In the event of such
termination of the contract, payment to the Contractor will be made as follows:
a) TheContractorshallbepaidforallworksapprovedbytheEngineer- in-
chargeandforanyotherlegitimateexpensesduetohim.
b) If the Corporation terminates the contract owing toForceMajeure or due to any cause beyond
its control, the Contractor shall additionally be paid for any work done during the said
two(2)months period including any financial commitment made for the proper performance
of the contract.
c) TheCorporationshallalsoreleaseallbondsandguaranteesatits disposalexcept incases
wherethetotal amount ofpaymentmadeto
theContractorexceedsthefinalamountduetohiminwhichcasethe Contractor
shallrefundtheexcessamountwithinthirty(30)days aftertheterminationandthe Corporation
thereaftershallreleaseall bondsandguarantees. ShouldtheContractorfailto refundthe
amountsreceivedinexcesswithinthesaidperiodsuchamountsshall
bedeductedfromthebondsorguaranteesprovided.
iii) OnterminationofthecontractforanycausetheContractorshallseethe orderlysuspension
andtermination ofoperations,withdueconsideration to the interests of the Corporation with
respect to completion safeguarding ofstoringmaterialsprocuredfortheperformanceofthe
contractandthesalvageandresalethereof.

SectionI - Instructionsto Bidders
i. In connection with the Tender Notice specified in the Bid Data Sheet
(BDS), the Authority, as specified in the BDS, issues this bidding
document for the delivery of Legacy Waste Remediation Services,
Throughout this bidding document:
ii. the term “in writing” means communication in written form (e.g., by mail,
e-mail, fax, including if specified in the BDS, distributed, or received
through the electronic-procurement system used by the Authority) with
proof of receipt.
iii. if the context so requires, “singular” means “plural” and vice versa; and
iv. “Bidder” means a person, including any individual, firm, Company,
Corporation, NGO, society, trust, Govt., state or agency of a state, or any
association or partnerships (whether or not having separate legal
personality) of two or more of the above and shall include succession and
v. “Day” means calendar day, unless otherwise specified as “Business Day”.
A Business Day is any day that is an official working day of the Authority.
It excludes the Authority’s official public holidays.
vi. “Completion Date” means the date of completion of the Services by the
Service Provider as certified by the Authority.
vii. “Authority” means the party who employs the Service Provider.
viii. “Authority’s Personnel” means all staff, labor and other employees of the
Authority engaged in fulfilling the Authority’s obligations under the
Contract; and any other personnel identified as Authority’s Personnel, by
a notice from the Authority to the Service provider.
i) “Party” means the Authority or the Service Provider, as thecasemaybe, and
“Parties”means both of them.
j) “Personnel”meanspersonshiredbytheServiceProviderorby any Subcontractor as
employees and assigned to theperformanceof theServices or anypart thereof.
k) “ServiceProvider”isapersonorcorporatebodywhoseBidtoprovidetheServices
hasbeen acceptedbytheAuthority;
l) “Service Provider’s Personnel” means all personnel
whomtheServiceProviderutilizesintheexecutionoftheServices,includingthestaff,labo
randotheremployeesoftheServiceProvider and each Subcontractor; and any other
personnelassistingtheServiceProviderintheexecutionoftheServices;
m) “Services” means the work to be performed by the ServiceProviderpursuant to
n) "SCF/RDF"meansnon-biodegradable,non-recyclable,non-reusable, nonhazardous
solid waste having
minimumcalorificvalueexceeding1500kcal/kgandexcludingchlorinatedmaterialslike
PVCplastic, woodywaste etc.
o) "inerts"meanswasteswhicharenotbio-degradable,recyclable, or combustible and
include debris, constructionand demolition wastes, street sweepings or dust and
siltremovedfrom the surfacedrains.
p) “GoodEarth”meansmixtureoforganicmatterandfinesoil.
1.3ThesuccessfulBidderwillbeexpectedtocompletetheperformanceof the Services by the
Intended Completion Date provided in theBDS.
2. Eligible Bidders
A Bidder shall not have a conflict of interest. AnyBidderfound tohave a conflict of interest
shall be disqualified. A Bidder may beconsidered to have a conflict of interest for the
purpose of this Bidding process, if the Bidder:
(a) directly or indirectly controls/ is controlled by or is undercommoncontrol with
anotherBidder; or
(b) receives or has received any direct or indirect subsidy fromanotherBidder; or
(c) hasthesame legalrepresentative asanother Bidder;or
(d) has a relationship with another Bidder, directly or throughcommon third parties,
that puts it in a position to influencethe Bid of another Bidder, or influence the
decisions of theAuthorityregardingthisBiddingprocess; or
(e) or any of its affiliates participated as a consultant in
thepreparationoftheAuthority’sRequirements(includingActivitiesSchedules,Perfor
manceSpecificationsandDrawings) for the Legacy Waste Remediation Services
thatarethe subject of theBid; or
(f) or any of its affiliates has been hired (or is proposed to
behired)bytheAuthorityorBorrowerfortheContractimplementation;or
2.3AfirmthatisaBiddershallnotparticipateinmorethanoneBid.Thisincludesparticipationas
asubcontractor.Suchparticipationshallresultinthedisqualification of all Bids in
which the firm is involved. A firmthat is not a Bidder may participate as a sub-
contractorin morethan oneBid.
2.4Biddersthatarestate-ownedenterprisesorinstitutionsintheAuthority’s Country may be
eligible to compete and be awarded aContract(s) only if they can establish, that
they: (i) are legally
andfinanciallyautonomous;(ii)operateundercommerciallaw;and
(iii)arenotunder supervisionof theAuthority.
1.5 A Bidder shallnotbe undersuspensionfromBidding by theAuthorityastheresultofthe
operationofaBid-SecuringDeclarationorProposal-SecuringDeclaration.
1.6 A Bidder shall provide such documentary evidence of eligibilitysatisfactory to the
Authority, as the Authority shall reasonablyrequest.
3. Qualificationof theBidder
3.1AllBiddersshallprovideinSectionIV,BiddingForms,apreliminarydescriptionofthepr
oposedworkmethodandschedule,includingdrawingsand charts, as necessary.

The Bidder is expected to examine all instructions, forms, terms,and specifications in the
bidding document and to furnish with itsBid all information or documentation as is required by
the biddingdocument.
Biddersthatarestate-ownedenterprisesorinstitutionsintheEmployer’s Country may be eligible to
compete and be awarded aContract(s)onlyiftheycanestablish,inamanneracceptabletotheBank, that
they: (i) are legally and financially autonomous; (ii)operate under commercial law; and (iii) are not
under supervisionoftheEmployer.
5.1TheBidder,attheBidder’sownresponsibilityandrisk,isencouraged to visit and examine the
locations of required Servicesanditssurroundingsandobtainallinformationthatmaybenecessary for
preparing the Bid and entering into a contract for theServices.The costs of visiting the locations of
ServicesandtheirsurroundingsshallbeattheBidder’sownexpense.Biddermusttakeanofficialpermissio
ntovisitthesiteandfollowapplicable safetymeasures, whilemovingaroundthe site.
6. Clarification of Bidding Document
6.1A Bidder requiring any clarification of the bidding document
shallcontacttheAuthorityinwritingattheAuthority’saddressspecifiedin the BDS within the date of
Pre-bid Meeting or during this meeting. The Authority will respond in writing to any requestfor
clarification, provided that such a request is received prior
tothedeadlineforsubmissionofBidswithinaperiodspecifiedintheBDS.
7.1At any time prior to the deadline for submission of Bids,
theAuthoritymayamendthebiddingdocumentbyissuinganaddendum.Theaddendumwillappearonthe
e-procurementsystemunder“LatestCorrigendum”.
Any addendum issued shall be part of the bidding document .
The Authority will publish the Pre-bid Meeting Minutes or Corrigendum or Addendum on e-tender portal
8.Currencies of Bidand Payment
8.1ThepricesshallbequotedbytheBidder,andshallbepaidforbythe Authority,entirelyinIndian

9.1 ToestablishtheconformityoftheLegacyWasteRemediationServices to the bidding document, the
Bidder shall furnish as part ofits Bid the documentary evidence that Services provided conform
tothe technical specifications and standards
10. Document establishing the Eligibility and qualifications of the Bidders
10.1 To establish their eligibility in accordance with RELEVANT ITB, Bidders shallcomplete the
Letter of Bid – Technical Part, included in Section IV,BiddingForms.
The documentary evidence of the Bidder’s qualifications to performthe Contract
if its Bid is accepted shall establish to the Authority'ssatisfaction that the Bidder
meets each of the qualification
criterionspecifiedinSectionIII,EvaluationandQualification Criteria.
AllBiddersshallprovidein document mentioned in this
tender,BiddingForms,apreliminarydescription of the proposed methodology,
detailed plan of action/workplan and schedule.
11 Period of Validity of Bids
Bids shall remain valid until the date specified in the BDS or anyextended date if
amended by the Authority in accordance with RELEVANT ITB.A Bid that is not valid
until the date specified in the BDS, or anyextended date if amended by the
Authority in accordance with RELEVANT ITB, shall berejected by authority as
Inexceptionalcircumstances,priortothedateofexpirationoftheBidvalidity, the
Authority may request Bidders to extend the period ofvalidity of their Bids. The
request and the responses shall be made inwriting. If a Bid Security is requested in
accordance with RELEVANT ITB itshall also be extended for a corresponding period.
A Bidder mayrefusetherequestwithoutforfeitingitsBidSecurity.ABiddergranting the
request shall not be required or permitted to modify itsBid.
12.Bid Security
Unless otherwise specified in the BDS, the Bidder shall furnish
aspartoftheTechnicalPartofitsBid,aBidsecurity,asspecifiedintheBDS, in original form and,
in the case of a Bid Security in originalform,in the amount andcurrencyspecifiedin theBDS.
If a Bid Security is specified pursuant to RELEVANT ITB the Bid Securityshall be a demand
guarantee, and in any of the following forms at theBidder’soption:
(a) an unconditional guarantee issued by a nationalized/ scheduledbank located in
(b) An irrevocable letter of credit; issuedbyaNationalized /ScheduledBank located
(c) acashier’sorcertifiedcheck;ordemanddraftfromaNationalized/Scheduled bank
locatedinIndia; or
If a Bid Security is specified pursuant to RELEVANT ITB any Bid
notaccompaniedbyasubstantiallyresponsiveBidSecurityshallberejected bytheAuthorityas
non-responsive.
IfaBidSecurityisspecifiedpursuanttoRELEVANT ITBtheBidSecurityofunsuccessful Bidders
shall be returned as promptly as possible
uponthesuccessfulBidder’ssigningthecontractandfurnishingthePerformanceSecuritypursu
ant toRELEVANT ITB.
TheBidSecurityofthesuccessfulBiddershallbereturnedaspromptlyaspossibleoncethesucces
sfulBidderhassignedtheContractand furnishedtherequiredPerformanceSecurity.
TheBid Securitymaybeforfeited:
(a) if a Bidder withdraws/modifies/substitutes its Bid prior to theexpiry date of the
Bid validity specified by the Bidder on theLetterof Bid or anyextended date
providedbytheBidder; or
(b) ifthesuccessful Bidderfailsto
(1) signtheContractinaccordance withRELEVANT ITBor
(2) furnishperformancesecurityinaccordance withRELEVANT ITB.
13 . FormatandSigningof Bid
13.1 TheBiddershallpreparetheBidasperdetailsgiveninRELEVANT ITB.
13.2 Bidders shall mark as “CONFIDENTIAL” information in their Bidswhich is confidential to
their business. This may include
proprietaryinformation,tradesecrets,orcommercialorfinanciallysensitiveinformation.
13.3A person or persons shall sign the Bid duly authorized to sign onbehalf of the Bidder. This
authorization shall consist of a
writtenconfirmationasspecifiedintheBDSandshallbeuploadedalong with theBid.
13.4Corrections,ifany,canbecarriedoutbyeditingtheinformationbefore electronicsubmission on e-
procurementportal.
D.OnlineSubmissionofBids
14.Preparationof Bids
Bids, both Technical and Financial Parts, shall be submitted online on the e-procurement
system specified in BDS 6.1. Detailed guidelines for viewing bids and submission of online
bids are given on the website. The e-tender for this Project is published on this website.
Any prospective bidder can logon to this website and view the e-tender and can view the
details of Legacy Waste Remediation Services for which bids are invited. A prospective
bidder can submit its bid online; however, the bidder is required to have
enrolment/registration on the website. The bidder should register on the website using
the relevant option available. The bidder can then login the website through the secured
login by entering the user id/ password chosen during registration. After getting the
bidschedules,theBiddershouldgothroughthemcarefullyandsubmitthespecified documents,
along with the bid, otherwise the bid will berejected.
All the documents are required to be signed digitally by the bidder. After electronic online
bid submission, the system generates a uniquebid identification number which is time
stamped as per server time. This shall be treated as acknowledgement of bid submission.
Physical, e-mail, Telex, Cable, or Facsimile bids will be rejected asnon-responsive.
15.DeadlineforSubmissionof Bids
15.1 Bid smustbeuploadedonlinenolaterthanthedateandtimespecifiedinthe BDS.
15.2 The Authority may,atits discretion, extend the deadlinefor
thesubmissionofBidsbyamendingthebiddingdocumentinaccordancewith RELEVANT ITB in which
case all rights and obligations of the Authorityand Bidders previously subject to the deadline shall
thereafter besubjectto the deadlineasextended.
16.1Theelectronicbiddingsystemwouldnotallowanylatesubmission of bidsafterduedate&time as
per server time.
17. Withdrawal,Substitutionand ModificationofBids
17.1Bidders may modify their bids by using the appropriate option for bidmodificationone-
procurementportalbeforethedeadlinefor submission of bids.For this the bidder need not
additionalpaymenttowardsthecostofthebiddingdocument.Forbidmodificationandconseque
ntialre-submission,thebidderisnotrequired to withdraw his bid submitted earlier. The last
modified bidsubmittedby thebidderwithinthebidsubmissiontimeshallbeconsidered as the
Bid. For this purpose, modification/withdrawal
byothermeanswillnotbeaccepted.Intheonlinesystemofbidsubmission,themodificationandco
nsequentialre-submissionofbidsis allowed any number of times. A bidder may withdraw
his bid byusing the appropriate option for bid withdrawal, before the
deadlineforsubmissionofbids,however,ifthebidiswithdrawn,re-submissionof thebid is

