Bidders shall not be under a declaration of ineligibility for corrupt and fraudulent practices issued by Government of Karnataka

Bidders shall ensure upload of relevant document certifying his/her status as Scheduled Caste/ Scheduled Tribe/other reserved category as prescribed in the tender document.

It shall be the responsibility of the Bidder to ensure credit of Tender Processing Fee and EMD into the respective receiving bank accounts of e-Procurement on or before the last date and time of bid submission.

EMD Payments through e-Payment mode shall be made as one single transaction and payments made in part are liable for rejection.

The tenderer should have Satisfactory completion as a prime contractor for at least one similar work to an extent of 50% of the cost of the work i.e. 7.00 Lakhs in the last five years period i.e., from 2019-20 to 2023-24, should be uploaded. Duly giving 10% escalation every year. The necessary work done certificate issued by the concerned Executive Engineer shall be uploaded

Each tenderer in his name should have in the last five years period, achieved in at least two financial year an average annual financial turnover of not less than estimated cost i.e. 14.00 Lakhs from 2019-20 to 2023-24, should be uploaded. Duly giving 10% escalation every year. All document/ certificates issued by a Charted Accountant should have a UDIN (Unique Document Identification Number) generated through the ICAI (The Institude of chartered Accountants of India) Portal. Certificate without UDIN the documents uploaded will be considered and treated as invalid document

Liquid assets and /or availability of credit facilities of not less than 30% of the amount put to tender i.e Rs.4.20 lakhs. (Credit lines/ letter of credit/ Certificates from Banks for meeting the fund requirement etc

Each of the documents uploaded to the e-portal should be self-attested by the contractor or an authorized representative in case of firm /company

Tenderers who meet the above specified minimum qualifying criteria, will only be qualified, if their available tender capacity is more than the total tender value. The available tender capacity will be calculated as under:Assessed available tender capacity equal to (AxNx2.5-B) where. A equal to Maximum value of civil engineering works executed in any one year during the last five years (2019-20 TO 2023-24) (Updated to 2024-25 price level) taking into account the completed as well as works in progress. N equal to Number of years prescribed for completion of the works for which Tenders are invited. B equal to Value, at 2024-25 price level, of existing commitments and on-going works to be completed during the next upto water maintenance period 2024-25 (period of completion of the works for which Tenders are invited)

Within 20 days of the receipt of the letter of acceptance, the successful tenderer shall deliver to the employer security deposit in any of the forms given below for an amount equivalent to 5% of the contract price plus additional security for unbalanced tenders in accordance with clause 25.5 of ITT & Clause 44 of the conditions of contract for all works

The necessary certificates/ documents in support of eligibility criteria fulfilled as stipulated shall be scanned and attached to e-tender document. The original certificates/documents shall be produced on or before stipulated date and time for verification failing to which the bidder will be disqualified from the tender. Scanned signature of bidder/authorized representative of the bidder shall be attached while uploading bid documents

If any of the dates mentioned above happen to be a general holiday, the next working day holds good

The intending bidders are advised to visit the site of work before submission of the tenders

The contractor should take still photos / videos of the work before commencement of works, during execution and after completion compulsorily. These photos/ videos should be made available to the implementing officer, for immediate reference during review of works to enclose it with completion certificate

The bidder at the time of execution of the agreement should give a detailed execution plan and fortnightly program to complete the work in full manner in maintenance period 2024-25 without fail. The program can be modified with mutual consent

The work will be constantly monitored by the Executive Engineer and if there is any slippage in achieving the program/a penalty / liquidated damages as indicated in the agreement / tender document would be levied. However, these liquidated damages will be refunded if the contractor makes good the shortfall in the subsequent months or completes the whole work before the stipulated date of completion

Conditional tenders are liable to be rejected. The officer competent to accept the tender shall have the right to reject any or all the tenders without assigning any reason whatsoever

Corrigendum will be published in web site for all modifications/corrections if any

The intending bidders should note that, if any of lands either in part/parts or whole required for the work is not acquired by the Nigam, it shall be the responsibility of the bidder to take possession of such land and start the work by the consent of the land owners before commencement of work at no extra cost to the Nigam and no claim whatsoever relating to non availability of land would be entertained

The contractor should mention their recent correct postal address and e mail address in the declaration form

Incomplete tender documents will be rejected

All materials like steel, cement etc., required for the above work should be procured by the contractor only at his own cost. And these materials will have to be got tested by the competent authority before put to use

The application made by the firm/company, shall be signed by a person holding the power of attorney, in which case a copy of power of attorney shall be submitted

As per the Karnataka building and other construction workers welfare cess act 1996, 1 percent of the bill amount will be deducted from the bills

Tenders will be opened on the due date in presence of the contractor or their Authorized representatives

Debarment of tenderers: The procurement entity may debar tenderer for a period not exceeding 3 years from participation in its tenders following such procedures as may be prescribed on the ground that tenderer is engaged in corrupt or fraudulent practices in competing or executing the contract including misleading the procuring entity or any stage of procurement activity with a fraudulent intention. ( KTPP Act 26A).

As per GO FD 5 EXP 12/2023 dated 15.05.2023, the contractor shall be abide to provide e Bank Guarantee towards Security Deposits

The payment of bills of this work will be made as and when the letter of credit is received under the same head of account from KNNL/Government of Karnataka

The contractors should adhere to the accepted action plan submitted by him under any circumstances without linking to the pending bill payment of the work

Typo-graphical errors if any will not be the ground for any claims by the Contractor

Tendering by the joint venture will not be allowed

The contractor should furnish the name of the individual /firm with address and Telephone numbers with place of registration, year of incorporation etc

The tender processing charges paid by the bidders are not refundable even if the tenders are cancelled

Royalty on construction materials and other taxes will be deducted as per prevailing Government orders.

Directions and Instruction given regarding MDP in the circular of Department of Mines and Geology dated:07/11/2023 and Govt of Karnataka letter No:WRD 35 PAC 2023 dated 05/06/2024 should be compulsorily followed ( only for concerned works)

The tenderer has to make his own arrangement for procurement of all materials required for the work. There is no departmental supply of materials. Contractor should procure only ISI mark materials and submit necessary quality control certificates from the authorized quality control authority, before execution

Sub leasing of work in any form is prohibited

No quarries are approved by KNNL for materials. The quarries considered are for the estimate purpose only. The intending bidders shall visit the site, identify the quarries, ascertain availability for the quantity and quality of the materials required for the work and shall quote his rates accordingly. No extra claim whatsoever will be entertained in this regard

The rates includes all leads and lifts and work shall be carried out as per the instruction of Engineer-in-charge .All specifications are as per relevant IS codes in vogue and Indian Road Congress. The rates for the specification in the Schedule B includes all lead and lifts irrespective of the distance and height, no extra claim will be entertained for additional lead and lifts

The validity period of EMD shall be for a minimum period of 225 days from the date of opening of the tenders

The EMD of the unsuccessful bidder will be refunded only after the acceptance of the tender by the competent authority as per tender clause

The tender inviting authority has got right either accepting tender or rejecting the tender without assigning any reasons

In case of death of contractor after executing the agreement commencement of the work , his legal heir if any eligible registered contractor and willing can execute and complete the work at the accepted tender rates irrespective of the cost of the work

EMD amount and Amount put to tender will be as mentioned in the e-portal of respective work
