1) The bidder shall submit all the relavant documents as per below mentioned clauses, otherwise offer will be summarily rejected without any back reference. 2) Any deviation quoted by bidder in any uploaded document or else where in any tab other than the deviation tab while submitting the bid will liable to ignored.
Quality Certification: The bidder must submit valid ISO/BIS/CE/US-FDA or equivalent certificate along with the bid.
Order shall be placed only on the bidders who have supplied COMBINED POSTERIOR VIRECTOMY WITH ENDOLASER machine during last 10(ten) years from the date of closing of tender to any Central Government Organization/State Government Organization/Public Sector Undertaking /Railway Hospital/Government Hospital/AIIMS/Institute of National Importance. Bidders must mandatorily upload the copy of 'Purchase Order / Contract Order' as proof.
In addition to uploading the 'Purchase Order/Contract Order' copy in above clause, bidders must also submit proof of successful execution of the same order such as Installation & Commissioning Report / Consignee Receipt and Acceptance Certificate (CRAC) / Receipt Note or any other document, as evidence of successful supply.
Performance Certificate: Out of the successful supplies submitted under above clauses, the bidder shall submit a performance certificate, as per Annexure-A1 attached with tender, of at least one (01) machine that has been in satisfactory operation for a minimum period of one year from the date of commissioning. The performance certificate shall not be more than three (03) year old as on the tender closing date issued by the actual end user of the machine.
1) Bidders shall provide para- wise/clause-wise compliance by submitting OEM brochures/pamphlets of the quoted equipment, clearly indicating the model number and demonstrating compliance with the main parameters of the technical specifications(if attached). 2) If all the parameters mentioned in technical specifications is not present in the brochure/pamphlets, the bidders shall furnish a self- certification confirming compliance for remaining parameters.
Authorised Agent: 1) Either OEM should quote directly or OEM can authorize and give Tender Specific Authorization to its Agent / dealer to quote on their behalf. 2) The authorized dealer should submit valid tender specific authorization, along with the offer, otherwise offer will be summarily rejected without any back reference.
Service Centre Requirement: a) The OEM must have a fully operational service centre located in the State of Maharashtra. The service centre should be capable of providing prompt maintenance services, repair services, technical support. Official address of the service centre and contact details (email, phone) to be attached with bid. b) At least one dedicated service engineer stationed in the Mumbai Metropolitan Region for emergency support and maintenance. Proof of stationing or self certification by bidder to be given.
The OEM should have market presence of at least 5 years from the tender closing date. The bidder should mandatorily upload supporting documents or self- certification for market presence of the OEM.

EARNEST MONEY DEPOSIT (EMD): As per Clause 0500 of the INSTRUCTIONS TO TENDERERS FOR ELECTRONIC TENDERS AND GENERAL CONDITIONS OF TENDER Indigenous Purchases Version-14 of June 2024 or latest with all corrigendums and amendments, if any, issued before the tender closing.
PRE BID MEETING: Pre Bid meeting will be done within 10 working day of publishing the tender with prospective bidders, JRH and Stores representative at PCMM Office, 4th Floor, Station Bldg,Headquarter, Western Railway, Mumbai-400020.
LIQUIDATED DAMAGE: As per clause 1104 of INSTRUCTIONS TO TENDERERS FOR ELECTRONIC TENDERS AND GENERAL CONDITIONS OF TENDER Indigenous Purchases Version-14 of June 2024 or latest with all corrigendums and amendments, if any, issued before the tender closing.
MAKE IN INDIA POLICY: As per clause 1800 of INSTRUCTIONS TO TENDERERS FOR ELECTRONIC TENDERS AND GENERAL CONDITIONS OF TENDER Indigenous Purchases Version-14 of June 2024 or latest with all corrigendums and amendments, if any, issued before the tender closing.
HSN Code: The bidders should quote the applicable HSN codes and it is the responsibility of the tenderer to quote the correct HSN code and upload the document.
Please enter the percentage of local content in the material being offered. Please enter 0 for fully imported items, and 100 for fully indigenous items. The definition and calculation of local content shall be in accordance with the Make in India policy as incorporated in the tender conditions.
Inspection by TPI Agency: Firm to quote place of inspection clearly in their offer to enable this office to incorporate it in PO.
Demonstration of Items/Machine: Succesfull bidder has to give demostration after placement of PO to consignee mentioned in purchase order.
Standard Force Majeure Clause will be applicable.
Offers from different tenderers submitted from the same IP address in a tender shall be treated as suspected cartel and all such offers received from the same IP address will be summarily rejected. However offers resulting in same IP address due to administrative reason like technical/networking issue at CRIS server shall not be treated as suspected cartel and the decision of the Railway administration will be binding on all tenderers.