18.1 InformationrelatingtotheevaluationofBidsandrecommendationofcontract award, shall
not be disclosed to Bidders or any other
personsnotofficiallyconcernedwiththeBiddingprocessuntilinformationon Contract Award is
transmitted to all Bidders in accordance with RELEVANT ITB
18.2 Any effort by a Bidder to influence the Authority in the evaluation orcontractaward
decisionsmayresultin therejectionofitsBid.
18.3 Notwithstanding RELEVANT ITB from the time of Bid opening to the timeof Contract
Award, if any Bidder wishes to contact the Authority onanymatter relatedto the Biddingprocess,
itshould doso inwriting.
19.Clarification ofBids
19.1To assist in the examination, evaluation, and comparison of Bids, andqualification of
the Bidders, the Authority may, at the
Authority'sdiscretion,askanyBidderforclarificationofitsBidincludingbreakdownsoftheprice
sintheActivitySchedule,andotherinformationthattheAuthoritymayrequire.Anyclarification
2.2BidsrequestedtobewithdrawninaccordancewithRELEVANT ITBshallnottobe opened
submitted by a Bidder in respect to its Bid and that is not in responsetoarequestbythe
Authorityshallnotbeconsidered.TheAuthority’srequest for clarification and the response
shall be in writing. Nochange, including any voluntary increase or decrease, in the prices
orsubstance of the Bid shall be sought, offered, or permitted, except
toconfirmthecorrectionofarithmeticerrorsdiscoveredbytheAuthorityin theevaluationof
theBids,in accordancewithRELEVANT ITB.
19.2If a Bidder does not provide clarifications of its Bid by the date andtime set in the
Authority’s request for clarification, its Bid may berejected.
20.Deviations,Reservations,andOmissions
Duringtheevaluationof Bids,thefollowingdefinitions apply:
(a) “Deviation”isadeparturefromtherequirementsspecifiedinthebiddingdocument;
(b) “Reservation”isthesettingoflimitingconditionsorwithholdingfrom complete
acceptance of the requirements specified in thebiddingdocument; and
(c) “Omission” is the failure to submit part or all of the informationordocumentation
required inthe biddingdocument.
21.Nonconformities,Errors,andOmissions
21.1ProvidedthataBidissubstantiallyresponsive,theAuthoritymaywaiveanynonconformities in
21.2Provided that a Bid is substantially responsive, the Authority
mayrequestthattheBiddersubmitthenecessaryinformationordocumentation,withinareason
ableperiodoftime,torectifynonmaterialnonconformitiesoromissionsintheBidrelatedtodocu
mentationrequirements.Requestinginformationordocumentation on such nonconformities
shall not be related to
anyaspectofthepriceoftheBid.FailureoftheBiddertocomplywiththerequestmayresult in
therejection ofits Bid.
21.3Provided that a Bid is substantially responsive, the Authority shallrectify quantifiable
nonmaterial nonconformities related to the BidPrice. To this effect, the Bid Price shall be adjusted,
for comparisonpurposesonly,toreflectthepriceofamissingornon-conformingitemorcomponentby
addingtheaveragepriceoftheitemorcomponent quoted by substantially responsive Bidders. If
the price of the item orcomponent cannot be derived from the price of other substantially
responsiveBids, theAuthorityshall useitsbest estimate.
F.EvaluationofTechnicalPartsofBids
22. Evaluation of Technical Parts
22.1In evaluating the Technical Parts of each Bid, the Authority shall usethe criteria and
methodologies listed in RELEVANT ITB and

23.1 TheAuthority’sdeterminationofaBid’sresponsivenessistobebasedonthe contents oftheBid
itself,as defined inRELEVANT ITB .
23.2 A substantially responsive Bid is one that meets the requirements
ofthebiddingdocumentwithoutmaterialdeviation,reservation,oromission.Amaterial
deviation,reservation,oromissionis onethat:
(a) ifaccepted,would
(i)affectinanysubstantialwaythescope,quality,orperformance of the Legacy Waste
Remediation Servicesspecifiedin theContract; or
(ii)limit in any substantial way, inconsistent with the
biddingdocument,theAuthority’srights,ortheBidder’sobligationsundertheContract; or
(b)ifrectified,wouldunfairlyaffectthecompetitivepositionofotherBidders
presentingsubstantiallyresponsive Bids.
23.3If a Bid is not substantially responsive to the requirements of thebidding document, it willl
be rejected by the Authority and may
notsubsequentlybemaderesponsivebycorrectionofthematerialdeviation,reservation,
24. Qualificationof the Bidder
24.1The Authority shall determine to its satisfaction whether the eligibleBidders that have
submitted substantially responsive Bid – TechnicalParts meet the qualifying criteria
specified in Section III, EvaluationandQualification Criteria.
24.2 Thedetermination will bebaseduponanexaminationofthedocumentaryevidenceofthe
Bidder’squalificationssubmittedbytheBidder, pursuant to RELEVANT ITB. The
determination shall not take intoconsideration the qualifications of other firms such as the
Bidder’ssubsidiaries,parententities,affiliates,subcontractors(otherthanspecialized
subcontractors if permitted in the bidding document), oranyother firm(s)different from
theBidder thatsubmitted theBid.
24.3If a Bidder does not meet the qualifying criteria specified in SectionIII, Evaluation and
Qualification Criteria, its Bid shall be rejected
bytheAuthorityandmaynotsubsequentlybemaderesponsivebycorrectionofthematerial
deviation,reservation, oromission.
24.4OnlyBidsthatarebothsubstantiallyresponsivetothebiddingdocument,andmeetallQualification
CriteriashallhavetheFinancialPartsoftheirBids opened.
G.PublicOpeningofFinancial PartsofBids
25. PublicOpening of FinancialParts
Following the completion of the evaluation of the Technical Parts ofthe Bids, the Authority
shall notify in writing those Bidders whoseBids were considered non-responsive to the bidding
document orfailedtomeettheQualificationCriteria,advisingthemofthefollowinginformation:
(a) thegroundsonwhichtheirTechnicalPartofBidfailedtomeettherequirementsof
thebiddingdocument;
(b) theirFinancialPartofBidwillnot beopened;and
(c) notifythemofthedate,timeandlocationofthepublicopeningofFinancialParts oftheBids.
The Authority will, simultaneously, notify in writing those
BidderswhoseTechnicalParthavebeenevaluatedassubstantiallyresponsiveto the bidding
document and met all Qualifying Criteria, advisingthemofthe followinginformation:
(a) theirBidhasbeenevaluatedassubstantiallyresponsivetothebiddingdocument and met
theQualification Criteria;
(b) theirFinancialPartofBidwillbeopenedatthepublicopeningoftheFinancial Parts.
H. EvaluationofFinancialPartsofBids
26. Evaluation of FinancialParts
InevaluatingtheFinancialPartofeachBid,theAuthoritywilldetermine for each Bid the evaluated
Bid cost by adjusting the Bidpriceas follows:
(a) price adjustment due to quantifiable non-materialnonconformitiesin
accordancewithRELEVANT ITB
(b) excludingprovisionalsumsandtheprovision,ifany,forcontingencies in the Activity
Schedule but including Daywork,when requested in the Specifications (or Terms of
26.2TheestimatedeffectofthepriceadjustmentprovisionsoftheConditions of Contract, applied
over the period of execution of theContract,shall not betaken into accountin Bidevaluation.
27.Corrections of Arithmetical Errors
27.1The e-procurement system automatically calculates the total amountfrom unit rates and

28. Comparisonof FinancialPartsofBids

substantiallyresponsiveBidsestablishedinaccordancewithRELEVANT
ITBtodeterminetheBid that has thelowest evaluated cost.
29. Abnormally Low Bids
29.1An Abnormally Low Bid is one where the Bid price, in combinationwith other constituent
elements of the Bid, appears unreasonably lowto the extent that the Bid price raises

29.2IntheeventofidentificationofapotentiallyAbnormallyLowBid,theAuthority, unless otherwise
specified in the BDS, shall seek writtenclarifications from the Bidder, including detailed
price analyses of itsBid price in relation to the subject matter of the contract,
scope,proposedmethodology,schedule,allocationofrisksandresponsibilitiesand
anyotherrequirementsof the biddingdocument.
29.3After evaluation of the price analyses, in the event that the Authoritydetermines that the
Bidder has failed to demonstrate its capability toperform the Contract for the offered Bid
Price, the Authority mayrejecttheBid.
30. Authority’s Right to Accept Any Bid, and to Reject Any or All Bids

