The tenderers are advised to carefully read this tenderDocument in conjunction with Indian Railways Standard GeneralConditions of Contract (Services) - 2018 with latest amendmentsand correction slips before participating in this Tender.

The rates quoted for the relevant supply items of work shallinclude the cost of materials and their accessories. Similarly, forfixing/installation/erection/ Testing and Commissioning item ofwork shall include the cost of labour, together with the cost ofproviding the necessary tools and tackles etc., so as to ensurethat the work carried out forms a complete supply, installation,Testing, commissioning of item work to the satisfaction of theEngineer-in-charge.

The prices quoted shall be net including all taxes and duties etc.

Documents to be Submitted Along with Tender (i)The tenderershall clearly specify whether the tender is submitted on his own(Proprietary Firm) or on behalf of a Partnership Firm / Company /Joint Venture (JV) / Registered Society / Registered Trust / HUFetc. The tenderer(s) shall enclose the attested copies of theconstitution of their concern, and PAN Card details along withtheir tender. (ii)Following documents shall be submitted by thetenderer: (a)Sole Proprietorship Firm: (Note: Mandatory only forwhom it is applicable).

Following documents shall be submitted by the tenderer: if HUF: (i) A copy of notarized affidavit on Stamp Paper declaring thathe who is submitting the tender on behalf of HUF is in theposition of 'Karta' of Hindu Undivided Family (HUF) and he hasthe authority, power and consent given by other members to acton behalf of HUF. (Note: Mandatory only for whom it isapplicable).

Following documents shall be submitted by the tenderer: ifCompany registered under Companies Act2013: (i) The copies ofMOA (Memorandum of Association) / AOA (Articles ofAssociation) of the company (ii) A copy of Certificate ofIncorporation (iii) A copy of Authorization/Power of Attorneyissued by the Company (backed by the resolution of Board ofDirectors) in favour of the individual to sign the tender on behalfof the company and create liability against the company. (Note:Mandatory only for whom it is applicable).

Following documents shall be submitted by the tenderer: if LLP(Limited Liability Partnership): (i) A copy of LLP Agreement (ii) Acopy of Certificate of Incorporation (iii) A copy of Power ofAttorney/Authorization issued by the LLP in favour of theindividual to sign the tender on behalf of the LLP and createliability against the LLP. (iv) An undertaking by all partners ofthe LLP that they are not blacklisted or debarred by Railways orany other Ministry / Department of the Govt. of India fromparticipation in tenders / contracts as on the date of submissionof bids, either in their individual capacity or in any firm/LLP or JVin which they were / are partners/members. concealment /wrong information in regard to above shall make the contractliable for determination under Clause 62 of the Standard GeneralConditions of Contract. (Note: Mandatory only for whom it isapplicable).

The following documents shall be submitted by the partnershipfirm, with the tender: (i) A notarized copy of the PartnershipDeed or a copy of the Partnership deed registered with theRegistrar. (ii) A notarized or registered copy of Power of Attorneyin favour of the individual to tender for the work, sign theagreement etc. and create liability against the firm. (iii) Anundertaking by all partners of the partnership firm that they arenot blacklisted or debarred by Railways or any other Ministry /Department of the Govt. of India from participation in tenders /contracts as on the date of submission of bids, either in theirindividual capacity or in any firm/LLP in which they were / arepartners/members. Any Concealment / wrong information inregard to above shall make the bid ineligible or the contractshall be determined under Clause 62 of the Standard GeneralConditions of Contract. (Note: Mandatory only for whom it isapplicable).

Partnership Deeds, Power Of Attorney Etc.: The tenderer shallclearly specify whether the tender is submitted on his/her ownor on behalf of a partnership concern. If the tender is submittedon behalf of a partnership concern, he/she should upload thecertified copy of partnership deed along with the tender andauthorization to sign the tender documents on behalf ofpartnership firm. The Railway will not be bound by any power ofattorney granted by the tenderer or by changes in thecomposition of the firm made subsequent to the execution of thecontract. It may, however, recognize such power of attorney andchanges after obtaining proper legal advice, the cost of whichwill be chargeable to the contractor. The tenderer whether sole proprietor, a limited company or apartnership firm if they want to act through agent or individualpartner s should submit along with the tender , a power ofattorney duly stamped and authenticated by a Notary Public orby Magistrate in favour of the specific person whetherhe/she/they be partner(s) of the firm or any other personspecifically authorizing him/her/them to submit the tender andother tender related activities till completion of the workincluding signing No Claim Certificate and refer all or anydisputes to arbitration.
