(1) I/We engage to supply the Western Railway with the articles specified above upon the terms of the Indian Railway Standard Conditions of Contract (latest revision) and upon the terms of the Revised Special Conditions and Instructions for the Guidance of the Contractors issued by the Western Railway (Instructions to tenderers & General Condition of Contract revised on September 2021 version 2021/1) available at IREPS portal at link www.ireps.gov.in/ireps/upload/repository/railway/483/148/public/TenderConditionsVersion2021- 1.pdf. 2) Following will be considered for order:- A) OEM/Manufacturer of Portable Smoke Extractor with satisfactory past performance as detailed in Para 2 [C] below along with undertaking as detailed at Para [D] below. B) Authorized dealer of such OEM/ Manufacturer of Portable Smoke Extractor with tender specific authorization of OEM/Manufacturer having past performance as detailed in Para 2[C] below along with undertaking as detailed at Para 2[D] below. Offers from authorized dealer of OEM/Manufacturer without tender specific authorization will be summarily rejected. C) The bidder (OEM / authorized dealer) shall submit documentary evidence of successful commissioning of the tendered machine/item, along with Purchase Order (PO) references and a performance certificate certifying satisfactory working of such machine for the last two (02) years, issued by a Gazetted Officer. Offers without the above documentary proof shall be summarily rejected. D) The bidder shall submit an undertaking certificate confirming the availability of spares for the tendered machine/item for a minimum period of ten (10) years from the date of supply.The offer without such undertaking will be summarily rejected.

(1) Risk Purchase clauses shall not be applicable.(2) VALIDITY : Tenderers to quote minimum 90 days validity of offers.(3) LD for late supply : Recoveries of liquidated damages shall be levied @ 1/2 % (Half percent) of the price of the store per week or part of week during which delivery is accepted. The upper limit for recovery of LD in supply contract shall be 10 % of the value of contract irrespective of delays, unless otherwise specifically provided in the contract.

Statutory Variation Clause

Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/ contractor.

Standard Governing Conditions

IRS Conditions of Contract: The contract shall be governed by latest version (along with all correction slips) of IRS conditions of contract, and all other terms and conditions incorporated in the tender documents.