31. AwardCriteria
SubjecttoRELEVANT ITBtheAuthority willawardthe Contracttothesuccessful Bidder. This is the
Bidder whose Bid has been determinedto be theLeast Cost (L1) Bid. This is the Bid of the Bidder
that meetsthequalificationcriteriaandwhoseBid hasbeendeterminedtobe:
(a) Substantiallyresponsivetothebiddingdocument;and
(b) LeastCost(L1)
32.NotificationofAward
32.1 Prior to the expiration of the Bid Validity Period, the Authority
willnotifythesuccessfulBidder,inwriting,thatitsBidhasbeenaccepted.Thenotificationofawar
d(hereinafterandintheConditionsofContractandContractFormscalledthe“LetterofAcceptanc
e”)shallspecifythesum that the Authority will pay the Service Provider in considerationof
the execution of the Contract (hereinafter and in the Conditions
ofContractandContractFormscalled “theContractPrice”).
32.2UntilaformalContractispreparedandexecuted,theLetterofAcceptanceshall constitute
abindingContract.
33.SigningofContract
Promptly upon Notification of Award, the Authority will prepare theContractAgreement
readyintheofficeoftheAuthorityforthesignatureoftheAuthorityandthesuccessfulBidder,within
10 daysfollowing the date of Letter of Acceptance. The Contract Agreementshallincorporate all
agreementsbetweentheAuthorityandthesuccessfulBidder.
Withinten(10)daysofreceiptofLetterofAcceptance,thesuccessfulBiddershall(a)furnishtheperfo
rmancesecurityinaccordancewith RELEVANT ITB,andrevisedmethodologyfordeliveryof
services(b) shall sign, date and eturn the Agreement to the Authority alongwiththedocuments stated at
34.Performance Security
34.1 WithinTen(10)daysofthereceiptoftheLetter of Acceptancefromthe Authority, the
successful Bidder, if required, shall furnish thePerformance Security in accordance with the GCC
using for thatpurpose the Performance Security Form includedin Section
VIII,ContractForms,oranotherForm acceptableto the Authority.
34.2 IfthePerformanceSecurityfurnishedbythesuccessfulBidderisintheform of a Bank
Guarantee, it shall be issued at the Bidder’s option, bya nationalized/ scheduled bank located in
India, or by a foreign bankacceptable to the Authority, through a correspondent bank located

The Selected Bidder may undertake and perform the obligations and exercise
the rights of theSelected Bidder under the Project including the obligation to
enter into Agreement for the entire work of this Project through it’s Special
Purpose Vehicle (“SPV”).
Formation of SPV is purely optional and if bidder wants to execute the project
through SPV then Bidder has to submit the Name of Proposed SPV along with
Tender document at the time of technical bid submission.
The selected bidder & / or its Director shall hold major equity stake in the SPV
at all times duringthe term of the operation Period.
The SPV and Bidder, both will be equally liable for all tender conditions and
Performance bank guarantee / security deposit for the entire work shall be
submitted by the SPV firm.
Any change in SPV structure, has to be approved by RMC
Moreover, all the administrative, legal & financial correspondence with RMC
shall be done by SPV only.
2.2 Joint Venture is allowed with maximum of two members (i.e Lead member
and other member) JV norms are in accordance with the following:
□ JV members are “Jointly and severally responsible and liable in a contract for
pre- qualification the JV should fulfill the criteria specified in the pre-
qualification document. The attributes to be evaluated will be the same as for
individual contractors, however certain parameters up to the specified limits
have to be essentially met by them collectively some by the lead partner and
some by the other partner, as briefly described below.
A) Qualifying factors to be met collectively only for technical criteria as per Point No.
2.4 and 2.4.1 (Page No. 47 and 48)
B) Qualifying factors for both partner to be met indivudally for financial criteria as per

Bidder must have achieved a minimum annual Contractual turnover (contractual income

Experience in successfull Disposal of RDF (Refused Derived Fuel) 2,01,685 MT (i.e. Fresh Waste
% of 237250 MT = 61685 MT and Legacy waste 20 % of 7,00,000 MT = 1,40,000 ) through vendor’s
registered with GPCB/CPCB for Plastic waste recycler, Processor/Waste to energy plant/ Cement
Plant within the last seven years ending on 31/08/2026.
Similar Nature of work:
(a) Having Experience of Operations and Maintenance of Trommel system for work of
MSW Segregation
(b) Having Experience of Bio mining / Bio remediation of Legacy/Fresh Waste/Bio
mining, Bio Remediation related work.
(c) Having Experience of Processing of MSW/Bio Mass/Bio-methanation /Compost/Waste to
(d) Having Experience of Segregation/Processing of Dry waste/Wet Waste.
4) The bidder who is ful-filling the above experience criteria 2.Must have work experience as
describe in below in any one year during the last 7 years.
The bidder shall produce the work completion certificate / 3A Progress Certificate or performance
certificate from Central govt. organization/ State govt. organization /RMC /MunicipalCorporations /
Institute or any other Agency of Government of India or any of the State Governments
/ULBs/Govt/Municipal Authority. The same shall mention clear amount and Work Done Quantity of
work related to this tender.
5) Minimum Scope of work :
1 Bidder shall Process the Legacy Waste/Fresh Waste by using Power Supply through Diesel
Generator Set (DG Set). Bidder shall establish, erect, install and run / operate DG Set at his own cost.
RMC will allow to use electricity on site for this work if coonection is available at site.
2 Bidder shall have enough Vehicles, Machineries like (Trommel with conveyor Belt System) and
Manpower to move and transport waste to process legacy on daily basis as per the given time limit
12 months). Agency must do continue this work at the approved same rate for another one year or
new agency will be finalized and start the work whichever is earlier. i.e. No price escalation will be
paid for this extended scope of work.
6) Other Scope :
1 Disposal of RDF and Compost as per MSW Rules-2026 is under Agency’s Responsibility and
must be disposed daily basis.
2 If RDF and Compost shall not be stored more than 15 days after processing.(Total estimated
qty. of stored RDF, compost shall not exceed as per theoretical qty. calculated from processed
qty. of last 15 days) if more qty, exceeds above limit than 35% of corresponding RA bill
amount will be withheld from RA Bill as Deposit. If this will continue for 2 months than
amount shall be retained as penalty or security deposit will be forfeited.
3 Inert Disposal at Landfill cell is under Agency’s Responsibility.
Joint Venture is allowed between maximum 02 Agencies / Members / firm.
The Joint Venture must fulfil the following condition.
The lead partner/ Prime member shall meet not less 50 percent of all criteria given in para of
general experience and working capital. The joint venture must collectively satisfy the criteria of para of