PACKING AND MARKING: Bidders are advised to ensure that materials are invariably stamped with manufacturer's name, month and year of manufacturing & expiry date as may be for their product.
DELIVERY CONDITIONS: 1) The Firm shall submit the General Arrangement, Foundation, and related drawings of the machine to the Consignee for approval by the designated approving officer, prior to commencement of manufacturing/supply. 2) The Supplier shall deliver the machine as per the Delivery Schedule (if attached) and shall dispatch it only after ensuring that the foundation is ready for installation and commissioning upon arrival. 3) The Supplier shall be responsible for transportation and unloading of the equipment on receipt, as well as its movement to the site of installation, including arrangement of road mobile crane, forklift, and other required handling equipment. 4) In case of road delivery, the date of receipt of the machine at the Consignee's destination shall be treated as the actual delivery date, irrespective of the F.O.R./F.O.T. conditions mentioned elsewhere in the contract/tender.
PERFORMANCE BANK GUARANTEE: As per clause 0606(ii) of INSTRUCTIONS TO TENDERERS FOR ELECTRONIC TENDERS AND GENERAL CONDITIONS OF TENDER Indigenous Purchases Version-14 of June 2024 or latest with all corrigendums and amendments, if any, issued before the tender closing.
EVALUATION CRITERIA: The inter-se-position of all offers received will be decided on total value of tender quoted by the firm.
GST COMPLIANCE: As per clause 0906 of INSTRUCTIONS TO TENDERERS FOR ELECTRONIC TENDERS AND GENERAL CONDITIONS OF TENDER Indigenous Purchases Version-14 of June 2024 or latest with all corrigendums and amendments, if any, issued before the tender closing.
PAYMENT MODE: As per clause 2900 of INSTRUCTIONS TO TENDERERS FOR ELECTRONIC TENDERS AND GENERAL CONDITIONS OF TENDER Indigenous Purchases Version-14 of June 2024 or latest with all corrigendums and amendments, if any, issued before the tender closing.
MSE POLICY: As per clause 1700 of INSTRUCTIONS TO TENDERERS FOR ELECTRONIC TENDERS AND GENERAL CONDITIONS OF TENDER Indigenous Purchases Version-14 of June 2024 or latest with all corrigendums and amendments, if any, issued before the tender closing.
WARRANTY / GUARANTEE FOR MEDICAL M&P: (1) As per Warranty Clause in the Technical Specifications and Clause 3909 of the INSTRUCTIONS TO TENDERERS FOR ELECTRONIC TENDERS AND GENERAL CONDITIONS OF TENDER Indigenous Purchases Version-14 of June 2024 or latest with all corrigendums and amendments, if any, issued before the tender closing date. In the event of any conflict, Clause of the Technical Specifications(except no. of warranty months) shall prevail. (2) Warranty clause is also applicable for spare parts / assemblies. (3) Maximum Downtime during the warranty period shall not exceed 2% on a quarterly basis (i.e., two days downtime allowed per 100 working days). - Penalty Structure: - 0.5% per week (or part thereof) of the contract value will be levied for delay in response time or rectification beyond the specified time. - Maximum penalty: 5% of the contract value over the entire warranty period. - If delays persist beyond this limit, the purchaser shall be entitled to encash the Warranty Bank Guarantee (BG). - Such poor performance shall be recorded and circulated across all Zonal Railways, and future tenders will duly consider this record. (4) For medical equipment, breakdowns must be attended within 48 hours of written intimation by the consignee (Maximum Response Time). No breakdown shall exceed three consecutive days (Maximum Downtime). If the equipment is not restored within this period, the contractor must provide a standby unit. (5) For the time by which the machine remains non-operational during the warranty period, penalty shall be applicable and the warranty period shall be extended by the same duration. The Warranty Bank Guarantee shall be returned upon the completion of the extended warranty period for the entire machine.
SECURITY DEPOSIT (SD): As per clause 0600 of INSTRUCTIONS TO TENDERERS FOR ELECTRONIC TENDERS AND GENERAL CONDITIONS OF TENDER Indigenous Purchases Version-14 of June 2024 or latest with all corrigendums and amendments, if any, issued before the tender closing.
LAND BORDER CONDITIONS: A bidder from a country which shares a land border with India will be eligible to bid only if the bidder is registered with Competent Authority as specified in Para 1810 and Annexure-7 of Western Railway Bid Document (Indigenous Purchases), Version -14 of June 2024. 1. "I have read the clause regarding restrictions on procurement from a bidder of a country which shares a land border with India; I certify that this bidder is not from such a country or, if from such a country, has been registered with the Competent Authority. I hereby certify that this bidder fulfills all requirements in this regard and is eligible to be considered. (Where applicable the evidence of valid registration by the Competent Authority shall be attached.)" 2. I certify that this bidder does not have any TOT arrangement requiring registration with the competent authority."