may undertakeassessment of potential market linkages for SCF/ RDF fractions, Inert/ C&D
Material fractionsand soil. It is important to freeze the waste quantity to be remediated on
the day of start of workas the target quantity.
ConditionsofContractandContract
SectionVIII -GeneralConditions ofContract
1. GeneralProvisions
Unlessthecontextotherwiserequires,thefollowingtermswheneverusedin this Contract
havethe followingmeanings:
(a) TheAdjudicatoristhepersonappointedjointlybytheAuthorityandtheServiceProviderto
resolvedisputesinthefirstinstance,asprovided forin Sub-Clause8.2 hereunder;
(b) “Activity Schedule” is the priced and completed list of items ofServices to be
performed by the Service Provider forming partofhis Bid;
(c) “CompletionDate”meansthedateofcompletionoftheServicesbythe ServiceProvideras
certified bythe Authority;
(d) “Contract” means the Contract signed by the Parties, to
whichtheseGeneralConditionsofContract(GCC)areattached,togetherwithallthedocum
entslistedinClause1oftheContractAgreement;
(e) “ContractPrice”meansthepricetobepaidfortheperformanceoftheServices, in
accordancewith Clause6;
(f) “Dayworks” means varied work inputs subject to payment on
atimebasisfortheServiceProvider’semployeesandequipment,inadditiontopaymentsfo
rassociatedmaterialsandadministration;
(g) “Authority”meansthepartywhoemploystheServiceProvider;
(h) “Authority’sPersonnel”meansallstaff,laborandotheremployeesoftheAuthorityengage
dinfulfillingtheAuthority’sobligationsundertheContract;andanyotherpersonnelidenti
fiedasAuthority’sPersonnel,byanoticefromtheAuthorityto theServiceprovider;
(i) “ForeignCurrency”meansanycurrencyotherthanthecurrencyof thecountryof
(j) “GCC”meanstheseGeneralConditionsofContract;
“Government”meanstheGovernmentoftheAuthority’sCountry
(l) “Local Currency” means the currency of the country of theAuthority;
(m) “Party”meanstheAuthorityortheServiceProvider,asthecasemaybe, and
“Parties”means both of them;
(n) “Personnel” means persons hired by the Service Provider or
byanySubcontractorasemployeesandassignedtotheperformanceof
theServices or anypart thereof.
(o) “Service Provider” is a person or corporate body whose Bid toprovidethe
Services hasbeenaccepted bythe Authority;
(p) “Service Provider’s Personnel” means all personnel whom
theServiceProviderutilizesintheexecutionoftheServices,including the staff,
labor and other employees of the
ServiceProviderandeachSubcontractor;andanyotherpersonnelassistingtheS
erviceProviderintheexecutionof theServices;
(q) “SCC” means the Special Conditions of Contract by which
theGCCmaybeamended orsupplemented.
(r) “Specifications”meansthespecificationsoftheServicesincludedintheContract,
andanyadditionsandmodificationstothespecifications inaccordancewith
(s) “Services” means the work to be performed by the ServiceProviderpursuant
to theContract;
(t) “Subcontractor”meansanyentitytowhichtheServiceProvidersubcontracts
any part of the Services in accordance with theprovisionsof Sub-Clauses
(u) "SCF/ RDF" means non-biodegradable, non-recyclable, non-reusable,
nonhazardous solid waste having minimum
calorificvalueexceeding1500kcal/kgandexcludingchlorinatedmaterialslikeP
VCplastic,woodywasteetc.
(v) "inerts"meanswasteswhicharenotbio-degradable,recyclable,or combustible
and include debris, construction and
demolitionwastes,streetsweepingsordustandsiltremovedfromthe Surface
(w) “GoodEarth”meansorganicmatterand finesoil.
1.2ApplicableLaw
TheContractshallbeinterpretedinaccordancewiththelawsofUnionof India.
1.2.1Throughout the execution of the Contract, the Service
Providershallcomplywiththeimportof goodsandservicesprohibitionsinIndia,when.
a) asamatteroflaworofficialregulations,Indiaprohibitscommercialrelationswith that country;or
b) by an act of compliance with a decision of the United NationsSecurity Council taken under
Chapter VII of the Charter of theUnited Nations,India prohibits any import of goods from
thatcountry or any payments to any country, person, or entity in thatcountry.
ThisContracthasbeenexecutedinEnglish and
Gujarati,whichshallbethebindingandcontrollinglanguageforallmattersrelatingtothemeaningo
r interpretation of this Contract. Gujarati Version shall be considered as authentic version.
Any notice, request, or consent made pursuant to this Contract willbe in writing and shall be
deemed to have been made when deliveredin person to an authorized representative of the
Party to whom thecommunication is addressed, or when sent by registered mail,
telex,telegram, or facsimile to such Party at the address specified in theSCC.
The Services shall be performed at such locations as are specified
inAppendixA,intheSpecificationsand,wherethelocationofaparticular task is not so specified, at
such locations, whether in theGovernment’scountryorelsewhere,astheAuthoritymayapprove.
1.6 AuthorizedRepresentatives
Any action required or permitted to be taken, and any documentrequired or permitted to be
executed, under this Contract by theAuthority or the Service Provider may be taken or
executed by theofficialsspecified in the SCC.
1.8Taxesand Duties
The Service Provider, Subcontractors, and their Personnel shall
paysuchtaxes,duties,fees,andotherimpositionsas maybeleviedunderthe Applicable Law, the
amount of which is deemed to have beenincludedin theContractPrice.
2. Commencement,Completion,Modification,andTerminat
2.1Effectiveness ofContract
This Contract shall come into effect on the date the Contract issigned by both parties and such
other later date as may be stated intheSCC.
2.2 Commencementof Services
Before commencement of the Services, the Service Provider
shallsubmittotheAuthorityforapprovalarevisedProgram(revisingtheProgram given along with
the Bid) showing the general
methods,arrangements,order,andtimingforallactivities.TheServicesshallbecarriedoutinaccorda
ncewiththeapprovedProgramasupdated
2.2.2Starting Date
TheServiceProvidershallstartcarryingouttheServices as per Work-Order
2.3 IntendedCompletionDate
Unless terminated earlier pursuant to Sub-Clause 2.6, the ServiceProvider shall complete the
activities by the Intended CompletionDate, as is specified in the Work-Order. If the Service
Provider does notcomplete the activities by the Intended Completion Date, it shall beliable to
pay liquidated damage as per Sub-Clause 3.8.In this case,theCompletionDatewill bethedateof
completionofall activities.
2.4ForceMajeure
2.4.1Definition
For the purposes of this Contract, “Force Majeure” means an eventwhich is beyond the
reasonable control of a Party and which
makesaParty’sperformanceofitsobligationsundertheContractimpossible or so impractical as to
be considered impossible underthecircumstances.
2.4.2No Breach ofContract
The failure of a Party to fulfill any of its obligations under thecontract shall not be considered to
be a breach of, or default under,this Contract insofar as such inability arises from an event of
ForceMajeure, provided that the Party affected by such an event (a)
hastakenallreasonableprecautions,duecareandreasonablealternativemeasures in order to carry
out the terms and conditions of thisContract, and (b) has informed the other Party as soon as
possibleabouttheoccurrenceof such an event.
2.4.3ExtensionofTime
AnyperiodwithinwhichaPartyshall,pursuanttothisContract,completeanyactionortask,shallbeext
endedforaperiodequalto
thetimeduringwhichsuchPartywasunabletoperformsuchactionasaresult ofForceMajeure.
DuringtheperiodoftheirinabilitytoperformtheServicesasaresultof an event of Force Majeure, the
Service Provider shall be entitledto continue to be paid under the terms of this Contract, as well
tobereimbursedforadditionalcostsreasonablyandnecessarilyincurredbythemduringsuchperiodf
orthepurposesoftheServicesandin reactivatingtheServiceafter theend ofsuch period.
2.5.1By theAuthority
TheAuthoritymayterminatethisContract,bynotlessthanthirty (30) days’ written notice of
termination to the Service Provider, tobe given after the occurrence of any of the events specified
inparagraphs(a) through (d) ofthis Sub-Clause2.6.1:
(a) iftheServiceProviderdoesnotremedyafailureintheperformanceofitsobligationsundertheCo
ntract,withinthirty (30)daysafterbeingnotifiedorwithinanyfurtherperiodasthe
Authoritymayhavesubsequentlyapproved inwriting;
(b) if the Service Provider become insolvent or bankrupt; or
goesintoliquidationotherthanforareconstructionoramalgamation;
(c) if, as the result of Force Majeure, the Service Provider isunable to perform a material
portion of the Services for aperiod ofnot less than sixty(60)days; or
(d) if the Service Provider, in the judgment of the Authority
hasengagedinFraudandCorruption,asdefinedinparagraph2.2
a.of Attachment1totheGCC,incompetingfororinexecutingthe Contract
2.5.2BytheServiceProvider
The Service Provider may terminate this Contract, by not less thanthirty (30) days’ written
notice to the Authority, such notice to
begivenaftertheoccurrenceofanyoftheeventsspecifiedinparagraphs(a) and (b) ofthis Sub-
(a)if the Authority fails to pay any monies due to the ServiceProvider pursuant to this Contract
and not subject to disputepursuanttoClause7withinforty-five(45)daysafterreceivingwritten
notice from the Service Provider that such payment isoverdue;or
(b) if, as the result of Force Majeure, the Service Provider isunable to perform a material portion
of the Services for aperiod ofnot less than sixty(60)days.
2.5.3 PaymentuponTermination
Upon termination of this Contract pursuant to Sub-Clauses 2.6.1
or2.6.2,theAuthorityshallmakethefollowingpaymentstotheServiceProvider:
(a) remuneration pursuant to Clause 6 for Services satisfactorilyperformedpriorto
theeffectivedate of termination;except in the case of termination pursuant to paragraphs
(a),(b),(d)ofSub-Clause2.6.1,reimbursementofanyreasonablecost incident to the prompt and
orderly termination of theContract, including the cost of the return travel of the
ServiceProvider’sPersonnel.
3. ObligationsoftheServiceProvider
The Service Provider shall perform the Services in accordancewith the
Specifications and the Activity Schedule, and carry out its obligations
with all due diligence, efficiency, and economy,in accordance with
generally accepted professional techniquesand practices, and shall
observe sound management
practices,andemployappropriateadvanced
technologyandsafemethods.
TheServiceProvidershallatalltimestakeallreasonableprecautions
to maintain the health and safety of theServiceProvider’s Personnel
employed for the execution of Services atthe locations in the Authority’s
country where the Services areexecuted.
Ifrequiredin theSCC,theServiceProvidershallsubmittothe
Authority for its approval a health and safety manual which
hasbeenspecificallyprepared forthe Contract.
The health and safety manual shall be in addition to any
othersimilar document required under applicable health and
safetyregulationsand laws.
The health and safety manual shall set out any applicable
healthandsafetyrequirement underthe Contract,
(a) which mayinclude:
(i) the procedures to establish and maintain a
safeworkingenvironment;
(ii) the procedures for prevention, preparedness, andresponse
activities to be implemented in the
caseofanemergencyevent(i.e.,anunanticipatedincident,arisingfr
omnaturalorman-madehazards);
(iii) themeasurestobetakentoavoidorminimizethepotentialforcom
munityexposuretowater-borne,water-based,water-
related,andvector-bornediseases,
(iv) themeasurestobeimplementedtoavoidorminimize the spread
of communicable diseases;and
(b) AnyotherrequirementsstatedintheAuthority’sRequirements.
The Service Provider shall always act, in respect of any matterrelating to this
Contract or to the Services, as faithful adviser tothe Authority,
and shall at all timessupport and safeguard
theAuthority’slegitimateinterestsinanydealingswith Subcontractorsorthird
3.2Conflict of Interests
3.2.1 Service ProviderNot to Benefit fromCommissionsandDiscounts.
The remuneration of the Service Provider pursuant to Clause
6shallconstitutetheServiceProvider’ssoleremunerationinconnection with this Contract or
the Services, and the
ServiceProvidershallnotacceptfortheirownbenefitanytradecommission, discount, or similar
payment in connection withactivities pursuant to this Contract or to the Services or in
thedischargeoftheirobligationsundertheContract,andtheServiceProvider shall use their
best efforts to ensure that the
ServiceProvider’sPersonnel,anySubcontractors,andagentsofeitherofthemsimilarlyshallnotr
eceiveanysuchadditionalremuneration.
3.2.2 ServiceProviderandAffiliatesNotto be otherwiseInterested inProject
TheServiceProvideragreethat,duringthetermofthisContractand after its termination, the
Service Provider, and its affiliates,as well as any Subcontractor and any of its affiliates, shall
bedisqualifiedfromprovidinggoods,works,orServices(otherthantheServicesandanycontinuati
onthereof)foranyprojectresultingfrom orcloselyrelated to theServices.
3.2.3ProhibitionofConflictingActivities
NeithertheServiceProvidernoritsSubcontractorsnorthePersonnelshallengage,eitherdirectly
orindirectly,inanyofthefollowingactivities:
(a) business or professional activity that would
conflictwiththeactivitiesassignedtothemunderthisContract.TheServiceproviderhasanobliga
tionandshallensurethatitsServiceProvider’sPersonnelandSub-consultants shall have an
discloseanysituationofactualorpotentialconflictthatimpactstheircapacitytoservethebestinte
restoftheAuthority, or that may reasonably be perceived ashaving this effect. Failure to
disclose said situationsmay lead to the disqualification of the Consultant orthetermination
ofits Contract.
(b) during the term of this Contract, neither the ServiceProvider nor their Subcontractors shall
hire publicemployees in active duty or on any type of leave, toperformanyactivityunder this
(c) after the termination of this Contract, such otheractivitiesas maybe specified intheSCC.
The Service Provider, its Subcontractors, and the Personnel ofeither of them shall not,
either during the term or within two
(2)yearsaftertheexpirationofthisContract,discloseanyproprietaryorconfidentialinformation
relatingtotheProject,theServices,thisContract,ortheAuthority’sbusinessoroperationswithou
tthe prior writtenconsent of the Authority.
3.4 InsurancetobeTakenOutbytheServiceProvider
The Service Provider
(a) shall take out and maintain, and shallcause any Subcontractors to take out and
maintain, at its (or theSubcontractors’, as the case may be) own cost but on terms
andconditionsapprovedbytheAuthority,insuranceagainsttherisks,andforthecoverage,asshal
lbespecifiedintheSCC;and
(b) at the Authority’s request,shallprovide evidence to theAuthority showing that such
insurance has been taken out andmaintainedand that thecurrent premiums havebeen
3.5 ServiceProvider’sActionsRequiringAuthority’sPriorApproval
The Service Provider shall obtain the Authority’s prior approvalin
writingbeforetakinganyof thefollowing actions:
(a) entering into a subcontract for the performance of any partoftheServices,
(b) appointing such members of the Personnel not listed bynameinAppendixC(“KeyPersonnel
andSubcontractors”),
(c) changingtheProgramofactivities;and
(d) anyother action thatmaybe specifiedin the SCC.
3.6 ReportingObligations
The Service Provider shall submit to the Authority the reportsand documents specified in
Appendix G in the form, in thenumbers,and withintheperiodsset forth inthe saidAppendix.
3.7 DocumentsPrepared bytheServiceProvidertoBethePropertyoftheAuthority
All plans, drawings, specifications, designs, reports, and otherdocuments and software
submitted by the Service Provider inaccordance with Sub-Clause 3.6 shall become and
remain theproperty of the Authority, and the Service Provider shall,
notlaterthanuponterminationorexpirationofthisContract,deliverall such documents and
software to the Authority, together witha detailed inventory thereof.The Service Provider
may retain acopyof such documents and software.
3.8 Liquidated Damages
3.8.1Paymentsof LiquidatedDamages
TheServiceProvidershallpayliquidateddamagestotheAuthorityattherateperdaystatedintheS
CCfo r ach day that the Completion Date is later than the Intended Completion Date. The
total amount of liquidated damages shall not exceed the amount defined in the SCC, without
total amount of liquidated damages shall not exceed the amount defined in the SCC, without
prejudice to any other rights or damages incurred.
Time is the essence of the contract and payment or deduction ofliquidated damages shall
not relieve the Service Provider fromhis obligation to complete the work as per agreed
Program andorder and timing of all Activities, or from any of the
ServiceProvider’sotherobligationsandliabilitiesunderthecontract.
3.8.2Correctionfor Over-payment
If the Intended Completion Date is extended after
liquidateddamageshavebeenpaid,theAuthorityshallcorrectanyoverpayment of liquidated
damages by the Service Provider byadjusting the next payment certificate.The Service
Providershall be paid interest on the overpayment, calculated from thedate of payment to
the date of repayment, at the rates specifiedin Sub-Clause6.5.
3.8.3Lack of performance penalty
IftheServiceProviderhasnotcorrectedaDefectwithinthetimespecifiedintheAuthority’
snotice,apenaltyforLackofperformancewillbepaidbytheServiceProvider.Theamountt
o bepaidwillbeasdescribedinSub-Clause7.2andspecifiedintheSCC.
3.9PerformanceSecurity
The Service Provider shall provide the Performance Security tothe Authority no
later than the date specified in the Letter ofacceptance.The Performance Security
shall be issued in anamount and form by a bank acceptable to the Authority,
anddenominated in Indian Rupees. The performance Security shallbe valid until a
date 28 days from the Completion Date of theContract.
3.10 Fraud and Corruption
requirestheServiceProvidertodiscloseanycommissionsorfeesthatmayhavebeenpaid
oraretobepaidtoagents or any other party with respect to the bidding process
orexecutionoftheContract.Theinformationdisclosedmustinclude at least the name
and address of the agent or other party,the amount and currency, and the purpose
of the commission,gratuity,orfee.
3.11 SecurityoftheSite
Unless stated otherwise in the SCC, the Service Provider shallbe responsible for
the security at the locations in the Authority’scountry where the services are
carried out including providingand maintaining at its own expense all lighting,
andwatchingwhenandwherenecessaryfortheproperexecutionandtheprotectionofth
elocations,orforthesafetyoftheownersandoccupiersofadjacent propertyand for
thesafetyof thepublic.
IfrequiredintheSCC,priortotheStartingDateforthecommencementofServices,theSer
viceProvidershallsubmitforthe Authority’s No-objection a security management
thatsetsthesecurityarrangementsforthelocationsintheAuthority'scountrywherethe
Services are executed.
In making security arrangements, the Service Provider shall beguided by applicable
laws and any other requirements that maybestated in theAuthority's

backgroundchecksonanypersonnelretainedtoprovidesecurity;(ii)trainthesecuritype
rsonneladequately(ordeterminethattheyareproperly
trained)intheuseofforce(andwhereapplicable,firearms),andappropriateconducttow
ardstheServiceProvider’spersonnel,Authority'spersonnelandaffectedcommunities;a
nd(iii)requirethesecuritypersonneltoactwithintheapplicableLawsandanyrequireme
ntssetoutintheAuthority'sRequirements.
TheServiceProvidershallnotpermitanyuseofforcebysecuritypersonnelinprovidi
ngsecurityexceptwhenusedfor preventive
anddefensivepurposesinproportiontothenatureandextentofthethreat.
3.12 Protection ofthe Environment
Asapplicable,theServiceProvidershalltakeallnecessarymeasuresto:
i. protecttheenvironment(bothonandoffthelocationswheretheServicesareexecuted
)fromdamagesresultingfrom itsoperations/and oractivities; and
ii. limit damage and nuisance to people and
propertyresultingfrompollution,noiseandotherresultsoftheServiceProvider’sope
rations and/oractivities.
The Service Provider shall ensure that any emissions,
surfacedischarges,effluentandanyotherpollutantsfromtheitsactivitiesshallexceedneitherth
evaluesthatmaybeindicatedintheAuthority'sRequirements,northoseprescribedbyapplicabl
In the event of any delay or default by the Service Provider in the completion of the project
within the timelines stipulated under this Agreement, the Service Provider shall, at its own
cost and to the satisfaction of the Authority, implement all necessary remedies as may be
required by the Authority. Furthermore, the Service Provider shall be solely responsible
for and shall indemnify and hold harmless the Authority from and against any penalty,
fine, or order imposed by any statutory authority, court, environmental board, or any
other regulatory agency, arising out of or in connection with the Service Provider’s failure
to timely complete the project and/or any environmental damage caused during the
course of the project. For the avoidance of doubt, if any such penalty, fine, or adverse order
is passed or imposed for any act, omission, or delay attributable to the Service Provider,
including but not limited to non-completion of the project within the prescribed timeline,
the Service Provider shall bear full responsibility for the payment of such amounts and
compliance with such orders, without recourse to the Authority.
3.13 CulturalHeritageFindings
Allfossils,coins,articlesofvalueorantiquity,structures,groupsofstructures,andotherremainso
ritemsofgeological,archaeological,paleontological,historical,architectural,religiousinterestf
oundonthelocationsintheAuthority'scountry where the Services are carried out shall be
placed underthecareand custodyof theAuthority.
As soon as practicable after discovery of any such finding, theService Provider shall give a
notice to the Authority, to give theAuthority the opportunity to promptly inspect and/or
investigatethefindingbeforeitisdisturbedandtoissueinstructionsfor dealingwithit.
4. ServiceProvider’sPersonnel
4.1Description of Personnel
Thetitles,agreedjobdescriptions,minimumqualifications,and
estimatedperiodsofengagementinthecarryingoutoftheServicesoftheServiceProvider’sKeyPer
sonnelaredescribedinAppendix
C.TheKeyPersonnelandSubcontractorslistedbytitleaswellasbynamein
AppendixCareherebyapproved bythe Authority.
4.2 Removaland/orReplacementof Personnel
(a)Except as the Authority may otherwise agree, no changes shallbe made to the Key
Personnel.If, for any reason beyond
thereasonablecontroloftheServiceProvider,itbecomesnecessary to replace any of the Key
Personnel, the ServiceProvider shall provide as a replacement a person of
equivalentorbetter qualifications.
(b) TheAuthoritymayrequiretheServiceProvidertoremove(orcausetoberemoved)
aServiceProvider’sPersonnel, who:
(i) persistsinanymisconduct orlackofcare;
(ii) performsdutiesincompetentlyornegligently;
(iii) failstocomplywithanyprovisionoftheContract;
(iv)persistsinany
conductwhichisprejudicialtosafety,health,ortheprotectionoftheenvironment;
(v) based on reasonable evidence, is determined tohave engaged in Fraud and
Corruption during theexecutionofthe Contract;
(vi) hasbeenrecruitedfromtheAuthority'sPersonnel;
Asappropriate,theServiceprovidershallthenpromptlyappoint (or cause to be appointed) a
suitable replacement withequivalentskills and experience.
NotwithstandinganyrequirementfromtheAuthoritytoremove or cause to remove any
person, the Service providershall take immediate action as appropriate in response to
anyviolationof(i)through(vi)above.Suchimmediateactionshallincluderemoving(orcausingt
oberemoved)fromthelocations where the Services are carried out , any ServiceProvider’s
Personnel who engages in (i), (ii), (iii), (iv) or (v)aboveor hasbeenrecruited asstated in
(c)The Service Provider shall have no claim for additional costsarising out of or incidental
to any removal and/or replacementofPersonnel.
Provider’s Personnel
(i)The Service Provider shall during the whole contract periodincluding
period of and Operation & Maintenance strictlyfollow and act as per the
provisions of payment of wages act,The Industrial Dispute Act-1947, all
labour/ workers relatedlaws. The Service Provider shall be responsible
for serviceconditionsandtopaysalaryandsuchallowancestothe workers
and officers time to time prescribed by
competentgovernmentauthority.Anybreachoflawrelatedtoworkmen/Labo
ur the Service Provider shall be responsible topay and compensate the
cost and the amount,
Corporationshallnotberesponsibleinanymatterrelatedtoworkmen/officer
sengagedtocarryoutworkincludingOperation and Maintenance. The
workers, labours, officersetc. engaged by the Service Provider to carry out
this workincluding, and Operation and Maintenance are solely of
theService Provider therefore the client shall not be
responsibletopayServiceProvidercompensationtotheworkers,labours,offic
ers etc. engaged by the Service Provider to carry out thisworkincluding
and Operationand Maintenance.
(i) ThecontractisinclusiveofOperation&Maintenanceincluding manpower
therefore Service Provider shall strictlyfollow all labour laws EPF, ESIC, ID
applicablelabourlawsincludinglabourpaymentasperminimum
labourwages. The Service Provider shall not sublet Operation
andmaintenance work to anyotheragency.
(ii) Corporationshallnotberesponsibleinanymannertopayanypayment arise
out of any legal proceeding or award of court,tribunal etc. under Payment
of Wages Act, The IndustrialDisputeAct-
1947,alllabour/workmenrelatedlawsrelatedtothe 54 workers, labours,
officers etc. engaged by the ServiceProvider to carry out this work
including and Operation
andMaintenance.TheServiceProvidershallbeliabletomakeanypaymentarisi
ngoutofanylegalproceedingorawardofcourt,tribunaletc.
(iii) The workers, labours, officers etc. engaged by the ServiceProvider to
carry out this work including, and Operation andMaintenance are solely
of the Service Provider therefore theyall shall not considered as regular
Authority of Corporationand no claim in this regard lies against
Corporation by any ofthe workers, labours, officers etc. engaged by the
ServiceProvider to carry out this work including and Operation
andMaintenance.
(iv) The workers, labours, officers etc. engaged by the ServiceProvider to
carry out this work including, and Operation andMaintenance are solely
of the Service Provider therefore theyshallnotentitle
togetanyIdentityCard from Corporation.
(v) TheServiceProvidershalltakecognizanceofChildLaborActandtakeprecautio
n not to deployChildLabor
(vi) Amendmenttoanylawmentionedaboveshallbeapplicabletothis contract.
5. ObligationsoftheAuthority
5.1AssistanceandExemptions
The Authority shall use its best efforts where legally warranted toensure that the
Government shall provide the Service Provider suchassistanceandexemptions asspecified in
5.2ChangeintheApplicableLaw
If,afterthedateofthisContract,thereisanychangeintheApplicableLaw with respect to taxes and
duties which increases or decreases
thecostoftheServicesrenderedbytheServiceProvider,thentheremunerationandreimbursablee
xpensesotherwisepayabletotheService Provider under this Contract shall be increased or
decreasedaccordinglybyagreementbetweentheParties,andcorrespondingadjustmentsshallbe
madetotheamountsreferredtoinSub-Clauses
6.2(a) or (b), asthecase maybe.
5.3Services andFacilities
TheAuthorityshallmakeavailabletotheServiceProvidertheServicesandFacilities listed under
6. PaymentstotheServiceProvider
6.1ContractPrice
ThepriceispayableinIndianNationalRupees(INR)assetforthintheSCC.
6.2 Termsand ConditionsofPayment
PaymentswillbemadetotheServiceProvideraccordingtothepayment schedule stated in the SCC.
Any other payment shall bemade after the conditions listed in the SCC for such payment
havebeen met, and the Service Provider have submitted an invoice to
theAuthorityspecifyingtheamount due.
6.3 Extra Quantity Extra Time limit after 1 year (excluding non working period) of Work.
Agency must do continue this work at the approved same rate for another one year or
new agency will be finalized and start the work whichever is earlier. i.e. No price escalation
will be paid for this extended scope of work.
7. Quality Control
7.1 Identifying Defects
TheAuthorityshallchecktheServiceProvider’sperformance and notify him of any Defects
that are found specifying a time by which these should be corrected.
SuchcheckingshallnotaffecttheServiceProvider’sresponsibilities.TheAuthoritymayinstructth
eServiceProvider to search for a Defect and to uncover and test any servicethat
theAuthorityconsiders mayhaveaDefect.
The Service Provider shall permit the Authority's Technicalauditor to check the Service
provider’s work and notify theAuthorityandServiceproviderof anydefectsthatarefound.Such
a check shall not affect the Service Provider’s or
theAuthority'sresponsibilityasdefinedintheContractAgreement.
7.2Correction of Defects, and Lack of Performance Penalty
(a) The Authority shall give notice to the Service Provider of anyDefectsbeforethe end
(b) Every time a Defect notice is given, the Service Provider shallcorrect the notified
Defect within the length of time specifiedbythe Authority's notice.
If the Service Provider has not corrected a Defect within thetime specified in the Authority's
notice,the Authority willassess the cost of having the Defect corrected, the
ServiceProviderwillpaythisamount,andaPenaltyforLackofPerformancecalculatedas
describedin Sub-Clause3.8.
8. SettlementofDisputes
8.1Amicable Settlement
ThePartiesshallusetheirbesteffortstosettleamicablyalldisputes arisingoutof
orinconnection withthisContract oritsinterpretation.
8.2Dispute Settlement
IfanydisputearisesbetweentheAuthorityandtheServiceProvider in connection with, or
arising out of, the Contract or
theprovisionoftheServices,whetherduringcarryingouttheServicesoraftertheircompletion
,themattershallbereferredtothe court of Law under Jurisdiction of Rajkot City only.
SectionVII-SpecialConditionsofContract

AppendixC-ObligationofParties
1. ObligationofServiceProvider:
i. The Service Provider shall ensure that all the aspects of project and process employed,
forexecuting the scope of the Services thereof, shall confirm with the specification and
directionsgiveninexistinglawspertainingtodumpsitemanagement,suchasSWMrules2026,
guidelinesfromregulatoryagencieslikeCPCB, DPCC, etc.and suggestions from NGT.
ii. The Service Provider shall provide a detailed plan of action for carrying out the entire
projectwork, considering the scope and timelines mentioned in the Tender. The Service
Provider shallalso make necessary modifications/changes in the detailed plan of action/
work plan, based onthe site conditions, or as recommended by Authority and finalize it
as per the approval by
theAuthority,priortothesigningofContract.TheServiceProvidershallensurethateachmilest
oneshould beachieved within the proposedtimelines.
iii. Prior to the start of project operations, the Service Provider shall be responsible for
obtainingalltheapplicablestatutoryclearances,permission,licenses,consents,andauthoriza
tionsnecessary for the Project at their own cost. The Authority shall provide assistance,
whereverrequired.
iv. Site preparation, mobilization, manpowerdeployment, installation ofmachinery, etc.
andconstruction/creation of other allied facilities shall be completed within 30 days
months from thesigning of the Contract Agreement.
v. The Service Provider shall conduct its own due diligence for site investigation, analyzing
thecharacteristics, composition, and quantum of the waste at the Project site or any
other studyrequiredfor theexecution ofthework, beforetakingdueapproval of
vi. All the cost related to these operations, including electrical consumption and other
utilitycharges, and required field arrangements, manpower deployment shall have to
bear by theServiceProvider only.
vii. Creationandmaintenanceofinfrastructure,facilitiesandamenitiesforwasteexcavated,stora
geand disposal, shall be at Service Provider’s risk and cost. Providing security
arrangements fortheplan project site, machinery,equipment etc.
viii. ConstructionofofficeroomfacilitiesfortheProject,arrangement
forwatersupplyandpowersupplyatthesite.
ix. It is the sole responsibility of the Service Provider to dispose of the rejects, Inert/ C&D
Material, etc. generated during the process. By products from such processing viz.
recyclables, Good Earth, SCF/ RDF, etc. and related revenues (if any) shall be the property of
the Service Provider.
x. The Service Provider shall not be permitted to use the municipal land at any point of
time ofcontract to mortgage (or) to be used as a security for mobilizing finance for this
purpose (or)any other purpose. Service Provider can use the land for the purpose of this
project only tillcontractperiod ortermination ofcontract.
xi. TheServiceProvidershallabidewiththeprovisionofMinimumWagesAct/WorkmanCompen
sationActandsuchotherstatutoryobligationsnotifiedbytheconcernedGovt.departments,
from time to time. It should be specifically noted that the Service Provider shallhave to
get them registered with the relevant authorities as required under various labor
lawsand submit undertaking of compliance along with the first payment bill failing
which thepaymentbill shall not be processed.
xii. The Service Provider shall strictly comply with all the statutory requirements notified by
theconcerned Govt. departments from time to time and indemnify the Authority against
anyclaim(s),whatsoeverarisingthere
fromandthetenderershallbesolelyresponsibleforconsequences thereof. The Service
Provider are requested to take cognizance of Child LaborAct and take precaution not to
deploy child Labor. If Child Labor is found to be deployed onthework, necessaryaction as
deemedfit will be taken.
xiii. Submission of progress report to Authority on fortnightly, monthly, and quarterly basis.
Themonthlyandquarterlyreportsshallbesubmittedwithin7(seven)daysofthesubsequent
monthandquarter respectively.
Aftercompletionofthecontractperiod(extended periodas the
casemaybe),within1months,theServiceProvider hasto remove
anyplant,machinery,equipment fromthesite.

i. AuthorityshallhandoverthedumpsiteareatotheServiceProvider,aspertheearmarkedland
parcel jointly approved by the Authority and the Service Provider, to set up machinery
andtakeactivities for processingand segregation ofexcavated material.

of thetitleof thelandto enablehim tocarryout activities requiredfor
executingtheservices.

A. SPECIAL CONDITIONS
1. Notice Inviting Bids
1.1 The commissioner, Municipal Corporation, Rajkot invites sealed bids from competent bidders
for Processing of Legacy waste (Mix) as per MSW Rules
2.1 To comply with the Municipal Solid Waste (management and Handling) Rules
2.2 To improve the existing standards of public health and environmental quality by establishing
efficient Solid waste Management.
3. Scope of Work
The Bidder should familiarize themselves with the site conditions, and also carry out necessary
site visits, surveys, studies / testing, analysis of the existing MSW with due diligence at their
own cost prior. Bidder will be allowed to take bores at site to ascertain density at different
levels and to carry out analysis of strata. Bidder shall not bring any dispute regarding any
variation in quantity and characteristics of MSW as he is expected to do his own studies.
The bidder shall carry out topography survey using drone, setup permanent benchmark on site,
a quantity survey of the existing legacy waste and demarcate the site into legacy waste zones,
finalise cutoff level in consultation with RMC officials, TPI. Biomining activities shall be carried
out zone-wise, and a list of identified zones shall be submitted to Rajkot Municipal Corporation
(RMC). Further, the bidder must intimate RMC in advance before commencing biomining
activities in any zone.
Bidders are requested to undertake required reconnaissance studies and field level studies
required by the Bidder to ensure that their Technical Proposal addresses the issues and meets
the requirements of the project as outlined in the Description of Work and Tender Document.
Bidders are open to carryout independent studies to confirm the validity of the information
provided in the Tender.
The Successful Bidder shall submit a Technical Proposal setting out the approach to the Project
within 10 days from the LOIfrom the RMC and get it approved before starting the project. The
Technical Proposal shall comply with the Project Requirements and O&M Requirements as
mentioned in tender document. The design and approach for implementing the Project shall
also be in compliance with the Applicable Law, Rules and Acts, including the SWM Rules
After submission of Proposal Documents, Within 10 days of the receipt of the same, the RMC
shall review the same by its proof checkby SWM dept./ consultant/ TPI and convey its
observations if any to the Contractor with particular reference to their conformity or otherwise
with the Scope of the Project and the Specifications and Standards. The Contractor shall not be
obliged to await the observations of the RMC on the Drawingssubmitted pursuant here to
beyond the period of 10 days and may begin or continue Works at its own discretion and risk.
If the aforesaid observations of the RMC indicate that the Proposal are not in conformity with
the Scope of the Project or the Specifications and Standards, such Proposal shall be revised by
the Contractor in conformity with the provisions of this Agreement and resubmitted to the RMC
for review. The RMC shall give its observations, if any, within 05 days of receipt of the revised
No review and/or observation of the RMC’s Engineer and/or its failure to review and/or convey
its observations on any Proposal shall relieve the Contractor of its obligations and liabilities
under this Agreement in any manner nor shall the RMC’s Engineer or the RMC be liable for the
same in any manner; and if errors, omissions, ambiguities, inconsistencies, inadequacies or
other Defects are found in the Proposal, they and the construction works shall be corrected at
the Contractor’s cost, notwithstanding any review;
the Contractor shall be responsible for delays in submitting the Proposal as set forth caused by
reason of delays in surveys and field investigations, and shall not be entitled to seek any relief in
that regard from the RMC; and
Contractors clearly understand that notwithstanding all the statements above including its
responsibility in respect of designs and drawings confirming to the requirements and relevant
specifications, being checked and approved by proof checking agency as also having been
scrutinized by RMC it is responsibility of the contractors that the final approval before
commencement of execution shall have to be based on the drawings and design cleared and
approved by the concerned authority of Government of Gujarat.
If errors, omissions, ambiguities, inconsistencies, inadequacies or other defects are found in the
Contractor’s documents, they and work shall be corrected at the Contractor’s cost,
notwithstanding any consent or approval under this Clause.
The intellectual property rights in respect of drawings, designs and all that is relevant to the
concept of rights shall be vested in RMC.
The Contractor shall execute the works as specified, and in conformity with the Specifications
and Standards set forth in the contract. The Contractor shall be responsible for the correct
positioning of all parts of work, and shall rectify any error in the positions, levels, dimensions or
alignment of work and the Contractor agrees and undertakes that the construction shall be
completed on or before the scheduled Completion Date, including any extension thereof.
All materials equipment, machineries used at site shall be as per the relevant applicable code,
norms, rules etc. All Movable Machineries, equipments, Vehicles used at site for processing
legacy waste, disposal of inert, rejectsetc. must comply with RTO norms of Rajkot City and
Bidder shall procure necessary insurance and Vehicle Tax receipts of RMC for the same as
required under this contract and as per the Rajkot Municipal Corporation norms.
Documentary evidence shall be provided for technical evaluation and all documents & technical
proposal submitted shall be part of contract. The same plan shall be adhered for
implementation. No change in the plan is allowed without the approval of RMC.
The Bidder has to obtain all the required permissions/ NOCs from various authorities like GPCB,
in order to operate the legacy waste processing plant and process the municipal solid waste at
Rajkot Nakrawadi Landfill and all other necessary approval, licenses, permission etc. from
concern statutory authority.
The successful bidder shall be responsible for carrying out necessary pre-processing of the
waste to ensure that the moisture content does not exceed 25% of the total weight of Solid
Waste before taking for processing. It shall be mandatory to reduce the moisture content to
the specified level through appropriate pre-processing methods such as drying, turning,
formation of windrows or any other suitable scientific technique, prior to inwarding the mix
municipal solid waste for further processing or disposal. No waste shall be considered as
inwarded or accepted at the processing facility unless the above prescribed moisture content
requirement is met.
The bidder shall provide barricades or use other suitable means to isolate the boundary
between unprocessed waste andprocessed legacy waste.
To set up necessary infrastructure including compoundwall / precast wall / galvenised or any
other sheet fencing around the whole plant with only one Entry and Exit Gate with CCTV camera
at entry and Exit gate and also provide cctv camera network within whole processing plant as
required for 24x7, DG set and machinery with other necessary utilities with CCTV network for
supervision at weighbridge and processing unit. Machinery like trommel machine of required
capacity, conveyor belt system containing hopper, feeding machineries like JCB, Hitachi and
waste transfer vehicle like tractor/dumper, Stone Picker Machine, cyclone separator, wind
shifter, disc separator, etc shall be deployed in quantity as mentioned in bid document. Agency
shall depoly 24*7 security at entry point in agency’s Plant.
The technical offer shall well include the technical details so as to derive the suitability and
sustainability of the same. The technical details shall also include the final percentage (%)
rejects to the total incoming waste at the end of processing cycle and dispose the inert in landfill
site of RMC. The rights of by products such as compost and RDF will be of successful bidder.
Bidder must write time frame for processing of all waste quantity.
A Vehicle(five seater LCV) for 24-hours (365-days) shall be provided for RMC legacy site work
for RMC Nakarawadi site staff topickup and drop from City Area to Nakarawadi Site and
supervision. The Vehicle should be not be more then two years old and anymake of Mahindra
,Tata, Toyota, Maruti, Kia, Hyudai, Nissan,etc. XUV type car. Vehicle Provided Form Full Contract
Period From Work order to Work Completion or Site clear.
Sorting and Segregation
The Bidder after agreement should prepare and submit a comprehensive PROCESSING OF
MUNICIPIAL SOLID WASTE plan including leachate management, Fire safety, CCTV surveillance,
environmental monitoring, product -byproduct-inert disposal plan.. This would also include a
plan for disposal of inert and other disposable/saleble material as per SWM Rules
applicable norms, acts, rules etc..
The Bidder shall take necessary steps and processes that would bring in control of odor and
leachate in the region.
The Bidder shall set up sorting system flexible enough and convenient for segregation of
dumped material.
The Bidder should maximize the separation of recyclables i.e. glass, metal, etc. as well as other
components for generation of RDF from the legacy waste.
It is the responsibility of the Bidder to provide adequate number of sorting machines for
achieving the Minimum Monthly average target of 2600 TPD and as mentioned in the scope of
Bidder shall manage Segregation, Storage, Transportation and Disposal of domestic hazardous
waste, biomedical waste, C&D waste if found during processing of waste at its own cost. The
disposal of any bio-medical waste and C&D waste is the sole responsibility of the contractor.
The contractor has to identify the buyer’s location.
The Bidder shall handover any valuable items like gold, diamonds, and all precious metals other
than iron scrap material.
Recovery of the Disposal Materials
The bidder should target to separate the bio-earth from the biodegradable component of the
solid waste at the dump site however contractor may be allowed to segregate only.
The bidder should ensure total stabilization of the waste dump so that it releases no offensive
odors and generates no leachates, so as to have the reclaimed land fit for any other purpose
including construction after the settling period as approved scientifically.
The bidder should take precaution of minimizing flies, rodents and bird menace and fire
The bidder should as in above section deal with pre-process output such as RDF, while
recyclables be sold to appropriate vendors. The pre-process and post composting process
rejects shall be handled as per SWM Rules 2026. The Bidder should explore the possibility of
minimizing the quantum of inert with alternatives. The PROCESSING site, which will be handed
over to contractor by RMC, shall be reclaimed 100 % to its natural level by contractor. It will be
the sole responsibility of the contractor to dispose the total material recovered along with inert
material / waste generated during the process.
Only inert material shall be allowed to dispose of in RMC Landfill Cell .
The plastic material segregated from the compost shall be handled as per Solid Waste
Management Rules 2026. 6) After the removal of clump, the site shall be reclaimed to its natural
ground level or level given by RMC Engineer in Charge. Bidder shall carry out topography
survey in the beginning of project in presence of RMC officials, PMC/TPI, also periodic
topography survey shall be carried out as per tender condition. Final level/formation level shall
be determined jointly by RMC officials, PMC/TPI consultant and contractor as per prevailing site
The transportation, storage and disposal of the RDF/SCF, Recyclable Material inert material and
the compost material shall entirely be under the scope of the Bidder under this project.
It is the sole responsibility of the Bidder to dispose the inert matter generated during the
process. Byproducts from such processing i.e. recyclables, enriched soil, compost, gas, energy
etc. will be the property of the Bidder.
The moisture content in the RDF should be as per the requirements suggested in Guidelines for
Usage of Refuse Derived Fuel in Various Industries CPHEEO October
Site Development and Facilities
The bidder should carry out necessary geotechnical surveys for considering the hydrological
and flooding potential at sites, in order to mitigate any effect on the activities during
PROCESSING in terms of leachate Mangement.
The plant area shall be fenced or hedged and provided with proper gate to monitor incoming
vehicles or other modes of transportation
Bidder should provide weighbridge, calibrated as per the IS Standards, to measure quantity of
various components of waste at landfill is processed in terms of sorting and segregated
materials, RDF, compost material, and inert going out of the site.
The bidder shall also provide fire protection measures and safety equipment as suggested by
fire department, RMC
The bidder shall provide utilities such as drinking water facilities and sanitary facilities
(preferably washing/bathing facilities for workers) and lighting arrangements for
easyoperations during night hours shall be provided and safety provisions including health
inspections of workers at site shall be carried out.
Bidder shall set a soil and ground water baseline so that the same will be available to evaluate
post PROCESSING reclamation of the site.
Bidder shall monitor ground water quality, work zone air quality and ambient air quality
monitoring within the site from authorized laboratories/Bidders and submit the report on
The bidder shall monitor and measure noise levels at the site and interface of the facility with
plant boundary and surrounding area.
Bidder has to ensure that he has acquired necessary approvals, clearances in connection with
PROCESSING project from relevant authorities.
The Bidders are recommended to follow the methodology of the PROCESSING as per CPCB
The Bidder will ensure that a CCTV monitoring system and remote access to CCTV and
weighbridge data should be setup for effective monitoring, Operation and Maintenance of the
Bidder has to design the capacity of PROCESSING plant which can process minimum 3500 TPD
waste, keeping in view the entire project timeline, monsoon period, Temporary Storage Area
built up and Closure work to be executed as per CPHEEO guideline and as per SWM rules

Operation and Maintenance of Infrastructure and Equipment
The bidder shall be responsible for construction, operation of site, maintenance of
transportation trucks, mechanical lifting arrangements to transfer the byproducts into trucks,
parking facilities, weighbridge, CCTV etc. The bidder should maintain the facility and machinery
in order to operate for the concession period.
The Bidder shall ensure that his personnel report work every day at designated time and
continue working throughout the day. The Bidder shall make provision for presence of requisite
manpower so that the work is not affected at the site.
The Bidder shall maintain at least 10% additional Vehicle / Machinery in inventory in order to
account for any breakdown of equipments, vehicles or additional work required to be as per the
instructions of RMC from time to time.
The Bidder should ensure regulated and continuous removal of waste from dump site/landfill
with utmost safety and under standard hygienic conditions. It is to be noted, If RMC or any of its
authorized agency or Health Department Personnel of RMC found improper hygiene conditions,
Penalty at the Norms of RMC may be levied to the Contractor and if such penalty is not paid by
contractor the same will be deducted from Contractor Running Bill.
The waste removed from the dump sites is to be safely transferred to the treatment facility
erected at the site. The Bidder will prepare a layout clearly showing the area required for
treatment of the garbage along with allied activities.
The treatment plant should be provided with necessary infrastructure like security and access
control/s, camera monitoring and recording features etc by the Bidder.
The entire site should be under CCTV surveillance. For that, High Definition IP based cameras in
adequate numbers (as directed by RMC) shall be provided by the Bidder and recording of the
same has to be submitted by bidder for each month or as and when required by RMC, during
entire project duration.
In case of any malfunction/technical problem in the functioning of the weighing system, the
same shall be rectified by the Bidder within a period of 24 hrs. During this period of failure,
weighing of dumped waste shall not be allowed.
In case Bidder are required to set up ancillary facilities at site like Fuel storage, DG set etc., RMC
may assist the Bidder in getting the same installed at site for period of contractonly. However,
the necessary permissions required are to be obtained by Bidder at his cost.
All handling of explosives, including storage, transport shall be carried out under the rules
approved by the “Explosives Department of the Government”.

available with his/her workmen.
Bidder shall ensure that his/her all Lifting Tools and Tackles are certified by competent person
(e.g. Chain Blocks, Slings, D- Shackle, Wire Rope, Crain etc.)
Bidder shall ensure that all his/her Electrical Appliances like Welding m/c, grinder, Drill m/c,
Breaker etc. are be in good condition with proper industrial plug top with good cable. Bidder
shall not bring any equipment with joint or damaged cable.
Bidder shall ensure that his/her workmen will start the job only after proper safety induction
It is the sole responsibility of the Bidder to abate the Odour and fire nuisance on the site. The
Bidder has to use enzyme/herbal based products which will help to abate the Odour and fly
nuisance. Necessary fire fighting vehicles shall be arranged on the site to abate the fire nuisance.
The Bidder shall make necessary arrangements such as water tanker, fire extinguisher,
firefighting pump on the site to extinguish the fire at their own expense.
Safety of the WASTE at the site will be the responsibility of the Bidder. The Bidder will make
sure WASTE and the RDF removed from the WASTE is safe from fire on the site. In case of the
accident on the site, the Bidder will be borne the expenses/ penalty as per Directions issued
from various governing authorities.
The plastic material segregated from the compost shall be handled as per Plastic Waste
Management rules-2026.
After the removal of dump, the site shall be reclaimed to its natural ground level.
The Bidder shall recover any domestic hazardous waste, biomedical waste and C&D Waste if
found during excavation, sorting/ segregation and has to handle/disposed the same as per the
prevailing norms.
The Bidder shall handover any valuable items like gold, diamonds, and all precious metals other
than iron scrap material to EIC of RMC.
The Bidder will segregate any Hazardous waste [as defined in Hazardous Waste (Management,
Handling and Trans-boundary Movement) Rules, 2008] if existing inside the site and separately
earmarked. Successful Bidder shall dispose of the same at GPCB’s approved sites in accordance
with Hazardous Waste (Management, Handling and Transboundary Movement) Rules, 2008 or
amendments thereafter.
All the material recovered from PROCESSING plant is the product belonging to the contractor
and the same has to sold/disposed off as per norms laid in Solid Waste Management Rules-2026
within 30 days.
There should not be any backlog for the product recovered during the PROCESSING process,
any product generation/recovered backlogged for more than 30 days will be taken into account
for penalty provision.
Bidder has to keep record of the material recovered/sold by him through PROCESSING process
through the digital weigh bridge slip and the same shall be keep in form of log book and checked
by Engineer appointed by RMC or through agency so appointed and the same should be
monthly approved by departmental head RMC.
At the end of the Project period, the bidder will leave the site along with all his equipment’s and
facilities used and handover the clean area without claiming any compensation of whatever
nature. Bidder has to completely remove the plant, machineries and equipment from the site
and clear the project area and shall be handed over to RMC.
Completion and Exit
At the end of the concession period, the bidder will leave the site along with all his equipment’s
and facilities used and handover the clean and reclaimed area without claiming any
compensation of whatever nature.
Methodology to be Adopted
The Bidder should ensure regulated and continuous removal of waste from dump site /landfill
with utmost safety and under standard hygienic conditions.
The waste removed from the dump sites is to be safely transferred to the treatment facility
erected at the site. The Bidder will prepare a layout clearly showing the area required for
treatment of the garbage along with all inductivities.
The Bidder should provide the treatment plant with necessary infrastructure like security and
access control/s, camera monitoring and recording features etc.
A separate first aid facility will be provided at the treatment plant within 100 mts.of the
treatment facility.

proposal submitted to RMC for approval.
o The Bidder will ensure that the land will be cleared to the natural ground level. If any
waste is found below the ground level, the Bidder at his discretion can accept to go
ahead with the PROCESSING upon mutual consent.
o The plan proposed should be comprehensive in terms of providing a source to end
o The Bidders shall follow the methodology of the legacy waste processing as per CPCB
guidelines published in Feb 2019 or any other amendments.
Weighing System
The Bidder shall establish a 2 Nos. of digital weighbridge system with a minimum weighing
capacity of 1 Nos. 100 tonnes and 1 Nos. of 50 tonnes. The system must receive prior approval
from the Rajkot Municipal Corporation (RMC) for the accurate measurement of legacy waste to
be processed, as well as for the disposal of byproducts.
The weighbridge system must comply with the following conditions:
Capacity and Accuracy
o Must support minimum weighing capacity of 1 Nos. 100 tonnes and 1 Nos. of 50 tonnes.
o Accuracy must comply with the standards specified under the Legal Metrology Act,
o Regular calibration must be conducted by an authorized agency and documented.
Digital Integration
o The system shall be fully digital with the ability to generate and store electronic
weighment records.
o Capable of real-time RMC’s monitoring systems.
o Data server must be stored/placed within RMC premise.
Certification and Approvals
o The weighbridge must be certified by the Department of Legal Metrology.
o Prior written approval for installation and operation must be obtained from RMC.
Reporting and Data Management
o Automatic generation of weighment slips, including vehicle number, date, time, gross
weight, tare weight, and net weight.
o Daily weight reports must be submitted to RMC in prescribed digital format in realtime.
Surveillance and Security
o Installation of CCTV cameras to monitor weighing activity.
o Video footage must be stored for at least 30 days and made accessible to RMC upon
o CCTV recordings of Operation of weighing system shall be provided as and when
required by the RMC officials and other authorized Bidders / individuals
o Provision of uninterrupted power supply through backup systems such as inverters
Operational Readiness
o The weighbridge should be operational during working hours or as directed by RMC.
o Must include trained personnel to operate the system and handle data entry.
Environmental and Site Compliance
o Installation should not obstruct traffic or drainage.
o Dust suppression and proper signage must be in place around the weighbridge area.
Location and Installation
o The location of the weighbridge must be approved by RMC.
o Proper access must be provided for entry and exit of vehicles.
The Bidder must get the approval from RMC for utilizing the existing weigh bridge for the
purpose of the WASTE weight measurement.
The Bidder shall ensure that the weighing system shall be made fully online, electronic wherein
the data of weighment system shall me maintained properly for the entire contract period with
backup server facility and shall be provided as and when required by RMC official and other
authorized Bidders / individuals
All the data acquisition of weighing system comprising weight of WASTE to be processed shall
be done online on website in public domain in view of the transparency of project operations.
Dedicated connectivity for both RMC users and citizens shall be provided by the Bidder.
Any malfunctioning in operation of weighing system will be responsibility of the Bidder
In case of any malfunctioning / technical problem in the functioning of weighing system, the
same shall be rectified by the Bidder within the period of 24 hrs. During this period of failure,
weighing of WASTE shall be carried out at private weighbridge located outside which should be
approved by RMC at Bidder’s cost and no additional charges shall be paid by RMC.
Drawings and Documents
The successful bidder shall submit the drawing layouts.
Leachate Mangement
The Bidder shall adopt comprehensive measures and implement effective processes to ensure
proper control and management of leachate generated within the project area.
The leachate generated from the windrows shall be systematically collected through
appropriate drainage or collection systems. The collected leachate shall undergo primary
treatment to remove suspended solids and reduce organic load. Following treatment, the
leachate shall be transported and safely disposed of at an authorized Sewage Treatment Plant
(STP), in full compliance with applicable environmental norms and regulatory requirements.
Under no circumstances shall the Bidder spray leachate over the windrows, as this may
adversely impact the composting process and environmental quality.
Environmental Standards
Bidder has to follow the Environmental Standards as mentioned below
o Air Quality Monitoring: As per Solid Waste Management Rules 2026 (SWM Rules 2026)
or amendments thereafter with respect to baseline site parameters.
o Noise Monitoring – As per Noise Pollution Rules 2000 or amendments thereafter with
respect to baseline site parameters.
o Leachate Management — As per Solid Waste Management Rules 2026 (SWM Rules
2026) or amendments thereafter with respect to baseline site parameters
o Leachate Treatment – As per Solid Waste Management Rules 2026 (SWM Rules 2026) or
amendments thereafter with respect to baseline site parameters.
o Odour Monitoring – As per CPCB guidelines ‘Odour Pollution & Its Control May 2008’ or
amendments thereafter with respect to baseline site parameters.
o Water Quality Monitoring - As per Solid Waste Management Rules 2026 (SWM Rules
2026) or amendments thereafter with respect to baseline site parameters.
o Aggregate Disposal- As per Solid Waste Management Rules 2026 (SWM Rules 2026) or
amendments thereafter with respect to baseline site parameters.
o PROCESSING of MUNICIPAL SOLID WASTE – As per CPCB Guidelines for Disposal of
MUNICIPAL SOLID WASTE.

Bidder has to make all the necessary arrangement for monitoring of environmental standards to
the extent possible Bidder may appoint a Professional Consultant/ Company approved by MoEF
/ NABET to achieve these standards.
Bidder must submit the lab results monitoring all the aspects such as properties of soil, air,
ground water, noise, leachate, RDF, etc. every month.
The Bidder has to obtain all the required permissions/ NOCs from various authorities like GPCB,
in order to operate the plant and process the WASTE at Rajkot Landfill and all other necessary
approval, licenses, permission etc. from concern statuary authority.
Hazardous Waste , E-waste
The Bidder will segregate any Hazardous waste, E-waste [as defined in Hazardous Waste
(Management, Handling and Trans-boundary Movement) Rules, 2008] if existing inside the site
and separately earmarked. Successful Bidder shall dispose of the same at GPCB’s approved sites
in accordance with Hazardous Waste (Management, Handling and Trans-boundary Movement)
Rules, 2008 or amendments thereafter.
Performance security of the Bidder will be released only after the entire project site has been
inspected by RMC officials and handed over to RMC without encumbrances.
Bidder must install necessary fire safety equipment, machineries and obtain fire safety approval
from RMC fire department.
It is the sole responsibility of the operator to abate the odour and fire nuisance on site. Operator
has to use all such materials & technology which are prescribed to prevent bad odour, flies &fire
nuisance. Necessary fire fighting vehicles shall be arranged to abate the fire nuisance. However,
in case of major fire incidence, RMC may assist by providing fire fighting vehicles according to
availability at that time. Necessary safety gears shall be provided by the operator to all staff
working as per the good industry practice.
Bidder shall ensure that material which is to be transported for disposal after scientific
processing is not dumped at Rajkot Dumping Ground. They can make necessaryarrangement
like fencing or any other suitable arrangement as directed by RMC authorities to prevent such
The Bidder shall incorporate computerized electronic automatic system in the design with
latest technologies for monitoring for the entire process its own cost.
For monitoring and evaluation of progress contractor shall divide entire working area in to
following category:
Plant and processing area
Unprocessed stock area
Recovered material stock area
Entire Windrow area must be divided into working area suitable for safe excavation in
consultation with RMC officials and TPI/PMC staff. Map should be created (.kmz, .kml file) with
each zone number, working schedule shall be prepared. Planning shall be submitted by
contractor for day wise excavation, windrow making, overturning till maturity and
transportation to process area. Daily activity must be carried out as per approved schedule and
geotag photograph must be submitted for zone wise each activity on daily basis. No activity
shall be permitted outside approved zone (working area) as per schedule.
Penalty of Rs.2000/- per instance per day shall be levied if any activity is observed outside
scheduled program/planned zone.
Special Conditions
There will be no lease of land to the Bidder. He will only set up the plant on RMC’s land for
scientifically treating the garbage and operate it without any interest in land whatsoever.
However, RMC will provide necessary assistance to lenders/bankers/financial institutions
funding the project in terms of granting right to entry if there is a need. Such right of entry
however will be restricted to the plant and machinery set up by the Bidder and will under no
circumstances be extended to the land. As specified above, there will be no lease of land to the
Bidder and hence the question of creation of encumbrances on the land does notaries.
The Bidder should familiarize themselves with the site conditions, and also carry out necessary
site visits, surveys, studies / testing, analysis of the existing MSW with due diligence at their
own cost prior to the RFP. Bidder will be allowed to take bores at site to ascertain density at
different levels and to carry out analysis of strata. All the data/information/maps provided in
the RFP are indicative only. Bidder shall not bring any dispute regarding any data provided in
the RFP, variation in quantity and characteristics of MSW as he is expected to do his own
Documentary evidence shall be provided for technical evaluation and all documents & technical
proposal submitted shall be part of contract. The same plan shall be adhered for
implementation. No change in the plan is allowed without the approval of RMC.
The entire site should be under CCTV surveillance. For that, High-Definition IP based cameras in
adequate numbers (as directed by RMC) shall be provided by the Bidder.
The Bidder must take necessary monsoon precautions such as leveling of the road, provision for
removal of the rainwater, stabilization of the heap of the WASTE, safety for electrical panels and
equipment, leachate collection and disposal, workman safety etc. Precaution to be taken during
monsoon for covering inert, soil, RDF etc.
EmergencyResponsePlan
The Service Provider shall develop the Emergency Response Plan “ERP”. This shall be a part of
the Operations Protocol developed by the Service Provider. TheERP shall set out steps to be
taken and measures to be adopted by the
ServiceProviderinrespondingtodealingwithEmergencyincludingthosesituations related to
personal injuries or fatalities, property damage and force majeure asfollows.
In the event of an Emergency, the Service Provider shall immediately carry out
aninspectionoftheareaaffectedbytheEmergency.WhereEmergencyhasnecessitated
closure of the Waste processing facility or part thereof, the ServiceProvider shall
promptly carry out any repair works necessary to restore the wasteprocessing facilities
to safe condition and in any event shall carry out such
worksbeforetheaffectedareaoftheprojectfacilitiesisre-openedtofornormaloperations.
TheServiceProvidershallensurethatsufficientstaff,plant,equipment,andmaterials,includi
ngwithoutlimitationmedicalassistance,areavailabletorespondtoEmergencywithin
reasonableperiod atall timesduringthe OperationsPeriod
Provision for Building Ancillary Facilities
In case Bidder are required to set up ancillary facilities at site like Fuel storage, DG set etc., RMC
may assist the Bidder in getting the same installed at site for period of contract only. However,
the necessary permissions required are to be obtained by Bidder at his cost. All handling of
explosives, including storage, transport shall be carried out under the rules approved by the
“Explosives Department of the Government”.
Mobilization and Construction period and commencement of the project
Bidder shall Supply, Install, Testing, Commissioning and Construct the plant and other allied
facilities and the process shall be completed within 60days from the receipt of LOA/work order.
This will include the mobilization period and time period required for getting
necessarystatutory clearances/permissions. After completion of construction and erection of
the plant, operation of the plant shall commence which will be considered as Commercial
Operation Date (COD) of the project.
Bill Submission
In case of bidder opts to quote for tipping fees, the Bidder has to submit the bill for the work
carried out. Payments shall be processed in within 30 days from the date of submission of
Invoice by the Bidder in accordance with the terms and conditions mentioned in Scope of Work.
Also, the Bidder shall submit the following documents/ details along with each bill raised
towards the payment.
1) Contour survey using drone only every month showing the monthly volumetric reduction of
existing dump. (3D cloud point data shall be submitted with the contour plan, every time Bench
mark established at site must be used as reference )
2) Laboratory test results of each month for Soil, for the Organic Content it should match FCO
standard, RDF shall match CPCB latest guideline. Noise, Air and Leachate shall be tested at the

Project Management Consultant and Third-Party Inspection
This Project is being executed undergoes T.P.I. & P.M.C. Bidders intervention. Bidder shall
comply all the comments, instructions, recommendation, rectification etc. issued by the
supervising T.P.I. &/ P.M.C. without any extra cost; however, the charges of TPI,/PMC shall be
borne by the Rajkot Municipal Corporation. The Bidder shall prepare and submit report of daily
activities in a proforma, which shall be approved by Engineer-in-charge before start of work.
The report shall specifically include details like items executed with respective quantities,
materials received on site, materials consumed, etc. In general, scope of work and details to be
provided in report shall contain all necessary information as required by the Engineer-in-
charge. During execution of work the proforma shall be modified, if desired by the Engineer-in-
charge to accommodate relevant necessary details about daily activities.
Bidder has to compliant in line with all the Safety Guidelines as given below during execution of
1) Bidder shall ensure that his/her workmen do not smoke or chew tobacco within working
2) Bidder shall ensure proper use of all the required PPEs while carrying out jobs.
3) Bidder shall ensure that adequate resources in terms of PPEs and tools-tackles should be
available with his/her workmen.
4) Bidder shall ensure that his/her all Lifting Tools and Tackles are certified by Competent
person (e.g. Chain Blocks, Slings, D- Shackle, Wire Rope, Crain etc.)
5) Bidder shall ensure that all his/her Electrical Appliances like Welding m/c, grinder, Drill m/c,
Breaker etc. are be in good condition with proper industrial plug top with good cable. Bidder
shall not bring any equipment with joint or damaged cable.
6) Bidder shall deploy one dedicated supervisor for the job undertaken by his/her Bidder to
take care of Safety of his/her employees
7) Contractor’s Supervisor shall ensure that the work during night hours and during public
holidays shall be carried out only after issue of required permit by RMC.
8) Bidder shall be equally responsible for his/her workmen’s and others safety as an acceptor of

10) Bidder shall ensure that his/her workmen will start the job only after proper safety

disposed in the drains without permission of site management.
14) While handling with any hazardous waste like spent oil, grease, paint etc. Bidder shall
ensure that disposal of the same is done as per the guidelines of site management.
15) All earthling systems shall be in accordance with IS : 3043-1985 code of practice for ear
16) It is the sole responsibility of the Bidder to abate the Odour and fire nuisance on the site.
The Bidder has to use enzyme/herbal based products which will help to abate the Odour and fly
nuisance. Necessary fire fighting vehicles shall be arranged on the site to abate the fire nuisance.
The Bidder shall make necessary arrangements such as water tanker, fire extinguisher,
firefighting pump on the site to extinguish the fire at their own expense.
17) Safety of the WASTE at the site will be the responsibility of the Bidder. The Bidder will make
sure WASTE and the RDF removed from the WASTE is safe from fire on the site. In case of the
accident on the site, the Bidder will be borne the expenses/ penalty.
